in proportion as kapok became cheaper, would decrease, without agreeing to the condition which the petitioner at that time desired, namely, that [illegible] would be taken into account against it. But in the meantime, the delivery proceeded so sorrowfully that, as stated, with the first return ship one had been able to dispatch nothing else than that which, besides some Patna linen, had come in before the departure of the ships in January; and it nevertheless became high time, day by day, to turn thoughts to the dispatching of the others, which one wished to have follow in January. Meeting together on 1 December last, the Director already pointed out to the members the fear he had that there would be nowhere near enough goods on hand to provide another two with a proper cargo in due time, given that at that time not a single piece of fine, and only very little coarse linen—among others some Boerong Chassa—had come in, and the entire stock of returns pro patria, with what was on hand from Kassembazaar and Patna, amounted to no more than roughly 10 tons. He therefore proposed whether it would not be advisable that one, following the example of the English and French, did one's utmost to help the Company as much as possible with its requirements by buying up goods from private traders, and in order to succeed therein as required, to follow the market with them, even though, as every member of the assembly was convinced, the prices they paid were so excessive that they, even with the increase granted in A.o 1766, differed by a good per cent to the worse. That although he considered this to be the only means to facilitate the collection and to be able to let two more ships continue their voyage on time, he nevertheless did not judge it very acceptable, and therefore submitted it beforehand or as a matter of importance to the members for their attentive deliberation. Deliberating thereon, we accurately weighed and considered everything that could come into consideration, and, although the circumstance in which one found oneself was indeed of such a hopeless aspect that one already had less than a change for the better to expect, and the aforesaid proposition thus seemed to be the most plausible means to meet this adversity somewhat, we nonetheless judged that one is too strictly bound to the orders, and would thereby expose oneself to too great an accountability, to proceed to such an extraordinary step without prior positive authorization, and therefore chose rather to bear the inconvenience in which one was, than [illegible], and to refrain from the proposed buying up, to which the Director also conformed. Nonetheless, by virtue of our resolution taken on that day, we take the liberty to present the above to Your High Nobilities, as is also done on this occasion to the Gentlemen Majores, with the humble request whether, because of the slight prospect that the collection of returns will improve for the present without a necessary redress of affairs in Europe, it would not be highly advisable in such unfavorable times to follow the example of others, namely to resolve upon such a purchase when one sees that there is otherwise no possibility of obtaining the required linen; at the same time imploring a favorable approval of our resolutions taken on 27 March, 14 May, and 9 October last, directly concerning the linen trade. The first, to accept on that for this year all such assortments as were ordered on the previous year's requisition, but only arrived after the departure of the ships or might still arrive, notwithstanding that the price for them might be determined to be lower, since we judged that it would fall hard enough on our suppliers to take back those articles of which nothing was requested this time, and that the determination made specifically regarding the Karra dherrys lq: 20 Cob os and the assortment entirely of blue stripes includes a restriction that is not so general that no exception of time and circumstance should be allowed in that regard. On the 22nd of September past, a petition was submitted to our meeting by the present Gunny Supplier Kammenaatseet, containing a representation of how he, the petitioner, found himself aggrieved in drawing up the Memorandum of packing for the book year 1765, because his predecessors, having continued therein on the old footing and having neglected to request any change in their favor, must absolutely have suffered damages, because, in comparison with earlier years, it differed considerably, as firstly more pieces are placed in a package than formerly; and secondly many of the fine linens were packed in chests or between planks and sent with them, and then sewn around with only a single Gunny, after which practice having fallen away, the same were sewn around with double Gunny for better preservation; that formerly, wax cloth was placed around even the coarsest goods and now no longer, whereby they also had to be supplied that much more sufficiently with Gunny; that besides all this, through a general deterioration, there was also a considerable change for the worse in the condition of the Gunnies, which currently turned out so thin that the wrappings of the packages were doubled; for which reason he, the petitioner, requested to be permitted to bring in as many Gunnies and as much Rope for the service of the cloth hall as are actually used, and for which the first and second in the said packing hall would then also have to sign, or else that he shall only deliver as much Gunny and Rope into the cloth hall as should appear necessary there upon a receipt from the First and second, and without him then having to concern himself