509 The 29th of June deemed necessary to inform those of the garrison and the seafaring personnel thereof by a publication, as well as of the authority granted at the latest session to the Council of Justice, and also that the soldiers Jean Pierre du Bois and Casper Terenholz, in view of the statements obtained, are acquitted of desertion and running away, provided they return within the year; which paper, having been drafted and read by his Honor during the meeting, was resolved as follows. The 29th of June Whereas it is being experienced more and more that the English recruiters or crimps, enticed by the premium set by that nation upon the delivery of European recruits, do not shrink from putting all kinds of sinister practices into effect in order to entice the soldiers from this garrison and other Company servants to desertion, but even go so far as openly to insult and in all manners of ways to provoke our men, both in taverns and along the public roads, into coming to blows with them, for which purpose they are armed with clubs or bamboos, in order to have a pretext to drag them, with the help of the English peons stationed all around, to the Castle, where, if they do not immediately enter into service willingly, they are detained so long that they cannot return to their lawful master out of fear of punishment; that the English gentlemen, also being customarily inclined from of old to apply themselves to such means in order to recruit their garrisons at the expense of their neighbors and allies, have not only ordered all Europeans who approach the Castle to view the tiger standing close by the Land Gate, or otherwise, to be taken into arrest, ostensibly to examine whether they might at times be spies, but actually to detain them under that pretext for so long that, not daring to return for fear of chastisement, they must resolve to accept the offer of service which they do not fail on that occasion to make under various promises and persuasions; and furthermore that several Company servants, abducted by force and compelled into the English service, would gladly come over to us again if they were not restrained by the fear that they would be punished as deserters or at least as runaways; IT IS THEREFORE that we, desiring to provide herein, notify everyone whom this might in any way concern hereby to not approach the Castle unless it were absolutely required in order to continue their way, on the penalty established by the warning of the 27th of April last, which remains in full force and effect, and to be on guard against the cunning and evil designs of the aforesaid crimps, as also everyone is hereby made aware for their information: Publication I. That our soldiers and seafaring personnel henceforth shall be permitted to walk in the city along the public roads armed with a stout stick or sufficient bamboo, not in order to assault or do any harm, directly or indirectly, to anyone therewith, even if they were known crimps or recruiters of the English, but in order, when assaulted themselves, to keep the attacker off their body and to repel force with force. II. That also for the reasons aforesaid, on the 26th of this month in the Council of Policy, it was resolved to authorize the Council of Justice, when disposing of trials of deserters, the exception of force or coercion being properly alleged, to hold the same as proven or verified in so far as it in any way appears or can be ascertained that the person accused of desertion seized the first opportunity or endeavored to seize it to return, or else has not yet been missing for such a long time that one can infer that he had the opportunity to do so but neglected it, and III. That on that occasion, the deputies, recalling a certain passage relating to the Letter and Protest sent at the beginning of the past month to that Gentleman and his council, made his Honour aware of this and presented to him that it was very well understandable that a soldier who had been kept in the Castle for one or more nights would have little difficulty in deciding thereafter to remain where he was, rather than expose himself by his late return to the punishment established by the articles of war for runaways and deserters; and that, therefore, precisely that keeping overnight for one or more nights was the means to force him to enlist, because he was certain that he could not then return free of punishment and would be treated according to the rigor of the laws. That subsequently Mr Spencer, having renewed his assurance that he would take all possible care to prevent anything that might disturb the good harmony between both nations, in the expectation that on this side people would concur toward the same objective with equal cordiality, and of which the revocation of the permission granted to the soldiers and seafarers to walk in the city with bludgeons would serve as an agreeable proof to him, they, the deputies, had promised to make a proposal thereof to their principals, and subsequently took their leave. After which was read a Report from the Pay Bookkeeper Wargaren, concerning an error committed by his predecessor, the Pay Bookkeeper Jan Pieter Ohdem who recently departed for Batavia, regarding the Pay Account of the junior merchant Willem Blaaukamer for the Year 1754, in which the same, under the last of August, was only credited for 24 months of salary, from the last of August 1752, when his latest account was closed in the Castle of Batavia, until the last of August 1754, as appears from an extract taken from the Ledger kept here and a copy of the account submitted alongside it, whereas he ought to have credited him for 34 months, since according to his aforementioned last Batavian Pay Account, also produced in the original, he was only credited for 2 months of salary at ƒ 40:—:— per month, from the last of August 1751, when the previous books were closed, until the last of October following, from which date his salary should have resumed its course here in Souratta. The aforementioned Report reading as follows: And whereas the aforementioned Blaaukamer daily complains about the injustice done to him, and comes to demand an amended account from the undersigned, he therefore very humbly requests to be strengthened in this matter with Your Right Honourable esteemed orders, assuming meanwhile the honour to be with deep respect. Since a pay account of the junior merchant Willem Blaaukamer has been presented to the undersigned Pay Bookkeeper, in which he