3735 or against the purpose and objective for which the same was introduced, namely to allow everyone to attain, in the end, good justice and experience of equity in a manner that is accountable before God and men, all of which the petitioner has thus deemed necessary to present with great respect to Your Noble Right Honorable Lordships, on the one hand because he considers himself to have been inextricably bound thereto by duty to himself and to the righteousness of his case, as also on the other hand, and principally, because he has not despaired of still moving Your Noble Right Honorable Lordships, by means of this petition, to view the request for relief in an entirely different light and accordingly to redress, to that extent, your decree of the 26th of the recently elapsed month of September, which, because it was delivered solely by interlocution and does not concern the substance of the dispute in the least, would be no novelty, since it is known in law and clearly demonstrated from the same, among others both in the manner of proceeding before the Court of Holland at chapter 14, article 84, and in particular in Merula, title 92, chapter 1, number 4, that the judge ex officio, without any improper interest, may of incumbent duty revoke such orders until the definitive sentence; however, the petitioner has much preferred to leave such matters to the equity, as well as the usual prudence and enlightened judgment, of Your Right Honorable Lordships, rather than to make a special request anew thereto. But as he is thereby still placed in uncertainty as to what Your Noble Right Honorable Lordships will be pleased to approve ex officio in this matter, and his duty nevertheless entails looking after both his lawful defense and the proper progress of the proceedings, he has meanwhile had to consider other means to arrange the matter, if not entirely, then at least in part, in such a manner that his written defense will not remain fruitless for him and obscured from Your Noble Right Honorable Lordships, and that nevertheless the above-mentioned interlocutory decree of the 26th of the last passed month of September would be satisfied, whereby the petitioner, pursuant to the clause which the advocate-fiscal Bergsma has seen fit to insert into his conclusion for rejection of the requested relief to answer, has been left unimpaired regarding his right to produce by relief such evidence as he might deem necessary for his vindication and defense, under which head it will then be open to him to produce by relief the aforesaid defense writing as the clearest and most powerful evidence for his vindication, indeed as a general guide or key for all the further evidentiary documents, 3736 documents which without that would for the most part be incomprehensible to Your Noble Right Honorable Lordships and virtually useless to the trial, and thereby to afford the officer occasion to introduce against it, by reproche and defense, whatever His Right Honorable Officer might judge to be convenient and applicable to the matter; which nevertheless, if the decree of Your Noble Right Honorable Lordships should remain as it now stands, since he was thereby denied the relief to answer, cannot in any way take place without separating and deducting not only the head but also specifically the conclusion, by both of which such was properly brought to the state of a judicial answer against the claim, and thus bringing this notable document within the terms of an exhibit; but since the said conclusion would thereby entirely lapse and become illusory, upon which conclusion everything nevertheless specifically depends in the termination of the proceedings, and in which the petitioner therefore has a very great interest, since the same goes further than the simple contrary conclusion which was taken against the claim on the public roll of Your Noble Right Honorable Lordships on the date of 2 May last on his behalf, he has, on the same grounds and motives which the Right Honorable and Venerable Directors in the Assembly of Seventeen were pleased to suggest in their frequently cited general letter of 10 November of the past year to the advocate-fiscal Bergsma—namely, when the case of Mr. Versluijs cum suis was not already too far advanced through an intervening definitive sentence, to renounce his instance and, with reimbursement of costs, to alter the claim in chief—now also had to see fit to renounce his preceding conclusion in the very same manner, to the end of also making the necessary corrections and amplifications in that regard for his part, against which he is therefore absolutely of the opinion that no obstacles or impediments can any longer be conceived: on the one hand because it would be exceedingly monstrous, against all grounds of law, indeed of irreparable injury and glaring injustice, if one wished to dispute something against the petitioner as defendant, to which the way was opened for the advocate-fiscal Bergsma in a similar case as plaintiff; and on the other hand because this also does not go against the practice and contemporary administration of justice, pursuant to which, under benefit of the requeste civil, at all stages of the proceedings, even until after the pleading has closed, a conclusion once taken may be altered and thus an error or omission committed therein may be redressed, as all our jurists

