Captain Barton, from here to Coromandel, likewise submitting for consideration whether the aforesaid persons had become a matter of some further reflection, now that the peace in Europe apparently stood to bring all kinds of ordinary navigators to India as well, also denied the confirmation requested previously on 16 July by a certain Monica Anthonijsen, widow of the citizen Hendr Abrahamsz, of the substantial relief granted to her by extract from the minutes of the proceedings and resolutions in the Council of India dated 7 June previously, with a Committimus to this Council, from the declaration of desertion of the appeal interposed by her against the sentence of the aldermen of this city between her and the former alderman Jan van Oort in his capacity, rendered on the date of 6 October of the past year, and deemed it in the highest degree necessary for the sake of the consequences, as well as previously determined by minute of 2 July concerning the aforesaid unqualified relief of the petitioner against a definitive order issued by us, to give Your High Honours the required notice, as we have the honour to do hereby, with a humble plea that it may please Your High Honours to provide for the future in this matter as you shall judge to be appropriate for the maintenance of justice and its pre-eminence. Lastly, 1500 Lastly, we must also respectfully communicate to Your High Honours that the attorney Bernard Victor Maloran, for and on behalf of the former commander of Java's Northeast Coast, Elso Sterrenberg, presented a petition to us on 23 July of this year, and thereby made known that the said Sterrenberg, having been summoned on the 15th previously on behalf of the bailiff Mr Nicolaas Jongsma for the following day before the aldermen of this city in order to give truthful testimony in the case of the apprehended citizen Gustavus Fiers, he, Maloran, appearing in the name of the repeatedly mentioned Sterrenberg, had made known to Their Honours that the summoned Sterrenberg believed he did not belong under their jurisdiction, and that he moreover could not testify against the aforesaid Fiers for reasons known to Their Honours, requesting on that account that the matter might be referred to this Council as the summoned Sterrenberg's competent judge, but that the proposed exception, for the reason that he, Maloran, Captain Barton from here to Coromandel, likewise submitting for consideration whether the aforesaid persons had become a matter of some further reflection, now that the peace in Europe apparently stood to bring all kinds of ordinary navigators to India as well, did not have his power of attorney with him, had been rejected by Their Honours and default with condemnation had been granted against the summoned Sterrenberg; that subsequently the often-mentioned Sterrenberg, having been called upon up to three distinct times by Their Honours' messenger to appear at the city hall for the passing of a declinatory statement on behalf of the bailiff pursuant to Their Honours' aforesaid order, had requested and qualified him, Maloran, to request a copy of the said order and at the same time to have an appeal against it noted to this Council; but that both had been refused to him and he was thereby rendered unable to attach the repeatedly mentioned order to his petition in the proper form, requesting nevertheless to be admitted to appeal thereof in common form. That we thereupon granted the aforesaid request and, in conformity with it, admitted the repeatedly mentioned Sterrenberg to appeal by apostille placed at the top, appeal from the order in question. That further on 25th thereafter, the frequently cited Sterrenberg, through the same attorney of his, caused to be made known to us in a further petition that, notwithstanding the aforesaid admission to appeal, the court messenger Visscher had in effect shown him, Sterrenberg, on the evening before, a certain writ of imprisonment for debt, decreed that same morning against him at the request of the bailiff Jongsma, if he did not comply with the aforesaid order the next day in the morning (namely on 25 July aforesaid) at eight o'clock, with a request at the same time, since he, Sterrenberg, feared that the aforesaid imprisonment obtained against him might be executed, that this Council might grant such an injunction in that regard as would be necessary for the maintenance of his good right; and that we thereupon, for the upholding of our infringed jurisdiction, under which the matter in question now belonged beyond all dispute by the granted admission to appeal, 1501 Captain Barton from here to Coromandel, likewise submitting for consideration whether the aforesaid persons had become a matter of some further reflection, now that the peace in Europe apparently stood to bring all kinds of unusual navigators to India as well, heard, enjoined the bailiff Jongsma from putting into execution the order of imprisonment obtained by him against the person of the said Sterrenberg, or ordered, in the event that it had already been put into execution, immediately to render the aforesaid order without effect by the release of the repeatedly mentioned Sterrenberg, and this on pain of having effective imprisonment directed immediately to the person of the aforesaid bailiff. That the aldermen, considering themselves injured to the utmost over and on account of the aforesaid injunction and order of this Council, addressed themselves with a very extensive remonstrance or complaint in the form of a petition to the Honourable High Indian Government, and after an entirely pathetic recital of matters, as well as one deviating quite considerably from the truth in many respects, requested thereby: 1st, that Their High Honours, for the further elucidation of their resolution dated 24 January 1716, or rather for the restraint of the proceedings and erroneous positions of this Council, would be pleased to declare redundantly.

