Which matters the Orphan Masters, in their aforesaid capacity, find themselves obliged to demonstrate to your Right Honourable with the required modesty that, subject to correction, they ought not to be so; but on the contrary, in three respects are diametrically opposed to all laws, to the prevailing Dutch practice, as well as to the fundamental and basic laws, together with the special orders of the Company in these regions. Against the statutory laws they are, in the first respect, contrary, since it pertains to the common good that lawsuits be decided more swiftly, as attested by Bartolus on Lex 1, Codex de novo Codice faciendo, number 22, and because it is also in the interest of the State that lawsuits be dispatched as quickly as possible, as noted by Claudius Barsius, Decisiones Bononienses 32, number [illegible] Statement of the assets, income and expenditures of the two Portuguese churches of this capital city Batavia, anno 1738, being [illegible] under sixty thalers, subsequently [illegible] first native [illegible] pieces of gold baptism [illegible] rixdollars six [illegible] Thonisz, with the under [illegible] 3431 23 32, number 14, following the learned doctors commonly on Lex 13, Codex de Iudiciis, on which grounds the Emperor Zeno in Lex 12, Codex eiusdem, has most earnestly urged all magistrates and judges to conclude legal proceedings as shortly as possible; and the law is everywhere full of such wholesome provisions, for it belongs to the office of the Judge to decide lawsuits with magnanimity and swiftly, Novellae 83, chapter 1, and to cut off the opportunity for protracting them, Lex 12, Codex de contrahenda stipulatione, since it is harsh for cases to be drawn out endlessly and for matters already settled to be reopened by improper ways, Lex 21, paragraph finale, Codex de fide instrumentorum; the canon laws also being very elegant and notable in this respect, when one hears them dispose that it is proper and required by equity that the controversies of litigants be terminated by a swift sentence, Chapter Iurgantium 2, de sententia et re iudicata, since it ought to be the work of the judge to put an end to lawsuits, Chapter Finem litibus 3, de dolo et contumacia. Indeed, the most renowned jurists even consider brevity to be one of the essential parts of the law, so that a judge—according to the excellent speech of the French President du Vair, delivered at the opening of the Chamber of Justice at Marseille in the year 1597, page 214—ought to take no more time for the settlement of a case than is due to him, because he otherwise makes himself guilty of the damages and inconveniences that this inflicts upon the parties; all of which finds its application principally in cases that are brought criminally and therefore affect the honour and reputation of an accused, indeed even in some way of his heirs and descendants, regarding which the statutory laws have explicitly determined in Lex ultima, Codex ut intra certa tempora criminales quaestiones terminentur, that criminal cases ought to be finished within two years, and not be drawn out to longer periods on any occasion; and of old, by those same laws—as can be seen from Lex 15, paragraph 4, Digestis ad Senatus Consultum Turpillianum—no more than one year was set for the conclusion of a criminal trial from the moment of the joinder of issue; which is brought into agreement with one another by Professor Antonius Matthaeus, De Criminibus, Book 48, Title 19, Chapter 5, number 5, on the authority of the renowned Cujacius, in this manner: that if the accused pleads his case from prison, one year must be observed; but if released, two years; this being used to be observed so strictly that even Andreas Gaill, De pace publica, Book 1, Chapter 9, number 14, likewise demonstrates from the foundations of the law that the definitive sentence passed at the latest after the expiration of two years is entirely null and void. And where would it end if everything had to be laid open in this matter that could serve further as a peremptory proof of how much the aforementioned disposition of your Right Honourable in this first respect completely deviates from all laws! It will therefore be much more fitting to show likewise now that the same, with all due respect, is no less contrary to the prevailing Dutch practice; whereby concerning the conclusion of criminal lawsuits, at the latest after the expiration of two years, the cited Roman laws have by no means been departed from; but on the contrary, Lord Voet, ad Pandectas, Book 5, Title 1, number 53, in fine, citing the Criminal Ordinances of the year 1570, has shown that the same are still in force among us, to such an extent that only very rarely and not except in the most arduous cases a criminal lawsuit is to be dragged out into a two-year period; it also appears further from the Instructions for the Court of Utrecht, rubric 20, article 8, that this extending of a criminal accusation to one, or at the latest to two years, is only to be understood concerning cases in which ordinary procedure is followed.