Vrooman, De Foro Competenti, book 2, chapter 5, verse 4, and book 3, chapter 4, paragraph 8; G. van Wassenaar, Praxis Judiciaria, chapter 2, number 13; as well as the Manner of Proceeding before the Court of Holland, title 11, chapter 1, paragraph 8; in which manner anyone under the same benefit is also always free to amend, amplify, and alter his libel of claim or answer, as well as to state and verify new facts, according to what is likewise taught by those same authors and is not only expressed more broadly by Professor Voet ad Pandectas, book 4, title 1, number 3, but is also further confirmed by a specific judgment rendered in the cases before the High Council of Holland and recorded by Councillor C. Neostadius, Decision 69; wherefore the petitioner would have had to pursue both of these avenues pari passu if it had not pleased Your Honorable Worships to leave his right to production unimpaired and thereby afford him the opportunity, as already stated above, to submit his written defenses—if not in the form of an answer, then at least in that of a piece of evidence for his exoneration by way of relief; which alone moved him, under this limitation and restriction, to waive the last instance and to direct his request at the end of this document separately to the first, after he shall have once again submitted to the equitable consideration of Your Honorable Worships whether everything that has been deduced at the proper place in this memorial with respect to the preceding request for obtaining relief of answer is not newly confirmed and established in a very emphatic manner by the arguments adduced here to demonstrate that according to present-day practice, at all times, yea even when the case is already in a state for judgment, correction, amplification, and alteration may and can take place as well in a conclusion once taken as in a judicial pleading of claim or answer; for if this is true, as indeed it admits of no contradiction, it surely causes all the more astonishment that one could still have called into doubt under some trivial and futile pretexts that the relief of answer would no longer be admissible after taking a contrary conclusion against the claim or after the expiration of some terms, and how one could moreover have pretended that the manner of proceeding in a criminal case could have suffered any detriment by granting it, since nothing was requested other than what in such cases coincided punctually with the manner of proceeding itself. So many weighty matters, so many powerful arguments, so many fundamental rules of law, so many opinions of the most renowned doctors, and so many examples in daily practice before the respective courts of this capital of the Indies itself, as have throughout been cited in this matter, make the petitioner live in hope that Your Honorable Worships, taking an equitable reflection thereon, will be pleased ex officio to alter your interlocutory decree of the 26th of the past month of September and to admit him as yet to relief of answer; but in case he should be unfortunate enough to have conceived a mistaken notion regarding this, he nevertheless now addresses Your Honorable Worships with great respect, requesting, on all the preceding grounds and motives, which he therefore also expressly adheres to in this matter, under the benefit of requeste civile, notwithstanding the state of the lawsuit, to be permitted to alter and amplify his conclusion of answer taken apud acta in such manner as he shall deem serviceable for the furtherance of his good right and for a lawful defense, and consequently to be restored against the default that he did not do so at the proper time, as well as relieved of all errors and omissions committed therein, with committimus and referral to the public roll of Your Honorable Worships. to proceed to their absolution or condemnation, aside from the fact that one of these delinquents was not a subject of the Company, but according to their own letter a subject of the king of cochim, and consequently could not and should not have been brought before the judicature of this court in case of appeal, but ought to have been handed over there for punishment to the king of cochim according to the tenor of the contracts without any further provocation. Secondly: How the petitioner, learning of this under a solemn protestation of his innocence upon the public roll of the honorable council of justice, requested the separation of his proceedings from those of the others; and the mentioned advocate fiscal having declared himself not to be a party in that matter, this was granted to him, and at the request of his honor a term was set from three months to three months, or as much earlier as he or the petitioner cum suis might be ready, in such manner as is further evident from the