Armenian Alexander Satoer first, and subsequently the fellow Armenians named by him and others, who were thought to be able to provide the required light in this matter, were properly interrogated accordingly, as appears from the sworn statements respectfully attached hereto of the aforementioned Alexander Satoer, item Satoer Ogas, Ioakim Pokos, Iohannes Padre aerd Oan Jan, Iohannes Aokkerton, Wartanes, Michiel Seruman, Choja Philippus, Aratoen Satoer, Wanis Samuel, and Zarkias, without the papers nevertheless being found to contain anything relevant to the matter, since these people testify to have seen nothing, but to have heard from one another that on a certain night some insolence was allegedly committed by Europeans at the house of the Armenian Bejan residing here, and which man, being thus the only one who must know if any violence was used against him, explicitly denied such in his declaration confirmed today under & N:; so that what was spread to the detriment of the aforementioned Fiscal, as if he had also been among that party, cannot be regarded as anything other than loose and false talk, whose first distributor it were to be wished could have been discovered to receive his well-deserved punishment, the undersigned therefore declares by this that he considers His Honor completely innocent in this matter, and also for the said reason can institute no action against others. /was signed/ M:s Koning. /in the margin/ Hougli in the Fort Gustavus the 10th October Ao 1768. 233 14 October had appeared obscure the statement made by this ministry in the letter of 11 January 1766, as if the Patna servants had, among other things, in the book year 1764/5 also disposed of the spelter with reasonable advances, whereas the same had run 30 per cent below the price for which that article was sold in March of the last-mentioned year at this head office, and that if no spelter had been sold at Patna since the ultimate of August 1764 with a higher advance than what has just been mentioned, their Right Honourable Worships could not then consider it at all a reasonable advance; it was thus understood to conform completely with all the answers, but in order to supply the required elucidation in this matter, it was also approved to demand of the invoice keeper Haghadamius not only to investigate the cause of the difference in the aforementioned selling prices, namely whether that which was sent to Patna was also sometimes charged higher than that sold at Hooghly, but also at the same time to investigate for what advances that metal has been sold at the aforementioned office since the ultimate of August 1765 until now, and to serve a report in writing on both matters. 234 14 October Permission granted to Lindstedt to remit some money. Before the members who had appeared in the assembly hall upon the convocation issued by the Honourable Director took their seats, the Merchant, Trade Bookkeeper, and First Warehouse Keeper Johannes Matthias Ross made known his contention that the rank belonged to him above the Merchant and Pay Bookkeeper Martinus Koning, partly because he had to be considered senior in capacity to the said Koning, since according to the deed received this year his salary and contract commenced on the day he entered into the actual exercise of his aforementioned functions, or the 7th of February 1766, and thus more than four months earlier than the repeatedly mentioned member Koning, whose capacity, salary, and contract according to deed commenced on the 24th of June of the said year; secondly, because the orders issued from time to time by the Honourable High Indian Government concerning rank, as appears from their respected letter to this Directorate of the 13th of August 1754, all amount to this: that the same must be arranged, not according to the year that someone became merchant or junior merchant, but according to the time that he has been a member of policy, that is to say, that he who first obtains a seat has and must retain the rank and precedence before all those of his capacity who are later introduced therein, if they hold offices to which sitting in the council is attached; so that he, Ross, in his opinion, without looking to the seniority of the capacity, on the grounds of this very clear decision, ought otherwise to precede, as having had a seat in the council almost two years before the merchant Koning, with the request that it might now be disposed in his favor in that regard; while the merchant Koning on the contrary maintained the opinion that, since he obtained the capacity of merchant from the Lords Directors on the 21st of October 1765, the appointment of a few months later ought not to serve to his prejudice, but that he, as having been junior merchant before, ought to take precedence. 237 18 October Deliberation on this, and resolution to give Ross precedence. Insertion of a report concerning the Lords' dues. Profit: ƒ 67.17.-, 96¾ per cento. According to the above return, it appears that the same was sold here 31½ percent dearer than at the Patna office. and guarantor Clement Fernandes, in case she should happen to triumph in the case of appeal; as indeed has happened, according to the note accompanying the last-mentioned resolution. Although the petitioners now have in their favor the first petitioner and the Honorable Rietveld, namely, that both, as evidenced by the Council of Justice's own Report, were opposed to the discharge of the said guarantor, this nevertheless seems of no use to them, as the question concerning it is already a settled matter by the first resolution. But since the petitioners therefore believe they have well-founded objections against the matter in question, they humbly request permission to bring them, if only in consideration of what they as salvagers of an estate are obliged to do, under the penetrating eye of this assembly. Let it first be established as a premise that the acts executed mutually by the guarantors in the aforesaid lawsuit on 25 and 29 April 1765 before the second petitioner, as the then first sworn clerk, merely bind them for and toward the satisfaction of such costs as the parties might be condemned to pay by sentence of the Honorable Council of Justice of this office; and let it then be deduced