The Council of Justice of the Castle of Batavia presently finds itself, besides the manifold businesses with which it has been occupied for some years now far more than ever before, compelled to submit a defense to the assembly of Your High Excellencies against the irreverent complaints of its officer, who without doubt, through the counsel and instigation of others, seems to have resolved to extend his defined authority and power much further than a good and properly regulated subordination allows, and that even by indirect and extraordinary means, namely by immediately addressing the High Authorities without any necessity or requirement of the matter and filing improper complaints against his judges, whereby not only the luster and the authority of this Court is extremely diminished and vilified among the public contrary to decorum, but also the present weakness of this Council, in which at present only six permanent members find themselves, deprived of its absolute president, who otherwise could de facto defend the same before Your High Excellencies with a concluding vote in judicial matters, cutting short many excessive troubles on occurrences of this nature; whereas on the contrary, at present, in the absence thereof, very many circumstances and heavy occupations are required, to the utmost grief of the few members, being utterly overwhelmed, and their pure zeal in the observance of the justice so sacredly entrusted to them is extinguished and made burdensome. 3800 Wherefore the mentioned Council, before proceeding to the matter in question itself, hereby most earnestly requests Your High Excellencies for a proper maintenance of its rights and privileges, to the luster of Your High Excellencies yourselves, who without any dispute indeed share in every way in the honor and esteem of those who administer justice according to office and duty under the political supreme government of Your High Excellencies, as that was the fundamental argument of that imperial, prudent compiler of the written Roman law in the proemium of the Institutes, stating that the imperial majesty ought to be not only decorated with arms but also adorned with laws, which indeed are executed before the judge, etc. Which having been remarked beforehand, it further serves regarding the matter in question itself, that the aforesaid Council, having had sight and reading of a certain detailed petition presented by the Advocate Fiscal Mr. Adrianus Bergsma to Your High Excellencies on 14 January of this year, containing diverse complaints and invectives against the mentioned Council over and regarding a certain order issued on 5 January in the case of the mentioned Mr. Adrianus Bergsma by reason of his office against Mr. Jacob van den Bosch, fellow member of this Court, having been summoned by the aforesaid officer, alongside several other persons, to bear witness to the truth, without making known in the least in the said summons in what case or against whom the mentioned inquests would be employed, but where

since, however, this information, as the Council subsequently observed, was aimed at taking action against one Francois De Koning, who had only simply been approached and civilly sued by His Honour; which petition and documents relating thereto having been placed, by order of Your High Excellencies, into the hands of the members of this Council, in order to supply Your High Excellencies with the reasons that had moved the said Council to deny the request of that officer and to dismiss it; thus the aforementioned members, although daily very busy with litigious civil as well as criminal cases, nevertheless in obedience to Your High Excellencies' decision contained in the minutes of the date aforesaid, will state regarding this matter as briefly as possible: that the case in question having been called on the court roll, Mr Jacob van den Bosch immediately appealed to the local laws and statutes of these lands, which dictate under the title of manner of proceeding, art. 2, in terms, that the supreme authorities of the land, those of the Court of Justice and the court, as well as the respective officers, may not be summoned to court by anyone, unless with special consent, etc.; against which the said advocate fiscal orally asserted that that law did not apply to him, claiming that he himself might summon a Councillor of the Indies to court without requesting veniam agendi, having known how to support that stance of his with no other reasons than solely that, acting ex officio, he was upholding the right of the supreme authority; in refutation of which argument the members of this Council consider it sufficient that the advocate fiscal, in the performance of his office, is indeed to some extent to be considered as a dual person: sometimes acting on special instruction and order of the supreme authority, in which case he must be furnished with a special resolution of Your High Excellencies, and sometimes again acting against someone by virtue of his office, with communication or indeed on special order of the Council; but in both of which cases, he is notoriously always obliged to regulate himself according to all the laws of the land, unless he has been specially exempted therefrom, from which it also then absolutely follows that he may not summon a member of the Court of Justice to court without having beforehand either been furnished with a special order from the supreme authority or having otherwise obtained veniam agendi, because this has been established in the just cited article