301 25 October A missive of the 17th still being presented, showing how they, the servants, in the year 1764, in view of the then already with ƒ1947. 10. in arrears and ever increasing account of charges on private shipping, which annually ƒ689. 14 as a fixed wage of the servants charged to the same enjoying their wage, without so much being able to be written off against the collected silk in kind, this administration had requested to be allowed to charge 3/16 instead of 1/6 per cent to the silk on the invoice, in the hope that that account, by means of a larger collection and dispatch of silk, would thereby gradually decrease much and finally be cleared; but that, because against their wish, due to the small quantities of silk that had to be purchased and dispatched since that time, the same had now already increased to ƒ3061. 83, they, the servants, considered themselves obliged to bring this matter to the attention of this meeting with the request, in order to prevent an increase thereof and the remaining in arrears of the same, henceforth to be allowed to charge still more and at most up to one per cent of those charges 302 25 October charges, on the invoice on the silk, in order to thereby get that account settled once and for all: it is, considering that such cannot well take place without noticeably depressing the purchase price, deemed best and consequently resolved, to order the servants to open a new account for the aforementioned charges for the coming year, under the name of Charges on private shipping new account, and to charge therewith the silk that is prepared in that book year; in order, because a fixed sum of ƒ57. 9. 8. light money or ƒ689. 14 per year is spent on these expenses, to arrange it so that one may have a clean account every year, namely by continuously making an estimate on the collection, and burdening the silk pro rata with the aforementioned charges, so that at the closing of the books whatever the account of charges on private shipping is found to be in surplus or in arrears can be balanced against merchandising expenses: but in the meantime to let the old arrears continue, until authorization for the writing off of 303 25 October Resolution to assist the servants with the ready money 5000 - 125766 — of the same shall be obtained from the Honorable High Indian Government, to whom, for that purpose, a request will be made shortly. 307 last of October Note of the finding of some Dhaka goods Monday the last of October Anno 1768 in the morning, absent the members Linner and Lafont. Before proceeding to the deliberation on the matters that are to be dealt with hereafter, in accordance with the proposal of the Honorable Director, the assembly having proceeded to the Trade Warehouses in order to inspect the linens to be named hereafter, namely: Dhaka Letter A Tanjibs first sort, second ditto, third ditto, fourth ditto, all long 39 to 40 broad 1 3/8 to 2 covids. The merchant Rossen is of the opinion that, the post of Chief of Patna being a merchant's position, it therefore conflicts not only with 313. ulto October reason and fairness, but also with the order and intention of our Masters and Lords, both in Europe and in Batavia, that an Under-Merchant is appointed thereto while there are merchants available; as appears from various of their High Commands, among others by the Missives from the Fatherland of the 11th of October 1749 and 18 September 1750; likewise from Batavia of the 3rd of July 1700 and 5th of August 1729; tending principally to the effect that in the distribution of offices it should be observed who in fact are the nearest, preferring the senior over the junior, and that promotions must occur without leaping over others. And since he is one of the petitioners for that post, he finds himself all the more aggrieved over the nomination of the Under-Merchant Falck as Chief of the Patna Factory, because his High Superiors will inevitably have to draw the conclusion that incapacity or other bad qualities of his moved the Lord Director and Council to this leap. It having furthermore been seen that at present, provided there is a regular progress in the minting, there would be a chance for the sale of 4000 marks of bar silver at the previously established price of f 32:3:13, it has been resolved and understood, considering that the servants also flatter themselves with being able to obtain enough cash on bills of exchange for the coming year, to prefer the latter, not only to avoid the risk involved in sending the silver, but also as it corresponds with the orders issued on this matter by the Honorable High Indian Government. And resolution to carry this into effect. 327 329 should weigh anchor from Higelij and set sail; whereby, as has now been experienced two years in succession to our heartfelt regret, one sometimes ran the risk, if not of accidents, then at least of the wetting of bales due to rain striking the vessels, regardless of the precautions taken against it; that the smallest of the coarsest and heaviest bales were indeed already on board, but that at present no more could be transferred until after the ships had arrived at Higelij: wherefore the aforementioned Lord Director, before proceeding to a resolution concerning the shipment or non-shipment of the goods, proposed to the assembly to hear beforehand the address of the aforementioned Master of the Equipage as to when in his opinion the ships might be able to set sail and be at Higelij; item, whether the vessels, if one were to dispatch them, could lie safely enough in the creek at the aforementioned roadstead to remain waiting for the ships for some time, if it could not be otherwise. 22nd 335. 8 November from the Council of Justice; having no session in this meeting; for the guidance and observation of those who will now be employed for this purpose, and as an example for the future, had drawn up the following: Instruction for the Fiscal and commissioned members from the Council of Justice, to serve as guidance during the clearing and mustering of the return ships. Although it is hardly feasible in matters subject to change to devise a fixed and determined order, we shall nevertheless set down hereby various points that commonly must be observed in dispatching the return ships, and have, so to speak, become a permanent practice. 