On 25 November of the previous year, during the meeting, a proclamation drafted by the Director, together with an ordinance regarding the ship officers for the benefit of the judicial officers who customarily keep watch on board, both inserted into the aforementioned resolution and serving to prevent and check the frequent thefts committed on the lighters here in the river and the many irregularities that occur on board during the presence of the ships due to the admission of so many low-class natives under the name of servants and brokers whose primary aim is either to steal themselves or to entice the crewmen to theft, we have not only approved, as it appeared to every one of us completely satisfactory for the intended purpose, but also resolved to have the proclamation published and affixed on land, and subsequently always on board upon the arrival of the ships; which then also took effect on land on 17 October thereafter, and on board upon the appearance of the four ships mentioned earlier that were here. Also, in order to better enable the Head Administrator to check whether all the horris charged in the specifications were properly employed, we enacted at the meeting of 5 January of this year that henceforth the officers of the Honorable Company's ships lying here at the roadstead shall be obliged to address directly to the Head Administrator not only the passes of all vessels departing from the ships to shore, provided they have loaded anything, whether belonging to the Honorable Company or private, not even excepting empty casks and other trifles, but also the receipts for all Honorable Company and private goods without distinction received on board; and we have at the same time resolved to have an extract from our resolutions concerning this decision appended to the instructions and other papers that are customarily handed to the officers of the ships arriving here at the roadstead for their information. We have qualified the officers of the ship Ouder Amstel to write off in their inventory a quantity of 11 small barrels of gunpowder, each of 50 lb, since, in accordance with Your High Noblenesses' order contained in the extract resolution of 9 February 1762, they gave notice that it was found wet, and it appeared to us from a report submitted by the judicial members Ian Martin Wilke and Ian Iacob Fes at our session of 24 January of the current year that this gunpowder, having been inspected by them in the presence of the skipper Ian Stuijver on the horri De Uijtwinner with which it was brought before the Honorable Company's shipyard, after having found it entirely unserviceable, they had caused to be thrown into the river. Besides what has already been supplied to the skipper Ian Stuijver upon his demand for necessities for the service of his vessel, the ship Ouder Amstel, of which mention is made in our humble letter of 30 December of the previous year, we were obliged to have supplied to him further, in place of 600 lb of rice found wet and entirely spoiled upon the clearing of the rice storerooms and subsequently thrown overboard, as per the accompanying sworn statement, an equal quantity of good rice, as well as, upon his request, 2 months' rice ration for 60 Europeans, and 2 months' rice for 100 Moorish sailors, since that vessel was provisioned at Batavia for only 9 months, of which 10 have already elapsed. We have also, in place of the chief mate of the aforementioned ship, Theodores Logeman, who deceased here, reappointed the second mate Carsten Peijer as chief mate, subject to the approval of Your High Noblenesses, to request the salary established for that position from Your High Noblenesses. The recruitment of the Moorish seafarers has now been no less successful than in the past year; for with the three previously departed ships, Borselen, Kievits Heuvel, and De Vrouwe Geertruijda, 279 heads have already been sent. And with the bearer of this follow another 123 heads, so that the whole constitutes an extraordinary number of 402 heads altogether! For the enlistment of these people, we caused to be advanced on 20 November under surety to the pay bookkeeper, as per what was noted in the resolution of the 21st of that same month, 3000 rupees, which are now to be settled again upon the departure of this last ship. Some Moorish sailors, sent from here with the Honorable Company's ship Bleijswijk and returned hither with Borselen, were not willing to be satisfied with their debited charge of 5 months and 14 days of pay according to the received specification of 25 June of the previous year on account of the loss of Giessenburg, on which they had been assigned, but on the contrary ventured to begin all manner of insolence, claiming that although they had indeed lost their ship, they had nonetheless performed the Honorable Company's service on Macassar and elsewhere during the aforementioned time, and that this charge had therefore been unjustly imposed upon them; so we, in order to avoid all difficulties and not to make the recruitment of the Moors completely impracticable or at least very difficult, were obliged to authorize the pay bookkeeper, who gave notice of this in a report and at the same time requested the Director's assistance in that writing, without which he declared he saw no way of being able to satisfy those people, to compensate the same

