2591 together with the said declaration and attestation likewise mentioned, must be presented and handed over to the honorable Council of Justice of this Castle, in order to deal therewith in respect of Laxamana with relation to the Junior Merchant Luijmes, in such manner as their honors shall deem proper; further ordering the secretary of this court, Anthonij Isaac Cassa, to present and hand over in the same manner to their said honors the sum of four hundred and ten rixdollars which were consigned by the aforesaid Laxamana to the court roll of the 4th of August past, and in payment whereof for the benefit of the said Luijmes he was at that time condemned, together with the further release thereof to the aforementioned Luijmes granted upon his request made to that effect on the 25th of August last past, without those monies having yet been paid out for the present, to the end that they may be further dealt with according to the discretion of their honors; below was written: In the presence of me, was signed: A: J: Cassa, Secretary; lower down was written: Extracted from the criminal roll of the aldermen of this city and agrees, Batavia in the town hall, date as above, was [illegible]. After resumption of which, as well as of the documents produced, this Council understood that the same, as a sequel to the case of the Junior Merchant Aarnout Luijmes as plaintiff and Jan Samuellem as defendant ventilated before their honors' tribunal, be handed over to the pro interim Advocate Fiscal, Mr. Nicolaas Iongsma, and to place the monies provisionally under sequestration into the hands of the secretary of this Council, Gijsbertus Schuijlenburg, and to give notice hereof to the bailiff, Martin Weir; below was written: In the presence of me, was signed: G:s Schuijlenburg. Extracted from the records of the honorable Council of Justice of this Castle and agrees, Batavia, date as above, was signed: A:s Kuvel, sworn clerk. 2592 Saturday, the 4th of August 1742 All present except the Lord Landdrost Vinck. Aarnout Luijmes, Junior Merchant in the service of the Honorable Company, Plaintiff, Against Jan Samuel Lemburger, residing here, Defendant, to hear conclusion for payment of five thousand and sixty rixdollars at 48 stuivers arising from loaned monies according to bond dated 18 April of this year passed before the notary Johan van VisVliet and witnesses, and that with the interest thereof at three-eighths rixdollar percent per month from the time of the lawsuit commenced until full payment; a copy of the aforesaid bond having been delivered three days prior alongside this citation, to hear request for provisional payment with costs in case of default, delay, or contradiction. Van Vliet, for the plaintiff and generally constituted by the same according to the power of attorney ad lites shown, passed on 1 August 1742 before the notary Johan van Visvliet and certain witnesses, exhibits the bond mentioned in the presentation and concludes therewith as in the same presentation. Cras, for the defendant and constituted by the same at the secretariat, serves the following libel and submits alongside it a register with several documents, the aforesaid libel reading as follows: Cras, for the defendant answering regarding the requested provisional payment, says it is true indeed that the defendant passed the exhibited bond before the notary Johan van Visvliet and certain witnesses and thereby, according to the custom and manner of all clerks, renounced the exception of uncounted money; however, on the other hand, it is no less true that the defendant, on the day the aforesaid deed was passed, being about to depart for Samarang, agreed with the plaintiff that he would deliver to his vessel five thousand rixdollars worth of trade goods in order thus to transport them to the aforesaid place to trade them there and sell them with some profit, whereupon the defendant, placing his complete trust, and especially that the plaintiff would conduct himself as an honest man in that regard and accommodate the defendant, at least not charging him more in the account than those goods were worth, of which the defendant had undertaken to render proper proof and account upon his return, has, upon that trust, at the requisition and for the security of the plaintiff, provisionally passed the aforesaid bond, wherein it then notoriously follows that the plaintiff, entirely against the duty of an honest man, summons the defendant to court to the end that the defendant should satisfy the contents of the aforesaid deed, whereas it has indeed been proven to him, as is now proven in court with the accompanying documents, that the goods which the plaintiff delivered to the defendant were worth more than two-thirds less than the sum in question, wherefore the defendant must hereby object no

having received no money, and therefore according to law remains not bound to make provisional payment, just as Sande clearly teaches in Book 1, Title 8, Definition 3, and Wassenaar in his Practijck Judicieel, Chapter 6, Article 19, where it clearly appears that in such a case provisional payment has no place, even if the exception of no money having been counted out has been renounced in the instrument, wherefore the defendant concludes herewith that the demand for provisional payment is inadmissible, and in the alternative for the denial thereof, further requesting in the principal case fourteen days to proceed against it as he shall be advised. Van Vliet, having reviewed the submitted libel of reply and documents produced therewith, declares that he is unable, on account of their voluminousness, to conclude this case while the roll is pending, requesting therefore until next Wednesday to be permitted to conclude this case communicatively with the attorney Mr. Willem Cras at their house. The honorable aldermen grant the request. Wednesday the 8th of August 1742. All present, except the honorable Lord President Maurits van Aerden, Ordinary Councilor of the Dutch Indies, likewise the gentlemen Braasem and the Sheriff Vinck. Van Vliet, replying for the plaintiff regarding the requested provisional payment, says that he accepts to his notable advantage that the defendant acknowledges having executed the exhibited obligation on behalf of the plaintiff before the notary Johan van Vesvliet and witnesses, since the validity of the claimed debt naturally follows therefrom, without the defendant's pretenses operating against it in the slightest, both with regard to the renunciation made therein of the exception of uncounted money and concerning the alleged sale of goods as the causa debiti, since these are entirely fabricated and contrived in order thereby, if possible, not only to frustrate the plaintiff of his rightful and lawful claim, but moreover also to have him regarded as a violator of the laws on the matter of private trade and to ruin him, seeing that the causa debiti originates from nothing other than good loaned and counted-out moneys, and the plaintiff has not carried on the least private trade, let alone in opium and linens, with the defendant or anyone else, and consequently has not in the least made himself guilty of any private or prohibited trade, as the defendant with his adherents would nevertheless gladly make Your Honors and Reverences believe by means of some trumped-up attestations; which submitted documents, however, when properly examined, cannot make the least proof in that regard, partly because the served party Paulus Godfried Weesz and the attestants Ignatio Patjeco, Steven de Rosaijro, Domingo de Melo, and Anthonij Perera are all wage-earning servants of the defendant, and are for that reason according to law entirely untrustworthy and incompetent to testify to his advantage.

