to be feared that on account of the aforesaid matter, the petitioners could still in time with good foundation be prosecuted criminally. And thirdly, because by the Council, assisted by the co-opted members, and consequently qualified only for the handling of affairs concerning the former Lord General Adriaan Valckenier, there was delivered to the advocate fiscal pro interim at his request a copy of the opinions given by the petitioners in the matter in question, which according to order and custom were kept in the secret chest; whereto the petitioners consider that said meeting was in no way qualified, for the reason that since it is permitted to no member of the Council to reveal the secrets of the assembly, the said assembly was even less authorized to surrender the opinions of the members kept in the secret chest to a fiscal who came to request the same only to make a very detrimental use thereof against the petitioners; it being impossible to operate anything to the contrary against this from the fact that the said opinions had previously already been submitted to Your Right Honourables upon your esteemed order, since this by no means removes the secrecy, because with respect to Your Right Honourables as their lawful sovereign, nothing may be kept secret by the Council of Justice, just as this record of the opinions, after the same had been authenticated by the secretary to be delivered to Your Right Honourables, was locked up again in the secret chest; nor also from the fact that in former times permission was granted by the Council to the advocate fiscal Master Adrianus Bergsma upon his request to be able to demand from the secretariat a copy of all such papers as he might need ex officio, since thereunder can by no means be understood to be included papers that are kept in the secret chest, of which the Noble Lord President has the key in custody, and out of which nothing may be delivered without the prior knowledge and consent of the members. All of which the petitioners have found themselves utterly necessitated to set down hereby, as well as thus to pour out their lawful grievances into the lap of Your Right Honourables, once again with humble request that it may please Your Right Honourables to cast a favorable reflection upon the same and to be willing to maintain the petitioners against the malicious persecutions of the advocate fiscal pro interim, whose primary aim is merely, if possible, provisionally to get the petitioners out of the Council of Justice, in order that he may then, according to his thoughts, play his part all the more vehemently and unconcerned; for which purpose the action which he has initiated against the petitioners was solely excogitated and devised by him, as is clearly to be discerned when one takes into consideration that a citation in person was requested by the fiscal only against the petitioners, but by no means against the former co-opted member Cornelis van Rhiel, notwithstanding said van Rhiel was of one and the same opinion with the petitioners; wherefore, if any substantial action were to be found, the very same request ought to have been made against him as well. Yet that did not happen for the reason that, since he no longer has a seat in the Council of Justice, he can for that reason cause no hindrance or impediment to the fiscal in his dealings; and that Your Right Honourables may further please to take such good measures in this case as you shall judge proper according to your high wisdom. By the Noble Lord President Master Jacob there was brought forward today here in Council the following: Friday the 2nd of November 1742. Extract from the minutes of what was transacted and resolved in the Council of India. Four members from the Council of Justice of this Castle, Master Bernhard Jacob Dellafaille, Master Pieter Willem Lammens, Master Theodorus Policarpus Woijt, and Master Jean Blocquau, having initially presented an ample petition, and thereby, for alleged reasons and motives at the end thereof, making request that they might be maintained against the malicious persecutions of the advocate fiscal pro interim Master Nicolaas Jongsma; so, after having considered what is necessary in this regard, it was approved and determined provisionally to interdict the aforementioned advocate fiscal pro interim not only from proceeding with the case against the said four members of the Council or molesting them, but also further from taking prior informations against anyone at all without the prior knowledge and consent of the said Council of Justice, except however those concerning the case of the former Lord Governor General Adriaan Valckenier, wherein action must be taken according to the orders of the lords and masters, and furthermore regarding all private trade or contraband goods discovered by him. Wednesday the 28th of November 1742. Present all except the gentlemen Dellafaille and Woijt. By the Honorable President Jacob Lakeman, Master of Laws, the below Extract was brought into the council today, accompanied by a copy of the writing mentioned therein, the one and the other reading as follows: Extract from the minutes of what was transacted and resolved in the Council of India. Friday the 16th of November Anno 1742. Likewise, upon the request made by the Councillor Extraordinary and President in the aforesaid council, Jacob Lakeman, Master of Laws, it was approved to deliver a copy of the writing presented to this government on the 2nd instant by the aforementioned members Dellafaille, Lammens, Woijt, and Blocquau, to the Honorable Council of Justice of this Castle. Below stood: Agreed. Was signed: Petrus Albertus van der Parra, Secretary. Thus, after resumption of the same, it was agreed to have it inserted into the memorial of the Council. Below stood: In my presence. Was signed: Schuylenburg, Secretary. Extracted from the memorial of the Honorable Council of Justice of this Castle and agreed. Batavia, date as above. Haksteen, Advocate, Sworn Clerk. [illegible] The 22nd of June 1740. 5 Batavia 1743. Ordinance and Instruction for the Council of Justice of the Dutch East Indies, Residing at Batavia. Chapter 1. Concerning the President and the Councillors of Justice in General. Article 1. The President and Councillors of Justice shall be chosen and appointed by the Directors of the General Dutch East India Company in the name and on behalf of their High Mightinesses the States General of the United Netherlands. Article 2. The Council of Justice shall consist of a President, eight ordinary Councillors, and extraordinary Councillors, and shall also be reinforced and provided with an Advocate Fiscal, alongside a Water Fiscal, both of whom shall also have a concluding vote in civil matters, as well as a Secretary or Registrar, and two sworn clerks, all capable and well-qualified persons. And henceforth, in all commissions, mandates, provisions of grace, and in all other acts, they shall be named and titled: The President and Councillors of the Honorable Council of Justice of the Dutch East Indies. Article 3. They must also be of the Reformed Religion and make profession thereof. Article 4. Furthermore, all members of the aforementioned Council, and the respective Fiscals, or at least the Advocate Fiscal, must be Doctors of Both Laws. Article 5. The Council of Justice shall hold its residence within the capital city of Batavia, situated on the island of Great Java. Article 6. And in the aforesaid Council there shall not serve at the same time father and son, father-in-law and son-in-law, or brothers and brothers-in-law, provided however that such arising affinity shall present no obstacle. Article 7. Furthermore, the Councillors shall also not be permitted to judge in matters of those who are related to them up to and including the sixth degree, as well in consanguinity as in affinity. Article 8. None of the Councillors shall be tax farmers, nor partners, nor also sureties or counter-sureties of the same, directly or indirectly. Article 9. [illegible] Article 10. Likewise, they shall accept no gifts, presents, or donations from anyone who has, or appears likely to have, a lawsuit before the Council, upon suspension