20 ditto 818 20 October a petition in which the petitioners express their hardship in being able to subsist solely on their salary and board allowance on the Patna expeditions during these difficult times, for which reason requesting that it might please this council to accommodate the petitioners in this regard and to grant them some gratuity to make good those heavy expenses, it was agreed, upon resumption thereof, to recommend the request of the petitioners as favorably as possible to their High Excellencies, the High Indian Government, since one cannot deny the truth of the reasons and complaints set forth therein, and to append the said petition herewith: To the Honorable Sir George Louis Vernet Director and Supreme Commander over the trade and interests of the Dutch East India Company in Bengal, Behar, and Orixa, along with the members of the respective Hughli Council, Honorable Sir, Respectable Councilors, With the greatest respect, your Honors' humble servants, Carel Mattys Willem de Lille and Paul Gebou Castel, the one serving as Lieutenant and the other as Ensign here, represent how they, the petitioners, in the present circumstances of the times, have very great difficulty subsisting here in this very place on their salary and board allowance, let alone when they are ordered on one expedition or another, and that not only because everything has become considerably more expensive for some years, but also because the opportunity seems as if vanished to be able to earn a living through one permitted way or another; That in earlier days an Officer departing for Patna had the opportunity to take along something for trade, and from that to make good to some extent the costs of his equipment during the period of as much as five months, but that at present they are also deprived of such windfalls, as their way is now cut off by the English, who roam through the entire country, namely by purchasing everything at the highest price and thus making a monopoly even of private affairs, not to mention the decline in finances and the little credit that an Officer, having no means himself, has to obtain ready cash in order to come to market with others; Yet since, notwithstanding all this, when they must go on a journey, the expenses must be found, and one can easily comprehend that the same fall rather heavier at present than 821 20 February 14 October than formerly, partly because one must purchase everything at the highest price, and on the other hand, in the eyes of foreigners, one is under a forced necessity to maintain one's decency, which cannot be done without extraordinary expenses, which again one cannot economize without exposing oneself to utter contempt: thus it is that the petitioners venture to take their refuge in your Honors, as it is fully known that what has been argued is the pure truth, requesting in all submissiveness to accommodate them to some extent in this distressing condition, namely, by granting an Officer to whose lot the command of the Patna expedition might fall in the future, for the relief of his necessary expenses, such a gratuity as your Honors, in your wise judgment and according to the present juncture of times, shall find proper. Lastly, it was agreed, upon sending over all the papers mentioned herein, to request the Hooghly Ministry to pass the said memorandum of general charges; below stood: Agreed, signed: Joh:s Bacheracht; and at the same time to note that among the debtors running on the books, the item of Moetsiram regarding advances on reeling wages amounting to f 31310:8:- is dubious for extensive reasons, as noted in the decree of the 14th current; item that the same has increased since last year to f 6452:8:-. 838 Extract Resolution, taken in Council at Kassembazaer, 9ber 1„ 244 on Friday, the 25th September Anno 1767 There were submitted by the Honorable Chief two Reports of the inventory of the Company's Cash and Effects, here and at kariem-abaadt, as of Ultimo August last; submitted by the Members de Barij and Benoest, who were specially commissioned thereto, and upon explicit interrogation and presentation of those Papers, they solemnly took the customary oath for the validity of the same. 851 21 September 21 October ought to be done with respect to servants who have not served out their contracted time and who can be said to depart for private affairs, with written-off salary, which accordingly shall cease as soon as tidings regarding the surrender of the Directorship shall have been received. Subsequently, the Junior Merchant, Cashier, and Secretary of this Council, Otto Willem Falck, is nominated and appointed as interim Chief to undertake the journey to Pattena as soon as possible, without it being necessary, however, for the dismissed Chief to delay himself on that account, since it has likewise been approved to give immediate notice of this disposition to the servants, with orders to allow the transfer to take place provisionally to the Junior Merchant and Secunde Anthoni Hardy, to whom the authority shall also be entrusted for so long or until after the arrival of Falck. The Secretariat of this Council and that which is annexed thereto having hereby become vacant again, and it being proposed by the Honorable Director to fill the same again with the person who recently had to step down from it, namely His Honor's Clerk Jacob Eilbracht, the members jointly