By the Honorable President Henricus Leembruggen, there was submitted to the assembly a copy of the Petition presented by the former Cashier Ioannes Haselkamp to Their High Mightinesses, the Honorable Supreme Indian Government; likewise a copy of the penal order decreed by the Honorable Court of 117 of Justice of the Castle of Batavia, issued upon the request of the aforementioned Haselkamp, and finally an Extract from Their High Mightinesses' dispatch dated December 4 last, relating to both aforementioned documents, and after resumption of the one and the other, having appeared with surprise that there are demanded from here such charters, books, and papers, as well as the moneys and goods without exception, which on August 20, 1767, might have been in the custody of the alleged Curators, the Fiscal Cantervisscher, or whomever it may be, since the said condemned Haselkamp ought to be well convinced that none of his papers of whatever name have remained here, at least not with the Court, because on September 3 last, when he was about to depart for Batavia to pursue his case there in appeal, all his papers which were held in custody by the Secretary of this Council were returned to him, of which it was not deemed necessary to take a receipt or written proof, because it was done in the presence of two commissioners and

commissioned members of this Council, Jan Appengh and Dirk Buijs, who affirm the same, and testify that he was content with it at the time, and spoke of no other papers or documents; the President and all the members of this Council declaring that no charters of the said Haselkamp are among them, and specifically, this is testified to by Mr. Cantervisscher, together with his astonishment that he was specifically named in the aforementioned order, and therefore maintaining that the subreptitious and obreptitious means which Haselkamp will have employed in his petition gave cause for that specific nomination, which cannot be refuted by him because the ingredients of his petition are unknown here, and thus he cannot do otherwise against it than to declare in truth and in good conscience that he has never had goods nor papers of that malicious former cashier in his possession, as such also does not belong to his office. Thus it is resolved, for the sake of thoroughness, to have the secretary write further to the Resident of Portonovo, Leonard Campie, who was previously secretary of this Council, whether he might perhaps have any books or papers of the aforementioned Haselkamp; that which was enjoined upon the curators being outside our scope, since they were appointed by the government; furthermore, to keep a record of the above, and to present a copy of this minute to the Honorable Right Valiant Governor and Council of Policy, in order to be dispatched to Their High Nobilities with the first departing letters. In friendly reply to the same, I must inform Your Honor that I have no books or papers of the former secretary and cashier Johannes Haselkamp in my possession, as all of them were taken from his estate by the curators; nevertheless, I wish to know what is being sought, in case I may provide Your Honor with any clarity in that regard. 20. and upon the obtained authorization for access to his papers, which we deemed we would need for that purpose, we proceeded, together with the fiscal of this capital place and two commissioner members from the Honorable Respected Council of Justice of this Castle, assisted by the secretary of said Council, to the dwelling of the mentioned Haselkamp. Arriving there, we found all his writings, both in the front hall on the ground, on a table, and in a room also on the floor, scattered far and wide, and mixed up with one another in such confusion that we had fully two days of work to gather the necessary ones together, so far as one could trace and find them from the other papers. Furthermore, setting to work, we found that almost all the vendue rolls were defective, consisting merely of rough drafts, written on loose sheets, and on scraps and fragments of papers; nor were these sheets even provided with numbers, and what is more, on many of them neither the day nor date of the held vendues was recorded, nor to whom those sold goods belonged, but instead they were provided with so many marks and references that we frequently made mistakes in them, and repeatedly had to begin the work virtually anew by checking, noting down, and compiling, as your Right Honorable Sir is requested to please observe from the mentioned rough drafts, which are still held by us. These irregularities, caused by a three-year neglect of the matters, also held us up for nearly four months, and only by questioning and re-questioning, both of Haselkamp himself and the servant of the deceased messenger, by the name of Wierappa, were we able to form a proper understanding of the found papers, in order to form from them both a statement of accounts and an orderly vendue book, as well as to draw the vendue bills from the latter and send them around for collection; to which we must testify that we would never have been able to do so if the elucidations of the aforesaid servant, who was always present at the vendues, had not set us right in many respects, for upon questioning Haselkamp himself, he repeatedly declared that due