148 27 Sep to subject Moorish regents to our legal compulsion or jurisdiction; furthermore, that they, as interlopers and smugglers in trade, must be considered highly detrimental, and are even considered as such in Calcutta, where they do their best to inflict all possible damage upon them in matters of commerce, and even to keep them entirely out of it, just as, in the opinion of this assembly, it can be said to be consistent with the interest of a merchant, to whom the multitude and increase of competitors can cause nothing but damage and trouble. All of which, with regard to allowing those people to buy houses in our village, has been resolved to bring to the attention of the Honorable High Indian Government as a ground for grievance; with the humble submission that if, notwithstanding this, Their High Honors should be of the opinion that the same could not be held as sufficient, it would then seem proper to require, both of foreign vagrants and of the Company's servants, to remedy the lack of housing by some convenient means, 149 27 Sep namely by building new houses, for which in such case they could seek to acquire the land by purchase, provided that they request designation and consent from the Director in advance. Beside the second of the aforementioned letters transmitted, there was also resumed an extract missive from the Honorable Grand Respected Directors of the Chamber of Delft dated 23 September 1767, and a declaration executed on the 26th of the previous month by various Company servants before a notary and witnesses, showing not only the poor condition of a bale of derriabauds brought by the ship Vreedestein for the above-mentioned Chamber, but also that four pieces were found missing from it according to the unpacking note, also sent over with the aforementioned papers. By the same Batavian letter, being ordered to take into the Company's service and to place on each returning ship one or two crews of Moorish sailors for the headquarters, under such regulations as were prescribed in the past year, and provided they consist of able-bodied men, better than those placed on the ship Popkensburg, of whom some twenty died between Bengal and Batavia; it was resolved, providing an extract to the Master of Equipage, to instruct him 151 27 Sep with the execution of this order. The business concerning the aforementioned Batavian letters being herewith concluded, and proceeding subsequently to deliberations on other ordinary matters, it was, upon the proposition of the Honorable Director, approved and resolved 152 27 Sept to give the Junior Merchant Thierny Reynard a seat on the Council of Justice and to introduce him properly as such on a future occasion, or when he shall be somewhat improved from his present indisposition. Subsequently, by the usual written report of the Trade Bookkeeper and the Invoice Keeper, the proper examination of the cash account for the months of June and July last was seen, reading as follows: To the Right Honorable George Louis Vernet, Director of the Honorable Company's important trade and interests, together with the members of the Political Council. 157. 27 September the Honorable Council of Justice of the Castle Batavia, rendered on 9 December 1767 and pronounced on 10 February last, whereby the sentence of the Council of Justice of this office, passed on 25 November 1765, and published on the 30th thereafter, in the matter of his daughter Maria Fernandes against her fugitive husband Adam Triglaff was annulled, she became the victorious party and he, Triglaff, was condemned in all the costs of the trial, incurred in both the first and the second instance, with the request that His Honorable now be pleased to let him enjoy the benefit of the resolution of this assembly of 22 March last, whereby the persons who had sat concerning a certain petition, presented for the release of the surety of the aforesaid Triglaff, for such reasons as may be seen at large in that resolution, and specifically for the granted release of the aforesaid surety, were declared obligated and liable for the indemnification of him, Clement, and his daughter Maria Fernandes aforesaid in case the 158. 27 September the case should be decided at the headquarters in her favor; that the Lord Director, finding the request of that man to be grounded in reason and equity, had therefore indulged him so far as to have an ordinance drawn up for the expenses, which altogether amounted to Stivers or Rupees 3203: 12 2/25 or f 4004:15, which His Honorable also produced for reading, proposing to the members to have everyone's share, as calculated in that paper, collected provisionally by the Cashier for deposit into the Company's Treasury; whereupon, having deliberated, it was resolved to agree thereto and to note the one and the other in the manner aforesaid. Thus, in consideration of the small amount thereof, and the known custom that in such, albeit voluntary gifts, one must follow the previous custom, so as not to run any danger over one or another trifle that this might on occasion be made to cost very dearly, it was resolved by unanimous vote to approve this purchase as well. Yet because, as appears from their further writing of 180. 27 September of the 20th of this month, it will take much effort to see whether the 100 chests, which according to the latest order for Their High Mightinesses were still to be procured, can indeed be obtained in just such sound goods and at the same, or similar prices; partly because they, the servants, had directed the advances and purchases according to the demand of 500 chests, and partly because they had already ceased purchasing, and upon the discussion held in that regard with the supplier had received nothing but various well-founded difficulties in reply, which they, the servants, had emphatically ordered him to remove as much as possible, and which they were about to resume by giving him shortly, in hope of approval, a further advance: it was ripely deliberated hereupon and considered that the uncertainty regarding the prices and quality of the goods prevents this ministry from granting a definite authorization for the procurement; and resolved accordingly to write to the servants to cease all trouble in that regard, rather than saddling the Company with 181. 