And in which respect, indeed, the manner of circulating the documents to each of the judges for separate resumption is as unknown as it is, for many weighty reasons, illicit; especially in the respective high courts of justice in the Netherlands, where even in the very heaviest and most weighty cases, before the proceedings come before the full bench for examination, only reporters or referendaries are appointed, who put in writing everything that in points appearing somewhat obscure at first glance can serve for elucidation, as well as for the understanding and dispatch of the trial. And when thereupon, after everything has been well scrutinized in council 3383 seen 23 of this Batavia, under Sixty daalders subsequently at the first Native pieces gold baptismal Rixdollars six thonisz: with the sub- ao: 1738. being 3431 80. — is seen, some difficulties or impediments still arise, the conclusion can be postponed for one or more days to think better upon it, and to deliberate therein with greater certainty, just as such appears in the Instruction for the Court of Holland, articles 149 and 153, with that which is noted thereon by Merula, Practica Civilis, book 4, title 85, chapter 6, and title 87, chapter 6, § 3. Indeed, it is so far from the truth that the conclusion of proceedings instituted criminally, however weighty, voluminous, or of wide consequence they may be, could in any way be retarded or, under these and those pretexts, whatever name they may have, put on the long bench, that on the contrary, according to the 11th article of the afore- Demonstration of the means, revenues, and expenditures cited Instruction for the Court of Holland, criminal cases, and fiscal cases or those that are further privileged, must be preferred and heard prior to all others, even with the postponement of all others. Partly, and indeed principally, because the condition of an accused, whether guilty or innocent, is extremely mournful, lamentable, and uncertain; but partly also because civil cases are often more obscure, or certainly more intricate, and more involved than can be extricated in so short a time, as testified by Voet ad Pandectas, book 5, title 1, number 53; as it is always, even though a thousand distinct points of accusation might be brought against someone, much lighter and with less difficulty 3384 by of the two Portuguese 23 of this Batavia. ao: 1738. being under Sixty daalders subsequently at the first Native pieces gold baptismal Rixdollars Six thonisz: with the sub- 3431 8 for a judge, after the matters have been investigated each in its order, to decide whether such a one is guilty or innocent; as well as whether there lies a defect of evidence, or that he ought to be acquitted for some other weighty cause, than that an extensive civil matter, over which sometimes twenty and more years have been contested, and the exchanged documents, through the chicaneries and controversies of law which commonly occur therein, have expanded almost to infinity, can be definitively concluded. Indeed, there would be so much to say on this subject that the orphan masters must again restrict themselves here; since the little that has been brought forward in this regard already more than abundantly shows, and makes sufficiently manifest, how directly the disposition in question of your honorable worships also, in this second respect, opposes the prevailing Dutch practice. And that in the third respect the same is even most of all contrary to the radical and fundamental laws, as well as the special orders of the Honorable Company in these regions, is entirely beyond contradiction. Statement of the means, revenues, and expenditures 3386 may be terminated, and summary justice and prompt administration of justice be granted to everyone, so that people in the Netherlands might remain free of complaints, which has since been repeatedly ordered by the Assembly of the Seventeen, and among other instances in a very significant manner by the General Missive of 17 December 1690, stating that since complaints repeatedly came before them concerning the protracted nature of the proceedings by which various persons arriving at Batavia were kept lingering, which caused the people to be ruined and to fall into distress, the High Government was to take care that such persons might obtain summary justice and of the two port 23 Batavia, anno 1738, being under sixty thalers. Subsequently, at the book capacity first native pieces of gold christening rix-dollars six thonisz. at the under- 3431 justice and prompt administration of justice, and likewise to make the necessary provision so that similar cases and complaints might no longer come before the Assembly. Indeed, with special reference to the present proceedings and explicitly mentioning the name of the late Mr. Versluijs, a similar order was issued from the Netherlands by letter to the Honorable High Indian Government dated 31 October 1733, all of which serves as striking and convincing proof that the Orphan Masters are fully justified, and by virtue of their office no less obliged, to present their just grievances against a resolution of Your Honorable Worships that so completely conflicts with these fundamental laws and repeated orders. And Statement of the means, revenues, and expenditures and although, in accordance with those very same laws and orders, they could very well have addressed the Honorable High Government in an appropriate manner to request such a provision for their execution as was expressly imposed and recommended to Their High Honors, they nevertheless preferred to turn first to Your Honorable Worships, because as of yet no prompt administration of justice has been directly refused to them; in which latter case alone the laws dictate, and as has been demonstrated from the same, among others, by the Imperial Councillor Andreas Gail, observation 28, number 1: that a judge, on account of denied justice, loses jurisdiction with respect to that case, and that a superior judge must be approached for the administration of justice. 