Since, in case Your Right Honourables had believed there to be any basis to have a judicial inquiry conducted specifically regarding that pasquil against the person of this or that individual, or rather of Barent Felix, Your Right Honourables would then also certainly have referred that commission to the Council as well, without prior knowledge of whom the Fiscal is not permitted to conduct any inquests or preparatory informations, both pursuant to the third article of his oath, whereby he comes to swear that His Honour shall make known all matters to the judge sincerely and in good faith to the best of his knowledge and insight, and in compliance with the respective orders of the Right Honourable and Highly Esteemed Gentlemen Seventeen, contained in the missive from the Fatherland dated 1 November 1709, dictating that the Fiscal shall receive all orders from the Council or its President, and report, relate, and submit everything concerning his office to them for deliberation, which in this matter is further found in the missive of the aforementioned Gentlemen and Masters dated 8 September 1683, wherein they come to desire that, since the Fiscal of the Noble Court of Holland, Zeeland, and West Friesland is not permitted to institute any action without prior knowledge of the aforementioned Court, accordingly here the criminal evidence of the Advocate Fiscal must be examined both by the Council and His Honour, following the manner of proceeding before the aforementioned Court, because Their Right Honourables and Highly Esteemed can find no reasons why the aforementioned practice could not be made practicable in the Indies in the same manner; And this has been enacted even more clearly by Their Right Honourables and Highly Esteemed in a previous missive dated 15 July 1718, sent first to the Governor and Council of the Cape of Good Hope, and thereafter sent hither as a guideline for this Council, wherein they desire that the Fiscal shall have to regulate himself in the exercise of his function according to the Ordinance on the matter of Criminal Justice, together with the good authors commenting thereon; for the elucidation of which the Council, in this matter, shall refer only to the 50th and 51st articles of the aforementioned Ordinance and to article 27 of the style of proceeding in criminal cases, together with the comments thereon by S. van Leeuwen in the notes; from which it then follows that, if any special inquests had been demanded by Your Right Honourables, the same would also have been communicated to the Council, and it shall be struck from the above-cited document, notwithstanding that the Gentlemen Gerlag, Della Faille, and Helvetius, being of the contrary sentiment, had maintained that the very same period ought particularly to remain there, as containing within itself one of the very strongest arguments with regard to the aforementioned defense of this Council; extracted from the memorial of the Esteemed Council of Justice of this Castle, and agrees, Batavia, 13 December 1735. with the supplication that, in case your High Noblenesses might be pleased to approve the aforesaid election, to then also kindly qualify this council to nominate another capable subject in place of him, Felis, and to present the same to your High Noblenesses in the aforesaid manner, just as the same can be found word for word in the address of the council submitted herewith under N:o 2, the joint members of the said council have received in response a certain extract from the minutes of what was transacted and resolved in your High Noblenesses' assembly, dated, though erroneously instead of Tuesday, Monday the 12:e of July last, and to their utmost sorrow, beyond all expectation, have reviewed the contents thereof as being unable to comprehend how they could by any possibility have merited, through their said most humble address, your High Noblenesses' indignation that grieves them to the utmost, which, both with regard to the aforesaid nomination and the respectful proposal of an adjunct sworn clerk to be approved by your High Noblenesses, as with regard to the person of the bailiff Barent Felis, who was only merely nominated for it but by no means provisionally elected, is visibly contained in your High Noblenesses' aforementioned resolution with sharp reproaches and the immediate return of the repeatedly mentioned address; for which reason they now also take the liberty to clear and justify themselves hereby regarding the undeserved perception of your High Noblenesses, both concerning the true and essential intention of their aforesaid nomination, as with regard to their said choice having fallen upon the person of Barent Felis, so that your High Noblenesses may thereby be assured that the members of this council, keeping themselves within the bounds of the administration of justice demanded of them, have sought even less to undertake anything, and certainly specifically not with the aforesaid, whereby the political supreme power and governance of your High Noblenesses would be curtailed, or that they would seek to arrogate unto themselves even the slightest part thereof, except solely upon a special qualification from your High Noblenesses, or indeed from the Right Honorable Governor-General, as shown by previous existing examples thereof, which will have to be produced hereafter. Concerning now the proposed defense, which the said members have in this matter deemed necessary to supply to your High Noblenesses for the reasons aforesaid, regarding their nomination of