to the length of time many matters had escaped him, and thus our only recourse was to the aforesaid servant, through whom the received vendue moneys were then also collected, yet not without great difficulty and many disputes with many of those payers, as a multitude of them claimed that they themselves were owed vendue moneys for goods sold on their behalf two to three years ago, and therefore desired that their debt might thereby be liquidated or validated in reduction thereof, not to mention many objections of that nature that arose before us during the time of three years that we had to spend with those disordered and unsealed estate matters, and undergoing many impertinent accusations in his submitted writings here in the Council of Justice, as if we had greatly prejudiced him and thus not properly looked after his troubled finances, from which, however, we have most clearly cleared ourselves, and regarded his position in that respect as an effect of his malicious nature. Give to know with due respect, Your Right Honorable and Stern Lordship's very obedient and humble servants Dirk Buijs and Fredrik Willem Bloeme, that whereas the petitioners, having been appointed by Your Right Honorable and Stern Lordship, pursuant to the respected resolution of 6 August 1765, as Trustees in the estate of the former secretary and cashier, as well as vendue master Ioannes Haselkamp here, have to the best of their ability and knowledge, according to the condition in which we found it, everything having been in the greatest confusion and disorder, settled and brought the affairs concerning that estate into that state in which it currently is; yet seeing that this could not have occurred without much trouble and head- breaking, as has been succinctly and respectfully demonstrated to Your Right Honorable and Stern Lordship in the petitioners' report and account of its execution, and the petitioners have had to occupy themselves therewith for entire months and up to the present, to the detriment of the work of their own departments, without as yet having been salaried for this in the slightest amount; so the petitioners turn with the utmost respect to Your Right Honorable and Stern Lordship, humbly praying, in view of the cited reasons, and the trouble had, that it may graciously please the same to grant them whatever Your Right Honorable and Stern Lordship, according to your renowned equity, shall judge to be appropriate. Furthermore, at the aforesaid session of 31 March last, the deliberation on the aforesaid affair, in so far as it concerns the administration, having been postponed until the above-mentioned documents should have arrived, in order then to commit to paper the reasons that had induced this Government to appoint Buijs and Bloeme as Trustees, so it is now unanimously approved and resolved to bring to the attention of Their High Nobilities in rescription to their honored letter of 4 December of the past year: Initially, the late receipt of the order dispatched in that regard, as it was received here no earlier than 26 March last, thus long after the departure of the ship Scholtenburg, or else that order would have been complied with immediately or earlier. And regarding the operative part of the ruling of the Honorable and Venerable Council of Justice of the Castle of Batavia, dictating that the pretended Trustees, the Fiscal Cantervisscher, or any others whosoever they 129 might be, upon a certain heavy penalty to be forfeited to the high authority, should lift the attachments, and should surrender to the attorneys of Haselkamp at the earliest opportunity upon proper receipt, all the charters, books, and papers seized under them, together with the moneys and goods, nothing excepted, which on 20 August 1767 might have been in the custody of the cited pretended Trustees, the Fiscal Cantervisscher, or whomever it may be; and further to render to Haselkamp or his attorneys account, proof and balance of their improperly conducted administration; to show that in the petition presented by Haselkamp to the aforementioned Their High Nobilities, nothing was mentioned about rendering proof and balance to his attorneys, but only that at the first shipping opportunity, whether via Ceylon or elsewhere, there might be sent over to the Secretary of the aforementioned Council, Gijsbert Welgevaren, all the moneys and goods that have remained in existence from the same since 20 August 1767, as well as all the papers that had been found in his estate at the time of his detention. could not have been complied with in all respects, because no one had presented themselves as authorized agents of Haselkamp, nor demanded any account, voucher, and balance; but concerning the further demands made to the curators in accordance with what was requested by Haselkamp from, and granted by, the aforementioned Their High Excellencies, the resolution taken hereinbefore was complied with, including the remittal of that which came in for the account of that former cashier after 20 August 1767. And further, that with regard to the goods demanded by him, this could be obeyed as little as with regard to all the charters, books, and papers found in his estate at the time of his detention, since the former were already sold by public auction, indeed the last on the date of 6 