Novbr 1 Novbr unable to attend due to indisposition, and which above-mentioned persons, having been assigned seats on ordinary chairs across from the Council members on the left side of the table according to the appointed rank, were also called inside, The Junior Merchants, and among them also the Kassembazaar Warehouse Keeper Daniel Overbeek, present in loco with the consent of the Honourable Director for private affairs, titular Junior Merchant and Ordinary Commissioner Willem Kerkman, Ensign Paul Gibou Castel, outgoing and incoming Head Surgeon of this Directorate Lucas Cramer and Jan Christiaen Hoen, Comforter of the Sick Hendrik Hesselo, provisional First Sworn Clerk of Policy and Secretary of Justice Pieter Hoff, and assistant sworn clerk Fredrik Shott, all of whom remained standing at the lower end of the table and, along with the previous appearing parties, were made acquainted by the Honourable Director with the reasons why they had been summoned, with the further announcement that in that capacity they were considered bound in loyalty and obedience to His aforementioned Serene Highness upon the oath, presently to be read out aloud in public from the place of installation by the provisional Secretary Eilbracht; This having been answered with a general declaration of willingness, and the aforementioned persons having thereby provisionally taken their leave, the Assembly proceeded collegially at half past seven o’clock to the estrade, except for the Captain and Commandant Jan Henrik Linner, who joined the head of the militia standing under arms on the square, leaving on the right side of the estrade the aforementioned qualified persons, and on the other side or on the platform in front of the Secretariat the other Company servants and citizens, alongside the Broker, Court-goer, the native merchants, and various other native persons of distinction. Friday Was read a finding submitted by the Senior Merchant and Head Administrator, the Honorable Menso Isinck, concerning the delivered cargo of the ship Vrouwe Cornelia Hillegonda, reading as follows: Finding of the shortages and defects in the delivered cargo of the ship De Vrouwe Cornelia Hillegonda, which recently arrived here from Batavia, as appears from annexed reports of the Ordinary and Special Commissioners, regarding which the undersigned requests the decision of the Council, for the information of the Trade Bookkeeper, to wit: Pursuant to the report of the Administrator, the following shortweights were delivered in the trade warehouses in the presence of the ordinary Commissioners, namely: 91 2/3 lb Japanese bar copper short, being invoiced at 50000 lb, and received by the Administrator only 49908 1/3 lb, thus 91 2/3 lb too little, or 3/16 per cent surplus. 80½ lb Bangka tin too little, since the invoice specifies 50000 lb, and was received by the Administrators 49919½ lb, consequently 80½ lb short, or 3/32 per cent short. 38 lb Dutch lead short on a parcel of 23274 lb that are invoiced, and only received 23236 lb, thus 38 lb too little, calculated at 5/32 per cent short. According to the report of the Commissioned Members from the Court of Justice, the Junior Merchants H. C. van Arnim and Lodewijk Verspyck, and in the presence of the Fiscal L. de Saumaise, upon the gross weighing of the after-mentioned spices, the trade warehouses were found short Friday the 6th of November, anno 1767, in the afternoon, absent the members Zinner, Lafonte, Ross, and Hagha Damius, the first three due to indisposition and the latter occupied in service. 6 November as 803 6 November 6 November as 59½ lb on 37 chests, which according to invoice should contain 2888 lb nutmeg and 1110 lb cloves net, and conform the memorandum of the Commissioners at the capital were weighed out to the ship's officers at 6045 lb gross, yet upon reweighing here only found to be 5985½ lb, thus a shortweight of 59½ lb, making 1 per cent surplus. 15 lb on 18 bales of cinnamon, which conform the entry in the invoice should contain 1440 lb net, and according to the aforementioned memorandum were weighed out to the ship's officers of that vessel at 1660 lb gross, but upon reweighing here found to be no more than 1645 lb, and thus 15 lb less, or 3/32 per cent surplus. According to the report of the Commissioners Mr. Borwater and S. E. Panning, there was found short in the Main Cash Treasury: 1 bar of silver bullion in chest No. 28, being invoiced at 100 bars, yet 99 found therein. According to the annexed declaration, the after-mentioned birds were delivered short, as: 29 pieces of lories out of 58 pieces 7 pieces of cockatoos out of 9 pieces 4 pieces of parrots out of 15 pieces perished and flown away 2 pieces of parakeets out of 18 pieces 200 pieces of ricebirds out of 300 pieces The delivered timber and equipment goods were delivered in accordance with the invoice. And after resumption of the same, it was approved and agreed: To allow the 3/16 per cent shortage on the Japanese