orphan masters aforesaid, as well as the advocate fiscal having on the 3rd of March last served upon the orphan masters of this city, in their capacity as having under their administration the estate left by Susanna Elisabeth Roselaer and as representing the heirs of the same, a written claim ad confiscationem, yet since the said case has not yet joined issue, we are also unable to provide Your Noble and Right Honorables with any further report concerning this, but we shall nevertheless not fail to notify Your Noble and Right Honorables with all reverence of the further progress thereof at the earliest opportunity, so that we also cannot neglect at present to bring before Your Noble and Right Honorables with great veneration, and to advise, that having on the 22nd of December of the past year submitted our written concerns against the request made by the members of the so-called Ceylon court-martial to the Noble High Government of these lands, set down more broadly in our last dispatched missive, their said High Nobles were pleased on the 20th of February to send the aforesaid request, together with our concerns and further papers relating thereto, to Your Noble and Right Honorables, and to await the highly honored commands of Your Noble and Right Honorables in that regard, meanwhile suspending the proceedings here until such time as the much respected orders of Your Noble and Right Honorables concerning this shall have been received here; upon resumption of which extract of the minutes, presented here in the Council by our President on the 24th of February thereafter, we, wishing to give no cause for further inconveniences, not only considered the same as communicated, but also, by a unanimous vote on the 26th of March last, determined to leave the said suspension in full effect until further orders from Your Noble and Right Honorables, set forth more broadly in the aforesaid minutes added hereto under numbers 6 and 7; just as we furthermore leave to responsibility what in the course of time is to result from such subtle inventions, originating from embarrassment and practiced to gain time, while we nevertheless look forward with great respect to the revered orders of Your Noble and Right Honorables concerning the aforesaid request, not doubting but that Your Noble and Right Honorables will likewise regard our arguments and considerations in that regard as equitable and satisfactory, tending solely to the maintenance of the authority of our demanded jurisdiction, administering on behalf of and on the part of Their High Mightinesses, and thus to let it take its course, and consequently duly to attend to the right of the absolute sovereign, as we have promised to do according to sworn oath, and our concern having been directed to nothing else; wherefore we also most solemnly protest that we have put to paper and submitted the means and motives solely for the corroboration of our position animo defendendi, and for the preservation of law and justice, with such permitted candor as befits a supreme judge, thus without flattery or indulgence, much less other considerations which merit no reflection by a judge. Mention having likewise been made in our last respectful letters regarding the case of the former Ceylon governor Stephanus Versluijs and associates, we shall at present let this serve as notification regarding the continuation of the aforesaid case, that eight interrogatories having been delivered to us by the detainee Joan de Mauregnault on the 9th of December of the past year, by virtue of our ruling of the 18th of November preceding, arranged for the examination of just as many witnesses as were expressly named at the head of each of them, with the request to be permitted to have the same examined thereon from his side as soon as possible after obtaining a condemnation from this council, we resolved on the 9th and 14th of December aforesaid, before ruling thereon, to have the persons named by the said detainee and made known in the articles exhibited by him, examined ex officio before commissioners from our council as speedily as possible, without interference from the parties or any summons or condemnation of this council preceding thereto, after he, Mauregnault, should nevertheless first have declared whether he had anything to add to the exhibited articles which had not yet been concluded and signed by him, and if not, that all the same should then have to be concluded and signed by him as is proper, so that the one and the other was duly accomplished; whereupon some further articles were subsequently submitted to us by Mr. Jacob Lakeman on the 13th of January of this year, with the request that we should condemn the aforesaid Mauregnault to answer the same truthfully; but before ruling thereon, it was deemed good by us to place the same in the hands of the commissioners for the month for examination, which also took effect, and it having been reported by the commissioners on the 22nd of the same month that they had found nothing objectionable therein, we, instead of taking a final decision thereon, thought fit to leave the aforesaid Mr. Lakeman at liberty to act in that regard ex officio in such manner as he should deem legally proper, but nevertheless ordered the said Mr. Lakeman henceforth, whenever he wishes to have any articles answered in his function as fiscal, to have this take place in the presence of commissioners from our Council, after the said articles should have been duly examined by us or by commissioners, so that for the answering of the aforesaid articles on the 26th of the aforesaid month of January a

a commencement being about to be made, he, Mauregnault, notwithstanding that the contents of our aforementioned minute resolution had been made known to him, declared that he was not inclined for the present to answer the same, but requested that he might first submit his interests in that regard to us, as appears from the report made by Commissioners in council the following day, so that on the same day we could not fail, as entirely unfounded, to condemn the same Mauregnault to answer the same articles categorically, as the same was also accomplished according to the report made to us by Commissioners on the 30th of the aforesaid month of January, and that he, Mauregnault, after answering the same articles, had held them as acknowledged, in which regard we have conformed, item to the aforementioned Mauregnault on the 3rd and 10th of February, upon his request made to that end, granted an authentic copy of the aforesaid articles, with his responses given thereto, as also of the two requests presented by him to us on the dates of 21 November and 9 December of the year last past, together with the first engrossments of the eight