Appeared before us, the undersigned commissioners from the Honorable and Worshipful Council of Justice of this aforesaid government, Ian Obbens, who, having this preceding declaration of his read out to him clearly and distinctly word for word, declared that he continues to persist by it, desiring that nothing more shall be added thereto or taken therefrom, and therefore, in confirmation of the truth thereof, spoke the solemn words: So truly help me God Almighty. Appeared before me, Ryno Johannes van der Riet, sworn clerk at the Secretariat of Justice of the Castle of Good Hope, in the presence of the after-mentioned witnesses, the ordinary seaman Anthoni van Eps, of competent age, who was appointed to the ship Oud Haarlem but remained here due to indisposition, who, at the requisition of Lieutenant Arnoldus Casteleijn de Keulenaar and Second Lieutenant Johannes Cornelis de Buissonje, who also served on the said vessel, declared it to be true: That at the beginning of the voyage, a difference had already arisen between the captain of the said vessel, named Cornelis Haringman, and the requisitioners herein, concerning a certain black woman named Rachel who was on board as a passenger, who, despite all friendly solicitations, was placed above the requisitioners at the table by the captain; that these disputes were of such consequence that the captain, with his bosom friends, being the junior merchant, captain-lieutenant, and doctor, continually harassed the requisitioners and did everything, as the deponent, who was constantly on the quarterdeck, daily witnessed, to make life on board unpleasant for them. That, besides various trifles that occurred daily and served as proof of the hatred the captain harbored toward the requisitioners, the deponent was also present at the table more than once when the requisitioners, who, because they had had the dog watch, being from twelve to four o'clock, had gone to sleep in the morning and therefore requested that the steward provide them with something to eat, nevertheless had to endure a continuous and absolute refusal from the captain, notwithstanding that the captain also daily, whenever the said black woman merely desired to eat in her cabin, sent her the required food, and indeed the finest from the table; it having also happened that the second requisitioner, sitting at the table himself, solicited some food for his mate, the first requisitioner, who was lying asleep as before, which the captain also directly refused and rejected. That the deponent was furthermore present at what occurred on the night of 7 October last, when the requisitioners, though admittedly a little drunk, were yet not in such a state that they could be judged unfit for their duty; the requisitioners having then repeatedly requested the captain to hand over the watch, without, however, having received any answer other than: I do not want to give up the watch; while the deponent furthermore heard no other expression of any kind that night, except only that the first requisitioner reproached the captain that he acted arbitrarily with the provisions, and shortened the requisitioners, along with those on whom he did not look favorably, in their share. That the deponent, moreover, has otherwise never seen the requisitioners drunk, except on that single occasion, and has always seen them very diligent in their duty. While, however, the captain was drunk more than once, and especially when, as happened daily, he made up a card party with the said junior merchant, captain-lieutenant, and doctor often until 12, 1 to 2 o'clock at night, and also presented himself at night several times in that condition during the deponent's and requisitioners' watch. The deponent further declares that the boatswain, boatswain's mate, and sailmaker on board, being also quite drunk, did not hesitate, besides making a tremendous racket, to attack each other in public with a knife and to hit holes in the head with a bottle, without, as far as the deponent knows, any punishment corresponding to the nature of these actions having followed. Declaring nothing more, the deponent gives as reasons of knowledge as in the text, being prepared always to confirm the foregoing by solemn oath. No. 14. of this government, the aforementioned Anthonij van Eps, who, this his preceding declaration having been read aloud to him clearly and distinctly, word for word, declared that he persisted therein, desiring that nothing more shall be added thereto or removed therefrom, and therefore spoke in confirmation of the truth thereof the solemn words, so truly help me God Almighty. Appeared before me, Ryno Johannes van der Riet, sworn clerk at the Secretariat of Justice of the Castle of Good Hope, in the presence of the following named witnesses: Jan Willem Rijlestom, gunner's mate, Hendrik Hendriks Postma, Pieter Valk, Hendrik Hamber, Jan Vergeest, Jan Maurits Kraa, Hendrik Krauter and Matthijs Verkerk, sailors, all posted in aforementioned capacities on the ship Oud Haarlem, yet remained here due to indisposition, and of competent age, who, at