there was periculum in mora, when subsequently some Members of this Council, upon reconsideration, and specifically at the time when the resumption of the aforementioned resolution was to proceed, raised many difficulties, because the gathering of preliminary information here has from ancient times been entrusted to the officers without the slightest restriction, without anyone ever knowing or hearing that they had overstepped their bounds in this regard, for which reason also, upon receipt of your Right Honourable respected notification of 8 September 1733, no change was made at that time, but it was for that reason left on the old footing without any contradiction, although the same has now already been ordered by Their High Excellencies and to that extent set in motion, notwithstanding that it was thought that only the draft instruction had been handed over to Their aforementioned Excellencies for revision or correction, and that they had only been asked to furnish their considerations thereupon to your Right Honourable, so that, moreover, it rightly came into consideration that this resolution might sometimes, in this juncture of times, cause many obstacles and prejudice in their office to the aforementioned officers, about which they felt aggrieved by way of considerations, which then had the effect that it was judged best by a majority of votes to waive the aforementioned Resolution, and nevertheless to verbally order the provisional advocate fiscal and water fiscal not to have any preliminary information filed at the secretariat without the prior knowledge of the President, unless there was periculum in mora, of which notification would then be given to the Council at the next meeting, which was announced to the same provisional advocate fiscal and also the water fiscal in the presence of the aforementioned four Members, and was also solemnly accepted by them for observance, without the President and the other Members having been able to think that the aforementioned four Members would have felt so aggrieved as to lodge a complaint about it, as has come before them to their very great surprise, and we would gladly leave it to your Right Honourable whether the reins have thereby been given so freely into the hands of the first-mentioned officer, to rage so arbitrarily to everyone's detriment and to play his part unhindered, as the aforementioned four Members have alleged in their complaint, and whether the great fuss made thereof by them truly merits the least reflection to make us suspect to your Right Honourable in these perilous times and thorny matters with which one is currently engaged, and in which matters one has proceeded with all moderation and circumspection, as has been done in all other matters of Justice, so that the President and the remaining Members have, on the contrary, reason to complain that they must see themselves in such a manner disgraced before the entire world by our fellow Members, and accused over matters verbally resolved in the Council by a majority of votes, and they are astonished that the expression of opinions in this matter is so falsely served up, since the Council or any of the Members was never of the opinion that the taking of such a resolution regarding preliminary information pertained solely to the sovereign in this place, but rather to your Right Honourable as our principals, once our prepared instruction had been seen and your Right Honourable approval had been granted thereupon. All of which aforesaid the President and the remaining members have judged necessary to set down here for their discharge and for the elucidation of your Right Honourable, since it pleased Their High Excellencies to transmit the aforementioned Request of the aforementioned four Members to your Right Honourable, without, however, the aforementioned four Members approving the above-stated by the signing of this letter, much less concurring therewith, but only confirming this with their signature in accordance with the order of your Right Honourable, in so far as it concerns the other and ordinary matters handled herein. In our previous respectful letter of 21 December 1739, we had the honour to show your Right Honourable that the Members of this Council had already presented to Their High Excellencies, for resumption, the draft instruction for the Council and the manner of proceeding in civil cases, but since it was judged by the Honourable High Government at that time that the same instruction should be held back here, we duly observed this at the time; however, it having been noticed by us from an Extract of your Right Honourable respected notification dated 28 September 1741 that your Right Honourable requires the same, we have the honour to send it off in copy alongside this, merely for contemplation. to discharge Cornelis Van Riel from our court of justice, who accordingly on the 17th thereafter, amidst the usual compliments, took his leave from this Council; and our ordinary fellow Member Mr. Pieter Willem Lammens, on the 20th of June of this year, communicated to the Council that he was of the intention to make a request to their High Nobilities, the Honorable High Government of these lands, for his discharge from this Council and release to the Netherlands, in order to repatriate with one of the first departing return ships after obtaining his aforesaid request, which, however, by the honored order of Your Right Honorable Nobilities, could take no effect. And upon the announcement of our President, following the order of Your Right Honorable Nobilities, we have since the month of June of this year ceased inspecting the ships that departed from here as well as those that arrived here in the roadstead, without us having included therein, however, the ships that arrive here in the roadstead from Amboina and Banda with spices, as those, following the old custom to prevent all malicious machinations, continue to be inspected by us upon their appearance. Specification of the Criminal Cases Concerning the Interest of the Honorable Company, which since the 11th of December 1741 have been concluded, are ready for judgment, and are still pending litigation. Leander van Balij, slave of the widow Grastorf, was on the 10th of January of this year, for running away and wandering in the upper lands, severely flogged with rods on his bare buttocks behind the town hall here, and clapped into chains for the term of two years on the island of Onrust, there to work without wages on the Company's common works, and to remain banished, with condemnation to the costs and expenses of justice. Lewis van Sumbauwa, slave of the Honorable Company, was, according to the sentence of this council dated the 18th of January last, for running away and wandering in the upper lands, severely flogged with rods on his bare buttocks behind the town hall here, and clapped into chains for the term of two years, to work therein and to remain banished, and further condemned to the costs and expenses of justice. Liam van Sumbauwa, slave of the Honorable Company, was, for running away and wandering in the upper lands, and because two krisses were found in his possession, on the aforesaid 18th of January, according to the sentence of