The 24th of October For the present with nothing other than Points of reply to Brootchia and has shown so much politeness to the Company to offend him directly, to answer that they had hoped to obtain the orders of His High Excellency the Governor-General a few days after the receipt of His Highness's letter, but that they still look in vain for the ships, and yet, not daring to delay any longer answering His Highness's express compliments, have dispatched the outgoing letter solely to serve to request the continuation of His Highness's favorable sentiments. After which were reread the letters received from Brootchia, containing an apology from the factors for the late notification of the news of the arrival of the English before the Brootchia river, which mainly consists in this, that they already had our orders how to conduct themselves upon the appearance of vessels of that nation before the city, but had not dared to share any news based on loose rumors before they had secure report, so as not to cause us anxiety through premature writing; with which excuses it was deemed proper for this time to be satisfied, the more so because the arrival of the English had no further consequences, while regarding the difficulties that the factors make concerning the work of the collection, to which has now been added a great dearness of textiles because the Mocha and Jedda merchants buy up everything without distinction, through which the workers can hardly be kept at our looms, they shall answer that they hope well that these and other obstacles will not be of such detrimental consequences that the outcome of the collection presently underway would not answer to the expectation that one has thereof. 21 November having been sent previously to Batavia on 14 August, having yielded a loss there upon sale of f613:3:-, and such having to be borne by those who have kept the goods, which it appears have already lain in the warehouses since the years 175 2/5 and 175 5/6, for longer than three years, because for the reason mentioned here beside it is contrary to good housekeeping to let goods lie unsaleable for so long, it was therefore approved, in dutiful obedience, to have the said sum compensated by those to whom it falls, which was judged to be no one other than the Chief Administrator and the Warehouse Master, for the reason that the latter is obliged to report daily to the former not only on the quantity but also the quality, after which it is the duty of the Chief Administrator to attend to the matter, and because this appears to have been neglected on both sides in this case, and those goods, as said, have already lain in the warehouses since the book years 5 2/5 and 5 5/6, that that loss be compensated by the ministers named in the text. 21 November As for some woollens, velvets, and a piece of gold cloth, if they happen to run to a loss of less than 50 per cent advance, it was further understood that the present outgoing Lord Commander, having been Chief Administrator until the year 1768, together with the Honorable Malabar Second Jan Anthoni Sweerds de Landas as former Warehouse Master, as well as the present outgoing and incoming Chief Administrators Kelly and Balman, the latter in the capacity of Warehouse Master, each be made to participate for one fourth in the said compensation, and to leave Their Honors the freedom to address the High Government at Batavia regarding this matter. Their High Noble Excellencies having been pleased to answer our inquiry made by respectful letter of 12 January of this year regarding the 75 or 50 per cent on the goods that have lain in the warehouses for three years and are subject to decay, in case they must be sold, that those to whom it falls are obliged to answer for it, and that one must act therein according to mercantile custom, it is therefore understood to obey this in the future, and pursuant to Their High Noble Excellencies' order to have the velvets, woollens, and a gold cloth, specified in the resolutions of 27 December of last year and 6 January of this year, and for which at that time the purchase cost was not offered, sold at public auction for the going rate, and if on average they cannot fetch 50 per cent, to have the deficit compensated according to the order, that is, by those who voted for the retention of the goods, because the goods have been kept for more than 3 years. The cost of 145¼ lb of red sealing wax out of a lot of 200 lb which was procured in the year 1763 by the Company's brokers and packed by the Bookkeeper Jan van Swijndrecht and Assistant Hendrik van der Vloot, the amount of which comes to ƒ 520: 3: -, which according to Their High Noble Indulgences' resolution of the 12th of June 1763 must be compensated by the procurers and packers, because the first-mentioned quantity ran together into a lump and was sent from Ceylon to Batavia, and was there found unsuitable for melting. The Honorable retiring Director says regarding this: That since the packers of the sealing wax only assisted to ensure that the required quantity was packed, and thus cannot be held liable for any damage, as their commission did not extend any further, His Honour had addressed the brokers as the procurers thereof concerning the adjacent compensation; but that they had pointed out to His Honour that the wax was of the best sort, and had been delivered in accordance with the samples shown, and that they therefore could not think that any compensation could be imposed on them on that account, as they could not vouch that the wax had perhaps not been stored in a place where some heat, whether from fire or from the sun, caused it to run together into a lump; that they further requested to be released from that compensation, and if His Honour, as he told them, could not take that upon himself, that they requested the recommendation of this table to Their High Nobles to that end, but that they had added that if Their High Nobles nevertheless pleased to persist therein, they would submit thereto, however hard it fell upon them; but that in hope of a favorable interpretation in that case, they requested that the wax melted into a lump might be sent back hither and delivered to them, in order to lessen their loss by re-melting it, which can easily be done here. The Council, having heard this, judged their request fair enough not to be refused; wherefore it is approved to present the same in the aforementioned manner, and in the meantime to debit the brokers for the charged amount. II. Balanced and 16: 2 434 The 21st of November The adjacent entry shall be charged to expenses of previous years' charges and incidentals. These artillery goods demanding elucidation, one will have the same provided by the Honorable Chief Administrator as soon as the adjacent report has been brought with the ship Ameliswaard by Their High Nobles in an esteemed missive. The incoming Director, to whom this address was principally directed, lamenting the illness of the outgoing Director, and the resulting inability and lack of strength to administer the Directorate any longer, and at the same time being convinced of the necessity of a Head who can personally oversee everything and give the necessary orders and commands, did not hesitate to take that burden upon himself, just as his Honour did during the meeting, without having yet received the formal transfer, assuming the authority and governance and binding the members to the obedience of his commands and the owed fidelity upon the oath by which they are obliged to the Company, until such time as the public presentation shall have been made. The members having affirmed this engagement, and the indisposition of the outgoing Director not allowing him to stay any longer, the incoming Director was congratulated upon the assumption of the administration, and the outgoing Ruler was escorted by all the members from the council chamber to his inner room with wishes for a speedy recovery of his health. Hereafter, the new Ruler ordered the Chief Administrator, Trade Bookkeeper, Secretary, and Pay Bookkeeper to give notice of the resolution of this assembly to their subordinates, so that they may know whom to recognize henceforth as their lawful Ruler; just as this was also announced to the Military Lieutenant, called inside for that purpose, with orders to notify the rank and file of it. After the said affair was concluded, a minute was submitted from the Court of Justice regarding the swearing-in performed in accordance with the political resolution of the 24th of the past month.