answered articles here mentioned, but to have their original preserved at the secretariat of this Council, whereupon subsequently the said Mr. Jacob Lakeman on the 3rd of March of this year, in his capacity as fiscal here, caused to be summoned in person before us the former Governor of Ceylon Stephanus Versluijs together with the members of the Political Council there, in order to see and hear a request made, but our interpreter, in the absence of the bailiff as being on a commission, reported on the same day that the military Captain Gerrit Kalden had died, exhibiting therewith a certain note written by the said Versluijs to the bailiff, whereby, producing a certain attestation, he requested that because of his weak bodily constitution the matter might be continued for the time of three months, when in the meantime by the said Mr. Lakeman some articles were exhibited with the request that the defendants present, before being discharged from personal appearance, might be heard thereon in full council, submitting nonetheless the request of the aforementioned Versluijs to the judgment of this Council etc., against which the defendants present were heard, and having submitted their interests verbally against it, it was thereupon understood by us, before disposing of the one and the other, during the meeting, to have him, Versluijs, asked by Commissioners from our Council, and in the presence of the said Mr. Lakeman as special fiscal, whether he would consider himself as if he had appeared in person, and whether they also had anything to bring forward regarding the aforesaid request of Mr. Jacob Lakeman in his capacity and the answering of the said articles, and upon it serving as a report by the said Commissioners that, according to the aforesaid Versluijs's declaration made, he had considered himself as if he had appeared in person, but leaving the answering of the articles as such to the judgment of this Council, we thereupon on the same day condemned the said Versluijs and the other defendants who appeared to answer categorically to the aforesaid exhibited articles after the same should have been summarized, in the presence of Commissioners from our Council, and subsequently ordered him, Versluijs, to be held in civil detention in his house under the supervision of the bailiff, and the other defendants to go into civil detention, both at the respective gates of this city and in the Castle, each separately, and to keep such civil detention without access until the exhibited articles should have been answered, to be disposed of thereafter by this Council, according to which appointment the said Political members, with the consent and approval of His High Nobility the Lord Governor-General, were placed in such a manner and in such a way as was made known by our minute resolution taken on the same day, and which resolution, together with our appointment and further minutes taken in that regard on the said date, we now have the honor to transmit herewith to Your Right Honorable Lordships under numbers 8, 9, 10, 11, and 12, so that the circumstances of the matter, should it please Your Right Honorable Lordships, could be examined all the more easily in that regard, and to conclude this matter, with the permission and approval of Your Right Honorable Lordships, we would further add here that the Commissioners lost no time in proceeding with the the period of fourteen days, upon which request Mr. Lakeman was heard, and his Honor having declared that he could set no time in that regard, but nevertheless undertook, after answering the articles of Versluijs as well as those of the other members of the Political Council at Colombo, to proceed with the affairs of the said Mauregnault with as much speed as was possible, we did not at that time rule upon the aforementioned request, but kept the same in statu quo, after which the aforementioned Mauregnault, on the 17th of the said month of March, again requested by petition that the jailer might be paid for expenses furnished to him out of the money realized from his goods brought here by the yacht Calombo before his arrival. However, we denied this request, and at his Honor's request caused a copy thereof to be given to the Advocate Fiscal, which we now also have the honor to transmit herewith in authentic copy under no. 13 for the perusal of your High Excellencies. Having thus far dealt with this matter and having given your High Excellencies the required communication thereof with the utmost respect, we shall not fail to provide your High Excellencies with the continuation thereof in all reverence at the first opportunity. And furthermore, we note here with this that, at the request of the Water Fiscal Leonard Weijer, we have by our sentence of January 13 confiscated such thirty-eight canassers of tea as were intercepted by him, the Water Fiscal, on December 18 of the past year aboard the Honorable Company's vessel Opperdoes, lying ready at that time to repatriate, in order that the proceeds thereof be distributed according to custom, deducting what is to be deducted. Likewise, on the 10th of this month, at his request, we granted an edictal citation against all those who might claim to have any right, action, or pretension to such thirty canassers of tea, eight bundles of hand-canes, and a chest of linens as were seized on February 27 last aboard the return ship Rijgersbroek, lying anchored here in the roadstead, by commissioners from our Council. But as the time in the said edictal citation has not yet expired, we shall, with the kind approval of your High Excellencies, defer this matter until a further opportunity. And furthermore, we communicate here in passing with all respect that Captain-Military in the service of the Honorable Company Fredrik Smit, having been summoned before us on January 20 concerning atrocious insults and defamations published against persons of honor, character, and candor, the Advocate Fiscal joined the proceedings and demanded close confinement, and subsequently that he be severely flogged by the executioner at the ordinary place of justice and banished for all his life from all places belonging under the Honorable Company. However, these demands or requests of the Fiscal were denied by us; nevertheless, the provisional civil detention of the person of the aforementioned Fredrik Smit was granted to him ex officio. Subsequently, the aforementioned civil detention was, on March 17 at the request of the said Advocate Fiscal, converted into close confinement, whereupon he passed away on the evening of the 20th thereafter in the Honorable Company's prison. Thus, the day thereafter, at the request of his proxy, the master of the powder mill Carel Gabriel Kern, we surrendered the