an adjunct sworn clerk, which in your High Noblenesses' aforementioned resolution is presented as a provisional election, it should serve to state that the council deems itself in that respect to have acted entirely blamelessly, since the aforesaid Barent Felix on the 1:e and a clerk at this secretariat named Pieter Haksteen on the 2:e of June last, having addressed themselves to this council in order (as they came to request) to be favored with the vacant office of adjunct sworn clerk, as appears from their petitions attached hereto under N:o 3 and 4, the members of this council, far from wishing to arrogate to themselves the disposition over it, deciding on their aforesaid petitions, referred the same by marginal appointment to your High Noblenesses, being well aware that the disposition over it by no means belonged to them, but to your High Noblenesses, although such was commonly deferred by your High Noblenesses to the council, because they have always been very cautious not to undertake anything that might be outside the limits of their office and duty, in conformity with which aforesaid appointment these said two petitioners subsequently turned, beforehand, with the intention to petition your High Noblenesses, to His High Nobleness the Governor-General, and received as an answer from His High Nobleness that whoever this council were to nominate for the said office would also be appointed; whereupon the aforesaid applicants subsequently, each by a separate written request accompanying this under N:o 5. and 6:, on the basis of His High Nobleness's aforesaid answer given to them, again addressed their supplications to the council; which, however, by the members of this council, out of mere caution not to offend your High Noblenesses, was still not judged satisfactory enough to proceed to a nomination in accordance with the said petitioners' claim, but they have much preferred, as being part of their bounden duty, thought it well, beforehand, the presiding member of this

to commission a member of this Council to communicate the aforementioned requests on behalf of the said Council to His High Nobility, the Right Honorable, Highly Esteemed Lord Governor-General, and respectfully to inquire whether the allegations of the aforesaid petitioners were in accordance with the truth, or not; which having also been complied with by the said presiding member, the same reported thereupon to this Council on Wednesday the 29th of June 1735 that His High Nobility had served him with the answer of Yes, and further that His Nobility left the election thereof to this Council, subject to the further approval of the Honorable High Government of these Lands; after which report was received, the members of this Council then also without further hesitation immediately proceeded to nominate a person for the said employment, as appears from the previously cited minutes held in the Council of Justice on the 29th of June last, considering themselves to be fully authorized thereto by what has been recounted above, the more so because through Your High Nobilities' favor, the election of the recently deceased Adjunct Sworn Clerk Daniel Wannemaker was likewise left to the Council at the time of his appointment, just as the same can be verified in these very words from the copies and extracts attached hereto of what was transacted and resolved in the Council of India on the dates of 14 and 21 August 1701, after which example they also strictly, and even with much more submissive expressions, guided themselves concerning this questioned nomination of an Adjunct Sworn Clerk; wherefore the said members of the Council, with all due reverence, cannot conceive what reasons of offense can be found in their conduct, in which they have exercised so much circumspection and security, unless it must be contained in the clause of their aforesaid respectful address, wherein they request that in case Your High Nobilities might be pleased to approve the election made, you would then also kindly authorize them to nominate another capable subject in place of the aforementioned Felip, and to propose that person to Your High Nobilities in the manner aforesaid, Wannemaker Whereas whereas only in that clause, and nowhere else in the said address, is found the word election, which in Your High Nobilities' resolution is interpreted as if the Council had provisionally elected an Adjunct to the Sworn Clerk; yet in this regard it should be noted that this word in the said address can by no means admit of this interpretation, since in the first place the elected person has not yet been relieved of his post by the Council or employed for the provisional performance of the Sworn Clerkship, but throughout this entire address is only proposed to Your High Nobilities for appointment, in order to await thereon Your High Nobilities' absolute and unconditional decision, and it was not the intention of the members of this Council to give to the said word election there any other force than merely that of a choice or nomination made of the person judged by the Council from two applicants who presented themselves to be the most capable for the more-mentioned post; which in this matter, subject to correction by better judgment, cannot well be understood otherwise, since that election or nomination was proposed in the said address solely for the approval and absolute confirmation, or rather final appointment, to be made by Your High Nobilities, just as Your High Nobilities in former times also attributed that, and no other, force