November: —. —. - - - 173 1/3 February 1733. . . . . . 1. ½. 1 No 10 5774 We the undersigned Elias Wargaren commander and Master of Equipage Hendrik Baak master shipwright together with his master-journeymen Willem de groot and Jan kortlever, all in the service of the Honorable Company, declare jointly hereby upon our conscience and truth to be true and truthful, at the requisition of His High Nobility the Lord Governor-General of the Netherlands Indies Mr. Dirk van Cloon, that we inspected the samples of the purchased native pitch, both the Batavian at 1½ and the Bantenese at 1 rix-dollar the picol, against each other and found the Bantenese outwardly to the eye somewhat better than the Batavian, but both samples having been melted, each separately in a separate pan, the contrary has appeared, that the Batavian is far better of quality and purer than the Bantenese, which having been melted was found not only impure, but also containing a large portion of grit or dirt. All that is written here above we acknowledge to be the upright and pure truth, presenting ourselves therefore if necessary to confirm the same further by oath. Batavia The 14th of December 1734. E:s Wargaren, H=k Baaks was signed: Willem de Groot No 11 3773 To the Commander at Bantam at fortress Speelwijk Julius Valentein Stein van Gollenesse, the Senior Merchant Lambert van Gessel, and Merchant Jacob van Wogneum are hereby delivered in the utmost secrecy, the annexed Extract from a certain secret resolution dated 4th of August last, handed by Their High Nobilities to the undersigned for information and compliance; also an Extract from a certain missive addressed by the undersigned on the date 25th of November to the said Their High Nobilities, and furthermore an Extract from Their High Nobilities' separate missive dated 14th of December, all concerning the present Bantenese Queen Sarefa phatnia, to the end that the undersigned may be assisted in the service of the Company in quite ample terms, with their written advice, regarding the following points, originating from the aforementioned orders of Their High Nobilities, from which these questions result. Firstly, whether the conduct of the cited Queen since the arrival of the undersigned has merited her removal, either from the court of the Sultan, or from Bantam; Secondly, whether that Princess's stay in Bantam can longer be considered advisable for the service of the Company, or the King, the Princes, grandees of the realm, and lesser subjects, or not; Thirdly, whether in this state of time and affairs it could be deemed advisable for the service and interest of the Company, if necessary, to urge and admonish the Sultan in secrecy to dismiss the aforementioned Princess, his only lawful consort, with whom His Highness 5176 His Highness lives in good harmony, without burden or injury to anyone; Fourthly, whether there is any likelihood that could give reason to maintain that the Sultan, either through reason or threats on behalf of the Honorable Company, will allow himself to be persuaded to banish his said consort, either from his court or from Bantam, according to the express desire of the High Indian Government as stated in the above-cited enclosures of this document. Thus, after considering various means to unburden oneself of this thorn and to remain free from the evil consequences—of which one may not unreasonably be apprehensive in view of her malicious manners and cunning, judging by the proofs she has already given of them—it has nonetheless, in view of the present state of affairs and the uncertainty of a good outcome, been judged best and most advisable to proceed covertly in this matter. Accordingly, it is recommended to the Lord Commissioner solely and exclusively to confer with His Highness on a suitable occasion in secrecy, in private, regarding this matter; and not only to make known to him that this government is fully aware of it and in no way satisfied, in view of the previous occurrences that have resulted from it, but also to show that with further indulgence nothing other than a very great contempt for his person and government can be born in the minds of his subjects, giving rise to many inconveniences in the course of affairs; and that his own interest therefore entails looking out for the necessary redress for the preservation of his authority and power, with the ultimate aim of thereby discovering to what extent this will find acceptance with His Highness, and to govern oneself accordingly in the necessity of a further attempt, the more so because at present there seems to be insufficient foundation to make representations of greater weight and emphasis regarding it; and moreover there appears to be a likelihood that, on account of her imperious nature and the interests of others in that court, she will not long maintain her position, but on the contrary occasion will be given to trip her up by means of less danger to the Company, and to strip her of her present power for the sake of tranquility. Was signed: W:t Blom. 5179 Extract from a letter written by the Councillor Extraordinary of the Indies and Commissioner on behalf of the General Dutch Company to the Bantam Court, Wijbrand Blom, to their High Excellencies, dated 25 November last, concerning: The Bantam queen Sarifa patria, concerning whom several strange stories have successively been reported from Speelwijk, which I shall leave as they are, as well as those that were most recently set down among others in a separate letter by Commander van Gollenesse on 8 August