account had been rendered, as communicated, with a decision to incorporate the representation into the resolution, as well as to inform your Noble High Mightinesses accordingly, and also to provide a copy thereof to Mr Jacob Lakeman, which latter circumstance has also become fully apparent to us from a certain extract from the minutes of their High Nobles of the 6th of September last, and presented here in Council on the 9th thereafter, inasmuch as it was found therein that Mr Jacob Lakeman had submitted a written document to their High Nobles against the report of this Council regarding the reasons given concerning the release of the former fiscal of Ceylon, Joan de Mauregnault, to which His Honour would not possibly have been able had no copy of the aforementioned report regarding the account required of us and rendered been handed to him; meanwhile, in continuation of this, we shall further note here that Mr Jacob Lakeman, on the 25th of the same month of August, caused the former Governor of Ceylon Stephanus Versluijs, together with the members of the Political Council at Colombo mentioned above, to be summoned in person before this Council, in order to see and hear the claim and preliminary request made, but before allowing this party brought to the roll to be called out by our messenger, we, being unable to imagine what the request of the said Lakeman would consist of, deemed it proper first to ask him the same, who thereupon having handed a certain writing to the presiding member in this matter, Mr Gualter Schutten, caused this Council, after resumption, to find that the same was a petition founded on a claim and conclusion ad mortem, and containing a third instance for incarceration of the above-mentioned persons, whereas such had already on two diverse occasions been unanimously denied by this Council after resumption of documents, for which reason we also could not fail to ask the said Lakeman very specifically whether, since the disposition made on the last request to the same end, any further documents or muniments had been obtained by him to the charge of the accused, and if so to furnish the same to this Council, in order to be able to judge therefrom whether such new instance was also admissible, whereupon His Honour finally brought forward certain interrogatories answered by the skipper Mijndert Schut, together with some extract letters, both those addressed by your Noble High Mightinesses to the Noble High Indian Government here, and those addressed by the same Government to the Ministers of Ceylon, while the said Mr Jacob Lakeman declared that he had no other new documents, after resumption of which, nothing having been found therein that could serve as a foundation for the requested incarceration, we, after the calling of the parties, and after Mr Jacob Lakeman had served the cited written request, and the defendants had served their interests against it by two libels, finally had to proceed to such a dispositive order as may appear in more detail to your Noble High Mightinesses from our appointment under the aforementioned date of the 25th of August, in the criminal roll currently being sent over, together with a certain minute kept by us concerning this, accompanying this under No 2 in authentic copy, to which, with the kind approval of your Noble High Mightinesses, we very respectfully refer herewith for the sake of brevity; their High Nobles, upon the written request made by Mr Jacob Lakeman, having in their resolution of the 6th of September last, already cited above, deemed it proper to grant, among other things, the requested suspension of the proceedings until further disposition, and thus to order this Council to keep the matters in question in statu, and at the same time to transfer all the papers belonging to both lawsuits under proper inventory to the meeting of their High Nobles, after resumption of which orders contained in the aforementioned extract minutes, and presented here in Council on the 9th of September, we deemed it proper to obey the same in all parts, but nonetheless to make a request to their said High Nobles by way of a petition, not only to obtain an authentic copy of the document as submitted in its entirety by Mr Jacob Lakeman to their High Nobles, but also found ourselves unavoidably obliged to submit, with proper respect, a written justification, as well as to qualify our fellow member Mr Willem Vincent Helvetius to draft both documents, as His Honour had offered his services for that purpose, as the same was then also drafted by His Honour, and having been resumed and approved by this Council, was presented on the 28th of September last to their High Nobles by three members specifically delegated for that purpose in the aforementioned full assembly; Nor also after that date, for the reason that their High Mightinesses, by their much-esteemed extract minute of the 28th of September aforesaid, have been pleased to understand that the cases of the former Ceylon Governor Stephanus Versluijs cum suis, together with that of Joan De Mauregnault, are to be handed over to the Advocate Fiscal of India, Mr. Adrianus Bergsma, and the well-mentioned Lakeman is now to be relieved thereof, as well as to restore the proceedings of the aforesaid Ceylon Governor Versluijs cum suis to that state in which the same were after the answering of the articles and the subsequent appointment to release under bail, etc., and to let the said Advocate Fiscal proceed further thereupon, as well as to order this Council to hold all that which occurred further and after that date as if the same had never happened, and to that end, as well as for a final quashing and clearing away of the aforesaid case, to hand over to their High Mightinesses in good faith, both in original and draft, all the papers relating thereto which were brought to light after the disputed ruling of the 25th of August past by the aforementioned Lakeman and this Council, in order to be sealed by order of the said Government and deposited without any further note in the secret chest of the aforementioned board, to the end that not the least stir be made about it any further, and at the same time also no longer to delay the progress of the aforesaid proceedings, in such manner as the said Extract minute accompanying this under No. 3 in authentic copy clearly shows, and after the resumption of which we have complied in all parts with the contents thereof, whereby we are not in a position to give your Right Honourable Worships any further communication regarding this, the more so because the newly appointed Advocate Fiscal in this matter, Mr. Adrianus Bergsma, owing to the voluminousness of these cases, has not yet been able to commence any further proceedings in that regard; thus we shall now proceed to communicate to your Right Honourable Worships that under date of the 27th of July of this year there was also submitted to us here in Council an Extract from the minutes of what was transacted and resolved in the meeting of the Honourable High Indian Government of