interlocutory order rendered in that regard, accompanying this under Letter B. Fourthly, that the frequently mentioned officer, on the date of 19 October last, when the term set for the answer had already long expired, having summoned the Honorable Mr. Versluijs and some other members to answer, His Honor, alongside others, not only requested another month and a few days' postponement for that purpose, but also required of the former Fiscal of Colombo, Johan de Mauregnault, a full term of three months to that end, all of which was also granted to them according to four other similar extracts from the court roll of that date, alongside this under the letter D. How painful it must have been for the petitioner, notwithstanding Your High Noble Lordships' initially taken favorable disposition, to nevertheless afterwards be summoned away from his office and prosperity and to be convened here before a court of justice, he will not need to demonstrate in this matter, since Your High Noble Lordships, in your more discerning judgment, will be able to penetrate this far better than he can express with a defective pen. The supplicant also by no means intends to inconvenience Your High Noblenesses with a lengthy and burdensome recital of one thing and another, but will merely take the liberty to note here how he, from the year 1730 to 1732, properly held the offices of fiscal at Galle and Iaffanapatnam, as well as, as aforesaid, that of secretary, with his meager salary of ƒ20, yet nevertheless with such zeal as if he had already been favored with the corresponding rank and wages. the former Governor of Ceylon, Stephanus Versluijs, and further political council members, as well as the aforementioned Roeland Cau, having been delivered, together with the answer submitted against it by or on behalf of him, Cau, could not properly as yet express their thoughts to either of the respective parties, but rather to Your High Excellencies, as being the sovereign authority of these lands, in order to prevent that they, being bound in time to judge that case as judges, by giving their preliminary advice might become entangled in an exception of recusal as was raised and proposed by the Ceylon prisoners in the year 1733; nevertheless, in order to comply as far as possible with Your High Excellencies honored intention, the members of this Council will with all veneration propose to Your High Excellencies hereby that regarding what was requested, namely whether the case of Roeland Cau could be handled separately from the other defendants, the members of this Council, subject to correction by better judgment, maintain in the negative, since the case for him, Roeland Cau, is so closely intertwined with that of the aforementioned former Governor of Ceylon, Stephanus Versluijs, and the other said political Colombo council members regarding the accusation concerning the made and maintained conclusion of Mr Adrianus Bergsma, against the present Governor of Ceylon, the honorable Dideric van Domburg, that it cannot well and properly be adjudicated in his respect earlier, or a public sentence be pronounced, without detriment to either of the respective parties, who would thereby be unarguably prejudiced in their further proceedings on one side or the other; Yet with relation to what was requested by Your High Excellencies in Your High Excellencies aforementioned resolution, namely whether he, Roeland Cau, could be employed in the service of the Honorable Company, it is served that while the Advocate Fiscal himself has not judged any corporal punishment to be applicable against the aforementioned Cau, and that therefore the aforementioned Cau has also been released from personal appearance and permitted to appear per procuratorem, this Council then also believes that the said Merchant Roeland Cau, with the pleasure of Your High Excellencies, could from now on, notwithstanding that the course of the proceedings along with their pleadings have not yet been finished, be employed in the service of the Honorable Company, as more examples thereof are to be found, and which the members of this Council also believe that in case Your High Excellencies should please to accede thereto, the same could take place without the slightest prejudice to the Advocate Fiscal or the right of the sovereign authority, provided however that he, Cau, in case he is placed in service by Your High Excellencies elsewhere than here in Batavia, shall be obliged to choose domicilium citandi et executandi and to provide security for the judgment, after which the Council believes his person is no longer needed here, for several reasons enclosed in the very nature of these proceedings, which if necessary and further required could be amply and broadly deduced. With all which the members of this Council hope to have complied with the honored orders of Your High Excellencies, wherefore they take the liberty, without inserting any further reasons here that for the present are to be considered premature, to subscribe themselves with all reverence and high esteem. Friday the 14th of September