declare that the aforementioned former Commander Sterrenberg, in the state he is currently in, and all similar persons such as deportees and the like, fall under the jurisdiction of the Court of Aldermen; secondly, that this Council might be ordered by their High Noble Excellencies to annul at once all proceedings concerning this matter, as well as to strike from their respective rolls and completely destroy the petitions, minutes, and other papers concerning this matter, particularly the last petition presented by the aforementioned Sterrenberg to the same, and especially the so-called offensive and enormous disposition made thereon, with the presentation of proofs thereof to their aforementioned Noble Excellencies; and finally tending to enjoin this Council to let the aldermen and their officers proceed freely and unhindered with their jurisdiction, without granting appeal in matters that are truly not appealable, nor to administer justice over former Company servants and even deported servants, etc. That their High Noble Excellencies, in accordance with the resolution taken in the Council of India on the 26th of the aforementioned month of July, had a copy of the aforementioned representation extradited to us, in order to bring our interests against it as soon as possible. And that, to comply with that requisition, we served their High Noble Excellencies with a written report dated 13 August, and thereby, through a detailed and truthful account of the state of affairs supported by the accompanying evidence, completely demolishing that of the aldermen, respectfully showed the frivolity of their reverences' complaints, as well as the impertinence of their requests annexed thereto, in reasonable confidence that their High Noble Excellencies, taking regard thereof, would have referred the aldermen with their grievances back to this Council, where they properly ought to be ventilated and decided; as our President further urged and pressed during subsequent deliberations on this matter in the Council of India. Yet, notwithstanding all that, their High Noble Excellencies, by resolution of 17 September following, delivered to us by extract authenticated, and as must be presumed even drawn up, by the bailiff Jongsma, still officiating as secretary of the Noble Supreme Indian Government, have been pleased to determine, first and foremost, to persist once again in their aforementioned resolution of 24 January 1716, according to which such persons who are removed from their offices, status, and salary for various offenses, even if political, must belong to the civil court from the time they are thus discharged from the service, and that particularly in matters that have not the least relation to those former services, without prejudice to their subjection to the jurisdiction of this Council concerning that which they have to account for on behalf of their aforementioned former services when addressed thereon; and furthermore to disapprove the aforementioned penal injunction granted by us against the said bailiff; and concerning the matter itself, to consider what has occurred both before the aldermen and before this Council as if it had not existed, and to leave the bailiff the liberty to issue a summons anew, and thus to annul all that has passed, under such attached recommendations and remarks as the accompanying copy of the aforementioned extract resolution, containing also all the papers belonging to this case, will show your Noble High Mightinesses in detail. Present all. — The sworn clerk of this council, Paul Fredrik Ever- zoon, petitioner Against Mr. Albertus Waals, Extraordinary Member in the said honorable council, and pro interim Advocate Fiscal of the Dutch Indies, as having substituted in office the departed Advocate Fiscal of the Dutch Indies, Mr. Cornelis Rosenboom, thus plaintiff ratione officii, on the one part— and Mr. Jacob Pompe van Meerdervoort, ordinary member in the said honorable council, currently suspended, defendant, on the other part; both summoned together in this matter, to hear sentence rendered concerning the written claim and conclusion made and taken by the original plaintiff under date of the 14th of November of the past year on and against the defendant on the roll of this honorable council. Captain Barton, from here to Coromandel [illegible] submitting also for consideration whether the aforesaid persons have become of some greater reflection, now that peace in Europe apparently also promised to bring all sorts of such unusual navigators to the Indies. Tuesday the 27th of August in the year 1748. Present all, except the Lord Pompe van Meerdervoort. The sworn clerk of this Council, Paul Fredrik Eversoon, requirant, against Monica Anthonijs, last the widow of the citizen Hendrik Abrahamsz, and previously widow and universal heir of the native citizen Titus Fransz, according to wills dated 5 December 1738 and 10 June 1727, both passed here before the notary Carel