the preceding day, whereby it was understood by their High Mightinesses, pursuant to the order of your Right Honourable Worships, to deliver to us in copy such two letters as the present Governor of Ceylon, Mr. Diderik van Domburgh, while still Commandeur of Galle, had written to the Ordinary and Extraordinary Council Members Stephanus Versluijs and Mr. Hendrik Van Baarle, and since sent hither in authentic copy for your Right Honourable Worships, together with an Extract from your Right Honourable Worships' venerated missive of the 31st of October of the past year, with orders to provide as quickly as might be feasible our declaration as to how we should view the contents of the said letters, and to what extent any use thereof could be made in law, so that their High Mightinesses might thereby be enabled to decide what is necessary in that regard; pursuant to which special request, then, a written declaration having been submitted by us on the 30th of July to the said their High Mightinesses, whereby the contents of the aforesaid two missives were merely noted to be of such nature that the former Ceylon Governor Stephanus Versluijs could in due time make use thereof for his defense, without our being able as yet to state what use he might make of them; nevertheless, on the same day, by a new minute after resumption of the same declaration, it was understood by their High Mightinesses not to hold themselves satisfied therewith, but further to charge this Council, for the elucidation of their High Mightinesses, to explain themselves in that regard in a satisfactory manner as soon as possible, and specifically to indicate what could and should be inferred therefrom with regard to Domburgh, as well as to what extent reflection should be made thereupon; upon the receipt of which decision the intention of the aforementioned their High Mightinesses became clearer to us, and consequently, on the 3rd of August, a further declaration was delivered thereto on behalf of this Council, to demonstrate, as far as the person of Mr. van Domburg was concerned, that his aforesaid letters must notoriously serve to his great disrepute, since from them his Honour's very fickle nature was established, in passing from one extreme to the other upon the instigations of his inferiors, as well as in denigrating his lawful masters and other Company ministers in a slanderous manner without foundation or probability, as was to be inferred from his laughable recantations, whereby one might posit that a ruler afflicted with such gross defects seems rather born to be governed than to hold any administration in his hands, principally in so important a government as that of Ceylon, etc.; And since for the present nothing further occurs to us to bring to the notice of Your Honorable Greatly Esteemed, we shall conclude this, and after having commended Your Honorable Greatly Esteemed together with your dear families to the sure protection of heaven, as well as wishing a complete and prosperous health, we are and remain with the utmost respect, Honorable, Greatly Esteemed, Wise, Provident, and very Generous Lords, My Lords, Your Honorable Greatly Esteemed's humble and dutiful servants: Batavia, 22 November Anno 1734. Right Honourable Commanding Lords, On Saturday the 15th last, this Council having reviewed a certain extract from the minutes of the business transacted and resolved in Your Honours' assembly on Tuesday the 10th of August past, transmitted to us by the presiding member, Mr. Gerardus Gerlag, whereby Your Honours were pleased to see fit and determine to demand an account from this Council as to why the merchant and former Colombo fiscal Ian de Mauregnault was released from his detention by this Council at his request, in such manner and form as can be seen more broadly from Your Honours' above-cited notarial resolution, and further from the original contents of the disposition of this Council submitted to Your Honours for review dated the 4th of the said month, and on the contrary to deny the counter-request made both verbally and in writing by the Honorable Mr. Iacob Lakeman, functioning in this matter as officer, seeing that Your Honours could not conceive what reasons might have moved this Council to proceed to such a disposition and change without the nature of the case having changed; So it is that the said Council, in compliance with Your Honours' ever-revered orders, hereby most respectfully comes to submit that, although the aforementioned Ian de Mauregnault was incarcerated by a previous disposition of this Council dated 15 July 1733, this nevertheless could not present the slightest hindrance to releasing him again upon a closer finding regarding his affairs. Because the aforesaid incarceration took place solely upon some cited evidence from a great number of documents supplied to this Council by the said officer in this matter in a certain summary memorial, which were delivered to us by the Honorable Lakeman without any formal register or inventory; the members of this Council at that time, of whom four or five have now already passed away, having trusted the said Honorable Lakeman as a sworn officer that, pursuant to his office and duty, he would have brought forward whatever was found in the papers in his possession for the exoneration as well as to the disadvantage of the said Mauregnault; which documents indeed at first glance seemed to provide half proof as well as presumptions and indications to the incrimination of the said Mauregnault, which are generally held by some Doctors and jurists of a somewhat strict and severe nature to be sufficient to grant a provisional incarceration, without those Doctors, however, making a reasonable distinction regarding the facts and persons of the accused, as is observed by others of a gentler and more humane nature, and regarding which one may say par excellence and with justice that such must principally be left to the conscience and the discretion of a judge, the doctrine of the Doctors on this matter being so divided that in that respect the well-known proverb is utterly applicable: quot sunt capita, tot sunt sensus; see Antonius Matthaeus, De Criminibus, D: title 14, chapter 1, numbers 6, 7, 8, and 9. Furthermore, it also contributed much at that time to the granting of this incarceration that the aforementioned Mr. Jacob Lakeman, from the papers in his possession, against his better knowledge and contrary to the indications of several documents, and most particularly the report of the Honorable former Ceylon commissioner Jacob Christiaan Pilat, which he had in his possession contradicting the same, was pleased to present such offenses which, if they had not been erroneously alleged, would have provided an indisputable basis for granting a provisional order of bodily arrest. Of which may serve as some examples: the wonderfully alleged crime of violation of sovereign authority from such facts that in their circumstances provided not the slightest intention of offending the sovereign or harming the republic, without which