aforementioned corpse to him to cause it to be decently interred, after, however, the aforementioned dead body had been properly inspected and found to have died a natural death. By our sentence of January 27 of this year concerning the person of the Junior Merchant and former Resident at Gorontalo Jan de Zille, we annulled the verdict of the Council of Justice at Ternate, after, however, the grievances a minima proposed by him were first admitted by us; likewise, we denied the claim of the Fiscal taken against him, De Zille, there, and condemned the Fiscal in the costs of the lawsuit, both in the first and second instance in case of appeal. Furthermore, on February 20, for the commission of sodomitical sins, the gunner's mate Cornelis Adriaansz. Schouten and the sailor Jacobus Verkroost were drowned in the water here pursuant to our sentence; in like manner, by sentence of this Council of March 18 last, on suspicion of the aforementioned abominable sin, one Daniel Wilkops of Rotterdam was condemned to be ironed in chains for all his life on the island of Rosingain in Banda, and the sailor Jurgen Jacobsz. of Smyrna was banished for all his life. The trial records of these are to be sent over to your High Excellencies according to annual custom, as well as the outcome of those who are currently still detained for those committed abominations, and against whom the Advocate Fiscal has already moved that they be subjected to sharper examination. Director General Michiel Westpalm in order to obtain the purchase prices of these and other goods, regarding which it was suspected that the Honorable Company had been considerably disadvantaged, he, Ian de Konink, according to the registered minute under Letter DD, was pleased first to request an authentic copy of the draft and further act submitted here under EEE, and having obtained the same, saw fit, instead of answering properly or giving the required elucidation concerning his previously made obscure propositions, to treat the undersigned very impertinently and to censor him in the exercise of his office in an arrogant manner to such an extent that he was forced to complain about this to Your Honorable Worships, as the note marked with Letter IF contains, and upon which solely the disposition placed here under Letter GG was rendered to his satisfaction. The undersigned, according to the aforementioned authorization of Your Honorable Worships, subsequently addressed himself to the Honorable Director General and showed his aforementioned authorization to His Honor, and also made the request as stated therein. Consequently, by order of His said Honor, the specification of the prices of tea purchased here for the Honorable Company in the years 1730 and 1731 was obtained in proper form by the senior merchants of this Castle, marked here with ZH HL; likewise, upon the interrogatories in torso marked with Letter II, the Honorable Councillor Extraordinary Adriaan Valkenier was heard, along with the other persons who in the repeatedly mentioned time had been commissioned for the purchase of tea, and furthermore, the questionnaire added hereto under Letter KK was answered by the Chinese Lim Konseeng and associates, and the interrogatories presented to Anthonio Corea and associates, to be found here under Letter LL, were both, according to the disposition under Letter MM and the minutes kept by this Honorable Council, brought here under Letter NN and OO, also recollected under oath in the form of a witness examination for reasons of ill health, just as the aforementioned interrogatories and the unmannerly responses given thereto by the burgher Ian De Konink were brought under oath pursuant to the disposition and the minute kept thereon, endorsed here with Letter PI. And subsequently, the aforementioned repatriated Director General Cornelis Hasselaar having petitioned Your Honors that the undersigned might accept against a receipt such charters and papers as His Honor should present to him, the Fiscal, and this being granted to the said Mr. Hasselaar as shown by the disposition cited here with Letter RR, the undersigned received from the hands of His Honor's proxy, the Honorable Willem Timmers, according to the register endorsed with Letters PS, the documents mentioned therein, submitted here under Letter FF, VV, WW, and HH, and furthermore, at the insistence of the aforementioned Mr. Willem Timmers and his fellow proxies to proceed as quickly as possible with the case of their principal, further requested of Your Honorable Worships that the Honorable Councillor Ordinary Adriaan Oostwalt might be reminded in the name of this Honorable Council, by way of an insinuation, to provide such further evidence as His Honor had undertaken to provide in his written answer, as was also carried out by the secretary of this assembly, and the written answer was brought back from the aforementioned Honorable Mr. Oostwalt by the same, inserted in the report endorsed with Letters i 2, while not laying aside the extract missive hereto under Letter ZZ. initially considered far more grounded than they now appear to him in their nature. For although Mr. Oostwalt, both orally and in writing, clearly presupposed that Mr. Hasselaar, in the management of the general directorship, had not treated his respective gentlemen payers with the required candor in various respects, and especially concerning the purchase of tea; and although the same Mr. Oostwaelt submitted a considerable number of documents to this honorable Council to verify those accusations, these same documents nevertheless fall far short of providing such convincing evidence as the nature of these disputes and other weighty considerations connected therewith require. For the register and its annexes signed here from Letter M: to Letter B: B: merely comprise that the tea was purchased by private persons for a lower price than by the honorable Company, without in any way proving that the same tea was equal in quality and was bought or sold at one and the same time. Except that the answered interrogatories of Jan Booij, Jan De Koning, and Jan Dit in their kind contain that gifts, presents, and donations were allegedly the cause of the expensive purchase of the tea for the honorable Company. This, the summoned citizen Jan De Koning states in an intricate and covert manner to have heard from the mouths of Chinese and others, without mentioning in the least to whom such gifts, presents, and donations were allegedly made, under the pretext that of the informers he could specifically name no one except the recently departed Portuguese Captain whom he denotes by the name of Marthijn, together with his factor or bookkeeper, unknown to him by name. But since the name of Marthijen does not appear in