Schoute and certain witnesses, such and in that capacity plaintiff, now petitioner of relief, on the one side, and Jan van Oordt, former alderman of this city, as co-executor in the estate and inheritance of the former skipper in the service of the Honorable Company, Thobias Trouwmulder, in that capacity defendant, now respondent, on the other side, both summoned herein to hear judgment concerning the request for the confirmation of the relief obtained by the petitioner on the 7th of June of this year from the Noble High Government of these lands with committimus to this Honorable Council, and entered onto the court roll on the 16th of July following. The Council, having reviewed all the documents submitted herein, Captain Barton from here to Choromandel [illegible] also suggesting for consideration whether the aforesaid persons [illegible] of some further reflection, now that peace in Europe apparently also [illegible] all kinds of such ordinary navigators in India, having reviewed and paid close attention to everything that was to be considered in this matter, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, declares the relief obtained by the petitioner from the Noble High Government of these lands to have been obtained sub- and obreptitiously, therefore denies the confirmation requested in that regard, and condemns the petitioner in the costs incurred herein, but declares that the attorney Maloran has earned no salary in this matter. Captain Barton, from here to Coromandel, also submitting for consideration whether the aforementioned persons have become of somewhat greater reflection, now that peace in Europe apparently was also to bring all kinds of such unusual navigators to the Indies; the petitioners and complainants that by the former a notorious infraction was made upon their jurisdiction, which is sufficiently grounded in this matter by the statutes, and also by the laws and resolutions of this bench; and by the latter an injury was inflicted, in the person of their officer, upon the entire bench, both because of the informality and exorbitance of that interdiction, and also because they thereby wished to constrain the bailiff to do something for which he was not authorized, without the obtained consent of the judge; and the Council on the contrary that all the aforementioned complaints are futile, inept, and meriting not the least reflection; all to be seen in greater detail in the aforementioned writings and annexes themselves, which are inserted before or here. Noble Lords, The aldermen of this city respectfully inform Your Excellencies how Mr. Nicolaas Jongsma, bailiff, requiring in his proceedings to be initiated against the detained burgher Gustafus Fiers a declaration from the former commander of Java's East Coast, Elso Sterrenberg, first had the same approached amicably to provide the same, and subsequently, since the said Sterrenberg had shown himself unwilling to present himself at the secretariat of the aldermen for that purpose in accordance with ancient custom, and had declared to the court messenger Johannes Henricus Delissch that he wished to be condemned thereto, had the said Sterrenberg summoned before the court of aldermen for the 12th of this month to bear witness to the truth; on which occasion the attorney Bernard Victor Maloran first indeed declared for and on behalf of Sterrenberg that he had been requested by the same to state that he, Sterrenberg, was a Company servant; but the said Maloran showing no power of attorney, and also having testified upon the questioning of the Honorable Vice-President Abraham van Dijk that he held no power of attorney from the said Sterrenberg, without which no attorney may act in law for anyone; furthermore, no further instance having been made nor the least conclusion taken by the aforesaid attorney for the admission of any exception, the aldermen could not view the matter otherwise than as a non-appearance of the party, and at the request of Bailiff Jongsma granted a default against him, Sterrenberg, and for the benefit thereof, according to the accepted practice here and everywhere, see Simon van Leeuwen, Ordinance on the Manner of Proceeding, Article 8, condemned the same according to the accompanying order to bear witness to the truth on behalf of that officer, and that without the least hesitation; as founded on Your Excellencies' Resolution of 24 January 1716, which was left in its full force and even confirmed and renewed by Your Excellencies' latest resolution regarding the point of jurisdiction between the Honorable Council of Justice of this Castle and the aldermen, dated 20 October 1747; the first-mentioned resolution dictating that all persons placed out of the service and pay of the Company, whether politically or judicially, shall absolutely and without distinction belong to the jurisdiction of the civil judge or aldermen of this city. Which sentence or order having been obtained by Bailiff Jongsma, he had the aforementioned Sterrenberg summoned on the 15th thereafter in the ordinary manner by the court messenger to comply with the same; but instead of giving any satisfactory answer, it pleased the said Sterrenberg to allege in writing a frivolous excuse thereon, for which reason the bailiff, with the prior knowledge of the aldermen, proceeded further to the execution of the said order and had the said Sterrenberg served notice up to two more times to perform the act to which he