prerequisites, however, such a crime can never exist; furthermore, the fabricated high monopoly in rice and the mortality caused thereby among the natives, as well as the so-called forgery in the Kilkarai accounts in question, besides several others. would have perpetrated, which, added to the other motives, also caused the opinion in favor of incarceration to prevail in this council by a majority of votes, among such members who, as has already been adduced above, believed they had to follow a severe legal doctrine of certain doctors of law, and almost all of whom have now passed away; Above all this, the members of this council were not a little moved to place the person of the repeatedly mentioned De Mauregnault into bodily apprehension by the precaution and policy of Your High Honors, whereby they had seen fit to place him immediately upon his arrival at this principal place into political-military arrest, through which many members of this council were of the opinion that this council was as yet rendered unable to make a disposition regarding his person contrary to the decreed arrest of Your High Honors, before and until he was entirely delivered out of that into judicial custody, and the said council had thus obtained formal power over his person; which then likewise brought it about that the precaution regarding his person (which otherwise might have taken place by simple civil detention) was put into effect by this council by a majority of votes through incarceration. And this all the more because the Honorable Mr. Jacob Lakeman, at his request for incarceration, both orally and in writing, came to allege several enormous acts, which in appearance did have some presumptions in their favor, and which his Honor promised fully to prove during the inquests still to be conducted by him here; just as his Honor also attempted to effect this both by the examination upon articles of various persons and of the said Mauregnault himself, up to two iterative times, and to which end it also not improbably appears that the said Honorable Lakeman obtained from Your High Honors the summons of the Colombo Secretary Roeland Caauw. However, since his Honor failed to fulfill the just-mentioned promise, it was thought fit by this council, not without foundation, pursuant to the resolution dated 16 April of this year, to examine exactly and to confront against the evidence that the Honorable Mr. Jacob Lakeman had produced to his charge, in accordance with the duty of a judge and to remove all hesitations, a certain provisional defense, recently presented to this council by the repeatedly mentioned Mauregnault along with a multitude of documents appertaining thereto; which examination of a prisoner's provisional defense neither may nor can be refused, pursuant to the criminal ordinance of the year 1570, article 53, whereby it is very specially enacted that upon slight indications of the innocence and blamelessness of the prisoners, all matters shall be postponed and set back, and the judges shall understand to release and absolve him, it being an error for them to think that the honor of Justice is diminished by releasing someone. (after the facts of the trial have appeared to him) to determine whether the prisoners on their part shall have to be kept in common and closed prisons, or whether they shall be delivered into the custody of some officer and servant of Justice, or be kept under house arrest, or also be relaxed and released from harsh imprisonment upon fidejussory caution and bail, or upon their juratory caution, which shall be estimated according to the status of the persons and the circumstances of the imputed crimes, delicts, and misdeeds, which is also confirmed and regulated by the following 29, 30, and 44. It is also astonishing that the Honorable Mr. Lakeman pretends to be ignorant of what is commanded by the following 46th article of the said ordinance, when he has seen fit to maintain in his petition that according to law not even a provisional defense may be admitted as long as extraordinary proceedings are being conducted; whereas on the contrary, however, it appears clearer than light from the said article, where it is ordered that in any state of trials and cases, until the sentences and executions thereof, that which shall appear for the discharge and innocence of an accused person shall be received; which article, for the prevention of all captious objections to be raised against it, receives its full explanation from the previously cited 30th and 44th articles, as is also taught by Mr. Pieter Bort, Tract. van crim. zaeken, tit. 9, 1, 42; van tr. de null. ex defect. citat., from no. 3 to no. 9 inclusive, and several others, based upon l. 18, 1, 9, ff. de quaestionibus. By which notorious laws and legal doctrines the reasoning of the frequently mentioned Mr. Lakeman is also stripped of all its apparent grounds, namely that after the examination of a provisional defense, the release could not fittingly take place, as if that would amount to a retractatio actorum judicialium, to which one must not easily proceed, cum publica utilitas illud non facile permittat. Yet, as contrary as his Honor's first proposition is to the just-cited articles of the said ordinance, so ridiculous and incomprehensible to a jurist is the false interpretation and application of the axiom which he alleges for that purpose; quis enim qui a primo saltem limine Themidem salutaverit et qui non est talpa caecior ignorat that the said axiom, which dictates quod publica utilitas exigit ne acta judicialia facile retractentur, only has its reference to instruments, contracts, and documents that are passed before the knowledge and presence of the magistracy, which may not lightly be broken by reliefs on the pretext of falsity or lack of qualification, etc.; and that the same is derived solely from the L. Barbarius Philippus ff. 3. de off. praetor. Over and above all this, yet another system of the said Honorable Mr. Lakeman is also absolutely contrary to the frequently cited ordinance, when he dishes up as a general rule, without any limitation, that half-proof would be enough to keep an incarcerated person in custody; whereas, that ordinance having been inspected, besides such half-proof it absolutely requires that a judge in the matter of defenses must indeed take further reflection both upon the status and quality of the persons, and upon the evidence and crimes brought to their charge, and that thereafter it must be estimated whether half-proofs against every one of the prisoners, of whatever station he may be, provide sufficient ground to decree an incarceration and to continue therewith; when article 50 of the ordinance on criminal Justice, joined with articles 28, 29, 30, and 44 of the ordinance on the style of proceeding in criminal cases, is quite clearly enacted: that upon half-proofs and probable suspicions one shall grant provisional arrest, or (quod notandum) a personal summons, which must be estimated according to the status of the persons and circumstances of the imputed