Honorable Gentlemen, Together with The members of the honorable Judicial Council of this trading post. Pursuant to and in compliance with your Honors' order of the 23rd of June last, the undersigned court messenger declares on the oath taken upon assuming his office, that he properly, by posting of a summons in common form both at the gate of the Company's lodge and at that of the wharf, summoned the persons of Philip Volhard of Neder-Amstadt, Jan Jacob Perck of Weydenburg, Andries Smit of Darmstadt, Johan Bernard Indes of Granedrep, soldier, to appear in person on the 4th of August last before your Honors' court of justice, in order to properly answer regarding their absence, under penalty of confession and conviction, so that they shall be held guilty of the crime of desertion. However, the summoned parties did not appear in person, which serves as a report from, below stood, Honorable Gentlemen, your Honors' humble and very obedient servant, was signed, H: Ruyteveldt, court messenger. The Honorable Fiscal in his official capacity requests thereupon by edict the fourth default ex superabundanti, together with an act thereof to be made in order to proceed with the indictment; he further serves the indictment and requests justice. The Council grants against the persons summoned by edict the requested fourth default, and at the same time, ruling on the indictment filed against them by the Fiscal in his official capacity, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, our Sovereigns, adjudicates the demands and conclusions of the Fiscal, Plaintiff in his official capacity. 24 J: W: Meuver The messenger declares on the oath taken upon assuming that office that he has duly summoned the defendants in person for the fourth time under the sounding of the bell, by proclamation and affixing of a fourth citation ex superabundanti, reading as follows: Inseratur. Yet that the defendants have again failed to appear. The Honorable Officer, Plaintiff, requests both the fourth default ex superabundanti against the defendants, and that a record thereof may be made to serve with the statement of claim, and further submits his statement of claim and requests justice. The Council, having granted against the parties summoned by edict the requested fourth default, and at the same time, ruling upon the statement of claim submitted against them by the Officer, Plaintiff, in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, our Sovereigns, adjudicates the formal claim of the Officer, Plaintiff; and accordingly declares the persons summoned and in default, by virtue of and in penalty of the defaults obtained against them at the sessions of [illegible] October, likewise 10 and 24 November of this year, deprived of all exceptions, declinatory, dilatory as well as peremptory, together with the defenses and answers which they, appearing herein, might have put forward and made; furthermore condemns the same, each individual for himself, to perpetual banishment for the rest of their lives from the jurisdiction of the Dutch East India Company, without ever being permitted to enter therein, on pain of being punished by the executioner, if apprehended, with the rope until death follows at the place where one is accustomed to execute criminal sentences; with confiscation of half of their remaining retained wages for the benefit of the said Company; and furthermore condemns them in all the costs, and upon apprehension also in the expenses of justice. The 20th of January Authorization for the purchase thereof as far as is absolutely necessary. The specification of the repairs made to the vessels. giving to know that the time of year has arrived when it is customary in general to tar the vessels belonging here, and that the same are in the highest need thereof; but as there is no tar in the Honourable Company's stock, he requests to be strengthened in this regard by Your Right Honourable's respected order, in which expectation he has the honour to subscribe himself.
