have, while signing himself with the most consummate respect, was written underneath, Right Honorable Sir, Your Right Honorable Sir's most obedient, most faithful and humblest servant, was signed, Leonard Campie, in the margin, Nagapatnam in the Castle the 25th of March 1766. And whereas the aforementioned answer given by him was found not to be sufficient and adequate to enable the Company to recover its expended moneys, since, as there was no warrant, it also could not be ascertained from whom those moneys, principally the 100 pagodas added thereto since February 1760, ought to be demanded, and it having been his duty, as the last person who took over the transfer, to give timely notice thereof so that the necessary measures could have been taken in that regard, thus rendering him liable for the same, it was therefore approved to have the abovementioned 100 pagodas reimbursed to the Company from his estate, without prejudice to his right of recourse, and for the present to let the remaining 50 pagodas run on, as well as in the meantime to inquire whether any heirs of Seijdoepoelle Marcair, who received the aforementioned 50 pagodas, are still living, from whom those moneys might be claimed. without the petitioners having given their consent thereto, because at that time it was not yet customary here for sureties to sign for it, but nevertheless, on account of the absolute power of the said servant, they had not dared to raise objections against it. We infer here from the aforementioned Note of the Renters, which we have confronted with the vendue rolls, and found everything completely to agree therewith. Oetandiappa Moddeliaar sold his possessions as well as those of his sureties Sarwane moettoe poele, and Mahomet Sultan Marcair, which together yielded an amount, after deduction of the salary of the Secretary and further charges, of p.r 1260: p.s 1622: 26. Item for the account of the renter Moeniappa sold his possessions as well as those of his sureties Moetappa poele, moetoe wengadassalam and Kistnapoelle, all after deduction of the incurred charges to the amount of 421. 1117: 54. As also of the Renter baddemaleappa poelle, on account of his sold lands, after deduction of those charges for an amount of 250. 32: 12. All these indicated sums of the held vendues of the renters, we have found in the vendue book all unreceipted, just as no separate receipts can be discovered for them, wherefore we believe to have full proof thereby that the aforementioned Renters lawfully demand the newly noted items, since it has not appeared to us from the slightest papers that they have enjoyed those monies, and much less that the same would be recorded in the Cash books to their benefit as paid off for their account, which however ought to have been, so as to have proof thereby that if the former Secretary Hazelkamp had paid off anything of the vendue monies, the same should certainly have been furnished with a receipt 237 receipt of the former receiver Hoflager, to whom if he had actually paid off any monies to the benefit of the Renters, he would also surely be able to present a receipt from the same. The former Secretary Hazelkamp has properly credited the Renter Moeniappa in his Account for that which is due to that Inhabitant on account of the sale of his Goods, amounting to pa/o 421: 1117: 54. Likewise has been acted in equity with the Renter Bademalle, who is also credited for that which became his, being 250. 32. 12. Both of these items could, with the pleasure of your Right Honorable Sirs, be ordered by the Curators of the estate of Hazelkamp, upon the receipt of the monies, to count the same into the Company's petty cash fund to the benefit of both mentioned Renters, so as to be able to credit their accounts in such manner. We are however also bound to say that it has appeared to us from the statement of account of Hazelkamp that he has taken in, to the benefit of Baddemalle in reduction of the lease monies of anno 1764, 208. pagodas 8 fanams, according to a note from the adigar Sutvon; but Baddemalle, to whom we made such known, says to be wholly ignorant of that arrangement, but indeed that he had been forced by coercion to remit such an amount to winaijgam, who had declared that he would deliver such to the Secretary Hazelkamp to the benefit of his Account, and that he thus had to demand that amount and several other extorted monies from Winaijgom, of all of which he had made a formal record at the secretariat, and that whenever such were paid to him, he would then also be obliged to pay off his debit to Hazelkamp. We submit this matter to your Right Honorable Sirs, so that the same may be brought to a conclusion by your highest penetrating judgment; on the other hand, it has not a little surprised us to discover that the former secretary Hazelkamp has only credited his statement of account for that which fell