the entire specification of the persons who sold tea to the honorable Company in the years 1730 and 1731, according to the annex here marked with Letter H: A:, and since this Jan de Koning, upon the further requisition of the undersigned, instead of providing clarification about his statement, conducted himself very inappropriately and impertinently according to what is aforementioned under Article Z: E: E:, his delivered responses, also originating merely from hearsay, cannot subsist in this matter either, and can as little convict the repeatedly mentioned Mr. Hasselaer of false administration as little as can be drawn to his debit from the further gathered documents Letter P: I: to P: E:, their drafted question points, and the responses provided therewith. Furthermore, the sentences of the further brief under Letter Z: Z:, delivered by the honorable Mr. Oostwaelt upon the legal notice served on him, have no effect, since on the one hand it contains nothing substantial and on the other hand, as a private writing, is not probative or valid in law. All the more so when, to remove all the aforementioned grievances, it is taken into consideration that the matter of trade in principle depends on chance, and that concerning it, the time and the various assortments of the aforementioned tea could have produced a great difference in price. In exoneration of Mr. Hasselaer, it further accrues that not only in the interrogatory under Letter P: K: K: on Article 7 and in the question points under Letter Z: Z: on Article 5, it is unanimously declared that the honorable Company always sampled and retained the best sort of those goods, and that consequently for the remainder the private traders and inhabitants of this city did not pay as much money for it as was paid by the honorable Company. But for the true exoneration of Mr. Hasselaar, the contents of the documents from Letter T: F: to H: A: seem greatly to serve, as it not only appears circumstantially therefrom that the tea was sold to various merchants at 50 to 62 rixdollars per picol, but according to their contents also further comprises that the tea suppliers received the full price and purchase money according to the reached agreement, and offered not the least doit as a gift either to the Director General or to the senior merchants of this Castle. After which, the undersigned, following the recorded decision of the Honorable High Government of these lands contained in its extract resolution annexed hereto under Z: A: A: A:, had to consent to the departure for the Netherlands of some summoned persons, because the repeatedly mentioned honorable Mr. Oostwaelt, upon the question of His High Excellency, was pleased to declare in the Council of India that he had to do with no one except the repeatedly mentioned honorable Mr. Hasselaar, and His Honor also in the further successive papers submitted to this honorable Council testifies that he cannot fortify his statement with any further proof. Having been read and reconsidered by some members of this Council, and currently presented to the table again, the written report and the documents pertaining thereto, submitted by the Advocate Fiscal of India, Mr. Isaak van Schinne, on the 14th of October last to the said Council, concerning what transpired between the gentlemen Cornelis Hasselaer and Adriaen Oostwalt regarding both the purchase of tea and other merchandise, by which the Honorable Company is said to have been burdened in the years 1730 and 1731; it is, after the said report was resumed anew, and the charters and papers related thereto were inspected again with mature deliberation and attention de novo, and having reflected upon the proposal of the President, approved and determined, before advising and concluding principally upon the aforementioned report, to order the said Advocate Fiscal ex officio to inquire further, with discretion and precisely, after what the Lord Ordinary Councillor of the Netherlands Indies, Adriaen Valckenier, is said to have reproached openly to the charge of the former Director General, Cornelis Hasselaer, in the assembly of No. 2 Their High Excellencies regarding the importation of the tea at the time His Honor was commissioned for testing, according to what the said Lord Oostwalt comes to testify about it, namely that it is said to have occurred and happened, to wit that he, Valckenier, as commissioner for the testing of the tea in the year 1730, was forced by the said Lord Director Hasselaer to accept bad tea for the Company for 45 and 50 rixdollars that was not worth 20 or 25, and further concerning this point to observe his duty and office as the matter requires. Secondly, to cause further inquiries to be made regarding what is considered a suspicious trade regarding the shipment of sugar to Mocha in the year 1731, and what regarding that is said to have been resolved by Their High Excellencies, as well as whether actually that sugar, of which the said Lord Oostwalt also comes to mention in passing, was sugar for the Honorable Company or not. Thirdly, to address Their High Excellencies in order to obtain clarification 7 27 3277 183 to obtain regarding a certain purchase of wax, with which the often-mentioned Lord Oostwalt comes to insinuatingly charge the aforementioned former Lord Director Hasselaar, as if the Honorable Company is said to have been considerably shortchanged thereby; further, to request a copy of what is said to have been recorded concerning that matter. Fourthly, whereas the Lord Oostwalt, in his answer to the notification from the secretary of this Council under the date of 25 July 1733 made to His Honor, comes to produce an extract from a letter from a certain Duvelaer delabarre, dated 7 March 1733, and marked with the letters ZZ, and addressed to the repatriated burger Jan de Coning, in which he, Duvelaer, comes to complain that, besides the set price for the cinnamon and the country's duties, he is said to have given moreover some rixdollars more to the Director and the First Chief Merchant of this Castle for the lot, and that semi-forcibly; thus the Advocate Fiscal is likewise ordered to address where it is appropriate in order to inquire and to see if the aforementioned Duselaer delabarre under the aforementioned direction of the Lord Hasselaer was, among other things, also a buyer of the cinnamon, and if necessary to request permission from the Right Honorable Lord Director General Michiel Westpalm in order to be permitted to have an extract of the first name and surname of the cinnamon merchants of that time. Resolution taken in the Council of Justice of the Castle of Batavia, on Monday the 28th of December 1733: Concerning the matters between the Honorable Gentlemen Cornelis Hasselaar and Adriaan