had been condemned; notwithstanding this, the same continued to persist in his obstinacy, so that the bailiff, for the acceleration of justice, was compelled on the 24th of this month to request from the aldermen the civil detention of the person of the aforementioned Sterrenberg until such time as he shall have complied with the aforementioned order, or else that he may once again and under penalty of civil detention be ordered to provide his testimony, just as the bailiff was also granted the latter. In this manner, Most Honorable Sirs, the matter stood when the bailiff this morning communicated in the assembly of the aldermen, to their utmost surprise and astonishment, not only that it had become apparent to him the day before that the honorable Council of Justice had on the 23rd of this month admitted the former Commander Sterrenberg to an appeal from a certain sentence which the aldermen were alleged to have rendered on the 15th previously, and whereby the exception quasi of renvoi, proposed by Sterrenberg to the aldermen, was supposedly rejected, notwithstanding that no such sentence is known to the aldermen, nor exists in rerum natura; but also that to him, the bailiff, yesterday or on the same day, by the bailiff's officer Van Eck, in the name of their honors and according to the words of the ruling, it had been forbidden to execute the order of civil detention obtained by him against the person of Sterrenberg (which likewise does not exist in the world), or in case the said order had already been put into execution, it was then ordered to render the aforementioned order immediately ineffective through the release of him, Sterrenberg, and this under penalty of directing actual civil detention immediately against his own person, the conclusion of that ordinance being the very height of enormity, because the bailiff is unable, Sterrenberg having already been brought into civil detention, to release him again from the same on his own authority, unless he wished to incur the well-deserved correction and reproach of the college. The President and Councillors of Justice of the Castle of Batavia, having received and reviewed, together with an extract from the minutes of what was transacted and resolved in the Council of India under date of 26 July last, the copy of a certain remonstrance or complaint in the form of a petition presented to your High Excellencies by the Aldermen of this city, wherein their Reverences complain very severely and request in the most emphatic manner the maintenance thereof, and so forth, regarding and concerning the fact that the Council of Justice, having admitted the former Commander of the Northeast Coast of Java, Elso Sterrenberg, at his request, to an appeal from a certain ruling rendered against him by their Reverences, has subsequently, upon a further petition presented on his behalf containing the grievances therein, thought fit to grant an interdict with penalty against the Bailiff Mr. Nicolaas Jongsma to the said Sterrenberg; on which account your High Excellencies, before proceeding to a decision thereon, have been pleased to require from the said Council a report for the elucidation or justification of their conduct in the subject case; so the said President and Councillors shall have the honour, in compliance with that esteemed requisition, to lay open before your High Excellencies the course of these matters in all their circumstances, succinctly and in truth, and thus to state initially hereby: That the attorney Bernard Victor Maloran, for and on behalf of the aforementioned former Commander Elso Sterrenberg, on the 23rd of the recently passed month of July, at the ordinary meeting of 1525 of the Council after the roll was completed, presented a petition to the same, stating that the said Sterrenberg, having been summoned on the 15th prior on behalf of the Bailiff Mr. Nicolaas Jongsma before the Aldermen for the following day to give testimony of the truth in the case of the apprehended, or rather as the Aldermen say in their submitted complaint, the hostage burger Gustavus Fiers, he, Maloran, appearing in the name of the aforementioned Sterrenberg, informed their Reverences that the said Sterrenberg considered that he in no way belonged under their jurisdiction, and that he moreover could not testify against the aforementioned Fiers for reasons known to their Reverences, requesting on that account that the matter might be referred to the Council of Justice as the defendant Sterrenberg's competent judge; but that the proposed exception was rejected by their Reverences for the reason that he, Maloran, did not have his power of attorney with him, and default with condemnation was granted against the defendant Sterrenberg; that subsequently the often-mentioned Sterrenberg, having been summoned on three distinct occasions by their Reverences' messenger to appear at the city hall to execute a deposition for the benefit of the Bailiff pursuant to their Reverences' aforesaid ruling, requested and authorized him, Maloran, to request a copy of the said ruling and at the same time to have an appeal against it noted with the Council of Justice, but that both were refused him, and he was thereby prevented from attaching the aforementioned ruling to his petition according to proper procedure, nevertheless requesting on that account to be admitted to appeal thereof in common form, as your High Excellencies may see from the annexed copy