was mistakenly shorted 10 months by his predecessor or former Pay Bookkeeper Jan Pieter Ohdem, he takes the liberty to demonstrate this difference and to set down here the account of the said Blaaukamer as it ought to be. It originates from the words from the last of August of the past year to the last of October following, and is noted in the margin 1752, thus crediting him on that account for two months until he arrived here. The former Bookbinder Frederik Willem Peijer having recently died, and no individual being at hand to fill his place, to which the duties of Court Messenger, Auctioneer, and Undertaker's Messenger are attached, and yet the proceedings currently underway before the Judicial Council of this Factory absolutely requiring a sworn person to serve as court messenger, it was therefore approved to have the soldier clerk Francois Angelij sworn in for that purpose before the said Council in that capacity, and to let him discharge all the other aforesaid duties alongside it, provided he also continues to serve in the Secretariat until a Bookbinder by Profession is again provided, if he in the meantime can find no opportunity or has no inclination to learn that craft. Factory Meeting 543 The 21st of August The 21st of August Notice having been given to the meeting that on Saturday the 18th of this month, His Honour had received an oral report from Storekeeper Sweers, stating that upon opening Latty Number 2, on the outer or south side thereof, level with the ground, a large hole was found through which a small boy could easily crawl; on which account, fearing that in the meantime a theft of great importance might have been committed in the same, he had immediately ordered that warehouse to be closed again and requested that the matter might be investigated, the more so because a similar incident had occurred once before during His Honour's administration, but, as it could not be perceived that anything of note had been stolen, no record of it had been kept, and he, the Storekeeper, had subsequently, upon the emptying of the same, discovered the contrary to his considerable damage, against which he would gladly be protected this time, since it was not possible for him to prevent such intrusions from outside; that His Honour had thereupon immediately repaired in person to that Warehouse, assisted by the Fiscal and two express Commissioners, and that not only was the Report of the said Administrator found to conform to the truth, but also that the bamboo fence had been forced, and that a plate and several small bars of Japan copper were lying on the ground near the hole, and not far from there a gunny sack entirely empty, without it yet being possible to suspect or trace who the perpetrator of that roguery was, although from all the circumstances one had to guess that it was no stranger but a known thief, and that the situation of that Latty was such that one was exposed to such incidents every day, unless permission could be obtained to build a new or sufficient wooden partition beside, or on the outside of, the same; Wherefore His Honour had ordered that the hole should not yet be closed up, but only that a large chest filled with copper be placed against it, in order that the Regents, if they wished to assure themselves of the truth of the matter

545 The 21st August The 21st August Considering that whether they might call into doubt the necessity of that work and on that account raise difficulties in granting permission for it, they could be convinced with the documents, thus submitting to the consideration of the assembly whether one should not at once address them to obtain it, and what ought to be done if they, of their own motion or according to the pleasure of the English gentlemen, should refer us to that nation to request consent from them as possessors of the Castle. Whereupon, after deliberation, it was unanimously maintained that this latter course—as containing a tacit recognition of the English Company as Governor of the Castle on behalf of the Mogol, notwithstanding the written promise recently obtained by them from the Chancellor of the Empire, Faas Uddien Chan, that he will soon provide them with the necessary patents of confirmation, as well in that capacity as in the character of the Admiralty of the Empire, which they have also appropriated to themselves—ought for no reasons to take place, unless express orders thereto should be received from the Fatherland or from Batavia; but that in the meantime our equality with that nation ought in all respects and on all occasions to be publicly maintained, without even by an unseasonable silence giving cause to think that one would cede a thumb's breadth thereof; and that this is such a reasonable matter that in case of refusal one has the greatest right in the world to protest against it, and to let all the consequences that have already resulted from it to the prejudice of the Company, and may further result, remain for the account and responsibility of those who prevent us from employing the necessary precautions against it. 0 549 The 21st of August Report regarding the garbling of 20 chests of spices through which at best a boy of 10 to 12 years, but no grown person, could have crawled; that we, inspecting the opening from inside and outside, found that the earth appeared to us to have been freshly disturbed, so that it seems very probable to us that the aforesaid hole was made that very same day, which could have occurred all the more easily since the aforesaid space between the catty and the adjacent structure is situated a little to the side and not along the usual passage, exits at the rear end outside the yard, and is also only provided with bamboos, as said, because the wall formerly standing there collapsed from old age long ago and no new one was permitted to be erected in its place. What adds even more probability to that presumption is that the Assistant Keyser, stationed at the warehouses, declared that he had inspected the patty that morning according to custom and had seen or noticed nothing; that we also found the aforesaid bamboos on the outside rather disordered, and a large hole in them; that we found lying inside the patties right in front of the made hole a plate of Japanese copper, and one of the bags in which that metal is kept cut open and completely empty, as well as some bars of Japanese copper lying loose in the latty, so that, by all accounts, something of it will likely also have been stolen.