The findings concerning the discharged cargo of the ship Ouder Amstel having been submitted by the Chief Administrator at the meeting of 27 February, we have, after first having noted that on the gross weight of the spices a deficit was indeed discovered of 1 3/6 and 3½ per cent, but that the 10th chest and thus out of the entire parcel 22 chests, being dumped and weighed net, yielded a surplus of ¾ and 3 7/8 per cent, and that consequently for that reason all the chests were accepted and stored in that manner in good condition, the spices being sound, caused the ship's officers solely by way of buyout to be charged on their pay accounts for 25 lb. of copper 25 lb. of Japanese copper in bars 5 lb. of ditto ditto in plates 34 5/10 lb. of Dutch lead 35¾ lb. of red minium 979 lb. of domestic harpuis 25 lb. of ordinary white benzoin 65 cans of Dutch vinegar 12 ditto of olive oil 2 bottles of domestic distilled waters but on the other hand caused their account by way of buyout to be credited for 45½ cans of arrack and for the permitted ship's deficits caused to be written off 142 3/8 lb. or 1/6 per cent on the Japanese bar copper 24 3/8 lb. or 1/6 ditto on the ditto flat 33 3/6 lb. or 1/6 ditto on the Dutch lead 20 lb. or 2/3 ditto on the red minium 800 lb. or 8 ditto on the domestic harpuis 166 5/6 lb. or 2/3 ditto on the ordinary white benzoin 40964½ lb. or 4 ditto on the Jacatran powdered sugar 1154½ cans or 3 7/8 ditto on the Arrack Api 10 cans or 5/8 per cent on the Dutch vinegar 5 ditto or 10/3 ditto on the olive oil 1 bottle or 2 2/3 ditto on the brandy 1 ditto or 2½ ditto on the domestic distilled waters Also the mast timber, which was recorded as 14 palm, but was found here to be only 10, caused to be entered in the books and accounted for as 10 palm, since it was maintained that the former must have consisted of a mere clerical error. The Director having several times remonstrated with and reproved the master of equipment Pleun van der Kuijl in emphatic terms, that the yacht De Vlieger, which was built under his supervision, had turned out so badly and contrary to the intention, which had been to have a capable vessel that could sail and row, and thus serve between the sandbanks for defense, especially against the small pirates who hide there and watch for the lighters, made known to the assembly on 24 March that the latter, certainly out of conviction of not having exercised the required attentiveness in that matter, and possibly also to be relieved of those reproaches once and for all, had offered to take over that vessel on his own account, and to deliver in its place a smalschip to the Honorable Company, as the Speelman was heretofore, provided that he be reimbursed for whatever that smalschip should come to cost more than the Vlieger cost in cash when built. And as we considered that one could not get rid of that bad and little useful vessel in any better way, as the Honorable Company would suffer not the least damage thereby, and besides judging a smalschip, which could be used both for loading and for defense, to be far better, we accepted that offer, and transferred to the just-mentioned employee the yacht De Vlieger just as it is, except for the cannon, the ammunition of war, and the anchors or grapnels, all of which were removed from it, in order to have a smalschip built in its place, under the condition of reimbursing the excess cost. Thus the vessels belonging here currently consist of only 1 smalschip, 2 covered and 3 open horrijs, 1 prau and 1 boat, which are all in reasonably good condition, except for the open horrij De Brootrot, which, being very frail due to old age, is also, in order to save all unnecessary expenses upon it, solely maintained to the extent that it can remain above water. Upon the departure of the last ship in the past year, or on 2 April, we took a resolution to send all the lighters, if wind and weather should still permit, under the supervision of the master of equipment to the island Premeger to fetch a cargo of stones, which can otherwise be obtained nowhere else, and which were nevertheless necessary to be thrown into the water along the revetment of this wharf for the preservation of the ground, which for some time past had diminished so severely that an accident to the foundations was to be feared; and although the vessels did undertake the voyage thither, yet because the approaching bad monsoon prevented them from making a second trip, and our cargo was not enough, we have, in order not to leave that begun and necessary work half done, sent those small craft with the beginning

104 beginning of the good monsoon sent once again to that island, and in order that they could be back here quickly and before the arrival of the expected ships, had them prepared around Primo September, and had the necessary crew hired for that time. But since the permanent crew on the vessels costs a great deal, as their pay continues whether they sail or lay idle, we took a resolution on the 27th of February last, upon the proposal of the Director, no longer to place any permanent crew on the two decked horijs De Postdrager and De Uitwinner, as well as the open horij De Broodrot, other than a tandel and a sailor on the first two, and on the latter only a tandel, and furthermore, as has already been customary until now with respect to the horijs De Hardloper and De Hoop, to hire crew for them on each voyage, and to begin doing so with Primo March, as this will certainly turn out to be much more economical for the Honorable Company. At our meeting of the 8th of February, the equipage overseer Pleun van der Kuijl submitted a specification of the usual annual repairs and outfitting of the aforementioned vessels, amounting in total to Rops 4845 1/26, or in cash Rops 3004 1/32 and from stores Rops 1840 29/30, which we