77 From Souratta under date 12 December Ao 1758. a small remainder of the previous year's contracting, such that it seemed by no means advisable, even if affairs came to a standstill in those regions, for the present to make any advance payments to the Amed Abaad brokers, without which they would nevertheless not be able to obtain a single Corgie from the hands of the workmen, besides the fact that the latter have for the most part run off, and the remainder have fallen into the utmost misery, and would presumably be incapable of putting their hands to the work with the required vigor, not to mention the danger and the heavy expenses of the transportation by water at a time when it is not yet decided who among the Marhettes or the present Governor shall remain master, and over which everyone plunders and robs with all their might as much as they possibly can; that although the Brokers and Suppliers here, after the displeasure and remarks of the Lords Majores were presented to them in the most serious manner, and His Honour strongly insisted upon a general reduction of prices, for which the low market of cotton in comparison with recent years, due to the delay of the vessels destined hither from Bengal, gave good opportunity, had undertaken to provide good and sound returns absolutely conforming to the samples in good time, with a general reduction of 4 pr Cto on the entire requisition for India, as well as such a discount on the European assortments as will appear more clearly from the Memorandum of prices to be inserted hereafter, they nevertheless demanded higher prices for some of the latter than the qualification of their High Mightinesses permitted; that in order to set the work in motion insofar as this main office is concerned and one is at present capable thereof, His Honour had summoned the brokers and Suppliers, not only to have them repeat their offer in full Council, but also to make a final effort alongside the members to see if it were possible to persuade them to deliver also such cloths, for which they demanded more than the gentlemen principals in Europe are pleased to spend for them, at the stipulated prices. Whereupon, the Brokers and Suppliers standing within, the quoted prices were presented to them with a repetition of the remarks from the fatherland, which they acknowledged and declared to be the very lowest for which they could deliver the goods sound and according to the samples, at the same time giving to understand that it is absolutely impossible to deliver the naginapaatsen Bajotas for one and the same price, but that it might sometimes happen, according to the remark of the Lords Majores, that the prices of the English Company here or there differed somewhat to the advantage from those of the Dutch, because the former always kept their own peons at Nerriaat, Dolka, Cambaid, Brootchia, and other weaving places, whereas they on the contrary were obliged to pay the necessary Sepoys in the weaving and bleaching places themselves and consequently burden the goods with those expenses, the Lord Director having in Ao passato for the first time given them a detachment or sergeancy of peons to keep watch over the Company's cloths at baddawalle not far from Braatsia and other nearby bleacheries; and since one could not contradict their statement, much less was able to promise them the same favour as the suppliers of the English because the small number of the Company's native militia, according to the instructions of the memorandum of retrenchment, is still to be From Sauratta under date 12 December Ao 1758. easily From Souratta under date 12 December Ao 1758. diminished as soon as the present precarious circumstances permit, and no European soldiers can be employed on their account for such duty, both because of the inconvenience of desertion, for which they would then have ample opportunity, and because they are most urgently needed on the vessels; so one presented to them in the most emphatic manner the rightful displeasure of the Honourable High and Mighty Lords principals concerning their deceitful conduct in dyeing the borders of the broulas or chiadderboraals with corrosive substances which eat through the fabric, which according to their own confession made to the Lord Director was only done after those cloths had passed the inspection of the Council, and also was not visible when they first came from their hands; and since they offered nothing against this, it appeared clearly enough that they had connived in that improper mixture of dye, on which account they were informed that, even if one wished to contract for dyed borders again, this would nevertheless take place under the express condition that if they were found again in the Netherlands as the Gentlemen write, they would have to reimburse the same in money upon being sent back, with the usual interest of 3/4 pr Cto per month, or else deliver new ones in their place under payment of the accrued interest thereon, but that one absolutely desired no more dyed borders, but woven ones; so that finally, in consideration of the fact that experience has essentially shown more than once, as was already taken into consideration at the session of 6 May Ao 1746, that by bargaining prices too closely one runs the risk of causing the Suppliers to step over from the Company's work to more profitable employment, or to seek their advantage in a lesser quality. 274