2593 to be able to testify, and on the other hand because, even if they on the contrary ought by law to be considered unimpeachable witnesses and consequently credit were given to the testimonies granted by them, their given depositions could nonetheless in no way operate to the prejudice of the Plaintiff: since the deponents Paulus Godfried Weisz and Ignatio Patjeco have each testified about a separate case or matter and are therefore, on the grounds of singularity, entirely incredible; and the remaining deponents Steven de Rosairo, Domingo de Meeld, and Anthonij Perera have deposed only, the first mentioned from hearsay, and that even from the mouth of the Defendant himself, and the two last mentioned regarding the condition of some goods which the Defendant was supposed to have brought to Samarang, without however saying from whom those goods were supposed to have been bought or were; as well as that the deponents in exhibit number 3, being the military ensign Iacobus van der Beek with his company, not only quite frivolously but even contrary to the truth, and that without giving the least reasons for their knowledge, have declared that the cases with Bengal fabrics mentioned therein were supposed to have been bought by the Defendant from the Plaintiff; besides which, the first witness named above, Ignatio Patjeco—the only one who, according to his claim, comes to testify from personal experience on account of an account given of the mentioned sale or private trade of the Plaintiff—has declared in his given attestation not only in a completely improbable and mendacious, but even in a contradictory manner, that he was supposed to have heard from the mouth of the Plaintiff, both beforehand and on the day of executing the attestation, that he had sold to the Defendant in the month of April of last year a quantity of linens and ten chests or packs of opium, provided that the Defendant, instead of money, would provisionally make a bond, and payment thereof would have to occur upon his return from Samarang here, which indeed cannot in any way be reconciled with the truth, since the bond would then already have had to be executed and satisfied in the course of last year, as it is unthinkable that anyone selling another person such an amount of goods as is alleged would trust him for such a long time without any proof, especially after the claimed condition had already been fulfilled and the time of payment had lapsed; as the Plaintiff nonetheless—in case the aforesaid testimony had been given according to the truth and the Defendant's claim existed in truth, which is however by no means the case—would have done, because the bond was only executed on the 10th of April of this year and the Defendant had already previously returned two or three times from Java's northeast coast before the mentioned debt instrument was executed, not to mention that those goods would then have been left unsold at Samarang for so long, as he nonetheless also, contrary to the truth, tries to prove with the testimony of the further witnesses, or at least would have to follow from it if any credit could and should be given to those exhibits; wherefore, and since it also has no semblance of truth that the Defendant, without knowing what and how many goods he was to receive, would blindly sign a notarial bond for it in the amount of an excessive hand

would have executed an excessive sum of five thousand and sixty rix-dollars on account of good lent monies received by him to his satisfaction, and therefore renounced the exception of uncounted money, and furthermore that the cited legal passages cannot find the least application in this matter, as having their reference solely to private and in no way to public notarial obligations wherein the aforesaid exception has been expressly renounced, since the reason why this exception is otherwise introduced in law ceases or indeed is entirely deficient in such cases, because no one, for want of money, is compelled in the execution of notarial obligations to surrender, with the same ease with which he comes to bind himself, all legal benefits in the hope of future counting, especially not since the person who comes to execute such an obligation for the benefit of another always obtains here in this place a note from the official scribe before whom he has executed the bond, and receives thereon the monies from the creditor, which he will certainly not deliver before the money is counted out to him; in addition to which it appears even from the very words of Wassenaar in his Judicial Practice at the cited passage that such an exception within the two years only takes place in private deeds, since that author, expressly stating that in that case no provisional judgment falls upon the acknowledged handwriting, cannot extend this or make it applicable to a liquid notarial obligation, seeing that no acknowledgment of handwriting takes place therein nor is required; besides which Sood Sam at the cited passage number 21 also expressly teaches that a debtor who, in order to prevent summary execution or provisional judgments, raises exceptions, must immediately prove them with letters or confession of the creditor and may not be heard if he wishes to produce witnesses: wherefore he, Van Vliet, in the name as above, debating the reasons and means submitted in the party's answer as untruly practiced, calumnious, powerless, and meriting no further refutation, hereby persists by way of reply for the requested provisional judgment, and concluding as was done in the claim cum suis, and otherwise salutarily imploring in and upon all, etc. Cras, for the defendant, says with due reverence, by way of rejoinder to the requested provisional judgment, that although the plaintiff accepts to his considerable advantage the defendant's confession regarding the execution of the obligation, nevertheless no one who has saluted the threshold of jurisprudence even from afar will be able to draw such a conclusion therein as that by which the plaintiff tries to twist the essential meaning of the alleged debt with a perverse sinisterity, so as thereby to cover his shame and to escape the consequences that could arise and originate therefrom, and also in such a manner to enrich himself with the money of another who must obtain and earn it so sorely through his own diligence; wherefore the plaintiff, who with a wrongful and scandalous purpose has already deceived various persons in this manner and still seeks to impoverish them further without flinching, denies that the debt in question should contain any underlying cause other than for lent and counted monies, working to that end to cause your Honors to consider the witnesses produced by the defendant as raked up and especially inadmissible in law, such as the served Paulus Godfried Weisch and the deponents Iguatio Patjeco