further with the packing or the bringing in, just as took place regarding the consumption in the Trade warehouses. would be charged so much more, and for which they qualified the invoice keeper, just as the first and second in the cloth hall were also ordered to hand over to the petitioner a receipt or discharge for what was actually consumed, in order to be able to account for themselves with it in due time. At Kassimbazaar, according to what was communicated by the servants in their letter of 23 April last, the suppliers of coarse linens raised virtually the same difficulties as the merchants here locally, and were not willing to declare themselves positively regarding the prices, because they were still in uncertainty concerning those of cotton, and also did not know whether the obstacles that arose in almost all weaving locations would permit providing good cloths and the required quantity. However, they nevertheless offered to contract provisionally at the prices of the previous year, provided they might have the freedom, if cotton were to become more expensive, to present their grievances further, and that in such a case they would not be bound to the fulfillment of the contract; against which the servants had stipulated, as a fair condition, that upon a decline in the value of that cotton they would have to drop the 9 per cent enjoyed in the year 1766, or as much as reasonableness entailed. And on which condition we, according to the decree of the 28th of the said month, instructed the servants to simply proceed with the contracting, just as, according to their advice of 8 May, it took effect with cash advances of the usual 85 per cent. And since the servants, in their first-mentioned letter, also showed how in the demand of returns for India dated Batavia in the Castle 12 July 1766, there were requested five packages of common bleached Kassimbazaar salempores no. 376, 2 ¼ cobidos per package, or 80 pieces, not higher than ƒ 474:- with all charges, and at which price the piece, including the charges, came to stand at ƒ 5:18:8, whereas in the year 1764 the awwal of this linen had cost over there ƒ 7:4:11¼ per piece, thus excluding the charges ƒ 1:6:3¼ more than the aforesaid determination; and that to this was now also added the 9 per cent increase granted on all coarse linens, without any appearance of any change for the better; we therefore, on the 28th of April aforesaid, upon the servants' declaration of not being capable of fulfilling that demand, were indeed obliged to resolve to excuse the procurement of this linen. With the delivery of the contracted quantities, matters went not much better there than at this office. On 15 August it was communicated that there was still nothing certain to report, as things went in the weaving places of coarse goods as in all others, and the complaints of the gomastas about the coercion and hindrances that occurred therein did not cease. In addition, the price of cotton was not yet fixed, and one could therefore make no firm calculation on the weaving. Also, for the first shipment to the Netherlands, not a single piece was received from there, and that which was dispatched on the 22nd past consisted of: 1700 pieces ordinary bleached doosooties 600 ditto ditto raw 4300 pieces dungarees of 27 cobidos 370 ditto of 32 ditto, the latter as a sample which the chief—having found in the remarks on the linens to be procured for the year 1756 that the Gentlemen Masters considered it a good thing if they could be made and supplied of the said length—had caused to be manufactured and obtained, and which the servants, since they had turned out well, had accepted at a proportionate price among the others in reduction of the demand and dispatched. The finding of the aforesaid goods stands recorded in our resolution of 31 December, when we—upon the servants' further representation that the suppliers had repeatedly complained of their distress over the increased costs, and that this time, despite the 9 per cent that had been granted to them, as said, in the previous year, they could scarcely cover their expenses, and for which reason they, although in vain, had repeatedly, and at the delivery with more emphasis, insisted on an increase—approved that the servants had granted them the first-mentioned increase, considering that the goods surpass those of the previous year in quality. Since then, there has further been received from there: 255 pieces raw doosooties 400 pieces bleached 1225 pieces dungarees of 27 cobidos 92 pieces ditto of 32 ditto, with a notice that approximately 1100 pieces are still missing from the demanded lot of linens, which were expected from the aurungs and which the suppliers requested might also be accepted upon delivery to serve for the year. Which was agreed to by us. And we, according to what was recorded in the resolution of the 8th of this month, found the above-mentioned linen of no lesser quality than the preceding. From Patna, where, as was communicated to your Right Excellencies on 31 March, a contract was concluded in late January, reports have continuously also been accompanied by hindrances and difficulties regarding the collection on the part of the English, the servants having by a letter of 22 September (concerning which, since the original, as appears previously, has gone missing, and no other papers relating thereto have as yet been sent to us, we have not been able to demanded