the requisition of Lieutenant Arnoldus Castelijn de Keulenaar and Sous-Lieutenant Johannes Cornelis de Bussonje, also having served on the aforementioned vessel, declared it to be true and truthful: That they, the appearers, are of the opinion that the disagreements which have taken place on board between the Captain and some other officers with the requirants must largely be attributed to the extraordinary vigilance which the requirants displayed during the voyage to stand up for the rations and necessities of the crew, in which they were shortchanged by the Captain. The appearers have also, ever since the requirants stepped into the breach for that matter, which occurred already in the beginning of the voyage, seen that the requirants were persecuted in every respect by the Captain, junior merchant, first lieutenant, and doctor, notwithstanding that the requirants performed their duty just as well and amply as well as the other officers, very faithfully and zealously, and behaved towards everyone on board, from the highest to the lowest, as befits every honorable officer; by which conduct the appearers unanimously declare that the requirants have in all respects merited the love and esteem of all the crew. Just as the appearers further declare never to have seen the requirants drunk, but certainly and very often Lieutenant van Rakom and Sous-Lieutenant Vlieger, and likewise the boatswain, boatswain's mate, and sailmaker, who did not shrink from drawing the knife and bashing holes in heads with bottles, without the appearers knowing, however, that any the slightest correction followed upon that. Declaring nothing more, the appearers give as their reasons of knowledge as in the text, being ready to further confirm the same under oath at all times if it be required. or children of petty officers are wronged, being solely caused by the fact that the captain of the said vessel, the valiant Cornelis Haringsman, maintained poor leadership and discipline, and together with his captain-lieutenant and ship's doctors improperly favored certain chosen darlings of theirs, whereby the latter did not hesitate to disparage and mock two of the officers and lord it over them. In such manner that the deponent, while the said vessel was still lying at the roadstead of Rammekens, was ordered by his gunner's mate, Paulus Hendrik Viema, to show his mess account. Just as the deponent showed not only the account but also a letter to the captain-lieutenant, the said gunner's mate presumed to say that they were with the crew and that the captain-lieutenant had given orders to take oversight over the mess goods, just as the same throughout the entire voyage lorded it not only over the mess goods, but over everything situated in the gunner's cabin, and acted according to his own whim, without the deponent having any say. And going even further, he did not hesitate to reproach the deponent that he had been whipped and branded, which the deponent took most seriously to heart, reporting it several times to his superiors and requesting to be maintained in his authority, but he could never obtain this, but on the contrary the said deponent had to vacate his cabin and leave the entire management to his gunner's mate. Furthermore, it happened that the steward was ordered by the said superiors to enter into his consumption book that which had never been issued, wherefore the deponent refused up to two or three times to sign the said consumption book. However, because the boatswain and boatswain's mate had signed it, he, the deponent, was also forced to sign the same, from which the proverb arose on board: A signed consumption book by a drunken boatswain, a boatswain's mate who cannot write, and a coerced and distressed gunner. The deponent could explain still more about how he was coerced by the withholding of his powder account, but since a further accountability concerning that will have to come, when one will further demonstrate from that same book the entries that he was coerced to put against the truth. Declaring finally that the requisitioners, before they were placed under arrest, always performed their duty properly and, both before and after the arrest, always conducted themselves properly, but that disputes did occasionally arise over the distribution of rations and over the contempt shown to them by their said superior. The deponent declares the foregoing to be the pure truth, offering, as reasons for his knowledge are in the text, to confirm the same under solemn oath if required. Number 16. Right Honorable President, Honorable Sirs. The undersigned, Arnoldus Castelijn de Keulenaar and Johannes Cornelis Buissonje, show with the required respect in the most humble manner how the petitioner, upon the report of the captain stationed on the East India Company ship Oud Haarlem, was summoned by the Fiscal pro interim, G. E., as Officer of Justice, fourteen days ago today before your Honors, to hear such demand and conclusion as the Officer of Justice serving on that day would take. The petitioners having appeared and the said