or forfeiture of their status and office, and upon further penalty that both the recipient and the giver shall moreover be corrected arbitrarily, all according to the exigency of matters. Article 11. Item, those of the Council shall give no advice or counsel in their case to parties who have, or appear likely to get, any lawsuit before them; and in the event that one of the members should unwittingly have given any advice or counsel to someone, and that matter were later aired before the Council, such person shall be obliged to recuse himself therefrom, upon penalty: for the first offense, of being suspended from their office and service for the term of one year, and for the second offense, of being deprived of status and dignity. Article 12. No one from the Council shall reveal the secrets and the held deliberations, arguments, and discussions concerning the matters pending litigation and being handled there, upon the same penalty as in the immediately preceding article. Article 13. Every year on the first court day after New Year, each member of the Council shall take the oath of purgation into the hands of the President, and he in turn from the senior or next Councillor, in the manner as follows: We declare and swear not to have received or enjoyed, over the past year, any gifts small or large from anyone who has had business before this Council or who appeared likely to get business before it, neither we ourselves nor, to our knowledge, our wives, children, families, or whomever it might be that may pertain to us, directly or indirectly; as we also promise henceforth to guard ourselves therefrom sacredly and religiously, saying in confirmation thereof: So truly help us God Almighty! Article 14. Also, each member shall be obliged, upon the slightest suspicion, to clear himself against the other in the manner aforesaid. Article 15. Likewise, the parties, or whichever one of them upon whom suspicion falls, shall be obliged by oath to declare that they have not promised, nor will promise, to give anything directly or indirectly to anyone of the Council. Jtem en sullen die van den Raed parthijen die voor haar eenig Proces hebben, of apparent staen te krijgen, in hunne zaeke geen advijs, off Raad geven, en bij aldien een der leden ijmand onweetens mogte eenig advijs, of raad gegeven hebben, en dat die zaek nader hand voor den Raad geventileert wierd, so sal de sodanige gehouden zijn, zig zelven daer van te excuseeren, op peene: van voor de eerste reijse van haer lieder ampt en dienst voor den tijd van Een Jaer gesuspendeert, en voor de tweede reijse van staat en digniteijt gepriveert te zullen werden. Niemand uijt den Raad zal de geheijmen, en Gehouden besoignes, raisonnementen, en deliberatien over de zaken aldaer litis pendent, en verhandelt werdende, mogen reveleeren, op gelijke pane als in het even voorgaande articul: 13. „ neuwe Alle Jaren den eersten Regtdag nae ajaer sal ider Lid des Raads in handen van den Praesident, en 11. 12. „ En die wederom van den oudsten of volgenden Raad den eed van purge moeten afleggen in manieren als volgt: Wij Verklaren en sweeren het voorleden Jaer van niemand, die voor desen Raad te doen heeft gehad, of apparent stond te doen te Krijgen, Eenige geschenken kleijn, of groot ontfangen, of genoten te hebben, nog wij selven, nog on„ „ses weetens, onse huijsvrouwen, Kinderen, familien of wie het ook mogte wesen, die ons mogen aangaan, directelijk, nog indirectelijk; ge„ lijk wij ook voortaan beloven, ons daar voor heijliglijk, en religieus te wagten, tot be„ „kragtinge van dien seggende, soo waarlijk helpe ons God almagtig! 14. And they in turn must take the oath of purgation from the eldest or following Councillor in the manner as follows: We declare and swear that in the past year we have not received or enjoyed any gifts, small or large, from anyone who had business before this Council, or who was likely to have business before it, neither we ourselves, nor to our knowledge our wives, children, servants, or whosoever it might be that pertains to us, directly or indirectly; just as we also promise henceforth to refrain from this sacredly and religiously, in confirmation whereof saying, so truly help us God Almighty! 15. Also, each Member shall be required, upon the slightest suspicion, to clear himself against the other in the manner aforesaid. Likewise, the parties or either of them upon whom suspicion falls shall be bound by oath to declare that they have not promised, nor will promise to give, anything directly or indirectly to anyone of the Council. 16. The aforesaid President and Councillors shall administer justice and do right: in the name 17. and on behalf of Their High Mightinesses the Lords States General of the United Netherlands. Thus to all those who require it, without respect of persons, be they rich or poor, great or small, of whatever state or condition they might be, without favor, fear, simulation or dissimulation, they shall do law and justice, and consequently cause their judgments, whether sentences, decrees, ordinances, or orders, to be executed and carried into effect. 18. To which end also all the respective officers in Nederlands Jndia, none excluded, are charged and ordered, as they are charged and ordered by virtue hereof, that upon the admonition and authorization of the aforesaid President and Councillors, they shall grant proper assistance to their Fiscals, Ministers, Bailiffs, and executioners for the execution of the issued Sentences, Decrees, ordinances, and orders, upon forfeiture of their offices, and arbitrary correction according to the exigency of the matter. 19. And the High Government of Nederlands oost Jndia shall also be bound, in the administration of Justice and the execution thereof, to help and assist the said Council against everyone. 20. Furthermore, if it should happen that the Council of Justice, through death or other casualties, becomes so reduced and weakened that Justice would thereby be delayed, and matters could not be properly dispatched, the vacant places shall then, upon the representation of the President and Councillors, be filled in the meantime by the High Indian Government with capable and experienced subjects, for as long as the said Council shall need and require them for the service of Justice. 21. The Members to be assumed must at least be provided with the qualification of Merchant. 22. The ordinary Meetings, court day, and roll call shall be held by the aforesaid Council on Wednesday mornings at half past eight o'clock, and furthermore they shall dispatch there, after the conclusion of the roll, the presented petitions which shall be handed over to the President, 23. to the end that they be disposed of by the Clerk or Secretary in such manner as shall have been concluded by the Council, after which the same shall be signed as soon as possible by the Clerk or secretary and issued to the petitioners. 24. And the ordinary recesses for the said Council shall be from the first Wednesday in October to the first Wednesday in November, and from the second Wednesday in March to the first Wednesday in April. 25. In the examining, reviewing, and disposing of lawsuits, there must be no fewer, regarding criminal matters, than seven, and regarding civil matters, no fewer than five Councillors from the beginning to the end. 26. Likewise, the aforesaid President and Councillors shall appear in the Council Chamber at both ordinary and extraordinary meetings, and must remain there from half past seven in the morning until eleven o'clock, or for as long as matters, subject to the approval of the President, shall require, without being permitted to depart therefrom earlier, unless for weighty and well-founded reasons.