this council, severely flogged with rods on his bare buttocks behind the town hall here, and clapped into chains for the term of five consecutive years, to work therein and to remain banished, with condemnation to the costs. Sacharias Luijden of Delft, quartermaster on Westerdykshoorn, was on the 24th of January aforesaid, for six months' absence, degraded by sentence of this council to sailor at 9 guilders per month, further severely flogged behind the town hall here, and clapped into chains for the term of one year, to work therein without wages on the Honorable Company's common works and to remain banished, as well as condemned to the fine of one month's wages for the benefit of the fiscal office. Augustus van Boegis, slave of the Honorable Company, was, for committed insolence and having had a parang and a kris on him, according to the sentence of this council dated the 31st of January aforesaid, severely flogged with rods on his bare buttocks behind the town hall here, and clapped into chains on the Company's common works for the term of one year, with condemnation to the costs and expenses of justice. Carel Cahman of Stockholm, corporal in the service of the Honorable Company and having been stationed on Banda, prisoner, was, for desertion on the 14th of February last, served by the Advocate Fiscal of India with a written criminal claim against the prisoner, concluding at the end thereof that the same should be condemned to be led on the square before the Castle for three consecutive days, each day three times back and forth, through the gauntlet of a drawn-up battalion of one hundred and eight men, with confiscation of both the aforementioned seized chest with goods or its proceeds, item of the prisoner's previously earned wages remaining credited to him from his aforesaid first service, to be distributed as customary after deducting what must be deducted, and condemnation to the costs and expenses of justice; and the prisoner was, according to the sentence of this council dated the 21st of the mentioned month of February, brought to the square before the Castle here, and there led three times back and forth through the gauntlet of a drawn-up battalion of one hundred and eight men, two sergeants walking in front with the points of their halberds pointed backwards; furthermore, the chest with goods seized in the year 1737, or the net proceeds thereof, as well as the prisoner's previously earned wages remaining credited from his first service, were confiscated to be distributed as customary after deducting what must be deducted, with condemnation to the costs and expenses of justice. Tjoen and Barak, the lord's prisoners, for having been apprehended during these troubles. In this matter, by a written declaration on February 20 of this year containing various allegations, the advocate fiscal of India, Mr. Cornelis Phillips, declared that he had no complete proof against the last three prisoners upon which he could pursue his action against them, and why he would willingly consent to their being released from their detention by this Council. However, he took the liberty at the same time to submit for consideration whether the first prisoner, on account of the vehement suspicions burdened against him, could and should not, following the example of former suspect Chinese, be put in chains to work at public works for the rest of his life without wages, with condemnation to the costs and expenses of justice. On the same day, according to the resolution of the said Council, it was decided to conform to the said declaration, consequently putting the first prisoner Tsie Wanko, commonly called Kee Peendek, in chains, therein to work at public works for the rest of his life without wages and to remain banished, and furthermore condemned to the costs and expenses of justice, but releasing the last three prisoners from their detention without costs. Cornelis Mase Costen, by true name Martens van den Bogaart of Schiedam, Jacob Theunisz of Helsingeur, and Fredrik Willem Graaf of Beeren, all sailors in the service of the Honorable Company, last assigned to the yacht de Jonge Jacob Willem, the lord's prisoners: the first two for drilling several holes in the aforesaid small vessel in order to sink the same, and furthermore, along with the last prisoner, also together for intended desertion, were, pursuant to the sentence of this Council dated March 10 of this year, brought to the ordinary place of execution and there handed over to the executioner, tied to a post, severely scourged with rods on the bare back, the first two named furthermore branded, and all subsequently put in chains, the first two therein each for the period of ten, and the last prisoner for the period of two consecutive years, to work at public works without wages and to remain banished, furthermore confiscating all the prisoners' earned wages, to be distributed according to custom, deducting what is to be deducted, with rejection of the further claim of the advocate fiscal and condemnation to the costs and expenses of justice. Sabtoe Galogor alias Laibo Allang Allang, Toeloe Loewoe, Bappa Bringi Soengi Baroe, Boegis Campong Malaijoe, and Mingo Anke, all Buginese soldiers in the service of the Honorable Company, having recently arrived here from Persia on the ship 't Hoff Niet Altijt Samer, the lord's prisoners: for conspiracy to murder the authorities and other European servants of the Honorable Company on the said vessel and to run away with the ship, were on the aforesaid March 10, pursuant to the sentence of this Council, brought to the ordinary place of execution and there handed over to the executioner, each tied backwards upon a cross, the first named Sabtoe Galogor alias Laibo Allang Allang having first been pinched with glowing tongs on the fleshiest parts of his body, furthermore broken alive on the wheel from the bottom up along with the other prisoners without the coup de grâce, and left in that state until they died, furthermore dragging their dead bodies to the outer place of execution and there leaving them as prey to the birds of the air, further confiscating half of the prisoners' goods and earned monthly wages to be distributed according to custom, with condemnation to the costs and expenses of justice. Lea of Batavia, female slave of the free woman Bartha Johanna, widow of the native schoolmaster in the aforementioned service Elisa Davidsz, the lord's prisoner: for committing theft, was, pursuant to the often-cited sentence of this Council dated March 10, brought to the ordinary place of execution and there handed over to the executioner, tied to a post, severely scourged with rods on the bare back, branded, and put in chains for the period of five consecutive years to work therein without wages at public works and to remain banished, and furthermore condemned to the costs and expenses of justice. Willem Blonje of Amsterdam, young sailor on Reijgersdaal, the lord's prisoner: was on the aforementioned March 10, pursuant to the sentence of this Council, for wounding two persons with a knife and committing resistance with the same against the master on the island of Onrust, brought to the ordinary place of execution and there handed over to the