approved, since it did not appear excessive to us but on the contrary showed that economy had been observed in everything with reason, and thus we had a sum of Rops 3004 1/2 paid out of the treasury to that official. Since the dispatch of our respectful letter of the 10th of April, those vessels have made the following voyages, namely: As noted earlier, they all went to the island of Premeger on the 23rd of April to collect a cargo of stones, whither they undertook the voyage once again on the 5th of October for the same purpose. On the 16th of October, the narrow-ship De Beschermer, with the open horijs De Hoop and De Hardloper, made a voyage to Brootchia to collect the return goods, just as on the 30th of November the war yacht De Vlieger with the open horij De Hoop, when at the same time the aforementioned narrow-ship together with 105 the open horij De Hardloper were dispatched to Samboeser to bring hither the cotton yarns prepared there, both of these vessels having made another voyage to Brootchia on the 31st of January, also to collect the return goods lying ready there, just as was done recently on the 27th of March by the narrow-ship alone. Passing then to the article of debits and credits, and having already reported in our respectful letter of the 30th of December regarding our disposition taken on the 9th of that month upon a report of the Head Administrator concerning certain charges and credits per invoice of the ship Borselen, we have the honor only to report in this regard that at the meeting of the 18th of December, we took into the books, to be accounted for here, the amount charged to this office per invoice of the ship Ouder Amstel for the kedge anchor of 724 lb lifted here from the Honorable Company's ship Velsen at f 152:17:-, and wrote off under ordinary rations the cost of 3 tubs of Japanese provisions charged in that same invoice at f 53:8:-, mention having been made in the aforementioned letter of the amount of the shares of various persons in the compensation for 307 lb of spoiled spices found short to the sum of f 569:12:8, which with the remaining f 374:7:8 making together f 921:-:- had been written off; and we had the f 1:8 credited to this office settled in the most convenient manner. Regarding the debits and write-offs, we have the honor to report that the undersigned Director, in fulfillment of his promises in our humble letter of the 10th of April of the past year to purge the trade books, put on paper shortly after the departure of the ships some remarks on the closed trade books of the year 1765/6, in which it was clearly demonstrated not only that various improper and unnecessary entries and transfers had taken place in those books, but also principally that many goods to an amount of f 19116:11 continued to be carried at their full value, just as if they were all serviceable assets, whereas some of them had already long since become unserviceable through use and could no longer be considered to be worth anything, while others, according to the order and custom prevailing in the Honorable Company, should only have been carried as unvalued goods. to take a resolution as soon as the inventory of the end of August was completed and the reports were compared against the trade books. But as this could not take place at that time, since the report of that comparison came in somewhat late, it was subsequently accomplished upon further report from the Chief Administrator concerning some defective and surplus goods in the respective administrations. After having disposed of this in our meeting of the 24th of March last, some were subsequently sold at auction, others destroyed, and still others shipped off to Batavia in the bearer hereof, and thus the trade books as well as the administrations have for now been cleared, such that we hope the effort exerted by the Director will serve to Your High Honours' satisfaction. Meanwhile, the principal part of the sold goods consisted of the so-called gift firearms, which, having circulated here for many years, through continuous cleaning and smearing with oil had become so unsightly that one could no longer offer them to a man of distinction, and therefore it seemed best to us to dispose of them. According to the yield inserted in the Resolution of the 13th instant, they have incurred a loss of f 109:1:8 or 12 5/8 per cent. And since this is not noteworthy, and according to our humble opinion compensation for it cannot properly be imposed upon anyone, seeing that such firearms, which cannot be kept clean other than by continuous smearing with oil or grease, must in the course of time age and lose their appearance without one being able on that account to consider them completely unserviceable, we have, trusting in Your High Honours' favorable approval, ordered the same to be written off. Under the disposition concerning the report on the comparison of the trade books against the inventory reports on the 25th of November 1766, it having been taken into consideration that the copper pans and pots had until now circulated on the books without weight or measure, and that it could thus well happen that the native servants exchanged the larger for small ones without one being able to verify this, we have resolved to have all copper works newly made in the future for the galleys, both on land and on the vessels, marked by express commissioners with special stamps, not only with the cipher of the Honourable Company but also with the number of seers or native pounds that each piece weighed, in order to be entered and accounted for in the books accordingly