August 1765, and the papers belonging to the secretariat were handed over to the first sworn clerk, while the curators had taken into their possession the defective rough auction rolls (as no auction book was found) in order thereby to look after the interest of the estate, and at the same time that of the Company; and moreover that all other unnecessary documents and bundles of letters had been handed over to Haselkamp upon his departure for Batavia, along with two silver seals, pursuant to a petition submitted to the Court of Justice, the disposition of which, dated 3 September 1767, it was deemed proper to present to Their High Excellencies, whereby, as well as from the minutes kept by that Court on 12 April of last year, and the declaration of the curators mentioned hereinbefore, it became further evident that neither goods nor papers of Haselkamp were to be found here anymore; while the government otherwise trusted that Their High Excellencies, taking satisfaction in the foregoing, would be pleased to consider their issued order as fulfilled with what was accomplished in that regard. Yet it was further deemed proper, in the letter to be dispatched to the aforementioned Their High Excellencies, to state that the government could not, however, fail to observe that the Honorable Court of Justice of the Castle of Batavia, in its Honorable disposition of 25 November of last year, referred to the curators appointed by this government for the estate of the aforementioned former cashier Joannes Haselkamp as pretended curators, and stated that their administration had allegedly taken place improperly, just as if those persons, Buijs and Bloeme, had set themselves up on their own authority and according to their own whim as curators in that confused estate, whereas they had nevertheless been appointed as such by those to whom Their High Excellencies entrusted the administration here, namely the Governor and the Council of Policy, just as dutiful notice thereof had immediately been given by missive of 19 August 1765, without the decision of this government in that regard having been challenged or disapproved by the aforementioned Their High Excellencies. And furthermore, that however certain it was that Haselkamp, through sub- and obreptitious means with which he must have supported his petition, had obtained that Their Honors used those terms of pretended curators and their improperly conducted administration, these were nevertheless too sensitive not to be refuted and to have the reasons demonstrated that had compelled this government to that decision; for Buijs and Bloeme, having been appointed thereto, were obliged to obey the order, so that "pretended" and their "improper proceedings" could not be made applicable to their persons, but had to reflect upon those who had authorized them, namely the Council of Policy, just as if it were not competent to nominate those persons as curators; and from that the questions must not unreasonably result: whether this government was competent to appoint curators, and secondly: such competence being assumed, whether it had not then been necessary to nominate curators for the estate of the unfaithful cashier Johannes Haselkamp! administrator of public funds, either having failed, or lying under the presumption of failing, can then very well be provided for ex officio by the magistrates through the appointment of a curator, and that such was also the case in the estate of an apprehended person, in order to spare expenses. And regarding the second point, to inform Their High Excellencies of the necessity that existed to appoint curators in the estate of Haselkamp, namely that, having been exhorted once again by the Governor to make every effort to settle the petty cashbook, which was at that time nine months in arrears, so that Their High Excellencies' intentions could be satisfied regarding an accurate audit of the same, so that such could subsequently take place monthly; he had continually cast those admonitions to the wind, on the contrary making it his practice under all kinds of pretexts to delay the execution, by which actions, and also subsequently from the confessions of that cashier, it became apparent that he did not possess the money that should have been in the cashbox, and thus was unable to account for the balance. The Governor, however, still exercising the utmost patience with that subject, notwithstanding that a commission for the audit had already been decreed, had granted him another eight days' time to see if perhaps, either through guarantors or collection, the Honorable Company might be indemnified, and he thus could be delivered from the punishment that faithless servants merit. Likewise, the said term having expired, and not the least security for the Company's money having appeared, they were forced, on 6 August 1765, to send the commissioners before the fiscal to the house of Haselkamp, who, returning, reported that the cashier had to account for 18956 pagodas, 9 fanums and 10 cash, or ƒ90770. 12. 8., but that no more in cash was found than 832 pagodas, 15 fanums and 25 cash, or ƒ3996. 13. 