executioner, tied to a post with a knife above his head, severely scourged with rods on the bare back, branded, and put in chains for the period of ten consecutive years on the island of Rosingai in Banda, or elsewhere where it shall please the Noble High Government of these lands to determine, therein to work on the Company's public works without wages and to remain banished, with condemnation to the costs and expenses of justice, and in the meantime, until his deportation, to work here in chains on the public works in the Honorable Company's artisans' quarter. Former halberdier of His Excellency, the Right Honorable and High-ranking Lord Governor-General of the Dutch Indies, prisoner of the authorities, was, for committed manslaughter, on the 10th of the aforesaid month of March, pursuant to the sentence of this Council, brought to the ordinary place of execution, and there having been handed over to the executioner, beheaded; furthermore, half of all his property and credited monthly wages were confiscated, to be dealt with according to custom, with denial of the Lord Fiscal's further claim, and condemnation in the costs and expenses of justice. Jan Boelhouwer, skipper in the aforementioned service, and stationed in that capacity aboard the vessel Buregnies, defendant in this case, was, by the then former Advocate Fiscal of the Indies, Master Cornelis Phillips, on the 10th of January of this year, regarding the failure to account in good faith for moneys given to him in the Fatherland for refreshments and other necessities; the alienation or embezzlement of the Company's planks, beverages, and provisions; as well as the committing of further improper actions and matters during his outbound voyage hither, served with a written claim against the defendant, and in conclusion thereof demanded that the defendant, by sentence of this Council, should be condemned to reimburse to the Honorable Company again in specie the one hundred and sixty silver ducatons, more fully mentioned in the grounds of the said claim, deducting only fifteen rixdollars paid therefrom in the Sunda Strait; item, further to impose upon him, and to pay, with seventy-five percent advance, the value of the planks, beverages, and provisions enumerated in the counts, which the defendant could not clearly demonstrate having exchanged for necessities; and that furthermore he, the defendant, for all that was charged against him hereinabove, should be corrected, fined, or penalized in such manner as this Council, according to the exigency and findings of the case, should deem proper, cum expensis; and subsequently on the 4th of April of this year, after the defendant was admitted to an ordinary trial and his case had been ventilated per procuratorem, according to the sentence of this Council, the defendant was condemned to reimburse to the Honorable Company such one hundred and sixty silver ducatons in specie as the defendant, prior to his departure from the Fatherland, had received and enjoyed from the Right Honorable Lords Directors of the East India Company at the Chamber of Amsterdam, in order to purchase therewith, upon one occasion or another, for the crew of the vessel Bureguies then under his command, (in case of need) refreshments, subject nevertheless to the deduction of such fifteen rixdollars as the defendant had paid therefrom in the Sunda Strait for refreshments; further, the defendant was also condemned to make over and pay to the Honorable Company, with seventy-five percent advance, the value of sixteen cellar bottles of brandy, 40 Company cheeses, two cellar bottles of oil, four ditto of vinegar, and four northern planks, which he could not clearly demonstrate to have exchanged at Santiago for sheep, goats, chickens, pigs, turkeys, and vegetables, both onions, sweet potatoes, and otherwise; furthermore, the defendant was also condemned, for the aforesaid improper conduct, to a fine of three months' wages for the benefit of the deaconry poor of this city, with denial of the Lord Fiscal's further claim, and condemnation in the costs of the lawsuit. Jan Charron, junior merchant in the service of the Honorable Company and having been stationed at the Government of Ternate, petitioner of appeal with the clause of relief regarding the lapse of time, and in due prosecution of this appeal in this case, was, by the merchant and Fiscal at the Government of Ternate, Anthonij Everhard Meder, ratione officii, on the 13th of March 1741, against the defendant, now petitioner, for actions and attempts tending toward sodomy, before the Council of Justice at the aforesaid place, served with a written criminal claim, and in conclusion thereof demanded that the defendant, by definitive sentence of the aforesaid Council of Justice, should be dismissed from office, rank, and salary, as well as to be banished from all territory and jurisdiction of the Honorable Company, and thus to be sent toward Batavia at the disposal of the Illustrious High Indies Government, cum expensis, or indeed for such purpose as the aforementioned Council should deem proper; and by sentence of the aforementioned Council of Justice on that same date, the defendant was dismissed from office, rank, and salary, furthermore banished from all lands and jurisdictions belonging to the Honorable Company, and thus to be sent toward Batavia by the first departing vessel at the disposal of the Honorable High Government of these lands, with payment of the costs incurred herein, subject to the approval of the Right Honorable Lord Governor and Director of that province, Marten Lelivelt; but from which sentence the defendant herein, having made himself appellant to this Council, thereupon on the 14th of February of this year (after he, upon his request made on the 31st of January prior thereto, was admitted therein, and at the same time the attorney Jan Daniel Holthuijs was ordered to serve him, the petitioner, pro deo) brought the case to the roll against the Lord Advocate Fiscal of the Indies, Master Cornelis Phillips, as representing in office the aforementioned Fiscal at Ternate, Anthonij Everhard Meder, and making claim in the case of appeal, first and foremost concluded for the confirmation of the obtained relief, and furthermore on the principal matter against the sentence in question served a written claim, and

