572. 573. 885 26 September 1762 26 September. Resolution to take as guidance the order regarding the ships that are dispatched in January, and to recommend a precise compliance with that command. The points of deliberation regarding the aforementioned rescription being also concluded herewith, and, as a continuation of the business, having initially spoken about the order in the honored letter from the Noble Grand Honorable Lords Directors and Plenipotentiaries of the Assembly of Seventeen for Secret Affairs, dated in The Hague, 25 October 1765, to command the officers of the return ships that will leave the Ganges after the first of January, in order to shorten the voyage, to bypass the Cape, and whenever it is resolved in the broad council or ship's council to put in there, they shall then have to state in that resolution the reasons that moved them thereto; item, depending on the circumstances of the time, to further order the officers absolutely not to put in at the Cape unless in case of distress for the preservation of crew and ship; and furthermore, to give them such further orders as we believe may serve best to bring the ships entrusted to them into the ports of the fatherland; likewise, to provide all such ships that receive this order with provisions and other necessities in such a manner that, apart from unforeseen accidents, a lack of requirements might not compel the officers to a contrary decision; and regarding which arrangement Their High Nobilities, in their respectable letter of 29 July, write to this Ministry that they had issued the order to provision those return ships with everything for nine months, so that a lack of necessities shall not hinder the execution of this order, and for which reason one had also to see to it here that whatever might be lacking from the provisions for nine months due to one mishap or another would be supplemented: so it was, after deliberation, approved and agreed to obey everything promptly, and to that end, besides the separate instructions and sailing orders that were drawn up at the principal place for the officers of the return ships of the second dispatch and sent hither to be handed to them upon departure, to alter and amplify with this order the instruction which is ordinarily given from here; and finally, to issue an extract from the aforementioned letter of Their High Nobilities to the Master of Equipage, in order to regulate himself accordingly regarding what is required and to take care that timely requisition is made for whatever might be lacking for making the voyage. 886 26 September. 26 September 1762 as also regarding the ropes as well as concerning the charges. to observe to do what is noted in the margin Also, the aforementioned High Government commanding, in conformity with what was ordered in a forwarded extract from the Homeland Letter of 4 October 1765, henceforth to report the weight to the Lords Majores upon discovery of a shortage in ropes and rigging; it was thus resolved to demand of the Honorable Chief Administrator and Master of Equipage, with the delivery of extracts, to give the required consideration thereto, and consequently in such a case to cut off one fathom from the heavy or unweighable ropes and weigh it, and then calculate the weight of the rope accordingly. It was also resolved in the future to take as dutiful guidance what Their High Nobilities recommend to this ministry, pursuant to what was written in the aforementioned Homeland Letter under the subject of Ceylon, namely henceforth to refer the charges on the repatriating seafarers to the disposal of our aforementioned Lords Masters, who, in the above-cited letter, give permission that, whenever upon finding shortages one might judge that the ship's brethren ought to be relieved of the charge imposed on them, the reasons serving thereto are then to be communicated to Their Right Honorable Grand Worships and the necessary evidence is to be transmitted at the same time, in order to judge thereon according to the findings of the case. And it is further agreed properly to notify the pay bookkeeper in advance of this arrangement, with the delivery of the necessary extracts. 577. 887 26th September. 26th September 1762. who, being inclined before their departure from Bengal to fill the chests permitted to them with piece goods, may not do so otherwise than from the Company's warehouses, and to that end must address themselves in good time to the Director, who upon their request must give the necessary orders that their chests be filled with patterned goods that are on hand in the Company's warehouses, and that with respect to those who pay for the aforesaid piece goods in cash, at the price for which the same were purchased by the Company, adding only the Hooghly and other charges with which those piece goods are encumbered, and of which subsequently a proper invoice must be prepared and sent in copy alongside the long invoices of the ships' cargoes, or separately, to Their Right Honorable Excellencies, whereupon, on safe arrival in the Netherlands, the linens with which the aforesaid chests are filled shall, pursuant to the Regulation of 9th September 1750, be sold by the Company and the proceeds thereof, after deduction of the recognition money in accordance with the aforesaid Regulation, be disbursed to the holders of the certificates of