The 18th November signed, with the Dutch appearing first in the copy handed over to Mr. Price, and the English first in the copy received by the Commander; in this manner: Surat, the 10th November Anno 1760. Surat, 10 November Ao 1760. Cartel or Convention for the mutual delivery of deserters of the Honble United Company of Merchants of England trading to the East Indies, and of the Honble East India Company of the United Netherlands in the city of Surat and its dependencies. Cartell or Convention for the Mutual Exchange of Deserters belonging to the Honble United English East India Company and those belonging to the Noble Netherlands East India Company in the City of Surat, and its Dependencies. We the undersigned William Andrew Price, Esqr Chief for affairs of the British Nation and Governor of the Mogul's Castle and Fleet etc Council in Surat in Behalf of the Honble United English East India Company, and Johannes Crabbe, Esqr, Senior Merchant in the service of the Honble General Chartered Netherlands East India Company, and on behalf thereof Commander of the Surat Directorate, together with the Council here, on behalf of the last-named Honble Company, having maturely considered the many inconveniences and disputes that have arisen between our Governments, occasioned by the Europeans and others making it a practice to desert to the great detriment of that good harmony and friendly alliance subsisting between our Employers in Europe, and which is even more essentially necessary to maintain in these remote parts of the world, and we being desirous of removing every cause that might tend to a disunion amongst us, more especially the principal foundation thereof, have mutually contracted and agreed, and do by these presents contract and agree, that from this day forward, not any deserters whether Europeans or others, properly in the service of our respective Companies, who may desert their colors and apply for protection to either party, namely those in the service of the Honble English Company to the Chief of the Netherlands affairs for the time being or those in the service of the Noble Netherlands Company to the English Chief, shall be received or entertained, but on the contrary be bona fide mutually returned, excepting those whom by the law of nations sovereigns are obliged to protect. In order that our good intentions about this matter may not be disappointed by any deserters from either side who might take the advantage of our not having a Cartel with such contents,

312. The 18th November To request Their High Excellencies' approval regarding this. Findings on the delivered cargo of the ship Duynenburg. the French, or other European Nation at Surat, our intention in that regard may not be frustrated by any deserters from either side who might wish to take advantage of the opportunity, we do contract and agree, that no Protection shall be given to such Deserters, who having left our respective Colours, and being entertained for some Time by that we have no cartel with the French, or any other European Nation at Surat, we likewise contract and agree, that no protection shall be granted to such Deserters, any one of the said Nations, ask afterwards the Protection of the other, vizt. Deserters from the Honble: English Company by the Chief of the Netherlands who having run away from under our respective flags, and being kept for some time by one of the said Nations, afterwards come to request the protection of the other, namely the Deserters of the Honble: English affairs, or Deserters of the Noble Netherlands Company by the English Chief but that those shall be likewise mutually returned Bona Fide, as if they Company from the Chief of the Dutch affairs, and the Deserters of the Honble: Dutch Company from the English Chief, but that such persons shall likewise be returned in good faith, deserted directly from the English to the Dutch, and from the Dutch to the English, And for the faithful, just as if they had directly deserted from the English to the Dutch, or from the Dutch to the English. The 18th November on the Cloves The Nutmegs The Japanese copper in bars The Japanese copper in plates asked what he could bring forward in his defense regarding this, whereto he answered thus: In respect of the 12¼ lb of cloves falling short above the permitted write-off of 2 per cent, that the spices at Batavia were weighed very sharply and accurately, so that he believed the shortage to have been caused solely by drying out and dust loss, as he was prepared to purge himself under oath that all possible supervision and precaution had been exercised by him in that regard, and that neither he nor anyone else to his knowledge had enriched themselves therewith. The same he also applied to the excessive shortage of 34¼ lb, or per cent, on the Nutmegs. Concerning the Japanese copper in bars, on which, above the write-off of 1/6 per cent, there was found short 60 2/8 d, or per cent, and among which two whole chests in the tally, he knew nothing else to say than that this mineral was received neither by him nor by his chief mate, but by the chief mate of skipper De Jong, who had previously been on Duynenburg. Regarding the 101½ lb, or /6 per cent, of Japanese copper in plates delivered short, he referred to what had just been said, adding thereto that he could give no reason for it since the number of chests had tallied correctly. Het zelve paste hy ook op het ercessive Minuwigt van 34¼ lb, of a P:r C:to op de Noten Muscaat. Aangaande het Koper Japans in staven waar op„ E boven de Afschryving van 1/6 p:r C:o ter min bevonden zyn, 60 2/8 d„, of ZuffC: r=m en daar onder twee geheele Kistjes in tel, wist hy niets anders te zeggen, als dat dit Mineraal niet door hem, nog door zyn Opperstuur„ man, maar door den Oppertuurman van schipper De Iong, die eerst op Duynenburg was geweest, ontfangen was, Omtrent de te min uitgeleverde 101½ lb of /6 pr C:o S: Koper Japans in platen beriep hy zig op het evengezegde, daar by voe„ gende, dat daar van geene reden wist te geven alzoo het getal der Kistjes wel was uitgekomen. 