from this whether, if the matter were in such a state that the now-discharged guarantor could still be addressed, it would be possible to claim from him with any right the costs that the appellant was forced to incur in order to obtain redress: if not, then it goes without saying that such cannot be demanded from the members of the Council of Justice. But besides this objection, there is another; namely, whether the sworn clerk Thott, although positively ordered by the Council of Justice to serve Triglaff, could and should not have continuously addressed him or his guarantor during the lawsuit for and toward the satisfaction of that which was legally due to him for his trouble; or, if he wished to wait until after the outcome of the lawsuit, whether in such a case it was not his responsibility to take care that Triglaff's guarantor was held bound and liable at least for the payment of his salary, instead of drawing up a petition for that man for his discharge, without having secured himself? If so, then this item also has no connection with that for which the members of the Council of Justice are charged. If now these two conjectures or suppositions are not unfounded, it would likewise follow naturally that the Council of Justice, insofar as it is genuinely held to the indemnification of damages, can only be addressed for those costs which constitute the first item on the warrant, or the rupees 1670: 13 paid by the plaintiff, in accordance with the judicial declaration, to her solicitor and the secretary of Justice here. However, since the first petitioner and the Honorable Rietveld, as said before, have the testimony of the entire college on their side that they were of a contrary sentiment, they therefore humbly implore Your Honors to be allowed to remain exempt from any contribution in this matter, or, if that cannot be granted to them, that on the basis of what is stated above, their portions, after deduction of the Batavia expenses and the salary of the sworn clerk Thott, may be reduced pro rata and remain deposited in the Company's treasury until such time as the Honorable High Indian Government shall be pleased to declare itself concerning the dispositions taken in this matter. And a record of the differing opinions raised hereupon, after the first and second petitioners, as involved in the matter, had stepped outside, and the matter being maturely deliberated, various considerations were raised about this, which, in accordance with the proposal of the Honorable Director and the unanimous approval of the other members, are recorded verbatim as follows: The Senior Merchant and Head Administrator the Honorable Menso Isinck and the Junior Merchant Haghadius both declared themselves to be of the opinion that the Council of Justice could not be held liable for errors committed by them, especially in civil cases. The Merchant Koning maintained that the expenses incurred here must be reimbursed without distinction by the members who sat in judgment on the discharge of the guarantor, and this because the guarantor had interposed himself for that purpose. The Fiscal de Saumaize, on the contrary, believed that the members who discharged Treglaff's guarantor ought to indemnify Maria Fernandes for all the expenses incurred by her, thus excepting those of the sworn clerk Thott. At the beginning of this business, there was read out beforehand the written objection of the merchant and pay bookkeeper Martinus Koning concerning the rank which he was obliged to cede to the merchant Johannes Matthias Ross at the session of the 10th current, reading as follows: The member of this assembly, the merchant Koning, having been permitted, upon his request at the meeting of the 18th of this month—when it was initially resolved to give the merchant Ross a seat in this Council above him, on the grounds that his contract and salary as such had already begun on the 7 Feb 1766, or since the date of the provisional appointment to his present functions of first Warehouse Master and cloth bookkeeper, and thus 4 months and 17 days earlier than that of him, Koning, as well as that he, Ross, had also obtained a seat in the Council long before the other—to submit his interests against this, finds himself obliged hereby to set down the same as follows: that although the earlier commencement of the contract and the salary, to which the said Ross seems chiefly to appeal, as existing in truth, cannot be contradicted, it is nonetheless utterly impossible for him or anyone else to demonstrate that he would therefore be the senior merchant, since the election of him, Koning, to that quality in the Netherlands already occurred on the 21 October 1765, and consequently nearly four months before the commencement of Ross's contract and salary, so that one must proceed according to the date of the effective appointment, although not immediately with the granting of the salary standing for it, and consider him, Koning, 279 to propose to remit money in cash accordingly from that day forth as an actual merchant, as well as to draw from this as a firm consequence thereof the rank and seat granted to him upon his installation in this assembly on the 24th September of the past year in accordance with what was resolved on that day, after the merchant Lafont, and thus above the aforementioned Ross, who also at that time objected as little against it as it would be possible for him to base the contrary thereof, or that such at that time might have been ill-conceived, with any appearance of reason or fairness on his earlier seat as titular merchant, because the same cannot say to have had that for anywhere near as long as an actual merchant as he, Koning, and thus that the rank belongs to him above him; for if such could stand, then the merchant Humbert, who likewise, like the member Ross, held a seat in Council before him, Koning, as a titular merchant, would also have the right to claim the same from him; all of which he, flattering himself to rely on good grounds, hopes may be taken into consideration, and inserted in the resolution of today's date, as well as presented to Their Excellencies the High Indian Government for his justification. / was signed / M:s Koning / in the margin / Hooghly the 25 October 1768.