under promises dutifully to observe their recommendation to send nothing above or beyond the Demand: the Cassimbazar servants having been instructed, in reply to their inquiry by letter of 23 April last, whether any other fabrics had to be procured for that office besides the 50 pieces of restas and 50 pieces of Sjoukodas petitioned for in the Demand, not to have any others made, but to use every endeavor toward a timely and prompt fulfillment of these. Your High Noblenesses' arrangement to handle the article concerning the Opium Trade henceforth by general letters in the future we shall promptly comply with, and we have immediately informed the servants at Patna of the remarks regarding the latest collection, as well as the determination of the Demand for the Year 1768 at 500 whole and no half chests, and sent them the necessary Extracts for their observance. Before proceeding to the report of what has been accomplished regarding the collection for the Year 1767, we shall first cite our considerations and the servants' defense on various points. The first that presents itself to us concerns the Extract sent to us from a separate letter of the Coromandel Governor, the Noble Lord Extraordinary Councilor of the Indies Pieter Haksteen, regarding the importation and sale of Opium by the English at Madras at 320 to 340 Rixdollars per chest, as proof that that Nation seems to manage to obtain that poppy juice at civil prices, and which therefore should form no less a point of attention for us regarding those that are charged to the Company's account. We declare ourselves unable to explain ourselves properly regarding this, since the opium is also worth different prices according to the different districts where it is gathered. At least the Poorania opium, of which nothing is purchased for the Company's account, is nowhere near as virtuous, but also by no means as expensive, as the Behar opium. It shall nevertheless be our principal care to answer Your High Noblenesses' intention as much as possible, and especially to admonish the servants at Patna that the required 500 chests for the Year 1768 are procured, and are virtuous wares at Civil prices. Yet according to our understanding, the reduced purchase for the Company's account will contribute little thereto, in comparison with the large quantities that the Country produces and the multitude of Enthusiasts, according to which one must accommodate oneself somewhat in order to master one's needs. However, those of Patna have been warned of the penalty that Your High Noblenesses have set against the acceptance of bad and expensive goods. For the arrears of the collection for the Year 1765/66, the Company has, according to the communication from Patna of 3 April last, been indemnified, and the servants have also been informed regarding the advance disbursements to be made; and regarding the remark of Your High Noblenesses, as if these weighed significantly on the trade if the money had to be borrowed for it, we can assure that there is no other remedy if no bills of exchange can be obtained, since this Trade must be kept going by continuous advance disbursements. That which Your High Noblenesses desire to be observed in the future, if any misfortune should happen again to the descending Opium, shall serve us as a guideline, having for the rest no more to report in reply on this matter than what the servants at Patna present in their special defense against the displeasure of Your High Noblenesses over the quality of the 738 chests of Opium recently sent, in their letter of 13 November last. The chief Rietveld and the Secunde Hardy, who had the management thereof, testify that it grieves them not a little, after so many efforts they had made in this regard and after having put into practice everything possible to obtain good and virtuous Opium, nevertheless to see that all their actions had not been able to gain the approval of Your High Noblenesses. Assuring us, with the request that this might be presented to Your High Noblenesses in the most favorable manner for their discharge, that they did not lack any attention, and that in this point they sought to observe their duty with as much accuracy as was ever possible for them. That they also dared to say that the Opium sent by them was of as good a quality as was produced in the Year 1766 by the Province of Behar; and finally that they would never slacken in their diligence and meanwhile flattered themselves that the juice gathered in the past Year is of as good a sort as could be found anywhere. was passed on the 29th of the same month, with an expression of astonishment at the complaints which had meanwhile been made by Mr. Rumbold to Governor Verelst regarding Chief Rietveld, and which had been communicated by the latter to the Director, namely that he sought to make an abuse of the granted license or freedom in this trade, by having the opium fields partially staked out with small flags and seeking to appropriate the crop thereof, with a recommendation to avoid in future not only such extravagances, but everything that could give any cause for estrangement, the more so because such conduct might easily be the cause of bringing the concluded convention to ruin, with the warning that, as this would be altogether unpardonable and unjustifiable, the servants might be mindful that upon further occurring complaints commissioners would be sent upcountry to investigate matters, for, although one could not precisely put them in the wrong, one could nevertheless not contradict anything, nor justify their actions, so long as their innocence did not become fully apparent. But meanwhile, before an answer to this arrived, two letters from Pattena of 21 April and 18 May were delivered here one after the other. In the first was found, besides a statement of their efforts for the promotion of this trade, that of the hope that the