Surat under the date of 17 April 1743 Since a longer delay would not only give precedence to the numerous competitors, but would also often be the cause that, due to the shortage of time, only a small quantity could be procured, it was resolved and decided with unanimous votes to waive the collection of the Indigo Biana as it is unobtainable, and in accordance with the latest homeland demand, based on the samples of the past year and the aforementioned condition, namely if the land route is unsafe, to contract for 40000 lb Indigo Chirgees against ro/a 43: dem: v: 36 ¾ lb 20000 lb dito Jamboesen against ro/a 20: dito 36 ½ lb as well as, for a speedy progression of the work upon the urgent request of the brokers, to have advanced from the main cash chest a sum of ro/a 20000:- And whereas the demanded goods from Broach for Ceylon and Malabar, according to the obtained reports in fulfillment of the order of this meeting, will be ready there on the spot by the end of this month; it was therefore decided to let the Chief Mate and Equipment Overseer Barent van der Net, together with the small-vessel master Pieter Pietersz: van Barendregt, provided with a proper instruction for their guidance and observance, depart on the upcoming 24th with the small vessel Batavia to fetch the same, as well as the further assorted Basta Broach and black Cangams bound for Batavia later on; as well as to supply that small keel with a corporal and eight common European soldiers, likewise two dito sailors, for the necessary defense against the roving sea rovers. Likewise, it was resolved to send the small-vessel master Michiel Rust with his small vessel De Speelman, reinforced with a corporal and six common Bugis soldiers, the day after tomorrow, upon issuing a proper instruction, to the mouth of the river, in order to await there such keels as might be destined hither from Batavia or Ceylon. Subsequently, the Honorable Director having submitted to the meeting for consideration whether it would not be best to dispose of the surplus of the provisions—which, pursuant to the secret decree of 29 July of the past year, were purchased upon the feared approach of the Lord Nasserjing, and for the aforementioned reasons by secret resolution of 14 November following had already for the greatest part been redistributed among the Honorable Company's servants and sold off—likewise in the most convenient manner to prevent spoilage and great loss: this proposal, being accompanied by necessity, was approved by all members together, and consequently decided to distribute the 2760 lb salt, 1173 lb arrack, 1500 maund firewood, and 2000 dry cow dung cakes still lying in the warehouses, also in so far as is practicable, to the clerks and soldiers, and to sell the surplus likewise in the best manner. Also, by order of the Honorable Director, it was noted herein that, pursuant to what was decreed at Leiden as inserted in the Resolution of the 28th of the past month of December, the burning of the unnecessary books in the presence of the express commissioners Paulus Liproost and Rykert Abraham Bouman, see the report made thereof on the 13th of this month, has been accomplished. Upon rereading the Ahmedabad letters of 19 September last, as well as the 6th instant, perceiving no matters of substance that merit any note herein, they proceed to the examination of a specification received alongside the said letters of such expenses as were incurred by the residents, pursuant to the previous authorization, see the decree of 27 July last, for the building of a wagon house, the rebuilding of the back wall, and the repairing of the side walls, to the amount of ro/as 242 3/64 or 363: 2: 8: and although this account is ro/a 12 3/64 or ƒ 18:2:8 higher than the calculation previously sent and inserted in the cited resolution states, it was nevertheless, for the reason that it is impossible to estimate such expenses so precisely, decided to approve the same for entry in the books, and to grant place below for consideration. Specification of such expenses as were necessarily made and paid for the rebuilding of the collapsed back wall of the old stable, the making of the new lean-to to shelter the Honorable Company's wagon, likewise the building of a wall on the inside and the repairing of the walls on the south and north side there, all in conformity with the honored authorization of the Right Honorable Director Jan Schreuder and Council by letter of 30 July of this year, namely:

From Souratta under date 17 April 1743 the secretary of that Council Willem Hoeffman as well as by writings by the Honorable worshipful residents there at the Office may be ordered to assist the said Commissioners in all cases where such shall be deemed necessary by them in the service of Justice, awaiting your Honorable worshipful disposition we shall remain with profound respect, stood below, Honorable worshipful commanding Sir, your Honorable worships' very humble servants, lower, by order of the Honorable Mr. President Johannes Pecok together with the other members of the honorable Council of Justice, was signed, Wm Hoeffman secretary, in the margin Souratta the 16 October anno 1742, even lower, the undersigned having reviewed the preceding request grants the requested instances provided the Company regarding the ferrying across of the persons named therein be kept free of expenses, Souratta the 16 October Ao. 1742, was signed, Jn. Furthermore, on account of the approaching Diwali, the heathen New Year's festival, it was approved to have