Patjeco, Steven de Rosayro, Domingo de Melo, and Anthonij Perera, all wage-earning servants of the defendant and therefore in law completely incredible and incompetent to testify on behalf of the defendant; and regarding the deponents Paulus Godfried Veisch and Jguatio Patjeco, who supposedly each speak of a separate case, since the attestation expresses and mentions an affair that allegedly occurred in the month of April of the preceding year, whereas the presented notice mentions a case that occurred in the month of April of this year; yet, however much the plaintiff may struggle to embellish this case and circumstance with a pallid attestation based on his contrived evasions and lies, in order, if possible, to obtain by the fox's skin what he cannot secure through the lion's hide, nevertheless, once the false face has been torn away and the laws are properly considered, it will instantly be evident that according to the laws of our country it is well known that although the plaintiff alleges and maintains that the first five named witnesses, as wage-earning servants of the defendant, are entitled to no credit in law, on the contrary they merit complete credit and their testimony must be accepted in law: first, because the matter can in no way bring them any advantage; secondly, because it is a matter that must be best known to them; thirdly, because they are honest and of good name and reputation, see Wassenaer, Chapter 1, Article 210 in his Practice, etc., and elsewhere. he bailiff would believe to be grounded in being able and permitted to institute his action in this regard against the aforementioned persons. Wherefore the undersigned, enjoying the high honor of having a seat as bailiff of this city in Your Honors' and Reverences' very respectable assembly, and in that capacity observing the rights of the high authorities of these lands, is also obliged to observe and help care for their affairs and interests. He believes with good foundation to be able and obliged to institute his action against the two above-mentioned persons, the one as the perpetrator, and the other as accomplice. And on which grounds he therefore also made a request to that effect in the assembly of Your Noble and Honorable Reverences of the day before yesterday. For as to what now concerns whether the execution of this matter ought to be carried out by the undersigned as bailiff of this city, or rather by the advocate fiscal of these lands: The undersigned believes that the same belongs indisputably to him, partly because it is a mixed matter, and partly because he is the first who obtained knowledge of these matters and has also already made a request to that end to Your Honors and Reverences. Wherefore the undersigned, having the honor to be an officer of this honorable College, also hopes from the customary equity of Your Noble and Honorable Reverences, and flatters himself in this matter, to be upheld by you. All the more because up to now no counter-contestations in this regard have been made from the side of the advocate fiscal. The undersigned also believing that, in case the fiscal in the future might see fit to wish to dispute this right of his, he is sufficiently capable of maintaining the contrary against the fiscal by means of both our instructions, by diverse examples, and by other authors. Truly, Noble Gentleman and Honorable Gentlemen, a very rash supposition, devoid of any foundation, on the part of the gentleman advocate fiscal, and one which the undersigned in no way expected from his Honor. For from this expression, the undersigned believes he can clearly perceive that, to the injury of his person, there lies enclosed therein a covert reproach, as if it were the case that the undersigned Bailiff did not exercise his office according to duty, but merely for the sake of appearances. Whereas the gentleman fiscal, for many reasons, ought to be convinced of the contrary. Yet the undersigned wishes to put the best construction upon this, and believe that this was not produced with any malice by the gentleman fiscal (at least with regard to the person of the undersigned). could appear, in order to bring the said matter to a point, but on the 13th following thereafter, when the said Bailiff also immediately made his action known to the Meeting, and requested that the same might remain reserved for him. Whereupon he was ordered by the said Meeting that his request should once again be brought in writing by the next day, just as he then also put into effect on the very appointed day, being the 15th of the aforementioned month. From which Your Honorable Worships will perceive that the undersigned began to show his duty regarding the said matter already two days earlier than the Advocate Fiscal claims, it being by no means to be imputed to him that, due to the manifold occupations of the Honorable President of the Aldermen, His Honor could not appear in the said Meeting sooner. Now it is indeed true that the undersigned in the meantime, if he had deemed it necessary, could also have conducted further inquiries, just as the Fiscal says he has done. But he saw that those which had already been fully submitted at that time were provisionally sufficient for him, and that it was time enough for him, when he had obtained the copies thereof, to make the further requests regarding them (supposing he should need still more regarding this). Now as concerning the inquiries that the Fiscal says he has