crimes, delicts, and misdeeds; from which it appears that incarceration is not always granted against prisoners of various conditions, but sometimes for the same delicts only a personal summons, as is very emphatically taught by the frequently cited Bort, tit. 5, num. 16, cum num. praecedenti; Anthon. Matth. de crimin. lib. 48. D. tit. 14. cap. 1. no. 9 in fine et cap. 2. no. 3, 4, 5, et 6. might come to follow, this having thus been remarked in passing, we shall proceed further to give your High Honors briefly a clearer account of the legitimate foundations and moving reasons upon which we, according to our conscience and from no other motives, have been constrained to release the aforementioned de Mauregnault. In that respect, we most humbly request that your High Honors please interpret in the best light that we, salva omni reverentia, cannot conform to what your High Honors were pleased to set down in the extract from the minuted resolution of your High Honors communicated to us, namely that the case of the aforementioned de Mauregnault would not have changed in nature; whereas, on the contrary, the same has, so to speak, been entirely reversed, and we consequently were compelled in all fairness to make such a notable change in our last decree, since the evidence that was initially brought against him, and from which a half proof could indeed be elicited, together with the presumptions and circulating rumors that at that time appeared quite acceptable to the charge of the said de Mauregnault, have been found by us to be removed and purged, namely to such an extent that we are currently assured that no corporal punishment can any longer be sustained from them, which is nevertheless the principal prerequisite to continue a decreed person in incarceration; as we have, in the first place, found through an exact resumption of the transmitted report of the Honorable Commissioner Jacob Christiaen Pielat that the facts charged against Mauregnault were not only nowhere near circumstantialized in such a manner as people here might have seen fit to state, but moreover in no way merited the odious naming of such crimes as those with which the same were truly christened in a hateful manner. Moreover, there was not the slightest thing to be drawn to his charge from the interrogatories put to Mauregnault on two different occasions and the responses given by him thereto; but, on the contrary, in his given responses he managed, beyond all expectation, to liberate himself from the offenses brought against him. Furthermore, not merely from his simple request for release, but rather from an ample provisional defense already sent to the fatherland, corroborated by notable evidence submitted therewith which he supplied to us, the falsity of some of the gravest crimes alleged against him was satisfactorily verified, and the other points of grievance, which might have been vindicated against his person corporally, were thereby also overturned with evidence constituting more than a half proof, whereas even vehement suspicions, according to article 42 of the ordinance on the style of proceeding in criminal cases, are sufficient to release an incarcerated person. In addition, he has very clearly un-nerved the evidence previously obtained against him, both with regard to its informal presentation and through an absolute demonstration that the deponents and witnesses who had first testified against him subsequently retracted their statements in his favor on several notable points; a multitude of counter-evidence having been further supplied by him, whereby the former, being highly suspect and impassioned, lose the greater part of their force and credibility against him, from all of which nothing else could flow than that this Council had to grant his legitimate request for discharge from a painful detention that greatly injured him in his honor and was burdensome in the extreme, according to the legal deduction in the Dutch Advice Book 4, consultation 188, on the 2nd question, grounded on the doctrine of Mr. P. Bort, Antonius Matthaeus, and other criminalists, as well as the opinion specially consulted on this matter by Council Member J. Coren in his Consiliis, consultation 1, in fine, and Professor Voet ad Pandectas, book 48, title 3, law 14; in support of which may also be adduced here the statement of Mr. H. de Groot in his Justification of the Lawful Government of Holland, chapter 14, that the long detention of prisoners was one of the most notable violations of the privileges with which the Duke of Alba is charged, all the more because Mr. Jacob Lakeman has failed to supply us with further evidence according to his promise, having been unable to produce anything noteworthy to his charge, although he made every effort to that end. Whereas the Most Honorable Gentlemen Seventeen, by their esteemed missive recently received here, dated 31 October of last year, were pleased to order this Government to deliver in copy to the Court of Justice of this Castle such two letters as the present Governor of Ceylon, Diederik van Domburgh, while still Commander of Galle, wrote from there, one dated 17 July 1731 to the gentleman Extraordinary Councillor Hendrik van Baerle, and the other dated the 25th following to the gentleman Ordinary Councillor and Governor of Ceylon Stephanus Versluijs, and accompanied the said missive of Their Honorable Excellencies with an authentic copy to serve at law, insofar as such should be appropriate, with further recommendation to their Honors to grant swift administration of justice to the said Versluijs and to those of the former Colombo Council who may be in detention here; so it is, in compliance with the aforesaid esteemed order of the well-mentioned gentlemen masters, approved and understood to let such happen, and to deliver to the said Court, alongside the copies of the aforesaid two letters, an extract from the more-mentioned missive of Their Honorable Excellencies concerning both matters, with another extract from these minutes, and by the latter to order their Honors furthermore to serve this Government as soon as ever possible with their declaration of how they shall come to regard the contents of the more-mentioned two letters and to what extent any use thereof may be made at law, in order that this Government may thereby be enabled to take the necessary decisions regarding this. 353 165 33 to elucidate in detail and specifically indicate what can and must be deduced from this with regard to the gentleman of Domburg, as well as to what extent this should be reflected upon, their Honors find themselves hereby obliged—although, under the favorable indulgence of your High Excellencies and subject to correction by a better opinion, they had believed they had satisfied the contents of the first-mentioned extract with the previous declaration, as this aforementioned Council had noted two missives therein as papers that the gentleman Stephanus Versluijs could use for his defense at that time, without however being able to say for the present what