distributed to the Company's principal native servants according to annual custom the usual Pomerys, honor veils, together to the value of ro/as 158:— or ƒ 237:—:— in the following manner, namely 2 pieces to the broker Roederam at ro/a 54:— 2 pieces to the broker Kissourdas at 54:— 1 piece to Persian writer Narangie at 20:— 1 piece to Warehouse writer Kassiaam at 15:— 1 piece to Court messenger Wassier Mhamet at 15:— 7 pieces together amount to ƒ 237:— or roas 158:— subsequently 347 From Souratta under date 1 April 1743 Subsequently were read the Brootchia letters of the 7th and 12th of the current month, the latter enlarged with an appendix dated the 13th thereto; and whereas what is noted therein requires no further reply other than that upon their made request it is approved to have the broker Goordendeas draped according to custom with a Pommerij on the day of Diwali; so for the rest it was only resolved to order the residents pursuant to the petition inserted hereabove not only to assist in all respects as shall be necessary in the service of Justice the Commissioners now sailing thither, and to show them all honor and courtesy so far as such can occur without expense to the Honorable Company; but also to take care that the usual pilots are at the mouth of the river early to await the small vessel; and furthermore that all possible speed and diligence be applied to the loading and dispatching of that small craft, stood below, thus done and decreed in the Chief Office Souratta on the day, month, and year aforesaid, was signed, Jn Schreuder, Is Pecok, Ar Coms dlahaye, Ar Wm Winaber, Fk Kristenstein, and Eo De wendt 1½, and provisional secretary. Wednesday From Souratta under date 17 April 1743 Recently or on the 23 October last it having been reported to the master commanding by the Master of the Equippage Barent Vander, how the small-vessel skipper Pieter Pietersz van Barendregt declared to have heard from the mouth of the comforter of the sick Dirk Oortmans that he had lost his eye through the doing of the provisional secretary of this assembly Eyso de Wendt, and that he had therefore prepared a loaded musket in readiness in order to shoot the said secretary therewith from one of his windows when he passed that way, his Honor, being astonished by this report, not only ordered the Master of the Equippage alongside the small-vessel skipper to pass proper depositions thereof at the secretariat for testimony of the truth, but also Wednesday The 14th November, Ao. 1742 All present at the same time 349 From Souratta under date 17 April 1743 at the same time gave order to place the said comforter of the sick in civil arrest in order to prevent all consequences that a reckless, frivolous nature might sometimes carry out, and this the more so because the Fiscal Delahaye, for the reasons aforementioned by resolution of the 2nd of the aforementioned month of October being on the point of his departure for Brootchia, could not immediately investigate this matter; but that officer now having returned and the collective members being assembled by convocation of the Lord Director, this aforesaid matter with all its circumstances was not only presented to the Council by his Honor, with the addition of the abovementioned depositions, but also in particular the Fiscal was ordered after exact review of the written testimonies to declare whether he should believe he has any action on that ground against the said Oortmans; the Fiscal having well considered this proposition alongside the Council and having taken into consideration that the two depositions can be regarded as no more than one, regarded From Souratta under date 17 April 1743 inasmuch as the first deponent testifies to that which he heard from the other; so upon the declaration made by the officer that such is not sufficient in law to institute any action against the detainee thereupon, it was approved to have the comforter of the sick appear before this assembly and to read the depositions to him, in order to be able to arrange what is necessary on a good foundation after hearing his answer; this then having been accomplished in that manner, and the accused having answered that he could testify before God and the entire assembly with a quiet conscience that he never had those thoughts, much less that evil intention, as he was himself assured that his eye was not injured by the secretary but by accident, it was after ripe deliberation approved and resolved the repeatedly mentioned Dirk Oortmans upon his sincere declaration before God

Today, the 23rd of October Ao. 1742, appeared before me, Willem Hoeffman, sworn first clerk of this Souratta Directorship, standing under the supreme authority of the Honorable worshipful Director Jan Schreuder, in the presence of the witnesses to be mentioned hereafter, the Chief Mate and Equipage Overseer Barent van der Net, who, out of love of the truth and advocacy of justice, and that at the requisition of His Honorable worshipful aforementioned, declared it to be true and truthful how, some time ago, days and date unknown, towards the evening, sitting outside at the small gate of the Company's shipyard, the barge skipper Pieter Pietersz van Barendregt, coming from within, reporting to the said Equipage Master, had come back, and subsequently related that he had been to the comforter of the sick, Dirk Oortmans, and had heard there from the same that he had lost that sight through the doing of the principal secretary Lysode Wendt, who had thrown some dirt or cow dung at him