36 The 15th February Anno 1771 having sailed under our flag, the private vessel the Helena, which departed from Batavia in the spring of Anno 1769 under the command of the free skipper Pieter Raadjes, and subsequently was run away with by the crew in the sight of the coast, while on that occasion the captain, mate, and 2 common sailors were murdered in a treacherous and inhuman manner; and whereas the sarang of that vessel, named Cassim, native of Souratta, where it is said that he previously murdered his own sister, along with another sailor named Zaal, also a native of this place, are known as the chief instigators of this mutiny and the murderers of the aforementioned unhappily perished people, our aforementioned Bengal servants have requested that we should institute the necessary inquest here in that regard, in order that these villains may fall into the hands of justice and obtain their deserved punishment. For these reasons, Gentlemen, we now address Your Honours, requesting the same, while sending a translation from the narrative of the aforementioned case with the description of the aforementioned delinquents, that in the service of justice, and whereas public tranquility and every private person is utmost concerned that such criminals fall into the hands of the law and are punished according to their deserts, you be pleased to order an investigation to be made here as the birthplace of the said delinquents, and, finding them here, to have them apprehended and delivered up to us for shipment to Bengal. We shall at all times, Gentlemen, gladly acknowledge the service which Your Honours will thereby render to justice and to us, and Your Honours will always find us ready to be of some utility to Your Honours again in similar cases. Concerning the construction of a new instead of the collapsed front house, no effort was left untried, Mr. Drazer persisted in his previous reply, which the Director proposed. Thus, it was further made known by the Director to the members of this assembly that His Honour had not neglected to do everything in his power that could be of any service to obtain permission to rebuild the house previously inhabited by the chief surgeon van der Sprenkel and which collapsed on the 13th of July last, but that notwithstanding all this, the English chief here persisted in the reply sent to us of the 19th October Anno Passato, inserted in the resolutions of the 19th November following, declaring that it was impossible for him and his Council to give us the least positive reply before and until he had received express orders to that effect from the Governor and Council of Bombay; that the said Director, 38. Director, thus seeing that there was not the least to be accomplished with this administration, while from all circumstances it appeared that their hands were so tied by the Bombay administration that they could engage in nothing, had deemed it necessary to submit to the members for consideration whether one should not now, as it is already eight months ago that the request for the construction of this dwelling was made, without having been furnished with any answer to this day, as the English administration in Bombay seems shameless and obstinate enough to leave all our letters dispatched thither for several months past, and among them that of the 14th September last, unanswered, address oneself once more to the Bombay Council, and with representation of this improper 39 The 15th February Anno 1774. Consideration in that regard. improper conduct request them repeatedly to order their Chief and Council here at the very earliest to allow us to rebuild the aforementioned collapsed dwelling, as was requested on the 14 July last, and whether one should consequently dispatch the letter prepared and presented here by the Director; whereupon, having deliberated and taken into consideration that although on the one hand one cannot flatter oneself with any, or at least with no favorable answer from the Bombay administration so long as Mr Hodges, who seems firmly resolved to obstruct us continually and to oppose us in violation of all that is equitable, yet on the other hand it is no less true that by sitting still one can gain not the least either, while one is compelled in the highest degree to the building of some dwellings, even if they were.

Resolution to carry out the said proposal and to dispatch the prepared missive. even of bamboos, in order thereby to relieve the Company from the payment of heavy rents, and nevertheless to provide the servants with proper shelter, it was approved and resolved to accept the proposal of the Lord Director in all respects, to dispatch the letter made ready by His Honour, and at the same time to request a reply to our last writing of the 5th September of the past year with regard to the claim against the Free Merchant Sleevens, and to insert the same into this. — To the Right Honourable Thomas Hodges Esqr President on behalf of the Honourable English Company and Governor of His Royal Majesty's Castle there, together with the Council, Bombay. Right Honourable Sir and Gentlemen! When on the night of the 13th July of the past year, a certain 41. The 15th February Anno 1771. certain old and dilapidated dwelling house, which had stood here on our wharf, built of lime and stone, yet so decayed by age that it had already long threatened to bury its inhabitants, collapsed, our Director addressed himself the day thereafter, or the 14th July, to Your Honours' Chief here as Governor of the Castle, and that pursuant to Your Honours' desire by letter of the 25th January 1765, in writing, requesting permission to build again, in place of the abovementioned collapsed dwelling, a dwelling 99 feet long, 44 feet wide including the outer gallery, and 13 feet high, to be inhabited by three servants, and that from the same materials as the previous one had been, namely of lime and stone, such as Your Honours' Captain Engineer should deem capable of withstanding the inclemency of the weather. We thought this request to be so equitable and arranged according to reason and fairness, that we flattered ourselves we should obtain the same immediately, since we thereby obtain nothing other than what we had already possessed for a series of years, namely a dwelling of lime and stone. But since we cannot possibly manage without this dwelling, as one cannot very well make the servants pass the night in the open air, and it was feared that this request, however sound, would again find opponents, as has repeatedly happened, or at least that they would seek to protract this matter, the first undersigned requested, in that case, to be permitted to complete one of the stone dwellings in question, regarding which we had the honour to entertain Your Honours at length by our missive of the 14th September last, without our having been so fortunate up to now as to receive any reply thereto, with reservation of