to that word, as is shown by the above-cited resolutions of Your High Nobilities dated 14 and 21 August 1731, where the same word to elect is found repeatedly in the exact same authorization granted by Your High Nobilities to the Council, and from which the address of the Council, questionable in this matter, was almost verbatim drawn and followed, with no further extension or other meaning, as is undeniably apparent from the entire contents of the said address, than solely to propose someone from among the Council's servants to Your High Nobilities, by selection as to capability, for absolute election or appointment; for all of which reasons the return of the contested address, and the never-intended interpretation of the cited word to elect, borrowed from Your High Nobilities' previous resolutions, in the decision taken by Your High Nobilities in this regard, and

3754 held on the 19th of November last, and could also be shown from his own handwritten letter written to the presiding member, Gerardus Gerlag, who thereupon had called the meeting that very same afternoon, which also had the consequence that the said Francois de Koning, although maintaining his assertion in the beginning, nevertheless, upon serious questioning by the undersigned, fell through the basket, the aforementioned petition with the ruling thereon was withdrawn again by the council, and the undersigned was even granted the right by the same minutes to institute such action as should be advised against the frequently mentioned Francois de Koning, according to the evidence of the vouchers under Numbers 3 and 4. The undersigned, who at present is still a stranger in these regions, thus finding himself necessitated by virtue of his office to inform himself about the conduct, life, and ways of the frequently mentioned Francois de Koning, discovered that he was of a very slanderous, wicked, and malicious nature and character, indeed a very harmful subject for this colony and the Honorable Company, as having also, for years past, notwithstanding being in the Company's service, conducted private trade, both with the English and Portuguese and in cargo letters to the fatherland at a third or half profit, contrary to the edicts issued against it from time to time. To verify this for your Honors, the undersigned had Claude de Chuij, former orphan master of this city, and his wife Catharina Reijniera Reijniers en Thoorn heard on articles and interrogatories, whose testimonies, also because of their departure for the fatherland, were reaffirmed in forma probanti at the request of the petitioner before commissioners from this said council, W. V. Helvetius and E. Haak, by way of a valetudinary inquiry, as appears by voucher Number 5. And in order not to let the matter rest here, the undersigned, now finding himself furnished with these two testimonies, believed he could take no more natural path toward uncovering this private trade, so detrimental to the Honorable Company, than to have the said De Koning summoned for the 5th of January last, 3755 to see and hear the request made tending to the end that he, the respondent, should be condemned to answer truthfully to the articles exhibited to the aforementioned council, annexed under Number 6. When the attorney Van Vliet, on behalf of the respondent, upon presenting a certain general power of attorney dated the 7th of September 1733 (although according to the style of procedure in criminal cases no attorneys are permitted to appear for an accused until after he has been admitted to an ordinary trial), requested a continuance, and the petitioner subsequently concluded for the denial thereof, the unexpected and unforeseen consequence thereof nevertheless was that the said request was continued by the council, notwithstanding that their Honors, on that very same day, condemned the aforementioned Francois de Koning for private trade on behalf of Jan Pels and partners, in their capacity, to the payment of a sum of one thousand eight hundred and ten rixdollars, as appears from the vouchers under Numbers 6 and 7. Yet, in order not to depend solely on the answering of the articles and the proof hoped for therefrom, the undersigned also caused some witnesses to be cited for the same day to bear witness to the truth, and among others Mr. Jacob van den Bos, who came to submit to the consideration of the aforementioned council whether venia agendi ought not first and foremost to be requested against his Honor, whereupon, although this was contradicted with much foundation by the undersigned, the petitioner's request was nevertheless absolutely denied by decree of the well-mentioned council against the frequently mentioned Jacob van den Bosch, according to the voucher with Number 8. is each of the members concerned in particular, about which they were consequently not permitted to vote, because no one can be a judge in his own cause, according to the single law in the Code, that no one may judge in his own cause, and as they could in no way judge over this matter, the Council, to whose judgment the request made by the petitioner was never submitted, ought first and foremost, before issuing this questionable order, to have awaited the contrary conclusion of the opposing party, the reply and the rejoinder, at which time they would first have been competent to administer justice thereon, and in no way upon considerations without the express consent and approval of the parties, as is all too well known in legal practice to demonstrate here at length. Leaving aside