8., consequently falling short by a considerable capital of circa 18124. –. –. pagodas, or 86995 guilders. Whether these circumstances of affairs did not demand that, without long deliberation or delay, recourse be taken to such means as could provide the greatest security, shall gladly be deferred to the judgment of all well-meaning and faithful servants; and that intended security was to be found nowhere else than de facto by having the fiscal and judicial members seal all possessions of him, the cashier, and having his person watched by sentries, just as the same, having initially been carried out solely by order of the Governor, was subsequently placed before the assembly by His Honour to ask what further ought to be resolved in that regard, whereupon, it having been taken into consideration by this assembly that he, Haselkamp, as secretary, had all secretarial papers along with the resolutions passed in succession in his custody, and the ship De Vrouwe Petronella Maria being on its departure, with which the submissive letter of this government had to be dispatched to Their High Excellencies, it was resolved to have all papers connected to the secretariat delivered to the First Clerk Campie, so that the writing work could proceed. Likewise, the commissioners De Filliettaz and Pietersz. were ordered to examine the cashbook accurately once more against the warrants since 1764, and to confront them against one another, as well as to submit a distinct report of their findings, for the reason that it had previously appeared that Haselkamp had indeed sometimes forgotten to collect warrants that had nevertheless been paid by him, which could also have been the case now. And finally, to arrive at the purpose intended in this, the bookkeepers Buijs and Bloeme were appointed curators in all the outstanding affairs of Haselkamp, and that all this was what was judged unavoidable by this government or the police, with the further disclosure that that cashier was not yet sub reatu at the time, and the sequestrator could not be placed in it, or else the cart would have been put before the horse, and that much less could the management thereof have been left to himself, because he, who had already acted so faithlessly, would not have done any better now, just as the same, notwithstanding he was in that labyrinth, could not refrain from dishonest dealings by borrowing money from various persons while he well knew he could not pay the same, as was to be seen in the criminal trial, where it also belonged, and to which reference was thus made.

That on the 31st of the said month of August one would find recorded the presentation by the Governor of a Petition submitted to His Honour by Haselkamp, and his acknowledgment thereby of the deficit in the petty Cash, and at the same time giving notice that the absconded former Governor van Teijlingen had indeed at first promised him that, once the papers of the widow Crucius were entrusted and sent to him, he would not only give an explanation of everything, but also assist her, and further endeavor to help him, Haselkamp, to what legally belonged to him; but later, in a letter of 15 August, contrary to his previous promise, expressly denied being indebted to him, Haselkamp, in a sum of 11579 pagodas or ƒ53579. 4. -, whereby Haselkamp declared his inability to pay the Honourable Company the aforesaid 11579 pagodas or ƒ53579. 4., but hoped to be able to satisfy the remainder that he still owed to the Cash, with a request to the Governor to devise a means to save him from total ruin, and that the arrest on his person and property might be lifted. However, the assembly declared that no expedient had been found to rescue him from that labyrinth, since the Cash ought to have been complete upon inspection, without a single doit lacking, but that on the contrary 18983 Pagodas or ƒ91120. in standard coin were found short, or, if one wished to deduct what had been forgotten to be included through the carelessness of the Cashier, 15899 pagodas or ƒ76315. in standard coin, of which he had declared being unable to pay 11579 pagodas or ƒ53579., while professing his hope that the remainder could indeed be satisfied; so that the assembly believed it had acted according to law and equity in ordering the Fiscal of this place to perform his office and duty against that unfaithful servant, who had even confessed to being unable to satisfy the Honourable Company; which disposition the Council furthermore believed to be grounded upon the Company's orders and statutes, of which it was resolved to cite only a few that had come to the knowledge of this Government in this matter, to wit: That regarding Coromandel, Their High Excellencies had ordered under date of 6 September 1794 that all servants who fell short in any moneys under their administration, over and above the punishment (which was established first), had to make cash payment within the time of two months, and whatever was then still lacking would be executed upon their property. That on 29 January 1718 the Honourable Council of Justice of the Castle of Batavia did not hesitate, concerning some deficit in his warehouse, first to confine the Masulipatnam warehouse keeper Steenlak in irons, subsequently to deport him and declare him unfit, etc., as well as additionally condemning him to the reimbursement of whatever should be found in arrears to the Honourable Company. That in the year 1709 the Secretary Borgoigne was whipped for a deficit in his administration