On this occasion, the report requested from the Court of Justice of this Office at the session of the 5th of January last was also received and reviewed, regarding the complaints lodged by a certain Clement Fernandes concerning the untimely release of the person who had stood as surety for the fugitive military adjutant Adam Triglaf for the costs that might be incurred in the lawsuit that he had with his wife before the said Court, which read as follows: To - 456. 22 March. To the Right Honorable Worshipful Lord George Louis Vernet, Director of the Company's interests in Bengal, Behar, and Orixa, and the Honorable Members of the Respective Council of Hugli. Right Honorable Worshipful Lord and Respectable Councillors. The President and Court of Justice of this office, having received the extract from the minutes of what was transacted and resolved in the Council of Policy on the date of 5 January last, whereby it is required to state who were those who voted for the release of the surety for the fugitive Military Adjutant Adam Triglaff in the lawsuit against his wife Maria Fernandes, and what reasons had moved the Court thereto, they have the honor to represent for that purpose: That there sat on this matter the then members, Jan Carel Kist, Cornelis Rietveld, Christoffel Maurits Doeve, Otto Willem Falck, Tissot Grenus, Jan Albert de Wijs, Johannes Matthias Ross, Jacob Nicasius de Meijer, Willem Kerkman, and Gregorius Herklots; but of whom none are present any longer except Ross, Herklots, and Kerkman aforementioned, the President and Councillors asked them what had moved them to the release of 457 22 March the said surety, and received an answer from the same, and firstly from member Ross: that he had been against the request to release the surety, because the verdict pronounced here had been appealed, and therefore the matter had not been definitively settled. The member Herklots said that he could no longer remember whether he had given his vote for or against the request, as the member Kerkman also declared, with this addition: that if he had given his vote to grant the request, it must certainly have appeared equitable to him. The then Secretary Jacob Eilbracht, having been specifically questioned thereafter, testified that as far as he recalled, all the members had been in favor of the release of the surety, except the then Fiscal Rietveld and the member Ross, without being able to positively affirm whether the member Tissot had been for or against it; and that it was generally assumed for the release that the surety of Triglaff had only bound himself for the costs that would fall here, which was believed to cease as soon as the judgment was delivered and the party was condemned in the costs. Of all which this serves as a respectful report, while we have the honor to be with due respect and esteem, underneath stood: Right Honorable Worshipful Lord and Respectable Councillors, lower: Your Right Honorable Worships' humble and obedient servants, lower: By order of the Honorable Lord President 458 22 March so, after the reading thereof, it was considered that as soon as a verdict of a subordinate judge is appealed to a higher Council, the matter in question returns to the very same state as it was as of the date of the judgment by the inferior court, consequently also the decision regarding the payment of the costs; and that therefore the Council, instead of granting the release of the surety, on the contrary ought to have held him liable for the expenses that had been incurred here, until such time in case of appeal the matter should be determined on its merits; President and Council, was signed: P:r Hoff, Provisional Secretary, in the margin: Hugli, the 22nd of March 1768. determined 459 determined, whereas now, in case the appellant should happen to triumph, she or her surety is deprived of all security for indemnification; and on that account resolved, without regarding who was for or against the release, since that is not pertinent in judicial decisions unless it appears that the dissenting persons had an annotation recorded against this or deposited their contrary opinion sealed into the hands of the secretary: to declare all those who sat regarding the petition for the release of the said surety bound and liable for the indemnification of the interested party in this, 22 March Maria 460 Maria Fernandez, or her aforementioned father Clement Fernandez, if it should happen that the lawsuit is decided in her favor. Furthermore, it is understood, under the usual proviso, to approve the memorandum of expenses incurred in bringing down the aforementioned saltpetre, amounting to Sa. 466 22 March Your Honors having, by extract of the minutes of the 19th of this month, requested further information from the undersigned regarding what was reported by them concerning the ammunition goods received from Cassembazaer and inventoried by them, they have the honor to inform Your Honors: That, as regards the goods stated in their first report to be serviceable, the same, in the condition in which they found them, certainly had to be considered unserviceable, but that they can nevertheless be made usable through repair and restoration. However, as regards the 75 pieces of hand grenades and 2 scales stated to be missing, the undersigned take the liberty to respectfully request Your Honors' pardon, this being a clerical error by the copyist, since the number of 175 pieces of hand grenades and 4 pieces or 2 pairs of scales stated in the packing slips was found to agree. 6 April Account of the gentleman Director regarding the pretended impossibility of calling at Ceylon at this time. Wednesday the 6th of April Anno 1768, in the morning. Absent: the Honorable Chief Administrator Isinck due to business in the large treasury, and the merchant Lafondt due to indisposition. Having looked out in vain until now for the final report from the skipper of the Vaillant regarding the discharge and landing of the ship Vaillant destined for Ceylon, of which mention was already made in the resolution of the 2nd of this month, the gentleman Director showed the members how His Honorable Worship had since entered into discourse with Tobias van Wagtendonk, the skipper of that vessel, about the voyage and had received an answer from him to the effect that, owing to the south-westerly winds already blowing fiercely and daily increasing at this time of year, it was utterly impossible to reach Ceylon; that His Honorable Worship, as the Master of the Equipage van Braam was still down below and no other nautical experts were currently at hand who could judge the reasoning of the said van Wagtendonk, had had to acquiesce in this to that extent; but that, because in such a case the ordinary instructions would have to be amplified and an order prescribed to the ship's officers as to what they should do or refrain from doing, he, the gentleman Director, considered it not unserviceable to let the members hear the objection of the aforementioned skipper from his own mouth, and to have the reasons given therefor recorded in the resolution, in order thus to be able to judge with more foundation how far the skipper's statement could be deemed acceptable, and what should be done or refrained from in that regard. The said Wagtendonk, having