Oostwalt No. 2. Annex to No. 2 Copy Friday the 19th of February Anno 1734. Extraordinary meeting at the house of the Honorable Lord President due to His Honor's indisposition, presentibus omnibus demptis Messrs. Gerlag and van Den Bosch on commission. The Lord Advocate Fiscal of India, Mr. Isaak van Schinne, having been asked here in the Council by the Lord President, Mr. Cornelis van Gaasbeecq tot Thienhoven, how far His Honor had advanced ex officio with the further inquiries ordered in the case of Messrs. Cornelis Hasselaer and Adriaen Oostwalt, as well as what might be lacking, seeing that against the prisoners who had been sitting here in irons for some months, nothing had yet been attempted, and without either the well-mentioned Lord President or this Council being aware for what offense they had been confined here in the Company's irons, which nevertheless ought not to be so; the said Fiscal thereupon testified that regarding the first matter he had not yet effected anything, as he had much to observe concerning it; yet in respect of the second point, that sometimes the papers could not be obtained from the General Secretariat as quickly as one might wish, and that he did not know otherwise than that it was noted on the prisoners' roll for what reason the prisoners were brought into irons, or at least that such was made known to the jailer upon bringing in the prisoners, and that he should then take care that the same was properly noted on the prisoners' roll. However, the aforementioned Fiscal having thereupon been urged in earnest terms by the well-mentioned Lord President to proceed with that case of Messrs. Friday, March 26, 1734. In the forenoon, extraordinary meeting. Present: all, except the gentlemen van Den Bosch, Lakeman, and Hoeverman. The fiscal advocate, Mr. Isaac van Schinne, informs this council that with the minutes of December 28 of the past year held by this council in the case of the repatriated former Director-General Cornelis Hasselaar and the ordinary councillor Adriaan Oostwalt, after having first addressed the well-mentioned honorable Mr. Oostwald, who had been indisposed for some time, and having received in reply from his honor that regarding the accusations against the honorable Mr. Hasselaar he had no further evidence than had already been supplied to this council; he subsequently presented himself to his High Honor, the right honorable, highly esteemed Mr. Dirk van Cloon, and the honorable Director-General Michiel Westpalm, and requested from their honors to requisition what was demanded of him, the fiscal advocate, by the aforementioned minutes; and that for this reason he had already obtained the petition presented by the aforementioned Mr. Hasselaar to the honorable High Government and the deed of surety executed by his honor on October 16, 1732, on behalf of the general Company; the fiscal advocate maintaining regarding the first point demanded of him by this council to have already performed this with discretion; and regarding the second point concerning the shipment of sugar to Mocha in the year 1731, that he was informed that no record thereof had been kept by the government; regarding the third and fourth points concerning the purchase of wax for the honorable Company and the price of the cinnamon, that it was promised to him, the fiscal advocate, to provide the necessary elucidation thereof, whereupon he would not fail to supply the same to this council, as well as the reports by the commissioners for tasting the tea to the frequently mentioned Mr. Cornelis Hasselaar, as also relating to the warrants issued by the cashier for the purchase of the tea in the aforementioned year; but that regarding the sample booklets his honor was told that the same were lost and might likely have been taken along in the original to the Fatherland by the repatriated former senior merchant Jacob De La Fontaine; whereof it was agreed to keep this record and provisionally to attach the copy of the petition along with the deed of surety to the case file. Friday the 26th of March 1734 Collated Copy In the forenoon, extraordinary meeting. Present: all members, except, in this matter, the gentlemen Gerlag, Haverman, and Roman. Having taken into serious consideration in this Court the further decision of the Honorable High Government of these lands, dated the 20th of February last, taken in the Council of India and brought before this Court on the 24th thereafter by the Honorable President, Mr. Cornelis van Gaasbeek tot Thienhoven, which was then only understood to be held as communicated and further ordered to be recorded in the memorial of this Court, the contents thereof tending specifically to the suspension of the instituted proceedings between the Advocate Fiscal of India and the detainees, formerly of the Ceylonese so-called emergency or court-martial, and this until further orders from the High Honorable Gentlemen Seventeen, to whom the papers with their annexes concerning this would be dispatched at the first opportunity. And thereupon, by their Honors, having taken into consideration that although this Court, on very solid grounds according to the orders of the masters, would wish to let the course of justice proceed without allowing it to come to a standstill by a granted suspension, this Court nevertheless finds itself invested with neither power nor authority enough to execute in this matter the continuation against the granted suspension; for which reason, and for other reasons adduced, it has been resolved and determined by a unanimity of votes to obey the aforementioned decision of their High Honors dated the 20th of February last, and to leave this case in the meantime in status quo until their Honorable High Mightinesses, our lords and masters, shall have declared themselves regarding this unprecedented and unexpected case, and it is trusted that this Court will be fully maintained. The Interpreter reports that the defendant Gerrit Kalden has died, and appears on behalf of the defendant in person, Stephanus Versluijs, presenting a certain private letter accompanied by a notarial certificate, the aforementioned letter reading as follows: Bailiff Felix. Through my continuing indisposition and weak bodily constitution, finding myself entirely unable to appear in person for the present before the Honorable Council of Justice, my request is that you come to report this and, making it known that for that reason I request the time of three months' continuation of this case, to deliver the accompanying certificate to their Honors. The Honorable Officer, Requiring Party, exhibits some articles with the request that the defendants present, before being discharged from personal appearance, may be heard thereon in full Council. 