use he would wish to make of them, because in the frequently mentioned first minute extract dated 26 July, no specific declaration regarding those papers in relation to the person of the aforementioned gentleman of Domburg was imposed on the said Council, and the case of the said gentleman gentleman of Domburg had already been concluded by your High Excellencies upon the previously submitted declaration of this Council, as well as that the case of the gentleman Versluijs, to which the frequently mentioned missives appeared to have great relation, was still pending here before this Council and awaiting its adjudication—nevertheless, pursuant to the frequently mentioned latest honored orders of your High Excellencies of the 30th of this month, now duly and specifically to declare concerning the person of the aforementioned gentleman of Domburg that the frequently mentioned letters submitted to this Council must clearly and undeniably serve to his great disrepute, since it appears from them that the said gentleman must be of a very fickle nature, who so easily passes from one extreme to the other, and that solely at the instigation of feigned flatteries of his subordinate ministers, does not shrink from disparaging his lawful superiors 5354 llb and other Company ministers with calumnies and false accusations, without having had the least foundation or appearance of truth at hand, as appears clearly and plainly from his own shameless recantation itself, whereby one might well state that a ruler who is attached to such improper flaws, namely to lend an ear, as he pleases to call it, to pernicious and flattering ministers to the detriment of others, seems rather born to be ruled than himself to conduct an administration of affairs, much less to be able properly to direct an office of so much importance and concern to the Honorable Company as is the important government of Ceylon, wherefore this Council wishes to testify that the Political Council of Colombo, in their resolution taken on 10 July 1732, noted this impropriety as a co-principal point for the exclusion of the gentleman of Domburg; all the above, however, under this reservation: that in case this Council should in time, either through the gentleman of Domburg or through the components of the pending proceedings between the gentleman Stephanus Versluijs, and his associates, and Mr. Jacob Lakeman, acting as officer in this matter, be supplied with such defensive reasons and circumstances whereby the said gentleman of Domburg could clear himself in that regard, the said Council cannot then be held to this their aforementioned opinion, which they presently declare to your High Excellencies just as this case appears at first glance without hearing any defenses from the parties, because this would and 3355 be contrary to the office of a judge, who may not pronounce a sentence without hearing the other side, the more so because thereby, in respect of a grave point of accusation against the gentleman Stephanus Versluijs and his associates, the final opinion of this Council would already be declared in an incompetent manner; wherefore this Council, for the above-mentioned pressing and well-founded reasons and motives, leaves the further explanation of the contents of the aforesaid two missives, in respect of the person and quality of the aforesaid gentleman of Domburg, with all due reverence deferred to the wise, prescient, and equitable judgment of your High Excellencies, with which they hope now to have fulfilled the true intention of your High Excellencies in all respects; in expectation of which the aforementioned Council of Justice shall take the honor 5355 to subscribe themselves with the utmost respect. the Council of Justice of the Castle of Batavia, who have remained behind in the said Council solely for the settlement of the affairs of the former Governor of Ceylon, Stephanus Versluijs, and his associates, and the former Fiscal of Colombo, Joan De Mauregnault, alongside the four assumed members, who, for reasons contained in the accompanying minute under number 1, have requested to be excused regarding this letter, are compelled to trouble Your Noble High Mightinesses in the midst of your weightiest affairs with these their reasonable grievances, the extraordinary dispatch of which with the tea ships now returning home owes its cause solely to that which was resolved and treated in the Council of India on the 30th of November of the recently ended year 1734, at which time Their High Noble Honors, after resumption of our separate letter last addressed to Your Noble High Mightinesses with all respect, dated the 22nd of November of the aforesaid year, saw fit to proceed to an alteration and total revocation of a certain resolution of Their High Noble Honors dated the 28th of September of the past year, of which by our said letter to Your Noble High Mightinesses only mere notice was given, without any of the least complaints or grievances regarding the injury that, as we conceive, has been done to us by that resolution, along with a previous one and yet another subsequent to it, having on the one hand been constrained thereto by the said resolution, since their said High Noble Honors thereby, by virtue of their sovereign power pertaining to the high authorities, without examination or inquiry into who might be right or wrong, saw fit, among other things, to order an amnesty between the college of Justice and its appointed extraordinary officer, and at the same time our fellow member Mr. Jacob Lakeman, regarding certain disputes that had arisen here; we also, on the other hand, being unable properly to do so, because the aforesaid resolution further dictated that the disputes between the college of the Council and the said Lakeman should be regarded as if they had never occurred, with this precaution, that to that end, both by the Council and by the aforesaid Mr. Jacob Lakeman, all papers pertaining to that matter drafted since the decision of this Council dated the 25th of August 1734, both in original and in draft, should be handed over in good faith to the said High Government, in order, by order of the same, to be sealed and placed away into the secret strongbox of Their High Noble Honors without any further remark, through which precautions this entire affair having been withdrawn from the knowledge of Your Noble High Mightinesses, we were obliged in all submissiveness to obey these aforesaid serious and absolute orders of Their High Noble Honors, and to that end, according to the accompanying Register under Number 2, to entrust as a deposit to the secretary of Their High Noble Honors: An extract from the minutes of what was transacted and resolved in the Council of India, taken on the date of the 6th of September 1734, and brought over into the Council on the 9th thereafter, with the notarial decision of the said Council behind it, and marked with Number 1. 