From Souratta under date the 12th of December, Anno 1758: under which name these cloths also generally pass here, although in reality they are always only 124 a long and 1 3/4 l=m wide, and this difference having been presented to the Suppliers, they declared such to be a general custom, regarding which they could make no alteration without a proportional increase in the price; but since it does not clearly appear from the Demand that their High Noblenesses and Honors aforesaid absolutely disapprove of the lesser length and width and on that account desire an alteration to be made in this regard, it was decided to have them manufactured as has been done until now, without any disapproving remark ever having fallen upon it. The more so, because the situation is the same with several other cloths that differ, either in length or in width, from what is commonly attributed to them, for example the Chintzes of Surat of 12 1/2 @ long, which are said to be 1 1/2 @ wide, having the width of 1 3/8; the Chelasses Souria in Kalla, instead of 1 1/8, are not more than 1/3 d=s; and the Dotij Dorogesjes, which have the name of 1 1/2 @ width, are only 1 3/8. However, the length of 12 1/2 @ given to the Chintzes Cherongse in the Demand from the Cape of Good Hope, as well as their width of 1/16, was judged to be regarded as a clerical error, since they are never longer than 11 1/2 @, but on the other hand 7/8 wide, in which manner it was consequently approved to have them manufactured. And since in the Demand for Paelo Chinco 50 pieces of Chintzes are found without specification of the sort, it was approved to provide ordinary Surat ones, as this is the most natural guess in such uncertainty. Likewise, to supply the Chindossen or common Patholen demanded for Timor in the same manner as the past year in Pappe Cindos. This matter having been thus dealt with, the Honorable Second, as president of the Judicial Council of this office, presented the following minute regarding the actual performance of the Oath of Purification by all the present and thereby interested political members, concerning the spices brought into this Directorate with the ships named therein, and it was decided to send an authentic copy thereof to their High Noblenesses to show that such has been accomplished, the expected Dende Rajapoer factors Sanderus and van der Sleijden having to purify themselves in like manner upon their arrival. Thursday the 16th of March, Anno 1758, forenoon, all present. The Honorable President submitted the following Extract from the minutes of what was dealt with and resolved in the Council of Policy at Souratta, Tuesday the 14th of March, Anno 1758: It is decided to have all the present members of this council, and those expected from Denda Rajapoer, take the Oath of Purification before the Judicial Council regarding the delivery of the spice cargoes from the ships Marienbosch, Luxenburgh, Lapienenburg, Thuys te Boede, and Middelburg, namely that they were not interested therein or benefited thereby, the respective commissioners having already sworn to their reports in this regard. From Surat, under date 12 December anno 1758. The proceedings held against two young boys of the Fiscal concerning an attempt at sodomy, as well as on account of the adjudication of the Fiscal's claim for the confiscation of all back-pay in monthly wages due to a certain deserter executed here, the aforesaid extract reading as follows: Thursday 16 March anno 1758. Forenoon. Presentibus omnibus. After the Junior Merchant Jan Oudenhoorn was created a member in this Council by the Political Council on the 9th of this month, sworn in, introduced, and assigned a seat after the Junior Merchant Daniel Burnet and above the Ensign Harmen Amesbeek, the Honorable President produced and read attentively an extract of the minutes of the deliberations and resolutions in the Political Council of this office on the 14th of this month, alongside the cited extract from the letter of the Supreme Indian Government to their Honors under date 15 November anno 1757, it was understood to let the contents thereof, according to duty and the esteemed recommendation of the Council of Policy, serve in all parts for instruction and observation, alongside inserting the said extract of the Batavia letter herewith to that end. To be inserted. Yet nevertheless, to remonstrate to their Honors by extract of this, with an expression of the sensible regret of this College over the displeasure of the aforesaid Supreme Government, both regarding the alleged impropriety of the criminal proceedings of the Fiscal Officer of the Council against two of his bondservants, named Patientie of Diu and Cardoes of Malabar, the Lord's prisoners, over an attempt at sodomy, as well as otherwise in all deference: that although this Council is far from maintaining