26. Subsequently, the members of the Council shall not be permitted to absent themselves on the prescribed meeting days, except with the prior knowledge of the President, or of the person who shall preside in his place. 27. The aforementioned Council shall take cognizance of all cases of Appeal and Reformation that must devolve to them from the Court of Batavia, and the other respective Judicial Colleges at all outer Outposts, under which Cabo de Goede hoop shall also be included, likewise from all other lower courts, as well as of cases concerning the reduction of awards of Arbiters or amicable mediators. 28. So that from now on all requests for reductions, reformations, and appeals, not only without, but also with the clause of relief against the improper interjection, elevation, and prosecution of the appeals, shall be made directly to the repeatedly mentioned Council of Justice, and that the documents used and submitted in the previous instances shall also be sent to them under an orderly Inventory, duly sealed and certified, by letter. 29. 2650 cities and Colleges, belonging under the jurisdiction of the Company, shall arise and emerge. Those who reside under an ordinary Judge in India shall from now on not be permitted to bind one another to stand trial elsewhere by prorogation or submission of jurisdiction in matters not exceeding the sum up to which their ordinary Judge is permitted to rule by arrest, up to which point the privilege of widows, orphans, and other miserable persons shall likewise cease. However, for parties residing under different judges, the debtors shall not be subject to the Council of Justice by prorogation of jurisdiction, unless they have expressly and specifically submitted themselves to the jurisdiction of the aforementioned Council and the claims exceed the sum of 50 Rijksdaalders. Furthermore, the President and Councilors of Justice shall be required annually, upon the departure of the return fleet, beyond and besides the Judicial Rolls, to send directly to the aforementioned Gentlemen Seventeen a summary report, in the form of a dispatch, containing a succinct account of the principal occurrences and transactions of business in the aforementioned Council, and some time before the departure of the aforementioned return ships, the President shall give communication thereof to the High Government of the Indies. Lastly, upon their introduction into the Council, the President and Councilors of Justice shall take the following oath. And in case it might be judged there that the matter is of such a nature and condition as to propose or remonstrate anything regarding it in the Council of India, the aforementioned senior or first Councilor, together with two fellow Members of the Council of Justice, must be commissioned thereto by and from among their number, who shall have to make a report to the aforementioned Council of Justice of their proceedings and what occurred in the Council of India. The President shall also have prominence and authority to summon the Councillors to the Chamber outside the ordinary assembly, and in the event of his indisposition or in matters of weight and suffering no delay, where there is no need to hear the parties, also to his house at all times when he shall deem that good and proper, so that the members, officers, ministers, and all subordinates shall likewise be bound to obey in all reasonable, honest, and proper matters, and also to appear whenever they shall be summoned by him. Article 10. The President shall also be bound to maintain the authority and luster of the Council, and to cause the instructions of the respective officers, ministers, and subordinates to be carried out. Article 11. The President, or the one who represents him in his absence, shall alone have the right to put the matter into deliberation of the Council, to gather the opinions, and to pronounce the decisions, by word of mouth or in writing, immediately after they are concluded according to the majority of opinions and votes. Article 12. The President shall also, in extraordinary cases where there is danger in delay, have the power to grant provisional orders of justice, provided that the applicant, regarding the obtained provisional orders, both of arrests and otherwise granted at his peril, seeks justice on the next court day. Article 13. And in such case the respective officers of justice, none excluded, shall at all times when they shall be requested be bound to assist the bailiffs of the Council of Justice, upon pain, in case of refusal or negligence, of being suspended for one year for the first offense, and for the second of forfeiture of their office. Item, the ordinary Commissioners being prevented or hindered, the President shall, in extraordinary cases and matters of weight in consequence of the expedition of justice, assign to the fiscals and officers such members as are nearest and readiest. Article 4. Their cases of arrests, injunctions, possessions, and the like must be brought before the full Council, even if they were of lesser amount than has been said. Article 5. Before the aforementioned Commissioners the contending parties shall not be permitted to use to their assistance any advocate, attorney, or solicitor who would enjoy a fee therefor, but shall be bound to appear themselves in person, or else by someone else not meddling with legal affairs, and to plead their case orally de plano; provided however that to such a person who might come in their stead, no salary shall be given or awarded. Article 6. The citations and summonses before the aforesaid Commissioners shall be made by the ordinary bailiffs of the Council, in the same manner and way, together with profits and fines, as is customary before the Council, as also the fines for the defaults the parties shall incur shall be collected and paid in the same manner, except that all terms before the said Commissioners shall be peremptory and run from eight to eight days, unless otherwise appointed by them for reasons. The bailiffs shall be bound to serve the first citations personally at the dwelling or place of abode of the defendants, three full days before the actions or claims of the plaintiff shall serve on the roll, and the further citations on the roll days before the session of the said Commissioners. 1657 court day he will intend to substantiate his demand and conclusion, which he shall then have to exhibit in originali, so that the case may thus be fully prepared and settled summarily. Article 9. And in this matter there shall be no further proceedings than by demand, answer, reply, and rejoinder, all by dictation to the court roll, without any further terms; the witnesses of the respective parties shall, after the rejoinder, be re-examined and sworn by the Commissioners at the earliest appointed opportunity, and no further citation shall be necessary for this purpose. Article 10. The said Commissioners shall be permitted, between parties contending before them, to grant provision of provisional payment where such is founded in law and practice, as well as final condemnation or absolution, and as they shall find to be proper after having taken sufficient knowledge of the case. Article 11. In matters that are doubtful, the Commissioners shall endeavor to dispose the parties to voluntary submission or binding agreement with renunciation of appeal, in order to be settled and pronounced by them as arbitrators. Article 12. The rulings rendered by the Commissioners, whether provisional, interlocutory, or definitive, shall be put into execution in the same manner as the sentences of the Council. Article 13. However, whoever finds himself aggrieved by any definitive ruling or judgment of the Commissioners, and has not been condemned in contumacy or upon confession, may request a rehearing thereof on the first roll day after the pronouncement before the full bench of the Council, provided that he deposits with the secretary the sum of six rix-dollars in heavy money, which shall be returned to him if the ruling of which he requested a rehearing is altered. Article 14. The cases that, belonging to the jurisdiction of the aforesaid Commissioners, might be brought before the Council, shall be canceled and struck from the roll, and the attorneys who presented them shall be condemned to a fine of six rix-dollars for the benefit of the said Council. Article 15. Furthermore, the aforesaid Commissioners shall be obligated, each in his month, to proceed together with the secretary to the offices of the respective Notaries residing at Batavia. Article 16. And there to inspect and examine whether the acts passed before them in the immediately preceding month are properly stamped, duly signed by the appearing parties, their assistants, the witnesses, and the Notaries, and are also numbered and registered in chronological order, and whether there are also found in them any marginal references that have not been signed by the Notaries. Article 17. 