Harmanus Flasse of Antwerp, sailor on the hooker, prisoner of the Lord, was, on account of six weeks of absence, and moreover letting his ship sail away to the fatherland, according to the sentence of this court dated the 25th of April above-mentioned, condemned to be sent from here to the fatherland as a useless subject, in order to perform ship's service for his food during the voyage; but because of his indisposition, it was ordered beforehand to bring him to the Honorable Company's hospital here to be cured there; furthermore condemned in the costs incurred herein. be dismissed from office, rank, and salary, and the second defendant be condemned to a fine of Two Thousand rd:s, half to be applied for the diaconate poor and the other half for the prosecutor or Plaintiff, or otherwise that both defendants for their committed misdeeds should be corrected and punished as this Council according to the exigency and finding of matters should deem and understand to be proper cum expensis; whereupon by attorney Olij for the first and attorney De Haan for the second defendant on 15 March following it was concluded to the end of inadmissibility and in order to the dismissal of the Plaintiff's claim with costs; furthermore, the parties having persisted for reply and rejoinder, and the gentleman plaintiff having considered as produced the documents submitted in this matter, and having thereby also renounced further production, and furthermore requested a verification, it was subsequently renounced from production by the attorneys Olij and De Haan for their respective Clients, whereupon the Advocate Fiscal on 19 April following brought this matter to the court roll to hear requested that the defendants should be ordered to renounce relief of response before opening of the inquiry should be granted, which request (after having been opposed by the parties' attorneys) was also granted, and a peremptory term of fourteen days for communication was granted to them; furthermore, after the second defendant had entered into relief of response and the first into relief of production, the defendants respectively having served their written rebuttals, and the parties having proceeded further, this matter was finally on 2 August 1741 brought to a state of judgment; subsequently, on 29 August of this year, according to the sentence of this Council, the claim and conclusion of the Advocate Fiscal of India, prosecutor on behalf of the Lord, made and taken against the defendants at the roll of the well-mentioned Council, was dismissed, the defendants acquitted of the same claim, yet nevertheless condemned in the costs of the lawsuit, for reasons moving the Council thereto. Jacobus van der Fest of Leijden, sailor in the artillery, prisoner of the Lord, was on 29 September last, according to the sentence of this Council, for five months of absence, and moreover for the carrying of two krisses, put on public display in the iron maiden at the square here with a board around his neck on which was written Deceiver for the duration of three half days, furthermore severely whipped there, and shackled in chains for the duration of six months in order to work therein without pay on the Honorable Company's public works, and to remain banished, with dismissal of the Fiscal's further claim, and condemnation in the costs and expenses of Justice. Roesa of Java, slave, and Troena, both chain-gang convicts in the Honorable Company's artisanal quarter, were for the breaking of their chains, by sentence of this Council of the date 10 October, condemned to be severely flogged with rods on the bare buttocks behind the town hall here, and shackled into chains again, as well as in the costs and expenses of justice. Willem Hendrik van Eeken, native of Bloemendael, cook, and Taan, Moor sailor, both in the service of the Honorable Company and recently stationed on the vessel Westcappelle, prisoners of the Lord for sodomy, were according to the sentence of date 27 October of this year condemned to be taken quietly out to the roads of this city, there cast into the sea, and thus executed from life to death, with confiscation of their goods and the accrued monthly wages, to be distributed according to custom after deducting what is to be deducted, and in addition in the Costs and expenses of Justice. Pieter Wesselsz: of Nagapatnam, having been stationed in the year 1737 at Tutucorijn on the sloop Johanna, prisoner of the Lord in this matter, was on 24 March 1741 by the Fiscal at Cochim, Nicolaas Bowijn, in a case of formal desertion and taking service with the English, concluded against the prisoner before the Council of Justice there, that by definitive sentence he should be condemned to be punished with the rope around the neck at the gallows so that death follows, and the prisoner was on 8 April thereof, according to the verdict of the aforementioned Council, condemned to be shackled in chains for the duration of six consecutive years in order to work therein during that time on the Honorable Company's public works, and to remain banished cum expensis, with dismissal of the Fiscal's further claim and conclusion; from which verdict the more-mentioned Fiscal Bowijn having lodged an appeal with this Council, and subsequently on 6 June of this year by the Advocate Fiscal Mr. Cornelis Phillips, substituting for the aforementioned Malabar Fiscal, having concluded at the roll of this Council for nullity or correction of the verdict in question, and that this Council, doing what the judges in the first instance at Cochim ought to have done, should adjudicate the claim and conclusion in such manner as it was made and taken by the original Plaintiff cum expensis; whereupon by this Council attorney Rom having been ordered to serve the prisoner in this matter pro deo, this case was again brought to the roll on 15 August to purge the default of answer and furthermore to answer as yet, when attorney Rom, for the prisoner and defendant, proposed minimum grievances insofar as the claim in the first instance made and taken by the more-mentioned Fiscal Bowijn against the prisoner and defendant was not wholly dismissed, concluding in that regard also in appeal for nullity or correction of the aforesaid verdict in question, and that this Council, doing what the judges in the first instance

ought to have dismissed entirely the claim and conclusion brought against the prisoner in the first instance, and to have acquitted the prisoner and defendant thereof, and further answering the conclusion of the lord advocate fiscal made in the case of appeal, concluded to the end of inadmissibility, and in the alternative to dismissal with costs, as well as by the plaintiff and appellant to the rejection of the proposed grievances a minima, and that the plaintiff in that case should be declared by the sentence in question not to be aggrieved; and further, this case having been fully pleaded by the parties, on the 7th of November of this year, according to the sentence of this court, the judgment in question was altered, and deciding anew in appeal, both on the principal matter and on the proposed grievances a minima, condemned the prisoner and defendant to be strictly flogged behind the town hall, and further to a fine of six months' wages for the benefit of the treasury, with costs. Master Nicolaas Jongsma, provisional advocate fiscal of India, acting in his official capacity in the place of the junior merchant and fiscal at Cochin, Nicolaas Bowijn, and in that capacity plaintiff, against Andries Leslorant of Paris, captain-lieutenant engineer in the service of the Honorable Company, defendant. In this case, on the 10th of April of this year, a written claim was served against the defendant by the aforesaid Malabar fiscal, Nicolaas Bowijn, and at the conclusion thereof it was demanded that he, the defendant, should by definitive sentence be declared to have committed a crime against the high sovereign authority as the prince of the land, and accordingly be condemned to have earned no wages from the Honorable Company during his trial, and subsequently, on the steps of the residence of the