amounting only to between 8 and 9000 guilders. And on 8 February 1724 Their High Excellencies had expressed themselves regarding the Cashier Pieter Coutrel, not only to let the Advocate Fiscal contend for a proper settlement of whatever he should be found to owe to the Honourable Company, but also to proceed criminally against his person according to the requirement of law and justice, just as he was condemned to whipping. That when Pieter van der Snippe, First in the Commission of Banjermassing, had first embezzled the Company's funds, and subsequently absconded, on 1 August 1732 Their High Excellencies ordered that the second of that Commission, Carel Breine, be held hostage in irons, and ordered the fiscal to proceed for the indemnification of the Honorable Company, even though it was stated in that same Resolution that if van der Snippe were not in hiding, the accountability for those monies would belong to him alone, and that consequently Breine had sinned only in a lesser degree. And that, because this Government is unaware of any alteration or mitigation of the standing orders, it had therefore made no difficulty in handing over to Justice a subject whose person deserved not the least compassion, if such even had a place in the Company's service, concerning the fraudulent embezzlement of the Company's monies, which he, according to his own written confession, was unable to settle to the sum of pa/o 11579. A subject who had afterwards shown his bad nature even further in insulting his rulers in such a bloody manner, that in case such had to make a settlement, and whatever was then still lacking, his goods would be executed. Although the case of Haselkamp has now become criminal through the aforesaid political disposition, and it could thereby be maintained that when the administration of that unfaithful cashier's estate ought to have been handed over to the sequester; it was nevertheless deemed fit to note that this could very easily have occurred in another place, but was not advisable in this affair, because that estate had to answer not only for Company funds, but also sequestration monies, vendue monies that still had to be received and also accounted for, all treated and handled so confusedly that it was not one man's work to get through it, especially not for the secretary of Justice, who at that time had to act provisionally in the office of secretary of policy, and thus had work in abundance, besides the fact that he had to administer the abandoned estate of the deserted Governor van Teijlingen, and

137 administered, whereby surely one thing and another could not be handled properly, and thus could not but have disadvantageous consequences; aside from and besides the fact that the Curators had already made a beginning with settling that estate, it was therefore also best that they simply continued therein, consequently that through that appointment the most advantageous course for that estate was pursued, as both those persons had the best time to be able to apply themselves thereto, aside from and besides the fact that the First, being secretary of the orphan chamber, possessed the necessary expertise in the management of such matters, and what was still the most preferable in this appointment was that the Curators were not permitted to charge any commission fees, because here the Company's funds were to be accounted for, which one wished to have liquidated first, without prejudice to the fact that, if they could be convicted of fraud, bad or negligent handling, this incumbent on those who had suffered or incurred disadvantage from their administration, in which case they would then be responsible for it, with the further declaration to be made that both those Curators had taken incredible pains in obtaining any light out of the confused state wherein they had found the estate, books, and papers relative thereto, being further comprehended in their demonstration inserted herebefore. rendered sentence have left the liberty to institute his presumed right and action thereagainst, against those whom he should be advised. How he, the petitioner, from consideration prior to that resolution, came to the supposition that his aforementioned request had been drafted in terms too general to expect a more favorable disposition therefrom, and for those reasons deemed it most advisable under respectful hope of a favorable interpretation to address Your High Noble Excellencies hereby once more, yet considerably more amply and with clearer demonstration of his equitable right, and in all humility to submit his humble request, merely to obtain that regarding which he under respectful correction believes the Company, and no one else, is obligated to make restitution to him, and the amount consisting in a sum of Rijxd=s 22196: 20: which the warehouse master Bonk, the cashiers Martens, Looman and Crucius, as well as some leaseholders were in arrears to the Company, and which by the curators appointed over the seized and noted goods of the petitioner have been paid out of his resources to the Company in satisfaction thereof, pursuant to the account accompanying this in all respect, notwithstanding that he, the petitioner, was entirely innocent in this matter, and not the least responsibility encumbered him, but rather others who neglected to