last, amounting to this: that ratoe anum, the king's mother, had managed to gain mastery over her son, the present Sultan, to such an extent that the aforementioned would have to abandon his legitimate spouse Sarifa patria; also that this princess had already requested a place of refuge from the Company, etc. And based on all that aforementioned successive writing from Bantam, their High Excellencies' reasoning was recorded in a secret resolution of 4 August last, from which such orders were given to me in mandate regarding the aforementioned Sarifa patria as are known. For that reason, from the beginning of my arrival here, I have not failed to investigate precisely, through secret inquiries, that princess's previous conduct; and from that I have had to understand that she was a woman of a proud and clever spirit, who through this had already abundantly managed to gain mastery over her husband when he was still crown prince. This consisted of her not being well able to tolerate that His Highness's amours with any of his court ladies extended anywhere beyond the person of her, Sarifa Patria, alone; and further that she, through 5780 her intellect and charming manners toward her husband, was capable of obtaining all favors from him for herself and her relations, and in those respects to direct everything to her liking. This has generally led everyone in Bantam to maintain that all good and bad matters that occurred and took place in the last days of the reign of the deceased Sultan had their origin almost entirely from the frequently mentioned princess; at least everything was charged to her account, perhaps indeed and rightly so, though in many respects this may still be greatly doubted for various reasons that will follow; at least it is so understood by me from the findings. For in favor of the truth, from all reports that have come in concerning the aforementioned Her Highness during my presence, and also from my own personal experience, I am bound to testify that I have never yet been able to perceive that, since my aforementioned arrival, she has ever, or at any time, directly or indirectly interfered in the slightest with matters concerning the government. Indeed, apart from the custody of the court treasures and the governance over the furniture, clothing, and kitchen, she has not even interfered with the king's domestic household and the women's quarters any further than by earnestly and amiably admonishing His Highness several times not to extend his newly adopted way of life after his appointment as king—in the case of his numerous amours with the court ladies—so broadly, for the utmost preservation of his health. But Her Highness otherwise seems to bother herself little with it, viewing it as something that is unavoidable by any means on her part, and will surely pass with time. direction, so orderly and quietly, staying clear of all interference, as one could and might expect from any princess of her rank. It has also happened several times during my stay here that she was with her spouse in Speelwijk and attended the secret conferences that were held there by me with the frequently mentioned His Highness, and likewise within the court, yet she never involved herself further in discussions of affairs than that I was welcomed by her upon my first arrival and she commended herself to the protection of Your High Excellencies; likewise, at all further meetings, she never engaged further in discourse than the polite conversations customary everywhere upon arrival and departure, and for the rest spent her time in all gatherings either amid occasional mutual banter arising between myself, her, and her spouse, or by hearing, seeing, and remaining silent. Also, the prince, according to what appears from all circumstances, notwithstanding his aforementioned new amours, still seems by no means to have shed his old love toward her, for in public conversations the outward respect he shows her always wholly prevails over that of all other court ladies, whom I have never seen considered inside or outside the court for anything other than employment in domestic functions, according to the courtly custom of the country. I have therefore, from all those aforementioned findings and the aforementioned present state of affairs at court, deemed it permissible to believe either that people were previously abundantly deceived concerning the aforementioned princess, sometimes on the basis of a collection of street gossip, or that after the death of the previous sultan she must have known how to alter her previous conduct so skillfully over time through her intellect that presently no other reports are heard of her than those, truly, written here, which can and may be considered praiseworthy in a woman of the character of the frequently mentioned Sarifa Fatuma. And therefore, the just grievances in which Your High Excellencies found yourselves from the received reports, according to the aforementioned secret resolution of 4 August, having been removed by her cited present conduct, it appears to me that the attempts regarding the sultan, her husband, recommended to me in that resolution, must necessarily remain suspended, at least as long as the frequently mentioned princess continues in her present good conduct, of which there can hardly be any doubt, as it is something that must maintain her entire welfare and interests, which is also very well understood by her, according to what has appeared clearly to me in this regard from various circumstances. Since on these grounds no