5360 Master Iacob Lakeman, in his capacity as fiscal in the aforementioned case, very shamelessly saw fit to set down in a certain calumnious writing against the members of the Council of Justice, submitted on 6 September of the past year in the assembly of the High Indian Government, and of which we have until now not been able to obtain any disclosure. To which end we now most earnestly submit to the impartial and lawful examination of Your Right Honourable Excellencies that the members of this Council, having decreed by court order dated 9 June 1734 (after a request for incarceration submitted by the oft-mentioned Lakeman against them had previously, on 5 August 1733, been denied by us for the time being) that the former Governor of Ceylon, Stephanus Versluijs, together with his political councillors, should be released from their civil detention, provided that the said Versluijs furnish proper bail to the amount of fifty thousand rix-dollars, dismissing the obstinate and unfounded counter-petitions of the oft-mentioned Master Iacob Lakeman, and further ordering the same to proceed in chief against the mentioned Versluijs and associates; yet notwithstanding those orders, the oft-mentioned Lakeman dared on 25 August following to go further and de novo make an impertinent and utterly injurious request for incarceration, basing the same solely on a certain defamatory conclusion ad mortem devised out of his own imagination against all the defendants; whereupon we found ourselves necessitated, both for the maintenance of our previous ruling 5361 and the pure judicial authority vested in us, as well as to avert the notorious scandal that he, after all his vainly attempted passionate endeavours, was still trying at the very last to inflict upon the defendants to their ruin, and also to check his irreverence towards us, to rule in such manner as can be seen in the court order dated 25 August aforesaid, again supplied herewith to Your Right Honourable Excellencies under No. 3, in the expectation that the aforementioned Officer would thereby be prevented from continuing with his unlawful and unchristian proceedings out of fear of a punishment that was thus far merely threatened, which indeed had the effect that he was no longer able to attack the defendants in such manner before our Bench. Yet, being unable to restrain his culpable passions, he dared, in the indulgence thereof with the utmost indignation, to attack us, who are his judges, addressing to that end in an extraordinary manner, without any means of appeal or revision, a certain writing to Their High Excellencies, directed both against our aforementioned latest court order and against an accounting demanded of us by Their High Excellencies containing the reasons why the former Fiscal of Colombo, Ioan De Mauregnault, had been released from his detention; which writing of the aforementioned Master Iacob Lakeman, in so far as it has reached our ears through rumours, was crammed with injurious insults, falsely adorned propositions, feigned pretexts, and defamatory arguments, wherewith the same sought to make it appear to the well-mentioned 5362 Their High Excellencies as though we had not discharged our sacred judicial office according to our oath and duty in the case of him, Master Iacob Lakeman, in his capacity as fiscal, against the aforementioned former Governor of Ceylon, Stephanus Versluijs, and associates, and the former Fiscal of Colombo, Ioan De Mauregnault; but that we, on the contrary, out of mere complaisance for the said Versluijs, had opposed and hindered him, Lakeman, in his lawful proceedings (as he alleges), and had moreover in an unprecedented manner, unbefitting his merits, publicly disgraced him and injured his honour on the public roll by our aforementioned latest court order; furthermore attributing the conduct of these matters by name to the three undersigned, claiming that they had managed to seduce and deceive the remaining four co-opted members who had opined alongside us in this case, as being ignorant of the law and practice; and making at the end of that writing, upon the aforementioned false pretexts, several improper requests, namely that the cases of the aforementioned defendants might be evoked from us as suspect judges and provisionally stayed, and furthermore that he, Lakeman, might be discharged from the aforementioned proceedings and that the same might be handed over to the currently serving Advocate Fiscal, and lastly, that he, Lakeman, might be redressed regarding the wrong which he believed had been done to him by us in the aforementioned ruling of 25 August aforesaid. accusations could by no means be qualified or verified in such a manner that on account of their liquidity or certainty, any provisional, let alone definitive and irreparable decisions, according to our humble judgment, ought to have been taken against anyone without prior notice or hearing, or at least without a summary defense from the accused parties; yet the undersigned have to their extreme sorrow had to experience that Their High Nobilities (be it said with all reverence, and under protestation of simple necessity) thought fit immediately on that very day, after reconsideration of the aforementioned writing, to grant the suspension of the proceedings requested therein until further order, as being unavoidable in that case, and furthermore disposing, to order us to transfer all all the papers belonging to the cases in question under proper inventory, and thus the trial in the state it was then in, to the assembly of Their High Nobilities, without the slightest opening of the accusations brought against us, or permission of defense, whereas we nevertheless believe that such can never be reconciled with the well-ordered governance of a Country, the more so when it is considered that in this matter a complaint was made by an officer about his lawful judges, and indeed those to whom, according to the orders of your Right Honourable, not only the supreme judicature of all legal cases concerning the Honourable Company's subjects in these Lands must remain entrusted, but very specially, the case in question had been committed; it being indeed in that respect incontestably known to everyone who pleases to examine the maxims of our our free united Netherlands, that no disposition is ever taken on any matters concerning the interest of any Magistrates, or colleges of prominence, be they Judicial, be they political, unless beforehand, either by sealed missive, or by way of commissarial appearance, or by Public citation, not only has proper notice first been given to the same, but there has also been demanded or accepted such defense or advice as the interested parties might see fit to submit against it, the omission of which renders such dispositions generally very detrimental to such interested parties, and besides the great consequences arising from the said grievances, almost always irreparable afterwards; which will be clearly demonstrated in what follows. 