27 September with worse and more expensive goods, adding however that it will be considered a mark of superabundant zeal if they, nevertheless, should know how to strike the Company's interest so well that Their High Mightinesses may have reason to be satisfied with their conduct, and that the first proof thereof will be the fulfillment of their promise of a timely dispatch of the opium. Regarding the linen trade, it being found communicated by the first letter how the servants had already for some time been in negotiations with the supplier concerning the price for which he could deliver the lot of linens this year, and that on that occasion they had strongly insisted on negotiating them several percent cheaper than what the rejects were accepted for last year, while he, on the other hand, had tried to persuade the servants to validate something more for them, but that he had finally allowed himself to be persuaded to deliver the aforementioned lot, just as in the past year, for 5 percent less than the sorted linens: this was deliberated upon 182. 27 September deliberated upon and observed that the order contained in the Home Demand for the year 1768, decided at Amsterdam on 14 October 1763, namely to accept no lot of Patna goods at all, even if it could be done with actually less deduction than the 5 percent recently negotiated there, as the second letter shows, was received only after the servants had contracted in that regard; and resolved accordingly to consider the aforementioned convention concluded, and at the nearest opportunity to represent to the Gentlemen Directors the difficulties that the servants allege against returning the third sort as well as the rejected lot; and which amount to this: that, being unable to enter into contracts with merchants in Patna, one was indeed obliged to have the purchase of linens carried out by gomastahs directly from the weavers; that the latter, finding more ease and profit in manufacturing the coarse and narrow cloths that were most in use there, or working for others who did not look so strictly upon the length and breadth, would thus with difficulty

But because the difference in profit with Hooghly and Patna is too considerable not to demand further report and elucidation on that account, it was therefore, in conformity with the proposal of His Honorable, likewise resolved not only to ask the servants for an elucidation as to what it should be attributed that the aforementioned spelter has remained unsold for so long, but also whether they see an opportunity, at the aforementioned price, to dispose of two times one hundred thousand pounds annually, or how much they might be able to cause to change masters in a full year in such a manner; in order to add something to them, if it might be of any importance, from the relief of approximately 100000 lb received this year from Batavia, and that which is expected next year, which otherwise, or if so far 189 27 Sep. the servants are in uncertainty regarding the market and the time of its sale, does not seem worth the expenses of transport and the risk; all the more so since the Honorable Lord Director takes it upon himself to dispose privately of the aforementioned 100000 lb all at once, at the price fixed by the Demand of ƒ26 per 100 lb, or as much more as can only be bargained for: while furthermore, regarding the impossibility still alleged by the servants in the first letter to obtain the stipulated price for the tin on hand, nothing else was found to be done than to await a better opportunity. But with respect to the 6000 lb of quicksilver received this year from Batavia, which pursuant to the resolution of the 6th of this month had been intended for the servants, to see whether it might again be disposed of there at the last-paid advance of 65 percent, the servants having shown their apprehension that they will not succeed according to wish in this matter; declaring that it was only through extraordinary good fortune that 190. 27 Sep last year one had got rid of the 1000 pounds that were then on hand at the aforementioned advance; at least that the buyer who took the parcel then was still stuck with it, while the prospects for the future shortly thereafter were so bad that one dared ask nothing for it; furthermore that the outlook being still just as disadvantageous, they, the servants, found not the slightest possibility for the disposal of such a considerable quantity, even were it considerably less than with a 65 percent advance, for which reason they requested that one would please excuse them from this, or else take such measures as one should deem necessary to free them from accountability in this matter: it is therefore, on account of the familiar consideration that one must beware of whatever is too hot or too heavy, and must let it lie, the excuse presented by the servants regarded as a praiseworthy prudence, and consequently decided to present both matters at the next opportunity to Their High Excellencies and await Their High Excellencies' further disposition, but to hold the aforementioned mineral substance here in the meantime to avoid 191 27 Sep risk. In the Batavia packet, circular extracts from their High Excellencies' resolutions of 18 July have now also been received, containing among other things orders: Firstly, that upon sending requisitions, both provisional and formal, there must always be added a note or list of the merchandise that remains in arrears upon the dispatch of that requisition, indicating the year and the time when they were received. The investigation requested on the 23rd of last month from the fiscal of this directorate, the Honorable Louis de Saumaize, concerning the complaint of the master of Ysselmonde, Arend van Deuzen, about the pilots, having concluded and the officer having submitted the following report