confusions or other disadvantageous reservations are to be feared regarding the person of the said princess, I have furthermore maintained that Your High Excellencies might well wish to set your minds at rest in her regard and deem it best that the action requested of me in this matter be kept from discussion with the sultan, in which, as I trust, nothing will have been done contrary to the true intention of Your High Excellencies, who in such cases never have any other aim than solely that Bantam be continuously maintained, under a just government, in a peaceful and tranquil state, for the purpose of obtaining good annual deliveries of pepper to the Company, for which, on the other hand, the prospects henceforth appear much better than they have been for a good number of years during the reign of the deceased sultan, of which time will also gradually provide favorable explanations, according to my thoughts. Third, whether, if necessary in this state of affairs and times, it might be deemed advisable for the service and interest of the Honourable Company to urge and admonish the Sultan in secret to send away the repeatedly mentioned princess, his only lawful consort, with whom His Highness lives in good harmony without encumbrance or detriment to anyone. and Hendrik Haak, and of which co-opted members already the military captain Andries Herfort and the merchant Jacob Roman, having been chosen by Their High Excellencies for other employment, have again been discharged from our Council, just as we shall then further add here that on the 4th of August last, from a delivered extract from Your Noble High Mightinesses' venerated missive of the 31st of October of the past year, the advancement of the Lord Advocate Fiscal Mr. Isaac Van Schinne to Extraordinary Councillor of India, and the reappointment of Mr. Adrianus Bergsma as fiscal was made known to us; pursuant to which, the said Mr. van Schinne, having properly taken his leave, was thanked by us for His Honour's performed services to justice, and the new advocate fiscal, according to custom and after His Honour had duly taken the oath for the standing of the aforesaid office, was also introduced in that capacity and assigned a seat in this Council; whereupon subsequently Their High Excellencies also, by resolution of the 26th of July of this year, on account of the demise of our President, understood, regarding the vacant place thereof, strictly to follow the honoured order of Your Noble High Mightinesses contained in their much respected missive of the first of November of the year 1709, and for that reason to let the senior member of our Council, Mr. Gerardus Gerlag, hold and administer the same ad interim until Your Noble High Mightinesses shall have filled that vacant place again; there now having come to be vacant in our Council, with the aforesaid presidency, five seats, wherefore we, with the pleasure of Your Noble High Mightinesses, inserting our respectful request made to Your Noble High Mightinesses in our aforesaid missive of the 28th of October, wish to hope that it will please Your Noble High Mightinesses to fill the aforesaid vacant places the sooner the better; thus now proceeding again to bring to the knowledge of Your Noble High Mightinesses in a compendious manner that which has occurred among us since our latest writing, we request with submission that Your Noble High Mightinesses will please not take it amiss that, regarding the ordinary course of justice, as well as the criminal cases and the lawsuits concerning the interest of Your Noble High Mightinesses that have been terminated by us since the 9th of October 1733, we obediently refer to such memorandum as we are accustomed to send yearly in that regard to Your Noble High Mightinesses, but that we shall note therefrom, in due time and place, that which we think necessary to be specially presented to Your Noble High Mightinesses. Which memorandum, under number 1, accompanying this, we shall, for order's sake, under number 2, for the perusal of Your Noble High Mightinesses, follow up with an authentic copy, or rather properly the duplicate of our latest most respectful letter of the 30th of March of this year, since it could only be dispatched as a single copy, wherein we had, among other things, undertaken to send with all respect to Your Noble High Mightinesses with the departure of these ships the draft instruction for this Council and the manner of proceeding required by Your Noble High Mightinesses, which for the greater part, according to communication made by the Lord President to this Council beforehand, had already been brought to readiness (though not yet resumed, much less approved, by the other Lords Commissioners), and which also would apparently have had its effect if such had not been prevented by the decease of our President, whereupon Their High Excellencies thought fit to have the aforesaid draft instruction and the seals of justice, which at that time were kept in the custody of the said President, fetched by their secretary, and subsequently the said seals were handed over by His High Excellency the Governor General to the senior member of this Council, Mr. Gerardus Gerlag; the said Their High Excellencies having been pleased to decree a commission from their assembly for the review, correction, and amendment of the aforesaid draft instruction, as has come to our ears indirectly, so that we are unable to fulfill our previously cited promises; but since the said Their High Excellencies are, according to all expectations, to