5369 53 or whether hands would be tied by the penal interlocutory decree that followed upon it, without examination or inquiry into who was right or wrong in this case, by virtue of the sovereign power belonging to the High Authorities, to restore the proceedings of the aforementioned former Governor Versluijs and associates to that state in which they were after the answering of the articles and the subsequent decree for release under pledge of hand, etc., and to allow the said Advocate Fiscal to proceed further upon it, as well as to order us to consider everything that occurred further and after that date as if it had never happened; and to that end, as well as for a final quashing and removal of that as was said odious, confused, and utterly tedious matter, to hand over in good faith to the Government, both in original and draft, all the papers concerning this case that were brought to light after the ruling in question, being being that of the 25th of August past, both by the aforementioned Lakeman and on our side, or that might have occurred back and forth concerning it, in order that they be sealed by order thereof and placed away without any further remark in the secret chest of Their High Noble Lordships, so that not the slightest stir be made about it any further, and at the same time that the progress of the prescribed proceedings may no longer be delayed, as appears from the accompanying prescribed Resolution under number 4. From which resolution although Their High Noble Lordships therein pretend not to have wished to examine who might be right or wrong it nevertheless incontrovertibly emerges to the advantage of the undersigned that our actions were found by Their High Noble Lordships to rest solely 5 5370 solely on the unshakeable foundations of law, equity, and practice, and were in no way as Mr. Jacob Lakeman had gladly sought to instill in Their High Noble Lordships directed by a passion for regard or spite, much less that the three undersigned had maliciously circumvented their fellow judges; for indeed, Their High Noble Lordships in that case with all due reverence would as rulers of these lands inevitably have been obliged to withdraw that case from us, as no upholding of justice could be expected from such suspect judges, and in addition would have had to decree against us a condign and well-deserved punishment, whereas on the contrary, the cases once already demanded from us were again entrusted de novo to our examination. By By which part of the decree in the said Resolution our conduct was indeed somewhat justified, and we were telle quelle reinstated against the previous ruling of Their High Noble Lordships of the 6th and 7th of September aforesaid, which was cited here before and had prejudiced us in every way; but apart from the fact that our request to obtain a copy of the accusatory writing of Mr. Jacob Lakeman for the defense and maintenance of our sacred judicial office was not even heeded by Their High Noble Lordships although shortly before, our unsolicited advice regarding the release of Mauregnault, contrary to the nature of such forced accountings of a judge, had nevertheless been sent to the frequently mentioned Lakeman, we find ourselves in all respects aggrieved by the remaining provisions in the said resolution of the 28th 5371 28th of September aforesaid. Because, firstly to follow the order thereof strictly as disposition was therein made upon some requests of Mr. Jacob Lakeman, it was approved to discharge him from the said proceedings against the aforementioned Versluijs and associates and the aforesaid Joan De Mauregnault, and to hand them over to the Advocate Fiscal of India, Mr. Adrianus Bergsma; which discharge must indeed be considered by everyone as an honorable dismissal of someone who has acquitted himself well of his duty, whereas it is notorious, from the aforementioned noted justification of our conduct, that he, as a slanderer and false accuser against us, ought to have undergone a punishment according to his deserts instead of receiving honor, as one one who had sought to tear the crown from the head not only of his equal, but in his official capacity of his judges who are in every way to be venerated, through defamatory insults; whereas now, without any the slightest signs of having done wrong, he has been able to boast for some time in succession against us that he has not acted improperly, since his request for discharge was granted to him with all decency preserved. whereupon Their High Noble Lordships come to desire that the same shall not prejudice the new Advocate Fiscal, but that the cases of the aforementioned defendants shall be restored to that state in which they were on the 9th of June 1734, when the order for release on bail, etc., was rendered, basing this absolute desire of theirs upon the sovereign power belonging to the supreme authority, without wishing to examine or inquire who in this case might be right or wrong, which also leaves no small suspicion as to whether or not said disposition of ours might somewhat be argued to have been rendered against equity and practice, whereas we nevertheless, in our remonstrance submitted to Their High Noble Lordships, have shown that the same, according to the usages and customs practiced and approved by the widely renowned Court of Holland, Zeeland, and West Friesland, necessarily had to be taken in such manner according to rights and laws, on account of the unfounded, vexatious, and calumnious proceedings of the oft-mentioned Lakeman; there residing, moreover, regarding the revocation of the said order, an absolute impossibility, since that order having been pronounced on the public Roll, and a copy thereof having been delivered to both parties, we as judges have declared ourselves so far in that respect that we may never go against it, nor can the same be revoked with any effect to the prejudice of Versluijs cum suis; over and above that the revocation of the said order and the setting back of this case implies an impediment to the course of justice and a suspension of the executions of our judicial decrees, both of which have been so often and clearly forbidden and interdicted by Your Noble Grand Mightinesses, it being for those reasons incomprehensible to us, with all due respect, how Their High Noble Lordships have wished to base this part of the said Resolution upon the sovereign power of the Prince, without examining who was right or wrong, whereas on the one hand, indeed, in this case no necessity in the world was found for the just-cited revocation of our order; because the new Advocate Fiscal, who could not yet be said to have committed any wrong, was not threatened, reprimanded, or restricted in the proceedings, but rather Master Jacob Lakeman, who by his calumnies, disrespect, and unnecessary sought delays, had doubly merited such, according to our contention; furthermore, as long as it was not examined who was right or wrong, it could not be presupposed against us that we would oppose the newly appointed officer in any reasonable request for postponement or delay, from which alone, however, any necessity for revoking our said order could arise, while moreover, through this setting back of the case, the