of the statutes without any exception in honour and lustre of the said members of this supreme college of judicature, and which, as far as we are aware, has never yet been contradicted or disputed by any officer; the great and rather fastidious fuss which the advocate fiscal makes in his aforementioned petition to Your High Excellencies, as the basis of his unfounded stance with regard to his character, together with the added ample account of what His Honour is to do in that office and how far the same places him above other advocates, etc., being in no way of any force against the said article, but completely superfluous, unless His Honour might thereby seek to extol himself above the members of the Council, contrary to the still prevailing orders of the Honourable and Respected Lords Seventeen of the date 1 November 1709, because he represents the prince of the land in the exercise of his function, just as if this Council were not likewise to do so, whereas after all that representation resides far more strongly and powerfully with the Council itself than with the officer who, according to the cited homeland orders, is subordinated and strictly subject to them, who is only regarded there, as far as his fiscalate is concerned, as a minister of the Council, which exercises the imperium merum in criminalibus to the exclusion of him, the fiscal, and without whom he is capable of undertaking very little, indeed can commence or execute no proceedings, except when there might be periculum in mora, pursuant to the orders of the lords and masters of the date 15 July 1748 sent to the Governor and Council of Cabo de Goede Hoop, and also imparted to this Council as a guideline; it being, moreover, notable to that end that the jus gladii was after all not mandated to him, the officer, but to the Council itself, for which reason it may and must be maintained with all justification that a fiscal does not represent the supreme authority so absolutely, but rather that His Honour, ex titulo procuratorio and utpote advocatus fisci, only acts and conducts affairs for the supreme authority ex mandato; all the more so since His Honour, after all, daily requires a authorization, both from Your High Excellencies and from the Council, upon his report or on the basis of own finding, to uphold the justice of the land and to prosecute the punishment of offences, all pursuant to the highly revered orders just cited; which dependence of the advocate fiscal on the said authorization of this Council would be contradictory to itself if such ample representation of the prince, as he seems to imagine, resided in his person, that absolute representation only having a place in officers of subordinate judges, who are capable of exercising much more a mere causarum cognitio than the merum imperium judiciale, and to whose officers also truly in everything the exercitio principalis potestatis belongs; Wherefore this distorted elevation of the office of the advocate fiscal yields a very weak argument in this instance, as if the advocate fiscal, by virtue of his office, would have no need for a veniam agendi against Mr. Jacob van den Bosch, who is a permanent member of this Council, to which Council he owes all respect; whereas such is especially granted as a privilege concerning the entire College by an explicit law, in very ample and general terms, on the exact same footing as that same privilege is attributed to Your Right Noblenesses, without the slightest limitation or exception regarding an advocate fiscal or anyone else who, although enjoying the very same privilege, is nevertheless not entitled to infringe against the will and consent of the beneficiaries upon a privilege granted to a college. Nor does it make any difference in this matter that Mr. Jacob van den Bosch was merely summoned to bear witness to the truth, having neither advantage nor disadvantage, honor nor dishonor to expect therefrom; as this is likewise an impermissible limitation regarding various matters over which legal action might be directed, the present case depending solely on whether he was summoned before the judge without obtaining permission or not, which can be denied neither by the advocate fiscal nor by anyone else, the law speaking in general without distinction of cases. As for what further concerns the precedent alleged by the advocate fiscal as a foundation, namely that an officer in the matter of his office by custom would have no need for a veniam agendi, and that Mr. Gerardus Gerlag had experienced such in person when his Honor was summoned in a criminal case before this Council by Mr. Everhard Kraeyvanger in his official capacity; in which regard the Council might well retort to Mr. Adrianus Bergsma that which he himself alleged in his petition, that one must live not by precedents but by laws, yet against this it shall incontrovertibly serve here that the said advocate fiscal misses the mark very unluckily in this respect, because Mr. Everhard Kraeyvanger aforesaid, after he had already previously submitted a report to the Council of India upon the requisition of Your Right Noblenesses themselves, was indeed properly provided with a special resolution of Your Right Noblenesses before his Honor legally addressed the said Mr. Gerardus Gerlag, whereby he was ordered to summon the same in a criminal case before this Council, and therefore had no need for a veniam agendi, as can appear from the trial records filed therein and resting at the secretariat of this Council, of which two documents are annexed