757 From Souratta under date 12 April 1759 having been presented a translation of a Persian missive from the amed abaad brokers, wherein they come to make their complaint about the second of this Office, Timmerman, namely that on his journey up to ameb abaad in 1756 he carried along a parcel of uncustomed cochineal on his own account, and having found means to slip the same past the inspectors at brootChia, the latter, being informed thereof, had detained another parcel of that dye-stuff belonging to the lord director which had been given along with the brokers for sale, on which the duties had been properly paid here and the bladders had also been stamped as proof thereof, so that they were obliged, if they did not wish to see them entirely confiscated, to quasi-consign there Ro/a 1462. or ƒ2193. —. — under the Brootchia Governor until the payment of duty should be proven by a Sourat customs receipt, From Souratta under Date 12 April 1759 with which they were indeed furnished through the intercession of this ministry, although such is otherwise not customary here; but in vain, as the Moorish Regents seldom return anything they once have in hands, unless one has the power to constrain them thereto, in that case caring little for the well-known Hindustani law that one must be able to produce the smuggled goods or the Corpus delicti in order to be able to institute any action against the smuggler; that thus this damage having been caused by the fraud of the said Timmerman, as appeared in a convincing manner from the discovery of the uncustomed parcel which he had sold to a Banyan, they had addressed the repeatedly mentioned Timmerman for the restitution of that sum, but that he not only showed himself unwilling to comply with their reasonable request, but had even given them as an answer that they could reckon their disbursement on the other customed parcel, and that they consequently found themselves obliged to request His Honour to constrain the said Zimmerman to the payment 759 From Souratta under Date 12 April Ao 1739. of the aforementioned Ro/a 1462., they having not been able to address His Honour earlier regarding that matter on account of the disturbances in those regions. Whereupon, after deliberation, it was resolved to refer the aforementioned brokers with their claim to the Court of Justice of this Office, in order to institute their action there against whomsoever they shall deem proper, and in order to facilitate that way for them as far as possible, to grant them, so far as necessary, Veniam Agendi, as well as to appoint the dispenser Guse to serve them before that Council as attorney, and to give notice of this resolution to the amed abaad servants to serve as information for the second Zimmerman, in order likewise to constitute someone in proper form to defend his case if the brokers are advised to institute their alleged action against him. The Lord Director furthermore having made known that the Young Assistant Dirk Spierejee, serving His Honour as Office Clerk, had requested From Souratta under date 12 April A:o 1759 to be advanced in rank and salary, as well as for the surplus since the expiration of his previous contract, it has been approved, in view of his good conduct and diligence, to advance him to full assistant under a new contract of 5 years, with the salary of 24 Guilders per month, the one and the other commencing from 5 June last, when his aforementioned engagement expired. Thereafter having been resumed a letter from the Commissioner van der sleijden, residing at Thanna, dated the 27 of the past month, directed to give notice that after all effort exerted to obtain the note promised to him of such of the Company's merchandise as was present there, the Subahdar had finally made him understand that he did not know how many goods had arrived at Thanna, but that such was known to Ramagie Madieuw, it was resolved to rest satisfied with what has been done by the said Commissioner in this matter, as it did not depend on him to procure the aforementioned note. — Further was read a missive from the Under-Merchant Sanderus, conveyed to Poena, dated the ultimate of August last, wherein the same, after having given a further account of how matters took place at Rajapoer regarding his being sent up to the Court, makes report of his arrival there, and of the audience he had with the prince, as well as of the expenses necessarily and for the sake of decency incurred by him on that occasion upon the earnest advice of several prominent Courtiers, who he says seem to mean well by the Company, with the request that the same may be passed for write-off. From Souratta under date 12th April Anno 1779 that the envoy Kronenbergh had already approached the threshold of the court, that he himself had also been robbed of all his belongings by the Marhettas, and was sent thither just as he stood, to excuse himself from going to greet the prince, or at least from presenting any sight-gifts, since he could very well have omitted such without injury to the decency of his masters or of the nation; it would however be very hard for him that he, acting with good intention according to the best of his knowledge and understanding, although perhaps having strayed from the right path through a mistaken conception of that wherein the honour of the Company and the nation resides, as well as where it must be sought and maintained, after having as good as lost all he had in the world in the service of the Company, without any hope of a full indemnification, should moreover have to suffer the consequences thereof and thus be treated with the utmost rigour: so it was resolved to pass the aforesaid expenses, to the amount of ƒ657. –. -., provided 763 From Souratta under date 12th April 1759. the said Sanderus undertakes upon his return hither to confirm by solemn oath that he not only truly expended the above-mentioned sum on the aforesaid occasion, but also deemed it necessary to do so for the honour and interest of the Company, and could not have made the sight-gifts smaller than the following specification indicates. But since they at the same time report that they have not yet been able to find any merchants for the areca, so it was resolved, seeing