Anno 1736 Having been brought into this meeting by the Lord Extraordinary Councillor Master Isaac van Schinne, as President of the Honourable Council of Justice of this Castle, two bundles of criminal trial documents and one accompanying bundle of documents recently arrived from Mallabaar, in order to serve here before the said Council in case of appeal, with the declaration that their Honours were unable to decide on these matters, on the one hand because the delinquents had not been sent here along with them, and on the other hand because the Commander of Golonesse, instead of having the Fiscal appeal if he felt aggrieved by the pronounced sentence, had placed himself Extract from the Minutes of the Proceedings in the Council of India as appellant not only against the aforementioned sentence, but also moreover against the demand of the Fiscal; so it was, after consideration of what was necessary, thought fit to hand back to their Honours the said documents, together with the passage from the Cochin letter in which this registered appeal was mentioned, in order to inform this Government of the irregularities and informalities residing in those proceedings, so as to confront the Mallabaer ministers with the same in outgoing letters for their instruction in the future. Having now spoken again about the writing and annexes submitted by the Lord Advocate Fiscal Master Adrianus Bergsma to the Noble High Government of these lands on the 15th of December of the past year, with the request that the same might be forwarded under cover of the Company's papers to the Noble High Honourable Lords Seventeen, and of which, alongside its annexes, an authentic copy was delivered on the 21st thereafter at the special request of this Council, and read in this Council on the 29th following thereafter; so, after the Lords Vander Duijm and Van Reverhorst had requested to be excused regarding their giving no advice on that matter, as being cases and disputes that occurred before their Honours' arrival, which was also taken into consideration by this Council and thus granted, it was furthermore resolved by a majority of votes to leave every Member of this Council free to mount such a defense against it in particular and send it up to their Noble High Honours as their Honours should deem proper for their defense; whereupon it was requested by the Lords Master Gerardus Gerlag, Master Jacob van den Bosch, Master Jacob Lakeman, Master Bernard Jacob Dellafaille, Master Willem Vincent Helvetius, likewise by the collective and present co-opted members, to have an authentic copy of the said writing as soon as possible, in order to act in that regard as their Honours should each in particular be advised, which was then also decreed by this Council. for the frame of the bulkhead, notwithstanding that it had been properly provided with double planks, transverse and upright, together with solid cleats and upright timbers, two of the upright planks next to each other had been broken off from the inside in the hold, and joined together with iron plates on the inside; just as also a plank of the same bulkhead was chopped through from the outside, running transversely from one board to the other and corresponding with the aforementioned two planks, with an axe, chisel, or some other instrument, through which one could very easily enter the hold, all the more so since a piece of sailcloth had been attached to the inside of the two upright planks in order to lift them out of their grooves once the outer broken planks were removed. Furthermore, upon inspection of that vessel, in order that such might not be discovered, it was also found that the points of the nails of the innermost planks by which that double bulkhead was fastened together had been broken off, their heads left embedded therein; subsequently, various square plates with nuts were let into the aforementioned upright and downward planks and firmly secured with nails. Holes were bored into the outermost broken planks, the ends of which were covered by the cleats or upright timbers, and arranged in such a manner that they could be joined together with the innermost upright planks by screws—the grooves in the heads of which were covered both by the bunk and with wax—fitting onto the aforementioned nuts, without any defect being visible from the outside or from inside the hold, no matter how carefully that bulkhead was inspected. 