Malabar commander and field commander Valentijn Stein van Gollonesse, to publicly recant his uttered slander as false, and with folded hands and bent knees to beg forgiveness of God, Justice, and the aforesaid Right Honorable in the presence of the regular battalion as field commander, and to promise according to oath and duty to acknowledge, honor, and obey him as his lawful supreme commander; likewise to revoke the slander spoken against the train fiscal Hendrik Wendelin Koller, under forfeiture of a profitable fine of 1000 rixdollars, to be divided one half for the deaconry poor of that city and the other half for the benefit of the treasury; further to reimburse the Honorable Company for the cost of the defrauded timbers with a fifty percent surcharge, as well as being stripped of rank and wages and declared incapable of ever serving Their Honors again, with costs; or to such other ends as the Court of Justice there might see fit and judge appropriate for the prevention of such slander and treachery, and as a deterrent and example to others. However, although this trial was not fully pleaded, it was sent over here to this court for settlement and placed in the hands of the provisional advocate fiscal, Master Nicolaas Jongsma, for examination, whereupon His Honor presented a certain report or declaratory statement to this court, in which he declares that the aforesaid proceedings ought to be declared null, informal, and of no value. Of no value, so that also by this court, after exact resumption of the same, according to the sentence dated the 31st of October last, the aforesaid proceedings were annulled as informal and inadmissible, and nevertheless the defendant was acquitted of the action initiated against him by the fiscal Nicolaas Bowijn at Cochin, and the aforesaid fiscal Bowijn was furthermore condemned in the costs of the trial. On the 7th of April 1741, because of inexcusable disobedience, gross negligence, and the resulting grounding of the ship Streefkerk, it was concluded by written claim against the defendants before the Court of Justice at Colombo by the fiscal of Ceylon, Jan Christoffel Klijbert, that the defendants should be stripped of office, rank, and wages, as well as declared incapable of ever serving the Honorable Company again, and condemned to the restitution of all the damages that the Honorable Company had suffered with interest through their and the deceased chief mate Pieter de Haas's clumsy carelessness, gross neglect, and irresponsible disregard of the orders of Their High Mightinesses in the loss of the ship Streefkerk; and that to this end, first of all, the arrested goods of the defendants, together with the estate of the aforementioned deceased chief mate De Haas, with their accrued monthly wages, shall be confiscated; furthermore, subject to the approval of the High Authorities, both defendants shall be relegated and banished to Banda on the island of Rosengain with the first ships, to labor there for the benefit of the Honorable Company until full satisfaction should be made by them, with the costs and expenses of justice. second defendant suspended for the term of six months from office, rank, and salary, and further declared both to have earned no salary since their arrest, and in addition condemned in the costs and expenses of justice, with dismissal of the further or other claim of the said fiscal Clijbort. Finding himself aggrieved for his share by this sentence, the said Orsel, as well as the aforementioned fiscal Klijbert regarding the judgment against the second defendant, lodged an appeal to this council; and subsequently, through the attorney Van Vliet on the 8th of August of this year, a written claim in case of appeal was served for the said Orsel, and at the conclusion thereof it was concluded to the nullity or correction of the sentence in question, and that this council, doing that which the judges in the first instance ought to have done, would yet dismiss the claim and conclusion that had been made, absolve him, the appellant, therefrom, and condemn the defendant in his official capacity in the costs of both instances. Which case then having been fully pleaded by the parties and brought to a state for judgment, by sentence of this council dated the 17th of November of this year, the sentence in question was altered, and the appellant dismissed from office, rank, and salary, as well as declared to be unfit ever to serve the Honorable Company again, and furthermore condemned to be sent from here to the fatherland at the first opportunity, with confiscation of the appellant's accrued monthly wages to be distributed according to custom, with dismissal of the further or other claim in the first instance, both against the appellant and with regard to the deceased chief mate Pieter de Haas concerning the confiscation of the latter's goods, which had been adjudicated by the aforementioned sentence, as being informal and untenable; and furthermore ordered that the fine for wrongful appeal be returned to the appellant, although the appellant was nonetheless condemned for his share in the costs of this lawsuit incurred both in the first and in this instance. And furthermore, through the acting advocate fiscal of India, Master Nicolaas Jongesma, representing the Ceylon fiscal Jan Christoffel Clijbert, on the 15th of August of this year a claim in case of appeal was served on the roll of this council against the defendant Matthijs Kriftsman, and thereby concluded to the correction and alteration of the sentence in question, and that this council, doing that which the judges in the first instance ought to have done, would yet adjudicate the claim made by the Ceylon fiscal, with costs, except however the confiscation of the arrested and consequently secured goods of the defendant, as being in case of adjudication of the further claim unnecessary and also improper. On the aforementioned day, the defendant concluded in court to the dismissal of the claim brought and made against him both in case of appeal and in the first instance, and furthermore proposed grievances and concluded to the admission thereof with costs. Whereupon, this case having thus been fully pleaded on the said date and brought to a state for judgment, on the aforementioned 7th of November, by sentence of this council, the sentence in question was approved; and disposing both of the claim in case of appeal and regarding the proposed grievances, the parties on both sides were declared not to be aggrieved thereby, with condemnation of the appellant in his official capacity in the costs of the lawsuit incurred in this instance. Jan de Roode, former senior merchant in the service of the Honorable Company and vendue master of this city, Petrus Albertus van der Parra, junior merchant, and Adriaan van Ravesteijn, bookkeeper, in the aforementioned service, holding power of attorney and proxy from the Jewish merchant and resident of Cochin de Cima, Samson Rotenburg, native of Frankfurt am Main, according to the power of attorney executed on the 4th of March 1738 before the sworn clerk Gerrit van Dorpen and witnesses in Cochin, as such and in that capacity defendant in case of appeal with the clause of relief against the