1. Upon their arrival on board, the Fiscal and commissioners must inquire whether the goods shipped from here have been taken in and stored in proper places; if anything cannot fit in, to investigate where the problem lies; to redress this, if feasible, in consultation with the Master of the Equipage; but if it cannot be remedied, to communicate the reasons given by the ship's officers by means of a brief note to the Noble Governor and Council at the Cape of Good Hope: bearing in mind in such a case that, pursuant to special orders of the Lords Majors, the permitted chests must be moved from the hold into the gunner's room, cabin, or fore-cabin, wherever is most suitable. 2. Also, according to the order recently received from Their Nobilities 336. 8 November the High Indian Government, the ships must be inspected before their departure to see whether any illicit goods have been concealed therein; and upon finding such, the Fiscal must immediately seize them and bring them hither, and together with the commissioners give notice of the person who has made himself guilty thereof to the Lords Directors of the Chamber for which the ship repatriates or to which it is addressed. 3. In the event that bales of linen have become wet along the way, such that the ship's officers and your honors have objections to shipping them, they must be written off the invoice with the utmost precision and sent back hither. 4. During these proceedings, to inquire whether the ship is sufficiently manned, keeping in mind that each return vessel ought to have a strength of 105 heads or thereabouts. If there is not enough crew, or otherwise too many, then to make transfers from one ship to another. 5. The ship having been cleared, to muster the crew, and if this or that improvement ought to be made, or persons are taken into service, they shall grant them proper deeds, which shall be signed by the three of them by order of the Director and Council of Hugli, first administering the oath of loyalty and obedience to the Honorable Company to the newly hired, and in general, charging all of them for stamp, registration, and booking fees on the expense account. 6. If there are Eastern male slaves on a ship, they must 337. 8 November must be taken off and brought hither at the disposal of the owner. 7. To write a letter concerning all proceedings on board to the Noble and Honorable Lords Directors at the Chamber to which the ship is addressed; sending the muster roll of the Zeeland ship to the Gentlemen of Amsterdam, and vice versa that of the Amsterdam ship in the letter to the Gentlemen of Zeeland, or the other Chambers, as the circumstances of time require. 8. Now, besides these permanent rules, of which a strict observance is required, your honors presently have the commission, if the gunnies and gunny bags for the Cape of Good Hope cannot be conveniently stored in Scholtenburg, to transship the same into Vlissingen, write them off the invoice, and give notice thereof to the ministers there; likewise, should it happen that Scholtenburg cannot take in some of the goods from the Fatherland, your honors will have to send the same back; giving preference in the return shipment to the bulkiest goods. 9. 338 8 Nov: Resolution to approve the same. Insertion of some complaints concerning insolence committed by a Skipper. who have signed the same. For the rest, we are Your Honors' good Friends, thus, after the reading thereof, it was approved and agreed to comply therewith and consequently also with the orders set forth therein, aside from that which must be done permanently, for the present; namely, that the gunny bags planned for the cargo of Scholtenburg for Kabo de goede Hoop, should they prevent the loading of the goods from the Fatherland, shall be transferred to Vlissingen, and likewise, upon the return shipment of these, to take the coarsest instead of the fine, with which, in the other arrangements mentioned therein regarding the taking of oaths on depositions relative to matters that will be discussed hereinafter, the said Instruction shall henceforth always be altered or amplified as cases may arise over time. These matters having been established, the Honorable and Respected Lord Director produced, by way of a complaint concerning the disorderly and arrogant conduct of the Skipper of Ysselmonde, Arend van der Deure, toward him, the Lord Director, the following document to be read: "Recently, the comforter of the sick, Benjamin Geel, then stationed on Vlissingen, came to me requesting to be transferred to Ysselmonde, because he, 245 339 8 Nov: being sickly, wished to remain until his full recovery, and since there was no visitor of the sick on that vessel, I granted him an order for the last-mentioned vessel. I told him that the man had made such a request to me for the reasons stated above, and that, being inclined to do everyone a favor when no one is harmed by it or the service neglected, I had given him his order and was not fond of breaking my word. I submitted to his consideration whether he would not also like to be granted a favor when requesting such, and whether we were not all there to do each other service and favors, and that such a man could in no way be in his way—truly a gentle manner to make a man, to whom a Director owes no account of his conduct in such a matter, understand reason. But he told me that the man was too pious, that he had no liking for such pious people, that he had not come to him beforehand to ask his consent, and that on Batavia no one engaged in placing comforters of the sick except ministers. Whereupon I replied in a gentle and laughing manner: 'Well, Captain, Your Honor will surely admit that I have as much authority here as a minister at Batavia,' but 340 8 Nov: which are affirmed by two members he then added in an arrogant manner that I had no power to remove anyone from his ship or place anyone on his ship without his consent. Whereupon I said to him: 'Because you are so arrogant, the comforter of the sick shall remain on your ship, and if Your Honor pushes arrogance too far, I will show that I even have the power to remove you.' Whereupon he went away. All this took place in the presence of the two gentlemen named here, to whom I said after Van der Deure's departure that if he had continued to make his request in a decent manner, I would have pointed out to the comforter of the sick that it would be better for him not to be on a ship where he would certainly experience displeasure, and would have given his order for another ship." It is for