to the Renter oetandiappa Moddeliaar alongside his sureties on account of their sold Goods, without in the same manner as the two previous Renters already cited by us, likewise 238 likewise to credit him, with debiting him for that which accrued to them in vendue monies. As the Curators of his estate have absolutely prevented such, under the pretext that he had already accounted for on his account to the Company everything that was due to the Renter oetandiappa Moddeliaar, both from the sale of his goods and those of his sureties, amounting, after deduction of those charges, to pa/o: 1260: 1622: 26. In similar manner it stands with the renter Mapoele moettoe Chittij, with whom Hazelkamp has acted just as with the previously cited renter Oetandiappa Moddeliaar, and this under the pretext that, by order of the fugitive Governor the Honorable van Teijlingen, he had handed over the entire amount that was due to that native from vendue monies, notwithstanding that the well-mentioned renter has declared on his conscience before us that he owed nothing else to the detained Hazelkamp than 780 Portonovose Pagodas, of which he is very well aware that out of the 1340: 1038: 39: 7¾ belonging to him on account of his sold lands, that amount was paid off toward his arrears in cash monies of the year 1763 with 520 Pagodas, and then another 260 Pagodas toward those of the year 1764, being as much as he had fallen in arrears on 14 rented villages. Yet that the surplus of 560 pagodas 1038 fanums and 39 cashes was still legally due to him, offering as proof of the truth to verify his statements with a solemn oath. And as it has nowhere appeared to us that the assertion of these renters could in any respect be considered suspect, since nothing has been booked to the credit of their account other than what was counted into the cash by the former receiver Hoflager for their share, and that the detained Secretary Hazelkamp has not been able to demonstrate by the slightest papers that he has accounted for any further monies, we therefore believe, with submission to your Right Honorable's wiser judgment, that Hazelkamp will be obliged to answer properly for what these renters demand from the sale of their goods, amounting from Oetandiappa Moddeliaar as well as that of his guarantors to a sum of 1260: 1622: 26 Pagodas, and from Mapoele moettoe Chittij 560: 1039: 34 Pagodas, together 1820: 2661: 65 Pagodas. The fanums reduced at 24 per pagoda comes to 110: 21: 65 Pagodas, so Hazelkamp would still have to be debited for 1930: 21: 65 Pagodas. If your Right Honorable should be pleased to agree with these our views, then that amount, just as the previous ones, as they came in on account of vendue monies, could be furnished by the curators of Hazelkamp into the Honorable Company's petty cash box, in order thus to credit the renters for it, and at the same time to order the well-mentioned curators to make an improved statement of account, whereby this sum can be properly credited and debited therein. The detained Secretary Hazelkamp also claims 625 Pagodas from the renter Seepermaal, pretending to have paid so much for him to the Honorable Company in rent monies. That man's debit is indeed settled, yet Seepermaal declares that this was done with his own monies, that he handed over the aforementioned sum of 625 Pagodas to Hazelkamp all in doits, for which he demanded a receipt, but that Hazelkamp had stoutly and firmly refused, saying that he did not receive that sum for the account of Seepermaal, but in deduction of what Winaijgom owed to him, Hazelkamp, privately. That notwithstanding all the protests of this renter that he had brought those monies toward the settlement of his debt to the Honorable Company, it nevertheless availed nothing, and he was forced, willy-nilly, thus to abandon the matter. This native has presented to us his great poverty and deplorable state, and offered as proof of truth that he would sacredly swear to all his assertions, with the request that, as he was deprived of that sum by force and his debt with the Honorable Company was also liquidated, he might thus remain free from that demand of 625 Pagodas. We could not refrain from presenting this supplication of his to your Right Honorable. The renters Moeniappa and Oetandiappa Moddeliaar likewise remitted to us 2 notes of what they had successively handed over in cash to the detained Secretary Hazelkamp, as appears from the papers which we respectfully let accompany this, with the request that the amounts mentioned therein might be credited to them, being from Moeniappa 1274: 2: 68 Pardauws and from Oetandiappa 64 Pagodas. And as it is publicly known that those men were sent around with peons to demand payment from various persons who were still in arrears on the rent, and that it is also known that all that was collected thereof they had to hand over, on orders, to