undue lodging and prosecution of this appeal. In this case, through the junior merchant and former fiscal of Malabar, Corijn Stevens, in his official capacity, against the original defendant Samson Rotenburg, concerning the chartering of the Company's vessel Proostwijk with contraband goods, when the same had departed as a passenger on the aforementioned vessel and had thus arrived back in Cochin, on the 8th of January 1737 a written criminal claim was served there, and at the conclusion thereof it was concluded that by definitive sentence he should be declared to have incurred such penalties as the placards and statutes of the High Government of India dictate, and that in consequence thereof the seized 5000 imperial thalers sequestered in the Company's warehouse should be declared confiscated, one half for the Honorable Company and the other half for the benefit of the treasury, and in addition an extraordinary fine to be distributed at the discretion of the judge, one half for the leper house outside this city of Cochin and the other half for the treasury as above, or for such other purposes as the Council of Justice there might judge and deem proper for the maintenance of the Company's trade. 2563 Merchant and Mocha resident Willem van den Bergh to be permitted to institute, if advised to do so, furthermore condemning the said Willem van den Bergh to all the costs and expenses of justice incurred and fallen during this trial, against which sentence the aforementioned Fiscal Corijn Steevens, having made himself appellant to this Council, on the 30th of July 1738, the Advocate Fiscal of India, substituting in his official capacity for the aforementioned Malabar Fiscal Corijn Steevens, ratione officii defendant in his further assigned capacity, concluded on the roll of this Council, firstly, to the confirmation of the obtained appeal with the clause of relief against the undue prosecution of this appeal; furthermore, having served a written claim in case of appeal, concluded at the end of the same to nullity and correction of the sentence in question, and that this Council, doing that which the judges in the first instance ought to have done, would be pleased still to adjudicate the claim and conclusion made and taken in the first instance upon and against the original defendant, with the costs of both instances; whereupon Attorney Hardtman, for and on behalf of the defendant in his capacity, after having consented to the requested confirmation, requested a copy of everything and a term of four weeks to act as shall be advised, which was also granted to the said Hardtman; and by ruling of the 5th of November 1738, the aforementioned Van der Parra was discharged from this case at his request, and the case was brought on the roll on the 3rd of December following to purge the default of answer and still to answer. 2564 The case having been brought on the roll to answer, Attorney Van Vliet, in the name of the other defendants in their capacity, then requested an extension for the duration of one month regarding this term because of the voluminousness of the papers, which was also granted to the same after the Advocate Fiscal had consented thereto; which proceedings having subsequently advanced to the term of replication, a suspension of the same was requested by the then Advocate Fiscal Mr. Adrianus Bergsma and granted to him on the 2nd of January 1739, until such time as the required papers from the Malabar should have been sent over here; which having had no effect as yet, our present Advocate Fiscal Mr. Cornelis Phillips on the 2nd of December 1739 by libel requested the continuation of the above-mentioned granted suspension, or, insofar as necessary, a new suspension of these proceedings, until such time as the commissioners departed for Mocha, Corijn Steevens and Jan Marcus, who had been appointed by the Noble High Government of these lands to inquire into the irresponsible conduct of the Mocha residents, and especially regarding the considerable waste and squandering of the original defendant and required party in this matter, Samson Rotenburg, should have returned; which continuation was opposed by Attorney Van Vliet for the defendant and required party in his capacity; that incident having subsequently been duly perfected by the parties, this 2565 Council, before deciding in this matter, ordered the Advocate Fiscal to submit such extract of the missive from the fatherland dated 10th of September anno passato of which he made mention in his submitted libel; which interlocutory order having been complied with on the 9th of December following and the aforementioned extract having been submitted, the requested continuation of the suspension of these proceedings obtained from this Council on the 21st of January last was further granted, until such time as the aforementioned Mocha commissioners Corijn Steevens and Jan Marcus should have returned to this place and fulfilled their commissions; after whose return, then also on the 13th of June of this year, at the request of the gentleman ratione officii plaintiff and appellant in his capacity, the granted and continued suspension having been lifted, this case was further fully pleaded in writing, and thus finally brought into a state for judgment as the same presently lies. shall have requested, which was granted to them, whereupon, an answer in writing having subsequently been served by them respectively on the 10th of October following, a copy thereof and a fortnight's delay to reply were requested by the said acting advocate fiscal. Jan Steen, quartermaster in the service of the Honourable Company, defendant in person in this case, was served on the 31st of October last by the acting advocate fiscal Master Nicolaaes Jongsma with a claim in writing, and alongside it submitted a register with several documents, at the end of which claim the said officer concluded that the defendant shall, by definitive sentence of this council, be dismissed from office, quality, and wages, and declared unfit ever to serve the Honourable Company again, and furthermore condemned to the compensation of a sum of one thousand twenty-five guilders and nineteen stivers on account of spoilage and losses on a quantity of circa eight lasts of wheat, but in case of inability thereto, that he, the defendant, shall be condemned to be severely flogged behind the town hall here and riveted in chains, in order therein to labour for the period of three years on the Honourable Company's public works and to remain banished; furthermore, his outstanding wages to be confiscated for the benefit of the Honourable Company, with condemnation in the costs and expenses of justice, the attorney Rom having on that day, upon the defendant's request, been ordered to serve the defendant in this matter pro deo, who then also requested a copy of everything and a fortnight's delay to act as should be advised. 