95 3283 The Honourable Officer Demanding Judgment concludes for the rejection of the request made by the defendants present, as being contrary to the practice and manners of proceeding in criminal cases. The defendants persist for rejoinder. The parties request a ruling. The Court, ruling upon the request of Mr. Jacob Lakeman as Officer Demanding Judgment in this matter, item the counter-requests made by the defendants present in their libel, as well as the request made in writing to this Court by the defendant Stephanus Versluijs, condemns the defendant Stephanus Versluijs and the appearing defendants, each separately, to answer categorically to the exhibited articles after the same shall have been summarized, in the presence of commissioners from this Court, assisted by the secretary or sworn clerk. It further orders the first defendant Stephanus Versluijs to be held in civil detention in his house under the supervision of the bailiff or sworn interpreter, or else the adjunct sworn clerk; and likewise that the remaining defendants shall enter into civil detention separately at the respective gates of this city and in the castle, to the end that they shall remain there in civil detention, all without access, until they shall have properly answered the exhibited articles, and further orders shall then have been made by this Court. treated nor altered, much less can or may anything be added thereto or taken therefrom, see E. Vromans, De Foro Competenti, book 4, chapter 1, number 6, and several other doctors. The aforementioned words of the sentence are also so clear that they need no interpretation at all, just as this was also very well understood by the attorneys of Mrs. Vuijst, namely Jan van Landschot and Rogier de Haver, since in their so-called petition they posit that the daughter of the oft-mentioned Vuijst has been deprived of her legitimate portion by the decreed confiscation; so that everything advanced in that regard by the gentlemen commissioners-rapporteurs ought to have been alleged by the parties in court at the proper time in contradictory proceedings, at which time the advocate fiscal would have been sufficiently able to refute the same with sufficient arguments and proofs. Wherefore he shall here solely conclude that the oft-mentioned sentence be left in its entirety, expressly protesting against everything contrary that might be done or attempted, nevertheless deferring, with great respect, as in all other matters, to Your Honorable Worships the disposition regarding the Ceylon account and statement of accounts of the common estate submitted by the secretary Bernardus Coop à Groen. Whereupon, shortly thereafter, there was brought in by the messenger of this Council, also in the name of the said Honorable President Mr. Cornelis van Gaavrebeeck tot Thienhoven, a certain sealed missive, the superscription of which was addressed to this Council, the contents thereof being as follows: Honorable Gentlemen, My Lords, Since the disposition of my body does not yet permit me to officiate in person, after cordial greetings, I have nevertheless deemed it my duty to notify Your Honorable Worships that the gentleman Mr. Gerardus Gerlag, presiding member of this Council, has among other things communicated and reported that on Saturday the 3rd of this month it was resolved to proceed today to a final settlement concerning the case of the secretary of this Council, Bernardus Coop à Groen, as sequestrator of the estate between the executed-unto-death Master Petrus Vuijst and his wife Barbara Wilhelmina Gerlings, joint possessor, against the water fiscal Leonard Weijer, as specially commissioned in this matter to observe the Company's rights regarding a certain incoming account of such goods as are said to have been converted to his own use and enjoyed by the just-mentioned Vuijst on Ceylon, item also regarding the statement of accounts submitted by the said secretary on behalf of that estate. All of the aforesaid I fully leave to Your Honorable Worships, in order to resolve, conclude, and decide therein in such manner as shall be deemed proper according to the state of affairs. However, whereas upon reading the report submitted by the gentlemen Mr. Willem Vincent Helvetius and George Fredrik Haverman, members of this Council, I have to my utmost astonishment noticed today that the aforesaid gentlemen have also seen fit to share and express in the just-mentioned report their consideration and advice regarding the claimed, asserted legitimate portion which the surviving daughter of the oft-mentioned Vuijst is alleged to be entitled to, notwithstanding that all his goods were confiscated by a sentence executed in public; whereas, under reverence to their Honors, no such thing was demanded of them, but solely and only to report upon the various matters concerning the aforesaid certain incoming account and statement of accounts submitted regarding that estate, as appears from a certain minute added hereto in the subject matter under date of 19 February 1734; so that, saving reverence, the gentlemen rapporteurs have exceeded the limits of their mandate and meddled in a matter that was by no means of their department, and also has no connection whatsoever with the matter upon which the Council requested their report. Above and besides the aforesaid, even if any interpretation and elucidation were to be requested, and could also be made, which nevertheless, saving better judgment, is by no means the case with such a sentence that has already been executed, such would belong and be proper to the judge who passed and pronounced the said sentence. And because that judge has already performed his function, the undersigned maintains that they themselves are not competent to be able or empowered to take any further decision regarding the asserted, claimed legitimate portion in favor of the oft-cited Vuijst's surviving daughter, but that such is and remains, as a benefit or a grace, reserved to the sovereign. In such manner, then, the undersigned also lives in the hope and expectation that no reflection, much less any decision, will be made by Your Honorable Worships concerning the consideration and advice of the gentlemen rapporteurs. Right Noble, Highly Esteemed, Wise, Prudent, and very Generous Gentlemen, My Lords. Whereas in our latest submitted submissive letters we have reported to Your Noble High Esteemed with all veneration concerning the affairs regarding the person of the former Governor of Ceylon, Stephanus Versluijs, together with the members of the Political Council at Colombo, and the former Fiscal there, Ioan De Mauregnault, we now find ourselves obliged, in continuation thereof, as briefly as possible, because it cannot conveniently be summarized