that those nuts are greatly subject to mites, to authorize the servants further to follow the market in that respect as far as might be required to dispose of that commodity, even if it were somewhat below the price of ƒ 20. –. –. or thereabouts, which was prescribed to them by letter of this Council of the 15th of the past month. Absent the merchant and warehouse master Johan Anthonij Sweers de Landas, the merchant and fiscal David Kellij, the captain-lieutenant at sea and master of the equipage Jan Warnar Falck, the junior merchant and cashier Rutgerus van Ebbenhorst and the junior merchant Philip Wargaren, being at the Company's shipyard, item the junior merchant Hendrik Kroonenbergh, on commission to Poena. — From Souratta under date 12th April 1759. The freedom to demonstrate to your Right Honorable Worships that private merchants as well as ship officers were previously obliged to transfer their goods within three days after customs clearance out of the Honorable Company warehouse, in which the same must be stored upon arrival in order to prevent all frauds and illicit trade, into their own warehouses or warehouses rented for their account; but that currently, due to the change in the Moorish governments, that customs clearance does not take place until the delivery to the merchant, which sometimes, because the merchants are very tardy with the reception on account of the scarcity of money, occurs fully three or even more months after the purchase made, and thereby not only shortages necessarily result, but also through the same, when these are somewhat excessive due to leakage, spoilage, desiccation, etc., great disputes can arise; and therefore he finds himself compelled, in order to prevent this, to respectfully request your Right Honorable Worships to have the goodness to make such a provisional arrangement, by granting him some percentages according to the condition of the goods, until their High Excellencies deem fit to order otherwise, and also that he may charge some warehouse rent to the private merchants and the ship officers, since it frequently happens to him that when many of the Company goods have arrived, he is obliged to rent private warehouses without enjoying the least gratuity for it. From Souratta, dated 12 April Anno 1759. had caused the old Begum to be brought and would perhaps have herself transported to her house, which in all likelihood had given occasion to spread the rumor that the Begum was intending to move; the Director furthermore testifying that, notwithstanding the fact that the brokers, in order to achieve one purpose or another that His Honour had not yet been able to fathom, spoke solely of peace, His Honour was well informed that matters were situated entirely otherwise, and that prudence therefore demanded that some measures also be devised at all events, for fear that the smoldering fire might very suddenly burst forth from under the ashes, in which case there might at times not be enough time left to put oneself properly into posture. Whereupon, having deliberated, it was resolved, From Souratta, dated 12 April Anno 1759. resolved, in order to create no commotion or to give anyone cause for notice, to postpone for the present the enlistment of extra sepoys or native soldiers, but at the same time to authorize the Director to recruit as many of them as shall be necessary, whenever His Honour shall judge such to be required. Furthermore, considering that if one remains divided between the lodge and the shipyard, one will be able to defend neither of the two, and that, in the event of a civil war, the former would likely suffer the greatest brunt, it was agreed to disembark the militia from both ships, and that at the very slightest sign of alarm all Company servants will hastily assemble in the lodge, except for the fiscal and the equipage master, who will remain at the shipyard, in order, alongside the sailors from the vessels Souratta, dated 12 April Anno 1759. and 50 sepoys, to guard the artillery standing there, and in the event of fire, to be able to employ the necessary means in or around that place to extinguish it, to which end the aforementioned vessels will all also go and lie before the shipyard, except for one galbat to cruise on the roads. 825 from Souratta under date 12th April Anno 1759 to give notice, also not to be blinded by the hastiness of the Sepoys, but as much as possible to inquire secretly and try to ascertain how the fire originated, who was the instigator thereof, and what was intended thereby, since one has to deal with a people that is not to be trusted and is capable of committing such villainous acts merely to remain free from accounting for the remaining balances; thus it was resolved to keep this record thereof. The envoy to the Poona court, Kroonenbergh, having on the 30th ultimo given a detailed account of what occurred in the further audience which he had on the 24th of that month with the prince, as well as his brother and chief minister Sedda Baba, concerning the affairs of Rajapoer, from Souratta under date 12th April Anno 1759 Rajapoer, and of the high hopes he has of succeeding according to wish in his commission within a short time, whereby it appears that on that occasion he, among other things, uttered bitter complaints about the army commander Ramagie Madeeuw, favorite of the said Seada Bawa, it was deemed proper to write back to him that although one completely approves the resolute language used by him in the aforesaid audience, he must nevertheless be cautious not to give cause through such complaints to suspect that he, the envoy, has been incited against Ramagie Madeeuw by his known opponent, the Governor of Bassijn, Fancraadje Kissou, or is animated by a spirit of partisanship, with the further recommendation 827 from Souratta under date 12th April 1759. recommendation that he must especially try to make himself liked by Sedda Bawa, who can be regarded as nothing other than the ruler of his brother's realm, and give no cause of displeasure to any of the grandees, insofar as this can be avoided by a man of honor and probity who seeks nothing other than to promote the interests of his master, as well as most emphatically to enjoin upon him the