on the matter: To the Honorable George Louis Vernet, Director on behalf of the Honorable Company's important interests in Bengale, Behaer, and Orixa, together with the members of the Council of Policy. Honorable Sir and Esteemed Councilors, The undersigned fiscal of this directorate, having conducted an inquiry pursuant to Your Honor and Excellencies' resolution of the 22nd past regarding the complaints lodged by the master of the ship Yselmonde, Arend van der Deuren, against the pilots here, has the honor to provide a report thereon, and at the same time to submit five depositions taken under oath and confirmed, all in the presence of the two masters present, Simon Bott and Cornelis van Bratten. Right Honorable Gentlemen, Honored Councilors. It is with proper respect that the undersigned fiscal takes the liberty to complain to your Right Honorable and Honors about an insult inflicted upon him by a party of malicious tongues, which, considering the accompanying documents, must be regarded as without precedent for a person holding an office such as that of the petitioner. It was a few days ago that the petitioner was warned out of true friendship by the junior merchant Iddikinge of the detrimental rumors that were being spread here to the detriment of the petitioner, as appears from a statement provided on the 12th of this month by the aforementioned Iddekkinge, numbered herein under No. 1; and such an insult could not possibly fail to arouse the greatest dismay in anyone who possesses the slightest sense of honor, let alone in someone who holds a public office, and even that of a Judge. For that reason, the petitioner thought he must spare no effort to learn from whom such a malicious accusation was launched. From the accompanying statements and summonses, your Right Honorable and Honors will observe that the petitioner has spared no effort to discover the first informant by whom that matter was spread, and he was in the hope that, with those questioned naming their informant, 203 28 Sep naming them, one would finally discover the first originator, whom the petitioner intended to compel, according to the style of the courts, to make satisfactory reparation of honor. Yet in this his objective the petitioner was disappointed by the last person served with notice, namely the assistant surgeon Jan de Haas. The military lieutenant de Lille declared upon the summons served to him under No. 2 that this accusation was related to him by the bookkeeper Hubert; the latter, being likewise questioned in this regard (see summons No. 3), named the junior merchant Reynard (see summons served to him, No. 4), who, however, declared that when the case was related to him, neither the name of the petitioner nor anyone else had been named. Here there would already have been reason to draw up an action against the one who had reported the petitioner without having been told such by another. However, in order not to make a misstep, nor to take anyone by surprise unawares, the petitioner requested the aforementioned clerk Thoft to serve notice to the aforementioned Hubert once again and to ask whether he persisted in his statement, namely, that the junior merchant Reynard had attributed this to the petitioner. He then altered his previous statement upon his notice No. 5, namely, that the latter had indeed related the case, but had not added the petitioner's name to it; that it had nevertheless been told to him by others whom he could not name. The reasons he gives for this are so poor that the petitioner could easily understand that they were merely seeking to dupe him and prevent him from getting to the bottom of the matter; thus he intended to compel the aforementioned Hubert through other means to name his informant, in order to apprehend the same as the slanderer. Yet a remedy was also found against this, for the aforementioned Hubert declared (see declaration No. 6) shortly thereafter that the case was told to him by the assistant surgeon 204 28 Sep assistant surgeon Jan de Haas, with such circumstances as can be seen in that paper. From all the devious ways that the aforementioned Hubert took, with his contradictory answers given up to three times, everyone had to doubt his statement, and from what was declared by the assistant surgeon Haas, it also appears that his last declaration is contradictory, for he pretends that the aforementioned de Haas said such to him while they were both sitting in front of the door of the officers' guardroom; however, de Haas contradicts this, saying he did not relate it to Hubert, but that the latter heard it because it was related in his room. How little this resembles a pure truth could easily be demonstrated if one cares to pay attention to these clear contradictions, and one can plainly see that everything was merely fabricated to leave the petitioner in the lurch and to forcibly make him bear the imputed blame without having the slightest chance to clear himself. On equally loose ground stands the statement of the said De Haas that the provisional assistant Jan Jansen had publicly recounted this incident in the lodge; for when asked about this, see sommation No. 9, he completely denies it. Thus De Haas in this case would certainly remain culpable, whether he had invented all of this out of a sort of spitefulness, on account of a reprimand given to him some time ago by the petitioner concerning violent treatment at the house of a certain Portuguese woman who had come to complain about him to the petitioner; since what he alleges is refuted by others. However, since the petitioner finds no ground to hold him principally liable and thus runs the risk of retaining that insulting name, he finds himself forced, for the preservation of his honor, to employ other means. He does not doubt in the least that Your Right Honorable and Honorable Sirs will agree with him that this accusation is as insulting as the incident is shameful; and the petitioner readily acknowledges that if he were capable of committing such deeds, he would never deserve to hold any office.