thereafter. Also on the same day, we took a resolution to send an unserviceable water ox, which had been used for many years at the well in front of the lodge, to the Banyan Hospital, and to have another bought in its place. But upon the report of the Purveyor that an extraordinarily large amount of money was demanded for it, we deemed it better upon further consideration in our meeting of the 27th of February last to cease that purchase, and instead of such a water ox to hire a Paggali or water carrier, as this will prove much more economical and give less trouble. For a Poggali costs per month in total only 8 rupees in hire; and for the maintenance alone of a water ox with its attendant the Honourable Company must pay 14 rupees monthly, not counting the initial purchase, and what the Purveyor receives annually for the necessary repair of the water well, amounting to 65 rupees, which now also lapses. In like manner, according to our resolution taken on the spot on the 14th of October of last year, the two draft oxen of the wagon of the Second, which on account of old age were completely unserviceable, were sent to the Banyan Hospital, and since then none other has yet been purchased, as the new wagon was not yet ready, of which we gave respectful notice last year. But now we shall have to proceed to the purchase of two other oxen, because that vehicle is finally completed, and the specification of its costs, amounting to 1347 rupees 29/15 in cash and 145 rupees 3/60 from stores, was approved in our meeting of the 13th instant, on the testimony of the Second, to whom it was entrusted to oversee that work and the charges submitted for its costs, that the former was good and sound and the latter in his opinion was not too large. The collection of returns for the year 1763 having entirely concluded, we settled the account thereof on the 6th of June of the past year, by having f 8817:11:- paid out to the suppliers for what they had delivered in excess of what they had received in cash in advance. to convey goods, departed thither, to remit for the payment of the daily expenses a sum of Rops: 2000:— in cash, for reasons stated in the aforementioned letter, being apprehensive to demand sugar, as was sent to them in the past year, instead of cash, because all places in that vicinity were filled with that sweetness brought thither directly from Bombay, so that they could not dispose of it quickly enough. Yet, upon their further request, we have nevertheless, pursuant to our resolution of the 24th of March of the current year, on the occasion that the small vessel De Beschermer had to depart for Brootchia to fetch the last returns, sent them 30000 lb: of Japanese bar copper, in order to trade with it in the same manner as was done with the merchandise sent thither in the previous year, as the suppliers there always have need of money after all. We have also remitted thither to the Armenian merchant Goodje Habeteek, occupant of the Honourable Company's lodge at Amedabaad, as the account of the annual monies for the payment of the Honourable Company's servants present in the lodge there was settled with the end of the month of August pursuant to the resolution of the 25th of November, a small bill of exchange amounting to Rops: 149 1/5. And this being all that we have to treat concerning this article of the outer offices, we shall proceed to the domestic matters, in so far as they have not already been treated under the other main sections: reporting firstly that, as appears from the resolution of the 19th of August, the general muster in the presence of the Fiscal, and in the presence of two judicial commissioners, without anyone being found absent, has been accomplished according to order. The first undersigned, having taken into consideration that the almoners had hitherto always taken the collection money of the church to themselves without anyone's presence to count it, and furthermore accounted for it annually under the ultimate of August according to their own statement, whereby it could well happen that the requisite accuracy was not always observed in that regard, has on the 5th of October, in order to prevent this, and to maintain good order in this matter as well, issued a written ordinance, which, having been registered in the resolution of the 25th of November following thereupon, principally entails: That the almoner, immediately after the end of the divine service, in the presence of the comforter of the sick and the sexton, shall empty the pouch, count the money therein, and note its amounts in a separate booklet, which the comforter of the sick shall each time fetch from the second and also bring back thither, and that the almoner shall then keep the money with him for further accounting, to be counted once or twice into the cash box. Inserted into the said resolution is likewise a report from the judicial members Lodewijk Andries van Jeger and Ian Marten Wilke, who, in the presence of the Fiscal on the 10th of October, following the order established by the Director concerning the pound weights, inspected all the balances in use here, calibrated the weights, and on that occasion found unfit: 4 pieces large iron balances, 2 pieces smaller ditto ditto, 2 pieces fine hand or money balances, and 1 brass weight of 1 lb: which unfit goods are now, among others, being sent over to the main settlement with this vessel. Their High Nobilities will also be able to see from the aforementioned resolution, if they please, how the First Draughtsman on the 3rd of November, according to an indication submitted by