hereto in copy. However, the advocate fiscal has been somewhat remiss in this case, because he did not properly examine those proceedings and was merely too hastily satisfied with the extract of the minutes of the claim brought against Mr. Gerardus Gerlag et al. serving on the appointed day, whereby he furnishes the weapons that diametrically oppose his contention; and he would have acted much more prudently to have let himself be somewhat better instructed by his advisors, for he would then have found that Mr. Everhard Kraeyvanger submitted the authorization of Your Right Noblenesses, by virtue of which he was entitled to sue Mr. Gerardus Gerlag in court without obtaining permission, prior to the date of filing his claim here in Council, and at the same time verbally requested that the aforesaid Mr. Gerardus Gerlag might be barred, pending the same proceedings, from continuing to hold a seat as a member, which was also granted to him. Just as obscure and ridiculous is also that the advocate fiscal says in his petition that Captain Johannes Giesken, having a seat in the assembly of the Aldermen and thus being able to enjoy one and the same privilege with Mr. Jacob van den Bosch, to wit, not to be summoned in court without obtaining permission, was nevertheless condemned to bear witness to the truth; since the advocate fiscal, being the legal scholar, ought well to know that Johannes Giesken, not having appeared upon the summons made, had to be condemned by virtue of default due to contumacy, the proposed exception of Mr. Jacob van den Bosch having been just as freely available to the aforesaid Giesken had he appeared; however, by virtue of the non-appearance, no nullity of the citation could be maintained on the foundation of the said privilege, because everywhere in our fatherland, contrary to the provision of Roman Law, for the maintenance of the dignity of judges, it is prohibited and ordered that by virtue of any privilege no citation is void, but that parties shall be obliged to make known by way of exception their privileges and defenses to the judge before whom they are called, unless possibly the province of Friesland, holding itself very strictly to the written law, might alone still practice this. Wherefore the default of Johannes Giesken must also have had the consequence that he was deprived of his privilege, which he ought to have alleged in court; it being furthermore also remarkable in this matter that the advocate fiscal did not cite the said Giesken with the addition of his official title.

For which reason it also makes no sense at all that the advocate fiscal makes such absurd outcries, as if the council appeared to bind itself little more to the laws and statutes, since the direct contrary is true, as the council issued the decree in question precisely according to the letter of the statutes of these lands. Against which he had not the very least reason to protest nullity and harmlessness, just as for that reason the same protest was rejected as insufficient and irrelevant, since his duty and the reverence he owes to the council required that, instead of making such an improper and unusual protest against the decree of his judge on the public court roll in manifest malice, he should merely have sought revision. Which must apply no less to the prerogative in question, which is granted to each of the members not personally, but to the college itself as a real privilege, to the honor and luster of the council, which each of the members enjoys because they make up the council, and not as a prerogative granted exclusively to their private persons. For which reason the council also believes not only to have been competent to issue the debated decree, but also to have been permitted to exercise moderation therein, without having to execute the law with strict rigor in this particular case. Wherefore the fiscal ought to have regarded that non-condemnation with gratitude, as a grace shown to him because, still being a stranger in these lands—as he himself alleged in his petition—he might be judged to have committed this error without suspicion of evil intent, having as yet little knowledge of such a particular local law. And consequently the aequitas legis itself came to require this, which cannot be presupposed to wish to punish those who offend through ignorance, but rather those who proceed with evil intent. Furthermore, regarding this matter in question, it is also to be noted that the request made by the advocate fiscal against Mr. Jacob van den Bosch was not rejected absolutely in the aforementioned decree in question, but in general terms, and that truly only through a careless notation by the retired secretary Bernardus Coop a Groen. was proposed, and also by both of them alone hinc inde was left and remained for decision to this council, which is entirely erroneously denied by Mr. Adrianus Bergsma in his petition to Your Right Honorables, though he will not dare to deny that, presente judice and in the hearing of all the attorneys at the public roll, he contradicted the privilege alleged by Mr. Jacob van den Bosch, first by proposing that this privilege had no application with respect to his person, indeed not even regarding the members of Your Right Honorables assembly, or whoever it might be, because he, as an officer representing the supreme authority itself, would per se be excepted from that general rule; secondly, this dispute has been fully contested through various reciprocal arguments conducted both by him, the advocate