11. From Surat the 31st of December Anno 1756. From Surat the 31st of December Anno 1756. The absconded Captain-at-Sea Willem Marchis, having been duly summoned, but not having appeared, the trial against him was completed in contumacy, and by the Fiscal ratione officii by intendit it was demanded that he should be banished perpetually from the Company's jurisdiction, on pain of being shot to death, with confiscation of all his accrued back-pay, one third for the Company, one third for the Marine Academy, and one third for the Fiscal, and with the express reservation of such action as the Company might consider itself entitled to institute against the said Latitant and Defaulter under edict regarding the wreck of the ship Bloemendaal, in order to institute it wherever and whenever it might be deemed advisable, with the further condemnation of the same in the costs; but the final decision of this matter was referred by the Judicial Council to the Honorable Council of Justice of the Castle Batavia, based on Your Right Honorables' Resolution of the 20th of January Anno 1694 and ours of the 4th of June last, in which latter are inserted the considerations on that subject submitted on those days by the first undersigned, and to which we refer ourselves under Your Right Honorables' esteemed interpretation to avoid prolixity; the same is attached hereto in extract, and the original trial records are likewise duly transmitted on this occasion, together with a covering letter to the said High Court in a packet under flying seal. Also against all the lower servants who since the last of April 1755 until the 1st of May of this year have gone missing and presumably deserted, to the number of 80 heads, proceedings were instituted by the Fiscal according to order, and the same have been condemned by definitive sentence of the Judicial Council in contumacy to perpetual banishment from the Company's jurisdiction, on pain of being punished with the rope until death, with confiscation of half of their accrued monthly wages for the benefit of the Company, with further condemnation in the costs, and upon apprehension also in the expenses of justice, which sentence has been approved by the Director, the trial records likewise being found in original among the annexes hereto. A boatswain's mate from the ship Huijs te Boede who deserted to the Moors, named Hendk: Snouwer, having been apprehended, prosecuted for that crime by the Fiscal and convicted thereof, and having confessed the same outside of pain and bonds after sentence ad torturam had already been passed against him and approved by the first undersigned, was for that, by definitive sentence of the Judicial Council dated the 3rd of June 1756, among other things condemned to be punished with the rope until death follows, which having also been approved by the Director and subsequently duly executed, we have the honor to present to Your Right Honorables the trial records against that delinquent likewise in original attached hereto, showing by the act of approval standing behind the sentence the reasons why the Director suspended the execution only so far as concerns the confiscation of all the delinquent's accrued wages until further order from Your Right Honorables, just as he on the contrary fully approved, and it was also executed; the sentence pronounced by the said court on the 20th of May last against Carel d'reijer, soldier, for the attempt at desertion, entailing having to run the gauntlet three times up and three times down through the entire garrison, a fine of four months of his pay for the Fiscal, and a declaration of having earned no wages since the day of his detention, with further condemnation in the costs. But two sailors appointed to the aforementioned vessel 't Huijs te Boede, named Jan Appel and Jan Hend:k Roode, having been condemned regarding the same to be placed inside with the costs, with dismissal of the further or greater claim, the Director, based on Your Right Honorables' Resolution of the 11th of February 1734, enjoined the Fiscal to enter an appeal from that sentence to the Honorable Council of Justice of the Castle Batavia, considering that the ship Kievitsheuvel expected from Cochin China would put into one of the neighboring ports, and could be here by October at the latest and dispatched to Batavia; but the first-named having since been transferred to the hospital due to illness and not yet being recovered, found an opportunity to escape without anyone's contrivance or neglect of duty, as appears from our Resolution of the 27th of July, to which the reports concerning that matter are joined, just as from the accompanying extract from our Resolution of the 20th of November last the motives that moved us regarding the sentence against the said Jan [illegible]

13. From Souratta, the 31st December 1756. From Souratta, the 31st December 1756. Demand of A:o 1756. To merely execute the sentence of Jan Hend:k Roode as it stands, upon his lamentable prayer made by Request, and subsequently to send him to Batavia upon the statement made by the first undersigned that the Director, having waived the appeal, believed in this extraordinary case, by virtue of what was alleged by the petitioner, to be permitted and able to desist from the appeal that had been entered, the principal reason of which is that his punishment has already been noticeably aggravated by his lengthy arrest; pursuant to which the same, after a preceding flogging with the rope's end, was placed aboard the Barbara Theodora, the legal proceedings in originali and the last-cited resolution in extract being enclosed herewith, as well as another