2658 Of all of which the said Commissioners shall make report to the Council at the first meeting, in order that, upon discovery of negligence or omissions, provision may be made in that regard and the established penalties may be applied. Article 18. Likewise, it shall incumbent upon the aforesaid Commissioners to attend, with one of the officers and the clerk or secretary, all publications of edicts, as well as criminal executions which, pursuant to the decision of the Council, must be carried out in the presence of Commissioners, and to make report thereof to the Governor-General, as well as to the President. Article 19. The same Commissioners shall also assist at all sales that are held by way of execution, voluntary or involuntary judicial decree, or by the clerk or secretary as sequester or curator, for which attendances the said Commissioners shall enjoy in the city six rix-dollars each per day and no more, and outside the city twelve rix-dollars, half days being calculated proportionately. Article 20. The other ordinary commissions, being the inspection of wounded, murdered, or slain bodies, shall likewise be performed by the aforesaid Commissioners, together with one of the officers and the clerk or secretary, and the necessary declarations taken from the wounded, and, as far as the dead are concerned, report shall be made to the Governor-General and the President. Article 21. Yet the said Commissioners shall not interfere with any extraordinary inspections, attachments, and whatever more there may be, unless in places where officers with their servants need not be admitted without judicial authorization and assistance; in which cases the Commissioners shall not proceed thither with the officer and secretary except upon special order and notice of the Council or President, and after having performed the same, they shall make report just as has been stated in the preceding article. Article 22. Lastly, the aforesaid Commissioners, with the secretary, shall be required to proceed once a month to the jails in order to inquire there into how the detainees are treated, lodged, or handled, and to make report thereof to the Council, as well as, by order and whenever the President deems it proper, to inspect the holding cells of the respective Fiscals and relate their findings to him. Chapter 4. Concerning the Commissioners for Maritime Affairs. Article 1. Article 2. The aforesaid Commissioners, together with the Water Fiscal, or in the event of his indisposition or other impediments, one of the other judicial officers, accompanied by the Secretary and a Bailiff, shall upon proper notification inspect all arriving and departing Company ships in the Batavia roadstead, except for those sailing to and from Bantam as well as up and down the east coast of Java. Article 3. And in relation to the arriving ships, they shall diligently investigate and cause to be investigated whether any private merchandise, contraband, or other prohibited goods are to be found therein, and whether the same are properly provided with passes and sea letters. Article 4. Item, with regard to the homeward-bound return ships, it must be observed, firstly, that the same are inspected beforehand, after taking in their lower ballast layer, to see if any corners or rooms for the storage of private goods have been made or erected between decks; and secondly, that the same, once fully laden, are searched once more to discover whether any private goods might have been placed therein in the meantime, at which point the Commissioners must also ensure that no chests, trunks, etc., of the crew are left inside. Article 5. Subsequently, the aforesaid return ships, having received their dispatches, shall for the third time, as well as all the others destined for the Indian outer trading posts upon their departure, be inspected solely for the purpose aforesaid, their passes and sea letters examined, their drafts forward and aft measured, and they shall be convoyed further to a certain distance by the Commissioners with the Council yacht. Article 6. The distance of the said convoy shall, in the bad monsoon, calculated from the first of November to the last of April, be left to the discretion of the Commissioners; but in the good monsoon, they shall be obliged to accompany the ships departing northward to beyond the sight of the Batavia roadstead, and those heading westward to the homeland, Bengal, Ceylon, and other places, as far as or around the Hook of Bantam. Article 7. And the aforesaid Commissioners, concerning their proceedings pursuant to the orders contained in Articles 4 and 5 at the time of the last inspection with respect to each ship, shall cause a written report to be made, signed by them together with the Officer and Secretary, an authentic copy of which shall be delivered aboard each vessel to which it pertains and dispatched, signed in the same manner as the original report, and addressed to the governors and ministers of the Indian trading posts whereto the ships sail; provided, however, that in addition, on the ships going from Batavia via the Cape of Good Hope to the homeland, a similar duplicate report shall be dispatched in a letter, not only to the Governor and Council at the Cape aforesaid, but likewise to the Gentlemen Directors of the respective Chambers for which the said vessels are destined. Article 8. The aforesaid Commissioners shall also, upon their return ashore, deliver and submit the said original reports, along with copies of the dispatched letters, to the Governor-General, and furthermore make a verbal report to the President of the Council. Article 9. Yet after completing the inspections of the incoming, empty, and fully laden ships spoken of in Articles 3 and 4, the Commissioners shall only be obliged to make a verbal report to the said Governor-General and President. Article 10. Furthermore, the Commissioners, flying the flag from the main topmast while convoying the departing ships, must observe, firstly, that upon sailing away from and returning to the Batavia roadstead they cause the proper salute to be given to the flag of the Netherlands State and the Company flying there; however, they shall not be permitted to allow any further honor or other cannon shots, except only upon hoisting and striking their aforesaid flag. Article 11. Secondly, that upon their arrival near or within cannon range of the return ships departing under an Admiral or Commander with the flag at the main topmast, they shall be obliged to strike their flag and keep it in as long as they are in or among the fleet, without raising it again until, after the work is done and having taken their leave of the Admiral or Commander, they have reached beyond the range of the cannon of the said fleet. Article 12. And thirdly, that whenever any ship or ships of the aforesaid fleet might run into trouble, the yacht or vessel of the Commissioners shall obey the orders of the Admiral or Commander of that fleet given in such an instance for the salvage of such ship or ships, but otherwise remain attached to the disposal of the commissioned members of Justice for as long as the commission lasts. 