341 223. /. The 29th October Anno 1768. To send back the Easterners placed on the ships with their vessels, and to grant 5 Bantamese priests transport to Mocha. The further content of the letters. and to observe the models for closing the trade books. attached thereto, upon a haughty reply from Bombay, could not be attributed to anyone other than the English themselves, Their High Noble Excellencies, in order to reinforce the Surat ships, having ordered on each of them a detachment of twenty-five Easterners, with the express desire that those people return towards Batavia with their respective vessels; so it was understood most obediently to comply with that order, as well as to grant free transport upon their return from Mecca to five royal Bantamese priests named Isafi, Baskie, Djamiel, Khair, and Sanang, who arrived here with permission from Their High Noble Excellencies by the three ships currently present, in order to proceed to the aforementioned Muslim place of prayer. The further content of the general letters, as well as the circular missives, extract resolutions, etc. received alongside them, dealing with nothing other than remarks and positive orders, so it was understood to be dutifully and accurately complied with, and particularly to cause to be observed the sent models serving for instruction in forming and closing the trade books in Surat, according to what was proposed by the Senior Merchants of the Castle of Batavia, in an extensive report submitted regarding this and approved by Their High Noble Excellencies, containing: "Report regarding the treatment of the intrinsic value of the coin species, and the resulting change in the pre- and post- 230.. The English Captain John Rezel having left the Batavia Roadstead without saluting the Dutch flag, not the least convenience, beyond water and firewood, must be shown to him, before he has given public satisfaction. The renewed ordinance on the small seal, and the regulation on the reform of the servants, must be strictly observed, and action taken with rigor against violators. 2. Those who receive their seals from Batavia must make a requisition for two years in order not to run into embarrassment. The order is renewed that the qualified muster roll must be sent to Batavia twice yearly; once shortly after the muster, and once in between. It must also be accompanied by a short list of the qualified and further actual servants, stating the year of their promotion to the ranks, and the year of their provisional or absolute appointment to the offices they hold. 3. If this is not done, the person upon whom it is incumbent shall forfeit one month's salary for the benefit of the poor of the Diaconate at Batavia. 236. The 29th of October Anno 1768. 2. Thus Their High Noble Excellencies order that everyone will have to conduct themselves punctually accordingly, and in particular that no actions are taken contrary to the permanent orders regarding the accepting of money on assignment, or the drawing of bills of exchange, certain fixed sales and purchase prices, and whatever else pertains thereto. Care must also be taken that no foreign coin species that have no fixed exchange rate are accepted, under penalty that the resulting loss will be charged to the account of the receiver. 3. The pay books suffer not the slightest change through the aforementioned arrangement, but must be continued on the present footing with the payment of wages; and the provision of monthly allowances, likewise with the board wages and rations, and whatever else has reference thereto. Circular Letter dated Batavia the 15th of January Anno 1768, and Received Here The 13th of October Anno 1768. Order that punctual compliance will be given to the Extract Resolution of the 15th of January Anno 1768, whereby it was ordered: That notwithstanding the ordered altered accounting of coin species in the trade books, nevertheless the exchange rate of the coin species among the public or the current value thereof must remain on the present footing without the slightest change. From the fixed percentage profit on some trade articles at sale or also certain fixed selling-off prices in guilders, stivers, and pence, no deviation may be made except in proportion to the fixed trade monies. Consequently, just as many pieces of money must be provided for the same quantity and type of goods as to date, in case no more can be stipulated. At purchase, no more must be paid out of the treasury than took place before the reduction. The trade monies chosen for each factory consist of the following, to wit: For Batavia, Colombo, and its subordinate factories, Cabo de Goede Hoop, Java Cheribon, and Sumatra's West Coast, as well as all factories around the Great East: The milled ducaton of 66 stivers. Malacca, Bantam, Palembang, Jambi, and Banjarmasin: The round Spanish reals of 54 stivers. Coromandel: the pagoda of 90 stivers. The opposite coast of Ceylon, Tuticorin, and its subordinate factories: the pagoda of 83 stivers. Bengal: The sikka rupee of 25 stivers. Surat and the Malabar: The Surat rupees of 24 stivers. China: The tael of 72 7/5 stivers. According to these trade monies, everything that is collected at those factories must be calculated and accounted for in the trade books. The remaining balances having been closed in two columns with homeland and Indian money, must upon the new books under 1st of September 1768 again be entered in Dutch money, and the credit and debit accounts with their amounts in rupees and guilders. 