From Souratta under date 17 April 1743. as well as that the same at present were brought so far into order as time had allowed; it is understood to record this here, and to remind the residents, by outgoing letters, of what was written thither by this assembly with respect to the closing of their little books under date 4 July of the past year. But concerning the request made by the residents to be permitted to present a sight-offering to the city governor Miersabeek upon receipt of the expected robe of honor from the imperial chancellor Nesaam ulmolk in confirmation of his rule, it is found proper not only to admonish them of what was resolved by us on 8 August of the past year concerning this, and communicated thither by letter, but furthermore to order them anew only to offer the customary gifts to the regents upon receipt of such honorary presents as come directly from the king, or when on other occasions it shall be agreed by us as absolutely necessary. Today, the 27th of February Anno seventeen hundred and forty-two, appeared before me, Hugo Pieter Faure, sworn first clerk of this Surat Directorate, standing under the supreme command of the Honorable Jan Schreuder, Director, in the presence of the witnesses to be mentioned below: the assistant Hendrik Kroonenberg and provisional assistant Martinus Bovie, who together and each individually, in the love of the truth at the requisition of the junior merchant and provisional warehouse master Arent Willem Ninaber, declare it to be true and truthful that they, as commissioners in the gift warehouse, were present at the weighing of a soekel of mace, and observed that it weighed only one hundred fifty-five and a half pounds gross, without more. In order herewith to comply with and fulfill Your Honorable, Respected, very esteemed verbal order, we the undersigned, From Surat, under date 17 April 1743. the undersigned, having been expressly commissioned, proceeded yesterday in the presence of the merchant and fiscal, the Honorable Abraham Cornelis de Lahaije, to the Honorable Company's Equipage Warehouse; further, we there very precisely inspected a heavy anchor cable of 17 inches, which on account of the presently occurring inventory had to be uncoiled for inspection, which has been so damaged in diverse places by rats and mice as we shall hereafter strictly and to our best knowledge record here, and must therefore firstly testify: that we, at approximately 26 fathoms counted from the end, found that a full half strand of the same had been chewed through by those vermin, of which we saw not only the chaff or gnawings but also the dead rat, which was completely dried out, lying between the rope; and that, secondly, in diverse places of the said cable, namely at the length of approximately 18, 19½, 25, 31, 56, and 57 fathoms from the beginning or end, at all those spots some yarns have also been damaged; furthermore, that there were also some slight surface grazes here and there along almost half the length of the cable, but that conformity with the statement of the master of equipage, Barent van der Net, it suffered little harm there as well as at the above-mentioned six different places, but that the said cable at the cited length of 26 fathoms, where half the strand is gone, before it can be of use, will have to be spliced together. From Surat, under date 17 April 1743. submitted for consideration that, whereas there was no one here who could give an unshakeable report as to how best to employ this rope, and whether the same, having been spliced, might safely be delivered for the required use without apprehension; whether it was not better to postpone the positive decision regarding this until, upon the arrival of a ship or ships, the necessary measures could be planned with more foundation following a closer inspection by persons knowledgeable in sea and shipping matters. Whereupon the members, after deliberation, jointly applauded the proposal of his Honour, and thus decided by unanimous vote to cause the same to take effect at the time and in the manner as stated. Subsequently, the presiding gentleman produced a written report concerning 12 chests of nutmegs sprinkled with cloves, which on the 25th of the recently passed month of August, upon the delivery of the remainder of the spices to the merchant, were opened and garbled in the presence of two commissioned members from the honourable Council of Justice, and in the presence of the merchant and fiscal, the honourable Abraham Cornelis De Lahaije, and were found to be as the following document dictates. From Souratta under date 17:' April 1743. death have already been taken into sequestration by your Honour; that your Honour might have the goodness to allow me to receive, under a proper inventory, not only all the papers, cash, and goods that the deceased had vacated and left behind at death, but also those that may already have been or may yet be addressed to him from Europe and other regions, in order to deal with them in such manner as our laws and customs entail. And since this reasonable request is not only founded upon general and specific laws, but is also supported by the treaties concluded between his royal majesty of Great Britain and their High Mightinesses the Lords States General, our lawful sovereigns; I cannot understand what reason could be found whereby the unfairness of your Honour's conduct would appear if my request were granted, notwithstanding that your Honour is pleased to say so. For assuming this, it is notorious that I, who am the causa movens thereof, must be far more unfair and unreasonable regarding my demand: which your Honour, however, without offending the laws that both your Honour and I are commended to observe, will never be able to prove, much less excuse yourself with the argument adduced: that the deceased had bequeathed all his trifles and meager effects by will to her whom he declared to be his lawful wife, and who on that account had