3387 of the two port 23 Batavia, anno 1738, being under sixty thalers. And And following which it is also stated in the Instruction for the Council of Flanders, article 24, in the Great Placcaet Book, 2nd volume, column 2706: that if the said Council should fail to let parties have prompt administration of justice, a complaint might be lodged concerning this to Their High Mightinesses, to the end that the Council be ordered to administer prompt justice; and that if this should not happen upon the third written notice, Their High Mightinesses shall evoke the case, which the Council shall be bound to obey; apart from and besides the fact that it seems much more expedient to solicit the prompt termination of proceedings before the judges themselves before whom they are pending, and the Orphan Masters also do not by any means presume that Your Honorable Worships, as permanent councillors of of the two portures Sahar Statement of the means, revenues, and expenditures to justice and all legal scholars, will now make more difficulty concerning the termination of the case of the late Mr. Versluijs than was previously made, when three permanent and five co-opted members were seated, concerning that of the members of the Political Council of Colombo, which was nevertheless connected therewith and contiguous, or rather one and the same; or else that, at least if Your Honorable Worships should not see fit to terminate the former as well as the latter in the Council after a prior resumption, proceedings should be conducted in accordance with customary practice and, to remove all difficulties, two gentlemen members should be appointed as reporting judges; since it would be an unheard-of and never justifiable matter if a judge, after someone had been investigated and prosecuted criminally for about seven years, and the lawsuit, after many traversals and vexatious occurrences, had finally been brought into a state for judgment, should wish anew to take some years, or an altogether uncertain time, to dispose of it; and that, moreover, in a case like the present one, in which the Honorable Company itself is, in several notable respects, so greatly interested in a speedy termination; besides the lesion and damage which, with all that, is suffered not only by the minor heir—as being in the meantime deprived both of the actual possession and the usufruct of the considerable sum of fifty thousand rix-dollars deposited with the Honorable Company—but also by the whole

Secondly, whether the public correction and vindication exercised by the Council over such disrespect and calumnies is not entirely proportional to the gravity and weight of this misdeed committed by the Orphan Masters, indeed even, if one had wished to proceed with the utmost severity in that regard, altogether too moderate. And thirdly, whether the petitioners were not fully competent or qualified to apply and execute this punishment upon the Orphan Masters in such circumstances and in the manner as it was put into effect. A single reading, Most Noble Sirs, of this aforementioned first infamous petition of the Orphan Masters, which from beginning to end is crammed with mendacious, malicious, and irreverent inferences regarding the Council, is, in the general opinion of the petitioners, more than 3395 enough Demonstration of the means, revenues, and expenditures Batavia, anno 1738. being sixty daalders subsequently first native pieces of gold baptism Rixdollars Six thonisz. by the under- 3431 23 enough to prove the affirmative of the first question to everyone; yet to provide some specific examples thereof, passing over a hundred and more impertinent expressions, it must simply be asked whether it is not utterly insolent on the part of the Orphan Masters, and with respect to the Council no less shocking than injurious, that in the aforementioned writing they dare openly insinuate against their judges, before whom they had completed their entire trial: that although they could have anticipated nothing other than a speedy termination of these protracted proceedings and a prompt delivery of justice, at the time they found the most reason to flatter themselves therewith, they were very unexpectedly informed of the Council's decision to circulate the lawsuit among all members for review and reading, and (quod notandum) thereby once again draw the matter into a protraction of which virtually no end could ever be expected; indeed, Most Noble Sirs, a most petulant concluding argument whereby the petitioners are of the two Portuan recorded and portrayed as judges who, contrary to their oath and duty, had taken an iniquitous decision with a punishable intention to perpetuate the litigants' proceedings and delay them indefinitely. Of no other nature is the utterly distorted reasoning that follows, presenting a malicious and irreverent inference, as if (apart from other childish inconveniences brought forward concerning a feared further review and the misplacement of the trial documents) by the aforementioned decision of the Council, the Orphan Masters' lawsuit could, to all appearances, not be terminated within one to two years; whereby the members of the Council, who to the number of seven must settle the said lawsuit, are suspected of such sluggishness and slowness, indeed one may well say laziness, that each of them would need at least three to four months to examine and review the disputed case. of the two Pont having been, hereupon finally followed a not unclear threat, in case the petitioners should not resile from their decision taken concerning the settlement of the case; namely, to lodge complaints against the Court to Your Right Honourables in that event, and on the ground of a denial of Justice, which they allege flows not directly, but indeed indirectly from that decision, to request that the case of the late Mr. Versluijs may be evoked by Your Right Honourables from the tribunal of the petitioners. This arrogant threat of an ultimate means of constraint, in the highest degree affronting to a judge, which is ever only put into practice for the most pressing and weightiest reasons, and with such cautious moderation as is contained in the missive of the Right Honourable Lords Principals dated 21 July 1707, was indeed done again by the orphan masters in an extremely insolent, offensive, and affronting manner in relation to their lawful ordinary Judges in this matter, and that too at a time when the petitioners, far from denying their Justice, Demonstration of the means, receipts, and expenditures aen habeld 3399 Sixty daalders Subsequently ter Boocnigheijdt first 2 Native pieces gold christening Rixdollars Six thonisz: ge with the under ing under ao: 1738. being Batavia, 3431 23 Justice, had already arranged and begun the examination and resumption of the trial in the second month after it had been taken under advisement, and since that time only half a month had elapsed. On which ground alone their more cited petition fully comes to merit all the epithets that were deservedly attached to it in the judicial decision of the petitioners on the 18th of the past month of March. Indeed, all these names are still far from sufficient for the single sentence that was basely thrown down near the conclusion or end by the orphan masters, and upon which a burning by the executioner's hands would rightfully have been fitting. For what can be more sensible and insupportable to snap at