write more fully in that regard to Your Noble High Mightinesses, we shall now, with the gracious approval of Your Noble High Mightinesses, desist therefrom and proceed to the statement of accounts that was exhibited here in Council by our secretary concerning the estate between the executed to death Mr. Petrus Vuijst and his wife Barbara Wilhelma Gerlings, of which mention has been made several times in our previous letters, and about which we now find ourselves obliged to note by this that on the 3rd of July of this year, upon the verbal request of our said secretary, we again spoke with one another for its settlement. this Council, and by which two papers not only the said Lord President, but also the advocate fiscal had maintained that the rapporteurs were by no means authorized to make mention in their report, as well as to maintain contrary to the sentence of this Council, that the legitimate portion from the estate of her father could not be denied to the daughter of the already mentioned Mr. Petrus Vuijst, protesting very expressly against the undertaking thereof, and against everything that might be done or attempted to the contrary, all more fully mentioned in the same writings, and which contention our fellow member Mr.

Mr. Iacob Lakeman also followed on the same day, except however that his Honor added no protest thereto, yet this very opinion being contradicted by the Honorable Helvetius, and a request being made thereupon to have a copy of both matters, as was also done by Mr. Bernard Iacob Della Faille, with a request to have all the papers concerning the aforesaid matter at his residence for resumption, it was then understood by us to grant the request of the last mentioned, except however the commissary report, and, on the contrary, to deny the request of the aforementioned Mr. Willem Vincent Helvetius for the delivery of a copy of the two submitted protests, to whom nevertheless was granted an inspection of the same, and a transcript of the minutes kept in that regard, since which time, on the first of September, a petition was submitted to this Council by the merchant and former fiscal of Ceylon, Ioan De Mauregnault, tending to the effect that the secretary of this Council might be ordered to make good to him (as having, pursuant to the order of the Noble High Government of these lands, conducted investigations in that matter of the frequently mentioned Vuijst and company) not only his competent share from the confiscation, but also an account of earned salaries submitted therewith, and whereas the fellow member of this council, Mr. Iacob Lakeman, was absent at that time, and besides was definitively recused in this matter by the said request, while Mr. Bernard Iacob Della Faille also requested of his own accord to be excused for reasons from giving his advice as a judge in this matter, it was provisionally understood to place the said request, with the attached account, into the hands of the Noble Mr. Isaac Van Schinne to act against it as should be advised, since his Honor, having acted as the principal officer in that matter against Mr. Petrus Vuijst, must therefore also be considered to be an interested party in the confiscation, and against which a written rejoinder was submitted to this council on the 27th of October by the well-mentioned Noble Mr. Van Schinne, we have therefore on the 17th of this month of November, upon his oral request made to that end, granted to the above-named Ioan De Mauregnault an authentic copy of the aforementioned rejoinder, and a period of fourteen days to reply thereto, and on this subject we shall further note here to your Noble High Mightinesses with all respect that on the 16th previously, our presiding member Mr. Gerardus Gerlag submitted here in council a certain extract of a resolution of their High Nobles dated the 3rd of August of this year, whereby their said High Nobles have been pleased to approve that all those who, during the violent proceedings of that unfortunate time on Ceylon, were not only deprived of life, but also suffered in honor, body, and estate, should again be justly indemnified and each of them granted a certain sum of money, as well as to leave it to the judiciary to decide whether the entire amount thereof shall be reimbursed from the entire joint estate of the frequently mentioned Mr. Petrus Vuijst or rather from the confiscated half, the details of all which are to be found in the aforesaid honored resolution, and after the resumption of which we thought fit also to place an extract thereof, so far as it concerned the last-mentioned member, into the hands of the Noble Mr. Isaac van Schinne, to the end that (as he must likewise be noted to be an interested party therein as before) his Honor, if it pleases him, may supply his interests regarding this matter to this Council; through all of which we have therefore found ourselves as yet unable to terminate and settle that matter, and to communicate the final result to your Noble High Mightinesses pursuant to our undertaking contained in our last dispatch, being able nevertheless not to fail to transmit herewith, for the consideration of your Noble High Mightinesses, under numbers 3, 4, 5, 6, and 7, authentic copies of all the cited minutes and writings, from which your Noble High Mightinesses, if it pleases you, will come to perceive the matter more fully in its circumstances than has been set down here above in brief, so as not to be prolix, with the utmost respect. Concerning the dispute between the gentlemen Cornelis Hasselaar and