branded chests; but that, insofar as those goods might be relinquished to one or another who might not be provided with cash and yet would wish to profit from this concession, then besides the purchase prices, Hooghly and other charges, there must also be brought into account 10 per cent for the advance of the money and 1 1/2 per cent for the maritime risk for the outward and homeward voyage, and that then also the invoices, drawn up according to the order mentioned hereinabove, may not be handed over to the seafarers, but must be attached to the long invoices or sent separately alongside the certificates of branded chests directly to our aforesaid Lords and Masters, to such end as is more broadly expressed in the aforementioned extract of the Missive from the Homeland; so it was, after deliberation, approved and agreed to hand over a copy of the extract from the minutes of the resolution in the Council of the Indies dated 24th June aforesaid, with the extract of the letter from the Homeland to the Fiscal attached thereto, and insofar as the filling of the chests is concerned, by way of extract to the Commissioners for the branding of the permitted chests, in order that each of them, insofar as it pertains to him individually, may regulate himself accordingly and take care that concerning the subject which actually gave rise to this 576. 575. 579. 888 26th September. 26th September 1762. To hand over the extracts thereof to the Fiscal arrangement, namely the abuse that to the prejudice of the Company has for some time been made of the permission under the aforementioned Regulation, no complaints may ever occur again; and so that the officers of the return ships may become informed of this in good time, it was also approved to issue some extracts to the aforesaid Fiscal to be published and posted on the respective return ships, as shall henceforth take place here yearly at the reading of the papers concerning the permitted baggage, which are ordinarily published towards the departure of the return ships; as also with respect to what has been ordained concerning the procuring of invoices and the calculation of the charges and percentages, it was agreed to recommend to the keeper of invoices, to whom, insofar as it pertains to him, extracts have been handed over, that he regulate himself precisely accordingly in occurring cases. By an extract from the general Resolutions of the Castle of Batavia of 9th December of the past year, it being enacted that the ship officers who transport the burdens of the head over the Company's naval force, or of the Upper and Under Master of Equipment, whether on commission, or taken over by purchase, or received as a gift, and thus bring them for their own account, must demonstrate their proof of ownership or the administration thereof with a certificate, and, just as at Batavia where toll is levied, pay half the toll; so it was approved to hand over a copy of this to the Fiscal. It was also resolved to register here the permanent order and another extract of the aforesaid date, in the event of complaints occurring from the ship authorities that they are not provided with one thing or another, and especially regarding the equipment goods, not to accommodate them with what is requested before and until the true necessity has become apparent, or in accommodating to observe whether their complaints are well-founded, namely by checking against the inventory that is sent over from the Main Place among the secretarial papers, what the ship or vessel had in stock, and what during the voyage, according to sufficient proofs thereof, was used as required, and with censure of such seamen who have not acted in this according to duty or propriety, as the exigency of matters requires. And whereas it is thereby also ordered, just as at Batavia, where a duplicate set of inventories is delivered to the secretariat, one of which remains in the hands of the ship authorities

Authorities and the other goes over alongside the Papers, to observe this also upon the return of the ships to the outer Offices, it has been resolved to furnish the Equipagemeester with a copy of the aforementioned Extract, in order thus to comply promptly with this last clause of the order. Furthermore, it has been approved to provide the servants at the subordinate Offices with a copy of another Extract dated 10th of the aforementioned month, containing a further explanation and determination concerning the security ordered by Their High Noble resolution of 9 July 1762 for assuming one or another administration, namely that whenever any servant transfers to one or another function, notwithstanding the security to be newly posted, the one previously posted shall remain in force until the Trade books of the current fiscal year, in which such a servant received another appointment, shall have been collated and therein any such upcoming debit items have been recovered or satisfied, but that then also such a security shall expire, even if four years have not yet elapsed since the time someone transferred from such a service to another. Furthermore, as another Extract Resolution of the last-mentioned date recommends and thus also establishes as a firm law, to collect likewise at the outer Offices the payment of Ten Rijxdaalders that must be contributed to the Diaconate in Batavia upon the manumission of