conducted, of which the copies No. 1 to 3 have been handed over to the undersigned. Regarding that, the undersigned will first say that, although the Fiscal in his rescript says expressly, which is to be noted superabundantly, that he previously gave notice to the Honorable President of this Castle, the undersigned nevertheless learned over time that regarding the said inquiries the said Advocate Fiscal acted without being properly equipped with Your Honorable Worships' required and very necessary ordinance. And if such is true, which will be best and most properly known to Your Honorable Worships, then it follows from this without any contradiction that in such case all the inquiries conducted in this regard by the Fiscal are informal, and consequently must also be held as null and void. For Pieter Bort in his Tractatus Criminalis, Title 4, No. 41 to 43, clearly says there: That according to the instructions of the Court of Holland, the Procurator General (whose person the Advocate Fiscal of the Indies represents here in this country) is forbidden, in matters that are somewhat weighty, to take any prior informations, unless by ordinance of the same Court, etc. Which, however, still seems to be permitted to the Bailiff and other lesser officers, as on this account as well as regarding the reasons thereof, is also amply cited by the above-named Bort in his aforementioned Tractatus Criminalis, Title 5, from No. 50 to 68 inclusive. And from which it also comes to follow that the Fiscal's conducted inquiries become invalid. Besides that, according to the opinion of the undersigned, the same were also not arranged according to custom and law. For the undersigned will take the liberty to submit for consideration to Your Honorable Worships' wise judgment, whether the Fiscal is authorized, as appears from the submitted paper No. 1, to have assumed the right to demand, on his private authority, through a messenger of this Council, from an attorney who is already serving his master in a lawsuit, the surrender of some papers. Who, as is known, is bound by his honor, oath, and duty to serve his master faithfully, and consequently, even had he committed a homicide, is not obliged to surrender any papers to the detriment of his master. In paper No. 2, the Fiscal, at his request, has a certain record kept by the sworn Clerk of this Honorable Council, regarding that which had occurred between the Fiscal and the citizen Lem. The third paper, marked with No. 3, contains a deposition of a man who had already given his deposition in the trial. Which deposition in the trial might be considered to have been passed in favor of the citizen Lem, whereas that same deposition for the Fiscal would have to serve to the disadvantage and against the very said citizen Lem, two contradictions truly, which do not stand in law. Besides that the undersigned will still leave deferred to the judgment of Your Honorable Worships whether it is thus proper and lawful to be allowed to demand a deposition twice from someone in one and the same case. But supposing now for a moment that the taken inquiries of the Fiscal had indeed happened with the prior knowledge and ordinance of Your Honorable Worships, nevertheless, it would then still, according to the sentiment of the undersigned (saving, however, the wiser judgment of Your Honorable Worships), have been the duty of the Fiscal, if he wished to show his vigilance and promptness in this matter,

In order, as soon as he had learned that the said case had been brought to the court roll by the aldermen, which, as the undersigned is aware, had already come to his knowledge the very next day, to address the aldermen regarding this and to have requested copies of the said case documents. For how indeed could the fiscal have known that the aldermen would subsequently have demanded the same trial from this honorable Council? And consequently this would be a very questionable waiting on the part of the fiscal, while at the same time being very well able to realize that the undersigned did not remain idle regarding this. Who, in the meantime, did not merely rely upon the bare knowledge that he had of this case, as the fiscal has very erroneously been pleased to state in his factum regarding this, but rather, in accordance with his duty, immediately set his devoir to work concerning it. And even supposing, for a moment, that what the undersigned has said above, namely that he had already gone to the house of his Honorable the President on the 6th of the month in order to give him knowledge of his action, did not avail the undersigned, then it would also notoriously have to follow therefrom that the notification which the fiscal says he gave superfluously to the Honorable President of this Council regarding this can likewise be of no benefit whatsoever to the fiscal. Now, concerning what the said fiscal advances regarding the case of the native officer named Laxamana, who was also summoned to the court roll of the aldermen on the aforesaid day, namely the 4th of the past month of August, concerning a matter of authority as well as of the citizen by the said Luijmens, the undersigned says that on the very same day he was summoned, just after the conclusion of the roll, he had the above-mentioned Laxamana called to his house, and questioned him about what he had brought forward on the roll concerning certain opium, having been able to draw nothing from him that could in any way serve as proof or conviction of what he had said on the roll. Thus the undersigned did not deem it necessary to keep any written record thereof. Nevertheless, this can be considered nothing less than an actual act of devoir which the undersigned set to work in this action of his, quite a long time before the fiscal says he began his. And likewise, the undersigned (if your Honorable Worships should be pleased to deem it necessary) is always in a position, and undertakes, to confirm what has been said above by or with witnesses. From all that is alleged above, the undersigned bailiff hopes and believes he has demonstrated to the satisfaction of your Honorable Worships that he has not only observed his