in the presence of all the members, to communicate to Your Noble High Esteemed by separate missive, with due respect, that when on the 29th of March of this year the answering of the articles of the above-mentioned members had been completed by commissioners from this Council, before whom this had taken place, a written report was delivered to us on the 9th of April, from which it appeared that the interrogated Roeland Cau, after the interrogation, had requested to have an authentic copy thereof along with the responses given by him, and that he might be released from his hostage or arrest, just as had likewise been requested by the interrogated Adriaen Van Hebi, Judocus Wilhelmi Hiltebrand, Ioan Elias van Mijlendonk, and Iohan Wilhelm Snhee, the last-mentioned moreover holding his answered articles to be re-examined and confirmed, but the interrogated Willem Bernard Albinus having only requested to have an authentic copy of the articles presented to him and his responses given thereto, without more; so, after reconsideration of all this, it was understood by us to hold the same as communicated, and to suspend the disposition regarding it until the aforesaid members should have properly re-examined and confirmed their responses; whereupon we, on the same day, being the aforesaid 9th of April, upon the considerations presented to this Council on the 7th preceding by Mr. Iacob Lakeman in his capacity as officer, namely as to how the person of Stephanus Versluijs should be considered with respect to the re-examination and confirmation of his given responses, which was then about to take place, as well as whether this should be effected at the city hall or at the house of the said Versluijs, decided to have the aforesaid Stephanus Versluijs appear in our council, or otherwise, if he should be unable to do so due to bodily indisposition and weakness, to allow the aforesaid re-examination and confirmation to proceed at his house before commissioners from this Council and the aforesaid Lakeman as fiscal; whereupon subsequently on the 14th of the aforesaid month of April, a certain petition having been handed over by commissioners from this Council, which had been delivered into their hands by the repeatedly mentioned former Governor Versluijs on the 10th preceding after the completed re-examination and confirmation of his articles, with the request to present the same with all respect to this Council on his behalf; so, after reconsideration thereof, and after Mr. Iacob Lakeman in his capacity as fiscal was heard thereon and his Honor requested that the disposition regarding it might be postponed until the next meeting, when he intended likewise to make a request to this Council, we approved granting the above-mentioned Stephanus Versluijs an authentic copy of the articles and his responses given thereto, but to keep the second or last part of his request, tending toward release from his hostage, in statu quo; while on the 16th of the aforesaid month of April another written report was delivered to us by commissioners, from which it appeared that the repeatedly named members, after the completed re-examination and confirmation, had renewed their request both for obtaining an authentic copy of their answered articles in so far as each of them might be concerned, as well as for release from their hostage, and also that the hostage Roeland Cauw had moreover insisted upon being allowed to conduct his defense separately; upon all of which the aforesaid Mr. Jacob Lakeman having been heard as fiscal, and his Honor having requested that the disposition regarding it might likewise remain postponed, the same was kept in statu quo just as before; but nevertheless on the same day disposition was made upon a certain very extensive remonstrance presented to this council on the 14th of April, or two days prior, by the wife, children, and other close relatives of the detained merchant and former fiscal of Ceylon, Ioan De Mauregnault; it being, after reconsideration thereof, not only declared that the said writing contained many impertinent and injurious expressions both with respect to this council and to the fiscal in this matter, Mr. Jacob Lakeman, but also consequently the said wife, children, and other close relatives of the said Mauregnault were expressly forbidden in the future to present again such writings to this Council on pain of further disposition; but nevertheless it was approved to reconsider exactly the answered points of inquiry

the wives of Judocus Wilhelmi Hiltebrand, Jan Elias van Mijlendonk, Willem Bernard Albinus, and Adriaan van Hek having subsequently, on the 25th and 29th of April, as well as the 6th and the 8th of May, on account of the indisposition of their husbands, requested and obtained free access to them, as also on the 12th of the aforesaid month of May, at the request of the frequently mentioned Stephanus Versluijs, delivered to us on the 6th prior, and after the said Mr. Jacob Lakeman was heard thereon, and his honor concluded to the denial thereof, free access was granted by us to the same Versluijs for his closest blood relatives within his dwelling, to the number 5312 124 of two to three and no more, but the remainder of what was requested was provisionally denied, it having since on the 5th of June, after exact resumption, been resolved to grant the requests submitted to this Council by Stephanus Versluijs and the members of the Colombo Political Council after the answering and reviewing of their submitted articles, both for release from their civil custody and to obtain an authentic copy of the same articles, the first part under solemn hand-pledge and promise nevertheless to appear again at all times upon being summoned under penalty of being held confessed and convicted, and indeed under the condition with regard to the detained Stephanus Versluijs that the same, with respect to his person until the outcome of the principal case, and to the satisfaction of this Council, should have to provide proper and sufficient bail for a sum of fifty thousand rixdollars; whereas on the other hand by the same ruling the two-part counter-request of Mr. Jacob Lakeman was denied, tending both to the incarceration of the above-mentioned detained persons and to the attachment of their goods, with the order that 5313 126 that officer should proceed against them on the merits of the principal case: which ruling was pronounced on the 9th of the same month and the solemn hand-pledge was then duly performed by the former Governor Versluijs alongside the above-mentioned members into the hands of the presiding member in that case, Mr. Gualter Schutten; the first-named Versluijs having, moreover, in fulfillment of the aforesaid ruling regarding the bail