a Judge than what Their Reverences say therein in this manner, that they, namely, by virtue of their office and duty, protest and wash their hands of the bad and pernicious consequences which from such an, NB, unlawful of the two Port Demonstration of the means, receipts, and expenditures unlawful and improper delay could in time further arise, or indeed certainly will arise. The petitioners therefore do not doubt that the specifically cited offensive sentences of the shameless Petition presented to this Council by the orphan masters, with omission of the further hateful propositions contained therein, will be sufficient to show that the said Petition, although the request contained therein might be altogether equitable, is, in view of the defamatory means set down therein, extremely insolent, injurious, and punishable. of the two Port 72nd article of the Instruction for the Court of Holland, for the reason that the well-being and preservation of a commonwealth consists chiefly in this, that the authority and respect due to Magistrates and Judges remain inviolate, so that all inhabitants may thereby be kept in their bounden duty. Upon which very grounds the contempt and disparagement of Justice in direct relation to this Council was very specially and particularly punished, and the preservation and maintenance thereof most earnestly recommended, in the letter of the Noble and Honorable Gentlemen Seventeen, dated 14 September of the year 1731. This then being incontestable, the aforementioned writing, so offensive and defamatory to the Council, could meet with no better fate than that the same, as a foul lampoon on the public roll, in glaring redress of the violated honor of Justice, was torn by the hands of the Secretary of the Council, and, having merited such designations as have here 340 before Demonstration of the means, revenues, and expenditures [illegible] Batavia, in the year 1738, being [illegible] under sixty thalers, subsequently [illegible] first 4 native pieces of gold baptism Rixdollars, six [illegible] with the sub- 343 23 before been shown, was returned to its authors without any disposition, with a stern recommendation for this time that the Orphan Masters shall henceforth never again come forward with such writings, or else the Council will indeed find means to maintain credit, honor, and respect. Yea, Right Honorable Sirs, if one had not had more regard for the honor of the Orphan Chamber than its members, who came to risk it so recklessly, such a libelous writing would by law have deserved to be burned by the hands of the executioner, and the members of the Orphan Chamber who had ventured to submit the same ought to have been placed in the hands of the officer, in order to be criminally prosecuted for the violation of the honor and authority of Justice, and by necessary consequence of the sovereign itself. reputation, to behave somewhat more modestly and properly, as well as to remain within the bounds of reasonableness, within their duty; all of this being evident from Your Right Honorables' repeatedly cited Resolution of the date 15 January 1726, and the minutes kept regarding that case by the Honorable College of Aldermen mentioned repeatedly, partly supplied to Your Right Honorables, and partly incorporated ad perpetuam rei memoriam into the Resolution books of Their Honors. This case, in addition to what has been demonstrated previously, having incontestably shown that the correction decreed and executed by the petitioners against the Orphan Masters was not only not in the least too severe, but very moderate in proportion to their unheard-of actions and deserts, it shall now be the time to examine whether the petitioners were qualified to punish the Orphan Masters publicly for their petulance and disrespect, even where they constituted the injured party, without form of trial or written condemnation. The petitioners are of the affirmative opinion, and believe this to be clearly evident from the just cited case of the Aldermen of this city, which in all respects was directed according to the general doctrine of all legal scholars, as they are to be found in Professor Voet ad ff. tit. De Iudic. et ubi quisque no. 2 in fine, Vromans De foro Competenti lib. 1 cap. 1 no. 1 in not. a and b, Mr. P. Bort Tract. Crimin. tit. 1 no. 54, who teach: that although according to law it is not permitted to administer justice in one's own case, or where one has any interest, it is nevertheless everywhere received: that the judge may punish and avenge a notorious injury or slight done to him in the performance of his office, and not only reprimand with sharper and hard words anyone who has behaved indecently in his presence, not 3404 showing Statement of the Means, Revenues, and Expenditures of the two Port 23 Batavia anno 1738. being under sixty rixdollars subsequently at the highest first 2 native pieces of gold baptism 6 rixdollars thonisz. with the under- 3431 showing him the due respect, but also in fact actually punish such a person, whether with an imposed fine, or even other heavier punishment, and all this without form of trial, inquiry, or written sentence, only to be put into effect by an oral decree or announcement on the spot; which general proposition is also practiced daily before all courts of justice, both here in the Indies and throughout the whole of Europe, as notable cases thereof are to be found in the second volume of the Papegay by Mr. van Alphen page 89, as well as in the repeatedly cited Councillor Bouricius, in his Tractatus de officio Advocati cap. 11 versu debet itaque Advocatus, giving as the fundamental reason for this that the injuries done to the judge sitting on his judgment seat do not concern him personally, but of the two Port Statement of the Means, Revenues, and Expenditures 3405 gravely injure the public authority of the sovereign, by whose power he administers justice, and for which he must watch and take care with all zeal, according to what is remarkably found in this regard in Eduard van Zurck in his Codex Batavus under the word Judges l. 5 in notis: so that in this respect the judge must be understood to wish to maintain and protect not his own, but solely and only the dignity of the Prince of the Land. of the two Portuguese Churches of this capital city Batavia, Statement of the Means, Revenues, and Expenditures 3406 in extraordinary manner regarding the injuries inflicted upon the presenters in the exercise of their duties, put into effect pursuant to the power competent to every judge according to what has just been deducted above; and that further this note or minute was drawn up for no other reason or necessity than to be able to justify ourselves therewith in time of need, as well