duty in this case most accurately and promptly, but also that he has notably preempted the fiscal therein, both in verbal and in actual activities. So that the undersigned, in the case of this prevention (which is assumed by the undersigned as established in this matter) competing to him, also believes that he can and may allege to the benefit of the bailiff the text cited by the fiscal from Vromans, De Foro Competenti, page 38, to page 99b in the notes. Just as it also clearly appears from the instructions for the bailiff contained in the Statutes of Batavia, in the 11th article thereof, that this case belongs to him by law. When one looks into Merula's Manner of Proceeding, in his Book 4, Chapter 4, Article 7, it would appear as though the advocate were founded in his contention, namely that his taken informations should effect preemption. Since it is said in that place that although between other officers citation alone makes prevention, the procureur-general nevertheless preempts all other officers also by precedent information. However, a little higher in the same Chapter 4, Article 3, he has already preferably stated that the procureur-general shall henceforth take no precedent information unless by order of the court. So that when he subsequently states as mentioned above, he certainly maintains and understands thereby that when the fiscal makes his precedent information preempt, the same must also have been done by order of the court. 2613 Today, the 13th of September 1742, in the morning around eleven o'clock, there appeared at the secretariat of the honorable Council of Justice of this castle, Mr. Martin Weier, bailiff of this city, and his honor declared that, being bound to comply with the minute of the aforementioned Council of yesterday in the case of his honor against the ad interim advocate fiscal, Mr. Nicolaas Jongsma, ordered to deliver his production at the secretariat within the time of 24 hours and subsequently to plead that case at the secretariat from 24 to 24 hours, he had found himself unable to be in readiness with his production within the stipulated time, and on that account renounces the production, as well as imploring general reproaches and salvations of law, whereupon, general reproaches and salvations of law being likewise implored by the ad interim advocate fiscal, and a disposition being requested by the parties, it is that I make this record thereof. On the occasion of the resumption of the ordinary letter which is to be sent to the High and Honorable Lords Seventeen, it having now been brought to communication by the honorable president, Mr. Jacob Lakeman, how he had been addressed by the honorable Mr. Maurits van Aarden, as president of the aldermen, and declared that their honors had to their regret perceived that the ad interim advocate fiscal had set down certain insults and expressions to the detriment of their body in his exchanged writings against the bailiff Marten Wijer in the case of prevention; that they considered themselves aggrieved thereby to the utmost, and expected a suitable satisfaction from this Council; and it being thereupon submitted for consideration by the aforementioned president whether, by virtue of the reserved clause in the sentence sentence of the date of the 19th of September last, a further disposition could not now be taken upon the complaints and grievance of the aforementioned aldermen, and some measure of satisfaction be given to them, it was thereupon approved, if a suitable means could be devised in that regard, to readily condescend thereto, and furthermore understood to postpone deliberations for devising a suitable means until the next meeting. Pursuant to the decision contained in the minute of the 5th of this month, having now proceeded to the devising of a suitable means to give the aldermen of this city, by virtue of the reservatory clause in the sentence of this Council of the date of the 19th of September last, passed between the ad interim advocate fiscal, Mr. Nicolaas Jongsma, and the bailiff, Marten Weijer, in the case of prevention, a suitable settlement and satisfaction regarding the insulting expressions contained in the exchanged writings of the aforementioned ad interim advocate fiscal, it was, after serious consideration, judged by this Council to have the aforesaid insults expunged by the secretary of this Council from the respective writings both of the ad interim advocate fiscal and of the bailiff Marten Weijer, in in full council, provided nevertheless that the aldermen shall not be permitted to make any further use thereof in the future; and furthermore understood to make this record of all this for evidence in due time. 2617 Friday the 28th of December anno 1742: All present By virtue and pursuant to the resolution contained in the minutes of the 12th of this month, now proceeding to the striking out of such insulting expressions as are to be found in the respective writings of the Honorable Provisional Advocate Fiscal Mr. Nicolaas Jongsma and the Bailiff, Mr. Marten Weier, submitted in case of prevention, the said Honorable Provisional Advocate Fiscal beforehand requested that, since he had heard from the side that this Court had resolved and intended to proceed with the striking out of the alleged insulting expressions contained in the respective writings, His Honor might know who had voted regarding this, and further be permitted to bring in his defense against it; whereupon it was understood by this Court to make a note thereof upon his request, but nevertheless, pursuant to the above-mentioned resolution of the 12th of this month, and on the foundation of that which on this matter is so emphatically enacted by the register of this Court, now to cause to be struck out by a secretary from the interests of the said Honorable Provisional Advocate Fiscal the period which begins, that also etc., and ending with the word bring, as well as from the reply submitted against it by the said Bailiff the 47th and 48th articles of that writing, and finally from the rejoinder of the said Honorable Provisional Advocate Fiscal a part of the 57th article, item articles 61 and 70, as