From Souratta, dated 25 May 1749. to remark what your Honours put forward in order to be able to dismiss us and our reasonable request out of hand, for had that gentleman essentially come here with such a special commission to govern everything during his stay, except for commerce and as Chief, it is certain that either His Honour himself, or your Honours on his behalf according to custom, would have given the necessary notice thereof, so that one would also have been in a position to show His Honour that respect which, without appearing impolite, one cannot well refuse to a gentleman of that standing in these lands. Moreover, His Honour also arrived here not like a subject or special commissioner of His said Royal Majesty, but as if he were a stranger who wished to know nothing at all of the close union between our mutual high sovereigns, nor of the obligation placed upon their respective subjects to show one another all possible assistance, and to settle amicably or by legal means any disputes that might sometimes arise between both parties; for His Honour had barely arrived in the roadstead when he immediately had the Company's ships searched and several English deserters removed from them by force, under the threat that if his demand was not complied with, he would immediately sink the ships. And as if this were not yet enough, His Honour not only visited the governor of this city in person, but also sent commissioners to him on two or three different occasions, and both personally ordered him and had him ordered to see to it immediately that our work on the revetment along the river bank was halted, or else he would become his enemy, and blockade the river completely, and so forth. And whereas we remain firmly convinced that His Honour cannot in any way be authorized to such things by His Royal Majesty of Great Britain, we therefore deem His Honour just as unauthorized to execute such matters as we, without convincing proof to the contrary, would act without authority in addressing ourselves to him on that account; and we must therefore hold to your Honours, who we know sit here in whose name. We therefore also request that it be interpreted for the best that we persist in all respects with our request made on the 4th instant, fully renewing the same by this instrument, and on that account leaving everything to your Honours' account and responsibility that was already previously left on a solid foundation to your Honours' account and responsibility. From Souratta under date 25 May 1749 Honorable, highly commanding lord The undersigned, sea captain of the ship De Hervatting currently lying in the roads, has the honor to report to your Honor how his voyage has transpired in the time of 6 months and 3 days from departing Batavia until arriving here in the roads, which consists of this: That on the 22nd of September of the past year, with the above-mentioned vessel carrying 213 men, in company with the ships West Capelle, Knoppenhoff, Hogersmilde, Het Fortuijn, and the hooker Don Quichot, he departed from Batavia, sailed out of the Sunda Strait on the 31st of October following, and arrived in the outer roads of Punto Gale on the 9th of December. That on the 18th of the same month of December he departed from there again with the ships Knoppenhoff, Westcappelle, and Hogersmilde, and arrived alone in the roads of Cochim on the 31st following; while the aforementioned three ships had in the meantime become separated from him by a heavy storm. That having departed this roadstead alone on the 18th of February of this year because the ships Westcappelle and Hogersmilde had already departed on the 27th of January before, he arrived in this roadstead on the 4th instant, having had 13 deaths in total by that time. However, why the voyage turned out to be so long was solely due to: 1. because in the beginning of the Suratte directorate he had to cruise for 6 weeks before he could continue the voyage hither; 2. because on arriving at Cochim he received orders from the lord Commander and Council to pass north of the Maldives; and 3. that between Cochim and this roadstead he experienced great calms and contrary winds and currents. This then being all that he can report of his voyage, he shall only prolong this by politely requesting of your Honor to obtain the customary three refreshment days for his crew. While otherwise naming himself with all respect, underneath stood: Honorable, highly commanding lord; lower: your Honor's humble and obedient servant; was signed: W.m Dewijs; in the margin: Souratta the 6th of April anno 1749. The said Captain has also brought along an original letter directed to this honorable assembly by the lord Commander and Council at Cochim, dated the 16th of February of this year, accompanied by several enclosures, which all tally properly according to the register; and concerning which there is nothing to note, it is merely deemed appropriate to answer them in due course. And since besides this no papers of