as with the frequently mentioned lampoon of the Orphan Masters inserted therein, at all times, and especially, as Your High Honours will be able to observe from the conclusion thereof, if you please, in order to give the requisite notice thereof in the first outgoing dispatch from the Council to the Noble and Right Honourable Lord Principals; thus it also naturally follows that the request by the secretary of the Orphan Masters for a copy of that private domestic note neither should nor could have been granted, because it was a decision taken in an extraordinary matter, taken, which by a communicative delivery would have changed its nature, the more so because it is certainly not customary in any Court or Tribunal to deliver criminal orders or formal sentences rendered in extraordinary procedure to those condemned or corrected, for the reason that no appeals or complaints against them are admitted, and therefore the condemned have nothing to do with them. of the two Portuguese churches of this capital city of Batavia, Statement of the resources, Revenues and Expenditures in an unheard-of manner, had to sigh and suffer patiently for over two years, or until 2 March 1735, when by the present Advocate Fiscal of India, Mr. Adrianus Bergsma, who had entered into the proceedings some months before, first served upon his Honour and the former members of the Colombo council a written demand, against which he, Versluijs, in the following November, already brought in his defense by a detailed response, with many accompanying documents submitted therewith. That hereupon time being taken by the Advocate Fiscal to reply, and in the meantime the proceedings against the other council members among whom was also included the former fiscal Ioan de Mauregnault being pursued, the aforementioned Mr. Versluijs on [illegible] February 1736 departed this life, from an apparent heartbreak and chagrin, as he could still see no end to the matters for a long time, having first assigned by testament the administration of his estate to the Orphan Masters, presently petitioners herein, who indeed made every possible effort, on account of the demise of Mr. Versluijs whereby all accusations against his Honour seemed to have lapsed, to extricate themselves from the proceedings, and likewise to regain possession of the fifty thousand rix-dollars, or the value thereof, which had been surrendered by his Honour into sequestration in place of or in fulfillment of the bail de judicio sisti imposed upon him by sentence of 9 July 1734, yet without having succeeded in their attempt in that regard, since they first found themselves compelled by two definitive pronouncements to accept the warrants of the trial, as well as to proceed according to the latest previous acts, and subsequently also to transfer the aforementioned fifty thousand rix-dollars into the Company's treasury, to the end that it remain deposited there until the conclusion of the principal case. That these respective decrees having been duly satisfied, the Orphan Masters subsequently sought to pursue the proceedings with all diligence and zeal as far as was in their power, which also had the effect that these same proceedings, together with those of the merchant and former Colombo Fiscal Ioan de Mauregnault as the case of the further council members, who from the beginning had found themselves entangled and involved therein, had already been dealt with separately by your Honorable Worships on 11 July 1736, were finally concluded and brought to a state for judgment under date of 31 December of the recently passed year 1738, or at an extensive period of between six and seven years after Mr. Versluijs was placed under accusation and had fallen into so many grievous difficulties. That the Orphan Masters, on the grounds of all that is stated above, could therefore expect nothing other than a speedy termination of these protracted proceedings and a prompt administration of justice, so as to be enabled, on the one hand, to withdraw again for the benefit of the estate the considerable amount of fifty thousand rix-dollars, which until that time had to remain in the Company's treasury without interest, and on the other hand also to give the required notification regarding the outcome of the case which is of such great importance to the heir and other distinguished blood relatives of Mr. Versluijs to the Orphan Masters at Middelburg, who likewise by testament were called to the further administration of his Honour's estate and to the guardianship over the minor heir in the Netherlands. But that, when there was the greatest reason to flatter oneself with this, the Orphan Masters were very unexpectedly informed of how it had pleased your Honorable Worships to take a resolution to circulate the trial among all the gentlemen members, each in particular, for resumption and reading, and in that way to draw the case once more into protraction, of which virtually no end can be expected for all eternity: for, besides that the immense quantity of documents of which this concatenated lawsuit consists would require a year and a day for such an individual perusal, it is also likely to result from this that at the least change, whether by unexpected deaths or promotions among the abovementioned gentlemen members, the case would have to begin anew, and so great a heap of papers would have to be resumed and examined again by the gentlemen who might be chosen to fill the vacant places, without even speaking of the inconveniences which might arise from this concerning the loss of notable trial documents, whether through unforeseen accidents of fire or other almost inseparable

Demonstration of the means, revenues and expenditures indicated in the ordinance of the year 1570, that the same are still in force among us to the extent that very rarely, and not unless in the most arduous causes, a criminal lawsuit may be dragged out to two years. It also further appears from the instruction for the Court of Utrecht, rubric 20, article 8, that this extending of a criminal accusation up to one, or at most up to two years, is only to be understood concerning matters in which proceedings were conducted in the ordinary manner, just as in other matters, and in respect of which the manner of sending around the documents to each of the judges separately for review is both unknown and, for many weighty reasons, unlawful, especially in the respective high courts of justice in the Netherlands, where even in the heaviest and most weighty cases, before the proceedings come before the full bench for examination, only reporters or referendaries are appointed, who commit everything to paper that might appear somewhat obscure at first glance, which can serve to