slaves, and to have the authorized Secretaries, before such letters of manumission are executed, render account once a year for the benefit of the said Diaconate; and this without prejudice to the maintenance that is moreover required for bonded servants who, upon manumission, are maimed or afflicted with incurable diseases, it is decided to deliver a copy of the same to the authorized secretaries here for information and compliance, and to send a copy for the same purpose to Kassembazaar and Patna. Likewise, as another Extract of the 13th of the aforementioned month of December ordered that everything which must be charged or credited to the ship's pay accounts be noted pro Memoria on the expense account of the ships, in order thus to discover in good time whether everything has been debited and credited in the books, and in case of finding the contrary (for which the defaulter remains liable) to be able to redress this at the main place before the departure of this or that person, it was resolved to instruct the Invoice and Pay Bookkeeper, by providing Extracts concerning this, to observe the necessary punctuality, and to which end the Pay Bookkeeper is ordered from now on, in such a case, to deliver the most exact statements to the Trade Office three days in advance, while whoever can then be convicted of carelessness or negligence shall remain responsible for the harmful consequences thereof. It has been approved to deliver a copy to the Court of Justice and Orphan Masters here, and also to have published here the Plakaat of 24 December 1765, wherein it is established within what time one must institute his action against living persons, or estates of deceased persons, while it is also noted in this that the servants at the inner Offices have also been duly pre-advised of this law by a copy of the same. Furthermore, as an extensive Extract Resolution of 7 February, for various reasons, in the Council of the Indies approved to establish that all persons authorized to make Wills or Codicillary Acts shall take it as a rule and guideline, in case this or that person should institute any other body besides the Orphan Chamber as Executors and liquidators of the estate, or merely as caretakers of the burial, item as guardians over minor Children, to notify such a Testator or Testatrix then that such a disposition conflicts with and runs counter to the intention and desire of the High Government here, which nevertheless permits as before the nomination and institution of other private persons admitted according to the laws of the country. Thus it is resolved to have this Extract also delivered in copy and sent to Kassembazaar and Patna, for the information of those who in this Directorate are authorized to execute public documents, and also to have a copy of the same registered in their Memorial by the Court of Justice of this Office, in order to recall this law also upon resumption and approval of Wills etc. Further, in conformity with the orders of another Extract Resolution dated 15 March 1766, it is understood, given the majority of His Serene Highness, the Prince Lord Willem the Fifth, Prince of Orange and Nassau, Hereditary Stadtholder, Captain and Admiral General of the Republic, etc., etc., etc., to alter the form of the Oaths and to strike out the words as guardians over His Highness after Their High Mightinesses, and to that end also to dispatch a copy of the same to Kassembazaar and Patna. 582.

554. 555. 891 26th September. 26th September It was resolved to deliver to the Curator Ad lites and Sequester an extract from the aforementioned general resolutions of the 20th of the above-mentioned month, determining the salary for the sale of real and personal property, as well as the administration and settlement of estates; namely, to be allowed to charge 5 percent for the proceeds of personal property and 2½ percent for real property, as well as 2½ percent of monies that the Curator ad lites merely receives, whether from the sequester or from skippers or bookkeepers of the ships, or also of cash and incoming evident outstanding debts that were in the estates, for which he had to account and transfer into the Company's treasury. Among the ordinary annual papers, it was agreed also to have published, and to deliver in copy to the Fiscal, an edict of the 20th of June last against the smuggling of spice trees and seedlings; likewise also to have published and delivered, as well as to deliver in copy to the Council of Justice and Fiscal, and also to send to the sub-offices, an advertisement of the same date containing: 1. A regulation regarding the making of coffins and the wages for the same. 2. A prohibition against the sale of children fathered by Christians with their slaves, and 3. A promise of freedom for a slave who has saved his master or mistress from any danger, or has done his best to that end. 597. 897 3rd October. 