Adriaan Oostwalt, also mentioned in our last dispatched letter, we can presently, to our extreme regret, communicate nothing else to your Noble High Mightinesses than that the advocate fiscal Mr. Isaac Van Schinne, on the 31st of March and the 4th of May of this year, submitted to us various papers and other documents, maintaining therewith that he had complied with the decree of this Council of the 28th of December 1733, but after the resumption of which it being found by us that the well-mentioned advocate fiscal had not yet complied with the first article of the aforesaid decree, we have, by a further order of the 23rd of September of this year, further ordered the advocate fiscal of India, Mr. Adrianus Bergsma, as replacing in office the gentleman extraordinary councillor Mr. Isaac van Schinne, to comply as soon as possible with the aforesaid first article of our decree of the 28th of December aforementioned, so that this council may thereby be enabled to dispose concerning the aforesaid dispute in such manner as should be found to be proper in good justice, just as your Noble High Mightinesses may gather this not only from the aforesaid further order, but also from the two minutes kept in that regard.

Meanwhile, as a continuation of what was reported to Your Right Honorable Excellencies in our last of the 30th of March of this year concerning the seized private goods on the return ship Rijgersbroek, it shall also be noted that the chief surgeon Huijbert Kien, after the time prescribed by the edictal citation had expired and the case was brought to the roll by the water fiscal, reclaimed the chest of linens, after he had already on the 24th of the same month of March presented a petition and thereby requested the release of the said chest, which request, however, instead of ruling upon it, was placed by us into the hands of the water fiscal Leonard Weijer so that he might observe his office and duty regarding it. However, after this case was continued due to the departure of that chief surgeon on a cruise, as well as by his indisposition and decease, and furthermore that on the 29th of September last it was first brought to a state for judgment by his codicillary attorneys, on account of this death, we pronounced such sentence thereabout as Your Right Honorable Excellencies, if it pleases them, will be able to observe from the same recorded under No 3 in the Register, so that we have also, under favorable well-wishing, taken the liberty to send to Your Right Honorable Excellencies, also under the said number 3 in the aforementioned Register, in authentic copy, the sentence pronounced in the case between the advocate fiscal and the Orphan Masters of this city as representing the heirs of Susanna Elisabeth Roselaar, in her lifetime widow of the repatriated, deceased former receiver-general Joachim Guilbaud, which lawsuit, having been brought to a state for judgment on the Claim for Confiscation on the 28th of July of this year, was also terminated thereupon as and in such manner as the aforementioned sentence shall further show, and to which, for the sake of brevity, under favorable approval of Your Right Honorable Excellencies, we shall refer. not only for the persons of the skipper Hendrik De Veth, and two young sailors named Johannes Jacobsz and Johannes Kolderman, but also the sailor Anthonij Van Maltha, who was held in arrest on the ship Noordwijkerhout, which had recently arrived here from the fatherland, on accusation of the frequently cited offense; in military custody, and to place and treat her at the points of the castle in such a manner as is more broadly set down in the contents, which also having been put into effect, we do not doubt that Their High Noble Excellencies will give Your Right Honorable Lordships a fuller account in that regard. Some time prior to this, three extracts were also brought forward by the presiding Member in our Council, Master Gerardus Gerlag, all likewise taken from Your Right Honorable Lordships general missive to Their High Noble Excellencies of 8 September of last year; thus we shall not fail, pursuant to the missive of Your Right Honorable Lordships dated 15 September 1730 and the explanation contained in one of the aforesaid extracts, if necessary to explain ourselves in an advisory report, together with the fiscal, on the point of accusation regarding the private trade, in such a manner as we shall deem to be in accordance with our judicial office and Dutch practice, without prejudice to the evidence and defenses to be brought against it in due course, in which manner we shall also comply to the letter with the desire of Your Right Honorable Lordships to give, at the request of Their High Noble Excellencies as representing sovereignty, an account or notification of our judgments for their reassurance, in such manner as has already taken place repeated times. Meanwhile, on the other hand, also to our great regret, we noted from the aforesaid highly respected extract missive the displeasure of Your Right Honorable Lordships regarding the inspection and convoying of the ships here; whereupon, however, we must respectfully state that it is an impossible matter for us to inspect such vessels as thoroughly after they are fully laden as would truly accord with the intention of Your Right Honorable Lordships, even though it has been introduced as a fixed practice to place upon each return ship, as soon as they begin to load it, until the time that it is convoyed by commissioners along with the water fiscal, two to three native