importance, but especially no further orders from their High Excellencies regarding the employment of this vessel have been received, as had nevertheless been expected, the lord Director renews his proposal made in that regard on the 24th of March last: namely, to send De Hervatting with a cargo for China to Batavia instead of to Bengal, and considers the same now all the more necessary because 100000 lb of areca nut and roughly as many pounds of sandalwood have already been shipped from Malabar for the trade in China, since these would otherwise have to be unloaded and sold here, upon which little profit could be made in these times, as the city is closed and these goods are not in demand at all due to a lack of provisions; whereas by sending them to China one could leave them in the ship, load alongside some other goods and principally putchuck and cotton for that empire, and thus send this vessel from the roads again with the utmost haste to undertake its return voyage directly to Batavia, either together with Westcappelle, or alone, whichever should fall out best; and after its departure Hogersmilde could remain in the roads a little longer and afterwards follow via Malacca, after having touched at Tutucorin back and forth en route and having delivered some goods there for Ceylon and Malabar. All these reasons having been further considered, and also taking into account the statement of the Ministers of Cochim in their aforementioned letter, that they had sent the areca nut and the sandalwood hither for the trade in China owing to the cargo space by order of their High Excellencies, the Council agrees with his Honor's opinion and judges that this would certainly not have been written so positively if they had not truly had that positive order, and that consequently it might well be that a clerical error had been made in their High Excellencies' esteemed letter of the 18th of October 1748, and Bengal had been stated instead of China; and therefore it was resolved with unanimous votes to embrace the proposal of the Lord Director, and to send De Hervatting not to Bengal, but with a cargo for China to Batavia, and to that end not only leave the areca and the sandalwood therein, but also immediately purchase and ship all other goods that can be obtained at fair prices for the trade in that empire, and to make all possible speed to

All of these reasons having been further considered, and also taking into account the statement of the ministers of Cochin in their aforementioned letter, namely that they sent the areca and the sandalwood here for the trade in China due to cargo space by order of Their High Noble Excellencies, the Council agrees with the opinion of His Honour and judges that this certainly would not have been written so positively if they had not truly had those positive orders, and that consequently it might well be that in the esteemed letter of Their High Noble Excellencies of 18 October 1748 a clerical error was made, and instead of China, Bengal was stated; wherefore it was resolved with unanimous votes to embrace the proposal of the Director, and to send the Hervatting not to Bengal, but with a cargo for China to Batavia, and to that end not only to leave the areca and the sandalwood therein, but also immediately to purchase and ship all other goods that can be obtained for the trade in that empire at reasonable prices, and to make all possible haste to send this vessel without loss of time either together with the Westcapelle or alone one after the other directly to Batavia, but to let the Hogersmilde follow via Tuticorin and Malacca. Finally, it was also resolved to have paid to the Honorable Company's suppliers Sourabbja and Rettengje rupees 66101 1/32 on account of contracting, because with that amount they will then as yet have received only 2 lakh in total. Below stood: Thus done and decreed in the Honorable Company's lodge in Surat on the day, month, and year aforementioned. The Commander of the Indian Sea, the Honorable Dirk Wolter van Nimweegen, and Merchant Eijso de Wendt, as supercargoes over the trade in China, having arrived very unexpectedly with the ship Sara Jacoba on the roads and subsequently appeared upstairs, the former was complimented according to custom by two members and the secretary of this assembly and brought before the Director, to whom he communicated his arrival from China via Malacca, Ceylon, and Cochin, but at the same time declared that he and his fellow supercargo, according to the order of Their High Noble Excellencies, were independent here and had nothing to do with anyone, and for that reason had also addressed the cargo now brought from China to themselves, in which matter they would nevertheless request the assistance of the Director, at the same time handing over a small invoice of some porcelain to the value of f 62:19:8 and a sealed packet addressed to this assembly. His Honour, although somewhat surprised by this unexpected compliment, nevertheless declared himself