watch according to their duty and in time for that aforementioned arrear. So that all this is evidently demonstrated in the following exposition, namely, at the 1st, 2nd, 3rd, and 4th entry of the aforementioned account it appears that those curators paid out of the petitioner's resources to the Honorable Company the shortfall of the first warehouse master Bonk, deceased already in the year 1763, in the amount of pag: 913: 16: 70: What reasons one had for this is uncertain, yet that the same was done unjustly shall immediately appear. The petitioner, in the capacity of vendue master and by order of his commander, had publicly sold various goods from the estate of the deceased cashier Crucius, and whereas a vendue master is immediately after the sale responsible for the vendue proceeds, these proceeds were likewise by order of his superior commander taken in there, for the benefit of him, Crucius, or rather in reduction of his debit to the Company, and thus the moneys were accounted for, and the outstanding funds of that vendue were and could not be considered other than moneys that rightfully and indeed belonged to the petitioner in ownership, which consequently could no longer be encumbered by anyone through any arrest or otherwise. Much less could or might one out of the petitioner's resources, without even hearing him, pay to the Company the debit or the arrear of a man who was deceased already two years and more prior; if it be that Bonk fell short of this amount in his administration as warehouse master, then indeed the chief administrator of that time should have stated this and, through a demand thereof from the executors of his will or his heirs, have indemnified the Honorable Company; if this has now been neglected, as it truly is, what connection does the petitioner then have to indemnify the Company? Reflection will perhaps be made on what is noted at those four entries, namely that those disputed pagodas 913: 16: 70: were paid from the vendue moneys of the widow Crucius, but this was supposedly added merely to give it an appearance. The petitioner will not enter into an investigation here as to how far the widow Crucius is obligated to pay Bonk's debit to the Company, since such does not pertain to his department; the only thing that he observes thereon consists in that he no longer had any vendue moneys of the widow Crucius in his possession, but had already, as said, accounted for the same to the Company in reduction of Crucius's debit, and that consequently, out of those moneys once accounted for to the Company, no second accounting could after that date take place, and that moreover for another servant. At the 10th entry of the disputed account, it appears that from the petitioner's moneys there was paid to the Company pagodas 100 in satisfaction of an equal amount that encumbered the responsibility of the cashier Martens, who died in the year 1754. If Your High Noble Excellencies would please keep your esteemed attention engaged for a little while regarding this, then the petitioner, who in his lamentable detention was kept ignorant of all this, does not doubt not only that it served as a cloak for those who, through indulgence or negligence, gave cause for this in the following errors, but that the petitioner's seized and noted goods moreover also served as a fund from which to satisfy the Company's arrear and to indemnify themselves. That these 100 pagodas were provided in the year 1741 or 1742 to the agriculturalists by the cashier Martens by order of the ministry and placed on record pro memoria in the margin at the cash office until further orders, the petitioner can by no means deny. And he also readily admits that those agriculturalists have absconded since a very long time ago, and thus to demand the restitution of the same is entirely impossible. to write off the amount, and if because of inattention or neglect in this regard the Company must be indemnified, then surely those who ordered this disbursement, or those who neglected to effect the collection in time, were obligated to do so, but by no means the petitioner in this matter, who only served as cashier after the lapse of 28 years, never signed for the takeover of these 100 pagodas, and also had no knowledge of them. According to the 13th, 28th, and 31st entries of the aforementioned account, they transferred from the money of the petitioner into the Company’s treasury pag: 7500 and noted therewith that it serves as a reduction of the petitioner's debit to the Company. In order to shed the required light regarding this matter, the petitioner will have to elaborate a little and note beforehand in what manner this pretended debit came to light. When the cashier Paulus Looman died in the year 1762 and his treasury was audited, no more than pag: 8508. 5. 70 was found in it, whereas according to the books there should have been pag: 21009 and 20 cassos, and thus a notable deficit of pagodas 12500: 13: 30. Crucius 148 Crucius, upon taking over the treasury, signed only for the pagodas 8508. 5: 70 received in cash, without making any mention of the missing pagodas 12500: 13: 30, and thus no accountability in this regard could be imputed to him. This Crucius having stepped down as cashier in the year 1763, and his treasury having been audited, a considerable deficit of pag: 9658. -.