1729 held at the aforementioned place, in order, pursuant to the intention and decision made by resolution of the first-mentioned date, and in accordance with the order and authorization of the High and Mighty Lords States General of the United Netherlands in their High Mightinesses' dispatch and resolution of 28 9ber of the year 1733, received for the first time with the ship Meijenberg on 14 July thereafter, to dispose, according to the state of affairs, upon and concerning the contents of the request sent along therewith and presented to their High Mightinesses for and on behalf of the aforementioned members of the said court-martial, being the persons of Dirk Bierins, Pieter Cornelis de Patoi, Thomas Termatte, Rudolph Peijselaar, Daniel Evertse, Hendrik Coorenaar, Pieter Sneek, Leendert Overschie, Theunis Holst, and Cornelis van Aerden, insofar as concerns the request found therein for the obtaining of their High Mightinesses' letters of abolition, in case, in the proceedings held by the said court-martial, through the petitioners' inexperience in criminal matters, they might not have acted with the required circumspection, and the petitioners might thereby have incurred some form of offense; but having had to postpone the taking of a final decision on the aforementioned day or the 16th of this month for reasons, and on that account, it now being proposed to the assembly by the Lord Governor-General to bring an end to this affair, etc. etc., it is, in consideration of the one and the other, and also the circumstance of the fear and subjection in which they stood with respect to their Governor, unanimously approved and resolved to abolish and annul that which has been committed and trespassed by the aforementioned six members of the Ceylon court-martial who are still alive, both in the appointment of that court-martial itself and in the proceedings held, and all further matters in connection therewith, as well as whatever might in any respect have been abused or forfeited thereby, and consequently to have the required letters of abolition issued in order to be delivered into their hands; yet nevertheless having them pay, according to the taxation of the Council of Justice of this Castle, the costs and expenses of justice that may have been incurred, and furthermore reserving to ourselves to dispose further concerning the expenses which the Honorable Company has borne on their account through the payment of monthly board money according to what was resolved on 15 July of the year 1734, since they were transferred from their detention, upon the instruction by their High Mightinesses in the dispatch of 28 9ber previously, into arrest on one of the bastions of this Castle, whenever the order and approval of their High Mightinesses shall have been received in this regard, to whom it was furthermore resolved to address oneself for that purpose, as well as, along with a succinct report of the matters, to bring 15763 3764 Wednesday 17 October 1736 this disposition of ours respectfully to their knowledge, and to send nothing other than an authentic copy of the aforementioned granted letters of abolition, but on the other hand to have all the papers which were delivered to us by the present Advocate Fiscal of India beside his first report returned into his hands to be delivered to the place where they belong. Saturday the 3rd of November 1736: Present all except the gentlemen Schutten, della Taille, Helvetius, and Rengers the last two due to indisposition. On behalf of the Advocate Fiscal, the request below was submitted to the Council on 31 October last, and alongside it was submitted a register with various documents mentioned therein, the said request reading as follows: Request Mr. Adrianus Bergsma Advocate Fiscal of India The Advocate Fiscal of India Mr. Adrianus Bergsma submits herewith a register with various documents, from which your Honorable Worships, if you please, will observe that according to the accusations of the prisoners Passchier Norbertus Dupree and Ian Iansz. van Dusselen, former forest rangers' assistants in Banda, among others in the year 1734, the hostage Barent Schalkers, former steward's mate in Banda, and Martinus Veerman, currently residing there, had engaged with them in the illicit trade of the Company's precious spices. That the hostage, having been heard on these accusations in full council against the aforementioned prisoners and having resolutely denied everything, was subsequently condemned by decree of 22 August last to go into hostage and to remain there without access to friends and relatives until he should be heard upon articles, which was also carried out on the 23rd following in the presence of the Commissioners; the undersigned, having deemed it beneficial for the discovery of the truth, examined the hostage and the aforementioned Passchier Norbertus Duprie and Ian Iansz. van Duffelen further on articles and points of confrontation against one another on the eleventh past; which also resulted in the two last-named asserting the fact directly to the hostage's face and maintaining it, just as they had done in full council, with so many circumstances that there is not the slightest doubt that the hostage, despite denying everything in an utterly brazen and self-assured manner, made himself guilty with the prisoners and the aforementioned Martinus Veerman of this foul illicit trade; all the more so since, in answering article 7, he even maintains that he never had any knowledge, acquaintance, or association with these prisoners in Banda, directly or indirectly, much less that there had been any grudge or enmity between them, except only that the prisoners, as the hostage presumes, must have conceived some grudge against him because, when they were