209 The 24th June Anno 1771 setting forth the privileges and threatening a protest, both regarding the great distinction found between an ordinary merchant and the Honorable Dutch Company, and regarding the splendid privileges obtained by the said Company in this respect from the Mughal Kings as the sovereign Landlords, and maintained in full force up to the present, consisting therein that we may suffice with the payment of the customs duties on the goods dispatched by us calculated according to the true prime cost, that he should desist from this unlawful demand, and on the contrary present himself to maintain us in those privileges pursuant to their given and repeatedly reiterated guarantee, since indeed he, the commander, could never consent to such a method of paying duties, but would be compelled, in case Mr. Draper should proceed with hindering the stamping and shipping of the return goods lying in readiness, to protest against it and act further according to advice; That 218 The 24th June Anno 1771 Souratta That this finally, after many messages back and forth, was of such effect that the aforesaid Mr. Draper consented to the stamping and shipping of the returns, provided this matter would be settled in one way or another after the departure of our ship, His Honor had subsequently in the month of May last prepared the following Missive. To the Honorable Worshipful Mr. Daniel Draper Esquire, Chief on behalf of the Honorable East India Company, and Governor of the Mughal's Castle and Fleet; together with The Council Honorable Worshipful Sir and Sirs! The Collector of Customs, by virtue of an order issued by the Custom Master appointed here in Souratta on behalf of Your Honor, having seen fit in the month of April last, when we were to dispatch our ship with the returns towards Batavia, to hinder the stamping of the said goods and consequently their shipment, on a far-fetched pretext that we were unwilling to pay the export duties, the first signatory immediately had the necessary remonstrances made against this and informed Mr. Draper of the untruth and groundlessness of this contention, but this having had no other result at that time than that the said gentleman was willing for that turn to allow our goods to pay duty and be stamped, provided this matter were subsequently settled, we therefore now, firmly presuming that Your Honor may have been misled by incorrect reports and rumors from people who are all too envious of the good harmony currently subsisting in Souratta, find ourselves obliged to disabuse Your Honor in that regard, and to demonstrate to the same to that end, First, That the contention as if the Honorable Dutch Company were obliged to pay for its purchased goods and merchandise dispatched elsewhere the duty of 2½ percent, not on the true prime cost of the same, but on such a sum at which they would be estimated upon an appraisal by persons qualified for that purpose by Your Honor, is completely groundless and irregular. Secondly, that we still, as always before, as consistent custom as well as our acquired right entails, pay the duties according to the prime cost, and that if these prices are somewhat lower than the daily market, this must be attributed to very natural causes. And thirdly, that the demand made by the Custom Master as if we were still indebted for a certain sum in duties arising from the calculated 2½ percent of such sum at which the dispatched goods were valued above the stated prices, is completely null and against all law. Now concerning the first part, it is an undeniable truth, confirmed both by our splendid privileges obtained from the sovereign of these Lands and by a custom that has prevailed from time immemorial, that the Honorable Dutch Company, far from ever being judged obliged to the payment of the duty on the dispatched

242 The 24th June Anno 1771. goods to be dispatched, according to an appraisal by whomever it may be, may and must suffice with the payment of the customs duty of 2½ per cent of the actual prime purchase cost. This is evident not only from the privileges granted to the said Dutch Company by the Mughal Kings and always preserved inviolate, principally from the King Shah Jahan in Anno 1643, from the King Aurangzeb in 1662, from the King Jahandar Shah in 1712, and finally from His Majesty Muhammad Shah in 1729, wherein the said Company is permitted to suffice with paying the customs duty on all the merchandise purchased by us in Baroda, Surat, or the environs thereof, according to the actual prime purchase cost, as the same should be stated in a bhertia or memorandum of the cost, with this express prohibition to each and everyone from demanding or taking anything more from us henceforth; but the constant and unbroken custom of all times, and virtually as long as the Dutch Company has been established here, also demonstrates this most clearly, for never has any of the regents who have any share in the customs duties, both before Your Honours made yourselves masters of the Surat Castle and after the same had put themselves in possession thereof by force of arms, presumed to make the slightest infringement upon this lawful right of ours or to cause us any hindrance in paying duty on