now that even if Mr. van den Bosch were well-founded in his considerations, which is in no way the case, the Council ought then to have denied the petitioner his request for the present and dismissed the instance in such manner and form as it was requested, as can be seen in Merula, Manner of Proceeding, Book 4, Title 24, Chapter 12, Number 5, and in no way absolutely, as if the aforementioned order took effect here, the petitioner would forever be deprived of the testimony of Mr. Jacob van den Bosch, to which, however, he attaches so much importance, even for the discovery and investigation of the private trade, because his Honor has always been very familiar with the said Francois de Koning. Regarding the subject matter, in order to demonstrate this to your High Excellencies as clear as day, the undersigned must state beforehand that the office of Advocate Fiscal has from ancient times, even among the Romans, see Perezius on the title of the Code on the Advocates of the Treasury and other doctors, and in the Netherlands, always been held in great honor and esteem, both because men of honor, candor, and authority are employed therein, and because in the exercise of their office they represent the Prince or High Authority, and on that account are bound to maintain their rights and sovereignty, and further to do everything that might tend to the honor of Justice, the preservation, and the maintenance of the laws of the land, without showing favor to anyone or concealing or dissimulating anything, dissimulating, see the doctors on the Law on the Advocate Fiscal, to such an extent even that an Advocate Fiscal, in the exercise of his office, may regard neither father, nor wife, children, or any kinsmen, to whom one otherwise owes all reverence, love, and friendship, as is taught by Merula, Manner of Proceeding, Book 4, Title 14, Chapter 3, with notes. For this reason the same Merula, in the said place, Chapter 1, also states very well that the office of Advocate Fiscal is of much greater dignity, esteem, and superior authority than any other advocates, there being as great a distinction between them in the matter of their office as there is between the Prince or High Authority and common people; yea, even your High Excellencies in their written commission call this office an eminent and important office. This then standing unshakeably firm, that an Advocate Fiscal in the matter of his office comes on behalf of the High Authority and represents the same, it follows therefrom naturally that an Advocate Fiscal acting by reason of his office against a private individual, of whatever condition, quality, and rank he might be, need not request any leave to sue for that purpose. So that it is beyond all dispute that the undersigned in the matter of his office has no need of venia agendi, being also customary, as Mr. G. more easily to allege the arguments therefrom by petition, just as the aforementioned Schuijlenburg was called inside and upon questioning in that regard had also acknowledged, whereupon it was resolved to have De Koning and the attorney Jongsma come upstairs immediately; after which, the said Jongsma having come upstairs and having been heard thereon in court, he then stated that he, De Koning, had instructed him a few days ago at the house of the lord fiscal, in the presence of the aforementioned Schuijlenburg and Banier, to present the aforesaid petition, and that not a single word was contained in it except according to his own statement, but that he, Jongsma, had not given De Koning a review of it because of his full hands with work; further, De Koning likewise having been called inside and closely questioned concerning the foregoing, as well as specifically asked whether he had ever given an order for the presentation of the above-mentioned petition, which was at first absolutely denied by him, and upon being further interrogated thereon by the well-mentioned advocate fiscal, the often-mentioned De Koning then confessed that he had indeed given the attorney Jongsma an order to present such a petition, but had not had the same for review prior to submitting it, at the same time complaining that Mr. van den Bosch had brought this into the meeting, because he had told it to His Honour this forenoon as a good friend and not as a judge, requesting that this council, along with the advocate fiscal, be pleased to excuse him in this matter; but whereupon, the said officer having declared that he was by no means satisfied with this, the more so because De Koning, upon his questioning, had stated that if the parties in question were found to be of such a nature that they could be declared capable of composition by this council, he, the advocate fiscal, would then consider himself satisfied without claiming anything from him, but on the contrary now requested proper satisfaction from this council, declaring that he in no way wished to abide by His Honour's clarification already made on the submitted petition concerning the said council, but to revoke the same hereby; thus it was thereupon further thought fit to leave reserved to His Honour such action as he shall believe pertains to him to institute as he shall be advised, and also to retain the presented petition together with the disposition written behind it and subsequently have it kept at the secretariat of this council, and also to keep this matter between the lord advocate fiscal and him, De Koning, in that state in which it was prior to the date of the presented petition. The Council, having heard