demand submitted by the Officer of Justice having been read out, they found themselves unable to answer immediately to all that was charged against them, and requested of your Honors a copy and a term of 14 days in order to be allowed to serve their answer in writing, which was favorably granted to the petitioners by your Honors, for which the petitioners dutifully express their thanks to your Honors. The petitioners, according to their last recorded order, ought to serve their answer today, but have found that to the said submitted demand of the Officer of Justice, the claimant, some declarations were annexed that directly contradict the truth, whereby the petitioners find themselves in the highest necessity to obtain counter-declarations against the same from some persons who remained here from the said vessel, just as they have already obtained from the ship's minister and commander. However, their manifold occupations caused by this incident in order to get their goods off the said vessel have rendered them unable to produce the further proofs as yet, and thus they are unable to serve their answer today with the proper proofs. Reasons why the petitioners turn to your Honors, humbly requesting that it may please your Honors to grant the petitioners, without further delay, a term and postponement for the period of another fourteen days. Appeared before the Honorable Worshipful Council of Justice of this government, Rijno Iohannes van der Riet, sworn clerk at the aforementioned Secretariat of Justice, as qualified in office by the High Authority of these lands to attend to the affairs of the landdrost of Graaff Rainet, Maurits Herman otto woeke, prosecutor ratione officii, on the one part, upon and against the burgher Andries Burgert, defendant, on the other part. 1. And this prosecutor ratione officii states briefly, 2. that from the recollected and sworn statements annexed hereto, 3. it appears most clearly that the defendant has made himself guilty 4. of dereliction of duty on account of a slave captured by him along the way, 5. and when he went missing, without a proper search in the field, notwithstanding the incoming report that the youth had been found dead in the field just beside the road, had left him lying there, 6. whereby on the following day that corpse was devoured by wild beasts, 7. and nothing was to be found but the remains of the skeleton alone, 8. so that one could not discover whether that youth came to die from the wounds received, or rather from cold and discomfort, 9. thus the defendant in the first place made himself guilty of the presumptive mistreatment of a slave, 10. and then in the second place of dereliction of duty to have that youth properly examined by inquest, or to have him tracked down in the beginning. 11. And if one would wish to reason by consequence on this subject, 12. with the greatest right the consideration might arise here 13. that the defendant must have been well convinced that the youth remained absent, 14. that this had its origin in the extreme mistreatment, 15. because he had no search made, 16. which the outcome further confirmed, 17. since the defendant made no timely inquest when the corpse was found, 18. in order thereby to conceal the mistreatment that would be detected on the body upon search; 19. yet, where nowhere in the evidence is the defendant's intention to kill that youth, 20. and where mostly the judge, in deciding, reflects upon this, 21. found, and in him only an excess in the moderation of chastisement can be proven, 22. on account of the unwillingness shown by that youth to come along, 23. and not properly investigating where that youth remained or later the corpse was found, 24. from which alone the guilt or the proximate cause of the death or the missing of that body 25. must be imputed to him, the defendant; 26. thus it also goes without saying, subject to correction, that although under the laws for such an excess committed through guilt, no ordinary, but rather an extraordinary arbitrary penalty is established, the same is always deferred to the judge. 27. From these, your Honours will be most clearly convinced that the principal defendant has not made himself guilty of the slightest neglect of duty, but on the contrary, it is trusted, acted as any right-thinking Christian can and ought to do. Considering in the first place, that by the principal defendant and the deponent on the road from the Vierentwintig Rivieren to the Candebo, on this side of the Wolve Fonteijn, a slave boy was discovered carrying a musket, who was unprovided with any certificate or pass, the principal defendant captured the said boy, disarmed him of his gun, and brought him to the field cornet Johan Adam Raubenheimer; which field cornet refused to keep that boy, under the pretext of not wishing to have such rogues on his farm, but rather left the principal defendant to this danger; the defendant in his said capacity will not enter into an investigation here whether that field cornet properly observed his duty, leaving this to the wise and equitable judgment