him, formed from the monthly allowance roll drawn up by the Purveyor Holmberg and submitted for signature, clearly demonstrated how the said administrator had charged too much on that paper, and why that servant, as well as the Examiner Smit, who likewise had been reprimanded repeatedly concerning such matters, were condemned, the first to three, and the second to one month's salary for the benefit of the burial ground. With the arrival of the ships we received from the former master of the equipment here, Falkk, a letter addressed to the Council of Surat and dated Utrecht the 30th of September 1765, wherein he excuses himself concerning a levy imposed upon him by resolution of the 7th of February 1764 for the painting of the house on the Note Dar, that was paid to the Company's modi Mannik Dada by his attorneys under security for restitution, and at the same time requests that he might be relieved thereof again; upon this, for the reasons given thereof, as appears from our resolution of the 9th of December of the last expired year, we resolved to have the said sum paid out again by the modi to the attorneys of the aforementioned former master of the equipment. Also on the same day, the Merchant and Warehouse Master Anthonij Iulius Bangeman duly provided surety for a sum of Rs 400, which was disbursed to him from the Honorable Company's treasury for the payment of the necessary expenses in the unloading and reloading of the ships. The same was also done, as appears from our resolution of 26 December, by the newly arrived Cashier Abraham Josias Sluijsken upon assuming his office, to an amount of Rops 4000:-, for which the Secunde Bosman and the provisional Pay Bookkeeper van Jeger interposed themselves as sureties. While in the meantime on that day it was approved to leave the surety posted by the retired provisional Cashier Monte uncancelled for so long until the latest book year shall be concluded. Among the enclosures hereto we have the honor to present to Your High Excellencies a petition from the Chief Surgeon van der Sprenkel, wherein he has made a request to us that he might be relieved of the surgeon's instruments charged to his account, amounting to f92: 9: 6, which were lost through the loss of the ship De Getrouwigheijd, but seeing that we consider ourselves unqualified to do so, we take the liberty to submit his application to Your High Excellencies in the best manner, to the end that he may be favorably relieved of that charge. The price current for which the Dispenser and Equipment Overseer usually bound themselves to deliver the provisions specified therein for a fixed price, we have, for reasons set forth at large in our resolution of 24 January, assigned to the Honorable Company's modi Mannik Dada, and caused to be prepared for the months of January to the end of August of this year, which we approved in the said meeting because generally all prices therein were set lower than in that of the previous year and thus differed considerably for the better; and have likewise resolved in future to have the price current drawn up under the 1st of September instead of under the 1st of January as previously took place, since one then has no ships on hand and is not occupied with full-handed work, moreover besides this the goods are at their cheapest in that season of the year and the same will also correspond better with the trade books, while one will then generally have general prices in those trade sheets, whereas otherwise one sees other prices published in the beginning and in the latter part of the book year: to that end we have also resolved to have delivered to the said modi, who thus purchases many goods in stock and therefore necessarily must be out of pocket, by the Dispenser and the Equipment Overseer each half of the monies advanced to them from the treasury upon assuming their function for the purchase of goods, to an amount of Rops 8000: —:-, and granted those administrators 5 percent above the fixed prices of the goods stated in the price current, while it will then be much easier for the Director to verify the expenses in the specifications, and the Honorable Company will be better served by this means. Directeur and Council at Suratta to draw the amount of his earned monthly wages up to the last of August 1766, on the grounds that Your High Noblenesses' order was to the effect of no longer permitting any of the Honourable Company's servants in the Gulf. However, since he says he is apprehensive that, as he has not been able to see from the copy of the resolution of Your High Noblenesses sent to him that the Gamron lodge must be entirely abandoned, he would become subject to a severe accountability by quitting that place, he has requested us to strengthen him with orders in that regard and as to how he should conduct himself therein. In our meeting of the 27th of February, deliberating on that subject as to what ought to be done in this matter, whether the aforementioned Buffkens should be summoned hither or indeed left there until further orders from Your High Noblenesses, we approved by a majority of votes, since it was taken into consideration that Your High Noblenesses' resolution concerning the breaking up of Kareek does not speak of Gamron at all, and we had not the least order in that respect, although it seemed probable to us that the same would indeed be received with the first arriving ships upon the report that the Honourable Sloutingh will have given at his appearance at Batavia concerning the state of affairs in the Gulf, to await the pleasure of Your High Noblenesses and