heartily inclined, as in everything so also herein, to follow the orders of the superiors with all readiness; but being unable to believe a matter of such an unusual nature upon His Honour's verbal statement alone, and being himself devoid of any information or written notification in that regard, requested to see that order. Whereupon he received from the Honorable Commander an original signed instruction dated 26 July 1748, prescribed to him and the said De Wendt by Their High Noble Honorable Excellencies, the gentlemen of the High Indian Government, which having been read and the Honorable Commander subsequently having been brought to his lodgings with the usual ceremony, the assembly was immediately convened, wherein the Director not only gave notice of the aforementioned, but the said instruction was also shown, reviewed, and further put to deliberation: what everyone thought of the declaration made by the Honorable Commander, and to what extent it agreed with the contents of the instruction. The Council, having well considered and compared everything, is of the opinion that the Honorable Commander must perhaps have entirely different orders upon the foundation of which he could declare so positively that he had nothing to do with anyone here, and for that reason had addressed the cargo from China to themselves; for from the contents of this instruction such did not appear in any way, nor could it be deduced from it at all, if one

The undersigned having been informed that Monsieur Butel du Bocage, former second cargo on the private vessel Johanna Elizabeth, had arrived here from Mocha with one of the Moorish ships and was residing at the lodge of the French nation with Monsieur Le Verrier, I deemed it not unserviceable to go to him in order to inquire into the matters that occurred in Mocha between the captain and first supercargo of the said vessel Marten Wouter Tempezel and the supercargoes on behalf of the Honorable East India Company in the Red Sea, the Honorable Pieter van Nimwegen and Pieter van Jongstal, as recorded in the resolution of the 25th September of the past year; and this being done, I requested him to give me a detailed account regarding the state of affairs there, which he not only fully promised, but also said he would present various pieces concerning what the frequently mentioned supercargoes Van Nimwegen and Jongstal had carried out to the detriment of the Honorable Company, both in trade and in its reputation, as well as to the obstruction of private commerce; after having waited for this until the 16th of this month, at which time he handed me a document annexed hereto under No. 1. So I know of nothing else to express here except humbly to request Your Right Honorables that this, together with the enclosures, may be sent to Batavia to Their Excellencies, the lords of the High Indian Government, while for the rest, with high esteem, I remain, beneath stood, Honorable Right Honorable Lord and Lords, lower, Your Right Honorable's humble and obedient servant, was signed, Abraham Cornelis de La Haije, in the margin, Souratta, the 26th of April, Anno 1749. Lastly, by order of the Lord Director here, a record was kept of what has occurred since the latest meeting, consisting of the following: On the 9th current, the further protest, pursuant to the resolution of the previous day, having been brought by the fellow members of this assembly, Huijsvoorn and Serff, to the head of the English gentlemen, Mr. Borrill, the same accepted it and declared himself heartily inclined to speak with Mr. Pawlett concerning its contents, but that he dared not take such upon himself, since that man was entirely beyond him or his orders. On the 10th current, a request having been made by the merchant and fiscal Abraham Cornelis de La Haije for two well-manned vessels in order to recover therewith a private gurab which, having been freighted by him and others, was taken by surprise three days ago by some small pirates in sight of the roadstead and towed to Sulthanpoer; whereupon the meeting was convened here, and after deliberation on the necessary points, it was resolved to grant him the three small craft manned with 36 European and 36 native soldiers for the aforementioned purpose, provided he commanded the expedition himself, took the expenses to be incurred for his own account, and made every effort to depart from the roadstead here at least within three days; and this having been announced to him, he accepted it and betook himself immediately from the shore. On the 11th, with the advice and consent of all the members, there was sold and transferred to Roederam and Kissourdas the entire quantity of camphor for ro/a 71½ and the entire quantity of radix china for ro/a 11½ per 100 lb, on the condition that they receive and pay for the same within fifteen days. On the 16th, having received news that the small craft were not yet at sea on account of the contrary winds and might not be able to get outside the river within five