the former Secretary Hazelkamp; we therefore, not wishing to act too hastily, addressed ourselves in writing to your Right Honorable, with the urgent request that because, in the investigation of the commission entrusted to us by your Right Honorable, various items presented themselves for which we had drawn up some points of inquiry, with the request that for our further clarification the same might be answered by Hazelkamp. such was also largely effected by him out of his own pocket, and that these amounts were deducted by successive warrants from the receiver, without furnishing any other proofs thereof than his verbal statement, relying solely on the testimony of his servants and of the messenger's servant, all of whom, having been interrogated by us, unanimously declared they knew nothing of the farmers' account, although Hoflager, in his attestation passed before two delegated Judicial Council Members, attests therein that by the warrant of ult=o Aug=s 1763, amounting to Pa/o: 3652: 19:30, there was supposedly deducted certain monies of Moemappa and williapoelle, which Hazelkamp had from those persons under his custody, without however mentioning therein that those monies were those from Moeniappas auctioned goods, and without furthermore being able to declare how much that sum amounted to which was deducted by the warrant, which clearly enough demonstrates how matters were administered at that time. Indeed, what is most remarkable of all is that the former Secretary Hazelkamp, who then supposedly counted the money for the farmers' account to the receiver Hoflager, is himself unable to state the sum, nor to show from his books or other papers what the amount is that he thus furnished for the aforementioned natives, and relying only on scraps of paper which the Curators declare were never found in his estate. It is noteworthy that the farmer Moemappa is specifically named as the one for whom monies were supposedly deducted by the warrant; whoever made him known must surely have forgotten that that native is credited in the accounting statement of Hazelkamp himself; and thus it is hardly possible that if Hazelkamp had paid out monies for him, he would then still have credited him in his account for the auction proceeds due to him, unless they had been the monies that he received privately from this farmer, according to the two notes of which we have already made mention herein, and that out of those monies a part was possibly delivered by Hazelkamp to the receiver. Yet how is it possible, we repeat once more, that if Hazelkamp had actually paid cash to Hoflager, he would be unable to produce any proof thereof, and as he knows how to bring not the slightest proof of his claims, we leave this matter to the prudent judgment of Your Honorable High Mightiness. At the 4=th and 5=th question points, the said Hazelkamp denies the receipt of the monies which were successively handed to him by the farmers Moeniappa and Oetandiappa moddeliaar; and says that if anything was remitted to him at all, it does not amount to an eighth part of their statement, although on the contrary the aforementioned natives wish to confirm the remittance of their statement with a solemn oath, and besides can obtain the attestation of all those who are known by the note to have paid monies to them. There being also some of Hazelkamps servants who upon our interrogation testified that they had daily seen that the aforementioned moeniappa and oettandiappa Moddeliaar, followed by some of the Company's peons, as soon as they had received any monies, continuously handed them over to Hazelkamp, but that they could not say how much this had amounted to, as they had kept no note thereof; and as this matter also requires a formal decision, we shall await that of Your Honorable High Mightiness's prudent arrangement. was supplied into the Cash, this was done per warrant by the receiver; but from that warrant it does not at all appear that by the same the amount of the vendued goods of the Renters was collected, as Hazelkamp claims, therefore, had this actually existed, this ought to have been known in the Cash Book by separate warrants, at which time the account of the Renters would have been properly credited in the Trade books. But that not having occurred, and those moneys having been handed over to the receiver by Hazelkamp, we judge that he at the very least ought to have had a receipt for that delivery, and had everything then proceeded according to order, Hazelkamp ought to have given notice to the renters of the delivery of those moneys, settled his vendue rolls, and then had the said renters, each for his own share, as well as for the receipt of their moneys, sign into the vendue book according to Old custom, to which the aforementioned Natives would have made no difficulty, since the delivery of those Sums to the receiver served to the