elucidate as well as for the understanding and expedition of the trial. And when, after everything has been properly reviewed in council, some difficulties or obstacles still arise, the conclusion may remain deferred for one or more days in order to consider it better and to deliberate upon it with greater certainty, just as this is provided in the instruction for the Court of Holland, articles 149 and 153, with what has been noted thereon by Merula, Practice, book 4, title 85, chapter 6, and title 87, chapters 6 and 13. Indeed, it is so far from the truth that the disposal of proceedings initiated criminally, however weighty, voluminous, or of long consequence they may be, could in any way be retarded, or under these or those pretexts, whatever name they may bear, be shelved; on the contrary, according to the 11th article of the just-cited instruction for the Court of Holland, criminal and fiscal matters, or those that are further privileged, must be preferred and taken up beforehand, with precedence over all others. Partly, and indeed principally, because the condition of an accused person, whether guilty or innocent, is exceedingly sorrowful, deplorable, and uncertain; and partly also because civil cases are often more obscure, or certainly more intricate and more involved, than can be disentangled in so short a time, as Voet attests in his commentary on the Pandects, book 5, title 1, number 53. For it always remains, even if a thousand distinct points of accusation might be brought against someone, much lighter and with less difficulty for a judge, after the matters have each been examined in their proper order, to decide whether such a person is guilty or innocent, as well as whether there is a lack of evidence, or that he ought to be acquitted for some other lawful cause, than for an extensive civil matter, over which arguments have sometimes been conducted for twenty or more years and the exchanged documents, through the chicaneries and controversies of law that commonly occur therein, have expanded almost to infinity, to be definitively concluded. Indeed, so much could still be said on this subject that the orphan masters must once again limit themselves here, since from the little that has been brought forward in this regard, it is already more than sufficiently, clearly, and manifestly evident how directly the aforementioned disposition of Your Honorable Worships also in this second respect contravenes the prevailing practice in the Netherlands; and that, in the third respect, the same is most of all contrary to the fundamental and primary laws as well as the special orders of the Honorable Company in these regions, stands entirely beyond contradiction and firm. For, not only is the entire administration of justice here modeled on the last of Dutch practice, to such an extent that the criminal ordinance of the year 1570 has been expressly prescribed for observance more than once by the Honorable and Most Worshipful Lords Principals in their letters, whereby everything contained above from that practice again finds application here in its full extent, and everyone must understand that the circulating of entire case files has crept in solely through corruption or abuse, and that too in cases of incomparably less scope or extent than that of the late Mr. Versluijs here; but, moreover, by the instruction for the Governor-General and Council of the Indies, enacted in the Assembly of the Seventeen on 17 March 1632, article 2, it constitutes a fundamental law that the said High Government should above all take care and give orders that principally criminal cases may be terminated as quickly as practicable, and that everyone be granted swift justice and expedition of justice, so that in the Netherlands one might remain free of complaints, which has since been confirmed in diverse subsequent instructions.

several times, repeatedly, it has been ordered by the Meeting of the Seventeen, and among other instances in a very significant manner, by general letter of 17 December 1690, containing: that whereas complaints came before them time and again regarding the protracted nature of the proceedings by which various persons who had arrived in Batavia were kept languishing, which caused the people to be ruined and to fall into distress, the High Government was to ensure that such persons might obtain swift justice and prompt administration of law, as well as to make the necessary provisions so that similar matters and complaints would no longer come before the Meeting. Indeed, with special reference to the present proceedings, and with the explicit mention of the name of the late Mr. Versluijs, such an order was even issued from the Netherlands by letter to the Honourable High Indian Government of 31 October 1733, all as convincing and conclusive proof that the Orphan Masters are fully justified, and by virtue of their office no less obliged, to present their righteous grievances regarding that which runs entirely counter to these fundamental laws and repeated orders. And although, in accordance with those very laws and orders, they might well have been able to address the Honourable High Government in a proper manner to request such a provision for the execution thereof, as was explicitly imposed and recommended to their High Honours therein, they have nevertheless preferred first to turn to your Honourable Court, as a prompt administration of justice has not yet been directly refused to them; in which latter case alone the laws dictate, as has been shown from them, among others, by the Imperial Councillor A. Gaill, observation 28, number 1: that a judge, on account of justice denied, loses his jurisdiction regarding that case, and a superior may be approached for the administration of justice. In accordance with which it is also stated in the Instruction for the Council of Flanders, article 29, in the Great Placcaet-Book, volume 2, column 2706: that if the said Council should be shown to be in default of providing parties with a prompt administration of justice, complaints might be made concerning this to their High Mightinesses, to the end that the Council be ordered to administer prompt justice, and that if this should not happen upon the third written notice, their High Mightinesses will evoke the case, which the Council shall be bound to obey. Besides and beyond the fact that it seems much more expedient to solicit the speedy termination of proceedings before the judges themselves before whom they are pending; and the Orphan Masters can also by no means suspect that your Honourable Court, as permanent Councillors of Justice and all learned in the law, will now raise a difficulty concerning the determination of the case of the late