bar copper to be written off, and to charge the ship's officers for that which is short in excess of the permitted allowance of 1/8 per cent, amounting to 1/16 per cent; but on the other hand to credit the same for 1/16 per cent on the tin and as much on the lead, being that which is beyond the permitted allowance of 1/8 per cent, as the shortage on both amounts to 3/32 per cent short. Furthermore, having resumed the consumption account of the ship Scholtenburg submitted by the aforementioned Honorable Head Administrator, it was resolved, after the reading thereof and confrontation of the proofs exhibited therewith, to pass the same, the 7 pieces of Mexican dollars which were surplus to be paid by the skipper Pieter Clement. To allow the shortage of 59½ lb or 1 per cent on the nutmeg and cloves, likewise the 15 lb or 3/32 per cent on the cinnamon, to be written off, as the same were weighed gross according to orders in the presence of two judicial Commissioners and in the presence of the Fiscal Louis de Saumaise. To cause the bar of silver bullion which is short from chest No. 28 to be paid in cash by the skipper Jacob Pieter van Braam, to whom the same was counted out at Batavia, but nonetheless to record for his discharge that according to the report of the Commissioners Borwater and Panning, the chest in which the same was found short was in good condition and properly sealed. 303 6 November 6 November the respect to call ourselves, below stood, Honorable Sir, lower, Your Honorable’s humble servants, signed, Jan Moorland, Pieter Clement, in the margin, Hooghly, the 5th of November 1767. Honorable, we take the liberty with due aforementioned Van Braam found difficulty in taking it over in that manner; that His Honor, in order to learn how the matter actually stood here, had appointed further express commissioners, namely the Skippers Jan Moorland and Pieter Clement, to inspect the said cordage, so that the Company might be indemnified in time in case it should be found that the frequently mentioned Van der Stam were liable in this matter; and that His Honor had yesterday received the following report from this last commission: To the Honorable Sir, George Louis Vernet, Director of the Honorable Company’s Important Trade and Interests in the Kingdoms of Bengal, Bihar, and Orissa, etc., etc. Honorable Sir, In compliance with Your Honor’s written order, we, the undersigned, proceeded to the Equipment Warehouses and there inspected the cordage present, among which we have found those mentioned below to be as unserviceable as is respectfully shown hereafter, namely: 5 pieces of topmast shrouds of 5 inches 1 piece of main or fore shroud of 7½ inches; these have, through long lying and moisture in the warehouses, decayed and rotted, having in the middle a heavy stiffness rendering them completely unusable; furthermore, we have carefully inspected the coir ropes recently brought by the ship Popkensburg, and among them found several in which there were two kinds of yarns, and that there were also some yarns which we could pull to pieces, though we cannot condemn the aforementioned coir ropes with complete certainty. Herewith hoping to have fulfilled the honored intention of Your Then, since the Council, in agreement with the Director, was of the opinion that, before deciding on this matter, the frequently mentioned Van der Stam should be heard concerning the cordage that is stated in this report to be rotted and unserviceable, he was, with approval, summoned and questioned about this, to which he answered that it had already been unserviceable when he took over the warehouses, and that he did not know otherwise than that proper report had also been made of it by the Skippers Arents van der Deuren and Pieter de Leur, wherefore he thought that it could not be said to run at his risk, requesting a decision on this matter; and upon notification, he thereupon retired outside. And since, after investigation made, it was found that in the report delivered on the 16th of December 1766 by the just-mentioned seamen the same cordage, and moreover also a kedge anchor among those which were carried on the books as serviceable, were reported as unserviceable, but at that time it was omitted to take the necessary resolution on this, it was now proceeded to a final decision on this matter, and judged that the said Van der Stam cannot 304 6 November 6 November cannot be considered subject to any accountability or reimbursement, but that the Company nevertheless ought to be held harmless by the person who previously had the administration thereof and neglected to make a timely report regarding the unserviceability of the frequently mentioned cordage; and consequently it was approved and resolved to have it reimbursed from the estate of the late Equipment Master Zuijdland, as being responsible for it, and thus to write off in the books: 5 pieces of topmast shrouds of 5 inches 1 piece of main or fore shroud of 7½ inches 1 