3rd October. concur. further proposal of His Honourable regarding Lafont to be had on pepper and spices. proposal of the Lord Director, regarding the acceptance of the fine linens reply to be submitted to their High where the Council concurs letter, and to order the same to examine carefully and as quickly as possible serve with a report, how much according to this statement, everyone's share in the compensation amounts to. Whereupon having deliberated, it is resolved to concur with the proposal of the Lord Director. And as the said Lafont, according to the further imposed compensation regarding communication of the Lord Director, by virtue of what was communicated by the Patna servants, in their letter of the 3rd of this month, that he would account for himself here or pay, had not yet satisfied the compensations imposed on him by our Resolution of 12 August and 16 September last; the first on account of the shortage on a parcel of pepper, discovered upon delivery to the merchant, and the other regarding discovered underweight on diverse parcels of spices, upon taking inventory and making transfer to his replacement, the present Chief decision to maintain the same result Rietveld, it is, notwithstanding the verbal request of the aforesaid Lafont, to be excused therefrom, approved and understood, to persist in the previous decisions, but to note here what he has brought forward in his defense, namely to have had the pepper and further spices, upon receipt, reweighed and sealed by Commissioners, and not opened again except in the presence of the same or of these Commissioners, and that the seals at the opening of the pepper bags and spice chests were also found to be in good order, as the Commissioners if required would have to confirm under oath, and finally that the shortage was only to be attributed to drying out and spillage, since he offered to confirm under oath not to have enriched himself directly nor indirectly with the spices; but his verbal while finally also in conformity with the request of the aforesaid Lafont it is resolved, to submit to their Excellencies in the most favorable manner after obtaining information from the Patna servants, who will be written to shortly, to demand a declaration hereupon under offer of oath from the Assistant Willem Cades, as also having assisted at the opening and reweighing of the aforesaid spices, as will also happen here from the other Commissioner the Assistant Pieter van der Sluys, to submit his aforesaid defense to the High Indies Government in the most favorable manner, and to implore relief from the assessment. Also on this occasion it was submitted to the meeting by the Lord Director that the delivery of linens, notwithstanding the price increase granted to the merchants, proceeded so defectively and hesitantly, that His Honour could not imagine anything other than a very incomplete 596. 50 4 599. 898 3rd October. 3rd October. deliberation thereon decision to send the Oranjezaal home instead of Welgeleegen reasons to concur with the proposal and to accept a fourth sort in complete satisfaction of the Fatherland Demand for this year, submitting therefore for consideration, whether one, since the authorization of the Gentlemen Masters at the head of the Demand for the Year 1767 determined on 14 October 1765 to accept unsorted goods if necessary to facilitate the gathering and a complete fulfillment of the Demand seemed to extend generally over all linens, ought not also to proceed to a decision to accept a fourth sort of the fine assortments, which have already come in, and are still expected; since otherwise, as His Honour had already noted, it would be impossible to satisfy the Demand. Indeed, that one had to assume with reason that the first two ships will by no means be able to receive a complete cargo, for the goods this year came in so slowly and in such small parcels, that, even assuming the Charum were also accepted, one will find work enough to properly load the return ships. Upon which proposal having been ripely deliberated, and upon a closer resumption of the Demand with the Lord Director, it being unanimously understood that the aforesaid order could notoriously be taken over all assortments, since the license to accept Charum and Tirti was granted, especially as often as the cases should occur that the sorted goods cannot be completely satisfied, as also, to show that it extended to more than one sort, a little further regarding the reduction of the price it was expected that the same would be proportioned somewhat more to the lesser quality of the goods, as their Right Honourable had experienced regarding the Tirti linens brought in during the past year, and especially among the fine sorts, regarding which in some respects of the Demand, as among others, with the diverse sorts of Cassa Bengale, and the Bethilles Cangam, the acceptance of Tirti is positively permitted, provided the price was reduced somewhat more; so it is, after consideration of decision to concur with that proposal of the fine linens also all this, approved and understood to concur completely with the proposal of the Lord Director, and accordingly of all the fine goods, also to accept a fourth sort, at such prices as have previously been paid for them, since due to the scarcity in obtaining linens no greater reduction could be negotiated, whatever trouble one had also taken for it. Since Welgelegen, being not yet unloaded, cannot possibly be made ready in time for the homeward voyage, it has been resolved, in accordance with the orders of Their High Mightinesses, both by their esteemed letters of the 14th of June and the 11th of July of this year, to assign the ship De Oranje Zaal in its stead, so as to undertake the voyage to the Netherlands together with the Zeeland return ship De Jonge Samuel in the