2570 Costs incurred in the trial, when by sentence of the said Council of Gamron on 21 April of the same year, the first defendant was degraded to sailor at ƒ 9 per month; furthermore condemned, falling on his bare knees, to beg forgiveness of justice and the commander, as well as Ensign de Wilt, revoking such blasphemous words as he ever spoke to the prejudice of the said person, declaring that he had known him not otherwise than in all honor and virtue; with confiscation of 1/3 parts of his goods, to be divided one third for the Batavia diaconate poor and one third pro fisco; item, that half of his earned and to be earned monthly wages shall be confiscated to the benefit of the Honorable Company for the compensation of the cordage and other goods misplaced by him which he should fail to show to have been used for the benefit of the Honorable Company; and furthermore, that the second defendant should be suspended for the time of six months, and likewise should have to make an apology on account of such injuries as were uttered by the first defendant, both against the Persian commander and against Ensign de Wilt; with forfeiture of two months' wages, half for the diaconate poor at Batavia and the other half pro fisco; and in addition to that, the payment of 2/3 parts of the costs incurred in the trial; item, the satisfaction of the needlessly used barrel of tar to the amount of 185 mamoodies at ƒ 78:12:8; and that subsequently both defendants should be placed on the ship Steenhoove, in order 2571 that, with that vessel, they be sent Batavia-wards, at the disposal of the Noble High Government of these lands; from which judgment the defendants, having constituted themselves appellants to this Council, and subsequently on 26 September of this year, through the attorney Olij for the first defendant, both in his own name and having power of attorney and proxy from the second defendant Ian Christoffel Tiede, entered into the roll of this Council by petition in case of appeal, concluding for the nullity and correction of the sentence in question, and that this Council, doing that which the judges in the first instance ought to have done, should deny the claim and conclusion brought against the appellants at Gamron and absolve them therefrom, with the costs of both instances; furthermore, leaving reserved to them, the appellants, such actions of injuries, costs, damages, and interest as they have already had and suffered, as well as might come to suffer further; of which, on the same day, inspection, and if necessary a copy, having been requested by the pro interim Advocate Fiscal Mr. Nicolaas Jongsma, His Honor on 24 October concluded thereupon for the approval of the sentence in question cum suis, so that this case has now advanced to the term of production. The abovementioned trials, the conclusions taken at the respective claims, their termination in state of judgment, and litispendence, with regard to the contents, have been briefly cited in substance here before, agreeing to that extent with the Civil and Criminal Rolls of the Council of Justice of this Castle and the proceedings held; Batavia, 19 December 1742. 2572 Wednesday, 6 June 1742. Commissioners for the month, Master Bernhard Jacob Dellafaille and Master Jacob Pompe van Meerdervoort, having reported today to this Council that yesterday the provisionally suspended Advocate Fiscal, Master Cornelis Phillips, in the presence of their Honors, properly transferred to the Advocate Fiscal pro interim, Master Nicolaas Jongsma, all such charters and papers as had been in his custody; it was decided to record this note thereof. At the bottom was written: In my presence, signed: G:s Schuijlenburg, Secretary. Upon reading the trial initiated before this court by the junior merchant Aarnout Luijmes as plaintiff against the burgher of this city, Ian Samuel Lem, as defendant, and especially from a private declaration made on the 23rd of June last by the ensign in the Company's service, Jacob Verbeek, and associates at Samarang, likewise an attestation granted on the 3rd current here in the city by the mate Ignatio Patjeco and associates before the notary Theodorus Leonardus van den Briel and certain witnesses, as well as an insinuation served on the last-mentioned day by the aforesaid notary, also in the presence of witnesses, upon the burgher Paulus Godfried Weisz, it being evident that the aforementioned Luijmes was said to have sold to the said person a quantity of linens and ten chests or packages of opium; and attention also having been given to the request of the Bailiff Martin Meier, made first orally and subsequently in writing to this assembly, to the effect that he might be reserved his right of action which he claims to have, prior to the Advocate Fiscal, against the said Luijmes and him regarding the aforesaid purchase and sale; it was resolved and agreed, first and foremost, to take note that the parties, according to the declaration of both their attorneys, are said to have reached an agreement with each other; yet notwithstanding this, to cause the aforesaid trial, together with a copy of the above-mentioned request of the said Bailiff, to be presented and handed over to the Honorable Council of Justice of this Castle, in order that both regarding the illicit trade and with respect to the aforesaid request in relation to the aforementioned Advocate Fiscal, as a case subject to their Honorable assembly, action may be taken as their Honors shall deem proper. Noble Lord and Esteemed Lords, The extract from the resolutions of the aldermen of this city of the 15th ultimo, containing the handover of certain papers from which is shown a certain illicit trade in opium and other goods committed between the junior merchant Aarnout Luijmes and the burgher Samuel Lem, together with the appended declaration of the bailiff, Mr. Martin Weier, containing several reasons why His Honor maintains to be entitled, even above and before the advocate fiscal of India, to prosecute the aforementioned persons, having been delivered to the undersigned pursuant to the minute of Your Noble and Honorable Worships dated the 23rd of this month, and he being thereby required to submit his interests; so, after an exact review of the matter, he now has the honor to present with all due respect to this Council: that some time ago he received certain report and information that on the 4th of this month, on the roll of the well-mentioned aldermen, by the said Luijmes, not only the aforementioned Lem, but also, which is to be noted, an indigenous officer named Ladamana, were each separately summoned, as if over and on account of lent and counted money; and on that occasion, by the attorney Cras, for and on behalf of the aforementioned Lem, a register with the above-mentioned papers was exhibited; and also, it was dictated and openly stated by Laxamana, appearing in person on the roll, that the debt by no means arose from lent money, but on the contrary on account of delivered and credited opium and other private trade; and further, that the summoned parties were, moreover, each in particular deceived and shamefully misled by Luijmes, in so far that the frequently mentioned Luijmes had allowed himself to be content with a sum of 2000 regarding a considerable claim of 5060 rixdollars, etc. All of which most highly necessitated the undersigned, in observance of the earnest and rigorous orders of the Lords Majors, to observe his official oath and duty, to prevent the aforementioned maneuvers and machinations to the detriment