benefit of their account, and thus one could thereby have publicly witnessed that what the detained Secretary Hazelkamp maintained squared with the truth. Yet none of these matters have been observed; Hazelkamp has nothing in his favor but his verbal word, whereas against this the renters all still stand in the vendue rolls for the amount of their vendued goods, and thus Hazelkamp is incapable of proving that those people have already been paid and satisfied by him. The reasonableness of this matter will very easily be understood by Your Honorable and Severe Worship, and we find ourselves only further obliged to mention respectfully: That however the case may be decided, the renters nevertheless have no concern therein, for if Hazelkamp has paid moneys to the receiver Hoflager on their account, the latter must remain accountable regarding the Renters, since in that Year he enjoyed double as much in Cash from the renters than he counted into the Company's Cash, which we shall have the Honor to explain further below. The Renter Wiliapoelle having been afflicted by a severe illness, could not present himself to us until a few days ago, with a claim of 71 new Nagapatnam Pagodas, and 76 pardaims 6 fanums and 21 Cash, which he attests were remitted on his account by various persons to the Detained Secretary Hazelkamp. We have spoken to the Curators of Hazelkamp on that Chapter, who informed us that this person had joined them at various times with his claim, but that Hazelkamp had positively denied knowing anything of that matter; and as the said renter made known to us his Poor and deplorable condition, we have summoned before us various people who are named in the note accompanying this, and which we have the Honor to present to Your Honorable and Severe Worship, who all declared outright that all which was stated in the aforementioned paper, they personally had handed the Sums to Hazelkamp. Thus full proof that he also received them, and thus in all fairness it must be credited to the Renter willia poelle; we present this item to Your Honorable and Severe Worship in order to Judge the same according to Your High pleasure. Having hereby concluded the principal investigation of our Commission, with the formal demonstration of the renters' claim upon the detained secretary Hazelkamp, we shall furthermore have the Honor to make a respectful report to Your Honorable and Severe Worship, that by the Examination of these Matters we have perceived that various errors have existed between the Account of the Renters and that of the Statement of the detained receiver Hoflager. We therefore take the liberty to make a Submissive report thereof to Your Honorable and Severe Worship, presenting a paper which we have drawn up from the year 176 1/2 to 176 4/5, to demonstrate what we propose to report to Your Honorable and Severe Worship. For obtaining the necessary clarification in the obscure and thorny affair of the Farmers of this Place, regarding the proceeds of their possessions which were liquidated by the detained Secretary and Vendue Master Joannes Hazelkamp, by order of the fugitive Governor Christiaan van Seijlingen, in order to apply the same in reduction of their outstanding lease monies, the members of this assembly, the Honorable Pierre Jean Louis de Filliettaz and Cornelis Pietersz:, having been requested at the session of the 27th of March last to investigate the same, as to how those monies were dealt with, or what part thereof was actually collected and received to the credit of those Farmers; and whether the same were fully accounted for by the said Hazelkamp, or whether an accounting should still be rendered by him; the said commissioners now serving a written Report of their proceedings, they informed this assembly in detail that the named Hazelkamp, having successively liquidated the goods of those Farmers by public auction in the years 1764 and 1765, had now during his detention caused the statement of accounts of his estate to be credited for the largest part of the proceeds thereof, on the grounds, as he claims, that what had arisen from the sale of the farmers' possessions had already been credited to their benefit by him, and thus the auction monies still remaining uncollected belonged to him. However, after much searching, questioning, and re-questioning, the commissioners finally obtained the best clarification in this regard from nowhere else than from the report of the Junior Merchant Jan Diderik Severin and the Bookkeeper David Vick, who previously, or by Council resolution of the 6th of August of the past year, were commissioned to inquire into the actual arrears of those farmers and to elucidate this assembly; according to which, then, all that was paid into the Company's Treasury in reduction of the outstanding lease monies had arisen from the lease monies furnished successively in cash by those