240. The 29th of October Anno 1708. The money from the sales shall then be counted into the Cash. The Company shall itself furnish the paper for the stamps. The stamp duty must be paid with the following surcharge, namely: Stamps of 6 and 12 stuivers with 1½ stuivers. The paraphers three quarters, the collectors one quarter. Stamps of 24 and 36 with 6 stuivers. Stamps of 3, 6, and 8 rixdollars with 12 stuivers. The paraphers shall share equally, but the collectors shall enjoy the surcharge pro rata of what they have sold. Stamps of 10, 12, 15, and 20 rixdollars with 24 stuivers. And of 25 rixdollars and above with 1 rixdollar. For all stamps, large or small, no other paper shall be used than small format, with the exception of parchments. Whoever writes a deed, petition, commission, pass, or other document on unstamped paper, or on a stamp other than the one designated for it, shall forfeit 150 rixdollars for each instance if the drafter or exhibitor is a secretary, notary, attorney, or other public person. However, others shall forfeit only twenty-five rixdollars if the stamp they ought to have used does not itself exceed that amount; and otherwise double the amount thereof. Whoever remains negligent therein shall forfeit 25 rixdollars each time. In order that stamps which have served as a cover may not be used a second time, all stamps attached to writings must be endorsed, on the side where the stamp is situated, with the day, month, and the year when, and the name by or for whom that writing is presented or is to serve. Without prejudice to the old order that all stamps serving as covers, and which are not written upon in the manner described above, must be torn by the secretaries of the boards immediately after delivery. 242. The 29th October Anno 1708. Under the Cargoes being primarily included all Surat silk garments, western linens, or similar contraband goods. From these permitted Cargoes, the ship officers, on pain of severe punishment, shall not sell anything along the way, but must bring the same to the place of their destination, where they shall be free to trade with them according to their own pleasure, without interference from anyone. If they take over Cargoes from the Sea Chiefs at Batavia, they must ensure they obtain a Certificate thereof and be able to present the same at the place where they arrive, in which case they shall pay half the Toll on those Cargoes as well as on their own. For the rest, all orders and regulations regarding the limits of private trade remain in full vigor. Extract Resolution of the 15th December Anno 1767. All private importation of Wheat at Batavia, not excluding the permitted Cargoes of the crew members, is prohibited, on pain of confiscation and four times the value thereof to be divided between the officer who shall make the claim and the informer. A general mortgage under seal and acts passed before an authorized clerk must mutually be preferred according to seniority, in such a manner that an older aldermen-deed precedes a younger notarial one, an older notarial one precedes a younger general mortgage under seal; and all these again before all private bonds, whatever might also be specially pledged thereby, whenever that exceeds a sum of 50 Rds; all not only with respect to original creditors, but also to the guarantors who have acquired the right to take action. Those who make claims on one and the same keel by virtue of Bottomry bonds must be admitted in equal portions, or pound-for-pound, since Bottomry bonds must not be considered according to the date they were made, but according to the day the ship departed from the roadstead. However, these bottomry bonds have preference over those that are passed when calling at one or more places on the voyage out or return, although to the same, with respect to the places where they were passed, an equal privilege must nevertheless be given. Also, with bottomry bonds, that which is stipulated by the ordinance on the Small Seal of the 29th September 1767 must be observed, namely: That no bottomry bonds on the Honorable Company's ships shall be granted unless it is declared therein that the moneys or goods will not be applied to any prohibited trade, on pain of, etc.; and that, moreover, on bottomry bonds in which the said clause is not stated, no judgment shall be rendered. All those who are authorized to hold public sales have a legal or tacit mortgage in the first place upon the sold goods, when those are still found with the Debtor within six months after the sale; and secondly they have preference over all general mortgages, whether notarial or private, even over all private special pledges that were passed within those six months. Yet in case the sealed deeds and notarial bonds are older than the time of the auction, these retain preference over the legal mortgage of the auction masters.