at the black guard, and that on that account a loaded musket was ready for the same, to teach said secretary a lesson therewith from one of his windows when he should pass that way. 355 From Surat under date 1 April 1743 in such polite terms sufficiently final from the hand, bringing forward how he maintained that by granting this request, the national protection granted to Phoonsen would be violated, principally because through such action the widow of the deceased would have nothing to subsist on; item, that he could not comprehend how neither our laws nor those of any other nations affirmed the lawfulness of the claim; and that therefore nothing else remained than merely to protest against this action, and to leave the consequences thereof for his account, thus it was also determined and resolved to cause this to take effect at the earliest opportunity. However, the Lord Director, during the session, being informed by a separate missive from the cited Mr Law that he was about to depart for Europe on the 25th of this month and that in his place Mr William Wake had been appointed as Governor of Bombay, this was communicated by His Honour to the council From Surat under date 17 April 1743 communicated and at the same time submitted for consideration whether it were not better now to postpone this protest for some time and rather first give the new governor thorough knowledge of the entire matter by sending all letters exchanged back and forth in this regard; the more so because it would be improper to protest against someone who is ignorant of everything and besides might possibly have a completely different sentiment than his predecessor; which was then also approved by all members and thus resolved with unanimous votes to send the mentioned Mr Wake not only all the missives that were written successively back and forth regarding this case, but also to show in a further letter how improperly the cited Mr Law comes to call the protection granted to the deceased Phoonsen a national protection, with the request to consider this matter well and to provide such peremptory and positive answer thereto as he shall judge proper. Honourable and Valiant Sir, Being informed by reliable reports that Mr Law has departed for Europe and Your Honour has succeeded in his place as Governor, I find myself obliged, after preceding polite congratulations on the obtaining of that honourable dignity, to inform Your Honour how, by virtue of the lawful claim that the Company has on the estate of the former Director Pieter Laurens Phoonsen, who died as a fugitive at Bombay, I requested of Your Honour's predecessor mentioned above, not only to send me all the papers, cash, and goods that the said Phoonsen vacated and left behind upon his death, but also whatever might already have been or might yet be addressed to him, under a proper inventory, in order to be able to act therewith as our laws and customs dictate. This answer being completely unsatisfactory with respect to my petition, I considered it my duty by a further missive not only to convince His Honour of the contrary regarding the latter, but also at the same time to object that a testament made by such persons and under such circumstances could not possibly hold validity, and therefore I continued to persist in my requisition; yet by this remonstrance I effected no more than by the first, since Mr Law, after having cited once again the made testament as the foundation of his answer, declared that he could not possibly grant my request, since he maintained that thereby the national protection granted to the deceased would be violated, principally because through such action the wife, or as I called her, the concubine of the said Phoonsen, would have nothing to subsist on; item, that he could not comprehend how neither our laws nor those of any other nation affirmed the equity of the claim. However, with respect to the first, I must say that it is impossible for me to fathom on what grounds His Honour can call the protection granted to the aforementioned Phoorsen a national protection, since such is directly contrary to the treaty of peace between His Royal Majesty of Great Britain, etc., and the High and Mighty Lords States General of the United Netherlands, concluded at Whitehall on 14 September 1662 and renewed at Breda on 31 July 1667; as well as the Treaty of Union concluded at Westminster on 1/19 February 1674; wherein the 6th article of the first-cited reads as follows: That neither the said Lord King nor the said Lords States General, or their subjects, shall receive in their lordships, lands, provinces, ports, and bays or regions, or any of them, anyone who has been or shall be declared a rebel or rebels, or a fugitive of the one or the other; nor shall they, in the aforesaid places or lands, or elsewhere outside their lordships, native countries, provinces, lands, ports, bays, or regions, grant, give, or supply to those or any of them aid, counsel, accommodation, soldiers, ships, money, weapons, ammunition of war, or victuals; nor shall either of them allow any person or persons in their lordships, native countries, provinces, lands, ports, bays, or regions, nor permit that to such rebels and fugitives any aid, counsel, accommodation, favour, weapons, ammunition of war, soldiers, ships, money, or provisions be given, ministered, or granted, but From Surat, dated 17 April 1743 shall effectively oppose, ward off, and actively prevent such. 313 From Souratta Under date 17 April 1743 The Amedabad booklets of the year 