to let him, Buffkens, keep his residence there for that long, as well as to give him notice of this decision. And, on the occasion that the annual salary of 1200 rupees for a full year was remitted by bill of exchange to the Factor at Masquetta, Alexander Dubordieu, we also transferred 759 rupees to him, Buffkens, being the amount of his earned wages at 23 rupees per month, calculated from the 1st of February 1766 to the last of December 1767. At the same session we also approved bringing to Your High Noblenesses' notice at the first opportunity that the first undersigned, having learned how the aforementioned Factor Dubordieu at Masquetta was terribly an eyesore to the native broker Norrotemdas residing there, who is in great prestige in that place and has very much influence over the Imam who holds sway there, and it was therefore to be feared that the latter would not fail to do away with him in due time; wherefore we take the liberty to request Your High Noblenesses to let the said Dubordieu return hither from there, the more so as to obtain news of the state of affairs from the Gulf, this can easily be learned through the channel of the merchants at Masquetta, who have their offices here in the city, without keeping anyone, whether European or native, there at the expense of the Honourable Company. From the Lord Governor and Council at Ceylon, via Bombay, we received on the 8th of this month a letter dated the 25th of December of the past year, together with a small requisition of necessities for the book year 1766/7, which we shall still endeavour to satisfy as far as possible with the bearer of this, and will provide the shortfall thereof in the autumn with the direction ship for Ceylon, since time is too far advanced for the quilted blankets demanded therein. In the meantime, on this occasion, another 134000 rupees have now been sent off for this government, just as 200000 rupees have already been dispatched thither with Borsselen and Kievitsheuvel, making together 334000 rupees or 501000 guilders, and thus amply as much as Your High Noblenesses have been pleased to order; although for this time it has cost us some effort to get this entire amount together, and it would not have happened either, were it not that the brokers as well as we made it their chief honour to satisfy Your High Noblenesses' pleasure to the utmost of their ability; since it is certain that under today's date we hold not a doit in cash, and they have now also effectively paid already a handsome little sum of 59740 rupees more than the merchandise amounts to which they have taken from the warehouses up to now. Concerning the negotiations held with the native princes and rulers, the first undersigned, as appears from the resolution of the 24th of January last, upon the appearance of General Kanderauw with the army he had with him before this city to claim some moneys which he had been demanding from the English for some time, prepared a letter, principally containing that we lived in the confidence, although he lay here before the city and seemed to have designs against the same, that he would undertake nothing against the Dutch Company, and thus also inflict no molest upon its servants. Whereupon the said field commander answered briefly, yet in very polite terms, that one need not be uneasy at all, but that trade could be continued undisturbed, and the merchants of the Dutch Company would even be protected by him, just as this will further appear to Your High Noblenesses, if it pleases you, from the said resolution, in which the translation of that received letter is inserted. We have, for the reason that the said General fully kept his given word, since he let pass unmolested the servants of the suppliers, who went back and forth with the Honourable Company's linens from the bleaching grounds situated on that side of the city, and had strictly forbidden his people from troubling the Dutch Company, and secondly because in these countries it is always customary to offer a present to such people of that character and who arrive before a city in such circumstances, which they otherwise themselves, if it is not given voluntarily out of one's own motives

is given, to come and demand it, which however the aforementioned General has not done; and thirdly: because, although one could have passed it by, it was nevertheless not advisable to omit it, as sending such unrequested gave a so much greater obligation, and also because one could not bind these people too much to oneself, they being [allarhettas], especially if it could be done with a trifle, as appears from what is recorded in the Resolution of the 27:th of February on the proposal of the Director made to the Members on the 14:th previously, to have a gift presented to the aforementioned General according to a project formed on that day, amounting to purchase price ƒ 388:1:— and sale price ƒ 572:16:— which was accepted by him, and for which he offered his expression of thanks to the first signatory by a letter incorporated into the aforementioned Resolution; which we hope will meet with Your High Noble's approval, as such, under these circumstances of times and affairs, and in view of the above-mentioned adduced reasons, was not well to be avoided. The first undersigned was again requested, by the Ahmedabad Nabob through two letters received from there, as also by the son of General Damagie, who resides there on behalf of his father as Pandit, or quarter-collector in the city, to establish an office there, but he politely declined both petitioners with an appropriate answer, as