- was likewise found. The petitioner, having been ordered to take over the treasury and to serve as cashier, demanded that this amount be brought into the treasury, stating that otherwise he would not sign for it, and addressed himself to that end to the Governor and Director, requesting orders on how he should conduct himself in this matter. Whereupon the petitioner was ordered to have a bond executed for these missing 9658 pag: and to record it within the treasury, with the Governor standing as guarantor. The petitioner was indeed somewhat reluctant and had little or virtually no inclination to comply with that order, but the forceful repetition of that command, and the threats made alongside it, coupled with the consideration that the petitioner, having sworn obedience as a subordinate servant to his masters, was therefore bound and obligated to obey these orders, necessitated him to comply with what was ordered. Yet Yet in the year 1764, around the end of August, when the treasury was to be audited, the petitioner addressed himself once again to the Governor and Director, requesting payment of those 9658 pag:, so as to be able to show his treasury complete in cash to the commissioners to be nominated for the general audit. And he received as an answer at that time: I shall certainly instruct the commissioners how they must act in this regard; just show them the bond, that is enough, it runs for my account. The aforementioned commissioners having arrived for the takeover of the treasury, not a word was spoken by them concerning the debit of Looman (no wonder, for that was still concealed from the petitioner and several others), but indeed of that of Crucius, whereupon the petitioner showed them the bond, which they inspected and accepted as valid, saying: The Governor has ordered us to accept that bond into the account as real cash, as he would stand surety for it, as this is evidently proven in the proceedings by sworn depositions and is further demonstrated in full by the Nagapatnam Resolutions of 13 August 1765. And since, without any prior knowledge of the petitioner, they transferred that notable deficit of Looman in 149 in the trade books to the debit of the petitioner's treasury as real cash enjoyed by him, this could also have no other consequence than that his debit to the treasury was thereby increased by pag: 22158. 18. 30, and that the petitioner consequently (being unaware of all this) when his treasury was audited 8 or 9 months thereafter, had to show a considerable deficit. So that this has not only become evident from the outcome, but from it can also be demonstrated ad sufficientiam juris to have been the sole source of the petitioner's 26-month-long severe detention, cruel proceedings, loss of his temporal goods, indeed, in a word, of virtually his total ruin. Since this is one of the points of the petitioner's action of recourse against the ministry of Nagapatnam, he will therefore (under favorable interpretation) not express himself further hereon, but gladly leave to Your High Nobilities' penetrating judgment the decision regarding all such applicable dealings. And meanwhile, for the fulfillment of the intended purpose in this matter, advance that since the petitioner, no less than his predecessor Crucius, had not signed for the missing 12500. 13. 30 of the deceased cashier Looman, he therefore for that in the least not

could not be held accountable and still less should be debited in such a covert manner in the trade books under the declaration that he had received the funds from the Executors of Looman's testament in their entirety, whereby, through the debit, they exposed him to a shortfall, and through the partially untruthful reason noted for why the debit occurred, they made him suspect of infidelity and dishonour, for the reason that if he, the appearer, had indeed received 12500. pagodas 13. fanams and 30 Casses from the Executors of Looman's testament, and had accounted for no more in the Cash than pagodas 10008: 23: 26:, one would rightly have said of him that he had acted faithlessly therein, but that now, this not being so, and the appearer, as has been proven in the lawsuit, having received no more than 10008. 23. 26. and also having accounted for the same, it remains indefensible that he has been unjustly debited with these still missing pagodas 2491: 19: and 4. Casses, to say nothing of the fact that this entire debit of Looman concerned him neither directly nor indirectly, but rather the chief administrator, whose duty it had been to have a Political resolution taken regarding this, and to have the estate or the proceeds of Looman's estate sequestered under the Executors, in order subsequently to be transferred into the Cash towards the settlement of the deceased's arrears, in which case one would indeed have taken the proper and direct course, whereas now, through all the leniency used regarding this, the concealment of this noteworthy shortfall, and more besides, it can by no means be said to have been done. Where indeed these have served to make a sacrifice of an innocent servant, in order thereby to cover the mistakes of those whose duty it has been to watch over it, and moreover to indemnify themselves. And as regards the debiting of the debt of Crucous, things are not