days, in consideration thereof, and as the vessels can presently by no means be spared so long owing to the unloading and loading of the ships, a resolution was taken by all the members, and the fiscal was also immediately ordered by a brief note to cease the expedition of the 10th current and to return in person upstream as soon as possible. On the 19th, the naval lieutenant Gerrit Verkerk, assigned to the ship De Hervatting, having submitted a petition requesting to be favored with the vacant position of equipagemeester here, it was immediately deliberated upon, and by reason of the necessity of having such a person, it was resolved with unanimous votes to grant his request, and not only to relieve him for shore duty as equipagemeester, but also to let him receive the conveyance of that administration and to give him a seat as a permanent member in the Honorable Court of Justice of this directorate. On the 19th, the small vessel De Jonge Susanna having departed for Brootchia to collect some return cargoes, on the proposal of the senior merchant Marten Huijsvoorn, the second merchant Hendrik Kroonenbergh was also sent thither under the pretext of retrieving the left-behind furniture of the said Huijsvoorn, but in fact to inspect the goods salvaged from Nieuwalcheren and, if necessary, to air them in order to prevent their spoilage as much as possible. Also on the same day, with the advice and consent of all the members, there was sold to the Honorable Company's shroff Narrendas Laaldas, to be received and paid for in two months' time, all the Japanese bar copper for ro/a 64 per 100 lb; and to Roederam and Kissourdas, to be received and paid for in one month's time, the entire quantity of lead for ro/a 12 23/60 and the entire quantity of sappanwood for ro/a 3¼ per 100 lb. And on the 25th, His Serene Highness the Lord Willem Carel Hendrik Friso, by the grace of God Prince of Orange and Nassau, etc., etc., etc., was, pursuant to the resolution of the 29th of March last, introduced also in this directorate as Stadtholder, Captain, and Admiral-General of the United Netherlands, and inaugurated in a solemn manner, first by the Lord Director and all the members of the Council, as well as by the ship commanders, lieutenants, and ensigns, item all lesser officials in full assembly, and thereafter by the military and all other servants of the Honorable Company in public, the whole day being subsequently spent with all kinds of joyous activities and celebrated among a gathering of many thousands of people in such a manner as is recorded at large in the daily register. From Surat under date 25 May 1749 sufficiently clear how the supercargoes were of the opinion that they had full authorization to make purchases and sales here according to their pleasure without being obliged to give any disclosure thereof or to request any assistance in the one or the other, except insofar as they might fall short; that this groundless fancy, having arisen from a mistaken understanding of what was ordered by Their High Excellencies in the instructions prescribed to them, was taken as an established matter after consideration by them, and now possibly would be defended all the more now that they surely, everywhere as well as here upon their arrival, stated the same as indubitable, and, as it seemed, had thereby also persuaded the Lords Governors on Ceylon and Malacca to address to them the invoices of what was given to them on the requisitions from here for the trade of this direction; that consequently it would be a hard task or virtually impossible to convince them of the contrary or, by representations of the true nature of the instructions, to give them a true idea; and that it might therefore well be taken into serious consideration whether it would not be best to abide by the resolution once taken the day before yesterday, but to leave the settlement of the dispute in this regard to the judgment of Their High Excellencies, and even in excess of necessity, and to give the supercargoes so much less reason for grievance, to keep the commission monies that may be calculated on both sale and purchase in sequestration until such time. The council, having well considered everything, praises the proposal of His Honour as in the highest degree equitable and the best that can be devised both to remove all unnecessary quibbles and to reassure the supercargoes that justice will be done to them in due time regarding what they claim, but nevertheless believes that if His Honour keeps the commission monies to be calculated on the brought cargo in sequestration, he then uses all too much indulgence in suspending his right upon a simple claim that exists only in imagination, and in confirmation of which the supercargoes can produce no other proof than their say-so and the instructions shown upon their arrival, from which nevertheless nothing of the kind can be inferred in the least. But the Lord Director having declared that he would rather do slightly too much