declared their full consent thereto, and the same was thereupon summoned into Council, informed of this, and likewise held to be included under the oath of secrecy once taken, for which he expressed his humble obligation; it was further understood that the transfer of the petty cash, which ought to have taken place on the ultimate of the past month, but could take no effect because the cash account of the ultimate of August was as yet unclosed, and for the present also had to remain open, is now to be omitted, and the accounting thereof left to Eilbracht, he declaring himself to be satisfied therewith. The said Eilbracht, as former Secretary of Justice, having been summoned together with the late Rietveld by the aforementioned persons vander Linden and Welgevare before the Honorable Council of Justice of the Castle Batavia, and his brother stationed at Pattena, the Bookkeeper Casparus Leonardus Eilbracht, having likewise made a request by petition to be permitted to come hither in order to consult with one another on the means to prevent the defendant's ruin and the deprivation of his good name and reputation, and to come in person to present his further 21 October 838 21 October further instance here, it was understood to record here the declaration of the Honorable Director that His Honor had already granted this to the petitioner in private some days ago. Lastly, it was understood, upon their request made by separate letter of the 12th of this month, to authorize the aforementioned servants to send off with the first fleet the 724 chests of opium already in readiness, and at the same time to grant consent to accept the 2 to 300 maunds mentioned in the aforesaid letter, which are said to be good opium, seeing that the Council understands that the 500 chests of which they speak must serve to satisfy the demand for this year, and that the demand for this year ought to be completely fulfilled, provided that it be done with good merchandise, since it is otherwise better to supply less than to supplement what is lacking with bad goods. 863 ber 23 d„os 23 8br Whereas Stephen Lieve Garrison, First Vendue Master of this city, on behalf of and representing his brother-in-law Louis de saumaise, who had been appointed in the capacity of titular Merchant, Fiscal, and Village Master at the Head Office of Hougly in Bengal, has submitted to us by petition; That his said brother-in-law, together with several other Company servants stationed at the said Office, among them the Secretary of Policy Otto Willem Falck, having been invited by Mr. Chevallier, Councillor at Chandernagoor, on 15 April 1766 for dinner at noon and to attend a concert in the evening, on his return to Chensura late in the evening became embroiled in the most heated exchange of words with the said Secretary Falck, which was subsequently followed by acts of violence; That the said Soumaise, who had shared a merry glass with the entire company, at that unfortunate moment, defending himself as best he could, had not only received a wound himself but had also inflicted one upon the said Falck, which in his extreme confusion he feared might have evil consequences; That for that very reason, instead of going to Chinsura, Soumaise returned to Chandernagoor, and being struck by fever, as well as having stayed there for several days, had great difficulty returning to Houglij out of fear of being accused and legally prosecuted both for his absence and for the aforementioned incident; That this difficulty had also led him to resolve to remain at Chandernagoor until he should be informed whether his transgression might be forgiven him in consideration of his young years; The petitioner therefore praying, for and on behalf of him, Louis de Saumaise, that it might please us not only to pardon and abolish the aforementioned transgression committed by him out of youth and without intent, but also to allow him to enjoy and possess the functions we had entrusted to him; So it is that we, having considered the circumstances in which he, Louis de soumaise, was involved, and all that could further move us to prefer the path of grace over that of the rigor of justice, have approved and understood, in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, the high Sovereign whom we represent, annulling and voiding, as we do hereby annul and void, the proceedings held against the often-mentioned Louis de Soumaise and the definitive sentence passed thereon by the Council of Justice at Hoegle in Bengal dated 9 August of the year 1766, whereby he was banished outside the jurisdiction of the Dutch East India Company and declared to have forfeited half of his abandoned property and his outstanding monthly wages, and to pardon, remit, and abolish to him, on the other hand, 865 23 8ber 23 8ber his aforementioned crime, as we do hereby pardon, remit, and abolish the same unto him, as well as all pains, fines, and penalties, both corporal and criminal, which he might have incurred for the aforementioned cause against the High Authority and Justice, and as a consequence of this our gracious disposition also to restore him, Louis de Soumaise, as we do hereby restore him, to the good name and reputation he previously possessed to hold all honors and offices, imposing hereupon perpetual silence on the Advocate Fiscal of India and all other judges, justices, and officers, whosoever they may be.