fiscal, and by Mr. Jacob van den Bosch concerning the authority of the office of a fiscal and the exception of his person erroneously deduced therefrom from the aforementioned general words of the frequently cited second article of the statutes, these debates even having been carried on back and forth so long and often that, in order to bring an end to matters, the presiding member of this council, Mr. Gerardus Gerlag, had to request the said two litigants to stand outside, so as to allow the judges before whom they had aired this dispute at the ordinary time appointed to regulate and decide litigious matters the freedom to deliberate thereon, to which they both immediately conformed and went out of the council chamber without any further exception or contradiction, thus leaving their question, debated up to a sextuplicate, to the decision of the council without any reservation, which, considered together, incontestably constitutes an oral pleading de plano, as well as a full tacit consent in law, as otherwise the parties would have had to request a day or take terms, for it is indeed not to be supposed that they raised this dispute stante rotulo merely in jest, but on the contrary that they thereby tacitly renounced all ordinary terms, which in this case, where the question was solely de jure and concerning the interpretation of the law itself, would also have been superfluous, since here no productions nor the consequences thereof were required, yea where not even a reply or rejoinder was necessary, as these are less customary in matters that are disputed de plano and stante rotulo, as may appear from the successive rolls of this council, wherein hundreds and more examples of that kind are found, as well as from the criminal roll of the advocate fiscal himself against the deserters and petty prisoners, in respect of whom these requisites of a complete pleading are never observed; and it is also incontestable that it belongs to the discretion of a supreme judge to regulate a pleading, to conclude regarding the same as required by the joinder of issue, and to reduce and shorten the terms when they are deemed unnecessary, ut patet from art. 28 of the instruction of the Court of Holland and art. 11 of the ordinance on justice in the cities and in the countryside, together with the notes thereon by Simon van Leeuwen, concerning which may further be consulted Merula, Manier van procederen, lib. 4, tit. 42, cap. 2, per totum, and Vromans, De foro competenti, lib. 3, cap. 1, § 3 and 5, cum additionibus. Noble, High and Mighty Lords A certain extract from the minutes of the proceedings in the Council of Your High Nobilities having been delivered and communicated by the presiding member of our council, Mr. Gerardus Gerlag, concerning a petition presented to Your High Nobilities by the fellow member of our college, Mr. Jacob Lakeman, wherein he complains about and on account of the fact that the said presiding member allegedly had a meeting convened and held on Monday, being 16 May, without To His High Nobility the right honorable and highly esteemed gentleman Abraham Patras Governor General together with the other Noble Gentlemen Councillors of the Dutch Indies. having proper notice thereof given to him, with further requests as found at the end thereof; wherefore the undersigned have the honor (being specifically named in that petition), in obedience to the orders of Your High Nobilities and to demonstrate the unfair treatment of his fellow members by the said Mr. Jacob Lakeman, and to clarify his unfounded complaint to Your High Nobilities, to submit the following: that it was not without the utmost astonishment that they observed from the said petition that the said member of our council feigns such ignorance, as if he knew nothing in the world concerning the defense of the undersigned against the petition of the Advocate Fiscal Mr. Adrianus Bergma, whereas on the contrary he well knew, as will also be clearly evident to Your High Nobilities, that the undersigned members, by order of Your High Nobilities, were to supply the reasons that had moved them to treat the matter between the said Advocate Fiscal and Mr. Jacob van den Bosch in the manner as was done. For the said fellow member of our council, Mr. Jacob van den Bosch, having been summoned by the Advocate Fiscal to bear witness to the truth without prior request for veniam agendi, maintained, after the reading thereof, that such a summons conflicted with the order contained in the second article of the statutes of these lands, under the title of Manner of Proceeding. This being contradicted in judicio by the Advocate Fiscal, and debated on both sides before this Council, the question was thereupon, after mature deliberation, decided in favor of Mr. Jacob van den Bosch by unanimous vote, except that Mr. Jacob Lakeman saw fit to interpret the said privilege of the Council to the detriment of the College (whereas it was nonetheless his duty to maintain the same by virtue of his office) and to admit, to the advantage of the Advocate Fiscal, an unlawful exception to the general wording of that law, which had nowhere been enacted, nor ever maintained, as being entirely contrary to the laws received among us and contrary to the opinion of all doctors, as is clearly taught by the renowned legal scholar Andries Gaill in his Practicarum Observationum, Observation 90, where he clearly states: singulariter esse receptum fiscum tantum privilegiatum in casibus in jure expressis, in non expressis juris communis