already taken possession thereof; item, that he left nothing of importance, and had existed more through the charity of others than through his own means; for although one cannot with reason contradict the latter, the same nevertheless does not 307 From Souratta under date 17:' April 1743. take away the claim that the Honourable Company has both upon his left-behind papers (if there were nothing else of importance remaining) and upon that which (as already said) might be or may yet be addressed to him from Europe and other regions; nor can it be unknown to your Honour, firstly: that a fugitive is not capable of disposing of his left-behind goods by last will, since these, if there were no creditors at all, have ipso jure fallen to his supreme authority; secondly, that a concubine, without the customary formalities, cannot be instituted as heir as a lawful wife. This being the truth, just as one will never be able to dispute it, causes the otherwise inadmissible disposition to fall away in this matter as well, although it does not even depend on that. For even if a fugitive were capable of making a will, and of declaring a concubine to be a lawful wife without prior lawful union, the Honourable Company would still be entitled to preference; since according to all laws no inheritance, whether ab intestato or ex testamento, can take place as long as the debts of the estate are not paid. From Souratta under date 17 April 1743 Finally, they proceed to the rereading of a Broot Chia missive dated the 15th current; however, since there is nothing substantial to decide upon it, it is merely noted in this matter, by order of the Right Honorable Lord Director, that the Secunde of the said office, Hendrik Kronenbergh, pursuant to what was ordained by letters of the 12th current, has sworn to his issued declaration dated 27 February of this year regarding the weighing of a soekel of mace, see the certificate written behind it; and that consequently the record made in this regard by the Resolution of 23 August last has in all this been fulfilled. From Souratta under date 17 April 1743 The members having been expressly called together by the Lord Director to deliberate on what is necessary regarding the Broot Chia office; they first reread the missive received from there dated the 15th of the past and the 2nd of this month; and since regarding the first the principal matter has already been recorded in the Resolution of 28 September last, they resolve to authorize the Residents, upon their request made in the latter, to proceed with the finishing of the 800 pieces of blue Kannekeyns for Cochin at the allotted price of 2 23/32 rupees, even though it is 1/16 rupee more than in the Year 1739, for the reason that the refreshing could not be bargained for less due to the high price of last year's indigo and the earliness of the season, in order to have them ready towards the end of this month, together with and alongside the coarse niquanias for Ceylon and Malabar, as well as the remaining sorted Basta Broot chia and black Cangams that are ready for Batavia, in conformity with the decree of the 22nd of the past month of June. From Souratta under date 17 April 1743 Proceeding further to the examination of the also received statement regarding that which has been disbursed on account of the contracting, and having observed therefrom that, besides the amounts of the previous year's returns, an amount of 496 rupees is still held by the broker Goordendas, which according to what is noted thereon was to serve for providing the finishing and packing; it is resolved to order the Residents of the said office to cause that small sum to be paid out at once, and according to necessity to disburse from the cash funds on a separate warrant each time as much as they shall deem necessary for refreshing, finishing, and packing the goods, in order thereby to prevent such expenditures from being mixed with the disbursements on the collection. And although it also appears from the mentioned statements that there is still a notable amount of 18558 3/64 rupees outstanding on the new contracting at that office, it has nevertheless been found fit, for the vigorous progress of the work, to remit further, at the usual loss of 2 1/2 percent, the sum of ten thousand, with advice to the Residents that the capital and their respective broker, when entrusting such to the suppliers, may disburse it for the greatest part on the coarse Corraats and long niquanias; as these, alongside the remaining Keesdhaars cloths, must have priority. The Council, having heard this proposal and, after prior deliberation amongst themselves, having declared to the Director that they could devise no better means than to send the brokers out once more, and principally to have a positive answer demanded from the merchant who delivered very sound goods in the latest year, to the end that what is useful might be decided upon with certainty; so was this carried out immediately, and during the sitting it was reported by the said brokers that, notwithstanding that all possible means had been employed by them to persuade this man to some reduction, they had nevertheless been able to effect nothing advantageous unless one wished to have the quality thereof 337 From Surat under date 1 April 1747 diminished, as he testified to have hardly been able to recoup his incurred expenses in the past year; but that nevertheless, in the hope of experiencing better times and to keep the delivery of the Honorable Company, he undertook to deliver here free of charge that blue at the previous year's prices, namely: the Chirges the maund of 36¼ lb for rupees 43 Ditto Jambusir the maund of 36¼ lb for rupees 20 provided that, if the disputes between the Maratha General Damaji and his governor Umabai, whereby the land route could become still more unsafe, should be of long duration, one of the Honorable Company's vessels be granted to him to fetch the same out of the Jambusir river.