of the Honorable Company, and to actually make a start therewith already on the 8th of this month; as Your Noble and Honorable Worships will be able to establish as clear as day and further appear from the notice to the attorney Cras and Samuel Lem under No. 1, from the note of the adjunct sworn clerk Haksteen regarding what passed between the undersigned and the aforementioned Lem under No. 2, both of the exact same date, and from the attestation of the burgher Paulus Godfrie Weijs dated the 10th following, appended hereto with No. 3 in the register; that the undersigned, five full days before the simple oral declaration, and a whole week before the written declaration of the Bailiff (as appears from the beginning of His Honor's address of the 13th of this month), had been actively occupied and an investigation was indeed conducted by him; so that, for the refutation of that declaration—which seems to have been brought forward rather for the sake of accusation and out of hostility than from earnest or any sound foundation—it will not so much be a question of examining whether the filthy illicit trade committed with respect to both persons Luijmes and Lem is punishable, and has thereby become a mixed case, and whether the Bailiff, in case the undersigned had not concerned himself with it in time, or rather too late, would be competent in such matters; but, in the opinion of the undersigned, it will now solely be the question of who, as things now stand and under this hypothesis, is entitled thereto. The reasons which the Bailiff provides in this regard are merely these: 1st: That it is not only a mixed case, but also that His Honor first obtained knowledge thereof and to that end has already made a request to Their Reverences. 2nd: That until now no contestations in this regard had been made by the advocate fiscal. Two reasons, Noble Lord and Esteemed Lords, that are so frivolous and, by what has been advanced, so reproachable, that they hardly merit any reflection, let alone refutation; seeing that it is established that the undersigned had already undertaken the investigation on the 8th, and His Honor made any movement or declaration in that regard only on the 13th. Now it is certain that prevention, which is nothing other than the anticipation of a judicial proceeding, holds in all matters the most advantageous right, and therein the slightest priority of time, an hour, yea even a moment, takes place, as may be found in Vromans, De Foro Competenti, page m. 38, et circa page 99 b, in the notes, where

Through the secretary of the Honorable Bench of aldermen of this city, Anthonij Isaac Cassa, on behalf of their Honors, having today been brought before the council here the following minute resolution adopted by their Honors on the 10th of this month, together with the documents mentioned therein concerning the junior merchant Aarnout Luijmes as plaintiff and the Malay ensign Wan Laxamana as defendant, ventilated before their Honors court, also the sum of four hundred and ten rixdollars which have been consigned by the last-mentioned, the aforementioned minute resolution reading as follows: Monday 10 September 1742. All present except the gentlemen Peper and the landdrost Vinck. The bailiff has this morning presented the following petition and alongside it submitted a declaration and attestation executed on 6 September 1742 before the sworn clerk Abraham Kuvel and certain witnesses at the secretariat of this court, with and alongside two small notebooks mentioned more fully in the aforementioned declaration, the aforesaid reading as follows: To the Right Honorable Lord, Lord Maurits van Aerden, Ordinary Councillor of the Dutch Indies and President, alongside the other Honorable Members of the Bench of aldermen of this city. Right Honorable and Honorable Gentlemen. Martin Weier, bailiff of this city, respectfully shows that, having received orders from your Honor and Worships to institute his action before this assembly on and against the native ensign Laxamana regarding illicit trade committed in opium, in such manner and form as he confessed on the roll of 4 August 1742, he, the bailiff, for his peace of mind, had summoned him, Laxamana, once again to his house to see if he could discover anything further from him regarding this matter, on which occasion he discovered such things that he judged it was his duty to have judicial declarations drawn up thereof, just as he then actually did at the secretariat of this honorable assembly. And whereas, to his great surprise and even contrary to what he, Laxamana, had said on the day the bailiff had summoned and interrogated him about this for the first time, he, Laxamana, now comes forward with such grave matters, and even supported with witnesses, against the junior merchant Aernout Luijmes, the undersigned therefore now considers himself obliged to institute his action not only against him, Laxamana, but also against the junior merchant Luijmes, as a result of which he also finds himself unable to obey your Honor and Worships orders. And wherefore he, the bailiff, also very humbly requests your Honor and Worships that not only may a record be kept hereof, but also that your Honor and Worships may be pleased to authorize him to prosecute his action against the said two persons either before this honorable assembly or before the Esteemed Council of Justice, or otherwise to suspend proceedings therewith until such time as the dispute currently pending before the said council between the advocate fiscal and the undersigned, regarding the priority of a similar case between the said Luijmes and the burgher Hem, shall have been decided, or such otherwise as your Honor and Worships by their wise considerations shall deem proper. Underneath stood, which was done, etc., was signed Martin Weier, in the margin stood, delivered on 10 September 1742. The Aldermen, having resumed the above petition, together with a declaration and attestation exhibited therewith, executed on the 6th of this month by the native officer Laxamana, etc., before the sworn clerk Abraham Kuvel and certain witnesses, also two small notebooks mentioned more fully in the aforesaid declaration and attestation, from which the private trade in opium and linens between the said Laxamana and the junior merchant Aarnout Luijmes clearly appears; having also considered the declaration made by the same Laxamana on 4 August last, first in the assembly and afterwards also at the house of the petitioner according to the report received by his Honor, namely that he had no proof that the monies which he owed to the said Luijmes arose from the purchase of opium, as he nevertheless had confessed on the roll, wherefore subsequently it was also approved by this court to authorize and order the petitioner properly to institute before this court the action that might arise from this against the repeatedly mentioned Laxamana: now understand that the aforesaid case of Laxamana, together with the above-mentioned petition of the petitioner, with the declaration and attestation, also the two small notebooks exhibited alongside them, as well as a receipt dated 14 March 1741, signed by Luijmes and also exhibited by Laxamana, together with