dispositionem locum habere; that is, namely, that an advocate fiscal is uniquely privileged only in such cases as are expressed in the law, but that where he is not specially exempted, the general disposition of the law applies to him, uti Imperator in L. fin: Cod: de usuris Fiscal: expresse jubet fiscum suum suae sanctioni parere, & L: 6. Cod: de Jure Fisci, whence it appears that the fiscal, no less than others, is strictly bound to the law and obligated to observe the same religiously. Concerning which decision the Advocate Fiscal saw fit, although he had no reason whatsoever to do so, to complain, and with exceedingly irreverent and insulting assertions against his judges, to trouble Your High Nobilities in your weighty affairs; whereupon reasons were also demanded by Your High Nobilities that had moved this Council to deny and reject the request of that officer. However, regarding this defense of their decision, the undersigned judged, and that indeed in the presence of Mr. Jacob Lakeman, that it did not concern him; which they still, with due reverence, maintain in law. Since he had been of a contrary opinion, he was not obligated to defend the position of the undersigned, his fellow members, against his own sentiment, and he could not possibly have conformed to the said defense; for, as it is beyond all contradiction, in rendering these reasons the matter had changed its character entirely, and the undersigned members of the Council no longer acted as judices jus dicentes, or as judges administering justice, but as persons accused by the Advocate Fiscal before Your High Nobilities who had to defend themselves against his irreverent complaints. Among which accused Mr. Jacob Lakeman could by no means be counted, since the same complaints were not directed against him, who, if any wrong had been done, could not be called to account for it because of his contrary opinion, but solely against the undersigned, who had decided the matter in that way. It therefore also notoriously follows that the said fellow member had to be considered naturally excused from that defense, and it is for that reason incomprehensible how he could presume to complain to Your High Nobilities about it on the grounds that, being an ordinary member, he ought to have had communication of the said defense by virtue of his office. This is truly the height of absurdity, as has already, it is hoped, been shown to the satisfaction of Your High Nobilities, though it may yet serve for clearer and more evident support that this defense of the Council against the Advocate Fiscal cannot be regarded entirely as

Therefore it is indisputable that Mr Jacob Lakeman, if he could even come into consideration here, could not be regarded otherwise than as a prejudiced party, or indeed one joined with the advocate fiscal, whose unlawful stance he had so strongly protected against all his fellow members, just as he certainly would also take a very great part and share in his triumph, which we, however, do not expect from the fair judgment of Your High Nobilities, but after which he, alongside the advocate fiscal—the two of whom seem to have intended to overwhelm the other members by turns daily with their sought-out and improper questions and disputes—is aspiring to the utmost according to his cast vote. All of this having been considered by Your High Nobilities, it appears undeniably contested that the aforementioned Mr Jacob Lakeman could not join with the undersigned regarding that matter, or defend something of which he had continuously, pertinaciously, with so much zeal maintained the contrary against the opinion of all his fellow members, and it follows from this that he is rightly excluded here. The aforementioned fellow member would have had greater and more sufficient reasons to address Your High Nobilities in such a manner if he had not been consulted in matters wherein he, alongside the other members, ought to have functioned in his office as a judge, as then undeniably no inspection or reading of such papers could or might be refused to him; but by no means in this case, for then Mr Jacob van den Bosch, with rather more foundation, would also have had to assist us in our defense, being likewise an ordinary permanent member in our council (upon which Mr Jacob Lakeman bases himself most), and moreover fully agreeing with his sentiment daily with the accused judges, upholding the privilege of the council from which Mr Jacob Lakeman had desisted by his advisory opinion. Indeed, an injustice would likewise have been done to him if he had been passed over when Your High Nobilities had seen fit to demand an advisory opinion from the council regarding the aforementioned privilege, but not where we are compelled to give Your High Nobilities reasons and an account of our decision, which he alone contradicted himself, and for the justification of which the undersigned had no need of the disapproval of Mr Jacob Lakeman, just as he also could have contributed nothing to the corroboration of our sentiment, and possibly only sought to obtain communication thereof out of curiosity. With this the undersigned could end their defense, but since the aforementioned fellow member pleases to say in his petition that, in order to prevent further difficulties and disputes, he let the aforementioned matter pass in silence as being done, since he thought that with that minute annexed hereto (which was delivered to him at his request, and whereby the reasons for his excuse are also made known) he was sufficiently armed