the oral declaration both of Mr. Jacob van den Bosch and of the procurator van Vliet, denies the request made by the Council Official Requiring Party regarding the said Mr. Jacob van den Bosch; further grants against the non-appearing respondents the requested defaults for the benefit thereof, and condemns them, together with the respondent Joachim van Vliet, to give testimony of the truth for the benefit of the Council Official Requiring Party. After the pronouncing of the above-mentioned appointment, the Council Official Requiring Party protested the nullity and harmlessness in respect of the first clause of the above-mentioned appointment, as intending to seek revision against it and at the same time to act in case of nullity, requesting that note be made thereof for reasons to be further deduced. The Council, having considered the request and the protest made by the Council Official Requiring Party, still persists by the above-mentioned appointment and rejects the aforesaid protest as irrelevant and insufficient against the appointment of this Council founded upon its privilege. Certain articles drawn up by the undersigned acting officer, answered by the former orphan master Claude de Chuy et al. on 24 November 1734 and on 7 December following verified under oath, with No. 5. Also several articles and interrogatories drawn up as before in order to examine thereon the aforementioned Francois de Koning, with No. 6. to judge concerning being summoned without obtained leave, but that to Your High Honours, as representing sovereignty in these Lands, solely and privatively belongs taking cognizance thereof, just as it is known all too well in law, for only the Emperor who granted the privilege ought to cognize and judge concerning it, teaches Vromans in de Foro Competenti, Book 1, Chapter 1, Number 19, wherewith also agrees Gail, Book 1, Observation 1, Number 6; namely then when there is a dispute regarding the substance of the privileges, or whenever the same touches upon the right of the prince, just as here, where the undersigned in the matter of his office proceeds on behalf of the same and represents the High Authority, for reasons that the sovereign alone is a lawful interpreter and judge of such prerogatives, as Vromans in the said place in the notes very well remarks, substantiating the same with much authority from laws and legal scholars. For this reason it is also that Emperor Charles specially ordered his Stadtholder, together with the President and Councillors of the Court of Holland, Zeeland, and Friesland, as representing the Countship of the aforesaid Lands, to the exclusion of all other judges and magistrates, alone to take cognizance of privileges granted both to subjects and to foreigners, not being subjects, residing within the aforesaid Lands; see the Instruction for the Court of Holland, 2nd, Article 8. Copy 3792 Certain extract from the minutes of the proceedings and resolutions taken in the Council of India on Tuesday the 10th of May 1735, accompanied by a copy of the further petition of the Advocate Fiscal of the Netherlands Indies, Mr. Adrianus Bergsma, concerning the agitated questions and differences between this Council and that officer over the ruling issued here on the date of the 5th of January 1735 in the case of his Honour, ratione officii, against the fellow member of this Council, Mr. Jacob van den Bosch, having been presented here in Council by the presiding member of this Council, Mr. Gerardus Gerlag, on the 11th of this month; so it is understood by this Council, after resumption of both, to thank Their High Honours hereby most respectfully for the communication and delivery of the aforesaid further petition, as well as, declaring themselves thereupon, to testify that the said petition, having been submitted without day or date in the same manner as the preceding was likewise submitted to Their High Honours, is nevertheless considered by this Council as an ingredient, or rather appendix, to the preceding petition of the aforementioned officer, submitted by the same upon reconsidering his unsettled thoughts solely for further substantiation and defense of his undistinguished assertion, as if the members of this Council would not be permitted to judge on privileges wherein the College could have any interest; which has already, alongside other improper pretexts, been refuted by Their High Honours in the report of this Council submitted on the 6th of May last; the text of the said report further insofar as the Advocate Fiscal is excused, etc., with the citations quoted there from Vromans, De Foro Competenti, Book 1, Chapter 1, Section 1, in the notes, Number 1, from the beginning almost to the middle, and from S. van Leeuwen, Censura Forensis, Part 2, Book 1, Chapter 13, Number 18. But it being noted that the repeatedly mentioned officer, in this his further submitted writing, avails himself of the just-cited Vromans, De Foro Competenti, Book 1, Chapter 1, Section 19, and Gail, Book 1, Observation 1, Number 6, or rather Number 7, for the substantiation not so much of whether the Council would not be permitted to judge on privileges touching their College, but, changing his tune, as wishing to prove therewith that the Council is not permitted to judge at all on any privileges, and consequently also not on the privilege of not being summoned to law without obtained leave, since such, according to those cited doctrines, belongs solely to the High Authority, and therefore was specially commanded by Emperor Charles to his