required prudence and attentiveness both in his speech and in his writing. At the same time, it was resolved to send to the said Kroonenbergh a copy of the aforesaid letter from Thanna containing the unpleasant news of the fire that broke out there, with orders to request compensation from the court for the Company's goods lost thereby, from Souratta under date 12th April 1759. thereby, since that misfortune is a consequence of the acts of violence of the Marathas and of the delay in the restitution of those goods, which has been insisted upon for so long and which could not be postponed with any semblance of justice; it being exceedingly fair that someone who makes himself master of another's property, keeps the appointed servants entirely out of the administration, deals with the merchandise at his arbitrary will, and sends it as and where he sees fit, should also bear the damage that falls upon it through neglect, carelessness, or unfaithfulness of his servants during his unlawful possession, with the addition that he must continue to urge this with the utmost emphasis, 829 from Souratta under date 12th April Anno 1759. must continue to urge, but nonetheless accept the free disposal of that which is still in existence and payment for that which was stolen and consumed by the regents, if this should be granted to him. From Souratta under Date 12 April 1759. being by profession, was by no means to be trusted; that it therefore could easily happen that the sight of richly laden ships might kindle their lust for plunder, and decide to venture a chance thereon, either by surprising the ships themselves, or by making themselves masters of some laden loose vessels, in which case, if the attempt succeeded, the Poenase court, which knows well how to take, but little how to return, would possibly acquiesce in the matter and sacrifice the friendship of the Company to the advantage gained, whereby the Rajapoerse affairs would also go backwards and the Company's servants and effects located in the Marhetse Lands, both at Poena and at Thanna, as well as at Amedabaad, would run great danger, and that prudence required always being on guard against their attempts, all the more because after the attack on the hooker De Jonge Jacob on the first of November 1756, the previously never violated safety of the roads can no longer be relied upon; the Director therefore proposed that the unloading of the ships, which had already been suspended by order of His Honour, be kept stopped until one is better informed of the true reason for their coming and of their actual intentions. Whereupon having deliberated, it was agreed, for the abovementioned reasons, to conform to the aforesaid proposition, and at the same time to authorize the Director to have the unloading proceed again as soon as His Honour shall judge that this can be done with safety, as well as to order the master Pieter de Bakker and all other ship officers on shore to repair at once to their respective vessels and remain on board until further orders, and also specially to instruct the said master, while communicating the motives of this resolution, to give notice thereof to the master Nicolaas Oman present in the roads, in order jointly to devise a signal letter and further necessary measures for defense in case of necessity. Thereafter the Director made known that His Honour, according to the authorization of the 7th of this month, had taken into service 125 extra pions and 25 inland sailors, in order, because of the heavy recruitments by both Governors, not to be forced at the last moment to accept ripe and green, or the refuse of others, all the more because the prominent and wealthiest inhabitants likewise provided themselves with men and it was therefore not advisable to wait longer, which it was thought fit to note here. Considering the weakness of the ships' crew, and the complaints that have been made about this from time to time by the authorities, especially when the men are sometimes exhausted from working and keeping watch, and on top of that visited with sickness and mortality, to which is added the testimony of the High Indian Government in venerated letters of 20 October 1756, namely that the Moorish or Souratse seafarers are of great use and service to the Company, and finally that regarding the sending of double teams, as has frequently occurred, no disapproving remark has ever been made, it was resolved upon the proposition of the Director to send 2 teams or 50 Moorish sailors to Batavia with every ship henceforth until further orders. from Souratta under Date 22 April A:o 1759. to state under offer of an oath what is known to them concerning the conduct of Jan vermeulen with respect to their head, and especially regarding the incident contained in the aforesaid petition, under provisional warning that when the Factor charges them to copy these or those papers, it is by no means up to them to examine whether such is the Company's service or not, but that they shall have to consider everything as the Company's service that is assigned to them by the same, and consequently execute the same not sloppily, but as accurately and neatly as is in their power. However, to reject the request made by the factor in the aforesaid petition, to order his counter-parties to bring to light what they have against his person so that he may account for himself, since the second Zimmerman 875 from Souratta under date 2 April 1759. Zimmerman seems to have already brought to light everything that was on his mind in the above-mentioned letter to the Company. At the same time, it was approved, in order to make an end to their squabbles, to separate the parties, and therefore to grant the request made by petition by the second Zimmerman for his relief from this directorship, with the order to undertake the journey hither at once after completing the transfer to his successor, in order to depart further for Batavia at the first opportunity, provided not only posting the usual bail of Ro. 160 or f 2400.-.- for 4 years, but also in addition pro re judicata, in case Damoesa c.s. draw him into legal proceedings concerning their claim, or else to continue serving at this Head Office until that matter is terminated.