Farmers to the receiver Arnoldus Hendrik Hoflager, 255 thus not the least of what had arisen from the auction monies was included therein, those Farmers consequently claiming what was due to them from the aforementioned vendue master Hazelkamp, which they submitted in an ample notice, and at the same time requested that the same might be credited in their favor, consisting of the following, namely: from the Farmer Oetandiappa Moodeliaar on account of his sold goods, and those of his sureties Tarwaima moettoe Poelle and Mahometh Sulthan Marcair, after deduction of the Vendue Salary and further expenses p/o: 1260. f. 1622: 26. it had appeared that these monies had been enjoyed by her, much less that the same had been taken into the cash books for her benefit, which however ought to have been the case if the said Hazelkamp had paid anything off from it, or that at least he would have had to be furnished with a receipt from the former receiver Hoflager, if he had truly disbursed any monies to the benefit of the farmers; only the son of the last-mentioned, but now deceased farmer Mapoele Moettoe Chithij testifying that from the aforesaid monies derived from the sale of his estate, amounting to 1340 pagodas, 1038 fanams and 39 casjes, a sum of 780 perCo: pagodas, being as much as his aforementioned father had remained in arrears for the lease of the 14 villages for the years 1762/3 and 1763/4, had been paid to the Company, so that Hazelkamp ought to be credited. The said Commissioners further demonstrating that Hazelkamp had only credited the farmers Moeniappa and Baddemalle in his account for what was due to them, namely perCo: 421 pagodas 117 fanams 54 casjes to the first-mentioned, and perCo: 250 pagodas 32 fanams 12 casjes to the last-mentioned; at the same time proposing to order the curators of Hazelkamp's estate, once the monies of these two items have been received, to count them into the Company's cash box, in order that the said two farmers be properly discharged for them in the books; wherefore, after deliberation, it was resolved to approve this, and accordingly to order the aforementioned curators, once those monies have been collected, to transfer them into the Company's cash box in favor of the said farmers, but from which, or from the share of Baddemalle, however, must be deducted the sum of 208 pagodas 8 fanams, which has already been taken in by Hazelkamp in reduction of the lease monies of the year 1763/4, although Baddemalle claims and professes to know nothing of this payment, with the declaration that these monies were extorted from him by Winaijgom, for which reason, in order to recover the same with even more extorted funds, he had submitted a formal bill to the secretariat, and upon obtaining it would be able to settle Hazelkamp's debt. Likewise, Hazelkamp having credited his account for that which the goods of the farmer Oetandiappa Moddeliaar and his guarantors yielded at public sale, without however crediting those people for it in return, as with the two farmers cited here above, claiming that all that was due to this farmer to the amount of 1260 pagodas, 1622 fanams and 28 casjes he had already accounted for to the Honorable Company from his own funds, which however the farmer denies, with the declaration that he was willing to confirm under solemn oath not to have enjoyed a single doit of the aforementioned monies, and that his account had been credited for nothing other than what he had actually delivered and counted in cash to the receiver Hoflager. Just as it was found that he had acted in a similar manner with the fellow farmer Mapoele Moetoe Chittij, under the pretext that by order of the absconded Governor van Teijlingen he had paid out the entire amount derived from the estate of that native; whereas on the contrary the son of that farmer declared in good conscience that he owed Hazelkamp nothing other than the 780 pagodas mentioned here above, and that it was well known to him that the same was paid from the proceeds of the sold lands, which were perCo: 1340 pagodas, 1038 fanams and 39 casjes, namely 520 pagodas for the lease year 1762/3 and 260 perCo: pagodas for that of 1763/4 for his arrears on the lease of the 14 villages mentioned here above, so that the surplus thereof to the amount of 560 pagodas rightfully belonged to him, showing himself ready to verify his statements with a solemn oath. Then, considering that the claims of these farmers and the reasons adduced by them to substantiate their statements are in no respects suspect, all the more as they were credited for nothing more than what Hoflager received from them, and moreover Hazelkamp has not been able to demonstrate with the slightest evidence that he accounted for the public sale monies, as the duty of a vendue master requires to deliver nothing without a receipt, and if one wished to rely on an order of the