mentioned therein, for the necessary security delivered to this Council several mortgage bonds and notarial bonds, all passed for his benefit by various residents here, for a principal capital lent to them of forty-five thousand four hundred rixdollars, with the further offer to provide as guarantor for the remainder in the sum of four thousand six hundred rixdollars still lacking from the imposed bail the former alderman of this city, Jan Hendrik Ducaijlar, who for that purpose had already appeared in the anteroom, and having been heard thereon in our Council, it was resolved, after resumption of the aforesaid mortgage bonds and obligations, to accept both and to consider 5314 126 the ruling of the 5th prior thereby fulfilled, and to release him, Versluijs, alongside the members from their custody, and to have the deed of suretyship executed as soon as possible at the secretariat of this Council, to the end that the copy thereof as well as the surrendered acknowledgments of debt should remain under the custody of our secretary until the full termination of the principal case, so that your Right Honourable Excellencies, if it pleases you, will be able to see the details more broadly from our ruling and minutes in that regard, to be found under the aforesaid date of the 9th of June in the criminal roll currently being forwarded; while furthermore, on the 30th of June of this year, a certain petition was delivered to us by the former fiscal of Ceylon, Joan De Mauregnault, accompanied by an extensive provisional defense with the documents serving thereto, requesting that he might not only be released from his detention, under such precautions as this Council should deem fit, but also that there might be released to him such moneys as have proceeded from the goods brought here with the yacht Colombo and publicly sold, 127 5375 and which are held under sequestration by the secretary of this Council, without prejudice, however, to the action that might be maintained thereon by Mr. Jacob Lakeman, or whosoever it may be, and under sufficient bail to cover the judgment to the amount of the same moneys; might as yet not be disposed of by this Council, inasmuch as he intended, and also undertook, to bring forth a principal claim against the aforementioned Mauregnault within the period of three weeks, at which time this Council would then be able all the more easily to take a decision regarding the one matter and the other; yet, after the same had been put to the vote, it was approved by us to proceed with the resumption of the papers pursuant to our resolution dated the 16th of April cited above, and after the reading thereof to dispose regarding the same as should be found to pertain to good justice; subsequently, on the 28th of July, it was again requested of us by petition through the attorney van Vliet, on behalf of the former Governor of Ceylon, Stephanus Versluijs, that this Council be pleased to order the said Mr. Iacob Lakeman to institute his boasted and sustained action against him, Versluijs, as yet within the period of fourteen days, and this on pain, in case of failure thereof, of being and remaining barred therefrom; against which the said Lakeman was heard on the day following, the 29th of the aforesaid month of July, and it having been requested by his Honour to be allowed an authentic copy thereof, in order next to declare himself in writing thereon, the question was put to him by this Council whether he could not declare himself on this subject immediately, or at the very latest the following morning, which latter was indeed accepted by his Honour for the following morning or the following Saturday; yet nevertheless, after the one matter and the other had been put to the vote by the presiding member in this matter, Mr. Gualter Schutten, it was agreed by us, indeed first to cause to be read to the said Mr. Iacob Lakeman a certain extract of a letter written by Your Right Honourable Worships to Their High Excellencies here under date of the 31st of October 1733, and delivered here two days prior, whereby this Council was recommended to grant speedy administration of justice, and subsequently, both for that reason and because the request of the frequently mentioned Versluijs was in itself very reasonable as far as the institution of the action was concerned, to order the aforementioned Mr. Iacob Lakeman to bring forth peremptorily against him, Versluijs, within the period of one month, such criminal claim as he shall believe to hold against the same; on the very same day, the 29th of July aforesaid, a petition was also handed over to us by the aforementioned Lakeman, and in the end thereof it was concluded anew, just as he had already done verbally, for the denial of the request of the former Fiscal of Ceylon, Mauregnault, so that the provisional defense attached thereto should be returned to him without disposition; yet, after a strict resumption both of the documents to the charge of the said Mauregnault and the declarations successively submitted to this Council by Mr. Iacob Lakeman in his capacity as officer, against the above-mentioned produced provisional defense with the documents relative thereto, and after everything had been maturely considered, it was approved and resolved on the 3rd of August to release the same Joan De Mauregnault from his detention, nevertheless under handpledge and bail for his person in the sum of ten thousand rixdollars, with provisional denial of the further requests contained in his latest petition and in that which had been presented by him prior on the 10th of March, just as also by this operative part the counter-request made to this Council by the aforementioned Mr. Jacob Lakeman was rejected, with reservation of costs until the end of the case, except for the prison fees, which we have decided are to be paid by the said Joan De Mauregnault before his release; as this decision was then also pronounced the following day, the 4th of the said month, and the contents thereof having been fully complied with by Mauregnault, he was released from his detention by virtue thereof; yet very unexpectedly it came before us that Their High Excellencies, by a certain extract from the minutes of the transactions and resolutions of the 10th of August, delivered here in Council on the 14th thereafter, came to demand from us the reasons which might have moved this Council to proceed to such a disposition and alteration concerning the person of the above-mentioned Mauregnault, where the case had not changed in nature, in order that Their High Excellencies might thereby be put in a position not only to take the requisite measures to advance Justice, but also to inform Your Right Honourable Worships of the one matter and the other;