of the 6th October. Regarding two deportees, whereby it was decided to send on this occasion to Batavia Jan Gijnan of Amsterdam and Jan Colomb of The Hague, former soldiers in the Company's service—the first posted in this garrison in A:o 1753, and the other at Gamron in A:o 1746, and missing—and to intercede with Your Right Honourables that they might favorably be accepted back into service, with the resumption of their pay since the 12th and 13th September last, when they returned to us from the English, as their representations made by request of having been lured into the English Lodge while in a state of drunkenness and there forcibly enlisted and detained, for the reasons cited alongside, do not appear implausible. A soldier of our garrison, named Jacobus van der Kloo, having on the 5th May last, according to the report of the non-commissioned officer on guard, uttered some seditious language, the Fiscal was ordered the following day, because of the well-known necessity of rooting out the seed of rebellion before it takes root, to make a thorough inquiry into the matter as well as after a certain unknown accomplice of his, and also to proceed with all rigor before the Judge against those mutineers; and by that officer a written report concerning that affair was subsequently submitted, inserted into our accompanying resolution of the 17th thereafter, when it was approved, for reasons discussed at length therein, to terminate that case by making the said Jacobus van der Kloo a sailor and, after a preceding severe flogging with the rope's end, having him serve provisionally, or until there should be an opportunity for his deportation from this Directorship, upon one of the small craft, and thus at the earliest moment purge our garrison of that harmful piece of furniture, as was carried out accordingly, and was recently followed by his placement aboard the bearer of this. The Captain of the French private ship Le George, hailing from Bengal, which was wrecked in May last while being brought into the Surat River, Francois Mitard, having most urgently requested of us that he, as a poor shipwrecked man who has a wife and children in Chandernagor, might be granted passage with the bearer of this to Ceylon in order there to seize the first opportunity to reach the Ganges directly or via Coromandel, provided he defrays his own expenses during the voyage, we believed we could not decently refuse him such, or without giving cause to accuse our nation of a lack of charity toward unfortunate strangers, and we hope that on this account such will not be displeasing to Your Right Honourables. To the Governor of Cambait. Memorandum of household/retrenchment. Batavia. To those mentioned in the headings above. The bearer of this, the ship Barbara Theodora, having returned on the 14th ultimo from Denda Rajapour, we have caused the same to be discharged of its ground-tier with the utmost dispatch, provided it with the necessary ballast, and reloaded it with the goods we had on hand for India, in order to unship them en route at Cochim for Ceijlon and Mallabaar. Having finished this work yesterday, the officers were dispatched with the necessary provisions today, and not only were fifty Moorish mariners placed aboard that vessel, but also various necessities were supplied for its use in accordance with our resolution of the 24th ultimo. However, none of these require special mention here, except only a hawser for a bower anchor which, according to the declaration to be found among the enclosures hereto, parted off Cape Commorin, and a heavy hawser to be used as a stream anchor at this roadstead, as is further evidenced by an extract of that Resolution, into which the petition of the commanding Captain-Lieutenant is inserted. Accompanying this is also another extract of the 3rd current, containing the findings on the delivered cargo of that ship, both here and at Denda Rajapour, on which no noteworthy shortages beyond the permitted write-offs were found, and regarding which we have made disposition according to the regulations. Why the formal description is deferred until the next occasion. Transmission of the held deliberations regarding the memorandum of household/retrenchment, and request concerning it. In order not to lapse into a tedious prolixity, which can hardly be avoided when one reports on matters repeatedly or piecemeal shortly after one another, and the confusion that may arise therefrom, we shall, with Your Right Honourables' permission, postpone the formal description of the state of this Directorate and the occurrences therein since the last of March of the past year—insofar as it has not already been dealt with in our later letters out of necessity—until the next opportunity, and in this letter merely cite a few points which we deem necessary to bring to your knowledge earlier. We begin by noting that we have the honour to present herewith to Your Right Honourables in a separate bundle our deliberations held on the last of March and 1st of April of the past year concerning the memorandum of household/retrenchment of His Excellency the Right Honourable Governor-General and its annexes, along with various papers belonging thereto, bound according to the register prefixed to them. We respectfully request a favorable and prompt reflection and disposition regarding this, especially asking that, if our representations concerning these and other matters should be found somewhat too bold or too extensive, this may solely be attributed to a zealous endeavor—well harmonizing with the veneration owed to Your Right Honourables—to convince your Highnesses, as well as the Honourable