servants or caffres of the said officer, both by day and by night, solely in order that they might keep a close watch against the transshipment of private goods, besides also the constables of the said water fiscal, who likewise keep close watch thereabouts upon this roadstead, so that upon the departure of those vessels we are impossible of being able to examine everything thoroughly again, principally because the permitted chests and cases, ship provisions, and other equipment goods that are already to be found therein, and are commonly very voluminous, would then have to be unloaded again and transshipped into small craft. This would not only—above and beyond the impossibility that also resides therein, because the repatriating ships in a combined fleet are obliged to seek out their holding post under the high land of Bantam as quickly as possible—cause much trouble, expense, and considerable delay to the voyage, but commissioners from this Council would also each time have to spend far too long a time with it, to the neglect of the other matters of justice. However, and besides all this, may Your Right Honorable Lordships be persuaded that we shall not fail to do everything in our power that is in any way possible to achieve Your Lordships salutary objective, and that without respect of persons, hoping further that Your Right Honorable Lordships will have found no further reason for displeasure in that regard concerning this Council since then; indeed, the true zeal and vigilance in that matter will now appear clearly evident to Your Right Honorable Lordships in every respect, if Your Right Honorable Lordships would only be pleased to consider that by commissioners from our Council, together with the water fiscal and his attendants, on 25 and 29 September, likewise 8 and 23 October, here at the roadstead of this city, both from the ships Westcappel and Middelwout and in the sloops, boats, and other craft of the other ships then lying ready to repatriate, several canassers, cases, and other private goods were seized and placed under sequestration, such that we have, at the request of the said water fiscal, granted him an edictal citation against all those who might claim to have any right, action, or pretension to the aforesaid seized goods; but as the time in the said edictal citation has not yet expired, we shall, with the kind indulgence of Your Right Honorable Lordships, defer that until a further occasion. officers previously were alone granted, but concerning the passing of the guards of the garrison, which Your Right Honourable Noble Lordships nevertheless also were specifically pleased to order, we have only been allowed such honour as is commonly shown to military ensigns and lieutenants, it being only permitted to us equally with the officers of justice that the guard troop should come out drawn up in formation in front of the town hall, which we believe does not in the least agree with the intention of Your Right Honourable Noble Lordships, because to the officers of justice the coming out drawn up in formation of the guard troop at all posts, and even the gates, is still shown as an honour above us; and although in our previous missives, sent since that time to Your Right Honourable Noble Lordships, we have made no complaints about this, we nevertheless imagine that we cannot let this pass for the present, for the reason that, notwithstanding the aforementioned resolution of Their High Noblenesses, immediately after receiving Your Right Honourable Noble Lordships' above-cited orders, the members of this Council were fully shown the honours about which our complaints now fall, equally with the officers of justice and other ministers, both before we had received the prescribed resolution of Their High Noblenesses and for a considerable time thereafter, this having lasted until some months ago, when those honours were very suddenly, and to the decline of our esteem among the common people and the natives here, taken away from us, without the reasons for this being in any way known to us, other than that we must conclude that this has been regulated in this manner, notwithstanding the aforementioned contrary custom, on the basis of the cited resolution of Their High Noblenesses dated 4 June 1732, which was first brought into our council here on 28 February 1733 by our deceased Lord President, and concerning which, because of weighty criminal matters then on the carpet, we only took a preliminary resumption at that time and resolved to deliberate upon it with attention on a further occasion, and therefore to postpone it at that time, as appears from the aforesaid extract resolution and our subsequent decision, joined hereto in authentic copy under No. 11, since we still came to enjoy the said honours at that time; we have in no way been able to conform to the said decision of Their High Noblenesses for the above-alleged reasons, although our President in the assembly of the said Their High Noblenesses was pleased to make a declaration of satisfaction on behalf of this Council on his own authority, and it stands acknowledged in the aforesaid resolution, we testify jointly that this occurred in no way with prior knowledge, much less with the qualification of this Council, wherefore we then also will hope, and hereby most emphatically request, that Your Right Honourable Noble Lordships will be pleased to provide therein for the maintenance of our persons, and further, in case of decease, to grant to the members of this Council at their burial such respect