1741/42 having been received here on the 8th of October last, examined and inspected, the undersigned takes the liberty of briefly presenting in what follows the findings of the errors etc. discovered therein, namely: Upon reviewing the Journal and confronting it against the papers available here, to wit: The passed monthly accounts transmitted by the missive of 16 November of the past year amount to and are booked as follows: That of September amounts to ro/a 297 1/64 or ƒ 446: 8:— On page 4 it is booked with only „ 297: 13/60 „ 446: 7: 8 Thus written off less ƒ —: —: 8 This is a bad reduction in the transmitted account, which presumably was noticed there upon booking and changed without the authorization of Your Honorable Worships. That of October amounts to ro/a 291 1/16 or ƒ 437: 18:— Number 5 properly booked with „ 291 1/60 „ 437: 19: 8 Consequently booked more than approved ro/a — 64 or ƒ —: 1: 8 In this, ro/a 64 each too little was calculated for horse and ox fodder on the anna and ghee, but of which the Residents gave notice in their letter of 30 December and, according to permission granted by the missive of 19 January of this year, have redressed; for which reason we only record this difference pro memoria. The specification of the month of November approved by the letter of 19 January of the current year amounts to ro/a 352 1/64 or ƒ 529: 4: 8 Ditto, the same is written off with „ 352 1/64 „ 529: 5: — Consequently booked more ƒ —: —: 8 This is also a bad reduction in the transmitted account, which was discovered there upon booking and altered without prior knowledge. Here the signer of this cannot refrain from submitting to the consideration of Your Honorable Worships whether it would not have been proper for the Residents to have given notice to us of the difference of the reductions in the specifications of September and November, however small they may be, as well as of the miscalculation in that of October, rather than altering the one and the other on their own authority. On Page 10 the transmitted defective telescope of 7 feet with its true cost is written off at ƒ 70:—: 8 However, in their original and duplicate letter of 28 March last, the same is properly declared at „ 74: —: 8 Thus, according to the letter, written off less by ƒ 4: —:— With which difference of ƒ 4:—, or with incorrectly apportioned costs of ƒ 74:—:8, the said telescope was also entered here into the books of this main office; which could more easily have been prevented if the Residents had been somewhat more precise in their writing. The incurred charges amounting to 63:— in the transport of the wines and medicines overland from Cambaye to Amedabaad were cleared through a great detour; as for that amount on Page 43, Invoice Charges was debited in favor of the Travel Expenses account, subsequently credited again to the charge of Miscellaneous Wines and Medicines, and finally on Page 14 at the charge of the Travel Expenses account discharged from Cash upon liquidation of the first entry. Which threefold transfer could very easily have been avoided if those charges had been brought directly to the debit of the Invoice Charges account upon payment from Cash, and on the other hand subsequently to the credit by charging Miscellaneous Wines and Medicines; in that case, the back-and-forth shuffling of such a simple entry, described here, would have been prevented in a much shorter and better manner. On Page 18, 100 bottles of French wine with the cost of 78 jugs of sack wine are written off at ƒ 59:19:— and on the other hand the latter with the cost of the former at ƒ 46:11:—; and although the account of Miscellaneous Wines is closed in this manner so far, nevertheless, if the said wines had each continued on their own account, the French wine would have been credited with ƒ 13:8:— and on the contrary sack wine would have been debited for the same amount. On Page 21 the cash stands debited for ro/a 1906 2/32, and according to the inventory no cash was found therein; which is because of the 3 bills of exchange amounting to ro/as 2000 remitted in late August, the maturity of which had not yet arrived when the inventory was made, and consequently was not recorded on the same; but afterwards, pursuant to the order by the political letter of 12 October, they were entered into the books there; for which reason we also record this pro memoria. Furthermore, the undersigned has found all the entries that were recommended to the Residents for redress in the resolute reply on the findings of the books of 1739/40 to have been very well handled. Upon recalculating the Journal, such as: Number 4, the office of Souratta is debited in favor of Cash for ro/a 290: 17/156, for which stands reduced ƒ 436: 4:— And it properly reduces to „ 436: 4: 8 Consequently too little ƒ —: —: 8 This difference has already been pointed out in the findings on the books of the past year. To the Honorable, Worshipful Lord Jan Schreuder Director and Supreme Commander of this Directorship Honorable, Worshipful, Ruling Lord, The Broach trade booklets of the year 1742 received here on the 8th of October last have been examined and inspected by the undersigned, who could not discover therein anything other than the following upon reviewing and comparing the journal against the papers on hand here, as shall be shown to Your Honorable Worship in the remainder of this, namely: The 367 From Surat, dated 17 April 1743 The quantities of sample cloths which, pursuant to the resolutive reply on the findings of the books of