transferred here in the irons, he had not sent them any tobacco upon their request; that although the hostage made mention of this in full council when asked, and in answering the articles, and only later thought of this during the confrontation regarding article 20, it does him more harm than good, because this presumes some knowledge, acquaintance, and association, which the hostage nevertheless so obstinately denied. Indeed, how is it also possible and conceivable that these prisoners, against whose life, conduct, and behaviour nothing else can be said, should be so wicked and godforsaken that, having never lacked tobacco there in the irons, they would falsely accuse the hostage against their better conscience solely for these futile reasons, besides the fact that they then would also have named no other accomplice except the hostage. So that these accusations, if they do not merit full credit, at least produce sufficient proof for torture; for although accomplices in crime legally have little credit when heinous crimes are committed, this does not always hold true, and especially in political crimes such as these, all the more so when nothing else can be said against the accomplices; and thus your Honorable Worships also seem to have understood it in the terms when, upon the bare accusation of the prisoner Ian Andries Shaland and these, without any other suspicions, the repeatedly mentioned Dupree and van Duffelen were summoned from Banda, their goods inventoried, and subsequently incarcerated. Wherefore the Advocate Fiscal, in order to be able to carry out his office and duty against the aforementioned Barent Schalkers as is proper, has decided to address your Honorable Worships with the humble request that the provisional hostage may be changed into an incarceration, alongside granting inventory and sequestration of his goods; or else, in case your Honorable Worships should conform with the report of the requiring officer with regard to the requested summoning of the aforementioned Veerman hither, that the hostage may be continued until such time as the just-mentioned Veerman shall have arrived at this place, been examined concerning this, and if necessary also been confronted with him. Seen by this Council an extract from the minutes of what was discussed and resolved in the Council of India on the 27th of this month, presented today by the Honorable President, and noting therein that Their Right Excellencies the High Indian Government of these lands, regarding the further requested public trial of various persons from Banda suspected of the illicit trade in spices, had only deemed fit to approve that the ministry there be sharply ordered to have the edicts against the illicit trade in spices found there renewed without delay, and to have them strictly observed by everyone, and especially and most seriously to recommend that the Governor and Fiscal pay close attention thereto and proceed rigorously against offenders without any connivance; it is therefore decided by this Council to absolve from the instance Barent Schalkers, currently held in civil custody, along with his slave Samo of Macassar, on condition of paying the costs, and to have this inserted into the criminal roll of this Council. Honorable and Respected Gentlemen, The Advocate Fiscal of India, Mr. Adrianus Bergsma, having reviewed the criminal proceedings instituted by him ex officio against the prisoners Paschier Norbertus Dupree and Jan Jansz: van Dusselen, both former assistant foresters in the service of the Honorable Company on Lonthoir in Banda, as well as Cupido of Timor, slave of the first-named, finds himself obliged to submit to Your Honorable Worships that the first two prisoners have, among other things, voluntarily confessed that in the past year they sold and delivered to the petty officers of the vessel Cats a total of twelve hundred pounds of nutmegs and one hundred and thirty-six pounds of mace, at one rupee per thousand nutmegs and three schellingen per pound of mace, which spices the prisoners had from time to time ordered their slaves to gather from the forest, and thus collected in their dwelling and concealed, where they were subsequently, with the help of their own and other hired slaves, carried out at night in sacks and brought to the aforementioned vessel using the orembai of the deceased perkenier Welman (quod notandum), which on that occasion was also smashed to pieces. That the prisoners, moreover, suspected that the large perkeniers were all guilty of this illicit trade, indeed held it as practically certain, for the reason that they had sold to the petty officers of the vessel Cats alone twelve hundred pounds of nuts and one hundred and thirty-six pounds of mace, and would not have been capable of supplying so large a quantity of spices, amounting to four hundred and eighty thousand pieces of nutmegs and seven hundred and four pounds of mace, as had been privately brought in by the aforementioned vessel.