beginning of the coming November month; and thus it is resolved to confirm this and to have transshipped from Welgelegen into the Oranjezaal: 100000 lb pepper and 25000 lb sapanwood, item all the provisions furnished at Batavia to that vessel for the homeward voyage, and finally to deliver upon departure to the authorities of the last-mentioned ship the secret signal letters for the Cape and other instructive papers received here for the authorities of the first-mentioned vessel. Furthermore, it is recorded here that two sufficient natives, by name Ram Moedie and Ram Kionajent, have presented themselves as sureties for the provisional secretary of Justice Pieter Hoff for the moneys that he might receive into his keeping in that capacity as sequester, the deed being drafted according to order with the following content: Today the 29th September 1766 appeared before me Fredrik Thott sworn clerk of the Bengal secretariat, present the witnesses to be named hereafter, Ram Moedie and Ramkinasjent, native sircars here, who declared to interpose in solidum, that is, both for one, and one for both, and to stand as sureties for Pieter Hoff provisional first sworn clerk of police and secretary of Justice here, and this pursuant to the resolution of the High Indian Government of the 9th July 1762, and the deliberations and resolutions thereon in the Honourable Council of Justice here dated 16th December 1763, for a sum of sixteen hundred rupees, so that the Honourable Company might recover therefrom all such actions and claims as might arise on account of his office of sequester during the time he holds it, or might redound within four years after his departure, demise or transfer to another post, renouncing for that purpose quite expressly the benefits ordinis divisionis et excussionis, the effect whereof has been explained to them; further binding for the fulfillment of what is aforesaid their persons and goods under legal obligation: Thus done and passed at Hoegli in Bengal, in the presence of Adrianus Dingshoff and Johan Christoffel Cumme, clerks, as witnesses. Regarding the tin, it is expected that it will be sold for the last fetched price. To pass as further provision. it was resolved, provided his time has expired, to promote to Assistant the soldier Adolf Asschenberg, who is serving at the pen and who was granted Assistant board money by Their High Nobilities in their respected letter of the [illegible], and accordingly to allocate to him the salary of twenty-four guilders per month, under a new engagement of five years starting today. The servants at Patna having shown in their letter of the 24th of September, in reply to our remark in our letter of the 27th of August, that although it is true that when negotiating 30000 Rupees the cash balance at the end of July was still large, on the other hand, payment also had to be made for the saltpetre which they were busy receiving at that time and the charges on which also amounted to something, just as the peshkash had to be paid, about which they were troubled daily, and several other advances, as could be seen in more detail from the transmitted cash account of August and the use of funds shown with the letter; so, considering that these reasons are not unsatisfactory and that the amount paid for saltpetre, with the charges incurred thereon alone, comes to f 70667. 17. 5, and according to the testimony of the Honourable Chief Administrator, after examination made of this cash account, nothing improper was discovered, it is approved and understood both to pass this and that the servants—noting that the cash balance at the end of August was only f 34526. 9. 12, but on the other hand they needed as much as f 157500. —. — for advances on the delivery of opium according to their separate letter, without having been able to supplement this shortfall despite all applied efforts by drawing bills of exchange—took advantage of a favourable opportunity to take up money on bond at the usual interest of 3/4 percent per month, and thus accepted on three distinct bonds and different dates a sum of Sicca Rs. 100000 or f 137500. —. — Upon the servants' inquiry whether the quicksilver may be relinquished at a clean 30 percent, or whether on top of that the 15 percent above the Hugli rate fixed on the merchandise at Patna must also be calculated, it was resolved to write to them that in this regard the same order applies as we wrote to them on the 24th ultimo concerning the vermilion, and that therefore the same, just like this dye material, must be disposed of by them at a 65 percent profit, or otherwise must not be requisitioned. But since it is known that various persons have taken things much too far in this regard, without listening to the warnings that had been given from time to time, His Honor submitted a proposal regarding this matter for the consideration of the meeting, as to whether, before proceeding to the pricing, a positive resolution ought to be taken not to validate the increase on all goods that are not well-proportioned in their sort or among which not enough body was found; but to apply the prices that were stipulated for them at the contracting, or as much less as should be found appropriate according to the quality of the goods. All members having conformed to this proposal, it was also decreed to inform the servants at Kassembazaar of this arrangement in the letter to be dispatched today, in order that they may also govern themselves accordingly. 