Governor, then there ought to be a receipt, or at least a warrant signed by the Governor; so the assembly conformed to the opinion of the aforesaid Commissioners, namely that Hazelkamp is likewise obliged to account for those funds, namely: from Oetandiappa Moddeliaar and his guarantors, 1260 perCo: pagodas, 1622 fanams, 28 casjes and from Mapoele Chittij, 560 pagodas, 1034 fanams, 39 casjes Total: 1820 perCo: pagodas, 261 fanams, 65 casjes or together, with the fanams reduced at 24 per pagoda, amounting to 1930 pagodas 21 fanams 65 casjes; and accordingly it was resolved to order the curators of Hazelkamp to count that amount into the Company's cash box, and that having been done, to debit and credit properly in the aforementioned amended financial statement to be drawn up by them. That the aforesaid Commissioners further brought forward the claim made by Hazelkamp on the farmer Seepermaal of 625 pagodas, by reason of his having paid so much for the said farmer to the Company for lease monies; but Seepermaal declares the settlement of his debt to have occurred with his own money, which he, having handed over to Hazelkamp to the amount of the aforementioned 625 perCo: pagodas in doits, could not obtain a receipt for, because Hazelkamp had declared that he had received those monies not for the account of Seepermaal, but in settlement of the private debt of Windijgom to him; this having been extensively reasoned and carefully deliberated upon, the same was found to be a private claim, thus

258 thus to apply to the Court of Justice, to which it was accordingly deemed proper to refer both of them, in order to sue one another in court if they should have any claim against the other. However, considering that by the resolution of the 4th of April last, upon the declaration made by Wienaijgom that, although this Seepermaal was known in the books as the farmer, yet he was not, but Winaijgam himself was the actual farmer, and thus the said Peepermaal had only been a salaried servant of his therein, the said Winaijgom was judged liable for the aforementioned 625 pagodas which still had to be paid in arrears of lease monies; and for the satisfaction thereof Peepermaal had been summoned before the Council of Justice; and on that account the present collector, David Viek, was ordered to take the necessary care for the collection of those monies, as well as of a small sum of pagodas 25: 2: 20 which Seepermaal said he still had to account for in lease monies; and by virtue thereof the collector, alongside the other claimants on Wienaijgom's estate, registered his claim with the court here; it was thus agreed, upon the collection of those monies and Sepeermaal being in no arrears on that lease, to have the same credited to the benefit of the estate of Hazelkamp for the debt of Wienaijgom to him. During the investigation of the said commissioners, the farmers Moeniappa Poelle and Oetandiappa Moddeliaar, having been interrogated by them, submitted two notes together with the report to demonstrate what they had successively delivered in cash to Hazelkamp on account of collected tolls from the persons mentioned therein, requesting that the amounts stated therein—one from Moewiappa Poelle amounting to 1274: 2: 68 Pardauws, and the second from Oetandiappa Moddeliaar amounting to 64 pagodas—might be credited to their favor. It was furthermore reported by the said commissioners that, upon examining this matter, it had occurred to them and several errors had crept in between the account of the Farmers and the statement of the receiver Hoflager, demonstrating this further by a paper drawn up by them thereof from the year 1761/2 to 1764/5: according to which the farmers have delivered more cash to the receiver Hoflager than he has paid into the treasury, except in the year 1761/2, in which the farmers, being in arrears or in default for pa/o: 3029:21:40, the receiver paid 1874 pagodas more than was handed over to him, as also under the last of February 1763 pr/o: 1155:, in order to settle thereby the entire arrears of 1761/2, which was easy to verify, since the cash book of 1761/2 was not closed earlier than anno 1763, thus he liquidated the lease monies of anno 1761/2 with those of 1762/3, serving as proof thereof that for the year 1762/3 he furnished no more than pagodas 3085: 18: 30 into the treasury, whereas a sum of pa/o: 6395: 13: 60 was handed over to him by the collective farmers, thus in that year paying pr/o 349:1:28 less into the treasury than received by him. Although it is true that the receiver Hoflager could allege having been in advance for the farmers in anno 1761/2 for pr/o: 3029: 21:40, it nevertheless appears that, this aforementioned amount being deducted from the lease funds furnished short by him in anno 1762/3 to the sum of pa/o: 3309:19:30, he has accounted for pr/o: 279: 21:70 less than ought to have occurred.