316 The 18th of November Banca tin Linseed oil Disposition regarding the shortfalls 11: 3/8 —: Arrack Api Regarding the missing 416 pounds, or 1/8 percent, of Banca tin, he likewise could offer nothing in excuse except that the dunnage, including this item, had already been in the ship when he and his Chief Mate were assigned to it, and that, otherwise, the number of pieces did agree. Finally, he stated with respect to the 61 cans, or 68 1/4 percent, of linseed oil received here short upon the 2 half-aams beyond the write-off, that this was caused by leakage and the bad casks, as during the voyage, because the ship was full, they could not reach them to inspect them. The aforementioned skipper having been dismissed, the meeting proceeded to a formal review of the aforementioned findings, and it was disposed regarding this matter, in accordance with the honorable orders of the High Government both under the General Regulations on Writings-in and Writings-off and otherwise, as shown below. The Junior Merchant Kroonenberg's request to be admitted again into the council satisfaction in that regard, it was thus approved to send a copy thereof to the servants there, and, while expressing the satisfaction of this Ministry in that regard, to encourage them to continue on that footing; and as they report, under the 10th of this month, regarding the countermanded one bale of broad Bherms, that that money had already been advanced to the workmen, and the yarn had been purchased and dyed, they had judged it best to let the work proceed rather than to leave the money among the weavers, as it would not be easy to collect the same upon a later gathering, to reply to them that their decision in that regard is accepted, but that they need not wait for this bale to give timely notice as to when the other return goods for the Netherlands will be ready, in order to be able to have them collected. Which amount was resolved to pass, and to charge to Ceylon by invoice; as well as to have the aforesaid smalschip with rigging, sails, Artillery and everything else belonging thereto, written off the books. And since by this dispatch, no more than one Smalschip, namely the Beschermer, remains here, whereas by the Memorandum of Management two are granted to this Directorate; and the remaining Vessels also do not exceed the number determined there, it was likewise approved to request the High Indian Government in the general Dispatch for Their Honors' esteemed authorization to build another, which may be of greater and better use in this River than the Jonge Suzanna has been. The 3rd of January the loading of the cannon at the gate and bastion of the city, opposite the Company's wharf, could be regarded as of no consequence, since it was not conceivable that they had ever stood unloaded since the English became masters of them, no less than the cannon of the castle and of the other posts they occupy, and that it was very natural to think that these pieces had been hauled down and reloaded according to custom, without this meaning anything else; that this had even happened several times before without anyone reflecting upon it, wherefore, in the opinion of some members, under the present circumstances it should not appear more suspicious than otherwise, and that if any misgivings were conceived from this, they would entirely disappear if one merely considered that the majority of these loaded pieces were not, nor could be, pointed at the Company's wharf; that with the English Chief presently lodging in the garden next to the former Sidi's wharf, it was not surprising that a sharp watch was kept on the latter at night, all the more because the authority of the English in Surat was not yet so firmly established that they would have nothing more to fear, and the discontent of the inhabitants, on the contrary, seemed to increase daily, wherefore it might very well be that some reasons existed for this which were unknown to us and which they did not deem advisable to make public, although having no relation to us, with which the Director fully agreed, and where it was further remarked that, for the rest, it might very well be that the British had an impression that we would not be unwilling to see the castle and the reins of government returned to Moorish hands, and that consequently they did not trust us much, being perhaps just as afraid of us as we are of them; that it therefore appeared to them that nothing in this matter ought to be precipitated, but that one should temporize a little longer to see if one could not discover something further that might serve as a better and more solid foundation for the resolutions to be taken, since, however one viewed the matter, our movements would unfailingly provoke the English into hostility and perhaps have unpleasant consequences. Against which it was represented by the Director that, however it might be regarding the reported indications, the time had nevertheless come that further news of the state of affairs in Europe, especially via Persia, could be had at Bombay, and it was also very likely that the English would be informed of this before us; that the latest tidings we had from the Netherlands were from the beginning of the month of June, when affairs seemed to have come to an extremity and there was a greater likelihood of war than of peace; that almost seven months have since elapsed without our having learned whether the disputes have been amicably settled or are to be decided by force of arms; that if the former were true, they in Bombay would not be so secretive as not to share the received news with us in the entire city, if only to deprive the Moors of all hope that we would ever conspire with them to dislodge the English from here again, but that the deep silence maintained in that regard must reasonably lead one to think that something else lurks behind it; that the proverb is indeed true that one should not wake sleeping dogs, but that our preparations, if any be decided upon, cannot be ill received by any reasonable person, since, if it is war, our duty strictly requires us to put ourselves in posture as much as possible, in order to preserve and defend the Company's valuable effects to the best of our ability, and not be captured and dragged away like defenseless sheep, and if the peace continues, this could not give the British the slightest umbrage, nor entail any harmful consequences for the Company or for us; that even supposing they wished to be uneasy about it, this would, with continuing peace between the respective sovereigns, give them not the slightest right to attack us, besides which they would not dare to engage in hostilities on their own authority, especially if it is true, as is claimed, that they hold us in as much awe as we do them; that, on the contrary, it is natural to think that if our preparations alarm them, they will send commissioners to ask us the reason for it, at which time one will be in a position to reassure them by pointing out that one has no other than defensive arrangements in place.
