Abaad, Nicolaas Hermanus De Wind; the bookkeeper and office clerk of His Honor, Stephanus van Niekerke; alongside the assistants Van den Bosse, Holmberg, and Essing; out of all of whom the first named, De Wind, was elected by plurality of votes to first clerk, and the offices annexed thereto of secretary of the Council of Justice and sequester; but on which occasion the secretary of this assembly, Rusperti, protested against this election, declaring the said De Wind unqualified for that service, and also that he did not wish to be held responsible or be surety for his work, requesting a note thereof in these records, which was granted to him, and at the same time it was decided to cause De Wind to provide sureties in the capacity of sequester. 297. The 1st of December Arrival of the ship Slooterdijk. The formal deliberations regarding the letter of the Right Honorable Gentlemen are postponed. Members to whom it was circulated for reading. Underneath stood: In the Dutch Office of Surat, on the day aforesaid. Was signed: S: Drabbe, P:s Kellij, G:d De Jonge, M:r J:s Bosman, J:s Panderus, W:m Blaaukamer, O:o H:k Ruperti, J:n Oudenhoorn, and L:t A: van Jeger. Wednesday, forenoon. The 8th of December, Anno 1762. All present, except the Junior Merchant and Secretary of this assembly, Otto Hendrik Ruperti, on account of indisposition. The ship Sloterdijk having arrived yesterday at this roadstead, and the skipper Ian Siewers having delivered the packet of papers to the Director this evening, His Honor convened this meeting to open and read the same, which was found to contain the formal favorable reply of Their Right Excellencies, together with such appendices as Their Excellencies were pleased to send us for our information, and which agreed with the accompanying inventory. All of these papers having been read with the required attention, it was deemed best to postpone the formal deliberations concerning the same until later, and because this vessel must be the carrier of the homebound returns to Ceylon, 295 The 8th of December To be dispatched as speedily as possible. On account of the indisposition of Ruperti, the report in question not having been submitted yet, Asked for the reasons, Who defends himself as in the text. Resolution regarding that vessel. it is decided, without the least waste of time, to begin unloading the ship in order to see whether, notwithstanding its late arrival, it can be dispatched fully laden at the end of this month. The report in question, which was spoken of at the session of the 1st of this month, not yet having been submitted, and the Secretary keeping to his bed since that day on account of indisposition, and one commissioner being as accountable as the other, Junior Merchant van Jeger was asked why it was still delayed, since he, as a member of this assembly, knew very well how much it was needed and desired before the ship arrived, which now, by its late arrival and speedy dispatch, has brought its own abundance of work, without the need for it to be interrupted by work that should long since have been completed and which truly requires one to focus all attention upon it. The said van Jeger argued against this that the Secretary had undertaken to draft that report, as he had always been the speaker and is master of the English language, whereby he undoubtedly understood many things better than he, van Jeger, by translation; pulling at the same time out of his pocket and presenting to His Honor the notes which he had kept after the conclusion of each conference. However, since these cannot constitute a complete report, and one remains unable to deliberate on the matter, van Jeger was most seriously ordered to make all haste himself and to notify the Secretary thereof in the name of the assembly; van Jeger, who offered the adjacent notes, was granted his request to have recorded his offered tender of the said notes, and that he therefore believed that the delay was not due to him. Lastly, it was recorded here that the First Sworn Clerk nominated at the session of the 1st of this month, Nicolaas Hermanus De Wind, at the opening of this assembly took the oath that must be taken upon entering that office. The 10th of December treated him disrespectfully and which matter was referred by the Honorable to the meeting Speech concerning the conduct of the aforesaid Secretary forbidden to read by anyone who catches a fever, and that it would be far more detrimental to him to do anything for which he had to employ his brain; that His Honor had thereupon gone to him in person, when, during some exchange of words over this matter, the Secretary, forgetting the respect owed to His Honor, with great fierce bitterness and no less impoliteness, had flatly declared that he could not or would not work, and absolutely refused his service; and that His Honor could do whatever he wished, even if he wanted to appoint another in his place. That His Honor, being neither able nor permitted to suffer this without compromising his office and character, had thought proper to turn the matter over to the meeting for them to judge it, saying that it could not be unknown to the members how many times His Honor had encouraged the Secretary with kind words, and what patience he had exercised, but how, on the contrary, the conduct of that servant had continuously been in regards to keeping his work in arrears, about which alone His Honor complained; how often His Honor had held before him the embarrassment that would arise if, with such a considerable backlog, heaven were to send him an illness, but that this too had not availed; that now, however, that case existed, and precisely at an occasion when the precious time left by the presence of this ship is greatly needed for the dispatch of the papers that ought to be sent over, but which precious time will now have to