2661 which must be free from all suspicion and bad presumptions, who, by virtue of the said commission, if necessary, may also conduct an ocular inspection or receive demonstrations of places, matters, etc. Article 2. And these commissioners, both in the production of witnesses and in the ocular inspection of witnesses, demonstrations, etc., may hear the adverse party, if notified thereto or requesting such, and receive their cross-interrogatories, without them nonetheless being permitted, at the requisition of the same adverse party, then or at the same time to hear any contrary witnesses, take inspection, or receive demonstrations, unless by virtue of the same commission obtained for that purpose from the Council by the adverse parties. Article 3. And with regard to the aforesaid ocular inspection and demonstration, the commissioners, assisted by the secretary or sworn clerk along with a bailiff, and provided with a land surveyor, alignment master, or other artisans, master craftsmen, or persons knowledgeable therein, not suspect to the parties and previously duly sworn, must transport themselves to the place of the dispute, in order to conduct such inquests there and take such information as shall be required for the decision of the case at law. Article 4. Furthermore, with regard to the other inquests which take place through witnesses for the proof of facts of the time, the writings of the parties shall be handed over to the said two commissioners, as well as their commission, without which they cannot proceed. 5. Item, no councilors, registrar, or secretary may solicit, speak, or cause solicitation for the aforementioned commission, but must let the president handle it. The commissioners shall also pay close attention to the limits of their power, which is expressed in the commission, as well as to the facts that are in controversy between the parties, and to the time within which the examinations must be completed, which time shall and must be reasonably fixed by the said commissioners according to the nature of the matters. Item, the aforesaid commissioners may not receive and examine on any one fact more than seven witnesses at most, except in cases that are verified by a turba of witnesses, or unless the inquest having been seen, or upon the report of the commissioners, it is ordered otherwise by the Council. The commissioners shall also ask the witnesses and deponents their names and age, and observe that they are pertinently examined on the facts, articles, and all circumstances of the matters; and that the depositions are thereafter read to them, and they are specifically asked whether they have declared according to truth and in conformity with their knowledge, opinion, and science, and whether they have anything to add to or subtract therefrom. Article 8. 2662 after which the oath shall be administered to the witnesses by the commissioners, in the presence of the parties or their attorneys, if they wish to be present, and the deponents enjoined duly to sign their responses and declarations thus sworn. Article 10. And so that everything is effected clearly and plainly, the aforesaid commissioners shall ensure that no language other than the Dutch language is used by the secretary or first clerk, as far as is practical and possible. Article 11. And the Reformed, as well as the Roman Catholics, Mennonites, Jews, Mohammedans, Chinese, and other non-Christians, shall take such oath as is customary to administer to them in the Netherlands and in India, and of which the formulas and subscriptions of solemnities reside at the Secretariat of the Council. Article 12. The aforesaid commissioners shall each receive, for the inquests, ocular inspections, and inquiries made and taken by virtue of the aforesaid, six rd:s per day inside the city and no more, and twelve rd:s outside the city, over and above a decent defrayment of expenses, half days being calculated proportionately. Article 13. And the aforesaid land surveyors and alignment master, etc., shall be remunerated at the discretion of the commissioners, all at the expense of the losing party at the time, if the aforesaid inquest, etc., was ordered ex officio; but if the same was done at the request of a party, the petitioner must provisionally bear and pay the costs incurred thereon. 2663 to two Members of the Council to examine them, and to report to the Council, provided however, that criminal and fiscal cases, as well as all privileged cases, shall be given preference and heard first. Article 2. And the Rapporteurs shall also take good care and heed in examining the case files to see whether the powers of attorney of the parties have been submitted therewith, and likewise whether the case file, according to the inventory, is properly furnished. Article 3. And if it should happen that any defects were found therein, they shall, before delivering their report, give timely notice thereof to the Council in order that proper provision may be made therein. Article 4. No one shall be a rapporteur in cases on the principal merits of which he cannot vote as a Judge. Article 5. Likewise, those who have been Commissioners for the Inquests in the case may not be employed as rapporteurs of the same, unless the Council, for certain reasons, should order otherwise. Article 6. Furthermore, none of the Council members, either by himself, through a party, or through anyone else, directly or indirectly, shall solicit the President to obtain any reports, nor take over reports distributed to others. Article 7. However, those who have been rapporteurs in the case in which an interlocutory sentence has been rendered, shall also be required to be rapporteurs for the definitive judgment. Article 8. And in order that everything may proceed in an orderly manner, they shall be required to make an extract, or compilation, from the case files and documents relative thereto, briefly containing the contents thereof, in order to be able to report everything better to the Council and to demonstrate what may serve for the understanding and dispatch of the cases. Article 9. In order to prevent and avoid all evil suspicions, the Rapporteurs shall keep secret that the case files have been delivered into their hands to make a report. Article 10. So that the Council and the secretary, upon their oath taken in office, shall also be required to keep the names of the rapporteurs secret. Article 11. And in the event that any of the rapporteurs should become known to one of the litigating parties, or if the rapporteurs were in any way 2664 troubled by them, or got suspicion that it had come to the knowledge of the litigating parties that the case file is resting with them, the rapporteur or rapporteurs shall be required to give notice thereof to the President and the Council, to the end that the case file may be given out to others, or that the Council can and may provide therein as it shall find appropriate. Article 12. Furthermore, the rapporteurs may not accept any notifications, schedules, or other documents, of whatever nature they may be; but the parties, if they wish to submit any notification, etc., shall be required to do so to the Council, or to place them in the bags when they conclude their pleadings in the case, provided they have made mention thereof in their inventories. Article 13. Likewise, when any cases are to be reported in the Council, the senior rapporteur shall not only have a quiet hearing, but the Members of the Council shall also be required to listen diligently and remain silent, without detaining or interrupting them in any way. Article 14. However, if someone from the Council wishes to add something or examine the rapporteur on a point serving for elucidation and further interpretation, he may do so after the report is made, yet with few words, without detaining the Council for long with cavils and disputes. Article 15. And when the report has been made, all the documents must be seen and read by the full Council, namely to the number of seven in criminal matters, and five in civil matters, without reflecting upon or relying solely on the report of those who examined the case. Article 16. Next, the report having been finished in the manner aforesaid and the case file with the documents having been seen and read, the President, or in his absence the presiding Member, shall ask for the opinions of the rapporteurs, and thereupon, at his discretion, begin to take the further advices and votes, whether from the senior, the middle, or the junior of the Members. Article 17. In voting and deliberating, no one shall trouble or disturb another in his opinion or deliberation, but each shall hear his fellow Members speak, deliberate, and vote with moderation and attention, without interrupting them or occupying the Council with disputes and cavils. Article 18. Likewise, the Clerk or secretary shall be required to be present during the making of the report and the examination, reading, and inspecting of the documents, 2665 to be and remain present, and to listen very diligently and sharply to the opinions of the Members of the Council, and to note them down on a scrap of paper, to the end that he may understand the matter in order afterwards to couch the rulings and sentences and put them into writing. Article 19. However, immediately after the pronouncing of the sentences or the issuing of the Rulings, the clerk or secretary must tear up the aforementioned scraps of paper, without being allowed to keep them; it nevertheless being free to each of the Members to submit their advices and opinions in writing, either immediately or shortly thereafter, in order to have them placed in the secret box, and to be allowed at all times (if necessary) to request an authentic copy thereof from the Council. Article 20. And if in deliberating any difficulties or complications should arise and occur, the President may postpone the conclusion to the next session, to the end that everyone may reflect further upon the differences, in order subsequently to be able to deliberate therein with so much more certainty.