all being nothing to the purpose of the case; regarding which one and the other it is resolved to draw up this minute, and to add a copy hereof to the said lawsuit in order at the same time to be sent in copy to the Fatherland to the Honorable High and Mighty Lords Seventeen. That he, passing over the first six articles as introductory, cannot wonder enough at the affected grievance which is found in articles 7 to 14, for the reason that one had regarded His Honor's written declaration as having come forth solely for the sake of the charge and propriety, 2. whereas it is not unknown to the plaintiff in his conscience that in the first instance he did not wish to initiate this case against the junior merchant Luijmes and associates, 3. notwithstanding the undersigned, on the 8th of August, before he was to go to the meeting of the aldermen, urged and encouraged him to do so, not only, 4. but also requested, in case His Honor could not or might not resolve thereto, to then request copies, etc., for the account of the undersigned, 5. with the offer to do the same on all occurring occasions, and to look after His Honor's interest. 6. But the undersigned, finding the Bailiff hesitating to the one and disinclined to the other, and imagining from the distant excuses that the matter perhaps was not going right, found himself compelled to take the matter in hand himself, and thereupon to make inquiries. 2619 7. About which he now has so much the less reason to complain, because the Bailiff in articles 15 to 19 would well make Your Honors believe that he had already betaken himself on the 6th of August to His Honor's President, the Honorable Mr. van Herden, and made it known that at the first meeting he would request reserve of action against Lem and Luijmes. 8. Whether the plaintiff was with His Honor at that time or not, the undersigned will not examine, 9. but this he still knows very well, that at the time the Bailiff was in conversation with him on the 8th of that month, nothing less was to be perceived from His Honor's discourses 10. than that His Honor would have agreed or concerted with that Honorable President to prosecute Luijmens and Lem at law; 11. but something entirely different! which, however, the undersigned, for fear that the Bailiff might now not judge it advisable to stand by what occurred privately between the two of them, will not or cannot mention, 12. so as not to become embroiled with the Bailiff, and much less with the said Honorable President, for whose distinguished character he has that high esteem and veneration which anyone is naturally owed, 13. although the undersigned will otherwise in time show that, being equipped with proper proofs, he will spare no one, observe his office and duty without respect of persons, 14. and in any case show that, however slight his ability and however absolutely destitute of prominent knowledge or capacity, one will never find him guilty of the abominable crime of fear of man, much less cowardice or poltroonery. 15. 2620 15. already made a similar statement to the Noble Lord President on the 6th 16. and that His Honor had also been inclined to propose the same, or have it proposed, at the first meeting, 17. what does that help now, since two meetings have passed and His Honor, in articles 20 to 24, even avows that this was not brought up before the 13th following, that is the third meeting thereafter; 18. and in articles 27 and 28, that His Honor in the meantime held no inquiries, as if because those already submitted to the roll were sufficient, 19. whereas those submitted inquiries, if one may call them such, were in no way gathered at the requisition of the lord repliant, but on behalf of Samuel Lem, and could be of as little service to His Honor as to the undersigned in case of prevention; 20. but it was in the highest degree necessary to put one's own hand to the work, as well as to hold proper inquiries and investigations. 21. Yet the Lord Bailiff, seeing that he is also grounded here, enters the lists a little closer and alleges firstly: that the Fiscal conducted inquiries without being properly equipped with the authorization of this Council; 22. secondly: that the same inquiries are, moreover, not drawn up according to the style of the courts. 23. As to the first, the undersigned declares himself unable to understand how the Lord Bailiff, being himself an officer, could be led and brought over to such a desperate and prejudicial argument, 24. since it is very well known to everyone that the Advocate Fiscal, just as little as His Honor, needs authorization for the taking of inquiries; 25. and that this has also been practiced for a hundred and more years without the slightest interruption or interdiction, and also, with due respect, could not be practiced otherwise here in this country, 26. unless one wished to make the holding of the office 2621 of Fiscal impossible, and wished to make the already burdensome employment and character of Your Honorable Worships still much more onerous and unbearable through endless assemblies; 27. so that here the passage from Bort 4, Nos. 41 to 43, is cited inappropriately and might serve much to the benefit of the undersigned, 28. since it only applies to the Attorney General, and consequently by no means to other officers, which makes applicable the axiom that the exception proves the rule in cases not excepted. 29. However much the Lord Bailiff also seems to wish to do the undersigned a favor by representing him as the representative of the Attorney General here in this country; 30. concerning which, however, it will be unnecessary to show any distinctions or to make other remarks, other than that the undersigned must, and may also, govern himself according to the custom of these lands and all his predecessors, 31. who were never forbidden, but always permitted, without prior qualification, to take preceding information or inquiries. 32. And as regards secondly that the investigations of the undersigned were not drawn up according to the style of the courts, this the Lord Bailiff attempts to prove by saying 33. that the undersigned is not permitted through a messenger or bailiff to demand from an attorney the surrender of papers. 