a hair better situated, for Crucous fell short, and the Governor and director ordered that this shortfall be provisionally settled with a bond. The Appearer, as a Servant, had to obey this Order in accordance with his Oath, the more so because the commander, through his guarantee, took the consequences thereof, as it were, for his Account. And thus he cannot be said to be liable. But if, notwithstanding this concise demonstration, any doubt still remains, the appearer is also capable of removing the same out of the way. And notes to that end that because he, the appearer, at the first inventory, as has been cited hereinbefore, made known his objection regarding that bond to the commander and the commissioners appointed for the handover, and the commissioners approved the same, and on the order of the said commander, as they have alleged and also sworn, accepted it as part cash, he is therefore all the more, and that entirely, cleared of any liability. If those commissioners have now, in their Report regarding the inventory of the Cash, made no mention of the bond, and have rendered the proceeds thereof as found in Cash, the responsibility thereof encumbers them, and if they have given notice of it to the chief administrator, then the responsibility falls back upon him; in short, however one turns or twists it, never more will it be found that the appearer is liable in that regard, and from this it will then follow of itself that accordingly the 7500. pagodas counted in the Cash were unjustly taken from his means, and that this shortfall of Crucous, in so far as upon the final sale of his estate the proceeds thereof were not sufficient, ought in law and equity to have been paid either by the governor and chief administrator, or indeed by the commissioners who were appointed for the handover. Lastly, according to the 19th, 20th, 21st and 22nd entries of the questionable Account, the arrears of 4 farmers to the amount of pagodas 2504. 12. 11. were paid to the Company, and that likewise out of the means of him, the appearer. This payment occurred upon a political resolution, yet upon what foundation such happened has appeared wholly incomprehensible to the appearer. He was indeed incarcerated, but never yet convicted of a crime worthy of such a confiscation; proceedings were indeed taken against him, but in the ordinary manner, and thus it had been the duty of the administration, before taking such a disadvantageous resolution, to confer with the appearer regarding it. It will perhaps be pretended that this payment was made from the proceeds of the goods seized by execution from the leaseholders and sold by him as vendue master; but against that, the petitioner answers that those proceeds were delivered by order of the ministry and accounted for to the Receiver Hloflager, and that the latter in turn brought them, along with yet other moneys on an ordinance, into the Company's small cash box, under the petitioner's accounting, and in reduction of the arrears of those leaseholders, who were each credited for it on their separate accounts, as shown in the lawsuit, and can be further demonstrated with the trade books present here. Those proceeds having thus already been accounted for, and after that date, without any prior knowledge of the petitioner, brought once again out of his goods into the Company's cash box, it naturally follows that a great injustice resides therein with respect to the petitioner, who has nothing pending with the lease moneys and by such arbitrary actions has had to satisfy one and the same debt item twice, and that solely to reduce the arrears of the leaseholders, possibly causing some of them to advance by this means, and thus to cover up the negligences of those whose immediate duty it was to watch against the leaseholders falling into arrears, and who, be it said with respect, are solely and exclusively liable for it. Concerning all the remaining items, both of the debit and credit of the account in that regard, it seems as if the petitioner will have to institute his claimed recourse against the ministry at Nagapatnam, although he cannot specifically declare himself on one thing or another in that regard, for: It has never yet been shown that the petitioner remained indebted by a single duit to the Company. The petitioner has also never been condemned to the payment of any shortfall. His goods, actions, and credits were attached, seized, and noted, converted into money, and payments were made therefrom at will. Yet never was any other light or explanation given of all that than the questionable account, which the petitioner obtained here from the lawsuit; therefore, these items must be left resting in such uncertainty until such time as the ministry of Nagapatnam shall see fit to comply with Your High Nobles' order in relation to the papers requested by the petitioner on 27 November Ao 1767. And since from all the foregoing it appears as clear as the sun at midday that the petitioner is completely innocent regarding all the cited items and is not subject to the slightest accountability of any kind, the petitioner also justly trusts that Your High Nobles will by no means approve that in Nagapatnam he was made to pay for what he had never received, and regarding which he had never been subject to any accountability.