orders of the Calcutta ministry would have the desired effect, there was for the present nothing to be said. That they were informed from the outer districts that the native servants were afraid to accept Company moneys, whatever assurance was given them that they could do so safely. That in order to bring these people as far as possible to a favorable view, the servants, just as in the year 1766, had solicited and obtained from the deputy Mr. Sitaab Raei parwanas for a free collection for the Company, which had been published everywhere and had cost f 393:15:. That the English meanwhile continued to make heavy advances, to which their suppliers also daily urged them, and which the servants, for the reasons adduced, also held necessary. Yet they could not refrain from bringing up here their embarrassment for money, just as if not enough had been said about it in the general letters, and to request relief as if repeatedly, because they had not the least prospect of being able to raise all that was required for the trade, neither on bills of exchange nor on bonds, and it seemed to them moreover not advisable to rely on a certain appearance, even if they had some, since in the event of an adverse outcome, nothing but loss was to be expected from it. The soliciting of the aforesaid parwanas and the expenditure incurred for them was passed by the Director and Chief Administrator on the 14th of the said month of May, in so far as the servants should make no abuse of their authority. And regarding the urgent request for money, it was replied that as yet no opportunity was seen to help them, but it was hoped that the deficiency would cease as soon as Mr. Verelst and suite, who at that time was understood to be on the point of departing upcountry, should have arrived at Pattena, assuming that some moneys would then indeed be obtainable on bills of exchange. The second letter, or that of 18 May, shows the further advance made by the servants of sa. Rs. 25000 or f 39375:- and that the reports from the districts as yet contained nothing but complaints about the violences of the English gomastas, whereby a general fear resided among the natives which could not be talked out of their heads by any force of reason, since experience taught them otherwise; with the further remark that the fire which occurred at Pattena on the 8th of the above-mentioned month, and of which the servants gave a detailed account in the public letter written at this same time, wherefore the English gentlemen could not fail to make a solemn expression of gratitude for the assistance rendered to their servants in that emergency by Chief Rietveld, as seen by a letter from the Calcutta ministry dated the 30th of the aforesaid month to us, and another written on 19 June at Pattena by the aforesaid Mr. Rumbold to Chief Rietveld, which latter stands inserted in the general resolution of 21 July last, would be of very detrimental consequences for this trade, since the British had ordered their gomastas to replace the 800 maunds lost thereby, over and above the remainder of their demand, with a similar quantity, and that it was consequently to be expected that this misfortune would be taken advantage of and means employed to ensure that the order was promptly complied with. Nothing specific was answered in writing to this, but this declaration was left to its own merits and demerits, the more so since the dominant character of our said competitors is all too well known, and regarding the communication made at the same time, as the arrival of Mr. Verelst yonder was not yet firmly determined, and it conveniently remained uncertain whether one could hope for any relief of money through His Honour, the employees were referred to our general letter of 24 June, showing that they were rescued from the so-called embarrassment by what had meanwhile reached them. Because Your High Right Noblenesses in another passage also please to testify that our reply to the Patriarchal Extracts inserted in the missive of 19 December 1766 seemed an incomprehensible matter, concerning the information requested by the Gentlemen Masters about the Swedish copper—namely, whether it could not be used in Bengal as well as the Japan copper—because it was inconsistent with what had been posited on an earlier occasion, namely in the respectful letter of 19 March 1763, concerning how the large import of Swedish copper by the English very much depressed the Company's trade in Japan copper, whereas in the aforementioned reply it had been proposed to the Gentlemen Majors to send a small trial parcel of it, but at the same time added that, due to the supply of foreign nations, not only could no fixed price be relied upon, but that it would notoriously cause a decline in the sales of the Japan copper if the import of the other gained any ground, etc. So, for the clarification of both points, we have the honour respectfully to show Your High Right Noblenesses that, having been able to infer nothing other from the text of the Patriarchal Extract of 4 October 1765 than an intention of the Gentlemen Masters to see whether this trade would have any success, we thought that a proposal to that effect was appropriate. Employed for this purpose being the skippers Jan Moorland and Pieter Clement, we, upon their submitted report which is inserted in the resolution of the above-mentioned date, first heard the said Van der Stam regarding the suffocated cordage, and received from him the answer that it had already been unusable when he took over the administration, referring to a report submitted at that time by the skippers Arent van der Dercken and Pieter de Leur, requesting on that account to remain free from all responsibility in these respects. 