That according to the account of the park-keeper Lucas Claese de Jong to the prisoners at his house, on the occasion that he had asked them about their delivery to the vessel Cats, in the presence and hearing of the surgeon of Lonthoir, Ian Baptist Fluri, he and several other park-keepers, namely Wouter Tempezel, the now deceased Iohannes Welman, Fredrik Mol, Samuel Gilberts, Willem Maurits, father Boudewijns, the now deceased Adriaen van Houthuijsen, being the former son-in-law of Boudewijns Alphonsius, Paulus Bijsterveld, and van Maelden, all engaged in this illicit trade, without the prisoners, except for the first two named, being able to accuse this or that one of the said park-keepers with certainty, except only that the prisoner van Duffelen had 36 pounds of mace to sell from Willem Maurits two years ago, having around that same time also bought two pounds of oil from his slave named Hes van Timor, at one ducat the pound, just as the prisoner Dupree is also aware that the aforementioned slave had also sold one pound of nutmeg oil to the aforesaid Martinus Veerman, which he, the prisoner, saw himself, and also understood from the said slave that his master, in addition, had sold fourteen to sixteen pounds of nutmeg oil at that time to a certain assistant surgeon, without being able to state the name. That the just-mentioned park-keepers Lucas Claese de Jong and Wouter Tempezel had already for a considerable time been guilty of this foul illicit trade with the ship's crew, as the prisoners Dupree and van Duffelen come to declare with much certainty and grounds of knowledge, and among other things that it supposedly happened so publicly that it was well enough known to everyone on Banda, yea even the Honourable Company's guard on Lonthoir, it having among other things happened in the year 1734, according to the account of the barber and painter's mate Basthiaen to the first-named prisoner, that a certain Macassar washermaid of Tempezel, who went to complain about her master to the chief of Lonthoir Willem concerning his illicit trade with the ship's crew, was brought back by the guard's corporal and subsequently taken home, whereupon the said slave woman was severely punished for this and clapped in irons. Not to mention that these latter accusations appeared to the undersigned in no way rejectable, but on the contrary of very great probability, both with regard to Tempezel, because in a short time he turned from a poor man laden with debts into a well-to-do man, making good cheer daily, besides that he also made himself very suspect through his conduct with the officers of the vessel Cats, as appears from the report of 16 November 1735 submitted to Your Right Honourables, and is also intending, if things go wrong for him on Banda, to take to the wind immediately with his vessel; as well as with respect to Lucas Claese de Jong, partly because he, along with the other park-keepers, was very consternated about the summoning of the prisoners hither and, as they say, put their heads together, and partly also sought to slip a young pinang or two grass root ties to the three prisoners mentioned in the heading hereof while in the irons on Banda, in all appearance to make away with them through the use thereof. To which finally comes that the oft-mentioned Lucas Claese de Jong, among other things, asked the provost Simon Dirks on Banda whom the third prisoner, Cupido van Timor, was accusing, and whether he also said by which orembai the spices had been brought on board; who, answering this last question in the negative, but that he had indeed heard murmuring about the orembai of Mr De Jong, the latter thereupon frankly testified: that is not true, but it was with the deceased Welman's orembai, for they even had that orembai smashed to pieces; which is very remarkable because it agrees with the prisoner's confession as noted above. So that the Banda burgher Martinus Veerman, the park-keeper Willem Maurits, but most especially the park-keepers Lucas Claese de Jong and Wouter Tempezel, have made themselves guilty of this foul illicit trade with the ship's crew, as will appear in more detail to Your Right Honourables upon reading the criminal proceedings. Wherefore the undersigned Advocate Fiscal, on the foundation of the evidence placed in the register under letters A, V, Z, AA, and DD, accompanying these in authentic copy, would be of the opinion, subject to correction by wiser judgment, that one ought to address the Honourable High Government of these lands with a humble request that it might please Their High Honours to write to the government on Banda at the first opportunity, in order, upon adjudication of the claim and conclusion brought against the prisoners Dupree and van Duffelen, to sell their inventoried goods by public auction and to remit the net proceeds of the confiscated property into the Company's treasury, furthermore to take into secure custody the Banda burgher Martinus Veerman, the park-keeper Willem Maurits, his slave Floris van Timor, Lucas Claese de Jong and his male slave Doulaet, Wouter Tempezel, along with a certain Macassar slave woman belonging to him, being a washermaid and clapped in irons two years ago.