of your Honours; the principal defendant was thus compelled to take that slave further with him and to expose himself to such a rogue. However, that captive slave opposed going along further and was unwilling to do so, whereby the principal defendant had to use the necessary means of compelling the slave with sjambok strokes, as he gave him some sjambok strokes; but can ill-treatment be presumed from this, much less that the strokes would have caused the death of the said slave, for the field cornet and the deponent Nieuwenhuizen were present there, and they surely would never have consented to ill-treatment; now the question would be, what other means were available here than to compel that captive slave to go along by means of strokes; for the defendant surely had no liberty to let one who was most probably a runaway and provided with a gun go free, and the field cornet did not want such rogues on his farm; that slave had to be compelled by a proper chastisement to go further with them, as indeed happened; the defendant took the said slave along, and close to the principal defendant's farm it was discovered that the said captive slave had run away and stayed behind; at the moment of that discovery it was not possible, because of the darkness of the night, to track him down and look for him immediately, but the next morning the deponent Nieuwenhuijse, with a Hottentot, were sent out by the principal defendant to look for the said slave, in the belief that he had run away again; once more the question here must be, could the principal defendant have done otherwise? been torn apart or devoured, that it was not necessary at that time, can it now in any way be presumed that the principal defendant was any cause thereof, nor can it be imputed to the principal defendant that the inspection did not take place in good time; for, Honorable Sirs, the slave became absent during the night, could he have been searched for directly in the dark, the more so because it was believed that he had deserted again and thus the immediate searching was not omitted out of conviction of ill-treatment as the prosecutor ex officio says from the 13th to the 16th article of his writing, because the principal defendant, completely unaware of any ill-treatment, the following day towards evening the principal defendant was first informed of the death of the said slave, was the approaching night then suitable to perform that inspection, and thus the principal defendant cannot be said to have neglected any time, and therefore not the least presumption can be drawn from this against the principal defendant. That having now asserted all this, that no ill-treatment whatsoever took place in any part, nor is any presumption thereto to be found, as well as no neglect regarding this inspection, since the night was not suitable for it, as all this now falls away, this notable advice or sentence cited by the demand in articles 28 to 31 will not apply at all. For van den Bergh, in his book of advices, volume 4, Consultation 285, speaks of an absolute ill-treatment from which that servant had died, but here the contrary appears, as it will most clearly appear to your Honorable Worships from the evidence produced by the prosecutor ex officio, that here no ill-treatment, indeed not even the least presumption of ill-treatment takes place, as I have reasoned at length herebefore, on the basis of which the defendant's representative rejects the arguments set down by the prosecutor ex officio as sub- and obreptitious, and concludes that the principal defendant shall be absolved by your Honorable Worships from the demand and conclusion made and taken against him by the prosecutor ex officio, with expenses. And since, in the view of the ratione officii prosecutor, in conformity with what was deduced here before, the facts committed by the prisoner and defendant can hereby be held sufficiently justified, 101. the ratione officii prosecutor shall nevertheless briefly proceed to the examination of the proofs that in the present case militate against the prisoner and defendant, 102. in order to be able to conclude therefrom subsequently, 103. whether and to what extent they can operate, 104. to make the prisoner and defendant undergo, on the basis thereof, that punishment, 105. which a manslaughter of that nature and qualification as has been committed here appears to merit according to law. 106. Appeared before me, Mr. Cornelis van Aerssen, Secretary of the Honorable Court of Justice of the Castle of Good Hope, in the presence of the after-mentioned witnesses, the burgher Jacobus Ludovicus du Plessis, of competent age, who, at the requisition of the Merchant and Landdrost of Swellendam, the Honorable Constant van Nult Onkruydt, declared it to be true: That he, the appearer, approximately three years ago now, without however being able to determine the precise time, having ridden with his brother Petrus Johannes du Plessis from his father's place situated on the Gourits River to the cattle post situated 2 hours from there named Het Groote Bosch, in order to