of the said petition, if pleased to do so. That the Council of Justice thereupon granted the aforesaid request and, in accordance therewith, by an apostil placed at the top, admitted the aforementioned Sterrenberg to appeal from the ruling in question; and that the said Council could not and was not permitted to decide otherwise in or concerning that admission, it being an ordinary provisional order of justice which is always granted without examination of the merits periculo petentis, without prejudice to the adverse party, both litigants and the judge a quo, who notwithstanding retains all his exceptions, defenses, and legal bars. Indeed, that the Council would and must have done so and not otherwise, even if the aforementioned ruling had in effect been rendered ex contumacia, in accordance with the content and words of the submitted complaint; all the more so because it belongs to the judge ad quem, and not at all to the judge a quo, to judge which matters are appealable and which on the contrary are not appealable, as Bailiff Jongsma himself, being advocate fiscal of India pro interim, once maintained against the bench of Aldermen, which their present President, having been at that time the presiding member in the Council of Justice, will certainly not be unaware of. From all of which it is evidently apparent that the Council of Justice, as has already been said in passing above, did nothing more or other in the present case than it was authorized, indeed bound and obligated to do, and consequently, that the grievances of the aldermen, however much disguised, are in fact futile, nonexistent, and not deserving of the slightest reflection; all the more so, since the foundation thereof, namely that the attorney Maloran at the bar of their Honors was alleged to have stated that he held no power of attorney from the defendant Sterrenberg, and that no further motion was made, nor the slightest conclusion taken by the same attorney for the admission of any exception, is entirely destroyed and overthrown by the two declarations attached hereto, both from the said attorney Maloran and from his colleagues, which your High Nobilities upon rereading will find to state precisely the contrary. Now the two other appearers say, both together and each in particular, that they well recall that, the aforementioned party having been called, the attorney Maloran joined the secretary of their honors, but that they do not know, directly or indirectly, nor have paid any heed to, what was alleged or said by the attorney Maloran, nor what the aldermen understood thereupon. And this having been taken into consideration, that although appeals are granted, as the council comes to allege, periculo petentis, and without examining how far they can be granted, as their honors further maintain without examination of matters, yet in this case, according to their honors' own words, that which belonged to the style was lacking, namely the order in question, and which, upon a mere pretense of the attorney that such had been refused him, ought not to have been passed over, since it had to decide in this case upon the appealability or non-appealability of the 1535 matter, and being entirely essential, could also if necessary be obtained by their honors' authority, all the more so since the attorney had already appeared before their honors with two contradictory occurrences upon which his request for appeal was grounded, namely with a rejected exception and a granted default at one and the same moment, which, as they certainly could not go together, would have required further clarification; furthermore, that in the same manner for the second time, upon the further instance of the said attorney and his repeated mere pretense that an order of civil detention had been granted against Sterrenberg by the aldermen, an order was rendered by their honors, and indeed one so penal and coercive toward an officer of justice, without hearing the latter in opposition thereto, or in any way examining the truth of the attorney's aforementioned pretense; that Captain Barton from here to Chormandel also raising a consideration regarding the aforementioned persons become of some greater reflection, now that the peace in Europe apparently also all kinds of such navigators in Indian service that the same, even if everything had been true and properly proven, would nevertheless still not be justifiable, since a bare inhibition could and also should have sufficed where there was as yet no disobedience, in case it was in the officer's power to obey it, and the added commination was fruitless and ill-suited if his reach did not extend so far as to be able to comply with it, so that the aforementioned threat in both respects could serve for nothing other than to prostitute the jurisdiction of the aldermen and to hold the officer in contempt in his office; and if it had been judged to be of such necessity, it yet absolutely required beforehand a proper examination of matters, all the more since their honors afterwards were indeed willing to take the trouble to examine what occurred at the court roll of the aldermen through affidavits of the attorneys, indeed of the very attorney through whose misleading, even down to the dates of what occurred, an appeal had been granted by that college regarding a matter that did not exist, namely for a 1536 a rejected exception of referral, which even appears from the aforementioned declarations