The sentence passed by the Court of Justice of this Office in the case of the Fiscal R: O: against Claas Bommerie and associates regarding desertion has been approved by the Director, with observations inserted by an act in our Resolution of 30 September, to which we take the liberty respectfully to refer, letting the original trial documents which served against them before the said Court accompany this among the Appendices. Likewise, in our meeting of the 22nd of August, since the Honourable Company's First Broker, Roederam Ruydas, had passed away, we appointed his son, Govenram Roederam, as the Honourable Company's Second Broker. The Quartermaster Dirk Brand, whom we had promoted at the session of the 28th of May to Boatswain in place of the deceased Mighiel Wisman, we have, upon the complaints of our Equipage Overseer regarding his bad conduct, degraded again on the 30th of September to his former rank, and revoked and cancelled his warrant obtained as boatswain. Upon this, on the 5th following, we obtained a short answer; solely from the Council, as Mr. Hodges had in the meantime stepped down, expressing their surprise that we had addressed them to order the Nawab to grant us permission for the transport of the spices, whereas we ought to be aware that they had no such power, but that they, nonetheless, upon the assurance which the Governor and Council at Bombay had given us on several occasions, would recommend to the Governor to be helpful to us in everything, and also in this matter: but as we could well gather from this that this served no other purpose than to stall us again with assurances and promises, and in the meantime to shelve this matter indefinitely, we deemed it advisable to address ourselves directly to the Bombay Ministry, as was executed the following day, laying before Their Honors everything that had happened and occurred concerning this matter, and how we had been misled by Mr. Hodges; upon this, on the 24th of March following, we received an answer 393 that it had ordered its Chief and Council here regarding the Town Governor. We had never doubted that the Nawab would have acquiesced in this instance, the more so because, before the spices were even unloaded, he had solemnly assured us through Wellie Ulla, one of his principal officers, that as soon as the spices were customed, he would see to it that they came outside. But to our utmost surprise, we have had to experience that, far from supporting us in so lawful a matter after a delay of several months, he has finally still not wished to give us any decisive answer. And since we cannot possibly wait any longer, because the spices in the Inner Patthij are drying out and spoiling, and are moreover subject to all kinds of danger of fire and theft, we turn to Your Honours with the very friendly request to kindly lend us a helping hand in this lawful matter, and to order the Governor no longer to oppose the transport of the spices to the warehouses on our wharf. When our ships arrived here in the month of October last, the city governor immediately granted written permission to unload our merchandise, according to custom, at the wharf in the outer town. But shortly thereafter he revoked his given word, and demanding that we should bring nothing outside, but everything inside the town, we addressed ourselves on that account to Mr. Hodges. This gentleman at first seemed to doubt whether we indeed had the liberty to unload and ship out at our own pleasure wherever the Director might think proper. And when we convinced him with the most solid proofs that this is one of our oldest and most essential privileges, granted to us by royal firmans and special covenants of the Regents, and confirmed by long years of usage, his Honor remarked that the privileges formerly obtained could no longer be valid in these changed times. And although we replied to him that in this manner he might well deny all its privileges to the Dutch Company and equate it with the lowliest unprivileged merchant found in the town, but that he was judged entirely unauthorized to do so, since Mr. Spencer with his Council members, by letter of 18 February 1759, and your Honor, by a subsequent letter of 25 January 1765, had guaranteed us all privileges, not simply those which we then effectively exercised, but also those we had ever obtained, he nevertheless paid no further heed to it, except that he finally agreed that if we would bring the spices and the Japanese copper into the town, we would then be allowed to unload everything else outside. And this compelled us to make a resolution to let the ships lie in the roadstead with their full cargo until we had addressed ourselves to your Honor and obtained an answer thereto. We even sent the vessels that were already lying before the wharf with merchandise back to the ships, and we also let the captains return to their vessels. However, the city governor, hearing this, immediately sent his confidant Walli Ulla to us with this message: that they should not stop the unloading, but might safely bring all merchandise to the wharf, except the spices, which were first to be unloaded into the inner Pathij, but promised that they would also be brought outside again as soon as they were sold; and since he, with the consent of Mr. Hodges, also had that same assurance given to the Director, we did not wish to trouble your Honor with our grievance, but rather yielded and brought the spices into the inner Pathij, in the trust that the promise made would be fulfilled. But Mr. Hodges having in the meantime been removed, we yesterday received a letter whereby the Council members, as appears from the copy which we likewise enclose herewith for your Honor's consideration, explicitly declare that they have no power to order the city governor anything. And although this seems exceedingly strange to us, as until this day we know no better than that the Castle Governor is, according to the customs of these lands, always regarded as the judge in the disputes that sometimes arise between the merchants and the city governor, we nevertheless thought it best not to answer that declaration at first, but much rather to address ourselves directly to your Honor, with the very friendly request to kindly lend us a helping hand in this matter, and to order the city governor that he may grant us permission for the transport of the spices to the outer town. We have also resolved, for the present, not to place two persons there, but only him alone. And since the reasons that move us to this are, according to our thoughts, so sound that Their Right Honorables will certainly approve of them, we hereby notify You thereof, and we request You to adhere to this resolution of ours concerning Masquette, and for that reason not to add any other person from Your clerks alongside him.