626. 912 627. 9th October 9th October. which the Members agree to. and to have Extracts thereof issued to the Council of Justice, Vendue Master, and Fiscal. the worsening of the times and the slow progress of the Company's trade demonstrated by His Honour. to have the necessary solicitations made to the Lord Nawab regarding the Boerong Zemindar and others. This having been deliberated upon, what was alleged by the Lord Director was affirmed with unanimity of votes, and consequently resolved to establish from now on as a permanent law, that no houses or other real estate that are already situated under the Jurisdiction of the Company, and which according to the plan mentioned in the secret Resolution of the 25th April of this current year might still come under it, may be sold to anyone other than European residents, whether Company's Servants or Free Citizens. And in order that this good intention may not be frustrated, it was also approved to have extracts hereof issued for their information, not only to the Council of Justice and the Vendue Master, but also at the same time to the Fiscal of this Directorate, both in this his capacity and in that of Village Master. This having been thus arranged, it was further communicated by the well-mentioned Lord Director that, however much His Honour had from time to time hoped for a better and more flourishing progress of the Company's trade, and especially now that not only our previous dispute with the Nawab has been settled, but even after a large expenditure the previous privileges and charters have been as it were renewed by a Sanad of His Excellency; nevertheless, to his inward regret regarding the interests of the Company, he noticed more and more a backward trend, as not only, in a way perhaps never yet seen or witnessed, what is currently observed during the appraisal of goods, namely finding virtually no first-quality goods among the Linens, but as if all the difficulties and hindrances inflicted upon us in the matter of trade by our Competitors were not yet enough, a report had arrived from Boerong that the Zemindar of that district had devised a new trick to cause the work in that Aurung to make even slower progress, as he had demanded from the Gomastas that they should pay the toll on all the raw Linens before and until he would tolerate the bleaching thereof or the transport thereof. Yet, because according to ancient custom, likewise pursuant to the Farmans and the aforementioned Sanad, we are bound to pay the Toll only once at one place, namely at Buxbunder, he, the Lord Director, deemed it advisable to give notice of this to the servants at Kasimbazar, and to order them to have the necessary representations made at the earliest opportunity against this to the Nawab, and to bring it about that the aforementioned Zemindar be ordered to desist once and for all from his unreasonable pretensions and to refrain from causing us any hindrance again henceforth. The officers of the Oranjezaal awarded the premium for a speedy voyage. Insertion of a report regarding the opening of three bundles of mace. Tuesday the 14th of October Anno 1766, in the morning, absent the Master of Equipage Zuijdland and the Merchant Lafont. Initially it was resolved to note here that the Lieutenants Carel Matthijs Willem de Lille and George Lodewijk Singelman, likewise the Junior Merchants Iacob Nicasius De Meyer, Jan Rauwerds, Gregorius Herklots and Jan Willem Salomon van Haugwitz, have taken the customary Oath of Purge for the lawful obtaining of their respective ranks and offices. The aforementioned De Lille, having been appointed as a Member of the Court of Justice upon the proposal of the Lord Director, in place of the former Lieutenant Tissot, and having on this occasion also duly taken the oath framed for that office, such is likewise noted here. The consumption account of the ship Oranjezaal having been submitted by the Senior Merchant and Head Administrator the Honorable Menso Isinck, and subsequently examined closely item by item, it was found good and resolved, after reconsideration of the same and confrontation with the declarations relative thereto and other documents, to pass the same, but to have the surplus provisions, consisting of 1135½ lb salt beef 1709 1/5 lb bacon 24 1/80 jugs of wine 13 7/60 ditto gin, and 15¾ ditto olive oil delivered to the Dispensary here, since those which were provided at Batavia for the ship Welgelegen for the homeward voyage, pursuant to the resolution of the 8th instant, have already been transferred from that ship into the Oranjezaal; to have the nine pieces of surplus Mexicans counted back into the Company's treasury by the Skipper Fredrik Kelger, and to have the remaining ship's clothing issued again for this ship to be employed among the seafaring personnel on the homeward voyage. Furthermore, since the aforementioned ship's officers completed the outward voyage in less than six months after deduction of the lay days, it was found good and resolved, in accordance with the regulation made in this regard by the High Indian Government in their highly respected missive of 29 August 1758, to award them a premium of Nine hundred Guilders for this, to be paid to them from the Company's treasury.