for his discharge, and consequently only complains principally about the scheduling and holding of a meeting on the Monday afternoon following thereupon, without any warning or notification having been given to him thereof; so they cannot refrain from advancing solely against this that Mr Jacob Lakeman acts very poorly in seeking to bring Your High Nobilities into that mindset, namely as if in the aforementioned meeting matters of a completely different nature were treated, whereas in fact nothing other than the resumption of the more cited defense took place, at which the undersigned judged that he ought not to be present, as the reasons for his excuse had been made known to him in accordance with the preceding minute, with which he had also been content, and (as he himself rightly judges in his petition) being with the same sufficiently armed for his discharge. It was, moreover, not strictly necessary that this defense be resumed in the council, and that resumption could very suitably have taken place by the undersigned at their houses (if they had agreed with one another in that manner), since, as clearly shown here above, it was not an act for all the members in their office and quality as judges, but only for those by whose advisory opinion the repeatedly mentioned decision had come into the world.

3824 seen as consisting solely of arguments, without the aforesaid Honourable Mr. Bernards having brought forward in his writing any other valid proofs in this regard against the Honourable Mr. Dehase, so far as has appeared to him. However, concerning the Gorontalo matters, in which the said Honourable Mr. Dehase was accused, first, of having engaged in a most foul, illicit private trade in the Company's linens by bartering for dust gold; secondly, that the linens at Gorontalo were sold by the resident Jan Nebbens much more dearly than was accounted for to the Honourable Company, and that His Honour was said to have enriched himself thereby; and finally, that His Honour was said to have taken and appropriated to himself the overweight of the gold on the aforementioned two standard weights, purchased there from time to time from the native on the Company's behalf: the advocate fiscal declared, regarding the first point concerning the private trade, that he had a cause of action against His Honour according to the letter of the placards issued on the matter of private trade, since it clearly appears from His Honour's original missive dated 28 March 1733, written to the aforementioned Nebbens and found under document letter C, that His Honour had sent to the said resident Jan Nebbens 74 pieces of salempuris, brown and blue, and 39 pieces of betilles to barter for dust gold for his own needs, as His Honour claims therein; although the said advocate fiscal believed that it ought not to be described with the name of a most foul illicit trade, being of little consequence if His Honour had not engaged further in it prior to this. Therefore, under correction of a better opinion, he was of the position that the accusation on this point ought to be suspended and everything in the meantime left in statu quo, because regarding the two remaining points, namely the excess profit on the linens and the overweight mentioned in the submitted draft missives of the resident Jan Nebbens, frequently mentioned herein, which were said to have sent dust gold to His Honour, the said advocate fiscal could in no way consider those proofs, given the denial of the Honourable Mr. Dehase of ever having received such a missive with the dust gold enclosed therein, 3825 as sufficient to institute a criminal action upon them against the Honourable Mr. Dehase as yet without foundation, since the same are found to be very blotted, crossed out, and altered, mostly without day or date. But since it can nevertheless be clearly gathered from those letters exchanged between the aforementioned His Honour and the aforesaid Nebbens how the matter truly stands, as charged against the Honourable Mr. Dehase in the writing of the Honourable Mr. Bernards, the said advocate fiscal was absolutely of the opinion that, on the one hand, a proper inquiry should be made with the former fiscal of Ternate, but presently second in the government of Makassar, Willem van Beseler, as having had in consignment from the resident Jan Nebbens, frequently mentioned herein, to the said Honourable Mr. Dehase two small bamboos marked F: O: H:, and, if it should be feasible, with the mates of the sloop Het Wijnglas, Andries Hetteling and of the sloop De Windbuil, named Claas Visser, who were stationed there at that time, and who were also said to have had in consignment, in the manner as before, two small bamboos marked F: O: H:, to determine whether they were aware of what was enclosed in the same bamboos, on what account this arose, and from where it originated; and, on the other hand, that the aforementioned resident Jan Nebbens ought to be summoned from there hither by Their Excellencies, the Noble High Government of these lands, and likewise that those of Ternate be ordered to send over at the same time the returns of the goods sold at Gorontalo from 4 August 1732 to 18 February 1733, and to make further inquiry among the Company's servants and natives as to what price the linens were sold for there at that time, in order to enable him to conduct a further inquiry into this matter here, whereupon he will be better able to declare whether and what action he might have against the said Honourable Mr. Dehase in this regard.