581 found, to be compensated from the estate of the late Equipagemeester Lucas Zuydland: 5 pieces of topmast shrouds of 5 Amsterdam, all dried out and 1 large 8 foresail ditto of 7 1/2 ditto, suffocated - 8 - item 1 warp of 18, having a bad spot in the middle, without prejudice to the right of the authorized agents or interested parties, if they should deem themselves aggrieved by this decision, to address Your High Excellencies in this regard, to whom we demonstrate, concerning the kedge ropes brought by the Popkensburg, that among them, according to the aforesaid report, some were found with two kinds of yarn that could indeed be pulled to pieces, without the commissioners, however, daring to condemn them with complete certainty, and why we have also resolved to make shift with them for the present as best we can; but to have the aforesaid unserviceable anchor written off and to send the same to the Netherlands when opportunity arises, without charging any monetary value. Second. That in case we should persist in the former disposition, we would then permit them to deliver the said cordage, or a portion thereof which might be thought necessary, in kind to the Company; as First. That it might please us to present their submitted grievances as favorably as possible to Your High Excellencies, and to allow the said petitioners provisionally to suffice with providing adequate security. Against the aforementioned imposed compensation, a petition was submitted to our meeting on the 23rd of the past month by the testamentary executors of the estate of the aforementioned Zuydland, containing first an exposition of the reasons which the said petitioners thought might be taken into consideration to absolve the deceased regarding the cause of the decay of the aforementioned cordage; and at the end, a three-part request, to wit: Against maintaining 1 582 maintaining that this would be more profitable to the estate than paying for the same to the Company at such an enormous price, namely with two capital advances. 3 and lastly, that if this second part should be accepted in whole or in part, we would nevertheless bring the interest of the said petitioners before Your High Excellencies and support it with our favorable recommendation, so that upon a favorable decision by Your High Excellencies in this respect, they may remain entirely free from harm. Having disposed thereof, we did not find their submitted reasons cogent enough to desist further from our previous resolution, except that, according to the second point, we were willing to allow them to return the warp, or the only thing that could be reckoned to come in handy, in kind to the Company, and thus let them pay for the remainder, or the shrouds, of which there are still enough on hand, according to the ordinance drawn up for it, with two capital advances. We take the liberty, however, presenting a copy of the petition, to request Your High Excellencies to be pleased to dispose further definitively in this matter, namely by approving our resolution; or to take a gracious reflection upon the third point of the said petitioners' request; whom we have also turned down regarding what they also requested in the aforesaid petition, namely that of the amount of the goods which had previously run in the ropeyard books of 1765/16 and, according to authorization of Your High Excellencies, had already been credited to them at the established price, the purchase value might also be paid; which they maintained was generally granted to the administrators by virtue of Article 15 of the General Regulations reprinted in the year 1764, but which in our opinion has no place, since the price for which they had run in the books was certainly specified by the supplier or the deceased Equipagemeester himself. By resolution of the last of December is also registered the report of the Head Administrator upon the findings of the Bengal trade books of 1764/5, which, properly answered in the margin, is also sent over on this occasion with the documents relating thereto, without our finding any necessity to cite anything further from it herein, except: that regarding the hospital expenses, for which Your High Excellencies, by the latest formal rescript, were pleased once and for all, and regardless of whether there are many or few cases lying in the hospital, to allocate f 8000 per year and in addition 50 guilders for arrack and spices, it was resolved by us on the day of the committee, namely the 14th of October aforesaid, to show to Your High Excellencies in all humility that this allowance is so small that the Director was at first at a loss to obtain another chief surgeon in place of the one dismissed from the Company's service, since even no second surgeon was willing to accept this meager salary, and that the second master from the hospital, Jan Christiaen Hoen, was persuaded to it with the utmost difficulty and reluctance, under the promise that his grievance against the said determination would be presented in the best way to Your High Excellencies; the same having submitted, upon the extract of Your High Excellencies' aforesaid disposition handed to him, at our meeting of the 21st of November, a petition whereby he requests