Mr. Versluijs, as they previously did when only three permanent and five assumed members were seated, concerning that of the members of the Colombo Political Council, which even now has been connected with and attached to it, or rather one and the same; or at least, if your Honourable Court should not see fit to conclude the former as well as the latter in the Council after a prior resumption, that it will then be handled according to practice, and to remove all difficulties, two gentlemen members shall be appointed as reporting commissioners, since it would be a very harsh, unheard-of, and never justifiable matter if a judge, after inquiries and proceedings had been conducted criminally against someone for about seven years and the case, after many hindrances and vexatious encounters, had finally been brought into a state for judgment, should again wish to take several years, or an entirely indefinite period of time, to settle it. And that, moreover, in a case such as the present one, in which the Honourable Company itself is so greatly interested in several notable respects in a speedy conclusion; aside from the delay and damage which not only the minor heir would suffer through the contrary, being in the meantime deprived both of the actual possession and of the usufruct of the considerable sum of fifty thousand rixdollars deposited with the Honourable Company, but also the entire family of the late Mr. Versluijs. Most Honourable Lords; On the 23rd of this current month of January, the case between the Orphan Masters of Batavia and the Honourable Council of Justice of this castle having been brought to the table again in the Council of India, on the occasion of a certain written document delivered to Your Most Honourable Honours by the said Council of Justice on the 13th previously against the resolution adopted at this table on the [illegible] of the same month upon the memorial of the Orphan Masters, whereby, for the cogent reasons contained in that memorial, it was deemed fit to exempt the latter body from providing, upon the summons of the Advocate Fiscal of India by virtue of the interlocutory sentence passed on the 26th of November of the past year by the above-mentioned court of justice, an extract from the private books or accounts of the deceased Groot Jan van Landschot; but nevertheless, in similar cases for the future, to request and await the order of the Most Honourable the Lords Principals; so the Extraordinary Councillor Elias De Haeze for his part advised that, notwithstanding the latest document from the Council of Justice, one ought to persist in this resolution, partly because the said document, in his judgment, contained several erroneous propositions, but partly, and indeed principally, because the final disposition concerning this delicate point having already been left to the Most Honourable the Lords Principals, it could therefore not be withdrawn again from their Most Honourable Honours, but such a disposition or decision must first be awaited, and to that end both memorials could be sent over to the Netherlands. However, since he, De Haeze, on that occasion perceived that the Honourable Director General brought in his advice in writing and supported it with various relevant reasons at greater length than could conveniently be done by word of mouth, he likewise proceeded to follow this example by virtue of the extraordinary scope of the matter, and now to deduce the reasons and motives of his advice somewhat more amply; The one reason then had its ground in the erroneous propositions, in his judgment, contained in the document of the Council of Justice, and because that, although he briefly stated the specifics thereof while expressing his advice, was nevertheless said somewhat generally, he shall explain those erroneous propositions more clearly here, consisting of the following, namely: Firstly, their Honours maintain that the Orphan Masters requested something politically from this government which ought to have been obtained through the channel of Justice; in which lies a notorious error; since the complaint made by the Orphan Masters especially looked to the prejudice which they judged was inflicted by the interlocutory decree of the 26th of November of the past year upon the oath of secrecy taken by them in this assembly upon assuming their functions, and thus to the foundation upon which the esteem and credit, indeed the entire power of their college over the estates and inheritances entrusted to their administration is established; which after all constitutes not an object of Justice, but indeed of the political disposition of this government, since the Orphan Masters are bound by oath to this government and not to the Council of Justice, and can and may only be released from that same oath, or maintained in it, by Your Most Honourable Honours. Statement of the resources, revenues, and expenditures of the two Portuguese churches of this capital city of Batavia, in the year 1738. The proposition of the Council of Justice that the orphan masters had been too premature in their request to this government, since they had not yet been condemned to anything or enjoined with anything, and that they ought in any case to have awaited such a condemnation first and only then taken the route of revision, after the conclusion of which it would first be time to resort to such extraordinary remedies as they had employed in this matter, is a proposition that is erroneous and abusive on all counts. For, besides the fact that it directly conflicts with the order given by the general missive from the homeland of 1 November 1709, explicitly dictating that all sentences of the Council of Justice must obtain their execution without tolerating any alterations or changes in that regard, it sounds even more extraordinary that the said court judged that an extraordinary remedy (if such ever applied) ought to be used by the aggrieved party not only after the passing of a definitive sentence condemning the orphan masters, but even after it should have been confirmed in revision. This is especially so since it could not, or at least ought not to have remained unknown to their Honors that, according to the standard on which the administration of justice throughout our entire Republic and its subordinate lands is modeled, after revision—and even though one might judge notorious nullities or iniquities to reside in such sentences—no exceptions, provocations, super-revisions, pardons, reliefs, actions of nullity, or other benefits or remedies, by whatever name they may be called, may be admitted or tolerated, as evidence thereof may be found, among others, in a certain resolution passed by the Noble and Great Mighty Lords States of Holland