and Respected Lords Directors, of the truth, solidity, and necessity of our positions and remarks, for the promotion of the Company's true interests and our own well-being. These, according to our understanding, did not permit us to dissimulate anything or touch upon it merely in passing, which seemed required for that purpose. In that case, we dare promise ourselves that Your Right Honourables and our aforesaid superiors in the fatherland, according to their renowned equity, will graciously deign to pardon us if we might thereby have inadvertently let ourselves be carried somewhat too far. The surrender of Amed-abaad to the Governor of Cambait, who has hitherto managed to maintain himself in the administration. But whose reign will perhaps not last long there. In the month of September last, the city of Amed-abaad fell to the share of the Governor of Cambait, Noerdin Mhametchan, who also has himself called Mominchan. He wrested the same from the Marathas without encountering any noteworthy resistance, and has hitherto managed to maintain himself in possession of that place against them with the help of the Coolies, although his enemies and their allies have gathered a large military force from all sides, with which they have marched thither under the command of the old General Damagie Rauw Gaijgual. However, so far as has been learned hitherto, they have accomplished little, except that they have sufficiently encircled the city from afar, having been forced, during various sorties by the besieged, to retreat with bloody heads before the triumphant arms of the Governor, who seems likely to give them plenty of work to do, provided he does not lack money in the long run. He is so poorly provided with this that he has already more than once had to impose extraordinary levies upon the merchants and other inhabitants to pay his auxiliary Coolie bands, who are not accustomed to granting long credit, nor are they squeamish about switching sides as soon as they think they will best find their account therein. On this occasion, the junior merchant Gijsbert Jan Feith returns by sea to Cochim with his family, to whom the Lord Commander and Council there have permitted a short trip hither to attend to some private affairs; besides also the Syrian Priest George Homitalla and two of his servants, to whom it was thought passage thither could not be refused, provided they defray their own expenses during the journey without cost to the Company. This year there has been no Honorable Company ship at this place, nor is it to be expected that one will come, about which people here seem to care very little. Last year we sent a letter to Your Excellency with Captain Marchis and prayed to God for its safe delivery. Now we have the honor to reveal to Your Excellency with this that in the year 1156 a ship was here whose supercargo was a certain seaman. To him we gave jewelry to the value of about 50,000 Spanish reals, in order to sell it in Bengal on our account and to purchase with the proceeds goods in demand here and to bring or send them back here for a commission of 5 percent of the sales. Missive or Commission To the Highly Honored General By the bearer of this, one Joan Roos, a native of Batavia, who is about to return to his fatherland via Judda, I take the liberty of assuring Your Honor of my humblest respect, and of informing Your Honor that about eleven months ago I had the honor of being recognized and nominated here as Consul of Their High Mightinesses the Lords States General of the United Netherlands, having made my entry into this city accompanied by the Grand Signior's berat, conditions, and express orders to the agha or corps of Janissaries, and commanding 24 beys of Egypt, who carried them all into execution; and on the 17th of March 1755 I had the honor to have the Dutch flag flown in Alexandria, so that the Dutch Nation, who had abandoned Egypt for over 90 years, now again enjoys the same privileges as the English, French, and Venetians who are established here, paying now only 3 per cent instead of the 10 per cent they formerly paid when there was no consul on their behalf there; so that trade is opened to them there again, and their spices, linens, and further products, which formerly had to come via Livorno and Marseille, can now be brought directly from Amsterdam, and the Dutch, instead of having to purchase the products of Egypt in Marseille and Livorno, can now obtain the same at cost price in Egypt, which will undoubtedly be very advantageous for Dutch commerce. Enclosed herewith is a price current of the goods brought from Judda and the Indies, from which Your Honor will be able to perceive their present prices, and according to demand they rise 10, 15, to 20 per cent; and if Your Honor or the Noble East India Company were inclined to make a trial of spices and other Indian wares in Egypt, there are now here several Christian merchants under Dutch protection, persons of credit and who conduct the greatest part of the Judda trade, who have solemnly promised me to buy the same upon the arrival of those goods or to trade them to Your Honor's greatest profit. This matter grieves us, not only because of the present loss, but because in this manner the trade of the Honourable Company in these lands, principally in this moneyless time, is completely obstructed thereby; and if Your Right Honourables do not please to permit the remaining Residents to accept those chunks for at least ƒ 85. — per 100 lb, we do not know how it will go, for by some indulgence in the selling of the Company's merchandise it might still be done at that price, but positively not for less.