be spent in clearing up the backlogged work, since without the Resolutions, from which everything must flow, no letters can be written; that His Honor further admonishes the meeting to take note of the inconveniences that such delay entails with respect to the administration and further service of the Company, of which, as it is daily demonstrated by experience, he will make no detailed account, but requests the Council to take closer note of the report of the Honorable Secunde inserted in the session of the 1st instant; that the Secretary, not content with causing him continuous displeasure through his sluggishness, has now also been able to go so far as to add insolence toward His Honor, so that His Honor judges it is no longer time to cover up what Their High Excellencies themselves already begin to discover, as can be seen from the sensible passage in Their High Excellencies' most recent respected letter with respect to the backlog of the Resolutions and the failure to send them; that certainly the Secretary will plead his illness against this, but that this does not excuse him in this case, since it only began after the first of this month and thus nothing has fallen into arrears in that time except the drafting of the Resolution of that date, but that his Resolutions stand in arrears prior to or since the 24th of March, and thus for more than eight and a half months, which cannot be attributed to any illness, not counting the aforementioned report, which does not concern him as Secretary, but nevertheless also provides proof of sluggishness, about which one had no small reason to complain at all times, and especially during the occupation, and which His Honor says he cannot fathom whence it arises; that meanwhile, regarding the inconveniences as complained of in the abovementioned report of the Honorable Secunde, His Honor was addressed first, and it would ultimately come down to everything falling on His Honor's responsibility, because people would say that he had not held the Secretary to his duty; that therefore the interest of the Company and the necessity of preserving everything from ruin had caused His Honor to determine to assert the character of Director, which he had always willingly changed into that of a friend when admonishing the Secretary regarding his work in order to avoid all public scandal; and finally that His Honor considers it highly service-requisite and necessary to make a change therein, declaring at the same time how much it goes against his feelings to have to propose to the meeting to excuse a man who possesses great abilities for the Secretariat from that office on account of his incomprehensible negligence, and to appoint another in his place. The Council, having heard all this with attention, and being convinced of many matters, first thought proper to commission two members to go to the Secretary and inquire of him whether he maintained what he had said to the Director, and why he did not settle his work; and appointed for that purpose the Junior Merchant Sanderus and the fellow Junior Merchant and Cashier Oudenhoorn. The 10th of December as in the text Consequently, upon being informed of the result of the conference held, the said Ruperti had taken that news very much to heart, complaining that this resolution taken regarding him was very harsh, and had reiterated once more what he had said to the Commissioners Sanderus and Oudenhoorn, and that it appeared to him to be an act of the utmost severity, particularly since, following the report received from the secunde on the 1st of the current month, they had not proceeded against him in such a manner when he was present, yet had now proceeded to this decision when he was sick and unable to defend himself orally or in writing; that the said Blaaukamer having shown him earnestly how very much it was his own fault that they had been forced to adopt such a resolution, and that he could not understand for what reasons Ruperti, through such negligence regarding the work of his department, had wished to give occasion for this, he had fully confessed that this, as far as the resolutions were concerned, was his omission, and that in his capacity as Commissioner with respect to the report in question he could only say that in a matter so delicate, so detailed, and of such weighty importance, he had not wished to omit or overlook anything that was accurate and pertinent to the subject, as a result of which it happened that, after having written something, upon reconsideration of his thoughts he had frequently had to cross out what had been set down and rewrite it, which had wasted much time; that he took the disposition taken very much to heart and foresaw very well how harmful it would be to him, not only in advancing his further fortune, but also to his health; that he therefore requested that the said final disposition concerning the secretariat might be annulled, and solely, because he certainly found himself unable to work, someone might be chosen ad interim for that service, promising not only to resume his work upon the recovery of his health, but also in the future to pay better attention to keeping the same up to date and whatever else depends thereon; and that since the Council had seen fit to dispose so severely concerning him, he would do everything that his strength permitted him, and more, in order to cause that disposition to be mitigated, namely, to dictate what was still missing from the report even though it should hang together like knotted sand, since he disliked seeing anything come from his hands that was imperfect, which, besides his weakness, was also one of the reasons why he had said he could not dictate, but that he would now have to comfort himself, as it could not be otherwise, because his ideas were very muddled through the loss of his health and