that their High Honors' remark would be unfounded, on the contrary readily admitting that it may well be that the idea this Council had and still has of the heinousness of the aforesaid crime caused them unconsciously to lean somewhat too much to the strict side, they nonetheless judge that they may and must adduce for their exculpation and for the elucidation of their High Honors: 1. That although the prisoners, according to their statement, were essentially only seven years old, and this was not contradicted by the Fiscal in the claim submitted against them for lack of proof to the contrary, nevertheless, both from the responses of the prisoners to the articles presented to them and from other circumstances which decency does not permit to cite here, it must be inferred that they were of much riper years. II. That it very seldom happens that the bondservants here in this country know their true age, and that therefore upon that statement, even if one wished to assume gratuitously that the same was done in good faith according to their best recollection, it seemed impossible to proceed to absolution or a mere childish punishment. III. That this statement deserved all the less to be credited because both prisoners appeared visibly older, especially the active delinquent Cardoes, who seemed to have reached fully two to three years more than his accomplice, not to mention that it would be too coincidental that both of them were precisely seven years and neither more nor less old. IV. That the evidence against those delinquents, so far as the remonstrants, none of whom are jurists, can judge thereof, was as clear and convincing as would be required regarding a crime whose consummation is so difficult to prove as the crimen nefandum, and against the prisoners, if it had appeared lawfully and satisfactorily that they had completed the age of fourteen years, and thus from the circumstances could be presumed that the act was completed or undoubtedly would have been completed had they not been caught, to bring out a verdict ad mortem or at least ad torturam, so that to the remonstrants—be it said in hope, under humble request of a favorable interpretation—according to their understanding, which they very willingly submit to the judgment of wiser and more experienced people, it has not appeared sufficiently or clearly enough that the actions of the aforesaid prisoners could be regarded as anything other than childish wantonness so as to dare adjust the sentence accordingly. V. From Souratta under date the 12: Dec: A:o 1758: the ordinary punishment and a complete acquittal has been chosen. 7: That in these warm countries the youth of both sexes mature much earlier than in others, while because of the lascivious and unedifying discourses which the serfs daily hold among one another, malice can also be presumed sooner, it being, to give only this one demonstrable example, quite customary at all times that girls who had not yet reached their tenth year were already marriageable. VIII: That the bare flogging, although strictly, nota bene, according to their years /:for that the sentence in question entails expressis verbis:/ with respect to such vile and abject subjects, who have no honor to lose, whose stomachs are unknown, and who furthermore are nothing more than slaves or serfs, seems capable of being regarded as little heavier than a domestic correction, which in these countries regarding such persons is commonly extended quite far, the more so since Justice here has no separate servants, namely officers or caffres, peons or sepoys, being actually native soldiers, are used for the whipping, and this may not take place on a scaffold but must occur on a ship or vessel. VIIII: That the judges felt conscientiously obliged, in a matter of such a nature as this, above all to take care that not only were the Dutch colonies purged and kept clean of such scandalous subjects, but also that the slave master might remain spared from damage as far as possible. X: That both of these good and equitable intentions were aimed at by the sentence in question, and, as they imagine, also achieved. That the remonstrants were not unaware that it is forbidden by the statutes of Batavia to sell slaves of Christians to non-Christians, but indeed that this law was applicable to guilty slaves sufficiently convicted of an attempt at sodomy, but on the contrary have previously always maintained that this applied solely to those who have not been judicially convicted of any crime. 