Wherein cases where the matter regarding certain facts is so intricate and complicated that the same cannot well be unraveled, one shall pronounce an interlocutory decree in the following manner: The Council finds the case not in a state to be finally concluded, and therefore declares that the parties shall appear on the Mc:et: before Mr. N: N: Commissioners, specially ordered for this purpose herein, who shall hear them, and if feasible reconcile them; if not, inform themselves further on the facts contained in the etc: of the aforesaid parties, subsequently put the information in writing, and bring it into the council, in order that, having examined the same, action may be taken as appropriate, reserving the costs of this until the end of the case. Article 22. And when it should happen that the members nevertheless persisted in their given opinions, the President shall conclude according to the majority of opinions and votes. Article 21. Article 23. 2666 Yet in case the votes should be tied, it shall be concluded as the written law dictates in that regard. Article 24. Article 23. The cases having been reported and decided, one of the reporting judges, after the opinions of the members shall have been noted down by the secretary or registrar according to the aforesaid, must draft and write the dictum of the sentence, subsequently hand it over to the President, or in his absence to the presiding member, to the end of being read in the presence of all the members who voted on the decision, and judged whether the same agrees with the conclusion reached. Which sentence, having been drafted in due form by the aforesaid registrar or secretary, he shall hand over the same together with the dictum to the President for collation, in order to be resumed and registered in full council at the earliest opportunity, as well as pronounced on the first court day, until which time the same sentence shall also have to be kept secret, on penalty as has been enacted in the chapter dealing with the Council of Justice. Article 26. The reporting fee shall be regulated according to the sessions held thereon, so that of all lawsuits for each hour no more shall be taken than 2½ rd:r, of which the reporting judges shall enjoy one half, and the other half shall be distributed Article 27. 2667 distributed among the remaining members who have heard the report and have been President in examining the case from the beginning to the end. Article 28. And in case the losing party is condemned in some portions of the costs with set-off of the remainder, the reporting fee, in the manner as before, shall be advanced and paid by the prevailing party, and can only be recovered by this last-mentioned from his counterparty for such portions as he was sentenced to in the said costs, as well as for half of the remainder, and thus in case of a single set-off of the costs, for the exact half of the entire amount; all notwithstanding opposition or appeal. 2668 Chapter 7. Concerning the Advocate Fiscal of Netherlands India. 1. The Advocate Fiscal of Netherlands India shall have to be of the reformed religion and make profession thereof. 2. As well as solely be subject to the President and Council of Justice and have to recognize no one in the exercise of his office except solely the said College, from which he, or indeed from the President in particular, shall have to receive all orders and deliver the reports in person thereto, as also upon his appointment, before his admission, show and hand over his commission to the President and Council; just as also the baljuw and landdrost in mixed cases shall strictly regulate themselves according to everything that is ordered in this chapter regarding this fiscal. 3. Yet in extraordinary occurrences, and where there might be periculum in mora, the High Government or the Governor-General alone shall have the power to command and enjoin the aforesaid Fiscal to execute attachments upon persons and their goods, provided that within twenty-four hours communication and notice thereof be given to the President of the said Council; just as the aforesaid officer shall also, as quickly as possible, have to relate his executions and proceedings in the aforesaid case to the said President, who shall then bring the same before the Council of Justice for deliberation, in order that it may be disposed of according to the findings of the case. 4. have in the Council of Justice, and in civil matters just as a member of the Council have an advisory and concluding vote, but shall not advise nor be present when opinions are given in lawsuits where he is an associated party, nor in matters concerning the high authority and the Honorable Company. 5. The Advocate Fiscal of India shall not be permitted to reveal the secrets of the Chamber etc., in such manner and under such penalty as is expressed in the 12th article of the first chapter of this instruction with respect to the Councillors, and shall further be required to conduct himself both regarding the prohibition against being tax farmers or partners etc., and receiving gifts and presents, giving advice or counsel, and the order to take the oath of purgation, according to what has likewise been established in articles 9, 10, 11, 13, and 14 of the aforesaid first chapter concerning the members of the Council. 6. The Fiscal and his subordinates shall be obligated to obey the orders and commands of the President and Councillors, as well as to appear whenever they are summoned by the President in their official capacity. 7. The Advocate Fiscal shall not be permitted to travel outside the city of Batavia without the consent of the President of the Council. 8. And traveling outside the city, he shall be obligated to instruct and provide for the Water Fiscal, or in his absence one of the other officers, to preserve and sustain the matters of the high authority and those of the Honorable Company in such manner as the Fiscal himself, being present, would be obliged to do. And in case it should happen that through a legitimate excuse or other legally acceptable reasons he should not be able or permitted to serve, the Water Fiscal shall substitute for him, just as he vice versa, in such cases, must also act for the Water Fiscal. 9. The Advocate Fiscal shall be required to be present on the appointed court days and whenever the Commissioners summon his cases for inquests and examinations, or in case of absence, illness, excuse, or other legitimate reasons, the one who substitutes for him, to the end that the prisoners, delinquents, and others prosecuted and sued by him in court shall not have their cases delayed, but brought into a state to be dispatched. 10. And in case the Advocate Fiscal should believe he has reasons to excuse himself in his official capacity from this or that case, he shall be obliged first to address himself to the Council of Justice and give notice thereof, so that it may be provided for and dealt with as is expressed at the end of the first chapter, article 30. 