piece of main or fore shroud of 8 inches and 1 piece of heavy rope of 18 inches, saving, however, the right of the authorized agents or interested parties, in case they might judge themselves aggrieved by this decision, to address themselves on this account to Their High Mightinesses, to whom on the next occasion the necessary representation will be made concerning the bad condition of the coir ropes brought by Popkensburg, with which, however, for the present, the best possible shift will be made; but concerning the unserviceable kedge anchor, it was resolved to have the same written off and sent to the Netherlands on the next occasion without charge of monetary value. Right Honourable Master and esteemed Councillors, The undersigned, Fiscal of this Directorate, having in accordance with your Honours' resolution of the 4th ultimo pursued the inquiry regarding the grounding of the ship De Vrouwe Elisabeth, and having now finished with the same, has the honour herewith to provide your Honours with a report regarding this, 915 6 November and at the same time to submit seven depositions taken under oath and confirmed, mentioned in the attached register. The same generally agree sufficiently that they sailed down with a good opportunity towards the first sandbank, but that due to the heavy swell and the hollow water which was on the said first sandbank at that time, the ship was caused to work to such a degree that this was the real cause of the grounding, although according to the statements of the skipper, chief mate, pilot, etc., there was also at that time one foot less than four fathoms of water; wherefore the undersigned finds himself obliged, in his opinion, to find no cause of action to suspect the pilot or the officers of the ship of any neglect of duty or carelessness, because after the loss of the rudder everything seems to have been done that could ever contribute to the preservation of the ship, which has also succeeded so far that, after having lost their anchors and some cannon pieces, and receiving assistance of an anchor cable and some crew, they brought the same safely before Ingelee. The Captain-Lieutenant of the ship Vrouwe Cornelia Hillegonda, which is scheduled to be dispatched today, namely Cornelis van der Stam, having been summoned to the meeting and asked by the Honorable Lord Director whether he had received the cargo and provisions for the vessel under his command, answered that he had no notice yet whether everything had arrived on board, but that one thing and another had been properly delivered to him here; and accordingly, it was resolved to note this declaration herewith. The same van der Stam, having also taken the oath in this assembly for the proper expenditure of barge freights, the employment of vessels, and otherwise, during the time that he served as Equipment Master pro interim, it was approved to record the same herewith; As it was also agreed to declare sufficient and satisfactory the sureties that he provided for his administration of the Equipment Warehouses, being the members of this assembly Johannes Mattheus Ross and Louis de Saumaise, who for that purpose executed at the Secretariat the following act: Today, 7 November 1767, appeared before me, Pieter Hoff, First Sworn Clerk of the Bengal Secretariat, in the presence of the witnesses to be named hereafter, the Honorable Johannes Mattheus Ross, titular Merchant, First Warehouse Master, and Trade Bookkeeper, and Louis de Saumaise, titular Merchant, Fiscal, and Town Master in loco; who declared to interpose in solidum, that is, both for one and one for both, and to stand as sureties for the worthy Mr. Cornelis van der Stam, Captain-Lieutenant at sea and former Equipment Master in loco, and this pursuant to the resolution of the High Government of the Indies of 9 July 1762 and the proceedings and resolutions taken thereon in the Council of Policy here, dated 16 September 1763, for a sum of sixteen hundred Arcot rupees of thirty heavy stivers each, to the end that the Honorable Company might recover therefrom all such actions and claims as might arise or accrue on account of his aforementioned service as Equipment Master during the time he held the office, after his departure or decease; expressly renouncing herewith the benefits of the order of excussion and division, the effect of which is fully known to them, binding further for the fulfillment of what is stated above their persons and properties under obligation according to law. 537 7 November Comparison of the above memorandum against that of the year 1765/6, likewise demonstrating the reasons for the difference and also the cause why the expenses of shallops and smaller vessels in this financial year exceed the limit set in that regard by Their High Excellencies, the Supreme Government of the Indies, namely: The expenses of shallops and smaller vessels in the year 1765/6 amounted to ƒ 34,328. 10. 8. And in this recently concluded financial year, according to this memorandum, an amount of ƒ 55,066. 