34. But where, pray, did the undersigned request or demand the surrender of papers? 35. Surely nowhere, unless it would have to be in the notice and the report of the bailiff Smith, submitted as No. 1 with the rescription. 36. Yet upon proper inspection of the same it will be found that it contains nothing other than a warning not to mislay those papers and, in the contrary case, the making of a proper protest; 37. which has also never been forbidden, and every private individual is permitted to do, even through a notary; 38. how much more so someone who maintains the right of the sovereign authority and for that purpose employs the bailiff of this Council, 2622 who, according to his instruction to be found in the statutes, title of bailiffs, articles 2 and 11, must serve all kinds of writs and, if necessary, serve the officers for free; 39. it having in any case depended upon the Attorney Eras whether to surrender the same in case of a demand, or not; 40. and then also upon the undersigned, by reason of his office, to compel him in court to the surrender thereof, or else to correction, 41. in case he had, through the wanton and malicious mislaying of such important papers, made himself an accomplice to the intrigues for the favoring of private trade to the detriment of the Honorable Company. 42. The undersigned will also freely confess that upon reading this, he could scarcely contain himself without feeling his displeasure and indignation, and being annoyed in the highest degree, being well assured that as soon as Your Honors perceive the malice of that period, you will be affected by it with the utmost indignation in the world. But to avoid annoyance, the undersigned will take the liberty, for the explanation of these matters, most respectfully to implore the full knowledge of the Noble Lord President of this Council. And he leaves it solely to the Bailiff and his conscience, whether His Honor, in writing that argument or having it written, was not affected with reluctance and blushing. And yet this discourse in article 70 must pass for a kind of pretension and an actual act of duty which the Lord Bailiff would still be willing to undertake to prove. submitted, which had nonetheless all been gathered by him without prior knowledge of the Council, according to his own whim and pleasure; furthermore, that upon the aforementioned request appropriate action was indeed taken, but at the same time it was resolved and approved by unanimous vote, out of consideration that the pro interim fiscal advocate increasingly made it his daily business to gather information against whomever it pleased him, without distinction or respect of persons, and without even giving the owed and required prior notice thereof to the Council, to whom he nevertheless owed all prior knowledge regarding the exercise of his office, to provide against this in the future by adopting a resolution whereby the respective officers would be ordered strictly to regulate themselves with respect to the gathering of information, both according to the orders addressed hither by our Right Honorable and Highly Esteemed Lords and Masters in several dispatches, and according to received practice in the Fatherland; that furthermore the pro interim fiscal, viewing this salutary resolution as completely detrimental to his singular, petty, and malicious designs, and therefore seeking by all ways and means to remove it from his path again, with that intention on the following Wednesday, at the beginning of the ordinary meeting—the Honorable Lord President not being present at that time due to indisposition—handed over to the presiding member, Mr. Jacob van den Bosch, a written document with the request that it be read immediately and before proceeding to the disposal of any other matters, as he asserted that there was danger in delay; that the aforementioned document having been read, the petitioners not only perceived from it that it consisted of some frivolous considerations suited to the fiscal's purposes for the overthrow of the above-mentioned resolution, which, as already stated, had been adopted by unanimous vote and would then have passed review had the Honorable Lord President been present; but also that, over and above these considerations, the fiscal had the malice to insinuate against the petitioners that they, in order to take revenge for what had been initiated against them by the fiscal in accordance with his oath and duty—concerning which matter he most shamelessly calls upon Almighty God as witness—had helped to push through the said resolution, which according to his pretext tended greatly to his detriment, declaring in that document that if the same resolution were approved, he would not be able to continue discharging his office any longer, as well as that he, the fiscal, moreover deemed that the petitioners, for the reason that this matter was so prejudicial to him, could not vote as judges upon the adoption of the said resolution, because that conspicuous dispute between him and the petitioners had not been decided by Your Right Honors; which insolent language, which the petitioners deem to have been uttered with great disrespect toward Your Right Honors, since the fiscal is by no means permitted, during Your Right Honors' deliberations, to initiate anything further concerning the aforesaid matter against the petitioners, because this fully tends to the injury and disparagement of Your Right Honors' aforesaid deliberations, and is also highly prejudicial to the petitioners, as on that basis they would be exposed, at the pleasure and whim of that officer, to his recusal in all cases in which he might merely wish to make himself a party, the petitioners take the liberty to bring in the most respectful manner to the attention of Your Right Honors, with the humble request that they may be maintained by Your Right Honors in their offices as members of the Council of Justice, in which they have been placed by the favor of our Right Honorable and Highly Esteemed Lords and Masters, against these newly practiced and unjust proceedings of