11. That they, as judges, consequently never had any intention whatsoever to exceed in the slightest the power and authority granted to them; and 12. That they therefore flatter themselves that, after consideration of these motives, the sentence pronounced by them will not be found entirely as ridiculous as they readily concede it must necessarily appear when one reflects solely or in the abstract upon the stated age of seven years cited in the letter of the Political Council to the said Their High Mightinesses; and 13. Or lastly, that the present Director, the Honorable Mr. Taillefert, on 4 June Anno 1756, as appears from the extract of this appendix to be submitted marked Letter A, after review of the sentence pronounced by this Council on the previous day against the executed Hendrik Snouwer for desertion, having declared that His Honour had noted regarding the confiscation of all his remaining pay to be divided thus, that to his knowledge the Resolution of Their High Mightinesses of 3 November Anno 1637 was not specially revoked to date, and therefore suspended the execution of that sentence to that extent until further orders from Their High Mightinesses, or until the contrary should appear to His Honour, this Council has ever since let the same properly serve as a rule and guideline. From Souratta under date 12 December 1758: insistence of the Radja of Hallaar for our continued stay in his capital city Nauwe Negger, and the continuation of the Honourable Company's trade in his lands, together with our answer thereto; we must now acknowledge that this prince as well as his ministers have fully kept their word and assurance that they would not hinder us in our departure, and we have enjoyed all assistance from them for the acceleration of the work of unloading and shipping off, although the court nevertheless daily persisted in requesting our stay, or at least that of only a single European employee, whoever he might be, and after which it strived with so much earnestness and cordiality that even the prince was pleased to humble himself to pay a visit to the first undersigned, both for the aforementioned purpose and to give a decisive proof of his high esteem for the Dutch Company, on which occasion His Highness also did not fail to renew his request with great politeness. But being unable to fit any answer thereto other than expressions of the impossibility of satisfying His Highness, we nevertheless had to promise him firmly that we would report His Highness's affection to Your Right Honourable Worships. We assure Your Right Honourable Worships that we would gladly have excused ourselves from that visit, and possibly have succeeded therein if the prince had let us know beforehand that he wanted to come and see us, but since His Highness was probably well aware that, on account of the considerable expenses, we would have devised all kinds of pretexts to avoid the visit, he followed immediately upon the person he sent to inform us of his coming, and that he From Souratta under date 2 December 1758: had already stepped outside the court, so that we, through an untimely refusal which might rightly be called an incivility if not impertinence, could not at the very last expose ourselves to obstruction, which would certainly have arisen from such conduct, and we would thereby have been forced, contrary to all interests and Your Right Honourable Worships' intention, to remain at Negga. We therefore had to await the prince and, according to an unavoidable consequence of such extraordinary honour as the visit of the prince of the land, present gifts to him, employing for this purpose, in the hope of Your Right Honourable Worships' esteemed approval, the gifts that were still in stock and had been returned by the Radja of Kiets, consisting of one piece of gold-flowered fabric, two pieces of Chinese velvet, and four pieces of perpetuanas, together with a nazar of 5 gold and 7 silver rupees, amounting at cost from stock to ƒ 1921:13:8 and from cash, with what had to be distributed to His Highness's numerous retinue, ƒ 430:10:—, or together ƒ 2352:3:8, which we very humbly beg Your Right Honourable Worships may be passed and that we may be authorized to write this off, in consideration of the above and the circumstances in which we found ourselves, which are indeed worrisome when a government wishes to keep someone in a place where one cannot or may not stay. From Surat under date the 12th of December Anno 1758: to give small presents, the government's polite insistence that our stay might turn into acts of violence, to which we judged we ought not to expose ourselves, not only because we would have had to make unsuitable gifts in such a case, but also to preserve to the end the esteem of the nation, which had never suffered any blow at Nauwa Negger, and not to allow it to be violated for a trifle. This being primarily what was transacted regarding the government, we shall proceed to state that on the 16th of January the ship Vrouwe Rebekka Iacoba arrived at the Negger roadstead, alongside the hooker De Ionge Iacob and the smalschip De Beschermer. We then neglected nothing to unload and load them, which was also accomplished according to wish and promptly through the assistance of the government. In that vessel we shipped 849 bales of pressed cotton at 725 lb per candy, regarding which we take the liberty to state that the same is of very good quality and free of seeds. The brought 500 canassers of powder sugar we sold immediately after the discharge for 14 florins, 6 stivers, 8 penningen the 100 lb, yielding an advance of 53 3/8 per cent on the cash, of which we have the honor to enclose a yield statement, which we hope will be able to give your Honors satisfaction.