shown by our Resolutions of the 24:th of January and 27:th of February last. From the English gentlemen, or rather from the former English chief here, Mr. Hodges, the Director received on the 13:th of February through two English Council Members a separate letter, properly directed in reply to a private missive sent to him, but in which he at the same time in very polite terms made known that he had been appointed from Europe as successor to Mr. Crommelijn, and on the 27:th of January had taken effective possession of the government of Bombay. We replied to the same on behalf of the Honourable Company, and congratulated His Honour on the assumption of the chief administration, and at the same time, pursuant to Your High Noble's most revered order, gave notice to the Bombay Ministry of the unchaste and scandalous conduct displayed by the Jew Elias Abrahams at Batavia, and also requested Their Honours to be pleased to order their subordinates to refrain from such malversations in the future, as otherwise the laws enacted against them would be executed in their full vigour. Pursuant to our resolution of the 20:th of December, we had the English chief here requested through commissioners, regarding the arrears of the unpaid auction monies of the Free Merchant Boucart on account of goods purchased from the estate of the late Director Drabbe at an auction held for the benefit of the Honourable Company in the year 1763, to be pleased to compel the heirs of the said Boucart to make the said payment, to which he replied that he would make an investigation into it, but as nothing was seen to come of it, and the first undersigned had had him reminded several times on this account, he finally let the Director know that whenever one had something to propose to them, it had to be done in writing, for which reason, as appears from the Resolution of the 27:th of February, we dispatched a letter on this subject to the English Chief and Council, which is inserted in the said Resolution, and whereby we again requested them de novo to order the heirs of the often-mentioned Boucart to discharge their debt to the Dutch Company to an amount of Ro: 15 972 at once. Upon this, a letter was brought to the Director on the 20:th of March by 2 English Council members, which in our meeting of the 24:th thereafter, upon reading, was found to be the reply to the one sent to them on the 26:th of the preceding month, and which contained that with respect to the claim on the estate of the deceased Boucart we had to address ourselves to the courts of justice at Bombay, since they took no cognizance of such matters, as concerning property; and since this answer seemed to us very improper, for the reason that there is no dispute about the validity of the debt, it being acknowledged not only by the said Boucart, but even by his heirs, and after demonstrating that by such a way of acting good faith was violated, one had only requested that the heirs might be compelled to satisfy what the Honourable Company has lawfully to claim from them, we resolved to answer this further, and once again to put the matter before the English Ministry in the most emphatic manner. Thus, this matter has been entirely settled, to the great honor of the Honorable Company. But because the Director had already prepared his Memoir of what occurred regarding this matter, and as it contains several circumstances the memory of which might be of some use sooner or later, he thought it best not to lay it aside. Instead, he takes the liberty of respectfully presenting the same to Your Right Nobles, if only for contemplation, in order to gather somewhat from it what trouble and difficulties one is daily subjected to here, now that the English gentlemen hold the mastery and, for that reason, can compel the native rulers to say and do whatever pleases them. Furthermore, we cannot fail to bring to Your Right Nobles' attention that, upon a declaration inserted in the Resolution of the 13th instant, we were obliged to provide the bearer of this, the ship Ouder Amstel, with a heavy coir rope instead of another unsuitable one which, having been brought ashore, was found in fact to be of no further use whatsoever. Likewise: that a sailor named Cornelis Etleef van Holstijn, having accused himself of a disgraceful crime committed in his fatherland and having been placed under arrest for that reason, the Fiscal reported on his case at our meeting of the 13th instant and proved, with affidavits from several persons, that he is genuinely innocent. Wherefore we considered that no legal proceedings could be instituted against him, but that he should be dealt with according to the orders sent by Your Right Nobles to Ceylon by letter of 30 October 1739. Consequently, he is now sent with the bearer of this, with the ship's officers being ordered solely to keep a watchful eye on him, in case he should remain innocent or perhaps at times become worse. And since the Storekeeper Nicolaas Holmberg, the First Sworn Clerk Dirk Spierejee, as well as the Bookkeepers Matthijs Monte and Willem Smit, have submitted petitions to us whereby they request Your Right Nobles to have a favorable regard for their persons in the event of any upcoming changes in this directorate, we hereby present the same to Your Right Nobles among the enclosures hereto. Your Honour's answer thereto, dated the 18th March, was: That your Honours did not take cognizance of matters of property, but that the courts of justice in Bombay stood open to everyone. Thus your Honours declare that you do not wish to interfere in this matter at