than too little in this matter, in order all the more to convince the supercargoes that they are treated equitably and placed virtually on an equal footing with this entire assembly, the Council therefore also agrees with this opinion, and thus it was resolved and determined with unanimous votes, for the removal of all unnecessary quibbles whereby precious time would only be spent uselessly and the interest of our Highly Esteemed Paymasters would be harmed, to leave the decision of the dispute concerning the right of this assembly and the opinion of the supercargoes to the judgment of Their High Excellencies in Batavia, and to that end also to keep the commission monies that may be calculated on the sale as well as purchase of the goods in sequestration until the answer thereto shall have been received; but in the meantime to persist fully in the resolution of the 23rd current, and on that account to recommend to the aforementioned supercargoes by extract hereof to comply therewith in all parts, unless they could produce and show more special orders of our lords superiors contradicting these and the General Commission of the Lord Director. Furthermore, it having also been seen from the same writing that the Honorable Commander maintains the Hervatting to be more fit than the Sara Jacoba for the return voyage to China because the bowsprit and the tops of the latter were not in a condition to make such a perilous voyage, it is resolved, considering that according to the strict order of Their High Excellencies, outside of the highest necessity, no shifting of the ship's crew, much less a formal exchange of the ships themselves, may be undertaken, to postpone the disposition regarding this until the necessary examination shall have been made concerning this, and in order to accomplish which it is also deemed fit to commission, as they are hereby commissioned and charged, Captain Willem de Wijs, Captain-Lieutenant Willem Erven, Skipper Lambert Toussain, and Master of Equippage Gerrit Verkerk, together with the assistance of such ship's officers and carpenters as they shall deem necessary and competent, carefully to inspect the ship the Sara Jacoba with regard to its condition, and to serve this assembly with a distinct and true report whether the same is capable of making the proposed voyage to China or not, and whether the stated defects cannot be repaired here without loss of time. After a further resolution had been taken yesterday with respect to the supercargoes for the trade in China, the Honorable Dirk Wolter van Nimwegen and Eijso de Wendt, and they had also been given the necessary instruction thereof by an extract from the minutes, they have indeed delivered today a General Factura for their cargo amounting to f216353:12:-, but nevertheless also submitted alongside it a writing in which they say among other things: that they had read the disposition of this meeting taken yesterday, in order, under that pretext as it seemed to them, merely to become master and guardian as well over their delivered cargo as over themselves; that this Meeting brought forward no other proof in confirmation thereof than the statement of finding nothing in their instruction that would make any change regarding the orders received in the past year or the always maintained manner of proceeding with respect to the cargoes delivered here, whereas the contrary was evident and to be inferred from the Extract General Resolution of the 18th of July 1747, and they now, according to their separate instruction, held qualification to be allowed to conduct trade practically wherever it seemed good to them, without interference from anyone further than they might deem necessary; that it was neither their intention nor that of this meeting to let time pass by with unnecessary quibbles and to harm the interest of our Lords and Masters, which might nevertheless be caused by this meeting in an unfounded manner if they were to set themselves against it and enforce their orders; but that for this voyage they are the lesser party and would do nothing else against it than to protest in the strongest terms, as they did protest hereby, against the wrong and violence that they believed was being done to them hereby in an illegitimate and unfounded manner, to great decline and insult to their persons; and they left everything to the further accountability of this meeting, both what their commission would come to suffer hereby, as well as that for which they in due course would consider to have a claim to be held harmless and indemnified with the interest thereof, to be seen more extensively in the writing itself, which is incorporated entirely into this: From Surat, under date 25 May 1749. It is as little our intention as that of Your Honors to let time pass through unnecessary cavils and prejudice the interest of our lords and masters, which could nevertheless be caused by Your Honors in an unfounded manner if we were to set ourselves against it and enforce our orders.