of the other attorneys, to the confirmation of what was advanced by the aldermen, far from destroying the same, never to have come into question at all; besides which also the matter itself concerning which that exception was allegedly proposed has been clearly and plainly decided by the resolution of this table of 24 January 1716, without poorly applied arguments being able to raise any doubt concerning it; and thus in this matter there was little necessity to take so much to heart the whole case, which itself could also not be judged to be of any importance, as it amounted merely to the giving of an affidavit in the service of justice, in which the courts ought rather to join hands; it is understood, first of all, to persist once again in the resolution of this table of 24 January in the year 1716, according to which such persons as are removed from their offices without capacity and wages for this or that misdemeanor, even politically, must belong under the civil court from the time that they are thus put out of service, and that especially in matters that have not the least relation to those previous services, without prejudice to their subjection under the judicature

Specification of the Criminal Cases that have been concluded, are pending judgment, and are still sub judice from the 1st of September 1747 to the last day of August 1748; Concluded Cases: Tangok, shaven Chinese, the Lord's prisoner for complicity in the murder of a master Banjer. In this case, the Lord Landdrost Godlieb Iohan Adolph van Trabe, after the prisoner had come to confession under torture, but had retracted the same again upon the verification, proceeding in the ordinary manner on the 2nd of August 1746, brought a capital demand against the prisoner; and after the conclusion of the trial, by sentence of this Honorable Council dated the 5th of September 1747, the prisoner was banished for the whole of his life to Ceylon, or else elsewhere at the pleasure of the Honorable High Indian Government, with condemnation to the costs. Anthonij Bouman of Dort, and Reijnier Ansorge of Delft, both carpenters, the Lord's prisoners for wantonness committed around a Chinese tavern, were sentenced by this Council on the 5th of September 1747, each to serve for the period of six months on the Island of Edam in the ropewalk for board, with costs. Iacob Jansz de Boer, chief mate in the service of the Company, last stationed on the Galathea, the Lord's prisoner for murder and piracy committed. In this case, the prisoner was sentenced on the 5th of September 1747 to remain banished for the period of ten years to such a place as it should please the Honorable High Indian Government, with dismissal of the further or other demands, and condemnation to the costs of the trial. 1540 Carel Carel, burgher Captain at Samarang, and Ian Tanko, Chinese, defendants in the first instance before the Judicial Council at Banda, here appellants with the clause of relief regarding the lapse of time, and in the continuation of the prosecution of this appeal, the proceedings conducted at the aforesaid government and definitively pronounced, being here prosecuted de novo and perfected in case of appeal, the same were, by sentence of this Honorable Council dated 6 June 1747, annulled as informal, and Mr. Cornelis Rosenboom, Advocate Fiscal of India, ex officio defendant, was ordered to proceed summary against the appellants before this Council, provided also that the Fiscal at Banda was condemned in the costs of the suit, to pay the same from his private purse, and at the same time leaving reserved to the ex officio defendant the right to institute his action against the Council of Justice and the Fiscal at Banda before this Council, whereupon by the Advocate Fiscal Mr. Cornelis Rosenboom, on 10 October following, a demand in writing was served ex officio summary against the defendants Carel Carelsz and Ian Sanko aforesaid, and at the conclusion thereof it was demanded that the sloop De Ondervinding, with its entire cargo, departed on 13 September 1745 from Batavia via Samarang to Banda aforesaid, having arrived on 7 March 1746, when the vessel and the entire cargo were first seized in sequestration and converted into money by public auction, should be declared confiscated, and its proceeds, deducting what must be deducted, divided according to custom cum expensis, when, after reading of the filed demand in summary action, it was concluded by the proctor Mr. Albertus Waals to the effect of non-receivability, and secondarily to the dismissal of the plaintiff's demand cum expensis, and the parties having persisted, taken for reduplication, held as produced the documents previously submitted, thereby imploring general reproaches and salvations of rights, at the same time serving an inventory of the documents and requesting justice, the plaintiff's ex officio demand and taken conclusion were subsequently adjudicated by sentence of this Council dated 31 thereafter, consequently confiscating the aforesaid sloop with its entire cargo, so that its amount, deducting what must be deducted, shall be divided according to custom cum expensis. Leendert Bloet of Nieuwerkerk, sailor, the lord's prisoner for being absent for seven nights, was on the aforesaid day condemned by this Council to be shackled in irons for the period of six months, to labor thus for that time at public works and to remain banished cum expensis. Jurriaan Kok of