11. The Advocate Fiscal shall enjoy from the confiscations a lawful half, after first deducting the two percent that is allocated therefrom to the members of the Council, and further all charges, costs, and expenses of justice; but from fines and mulcts estimated in the laws or placards at a certain or fixed sum, such portions as are established therein; and furthermore of all other arbitrary fines as much as shall be awarded to him by sentence. 12. The Advocate Fiscal shall have in service for his assistance and the execution of all commands and orders two Dutch or European servants, as well as in addition thereto as many native Caffres as shall be necessary for the service and dispatch of justice. 13. He shall also be obligated to attend to all matters concerning the rights and majesty of the high authority and in particular to take good care of the honor of justice, as well as to preserve and defend the domains, rights, and privileges of the chartered Netherlands East India Company, and likewise in all matters and disputes arisen or yet to arise in the aforesaid cases (wherein the interest and concern of the country and those of the aforesaid Company are mingled) wherever it is required and requested, to observe, sustain, look after, solicit, and defend against all and everyone, whether as the principal party or joined with others, in such manner as shall be found appropriate according to the exigency of affairs. 14. The Advocate Fiscal may, with the advice of the Council, inquire and inform himself throughout all of Netherlands India regarding all offenses, abuses etc. of the Company's servants, with the exception of those which are specially assigned to the Water Fiscal in the following chapter; and in mixed cases he shall conduct himself according to what is established in the 33rd article of the first chapter of this instruction. 15. The Advocate Fiscal shall at all times, when instructed by the Council, also be obligated to inform himself about the extortions, exactions, and abuses of all officers of justice and other persons subject to the Honorable Company. 16. And in case it should happen that any parties who were sued in court by the Advocate Fiscal should submit themselves to the arbitration of the Council to avoid long lawsuits, costs, and trouble, the Advocate Fiscal may likewise submit himself insofar as the President and Council deem it proper according to the circumstances of the case, who shall terminate the same without long delay, according to what they shall find to have been abused against the high authority and justice. 17. It being well understood, however, that in matters touching the country's freedom, rights, high lordship, sovereignty, finances, domains, and so forth, he shall not be permitted to do so without first having obtained leave and permission thereto from the Governor-General and Councillors of India, and being equipped therewith with a resolution or written order. 18.

The advocate fiscal shall not be permitted to take on any cases for officers or others, unless there are reasons for it and by ordinance of the Council, in so far as it touches justice, or of the governor-general and council of India, for as much as it concerns the domains, finances, etc. 19. And when the advocate fiscal might be ordered by the highly mentioned governor-general and council, whether regarding matters concerning domains or finances or indeed others, to institute any action, he shall, before initiating anything, be required to give notice thereof to the president and Council, so that it may be disposed of by the same according to the findings of the case. 20. Item, the fiscal shall not be permitted to draw anyone into a lawsuit except after obtaining prior information against the one whom he wishes to prosecute. 21. And the same shall take no prior information, nor put anyone into detention, or make any seizure, unless by ordinance of the Council or in cases where he was present when the offense occurred, or if any private or contraband goods were discovered, in which latter cases he shall be permitted to do so ex officio, though being required to give notice thereof immediately to the president or Council. 22. Also, after obtaining his information, the mentioned officer shall be required to supply the same to the Council, and to submit it there on the basis thereof, to make such requests, whether for the seizure of any goods or for apprehension, incarceration, hostage-taking, summons in person, or others, as he shall deem to correspond with the nature of the offense and the delinquents, as well as with other circumstances of the cases. 23. The advocate fiscal, inquiring ex officio, shall conduct himself uprightly and sincerely in obtaining the information, and thoroughly investigate and diligently pursue the cases in all their circumstances, as well as pay attention to the motives, reasons, and arguments, both of the defense of the prisoners and the accused, and of their accusations. Furthermore, the fiscals, bailiff, and landdrost may anticipate one another in fresh deeds in apprehending those whom they shall catch in flagrante delicto. 24. Item, the advocate fiscal shall be permitted at all times, notwithstanding the state of the cases, provided it has not yet been concluded, to join in the proceedings or take his conclusion for the benefit of the high authority by ordinance of the Council. 26. And if it happens that the cases in which he has joined are held back, he shall nevertheless be bound to proceed against the opposing party for the interest of the sovereign and the Honorable Company. 27. And when the advocate fiscal has joined with a party, the said party shall not be permitted to make use of any writings, records, or memoranda before and until the fiscal shall have had inspection thereof. 28. However, none of the parties shall be permitted to join with the advocate fiscal except at his own expense. 29. The advocate fiscal shall not be permitted to compound for any fines or penalties exceeding the value of six rix-dollars heavy money, unless the president and council, for important reasons, at the request of the parties, agree to the same, in which case it shall be left to his discretion; however, in cases of great interest and consequence, two commissioners shall be appointed by the council from among its members, in whose presence the composition shall be settled, to the end that the Company's portion in all the aforesaid fines and penalties, both by the mentioned composition and condemnation, remains undiminished. 30. Furthermore, he shall be required at all times to help or assist the bailiffs of the Council in executing their arrests and legal writs. 31. All criminal trials which, according to orders and custom in India, are sent over fully prepared from the outer trading posts with the accused to the Council of Justice in Batavia for decision, shall be placed into the hands of the advocate fiscal, who shall examine the same exactly and provide the council with a written report on how he found them handled, and whether any defects might reside therein, or whether the same are properly in a state to be finally concluded. 32. Furthermore, the advocate fiscal shall, in all criminal actions instituted by the respective officers at the outer trading posts and from which an appeal has been made, be required to substitute for the mentioned officers and prosecute the cases before the Council, or else, upon findings, with the advice of the council, to desist therefrom or to proceed further therein as shall be deemed appropriate. 33. Just as he, with advice as before, shall be required to appeal for the interest of the high authority in cases where the appropriate punishment according to the nature of the offenses was not inflicted by lower judges, and yet such verdicts have remained without appeal, excepting however those which entail the death penalty and are approved by the political authority. 