Subsequently, deliberation having been held regarding the means to indemnify the Company in this matter, and considering that if one wished to act with the broker strictly according to the rigor of the law and have as much of his immovable property sold by execution as is required for the satisfaction of the Company, the same could only be effected through the help of the Broach Regents, at which time all the other creditors of the broker would undoubtedly also come forward, and the Company would only enter into concurrence with them, so that the broker, because according to the ordinary course of matters of that nature in these countries the Regents generally fare best from the debt claims that must be satisfied through their intervention, would be thoroughly ruined, without one daring to hope that the Company would be paid in full, as on the one hand one cannot know the general total of his debts, and on the other hand it is an established truth that goods sold by execution

The 14th June What was recommended to the factors concerning the collection. for the security thereof, give the Lodge, with all his other real estate, in amicable mortgage to the Company, with the explicit clause that, if the Supreme Indian Government should approve these measures and the Broker remains in default in the fulfillment of the above, the Honorable Company shall be fully authorized to sell the Lodge for whatever it may fetch, or to retain it in ownership, not for Ro/a 25000: or ƒ37500:—:— at which the Broker claims that building has been appraised, but for a sum of Ro/a 10000:— or ƒ15000:—:—; but in case it should not please Their High Excellencies to consent to the foregoing, that the Contract shall then be null and void, and the Company shall have the right to sell the said Lodge forthwith to the highest bidder, along with as much of the other real estate as shall be required for its satisfaction. And it was also agreed to recommend to the Employees to put the above into effect without the least loss of time, and to order them to see to it that the Weavers and Dyers precisely pay the promised Ro/a 1500:— or ƒ2250:—:—, in deduction of what they owe the Broker on the present collection, to the benefit of the Company, as well as to clarify to this Ministry whether the returns delivered by the Broker for the present collection, to an amount of ƒ1798: 10:—, have actually been accepted and thus are valid in the Account or not! 232. Against which it was argued that, although no one can deny that every country has its own particular laws and statutes to which all inhabitants, whether natives or foreigners, must conform, Europeans in the Mughal lands are nevertheless privileged, and in particular the Dutch Company has been granted its own administration of justice, with all that relates thereto, by the imperial Firmans; that this must undoubtedly also include the drafting of such papers as are here in question according to the manner customary among the Dutch, especially when they concern persons who, like the brokers, are under the Company's protection and acknowledge its jurisdiction, and that it would be a tacit and indefensible surrender of the Company's dearly acquired rights and prerogatives to conform in this matter to the common laws of the land, which might subsequently be drawn into precedent by the rulers and cause all kinds of inconveniences. 243. The 2nd September advanced to Under-Surgeon with ƒ 20:-:- per month. The samples of the Cettere wietas again found very bad, caused by the supplier's lack of width. to Under-Surgeon, and to allocate to him, pursuant to Title VIII, Section 13, of the General Regulation concerning the Promotion of the Servants of the 31st July 1753, the wage of ƒ 20:-:- per month, to serve out for this a new contract of three years, both taking effect today. The further samples of the Settera wiesas requested at the session of the 14th June last, having finally been brought in by the suppliers and inspected in the Meeting, but again being found much worse than the old sample, the suppliers were called inside and shown the visible difference regarding the quality, and also asked for the reason thereof, which they said consisted solely of the required greater width, adding thereto that they saw no chance of delivering better ones if one insisted that those cloths, when finished, which according to the statement had to hold a full 1½ @ in width, as one could easily understand that the same, being made raw at that width, must in the finishing shrink more or less like all other linens, and that the warp, consisting of a certain and fixed number of threads, the linen must absolutely turn out worse if one desired it wider than ordinary, or after finishing as wide as it customarily turns out before finishing, because if one takes yarn of the ordinary fineness, the threads arising from the required greater width must necessarily be warped further apart from one another on the loom, so that the linen could impossibly be as tightly woven as otherwise, and that, if one wished to remedy this defect with coarser yarn, 244. The 2nd September comes, and because of the higher price, to let the cloths stand on the old footing again; still to advance ƒ 37500:-:- on the collection. The Horg De Mosselschulp in place of the lost Chaa, it must inevitably follow from taking coarser yarn that it could not match the samples in fineness. On this occasion, the suppliers requested a further advance of Ro/a 25000 or ƒ 37500:-:- on the collection underway, which it was deemed good to grant them, under recommendation to make speedy progress therewith.