see whether, as the appearer's father wished to keep his sheep there for some time, that place was sufficiently provided with water for the watering of the cattle, he, the appearer, then saw a herd of cattle not far from the said place Het Groote Bosch, and upon the instruction of his mentioned brother that he, the appearer, should drive away those cattle, which were close to the land of his father, rode thither, while the appearer's mentioned brother would proceed to the place, look for the water there, and subsequently join the appearer again from the other side. That while the appearer was still busy driving away the said cattle, his, the appearer's, mentioned brother Petrus Johannes du Plessis returned to him, the appearer, and related that he had shot dead a Hottentot belonging to Daniel Pienaar on the place; that the appearer having asked his mentioned brother for what reasons he had done this, received in reply from the same that having encountered the aforesaid Hottentot on the place of his father with the cattle of the mentioned Pienaar grazing on the land of that place, he had first kindly warned the mentioned Hottentot to leave with the cattle, but subsequently, upon the insolent behavior of the said Hottentot—namely, that he did not want to leave because his master had sent him there—he gave him a blow with his sjambok, upon which the mentioned Hottentot immediately attacked him with the knobkerrie he held in his hands and struck at him; and that the first blow of the said Hottentot having missed him, the same (notwithstanding he was also warned to refrain from doing so) nevertheless continued in the utmost rage to strike at him with his kerrie; his horse having jumped aside, he then discharged his gun loaded with birdshot, whereby the said Hottentot was hit in the chest and fell to the ground. delegates from the Honorable Council of Justice of this government, the burgher Christoffel Botha, of competent age, who, at the requisition of the merchant and Landdrost of Zwellendam, Mr. Constant van Nuld Onkruydt, declared to be true: That at the end of the past year 1785, on a certain evening, without however being able to determine which, upon the appearer's herdsmen returning home with the cattle from the pasture, it was related to the appearer that on that day the son of the appearer's neighbor Charles du Plessies, named Pieter Johannes du Plessies, had chased them from the field and said that he wished to speak with their master or the appearer, and that they thus had to tell him, the appearer, to come into the field with his cattle. However, the appearer, being aware of the quarrelsome way of life of the aforementioned Plessies, did not pay attention to it, nor did he go to the same Plessies. That the appearer in the meantime, in the beginning of the month of January, meeting the aforementioned Pieter Johannes du Plessies on the road, asked him in the presence of the burgher Johannes Boshoff for what reason he had sent for the appearer. Appeared before us, the undersigned commissioners from the Honorable Court of Justice aforesaid, the citizen Pieter Johannes du Plessies, who, having had these preceding interrogatories clearly and distinctly read out to him word for word, declared to persist by them, desiring that nothing more be added to or taken from them. The Landdrost of the Colony of Swellendam, Constant van Nuld Onkruyt, prosecutor in his official capacity in a criminal case on the one side, against the citizen Pieter Johannes du Plessies, defendant in person in the aforesaid case on the other side, to hear such criminal demand and conclusion, or request or requests, as the prosecutor in his official capacity shall make and take against him, the defendant in person, to answer thereto, and further to proceed according to law. After which it was submitted by the sworn clerk, Mr. Ryno Johannes van der Riet, as qualified to attend to the affairs of the Landdrost of Swellendam, that whereas it had pleased this Court, on his request made on the last court day—namely that the gentlemen commissioners who were to attend at the interrogation of the citizen Petrus Johannes du Plessies might be authorized, if he should persist at that interrogation in the murder of the Hottentot confessed in open court, to place the same du Plessies in criminal detention—to dispose thereon that their Honors held this request in advisement until such time as a further report regarding that interrogation should have come in, he, the sworn clerk, now producing those interrogatories, therefore reiterated his request made. The Court has thereupon seen fit to resolve to place the mentioned du Plessies in civil arrest until such time as the inquest report shall have come in and the officer shall have submitted a report on what was advanced by the aforesaid du Plessies in his responses regarding the declaration made. While the Honorable President together with Messrs. van Oudtshoorn and Mappa, who were of the opinion that according to the customary manner of proceeding in a criminal case the mentioned Plessies could not be