on 25 January 1659, and expressly sent to these lands by our Lord Principals for observance. From all of which it follows that the orphan masters addressed themselves quite properly in due time and by no means too prematurely; since after a definitive sentence, and much more so after revision, they would have found no further venue for complaint, nor would this government have involved itself in granting a relief, a power of which the Sovereign himself has deprived himself. The third main proposition of the aforementioned court—to pass over the minor ones, about which something could also be said, for the sake of brevity—also amounted to this: that, since the respective Presidents of Justice were granted a casting vote in the Council of India on judicial matters by the aforementioned letter of the year 1709, the Lord President Van Schinne ought not, upon the taking of the decision on the remonstrance of the orphan masters, to have been enjoined to stand outside alongside the Lord President of the latter-mentioned body. In this assertion, once again, a very palpable error resides; given that it is not only improbable, but even utterly impossible, that the Noble and Most Honorable Lords Principals would also have wished to grant the President of the Council of Justice, by the aforesaid order, a vote on complaints and grievances concerning the decisions and proceedings of that body in which he had personally taken part, and thus make him both judge and defendant at the same time. For such would be an authority completely contrary to all laws, indeed contrary to natural reason and equity, and incompatible with any Sovereign himself, nor ever exercised by the Counts of Holland; but which the aforementioned court, in this case where the orphan masters had lodged their complaint against the interlocutory judgment of 26 November with a request to be relieved from compliance therewith, nevertheless attempted to introduce and confuse with the judicial matters regarding which the president of that body, according to the order, properly holds a vote.

Demonstration of the resources, revenues, and expenditures of the two Portuguese Churches of this capital city of Batavia, in the year 1738. may vote in the Council of India, employing various specious reasons for that purpose, as if, should the President not be permitted to do so in matters already ventilated before the court of justice, he would likewise not be allowed to do so in matters that were still to be ventilated before it, and thus the intention of the Lords Principals would almost entirely be made illusory for 100. —, since virtually nothing concerning justice, beyond that, can occur: for who does not see that this deviates completely from the present matter? Regarding which this assembly solely understood that the President of Justice had to recuse himself while a disposition was being made upon absolute complaints and requested redress, not concerning cases that were still to come before the court of justice, but concerning those that had already been before it, and in which he had also joined in passing sentence: such complaints or grievances occurring so seldom that it is incomprehensible how the Council of Justice could have extended the recusal of its President, strictly in such singular cases, virtually to all others, and on that occasion also forgot: how many matters of justice from the outer offices are handled at this table that have never been before the court of justice here, or are ever to be brought before it, and in which the President nevertheless, in order to serve this assembly with his legal advice as a jurist, as well as to conclude with the majority, has a vote in accordance with the orders from the fatherland, which without doubt also partly relate thereto: from all of which it shines forth all the more clearly how unauthorized the Council acted when it saw fit so sharply to censure this Government over the recusal of its President during the disposition on the grievance of the Orphan Masters. Thus the Extraordinary Councillor Elias De Haeze believes he has given satisfactory reasons for the one part of his advice: namely, that in the judicial document in question he encountered many, or virtually nothing other than, erroneous propositions, and moreover found them by no means of such merit as to resile from the resolution once taken; intending now in a few words to set down here the motives of the other part of his advice, to wit: that he considered persisting in the resolution all the more necessary, and even inevitable, because the disposition and decision of the dispute between the Orphan Masters and the Council of Justice, by virtue thereof, having already been submitted to the Noble, Highly Esteemed Lords Principals, it could not be withdrawn from them by a further resolution nor could any innovation regarding the matter be initiated, but such a decision had first to be awaited, which is absolutely grounded in law; since one finds a rule therein: that while the Prince, the High, or Higher Authority is deliberating upon a matter, nothing concerning it may be innovated or altered; and this should all the more hold true in this instance; since the resolution taken upon the request of the Orphan Masters also found its principal foundation in the Company's visible interest and concern, which—merely to make a discovery on a single occasion of the private trade of the servants—would in a multitude of other cases suffer a heavy burden, and through the lapse of years, if the credit of the Orphan Chamber here were once reduced to nothing, could not be redressed; so that the disposition over a subject of so much delicacy belongs above all to the Noble, Highly Esteemed Lords Principals, who then without doubt will also deign to take into consideration: how many kinds of means present themselves during the lifetime of the Company's servants, and even after their death—if the judge and fiscal officers are otherwise in earnest—everywhere to discover that so strictly forbidden and in truth utterly harmful private trade, without it being necessary after their decease to sacrifice the credit of the Orphan Chamber, which is firmly tied to the public good and the Company's true interests, in order to display the utmost earnestness concerning its discovery in a case where nothing more is demanded than the simple dismissal of the former First Senior Merchant of this Castle, Jan Herman Theeling, without demanding any reimbursement of monies. These being the principal foundations of the advice of the Extraordinary Councillor De Haeze, he will let the matter rest there, although there would still be somewhat more to say in that regard, and request that it may be dealt with accordingly.