In regard to the point of private trade, this Council believes that upon further or closer investigation private trade might indeed be discovered, but that in this respect, even though on the basis of the aforementioned produced evidence very heavy suspicions and indications do arise against the repeatedly mentioned Honorable Mr. Dehase, these are nevertheless not deemed in all respects convincing enough to take legal action against His Honor; besides which this Council also still finds itself obliged to present to Your High Honor that, even if what was raised by the Honorable Mr. Bernards regarding the excess profit on the linens were found to be true, the same would amount to no more than about three hundred rixdollars and by no means, as the mentioned Honorable Mr. Bernards mistakenly charges against the Honorable Mr. Dehase in the account marked Letter B, a sum of 1748. 3/4 rixdollars; with which, expecting to have complied with Your High Honor's respected order and adopted resolution, the members of this Council together with the Advocate Fiscal shall presume the honor to sign themselves below: Right Honorable High Commanding Lords, lower: Your High Honors' Obedient Servants The Council of Justice of the Castle Batavia, and thereunder: By Order of the same, was signed: Gl. Honourable Worships, Shows with due reverence Stephanus Versluys, ordinary Councillor of the Indies and former Governor of Ceylon, that it has appeared to him, the petitioner, from the claim brought against him ratione officii by the Mr Advocate Fiscal Mr Adrianus Bergsma on 2 March last, that along with it His Honour has not submitted the documents, rulings, and minutes regarding the proceedings taken against the petitioner prior to the aforementioned date, 3831 with those of his preceding Councils by Mr Jacob Lakeman, whose successive requests the petitioner has only understood by rumor to have been no less injurious and infamous than the proceedings themselves were violent and bloody, without him ever having had inspection thereof and thus occasion to clear himself against the same insofar as necessary, or to act in this matter as its weight might require; and although it is by no means to be blamed in the already mentioned Mr Advocate Fiscal Bergsma that His Honour, by withholding these documents, has sought to cut off the opportunity to express His Honour's opinion thereon, it is on the other hand also true that the proceedings could not be brought to proper formality if the petitioner were not provided therewith on his part, especially now that so much is at stake for him therein in every respect; having furthermore also found that, alongside the above-mentioned claim, several documents included under the inquests held in Ceylon have not been produced, which the petitioner needs in the highest degree for his defense, and of which authentic copies are in his possession, but since, while the originals are available, no justice could be done thereon by Your Honourable Worships, he has been obliged likewise to represent this to Your Honourable Worships and, in conclusion hereof, to request with the utmost emphasis that he may be granted authentic copies of the minutes and rulings upon his successive requests as well as upon those of Mr Jacob Lakeman, and furthermore of such documents as may have been produced in court or otherwise rendered by Your Honourable Worships in relation to the petitioner prior to the bringing of the claim; as well as that the Mr Advocate Fiscal Mr Adrianus Bergsma may be enjoined to add, by way of amplification to the register submitted with the claim, and to produce in court, such Ceylon documents as are specified in the annexed list. Furthermore, it enjoins the said Advocate Fiscal to exhibit here in court all such Ceylon documents as are listed on the memorandum annexed to this request, and in so far as they may be in His Honour's possession, together with properly amplifying his submitted register of documents. Honourable and Worshipful Sirs, With great respect, Joan De Mauregnault, merchant and former fiscal of Colombo, remonstrates that the petitioner, upon the resumption of the claim and conclusion made and taken ex officio by the Advocate Fiscal Mr. Adrianus Bergsma on and against the Honourable Ordinary Councillor of the Indies and former Governor of Ceylon Stephanus Versluijs, with the removed members from the Colombo Political Council, as well as the petitioner, on the 2nd of the past month of March, observed that the said officer, likely not wishing to express himself on or interfere with the violent and injurious proceedings held among others against the petitioner by Mr. Jacob Lakeman under the specious title of defender of the rights Friday 27 May 1735, present all except in this matter the gentlemen Gerlag, Lakeman, and Dellafaille. No. 41 judge