kept other than in criminal detention, have had this vote of theirs recorded. who was grazing the grass in the field adjoining the aforementioned place with his herd of cattle, which provided the arrested person with well-founded reasons to ask the said Hottentot for what reasons he came to graze the grass there at that place, whereupon between them, concerning the lawfulness of the possession of the said place, an exchange of words arose, while in the meantime the petitioner's second son Jacobus Ludovicus had gone to drive that cattle back, and consequently had left them alone there at that place; that at that moment the aforementioned Hottentot, who had repeatedly dared to attack the people namely Jacobus Botha Philip's son and Pieter du Prees, which the petitioner if required would also be able to prove to the satisfaction of the court, also assaulted the petitioner's arrested son and wanted to smash his skull with a stick or kierie he had with him, the latter being leaped upon so suddenly that he was greatly alarmed, and seeing no means to save his life in such a wilderness by flight, in that consternation and confusion of the senses, in order to strike fear into the attacker, fired the gun he had in his hands, and possibly struck the aggressor; that subsequently this incident was directly reported by him to the competent judge, the Merchant and Landdrost at Swellendam, the Lord Constant van Nult Onkruijdt, and he was not summoned for this until 20 March last by writ to appear before this illustrious tribunal; in obedience to which he then also appeared before Your Right Honourable Lordships on the appointed day, when the Officer, plaintiff in his official capacity, had requested and obtained on the roll that the petitioner's aforementioned son should be heard on the aforementioned matter article by article, per verbum credit vel non, with the result that bodily apprehension was thereupon decreed; which makes the petitioner presume that the same, on account of his thoughtless responses given, indeed seems to be burdened with some prejudice; and primarily that, because the laws teach that when manslaughter is established the accused must properly prove the maintained self-defence; which laws, especially in a country for the most part originating from a barbarous nation, are not only not well practicable, but are also subject to various exceptions, as can be soundly deduced from common sense. And to demonstrate this, the petitioner takes the liberty respectfully to remind Your Right Honourable Lordships of the unheard-of murders by that monster of nature, an executed Soera di Poera; if the same had fortunately been struck down or stabbed to death at once by the first person attacked, would not the lives of several worthy inhabitants thereby have been saved? Has not also the so often sad experience, alas, taught all too well how many a worthy inhabitant has been ambushed by such birds of prey and robbed of their cattle and lives, and could one then, in case of self-defence, repeatedly be burdened with the proof, Right Honourable Gentlemen? Surely not! And in the second place, the petitioner presumes, under correction, that these same laws only seem to require such in places where one usually, among civilized nations, has or can have proof at hand, and the dispute takes place between equal parties, which in this case can never with reason be maintained to take place or to hold ground, if Your Right Honourable Lordships would most graciously be pleased to take into serious consideration the place where the petitioner's son was attacked, which will be found to be a far remote wilderness where one rarely has or can have witnesses. And what man would be found, Right Honourable Gentlemen, who, being murderously attacked without reason with a club or kierie in hand and brought into danger of losing his life, at that moment remained fully master of his judgment, much less that he would be able to remember what the laws require in such incidents; yet in order nevertheless to satisfy the aforementioned requisites, the petitioner takes the liberty, with Your Right Honourable Lordships' most gracious permission, most respectfully to inform the same to be true and truthful: that the frequently mentioned Hottentot belongs to that class who are accustomed to assaulting people, just as he dared to seize the abovementioned Botha and the burgher Pieter du Prees, and to strangle the throat of the last-mentioned, and that to such an extent that, were it not that he was relieved by fellow burgher Louis Holtshausen, he would apparently have had to leave his life on the spot, which the petitioner offers to Your Right Honourable Lordships to prove according to the style of the courts if required; wherefore the petitioner trusts, in this respect, to be able and permitted with good foundation to invoke the well-known legal axiom saying: nam semel malus semper praesumitur malus praesertim in eodem genere malitiae, cap. 8, Semel, de Regulis Juris in Sexto; and consequently a strong and violent presumption to prove that the