came to make a request that, instead of the sum of f 50 granted by Your High Excellencies for arrack and spices, in which the indispensable articles of Dutch vinegar and Cape wine were not included, the provision of spices, arrack, vinegar, and wine should be made in kind and just as to his predecessor, according to the determination of 23 November 1762, and that he might also be supplied with two pieces of gerras for bandages. Notwithstanding that objections were raised against this, as to whether we might take it upon ourselves to give any consideration to this petitioner's suit in a matter that had been settled and virtually fixed by Your High Excellencies, we have nevertheless, from a conscientious conviction that even if the 9,000 guilders proposed by us had been allocated to him, he would still have difficulty getting by in the present expensive times, and that he would thereby be too heavily burdened to come to the Company's market on top of that to purchase spices and other necessities, judged that Your High Excellencies, considering that a proper reckoning of what is necessary brings much relief to hundreds of miserable persons, and conversely that a meager provision cannot fail to come to the aid of the want and distress of so many needy people, will also not take it amiss that we have provisionally, until Your High Excellencies' further order, granted the first part of the petitioner's suit, but refused the rest. Humbly requesting that Your High Excellencies please approve this decision, or favor us with an increase of the allocation up to nine thousand a year, and no more. By extract from Your High Excellencies' formal rescript of 11 July, we have informed the Council of Justice of this office of Your High Excellencies' recommendation to govern themselves in future regarding the punishment of deserters and runaways according to the military orders of the Articles of War for the militia, enacted on 27 December 1753, and the placard issued on the subject of deserters and runaways; as well as given to them and to the Fiscal the further interpretation of Your High Excellencies with regard to the previous orders concerning the cancellation of the monthly pay and emoluments of servants in case of suspension; likewise the presentation of criminal sentences to the Director for approval; as well as the sent Regulation concerning the permitted cargo allowance of ship officers, with the additions made thereto from time to time; likewise the brief extract of the orders on the free navigation around the West of India, so that collectively, or each in his own capacity, they may regulate themselves strictly according to them. However, since there are no copies on hand of the aforementioned military articles and the general Articles of War, we take the liberty of requesting Your High Excellencies for some of the same, and also to remind you that we have not yet received copies of any criminal and civil rolls of settled cases before the High Court at Batavia, which were promised to us in Your High Excellencies' honored letter of 30 July 1756, and which would certainly give a great deal of light to those who must exercise the office of judge here without being fully versed or experienced in the laws and customs of the country, and alongside which a sufficient number of copies of the Statutes of the City of Batavia would also not be at all amiss, if it should please Your High Excellencies to provide this Directorate therewith. To the aforementioned College were added as members the Junior Merchants Hans Carel Baron van Arnim and Leonard Verspyk, who were at the same time sworn in by oath, which was also done on the 30th following with the Junior Merchant Jan Albert van Iadekinge, who arrived thereafter; whereas on that day the Junior Merchant Otto Willem Falck was discharged therefrom for such reasons as will appear hereafter. The criminal cases concluded before the Court of Justice consist of the following: One by the provisional Fiscal of this Directorate, Otto Willem Falck, ratione officii plaintiff, against Barend Janzen, former pilot in the Company's service, defendant by edict, in a case of desertion and the sailing away of the Company's ship Vrouwe Petronella. 1. By the said Fiscal Falck, ratione officii plaintiff, against Jan Hendrik C:S:, defendant by edict, in a case of desertion. One by the said Fiscal, ratione officii plaintiff, against Jurgen Andries Limburg and Anthoni Kerkhoff, concerning undertaken desertion. One by the above-named Fiscal against Andries Boode and Pieter Dammes Davids, the former in a case of having intended to commit the abominable crime of sodomy with the last-named. One by the repeatedly named Fiscal, ratione officii plaintiff, against Jan Laurens and Joseph Colin, the former in a case of attempted and the latter of completed desertion and suspicion of crimping. One by the Fiscal Louis de Saumaise, ratione officii plaintiff, against Carel Andreas, in a case of desertion and mutiny. Of the servants, Director Vernet is inwardly moved with the most notable feeling of gratitude for the great and favorable confidence that Your High Nobilities are pleased to place in his person, by requesting him to continue in the same, instead of granting his discharge from an administration that is so full of sorrow and care. He could also not fail to submit to the pleasure of Your High Nobilities, although he wished that he could fully answer the purpose intended thereby. But, on the contrary, he suffers the misfortune to see his exerted endeavors and attempted undertakings for the revival of the ruined affairs disappointed by the scandalous deception of those upon whom this principally depended, and who had given the most solemn assurances thereof. Nevertheless, he hopes that Your High Nobilities will do him the justice to remain satisfied with the zeal hitherto applied by him to keep matters still in balance notwithstanding that this his good purpose was frustrated, which gives him the confidence of a gracious