and stamping our goods; on the contrary, out of a conviction of this right of ours and assurance that we have never made any abuse thereof, the same regents have always been peaceful and satisfied therewith, so that it will always be a matter of utter impossibility for Your Honours, gentlemen, and all who have any share in the customs duty, to demonstrate with any semblance of truth that we ever paid the customs duty according to an appraisal by this or that person. Consequently, it is an undeniable truth that Your Honours' contention is utterly groundless, and as a result, the imposed, though afterward again revoked, stoppage of the paying of duty on and stamping of our merchandise has been in all respects irregular. And holding this first subject as proven herewith, 243 The 24th June Anno 1771. we proceed to the second, regarding which—since it is indeed in all respects true and cannot be contradicted that we still at present, as always before, pay the customs duties on the goods and merchandise dispatched by us according to the true purchase prices, which are stated by our suppliers to those entitled to the duty or their servants in a memorandum or bhertia—we shall merely demonstrate to Your Honours that if the stated true cost is somewhat below the daily market, this cannot be attributed to any unfair or underhanded causes or maneuvers, but that the same owes its origin in all respects to a pure manner of trading, and specifically solely to the fact that our Company grants various advantages to its suppliers which they can obtain from no private merchant, and which therefore notoriously must procure a lower payment. For whereas every merchant in Surat, whenever he manufactures or purchases any goods there for himself, must naturally calculate the interest on his capital which he advances for the purchase, for such time as the goods remain unsold and he recovers the monies advanced for them; whereas he must at the same time reckon with his godowns and warehouse rents, with the danger to which his goods are subject in the course of a year, whether from spoilage, fire, and other accidents, and finally also with the risk he runs of remaining stuck with his merchandise unsold, or frequently being forced to dispose of the same at a loss; the suppliers of the Dutch Company, who are in fact its agents, have nothing to do with all this. Thus, instead of advancing their funds, practically the entire amount of the purchase is paid to them a year in advance, which not only causes them to profit from the interest of 9 per cent, but above and beyond that still gives them the opportunity, with this money which they do not immediately pay out again, to make a profit on money exchange, while, at the moment they receive the goods from the hands of the workmen, they deliver them into our lodge.

If the difference is now so great with respect to the goods which are manufactured here, it is infinitely greater with regard to those goods which are manufactured for us at Brootchia and which, at the present time, supply by far the greatest portion of our shipments, because in that regard not only do all the aforementioned advantages likewise take place, since the goods prepared are also delivered there immediately into our Lodge and to our Factors, but our Suppliers or Commission Agents furthermore profit, firstly, 5 percent on that which another private Merchant must pay there for tolls, and from which the Netherlands Company, according to its privileges, is exempted, and secondly, the freight and insurance, along with the unloading charges etc., all of which are borne by the Company, since it keeps its own vessels here for collection and protection, and which altogether may well also be calculated at 5 percent. That it would be injustice itself if one wished to oblige us to pay the toll following such a Valuation, whereby one first has the exact prime cost prices declared by a Berthia, and demands the tolls according to that declared cost with respect to those goods which are appraised below those declarations, while from those merchandises which are estimated higher than the same declarations, the Toll is demanded according to the said appraisal. And that, above all this, by the introduction of such a new custom, trade—the prosperity and growth of which always demands the foremost care and attention of all states and Governments—would be too greatly depressed, and thus, whereas the same must be general in order to make a Country flourish, it would very soon be metamorphosed into virtually a private monopoly, since it is certain that those whose goods were appraised the lowest would always reap the greatest profits. One from the Dispenser Monte, also concerning the shifting of tiles and repairing of the roofs in the Company's Lodge, and the buildings belonging thereto, the stable and hay warehouse, as well as the tent and inner latticework, amounting in cash to Rop:s 399: 24:—, and thus less than in the previous year by rop:s 20: — 25 —, as the same then amounted to rop:s 420: 1—. A specification from the overseer of the Lodge at Amed-Abaad, Goodjen Abetick, concerning the shifting of the tiles on the roofs and further repairs to the same, amounting to rop:s 155:½.