Stadtholder, together with the President and Councillors of the Court of Holland, Zeeland, and Friesland (though his Honour apparently means West Friesland, that is, North Holland), as representing the Countship of the aforesaid Lands, to the exclusion of all other judges and magistrates; so serves to express the sentiment of this Council thereupon that the Advocate Fiscal, regarding these his two latter assertions, is entirely in the right, and we can also never contradict such, nor have we wished to, but only come to maintain that that special delegation of jurisdiction over the privileges, which otherwise belongs solely to the Prince, In the afternoon extraordinary meeting. claimed, by the high authorities of these Lands, both to the Council of Justice, which in these regions constitutes an equal court, indeed even equals the High Council in judging, as ruling by arrest, is deferred, as the same is granted to the highly mentioned Provincial Court (though by no means so privately and to the exclusion of other judges as the officer comes to pretend from the cited 8th article of the instruction of the aforementioned court), in proof of which position the Council hereby only refers to the 5th article of the Batavian statutes, under the title of The Council of Justice, where it is said that in original jurisdiction before this Council shall come all matters touching the country's freedom, Sovereignty, Lordship, N.B. Rights, Domains, finances, etc., regarding which, moreover, Voet on the title ff. de Constitut princip. no. 26 is decisive in every respect, from which it appears that the jurisdiction in question is indeed specially delegated to this Council; and this has likewise never been contradicted, but from all times until now has been thus observed, whereas furthermore it should be considered that the privilege de non in Ius vocando absque impetrata venia regarding the Members of this council and all other persons is debated before this College, and the aforementioned leave was always obtained from this Council, excepting the persons of Their High Nobles, against whom such is petitioned solely from the High Government itself, which special exception clearly demonstrates that besides this, against all other persons, such must be requested from this Council as being fully competent in this regard, and the Council was then also competent to judge thereon according to findings; whereby it is believed that all doubt regarding this point has been removed; for which reason it is further understood to qualify the presiding Member of this council, Mr. Gerardus Gerlag, to deliver this minute with all observed reverence into the meeting of the highly mentioned Their High Nobles for the contemplation of Their Honors when settling these differences, and to implore their beneficial reflections in this regard, underneath stood, in the presence of me, was signed C. Tuesday the 13th of January 1671. Present all except the gentlemen and Mr. Willem van Outhoorn; Jacob van Dam, Aernoud van Overbeeke; Daniel Wichelhuijsen, and Francois van der Lee. Mr. Cornelis Snoeck, fiscal of India, making a brief oral report of the information that he, in his official capacity, with communication and license from the Honorable high authorities here pursuant to Your Honorable Honors' appointment of the 24th and the 30th of the recently past month of December, has obtained regarding the bad conduct, vile practices, honor- and oath-forgotten impieties, etc., of Mr. Daniel Wichelhuijsen, councillor in this Honorable Council, considering that the petitioner, in order to prove all the same clearly to the satisfaction of the law with full evidence, requires the testimony of the gentlemen and masters Willem van Outhoorn, Jacob van Dam, and Aernoud van Overbeeke, fellow councillors in this Honorable Council, and that it is reasonable and Christian to bear witness to the truth, especially in matters of such highly weighty importance, as these are, where the widely renowned and never blemished honor, good name, and reputation of our highly praiseworthy authorities, the luster of Justice, and the welfare of this flourishing community are concerned to the very highest degree; so the claimant requests, in the name and on behalf of the above, the aforementioned gentlemen Outhoorn, van Dam, and Overbeeke, that Their Honors may be pleased to give sincere testimony of all that has appeared and is known to Their Honors regarding the aforementioned matter, and that the other gentlemen of this Honorable Council will be pleased to condemn the mentioned Mr. Outhoorn, van Dam, and Overbeeke thereto, insofar as it might be necessary. The summoned gentlemen maintain that they ought to remain excused from this demanded declaration, since Their Honors are fellow Members of this council with Mr. Wichelhuijsen, and furthermore that that which Their Honors have knowledge of regarding this are matters that were made known and presented to them by the mentioned Mr. Wichelhuijsen in familiar and mutual discourses; further submitting to the consideration of the Honorable President and other gentleman Members of this Council whether Their Honorable Honors (who at present, due to the involvement in law of Their Honors the three summoned ones and the illness of Mr. van der Lee, are only four votes strong, sufficiently preserving the respect of this council) are competent to condemn them, the summoned, in this matter, without apparent and special order from His Honor the Noble Governor-General and the gentlemen councillors of India.