and outward pomp of a military battalion and the carrying forward of a coat of arms, as not only the officers of justice, with whom the members of this council are nevertheless made equal by the repeatedly mentioned extract missive of Your Right Honourable Noble Lordships, but also the former fiscals, bailiffs, military and burger captains have always enjoyed here; to which we will still add our humble prayer and request, that Your Right Honourable Noble Lordships, in filling the vacant seat of President in our Council, will likewise be pleased to add the title of Councillor of India to the person who is benefited therewith, just as the much-honoured orders of Your Right Honourable Noble Lordships contained in their general missive dated the first of November 1709 themselves entail, and as is also practiced here with regard to the other lesser bodies, up to and including that of the heemraden, wherefore we then also will not doubt in any way whether Your Right Honourable Noble Lordships will take such decisions on this and other subjects of that nature as the circumstance and the weight thereof shall be found to require. 31 5219 Specification of the Criminal Cases concerning the interest of the Honorable Company, which have been settled, are in state of sentencing, and are still pending since 9 October 1733. Ieuw Koetko, Chinese, Bappa Boesoek, free Boutonese, and Poeroe of Bouton, slave of the free Balinese named Bappa Ahat, have, for smuggling and illicit trade in pepper, according to the sentence dated 4 November 1733, had the seized four hundred forty-three pounds of pepper confiscated for the benefit of the Honorable Company, and furthermore all three prisoners were severely whipped on the bare buttocks behind the town hall here, and each was shackled in chains for the period of one year. Stephanus. Stephanus Ingeman of Batavia, former junior merchant in the service of the Honorable Company and first transfer officer of the garrison office here, prisoner of the state, regarding the harboring and concealing of the fellow prisoner Martha Bintang, accomplice in the murder of the former receiver-general Joachim Guilbaud, the advocate fiscal concluded against the prisoner by written criminal claim on 21 November 1733 that he should be brought to the ordinary place of execution and there severely whipped with rods on his bare back, branded, and subsequently sent to the province of Banda for the period of twenty-five consecutive years, in order to remain banished there on the island of Rosingain during the aforesaid period. But, 5220 32 but the prisoner was, on the following 25th, according to the sentence, banished for life to the island of Rosingain in Banda, without ever or at any time being allowed to return here, on pain of heavier punishment. Thomas Beneke of Staate, corporal and formerly stationed at Banjermassing, prisoner of the state, regarding dishonest conduct concerning the Honorable Company's rations, the advocate fiscal concluded on 11 November 1733 that he should be demoted to soldier and further sentenced to run the gauntlet three times back and forth through a battalion of one hundred and eight men, but the prisoner was, according to the sentence of the following 9 December, acquitted of the same claim and released from his detention free of costs and damages. Anthonij. Anthonij Radee of Bruges, house carpenter and formerly stationed at Palembang, prisoner of the state, has, for committed manslaughter, according to the sentence of 12 December 1733, been punished with death at the gallows with the rope around his neck, furthermore half of all the prisoner's goods and accrued monthly wages were confiscated, to be divided according to custom after deductions. has reached its proper address, but has also provided the required satisfaction to Your Right Honorable High Mightinesses, in which expectation we can now no longer refrain from submitting to Your Right Honorable High Mightinesses, with all submission, the continuation of matters as they have occurred before us and as promised in our aforesaid letter, to give a further report in that regard, and to note therewith that the Water Fiscal, on 3 February of this year, against the report of our secretary, served a written rescription, after that same secretary had been requested by petition on 20 January that the said Water Fiscal might be ordered to serve his rescription within a certain peremptory period to be set by us for that purpose, in order finally to see an end to the estate of Vuijst; which above-mentioned submitted rescription we thought fit on the same day to place into the hands of our secretary, so that, if he saw fit, he might serve a reply thereto; but the said secretary persisted on 10 February aforesaid in his reply, so that on 19 February following, when we were about to take up the aforesaid vexing matter for resumption and its final settlement, we thought fit and decided, for the greater facilitation thereof, to place the aforesaid matter into the hands of our fellow members, Mr. Willem Vincent Helvetius and George Fredrik Haverman, in order to examine the same thoroughly and to serve this Council with a written report before the departure of the tea ship; which was indeed handed over to us by the aforementioned members on 26 March last; and after resumption thereof, we understood that the decision of this Council was thereby fulfilled, and ordered the same report to be joined to the case records, so that it may be taken into consideration upon the settlement of the said matter.