right of a third party, namely Versluijs cum suis, is openly curtailed. Wherefore nothing here can serve as a foundation for the interposition of the said Princely power, employed by way of an extraordinary remedy, which is by no means put into effect by the supreme authority in quibuslibet causis, but very sparingly and rarely, solely in cases of the very utmost importance, peril, necessity, and of a very evident utility, yet with all circumspection, and indeed after all possible examination and inquiry into the true condition of matters, according to all unshakable political fundamental laws. Furthermore, by the said Resolution it was further understood that between the Council and the named Lakeman a final quashing and clearing away of this hateful, confusing, and altogether tedious case (as they are pleased to term it, without any distinction of parties) should take place, wherein the undersigned believe a third injury resides for them, as they are thereby completely and utterly deprived of their right to vindicate, after proper defense, their good name and reputation, which had already been so publicly prostituted, through this ordained amnesty, which remedy of quashing between litigant parties, indeed, is also never decreed by the supreme authority except only in case of momentous necessity between such parties who, being equal in power, come to disturb not only each other but even the commonwealth with actual acts of violence, or indeed threaten it with some danger, of which, however, not a single example can be provided between such unequal parties as presented themselves in this matter, namely so eminent a college of justice and its subordinate officer, and this all the more on account of a correction that was still only threatened in an unspecified manner in futuro, which the members of such a college believed they were bound, by virtue of their office and duty, to put into effect against an improperly proceeded [illegible]

375 a party that has litigated, who had submitted itself to their jurisdiction, far from this, through the irrefutable submitted evidence—tested against law, equity, and practice—of their equitable conduct, and consequently of their manifest blamelessness proceeding therefrom, had far rather deserved a striking reparation of the wrong done to them, and a maintenance of their honor and decency among the public consistent with their conscientious and distinguished character; which public can now retain little esteem for judges upon whom a doubt regarding the sincere observation of their sacred office has still remained residing. Having thus far unfolded to your Noble High Mightinesses the prejudices and grievances which we, the undersigned, believe to be contained both in that which Their High Nobles resolved and transacted on the aforementioned 28th of September, as well as regarding the silently passed-over request that was made by us so urgently for the demonstration of our innocence and the reparation of our honor, namely to be permitted to receive a copy of the accusatory writing submitted against us by the aforementioned Lakeman, in order to be able to defend ourselves against it and further to do as might be advised, we must now with all due respect proceed to that which Their High Nobles were pleased to put into effect further after the date of this resolution with respect to the aforesaid dispute between us and Mr. Jacob Lakeman, by that which was regulated and resolved on the 30th of November 1734, concerning which we likewise (reserving all due respect for Their High Nobles) believe we must now present our complaints to Your Noble High Mightinesses, because on that day it was decided by the said Their High Nobles to send the papers of us and of the aforementioned Honorable Mr. Jacob Lakeman to Your Noble High Mightinesses for consideration in a separate packet and under a separate Register, according to what has come to our knowledge, both through oral report from the presiding Member, Mr. Gerardus Gerlag, on the 14th, and on the 29th of December last, from the extract transmitted herewith under No. 7 from the minutes of what was transacted and resolved in the Council of India on the 10th of December 1734. repeatedly named principal accused, committed against his oath and duty, will be deemed to suffice and be satisfactory; concerning which we most earnestly petition Your Right Honourable Excellencies' authority and orders herewith, as well as such appropriate measures for the maintenance of our weighty judicial office, whereby in the course of time such injuries and grievances may be prevented as we, saving better judgment, believe to have suffered, respectfully speaking, by the three resolutions of Their High Excellencies deduced herewith; inasmuch as no supreme judge ought to be suspected or held to account regarding the exercise of his office, except for clear and weighty reasons, since the same produces incalculable prejudices and harmful consequences for the common good, as appears, among other political writers, in the work of the renowned Cavalcanus, in his Tractatus de Brachio Regio, whose doctrine the undersigned, as very applicable to this matter and as the general foundational argument of their aforementioned grievances, have judged not unfitting finally to quote here, where the same says in the aforementioned treatise, part 5, numbers 2 and 3: Wherefore less praiseworthy are those who frequently and easily lend their ears to complaints and complainants, while the duties of the office are still active, against the judges, who, while they administer with cheerful spirit, eager zeal, and manly vigour the province entrusted to them with all their strength, are harassed and disturbed by the iniquities of slanderers, become weak, lack strength, do not know what to do in the face of such an obstacle, and the office is degraded, and the order of judgment and justice is inverted by so many trifles and complaints. Hence it happens that while subjects ought to be brought back to a better course of life by fear of punishment, the opposite occurs; and when the province ought to be cleansed of evil men and offences punished, then perverse men all the more boldly rise up against honest judges, display their rashness, and make known their contumacy; while the judge loses his good reputation, and becomes so astonished and dismayed that he is rendered almost mute, because where there is no order, there is confusion. With which political maxim, as being incontestable, the undersigned will, provisionally only, step down from these their grievances, and since this respectful letter is addressed to Your Right Honourable Excellencies for no other reasons, they conclude the same for the present, after having commended Your Right Honourable Excellencies together with your precious families to the solely sufficient protection of the Almighty, and having wished all blessings, prosperity, and strength in the exercise of Your Right Honourable Excellencies' weighty offices, and with all respect and submission subscribe ourselves.