the pro interim fiscal Jongsma; General is obliged, as soon as any crime has come to his knowledge, to report the same to the court, which, finding the case appropriately disposed for it, charges the same Procureur General to conduct a preliminary inquiry into the said fact and the circumstances thereof, the reason being that even preliminary inquiries gathered concerning an offense to some extent burden and defame the person against whom they are taken, and lest the fiscal abuse the authority granted to him to the ruin of another, and under the pretext of the law and legal authority pursue anger and vengeance, as can be seen in Groenewegen in the treatise De Legibus Abrogatis, at the title of the Code De his qui accusare non possunt; just as the inquiries, having been taken by an officer with the prior knowledge and notice of the judge, must also be brought for examination and investigation by the same, in order to decide upon the requests of the fiscal according to the findings of the case, with which also agree the esteemed orders of the Right Honorable our Lords and Masters, communicated hither by several letters, and most notably by that dated 8 September 1733, in which their Right Honors are pleased to explain themselves in these words: that the Fiscal of Holland was not permitted to institute any action without summary prior knowledge and consent of the court, and that their Right Honors can therefore find no reason why it could not be made practicable in the Indies in like manner; according to which homeland practice and esteemed orders the Honorable President, alongside Mr. Willem Vincent Helvetius and Mr. Cornelis Phillips, together with the first undersigned, also governed themselves in drawing up the new instruction for the Council of Justice, as can be seen from the 21st article of the chapter concerning the Advocate Fiscal, the same being of this content: and the said Advocate Fiscal shall take no prior inquiry nor place anyone in detention, unless by order of the Council, or in a case where he was present when the offense occurred, or if any private or contraband goods were discovered, in which latter cases he shall ex officio be permitted to do so, but be obliged immediately to give notice thereof to the Council; and since now, by the thwarting of the aforementioned resolution, the pro interim Advocate Fiscal has an ample and full power to act at his own will and pleasure, which the petitioners deem to be a matter of the very gravest consequences, they could not fail, but found themselves in the highest degree obliged, respectfully to bring these their considerations before the wise and discerning eye of Your Excellencies for their discharge, as wishing to have no part nor share in the misfortunes that without doubt will follow in the course of time from all these matters, especially because in the Council, by some of those who have now helped to overthrow the resolution taken by unanimous votes, it was said and maintained that forbidding the fiscal from taking prior inquiries without the prior knowledge of the Council is a point that ought to flow from the high sovereign authority; the petitioners being obliged to declare in all earnestness that whereas the pro interim Fiscal has had the audacity to express himself in one of his writings that he found it extremely difficult to look on with tranquility and good eyes upon persons who had made themselves guilty of such punishable conduct continuing in the delicate office of judge, the petitioners' consciences are also far too delicate for them to remain idle any longer and give no notice to Your Excellencies, their lawful authority, of the dangerous consequences which are foreseen by the petitioners and will certainly be caused by the pro interim Fiscal; herewith the petitioners would be able to end their just complaints against the pro interim Fiscal, were it not that they had learned a few days ago in what impermissible manner their case has been handled at the Council of Justice; in which regard the petitioners humbly request permission to set down hereby furthermore that, some time ago, the aforementioned Fiscal having requested from the Council of Justice, in the absence of the petitioners—the said Council then being reinforced with the co-opted members and assembled solely for the handling of the matters concerning the former Governor-General Adriaan Valckenier—to be allowed to have a copy of the opinions of the petitioners, whereby they had granted the request made by the said Mr. Valckenier to the Council on 27 December 1740, and which were kept in the secret safe, the said request was granted to him; that furthermore, on Wednesday the 3rd of October following, this officer, although fully convinced that the said secret opinions could in no way serve as any ground for his action, which against all law he dared to initiate against the petitioners, nevertheless, having made a request on the foundation of the aforementioned opinions to be permitted to summon the petitioners in person and to prosecute them criminally, this second request was denied to him for the time being.

Furthermore, that regardless of the fact that the fiscal should have subsequently kept quiet, he nevertheless managed to find it fitting to lapse into such unheard-of audacity and extravagance as to have the citations prepared at the council's secretariat on the following Friday or Saturday, with the requests annexed thereto, in order to make the petitioners appear on the public roll as criminal offenders by the following Wednesday, and there to hear such requests and demands as he, the fiscal, would wish to make against the petitioners; that one of the sworn clerks, not daring to take this upon himself, and therefore having given notice of this on Saturday to the council, which had assembled again at that time for the handling of the affairs concerning the former Lord General Valckenier, the said council thereupon prohibited him, the fiscal, from proceeding further with the aforementioned matter; whereupon it was also declared at the same time by the noble Lord President Mr. Jacob Lakeman and the ordinary members the Messrs.