of the high authorities and the Honourable Company as of the date aforesaid, has by no means submitted any documents relating thereto, or much less the declarations, requests, and other representations made successively in court, both orally and in writing, as well on the part of the aforesaid Mr. Lakeman as of the petitioner, with the rulings and minutes rendered on that occasion before Your Honours, whereby the trial with respect to the petitioner would remain so far informal unless he provided therein by this humble address to Your Honours: Cum non sit dubium quod ad effectum ut reus se defendere possit oportiat quod copia processus sibi decernatur per judicem ac etiam tradatur, as is demonstrated from the doctrine of more than twenty of the most famous jurists by Sebastiano Guazzini, De defensione reorum, defensio 24, chapter 3, number 1, by which author in the same place, chapter 3, number 1, this general proposition is further illustrated and incontrovertibly proven to the petitioner's intent: Quod reo edi debeant omnia acta et indicia et ea omnia quae ad reum pertinent Since there is no doubt that, in order for the defendant to be able properly to defend himself, it is proper that a copy of the proceedings be granted and also delivered to him by the judge. That to the defendant must be delivered all acts and indications, as well as everything relating to the defendant, even though he might thereby be harmed in the slightest. The first reason thereof is because by not granting all the acts to the defendant, the judge would strip him of the means of defence, which he may not in the least take away. Lakeman, to whom as plaintiff, by resolution of the aforementioned Their High Excellencies, a copy of the aforementioned supplied reasons has been granted, which therefore, according to law, can no longer be withheld from the petitioner as defendant, since plaintiff and defendant proceed on an equal footing according to the last law in the Roman-Imperial law book on the fruits and costs of legal proceedings; and for that reason, what is permitted to the plaintiff must not be denied to the defendant, according to the 41st rule in the comprehensive book of the Roman civil laws: on the rules of law. Indeed, to the petitioner even more favor should be due, by virtue of the 125th law in the comprehensive book of Roman civil laws on the rules of law. It is true that the delivery of the document in question to Mr. Lakeman (who without doubt will have transferred it, along with the further documents concerning the petitioner, to the present Advocate Fiscal) did not originate from Your Honorable Ascendancy as judge, but this in no way prevents that Your College should have obtained knowledge thereof, and from that learned that the petitioner, if he were not placed on an equal standing with his party in this matter, would be subjected to a notable grievance. And since it can be unknown to no one that a judge is specially obliged, at the instance of the aggrieved party, to repair all grievances, which now cannot happen otherwise than through a like delivery of the repeatedly mentioned document to the petitioner, for which in the subject case a powerful argument can still be drawn from the words of the above-cited Quazzin, defense 24, chapter 3, number 2. So this shall also constitute one of the final requests at the end of this petition, in which he must first demonstrate to Your Honorable Ascendancy that, alongside the claim of the Advocate Fiscal Bergsma, such documents among the inquiries conducted on Ceylon and committed to paper as are specified on the attached note have also not been produced, of which the petitioner must avail himself for his defense; being fully grounded to request the exhibition thereof herewith, not only by virtue of the previous legal allegations, but also because jurists (according to what can be found in P. Menula, practice, book 4, title 38, chapter 1, number 5) hold and understand that the plaintiff, upon the request and instance of the defendant, must and ought to produce all instruments that in any way serve the case and can advance it, notwithstanding that the plaintiff does not wish to avail himself of them in court. For all of which reasons and motives the petitioner turns to Your Honorable Ascendancy with the respectful request that there may be delivered to the petitioner in proper form: Firstly: the minutes and rulings, both upon his successive verbal and written requests made prior to the date of the claim, in so far as copies thereof are not yet in his possession, as well as the declaratories, counter-requests, and further writings of Mr. Jacob Lakeman, with the rulings and minutes rendered thereon; and further such extracts from the criminal court roll as concern the petitioner and can serve for the instruction of the proceedings.