Amsterdam, soldier, Lourens Veldhuijsen of Leijden, drummer, Ian Heijde of Hamburg, soldier, Jurgen Willem Kerkhoff of Quedelenburg, assistant surgeon, the lord's prisoners for desertion, were by sentences of this Council dated 5 December 1747 condemned, among other things, each to remain banished for the period of six months to the Island of Edam, and to serve there in the ropewalk for their board. Ian de Roth, former Merchant and Fiscal at Malacca, defendant and petitioner for revision, in this case on behalf of the petitioner, the proctor Mr. Willem Cras served a demand in writing, and at the conclusion thereof concluded and maintained that error resided in the sentence rendered in the first instance, and that therefore the same error should be corrected by this Council and the adjunct revisers and the petitioner be absolved cum expensis, this case being further perfected by the parties and brought to a state for judgment, it was declared by sentence of this Council and the lords adjunct revisers dated 9 December 1747 that error resided in the sentence in question, and correcting the same, the defendant, currently petitioner, was dismissed from office, status, and wages, and condemned to a fine of three thousand rixdollars to be divided half for the Honorable Company and the other half for the fiscal, with condemnation of the ex officio defendant in this case in the costs incurred herein. Ingebeij Bratanga Djaija, free Javanese, defendant for defrauding the toll, in this case Mr. Albertus Waals, pro interim Advocate Fiscal of India, concluded in court against the defendant for the confiscation of two corgies of red checkered cloths, which the defendant secretly exported without paying the impost or toll, and which were intercepted by the farmer of the boom Tan Iko, so that their amount, deducting what must be deducted, shall be divided according to custom between the ex officio plaintiff and the farmer, with condemnation to the payment of double their value, half for the Honorable Company and the other half for the fiscal, in accordance with the 4th article of the conditions of the lease of the boom, and the defendant appearing in court having confessed guilt and consented to the condemnation, the ex officio plaintiff's demand was, by sentence of this Honorable Council dated 16 January last, adjudicated upon the defendant's confession of guilt, and the defendant condemned in accordance with the contents thereof cum expensis. Albertus Waals, the aforesaid request was granted by this Council, after which on 12 March reproaches in scriptis were served by the gentleman ratificer officer plaintiff, and general reproaches and salvations of law were implored by the defendant, while simultaneously undertaking to serve an inventory of the documents at the next opportunity, in the manner done by the parties on the 19th thereafter, and this case thus being brought into a state of judgment; so by this Council on 26 March last, by definitive sentence, the defendant was condemned to a pecuniary fine of Two Hundred silver Ducatons, to be divided one half for the Dutch Reformed church, and the other half for the diaconate poor of this city, with rejection of what was further or otherwise claimed, and condemnation in the costs of the lawsuit, whereupon the gentleman ratificer officer plaintiff, finding himself aggrieved by the aforesaid judgment, on 9 April thereafter against the defendant, after obtained admission, [illegible] 1542 admission served a claim in case of revision, and thereby concluded that by sentence of this Council along with the gentlemen adjunct revisers it should be declared that error had been committed, and that consequently the same sentence be nullified, or at least reformed, and to him, the petitioner, his conclusion taken in the first instance should still be adjudicated cum expensis or to such other end as the petitioner might best pursue, against which on behalf of the defendant it was concluded to the approval of the sentence in question, and that by this Council and the gentlemen adjunct revisers it should be declared that no error resided in the same, the parties thus having persisted for replica and duplica and simultaneously having undertaken to serve an inventory of the documents at the next opportunity, which took place on the 23rd thereafter and the lawsuit in case of revision thus being completed and brought into a state of judgment, it was subsequently declared on 10 May thereafter by this Council and the gentlemen adjunct revisers that no error resided in the sentence in question, consequently denying the claim and conclusion of the gentleman ratificer officer petitioner with compensation of the costs incurred in this matter. Salomon van Balij, slave of the citizen Bouman, chain-gang laborer assigned to the quarter, has, for breaking his chain and premeditated theft (having with him a dreadful knife sharpened on both sides), according to sentence of the 20:th of July 1748, been exposed to public view under the gallows with a rope around his neck, further scourged, branded, and riveted into chains for ten years beyond his former banishment, costs and expenses. Coridon van Mallabaar, slave of the late citizen Simon Piere de salies, has, for committed heavy and very substantial domestic theft, according to sentence of the 20:th of July just mentioned, been hanged, and his dead body dragged to the place of execution outside, etc., costs and expenses.