assent, upon the favorable recommendation of Your High Nobilities, to obtain his direct deliverance to the Netherlands in two years' time. No less expression of obligation are Your High Nobilities requested to accept from the Merchant Martinus Koning and titular Merchant Louis de Saumaise: the former for the reinstatement to his post of Pay-Bookkeeper, and the latter for the gracious pardon of the fault committed by him in the spring of 1766, and his likewise reinstatement into his service of Fiscal and Village Master; assuring Your High Nobilities that their gratitude in this regard will never end, but shall serve as a spur, by a vigilant observance of their duty, to give the most evident proofs that the beneficence of their High Masters has not been ill-bestowed. Both were introduced into our assembly of the 25th of September, and the oath was taken from them pertaining to their offices and duties, as well as those that must be passed for the pure and lawful acquisition of this and that capacity; the recommendation of Your High Nobilities, not to require the latter from those who come from Batavia, shall be observed, and it has also never happened except upon the assurance that they had not yet taken the same before Your High Nobilities; who furthermore are generally thanked with the most sincere respect on behalf of those who have been confirmed in their duties or advanced in rank, and of whom the Junior Merchants Overbeek and De Meyer have provided sureties for their administrations as Warehouse Master and Cashier at Kassembazaer according to the orders, as have the Pay-Bookkeeper and Fiscal aforementioned; item the Master of the Equippage Jacob Pieter van Braam, the acts of which have been entered by resolution of the 8th instant, and those for the retiring provisional Master of the Equippage Van der Stam by decree of the 7th of November of the past year. 509 by Leendert van der Linde and Jacobus Welgevaaren, contra the merchant Cornelis Rietveld in his capacity as former Fiscaal and Jacob Eilbracht aforesaid, in his capacity as former Secretary of Justice, in order to appear in person before Their Honors' tribunal in the coming month of August, or to send an attorney, and to hear such a claim and conclusion as the plaintiff would wish to make and take against the defendants regarding diverse actions and pretensions cited therein, etcetera; thus copies thereof were sent to Pattena on 15 October; but meanwhile a letter from the servants of two days prior was delivered here, whereby said Rietveld demonstrated that this news had already reached his ears indirectly, and requested of us that, for the defense of his good name and reputation and whatever further might have to be carried out, he might be granted his dismissal from the headship of the factory, since this matter was too delicate to merely entrust to others, item that we, until such time or until he should have pleaded his case, would allow his office to be administered by someone else, and permit him to depart on the first ship. And since on the 21st of the past month we judged that in all cases whereon someone's honor and reputation depends, the path to defense ought to remain open, we thus granted the aforesaid request, however in such manner as, according to the extract of the letter from the Fatherland dated 5 October 1761, ought to occur regarding servants who have not served out their contracted time or can be said to request their dismissal for private affairs, with discontinued salary, which consequently shall cease as soon as tidings shall have been obtained concerning the transfer and accounting by the head of the factory, whom we meanwhile provisionally replaced, having entrusted 590 the secretarial office and the position of cashier a few days prior to Junior Merchant Otto Willem Falck to undertake the journey upcountry as soon as possible, without said Rietveld, however, having to delay himself thereafter, because the servants of the factory were then, at his insistence, informed thereof the very next day and at the same time instructed to provisionally let the transfer proceed to the second-in-command Anthonie Hardij, to whom we also assigned the authority until such time or until Falck should have arrived over there. The secretarial office of this assembly and that which is annexed thereto thus having become vacant again, and the Director having declared that for the performance of this function he placed his best trust in the person who had performed it for fifteen months to his particular satisfaction, namely his then-clerk Jacob Eilbracht aforesaid, both duties were then assigned to him again, and he was at the same time held bound to the oath once taken as secretary; furthermore, it was resolved to omit for now the transfer of the petty cash, which ought to have taken place by him to Falck on the last day of September prior, but for reasons as stated by Resolution could not yet have taken place, and to leave him, Eilbracht, accountable for it, since he was just as satisfied with that as with taking over the secretarial office again upon the transfer made by him. to be allowed to purchase elsewhere the patterned goods that they could not obtain from the Company to fill their permitted chests, as can be seen in the Resolutions of 17 November and 4 December, in which the petitions are inserted, and on which latter occasion they themselves, with an extensive demonstration of the damage that awaited them by missing such a privilege—and concerning which the skippers who sailed out in the year 1766 testified they had never been forewarned—sought to persuade us to grant an approval at their own risk, declaring