the year 1739/40 according to the content of the transmitted attestation, were entered under the previous remaining balances in the journal of the year 1741/2 on page 1, are specified very unclearly with small dashes in one of the inventories received here of the end of August of this year from the 10th to the 13th page, indeed to such an extent that without the said attestation in the books one cannot see whether these signify whole pieces or merely fragments; furthermore, 2 pieces of raw cannequins for black of the year 1731 are noted in the cited inventory of the year 1742, and 1 skein of cotton yarn letter A of the years 1715 and 1722 is noted for yarn A, B, and C. Under number 25, rupees 204 3/4 were given as gifts and written off in cash upon the delivery of the gift goods for servants' expenses and bags of red basta, notwithstanding that in the political letter dated 23 May last permission was granted only for the expense of rupees 100 for servants' expenses, so that the remaining rupees 104 3/4, of which rupees 10 1/4 was spent on the making of red basta bags and rupees 94 1/2 according to their claim were delivered in accordance with custom as a gift to the servants of the regents, were delivered without any authorization. Under number 26, the writing materials to the amount of f 28:18:—, the French and sack wine to the amount of f 66:4:—, and the medicines to the amount of f 90:4:— were written off without having requested permission for it. The provisional Warehouse Master, Arent Willem Ninaber, having reported to the Lord Commander that the Company's lattij, in which the merchandise is stored upon arrival, was through two years of use practically completely deteriorated, and thus incapable of rendering the necessary services upon the arrival of the ships, which under God's blessing are daily expected, this was brought to the knowledge of the council by His Honor and at the same time submitted for consideration; whether it would not be better if permission could be obtained from the regents by means of a polite request to erect a new lattij of adequate posts and planks with a solid stone roof, instead of the old one which, according to previous custom, is merely partitioned off with fir bamboos and mats and covered with sails. From Surat, under date 17 April 1743 to recover as closely as possible that which belongs to the Company, but that in addition he was condemned in the costs and expenses of the lawsuit, and likewise declared to have earned no wages from the day of his detention. This report having been recorded in these minutes by order of the said His Honour, it was approved and resolved to close the account of the cited Holst, whose wages have already been stopped since 11 May of the past year, in the pay books of this directorship as soon as his small estate shall be inventoried, and to keep him under military guard until he can be sent to India's headquarters. The Lord Director also informs the council that, pursuant to the resolution of 17 December last, the regents had indeed been urged regarding the erection of a new warehouse with sufficient pillars and planks and a solid stone roof, instead of the old one which is merely partitioned with spars, bamboos, and mats, and covered with old sails, but that the city duwan Radjaram had kindly requested not to press formally for this for the present, since the governor, the Lord Theeg Beekchan, is again heavily occupied with his old passion for daily drunkenness and is therefore frequently in an ill disposition, and, considering this a novelty that had never been in use, might very likely refuse it entirely, under promise that he would gradually pave the way for it. Therefore His Honour deemed it best to wait with this for some time yet, and in the meantime to put the old one into condition through necessary repairs for the storage of the expected merchandise; which proposal was considered by the members, and resolved to carry it into effect. Likewise, on the proposal of the Lord Director, it is approved to have the bell, which has already been lying in the Equipage warehouse since the year 1704, hung at the Honourable Company's shipyard according to obtained permission. As also, in order to pursue the collection of returns more vigorously, to disburse from the main cash chest on the account of contracting to the Honourable Company's brokers Roederam and Kissourdas, 10000 rupees for indigo and 8000 rupees for cotton cloths and other printers, making together 18000 rupees. From Surat, under date 17 April 1743 Finding nothing in an Ahmedabad letter of the 4th current that requires any notation herein, except only the request made by the Residents to obtain the necessary monetary assistance for daily expenses, it was solely resolved to remit to them, alongside the first outgoing letter, two thousand rupees by bill of exchange under the usual loss of 3½ per cent. However, with respect to the Broach office, it was noted that on the 10th of this month a note signed by the provisional secretary by order of the Lord Director was dispatched thither, serving to accompany a packet addressed by the honourable Council of Justice to the provisional head Carel Berg. Yet to instruct the Merchant and Fiscal Abraham Cornelis de Lahaye not only to demand from the ship's officers the ship's journal along with the instructions handed to them at Batavia and Cochin, and to investigate what may have caused this long voyage, but also, if he deems it necessary, to have them provide a written report regarding this.