2. 8. Thus now more: ƒ 20,737. 12. —. Which remarkable difference is caused by the following: Firstly, in this financial year there was one more shallop in this Directorate than in the previous one, being the Troon Prins, for which is put down as much as was spent on one of the shallops in the previous year's memorandum: ƒ 6,503. 15. —. Secondly, in this last financial year one was forced, for lack of coir ropes, to issue ropes from the fatherland, and, as these were not sufficient, to purchase other coir ropes at an excessively high price, which was not necessary in the previous financial year; at that time, 34 pieces of ropes were issued to 6 shallops, which cost no more than ƒ 3,702. 11. 8, whereas the number issued this year to 7 shallops, or 39 pieces, amounted together to ƒ 15,770. 7. 8. Thus spent more on ropes this year: ƒ 12,067. 16. —. The remaining difference of ƒ 2,166. 7. — stems from the heavy repairs that had to be carried out on the shallops, as they were falling into increasing disrepair daily, and also on the bassuras, the latter alone amounting to over ƒ 800 more in this financial year than in the previous one. The difference comes to, as above: ƒ 20,737. 12. —. By the memorandum of household expenses, the costs of 6 shallops and 2 bassuras are fixed at ƒ 24,000. —. —. And by Their High Excellencies' highly esteemed letter of 29 October 1751, there is granted: For another shallop: ƒ 3,700. —. —. And for a bassura: ƒ 900. —. —. Together: ƒ 4,600. —. —. Total: ƒ 28,600. —. —. And according to the contents of the preceding memorandum, there was spent on this in this financial year: ƒ 55,066. 2. 8. Being thus issued more than the regulation dictates, a sum of: ƒ 26,466. 2. 8. This excess of expenses is caused partly by the heavy repairs that had to be done to the shallops, as is mentioned here before, in addition to which more must nowadays be paid for the necessary materials and labor wages than in earlier years. However, the greatest part thereof is to be attributed to the loss of ropes, anchors, and grapnels, in whose place one has had to issue others in this financial year to the amount of ƒ 20,393. 13. 8. If this were deducted from the fixed sum, then the remaining issued rigging, the carpenters' work, and victuals for the service of 7 shallops, 2 bassuras, and 2 pansoys ought to amount to no more than ƒ 8,206. 6. 8. Below stood: Hooghly in Fort Gustavus, the last of August, the year 1767. Was signed: C:s van der Stam. And since, as the above comparison demonstrates, the principal difference for the worse compared with that of last year originates, firstly, because in the recently expired financial year one again had one more sloop on hand, namely the Troon Prins, and for which is set down ƒ 6,503. 15. —; secondly, from the greater amount spent on ropes issued to the sloops, which this time alone amounts to ƒ 12,067. 16. —, caused by the fact that, for lack of coir ropes, not only did ropes from the fatherland have to be used, but, since these latter were not sufficient, coir ropes also had to be bought up at excessive prices; while the difference with the regulation must be attributed to the heavy expenditures that were incurred this time to put back in order the vessels which—as was already shown provisionally to Their High Excellencies in the past year—were maintained very poorly in the financial year 1765/6, the increase in the cost of materials and labor wages, but principally the loss of ropes, anchors, and grapnels, in place of which others had to be 6 November

All trade in Opium is prohibited under the same penalty, except for that which has been purchased from the Society in Batavia. Furthermore, all export of Pepper, tin, and Japanese bar copper is interdicted, unless it appears to have been bought from the Company; but not their import into Batavia, provided they are then delivered to the Company for the established price, and with respect to the first two articles, that they are by no means traded clandestinely at Malabar, Bantam, Palembang, Bangka, Borneo, and Belitung. The trade in wild Cinnamon, peeled like the Ceylonese. All trade in, and therefore the importation of, Surat silk cloths, and all Western linens, by whatever name called, is likewise prohibited under penalty of confiscation and forfeiture of four times the amount, besides the dismissal and the banishment of such servants of the Company who make themselves guilty thereof. 6 The private navigation and trade of the citizens' small vessels, upon obtaining special permission from this government, departing for Coromandel or Bengal with a cargo of Sugar, Arrack, beverages from the Fatherland, and other permitted goods, may on their return voyage carry no linens, by whatever name called, under penalty of confiscation thereof and forfeiture of four times the amount; nor any foreign Europeans or native Passengers, under penalty of a fine of one thousand Rds.