that every single one of them who could be convicted of having known anything of this further arrangement of the Gentlemen Majors would submit to the confiscation of the goods and all such further dispositions as Their Right Honorable Worships would be pleased to take in their regard. Yet, with all this, we have repeatedly rejected them, judging that it would be unjustifiable to violate Your High Nobilities' desire, namely for us to adhere primarily to the orders of the Gentlemen Majors; and we also did not consent to the request that the petitioners made on the last occasion, to be provided in any case, whether their request might be granted or not, with an extract resolution as proof of what had been disposed by us upon their petition, because we considered that ill-advised, and also thought that justice would certainly be done to them by our Lords and Masters if they made their grievance known with modesty. Promising a dutiful observance of all the other positive commands of Your High Nobilities, and regarding the matters of which no further recapitulation is required, referring ourselves to the aforementioned resolution of 14 October, we finally still have the honor to report to Your High Nobilities, in response to the elucidation requested by missive of 18 June as to how the French obtained the pepper which, according to the latest advices, they brought to Europe from Bengal, and how large the quantity was, that the same was certainly purchased by them on the Malabar Coast, where they have a small trading post, from which place all English and French private individuals can very easily obtain their requirements, and bring a great deal here annually. But the size of the quantity transported by them from here we cannot possibly determine, as nothing concerning this has come to our knowledge. We have thus far looked out in vain for the expected opium, which according to the latest news from Patna of the 24th ultimo had not been shipped due to the persistent lack of vessels, but for which we have seriously reproached the servants on the 5th of this month, noting that several private vessels belonging to themselves have arrived here, with which one could have sent at least half, with a recommendation for an immediate dispatch. Your Honors, Gentlemen, upon a closer consideration of the circumstances of the case, must be completely convinced of the unreasonableness with which your people have acted, by daring forcibly to break into a cutcherry and carry away a person who is under the protection of our flag. This deserves the highest punishment, even supposing our servant were in the wrong. 596 What would we not have to suffer if they themselves were the first aggressors? And if all the information we have received concerning it were truly confirmed in them. Had your people been ill-treated, they should have asked for satisfaction, which would have been procured for them immediately, as this has never been refused, as your Honors, Gentlemen, can testify. But to undertake to act in this indefensible manner, and your Director justifying them in it in the way that he does, and even demanding satisfaction in the name of your Company, appears to us to be little less than an open declaration of hostilities. An act that we flatter ourselves your Honors will never approve of, nor justify. Had Mr. Vernet thought fit to have the offenders punished upon the first request of our President, we might possibly have avoided the unpleasant necessity in which we now find ourselves, of insisting upon a public satisfaction for such a public insult. With respect to the complaints against Messrs. Wallen and Finlason mentioned in Mr. Vernet's letter, Mr. Verelst has summoned these persons, and they outright deny having any knowledge of what they are accused of. Since it has appeared to us with the utmost joy from the letter of our Lords and Masters that His Serene Highness Willem the Fifth, Prince of Orange and Nassau, as Hereditary Stadtholder, Captain, and Admiral General of the Republic etc. etc., entered on 8 March 1766 into the actual exercise of the eminent dignity that placed His said Highness at the head of the government of our country, and the same is to be proclaimed by us on the first of November next, it is for this reason that we, considering the good harmony and friendship that subsists between His Britannic Majesty and the Lords States General of the United Netherlands, could not refrain from informing Your Honours of this with all satisfaction, not doubting that Your Honours will gladly share in the sentiments we feel regarding this important news, and wish with us that God will further take him into His safe keeping and grant him a long and happy reign. We received word today that at Kalna, one of our vessels laden with coarse linens, the first we were to receive in fulfillment of the contract for this year, is being detained, and that solely because we will not consent to the unreasonable demand of the chowkidar, who at first demanded thirty rupees, but has now reduced this to twenty-one. It was formerly the custom for the manjhi at this guard post to pay one or one and a half rupees according to the size of the vessel, against which no one has ever raised any objection, and this was even presented to the said chowkidar, but he will not listen to it. Since the above-mentioned chowki belongs under Burdwan, which is farmed by Your Honours' servants, we merely request to know whether the aforesaid demand has its origin in orders from Your Honours, and whether Your Honours insist that the requested money must be paid, as we shall in that case immediately give orders for that payment.