those reasons and by virtue of the permission contained in the aforementioned instruction that the suppliant addresses himself with greatest respect to your Right Honorable and Venerable, requesting that the said comforter of the sick may be taken off his vessel again. The Merchant Koning is of the opinion that the Lord Director certainly has the power to transfer such persons as comforters of the sick; and, together with the Fiscal de Saumaise, declared the master's conduct 345 8 November: to be very offensive, yet both found themselves hesitant to remove him from his vessel. The Members Humbert and Haga Damius imagined that if the Lord Director were pleased to be satisfied with a request for an apology, it would then be best to mediate the matter and let the master retain his ship; but since the Lord Director testified that such was now no longer appropriate, both the aforementioned members declared that, in order not to impair authority, an example must be made of van Deure. And now that the majority inclined to leave the master on the ship, the Lord Director declared that he found it extremely strange in an assembly that was bound to maintain subordination with him, that it showed so little deference for the infringements that authority would continuously have to suffer in such a manner, and on that account, he could not take it upon himself to continue at the head of affairs, but from now on, at the expense and responsibility of those who hold such contrary notions, or find difficulty in conforming to his proposals, would lay down the governance, as His Right Honorable thereupon immediately went outside the meeting; the members free

The Merchant Ross declared that his previous sentiment had not aimed to injure the authority of the Lord Director, as he found the conduct of the skipper utterly condemnable; but that he had only shown hesitation on account of an insufficient experience in the orders concerning the removal of Skippers; yet, to choose the lesser of two evils, he also maintained it to be most appropriate to conform with the proposal of the Honorable Lord Director. The decision having now been taken in this manner, namely to remove the aforementioned Skipper van der Deure from the ship IJsselmonde, and, in accordance with the proposal of the Lord Director, to send him to Batavia at the disposal of the Honorable High Government of the Indies, his Honor was requested by the members in body to honor the meeting with his presence again; which having taken place, and the Lord Director having taken his seat, the aforementioned disposition and each person's sentiment thereupon was distinctly read to his Honor, and thereafter it was made known by him how, upon the impending departure of the Honorable Lord Looten from Ceylon to Batavia, his Honor had first made a trip to the roads to inspect the ships in order to choose one for his transport ship, and that since on the ship that pleased his Honor there was a Skipper for whom he did not have much inclination, the Lord Governor had proposed to that man to exchange vessels with another whom his Honor wished to have; but that this man, having opposed this and appealed to orders that deprived a Governor of the power 348 8 November to remove a skipper from his ship, the said Lord Governor had brought this case before the assembly, by which, in accordance with his Honor's proposal, it was resolved to change the skippers of the ships, and to place the one his Honor chose upon that vessel which had been selected for his transport, without this having been disapproved by the Honorable High Government of the Indies; that the Lord Director, since the supreme command in the various places in western India was not accorded any more dignity or authority whether it was occupied by a Councillor of the Indies or not, and that since his Honor, concerning the transfer of commanding officers, had never acted otherwise than after having taken advice from the chief officer of the ship, could therefore not see how that which had now happened to the Lord Director could be regarded as anything of an entirely different nature, extending quite far toward the mockery and contempt of the authority entrusted to him, which in any case, whether it happens to a Governor or a Director, ought to be opposed, for the maintenance of good order and the respect that an inferior owes to his superior. Verspyk, in the presence of the Fiscal L. de Saumaise, upon the gross weighing of the hereafter mentioned spices in the trade warehouses, were found to be short, to wit: 61 lb on 45 chests which according to invoice must contain 1350 lb cloves and 3141 lb nutmeg net, and conform to the 353. 8th November memorandum of the commissioners at the main place were weighed out to the ship officers at 6550 lb gross, however upon reweighing here only found to be 6489 lb gross, thus an underweight of 61 lb gross, or 7/8 percent approximately. 40 lb cloves on 45 chests entered by invoice at 3692 lb net and according to the abovementioned memorandum weighed out gross to the officers of that vessel at Batavia at 5830 lb, from which deduct the 7 chests that became wet according to the report of the special commissioners, the junior merchants Herklots and Iddekinga, which weighed at the main place 913 lb, leaving 4917 lb gross for 38 chests which here only weighed 4877 lb gross, and thus 40 lb gross in underweight, or 13/16 percent. 49 lb cinnamon on 63 bales which conform to the entry by invoice must contain 5040 lb net and according to the aforementioned memorandum were weighed out to the ship officers at 5606 lb gross, however upon reweighing here only found to be 5557 lb, thus an underweight of 49 lb gross, or 7/8 percent short. 23 lb mace on 15 suckers, in which conform to invoice must be 2310 lb net, and which, as appears from the repeatedly mentioned memorandum, were weighed out to the officers of that vessel at the main place at 2545 lb gross, however here only found to weigh 2522 lb, therefore 23 lb gross in underweight, or 15/16 percent short. That, examining the cause of the same, they had to judge that this occurred partly because, having put to sea, they had noticed that there was a leak in the ship; that inspecting the same, they had found it in the stem seam, and along the deck beam under the ports, and that thereby the water had continually forced its way through due to the pitching of the vessel, despite all efforts taken against it.