all. And referring us at the same time to the ordinary judge, it appears to your Honours to be beyond doubt that our claim is of such a nature that its legality must first be litigated and a judicial ruling made. But may it please your Honours to permit us to say: That this idea has no place at all in this case; for the auction book, kept by a sworn person, and the authentic extracts recently presented to your Honours from the same, show that Mr Boucard and his broker Girderlaal Persotum actually bought the goods to the aforementioned amount of rupees 1591¾. Mr Boucard himself has never denied it, but on the contrary fully admitted the truth of it in the presence of us all on the 24th January 1764, on the occasion that a conference was held in our factory with the creditors of Mr Drabbe. And as recently as the 27th January of this year, Mr Stratton, as son-in-law and principal heir of Mr Boucard, upon the inquiry made by our first sworn clerk and witnesses, declared, not that he did not owe that money, but only: That he would not pay, before and unless he was compelled thereto. Consequently, there is no dispute at all about the property. The debtors themselves declare that they are indebted. And what such a clear and in itself indisputable matter would do before the ordinary judge, we do not know. 141 can be dismissed and referred to the ordinary judge at Bombaij, we do not believe that Your Honours, even upon further consideration, will approve. Indeed, it is certain that we know of no precedent where this has ever occurred in such a manner before. And we also doubt very strongly whether Your Honours would be pleased with our answer if, in a similar case, we were to see fit to refer Your Honours to Batavia. Besides this, it is not simply the aforementioned debt or the unwillingness of the heirs of Mr. Boucart to settle the same about which we have complained. We have also represented to Your Honours that this incident violated Good Faith, one of the main pillars, if not the foremost, upon which public law and the Law of Nations rests, not only in respect of commerce and conduct, peaceful coexistence, and amicable intercourse in general, but also in particular regarding the good friendship and understanding to which our respective Nations are bound beforehand, by virtue of neighbourliness and in compliance with the treaties so solemnly concluded and so frequently renewed between our High Sovereigns. And the redress that must inevitably be made in this matter is not an affair pertaining to the Judiciary, but rather to the Administration or to those who hold the supreme power in their hands. These alone can correct and heal the abuses and infringements that have occurred therein. All of which shows once again that we cannot address ourselves to the ordinary judge, but that we are obliged in the first place to address Your Honours, and also to await a satisfactory answer from Your Honours. It is true that Mr. Boucard once said that those goods had been purchased by him and his broker in order to obtain satisfaction for what he had to claim from Mr. Drabbe. And it has been suggested to us indirectly as if this might be permissible according to English law. But we cannot believe that the latter is true. And even if it were so, we nevertheless believe that this can have no application in this case. For just as a Dutchman who seeks to pursue commerce for his profit in the English Factory must submit to the laws and customs in use there regarding commerce, so too is an Englishman who buys or sells anything in our Factory obliged to conform to the laws and customs in force with us. And these admit of no exception, especially at public auctions: whoever purchases anything must without fail pay at the appointed time, or if that does not happen, he must resign himself to being compelled thereto by force, since the auction master not only holds priority over all other creditors, but also the right of immediate execution. 142 Furthermore, the sale did not take place on behalf of Mr. Drabbe, but by and on behalf of the Honourable Dutch Company. How then could Mr. Boucard take from the Honourable Company that which he had to claim from Mr. Drabbe? And even if the goods had been sold for the account of Mr. Drabbe, Mr. Boucard would nevertheless not have been permitted to satisfy himself from them on his own private authority. For no private individual may, according to our laws, be his own judge. This is an act of sovereignty that no private individual may commit without a special mandate. If Mr. Boucard had anything to claim from Mr. Drabbe, he should have addressed himself to the undersigned Director. And if the latter had refused to hear him, he could have lodged a complaint about it with Your Honours. But that he wished to take the law into his own hands, Your Honours yourselves cannot permit; for if private individuals possessed that freedom, the best-regulated states would soon be turned upside down. The laws aimed at property, peaceful possession, and amicable coexistence would cease entirely. And above all, the distinction between magistrates and subjects, upon which the welfare of the lands and inhabitants entirely depends, would be rendered unnecessary. Therefore, we believe we have shown clearly and plainly, not only that our claim is lawful, but also, especially, that our application to Your Honours is just. And living in the hope that this our further representation will also merit Your Honours' further reflection and afford us a more satisfactory answer, we remain in that expectation with the highest esteem.