been specially appointed by the gentleman Director, was thereupon summoned inside in accordance with His Honorable Worship's proposal. The reason for his summons having been made known in concise terms by the well-mentioned His Honorable Worship, and he being at the same time admonished to inform the assembly conscientiously wherein the difficulty actually consisted in undertaking the voyage to Ceylon in the present season, he declared that it was presently utterly impossible to make that voyage in less than four to four and a half months, because, as he demonstrated with the chart of the Indian Sea, expressly opened for that purpose, the strong south-westerly winds deprived him of all possibility, once at sea, of holding westward; on the contrary, that he could expect nothing other than to be set far to the east by wind and current; that he would thus be obliged to cross the line to the latitude of 19½ degrees in order to descend as far south as possible, so as to steer north of the Maldives, first to Malabar and thus to Trincomalee, which was even then barely possible and not to be done without danger to ship and crew, considering that, having to work against the monsoon, after having struggled for a long time one would sometimes still be no further advanced, and through lack of water, sickness of the crew, and otherwise, one could choose no other option than to seek Batavia through the Strait of Malacca. Of all of which, after the skipper had been dismissed again, it was resolved to keep this record; and following the business, the discourse was resumed by the gentleman Director, noting that, as His Honorable Worship had alleged more than once, Ceylon will be relieved from the scarcity of rice through the relief from private parties and that which is apparently to arrive from the main settlement, so that it will be much the same whether the Vaillant arrives there or not; indeed, that if it should happen that this vessel had to turn its prow toward Batavia, the rice would be as welcome there as on Ceylon, seeing that Their Honors in their respected separate missive to His Honorable Worship dated the [blank] indicated this not indistinctly, desiring that private individuals, both national and foreign, should be encouraged to deliver rice not only to Ceylon but also to Batavia; but that he, the gentleman Director, as the ship had been expressly detained to make the voyage to Ceylon, was for his part of the opinion that the officers should be ordered in the instructions to employ all seamanship in order to make that island along the ordinary route, but that, this being impossible, then to set the course for Batavia. Whereupon, having deliberated and the opinion of the gentleman Director being unanimously agreed to, it was approved and resolved to conform entirely therewith; also, pursuant to His Honorable Worship's further proposal, to appoint on the aforementioned ship, in place of the commanding officer Jacob Zanie who was placed on the sloop de Kroonprins, the third-watch Christian Christiaansz Kreuger as second mate, and as steward the gunner's mate Johannes Paulus van Ligten, in place of one Lodewyk Malty who remained behind at Malacca. 12 April Continuation of the inspection of coarse linens Tuesday the 12th of April 1768 in the morning, absent the merchant Lafont. The Director and Council having assembled again this morning in the cloth hall, and their Honors having inspected the following assortments: Guinees, Gerras, and Salempoeris, and furthermore, no change having occurred in the contract price regarding the same, it has been approved and agreed to record this herewith, and to make a beginning tomorrow with the inspection of the remaining goods. Before commencing the appraisal of the fine and ordinary sorts of linens, which was postponed yesterday and resumed today, the Director produced for reading the translation of a memorial drawn up in Bengali by the gomastas in the aurangs mentioned therein, containing the reasons and causes regarding the adverse course of our collections, reading as follows: Translation of a Bengali memorial regarding the reasons and causes why the work in the aftermentioned aurangs makes no progress, submitted by the various gomastas of the merchants residing at each of the places, as follows: Chandrakona Pursuant to master's orders, we proceeded to the aurang for the purchase of the linens. From of old it has been customary that the three Companies could procure their requirements to their satisfaction, but in these days an English gentleman named Hoet has appeared here, who made a survey and listing of all the looms that could be found here. He also placed the weavers under all the pykars, who must answer for them, and had the latter enter into a contract known by the name of Rozbandi, or daily assessment, pursuant to which the pykars must deliver the linens to the English Company. Because of this, they are unable to deliver to us those goods on which we have given potton (earnest money), claiming that no more can be woven than what that Rozbandi demands of them, and offering to return the money if one intends to use coercive means to compel them to deliver to us. If one manages to obtain a single piece from this or that asami by paying 2 to 3 rupees more than others, it is still bad merchandise, not at all according to the sample. How then is it now possible to look after the Company's interests? We also inquired of the aforementioned pykars what was done with the reject cloth that the English 13 April English happened to cast out, but they will not divulge that, so what else can we do but exercise patience. Furthermore, in the month of December last, Mr. Bitter and Monsieur Les Granges arrived here. The said Bitter at that time ordered the English agent, Motra Mohan Bysack, to see to it through his people and to use every effort to ensure that all such goods on which the French had given potton were delivered into their lodge within fifteen days, after which that gentleman departed for the coarse linen quarters. Meanwhile, the affairs of the French are proceeding satisfactorily on this account. Haripal and Dhaniakhali It is now a year ago that on behalf of the Dutch Company we gave potton, or earnest money, to the weavers, and of that 14 annas on the rupee has come into our hands. If we address the weavers somewhat forcefully, they insist that we provide them with permission or an order from the gomastas of the English, although otherwise they are heartily willing to serve us, but they lack the ability. Some time ago, when Mr. Bitter and Rada Mohan Bysack appeared at Dwarhatta, they imposed upon the weavers to first finish that cloth which was in arrears during the three months they had stayed in Calcutta, before they would be allowed to work for anyone else. Subsequently, they also assigned them to weave the goods under the new contract, which is the reason why nothing can be made for the Dutch Company. In addition, the demand of the English Company this year is twice as large as the previous one, and among their private individuals one also finds several lodges and extraordinary sums of money for the purchase of linen. All this also results in the weavers being greatly tormented, and how is it possible for our affairs to proceed?