frequently mentioned Hottentot assaulted the petitioner's son. the aforesaid kirri in hand, intending to bash in his brains, was attacked without being able to save himself by flight, considering that it is well enough known to everyone how the aforesaid Hottentots are trained in throwing such clubs and know how to hit people, to which is added that once they have approached people so closely that they have them within the reach of their kirris, there remains for such persons no means of escape without exposing themselves to the extreme danger of losing their lives, as is known to everyone, For which reason the petitioner's son, justly fearing to lose his life in case he attempted to save himself by flight, in this agitation and confusion of senses, by way of self-defense, in order to terrify the said Hottentot who pressed on all the more strongly, discharged a firearm, and possibly struck the same aggressor due to his furious assault. That now, Honorable and Esteemed Gentlemen, the aforesaid deviation, on good grounds, must indeed be considered as a causa seu actus immediatus of the shot fired in the aforesaid agitation and possibly to make the mentioned Hottentot afraid in his rage, is clear, and since his all the stronger pressing upon the petitioner's son, being struck from the front, provides clear proof of his furious aggression, and from this it may be presumed that his, the petitioner's aforementioned son, had no animum dolo malo offendendi, but rather necessarie defendendi, and consequently had no intention of doing evil. For it being beyond legal dispute that everyone is permitted, not only for the defense of his body, but also of his honor, to stab to death the attacker or threatener who approaches with a knife or firearm, as the attacker or threatener is legally understood, by reason of his threats, to have killed himself first, as the jurists on this matter teach concerning aggressors, see Dutch Consultations and Opinions, 2nd, 3rd part, Consultation X, no. 8: 4: Therefore, it will indeed require an object of Your Honorable and Esteemed wise consideration whether in this case the confession made ought not in all fairness and equity to be accepted as a whole, which the petitioner trusts from the equity of Your Honors will in this case be so understood. Since the petitioner's aforementioned son communicated the incident in such good faith directly to the competent judge already mentioned herebefore, and having been summoned for the same before this illustrious court, also appeared in person at the appointed time; whereby, according to law, all bad suspicions that he might be guilty of anything, according to the unanimous opinion of so many accredited legal authorities, come to vanish, see Julius Clarus, l. fin., quaest. 25, num. 24, compared with Mascardus, said Conclusion 819, num. 21. The more so, as it is notorious in law, in case of doubt, a man not being ill-famed for brawling having stabbed another to death, is understood according to the doctrine of the authorities to have done the same by reason of self-defense, see Dutch Consultations, 2nd, 3rd part, Consultation XI, no. 6, page 35, and consequently the same, subject to the correction of Your Honors' more enlightened judgment, is sufficiently proved. And established on that ground, that a homicide, by means of self-defense, through fear and agitation, at least committed without premeditation, consequently, by the ordinaria poena legis Corneliae de sicariis is not only not punishable, but the perpetrator is even acquitted entirely, defense being jure naturalis, as is taught on solid grounds by Carpzovius, Treatise on Capital Crimes, 1st part, Chapter 28, nos. 1, 2, 3, page 203. That the petitioner, knowing his apprehended son on the basis of the adduced grounds not to be guilty of any offense, is therefore compelled to turn to Your Honors with a very humble and submissive request that it may please the same to discharge his said son under oath and sufficient bail, for a sum to be arbitrated by Your Honors, sub poena confessionis et convicti, and subsequently to admit him to appear by attorney in the ordinary manner and plead his case, or if Your Honors should hesitate therein, taking into consideration his so long-lasting detention, to dispose otherwise as Your Honors' well-known prudence and equity shall deem proper. Wherefore and for other reasons and means to be further deduced in due time and place, if necessary, the Officer Prosecutor, making his demand, concluded that by definitive sentence of Your Honorable Worships the prisoners and defendants mentioned in the heading shall be condemned to be taken to the place where criminal sentences are customary to be executed, and there, being delivered to the executioner, to be tied to a post and severely flogged with rods on the bare back, and further to remain banished from this Colony for perpetual days, with condemnation of the prisoners and defendants in the costs and expenses of justice, or to such other penal punishments as Your Honorable Worships in good justice shall deem to belong.