34. And concerning the prisoners who are sent over from elsewhere to Batavia, and by ordinance of the governor-general are brought into the Company's irons, the fiscal shall as soon as possible give proper notice thereof to the president or Council of Justice, and shall not release any of the same except with the prior knowledge of the aforesaid council, without whose special disposition he shall also not be able to set at liberty any other prisoners or hostages. 35. Item, the same shall detain no one or keep them locked up in his private so-called jail longer than at most the duration of twenty-four hours, after the expiration of which he shall be required to release them or transfer them to the lord's irons according to the circumstances of the cases. 36. Likewise, to keep an exact register of all cases that he has pending before the Council, both ordinary and extraordinary, as well as those in which he has joined, in order to show the same to the Council when admonished to do so. And that officer shall also have to take good care that all criminal cases are prosecuted with the greatest speed to be concluded, so that no prisoners waste away through prolonged detentions, or remain incarcerated to great and unnecessary expense of the country, or are kept lingering in uncertainty. Item, the same shall have a seat in the Council of Justice, and regarding all cases and occurrences, except the criminal ones and those applicable thereto, an advisory and concluding vote. 3. Item, he shall also have in service for his help and assistance, as well as for the execution of all arrests, sentences, appointments, and dispositive orders, two Dutch or European servants, together with as many native Caffres as the requirement of affairs shall necessitate. 4. And if any private unpermitted merchandise or contraband goods are then discovered, the same, and where the matter so requires, also the guilty persons, shall by order of the aforesaid Commissioners provisionally be placed into secure custody until further disposition by the Council. 7. Subsequently, the Water Fiscal shall be bound to proceed against those seized goods and against the offenders, with the prior knowledge and approval of the Council, as the ordinances and placards entail. 8. But it is here to be noted that in case the Advocate Fiscal of the Indies had obtained knowledge of any private trade or contraband on the Company's ships on the roadstead or outside it, he shall also be obliged to be vigilant and inquire in that regard, as well as to pursue his right upon overtaking, provided however that he shall not be permitted to undertake such earlier than after the customary inspection shall have been done. The secretary, or clerk of the court, and the sworn clerks must be of the Reformed religion, and also stand under the orders of the president and councilors of justice, and therefore, in the performance of their duties, depend solely upon that same collegiate body. Article 2. And before assuming his duties, the secretary or clerk of the court shall be required to post security in the sum of 4000 rix-dollars on behalf of those who might be prejudiced through his misconduct or negligence. Which respective said registers he shall be obligated to present every month to the president, or in his absence to the senior councilor, to be inspected and examined to see whether proper diligence has also been exercised in the registration. And in order that the state of the matter may be evident to the council in cases concerning insolvent estates and disputes regarding preference and concurrence, he, the secretary, in his capacity as curator or sequestrator, shall additionally submit upon production and subsequently disclose on his inventory of documents a proper balance sheet of the debit and credit. Article 33. Likewise, from now on, the same shall be required, as curator or sequestrator, after proper inventarisation, sale of the goods, and (as far as possible) collection of the outstanding debts, at the latest within two months after the curatorship or sequestration shall have been ordered, to summon all known and unknown creditors to institute their actions and to see the judgment of preference and concurrence held, without this being allowed to be postponed on the grounds that all the assets and debts of the estate might not yet have been collected, or under any other pretexts. Article 34. Then, also after the pronouncement of the sentence, in order to halt the accrual of further interest, he shall immediately, notwithstanding any of the aforementioned pretexts, satisfy. And the Council of Justice Furthermore, they must place the aforementioned registers in a separate case and keep them secret, as well as both diligently ensure that no drafts, minutes of missives, muniments, acts, transactions, documents, writings, certificates, appointments, interrogatories, whether in civil or criminal resolutions, minutes, sentences, whether interlocutory or definitive, are left lying about the secretariat, or that simple copies or extracts are made from them and drawn up, except, when required, with the prior knowledge and approval of the President and the Council, on pain of being suspended from their office, and moreover the clerk shall be punished arbitrarily. The principal duty of the first sworn clerk, over and above the aforementioned, shall also be that he must attend matters being argued before Commissioners from the Council and keep proper notes of their proceedings. He shall also be obligated to handle the minutes and pleadings held before the Commissioners of Small Claims, just as the secretary of the Council is ordered to do for the full College, and further generally govern himself according to the orders prepared in both chapters of the Commissioners of Small Claims, for land commissions, and for inquests. Item, he shall ensure that each of the Commissioners of Small Claims and of Inquests is handed, the day before the proceedings and the holding of the roll, a proper roll together with the informations and acts upon which litigating parties request a re-examination, or upon which any persons must be heard or inspected. Also, upon the death of one of the attorneys, he shall, by order of the President or the Council, properly accompanied by witnesses, proceed to the house of the deceased, in order there to make a true inventory of all the pieces, acts, documents, and writings of the deceased relating to lawsuits pending before the aforementioned Council, together with their minutes, duplicates, or simple copies, to the end that these may be properly disposed of. Article 51. Item, he shall ensure that every month a proper memorandum is prepared of all prisoners, hostages, and arrestees, with a statement of the numbers of the rooms and wards where they are held; item, an advisory roll of the lawsuits that are ready for judgment, whether communicatory or other civil, or criminal, ordinary or extraordinary, always supplemented and laid ready in the box for the President. Article 52. As well as to examine very precisely the sentences of such persons who have been condemned to ad opus publicum for a certain time, and to prepare a relevant list thereof monthly, and deliver it to the President with a statement of those who must be released and discharged, and alongside this prepare an act to be signed by the President. Article 53. Furthermore, in the event that the respective attorneys should be obliged to summon their principals or parties to accept the bills of salary and procedural costs, and these are reduced, or that the aforementioned principals or parties should come to complain about the exorbitance of the said bills, whether already paid or yet to be paid, such bills shall be compared by one of the aforementioned sworn clerks, at the expense of the losing party, with the list of established fees and the various items entered accordingly in the margin, and, this having been done precisely, all such bills shall be handed over to the Monthly Commissioners for taxation, approval, and signature; the said clerks shall be remunerated for the aforementioned examination and drafting as expressed in the chapter on salaries. And if it should be found that any abuses or excesses were committed by the same clerk in this regard and discovered by the Commissioners, they shall be arbitrarily punished on that account.