strength; and that he had finally requested the said Blaaukamer to present the above to the Honourable Lord Director in his name. The 10th of December Opinion of the Fiscal De Jonge and the Broach Factor Sanderus in the meeting The meeting having heard all this, and having reconsidered the decision of this morning concerning the reasons for the dismissal of the former secretary, and having pondered everything that could serve the matter, the Fiscal De Jonge and the Factor of Broach Sanderus voted alternatively; namely, that one should persist in the decision taken, or else elect someone ad interim, provided that for the future a restriction be prescribed for the secretary, to which he shall have to adhere strictly, whereupon, in the event of non-compliance therewith, one could always resume the same measures of today, and Ruperti would retain his respect; but since reasons also militated in favour of a contrary opinion, those two members declared that they would align themselves with the majority of votes and the final decision of the others, which resulted in persisting in the decision of this morning, for the reasons of not paying much heed to Ruperti's promise, because after similar promises and protestations made, they had seen him lapse into the same fault repeatedly; that they considered they had tolerated such various mistakes from him long enough, and that his conduct gave reason to suspect that he imagined that they did not dare to tackle him, and that everything depended solely on his abilities, which they felt they must now show to be otherwise, and that through provocations one could lose one's patience, and finally that the die was cast, and the decision taken, which should have been taken long ago. Their Right Excellencies demanding a report as to why 577 7/8 lb of fine cinnamon remains here, which was supposed to have been received from Batavia as early as the year 176 1/6, with orders to send that bark to that capital if it cannot be sold for 130 stuivers, it is decided to serve in respectful answer that, as appears from the Resolution of the 8th April of that year, this parcel was recalled from Ahmedabad in the year 1758 because it could not be sold there, and was retained here to serve for gifts and the permitted emoluments, since we are no longer provided with any cinnamon from elsewhere, whereby that spice has also already decreased to a remainder of 453 1/8 lb; further, concerning its shipment to Batavia in case it cannot be sold for the aforementioned price, this having been discussed, and taking into consideration against that order the absolute necessity of having some cinnamon in stock, both to serve for the annual and ordinary gifts and to oblige the Government whenever it requests some of it, as well as for unexpected donations, just as from that above-mentioned remainder 10 lb was recently sent to the Prince of Kutch, these reasons were judged weighty enough to decide to retain the same, unless Their Right Excellencies should be pleased to reiterate their order for the dispatch of the remainder that will then still be here. And as, according to the Register, the Extract Resolution concerning the artillerymen was not sent along, the business regarding what was prescribed therein must be suspended until its receipt. Right Honorable Commanding Lord and Esteemed Councilors! B. Tyken. Since now the said returned sailors have reported the foregoing to the family of the deceased, the same have been to the undersigned, absolutely demanding the chest and that which was inside it, saying they well knew that the said sarang had possessed more than 700 rupees in cash, besides that which was unknown to them, further declaring that they will not tolerate that any man of the aforesaid crew receives a single paisa of his earned wages before and until they are fully satisfied or provided with a writing upon which they can rely. And since the extortions daily inflicted upon him by these people on this account are unbearable, he requests that Your Right Honorable please indicate to him a means whereby a speedy end may be made to this troublesome matter, as well as to authorize the undersigned to secure the aforesaid family in such a manner as Your Right Honorable shall think fit, that they will obtain what is guaranteed to them. Awaiting Your Right Honorable's esteemed disposition, he has the honor to subscribe himself as, below: Right Honorable Commanding Lord and Esteemed Councilors; lower: Your Right Honorable's humble and very obedient servant, was signed: J. Syken, 366 The 30th December To authorize him to answer for that estate, and to make the said request to Their Excellencies, and to write to Ceylon and was estimated by them at the value of 500 rupees, although some native sailors declared under oath that there was no more in the chest than the goods specified in that report, regarding which said Drabbe requested orders. This then being deliberated upon, it is resolved, as one must indeed yield to those people in this case, to authorize the said official to give a certificate to the families of the said sarang that the proceeds of those goods will be paid to them as soon as news thereof shall have been obtained; and that one shall write about this to Their High Mightinesses, and at the same time request that Their High Mightinesses please issue orders that upon the decease of such people, their estate not be sold, but delivered to Surat in order to be handed over to their heirs or those having a right thereto, and thus prevent all inconveniences and hitches and the vexations of those seamen, which to our regret become ever greater and more frequent; and one shall also write to Ceylon per the ship Slooterdijk about this affair, in order to be informed how much that estate yielded at sale, so that provisionally that amount may be paid to the heirs.