everyone's proper rights and leaving the matter in question in status quo. And if this too should meet with obstacles, our Director requested, as if compelled by the direst necessity, in that case to be permitted to build the aforesaid dwelling house of rafters and bamboos plastered with lime, above with a ceiling of planks and a tile roof, and below with a stone footing 42 The 15th February Anno 1771. foot to the height of two to 3 feet above the ground. We now reasonably flattered ourselves that, if the first request had encountered obstacles, at least one of the two remaining would have been granted immediately, and we were strengthened in this good expectation when Your Honours' Chief here was pleased to send the Captain Engineer of the English Company, Nilson, to our Wharf two days after the aforementioned request had been made, who examined the said collapsed dwelling and the ground upon which they wished to build this new one. Experience has taught us the contrary thereof, as we looked out for an answer until the 19th October following, and thus for fully 3 months, and finally, upon our missive dispatched on that day to the Surat Chief and Council tending to a repetition of the aforesaid request, having obtained on the 26th of the same month, by letter from the Surat administration of the day before, no other answer than that the said request would be replied to as soon as Their Honours had received Your Honours' resolution concerning this, without their having been pleased, up to now, and thus in the space of eight months, to send us any the least answer, let alone that they should have granted us the said request according to equity. We shall not, Gentlemen, enter here again into a discussion of our right and of the injustice that has now been done to us for two years, as we believe we have done so circumstantially in our aforesaid missive of the 14th September 1770. We shall by no means express ourselves as to whom it must be attributed that we are thus treated unworthily; it is enough for us that we have made the request in the proper place according to Your Honours' own contention, and that consequently the Gentlemen of the Surat Council are bound to grant us the same pursuant to our firmans and glorious privileges, or otherwise, in case they believed they had the right to do so, to reject the same. And therefore we shall merely content ourselves by this to request Your Honours very obligingly to order their Chief and Council here at the very earliest to permit us the aforementioned erection of a new dwelling house

Subsequently, it having been made known to the meeting by the Lord Ruler how it had appeared to His Honour for a considerable time that it was extremely necessary for the service of the Honourable Company, as well as to be always provided with brokers who were knowledgeable in the service of the same, to 45 The 15th of February Anno 1771. On account of the ailing condition and old age of Mantchergie, regarding the appointment of a third broker. Tabidaas Nagerdaas, who has appeared to be the most suitable. proceed to the appointment of a third broker, since the first broker, Mantchergie Goorseedje, was advancing in years from day to day and had even been very sickly and ailing in the past year, so that while the said Mantchergie was still alive, this person could timely qualify himself in the service of the Honourable Company and its trade; that therefore the Bania merchant Tabidas Nagerdas had appeared to His Honour as the most suitable of the merchants under our protection and also knowledgeable in trade, of whom His Honour testified that he had always served him with great vigilance, honesty, and fidelity in his private affairs; and that, while it would possibly exceed the limits of the authority of this administration if one were to decide upon this appointment here, 46 The 15th of February Anno 1771. And to make a request to Their High Mightinesses for this purpose. Decision to let this take place by the general letter. The contracting, delivery, and acceptance of all linens, cloths, and cotton yarns demanded in the respective orders for Ao 1771 shall take place according to the previous year's samples as far as the outward appearance is concerned, but regarding the length, breadth, and wiesas of the cloths, one shall govern oneself according to the stipulations made in the orders, in such manner that, even if the samples should not contain the fixed length, breadth, and wiesas, nevertheless in that respect nothing must be lacking in the delivered cloths, not counting 1/4 or 1/2 wiesa and 1 or 2 fessoe. 2. For this, the suppliers shall enjoy the prices that were granted to them in Ao 1764 for the delivery, and thus the increase granted in the past year shall now completely cease. 3. Excepted are the chintz baftas and silk patolas of 5, 4, and 3 asta, for which they shall now again enjoy the last previous year's prices, with this condition that the said suppliers, with regard to the patolas of 5, 4, and 3 asta, shall be held to deliver the requested goods of those assortments promptly, and failing that, to compensate the Company for all damages that might accrue to it from this non-delivery; and nevertheless the patolas of more astas must also be delivered and completely fulfilled at the prices paid for them in Ao 1769. 4. And so that the suppliers should begin the work without loss of time and be able to proceed with it vigorously, an advance payment of Rop: 100,000 in cash shall be made to them by the ultimo of March, and subsequently as much more along the way as shall be deemed necessary in proportion to the goods coming in. Linens, cloths, and cotton yarns demanded in the respective orders pro Patria and India for the year 1771. 55 The 15th February Ao 1771. 5. Also, 1 1/2 percent for invoice charges shall be credited to the suppliers on everything that they purchase in Brootchia, Cambait, and Brodera, or thereabouts, and ordinarily bring here by water. 6. In return, the suppliers shall be obliged to bring nothing but sound goods to the bazaar. And if occasionally any pieces should be found among them that are deceitfully woven or otherwise extraordinarily bad, the same shall not simply be rejected, but confiscated for the benefit of the bazaar commissioners. 7. They, together with the commissioners, shall also have to compensate for all such pieces as might occasionally, according to solid testimony, be found deficient, damaged, or unsound upon opening well-conditioned packages in Europe or India; namely, they, the suppliers, three-quarters, and the bazaar commissioners one-quarter of their cost. 8. Furthermore, the suppliers must deliver and bring to the bazaar the raw potijs for the printed cloths on the Indian order before the ultimo of November, and all other goods so timely that the same can lie ready for shipment at the latest on the following dates, viz.: The Patria and Cape goods on the 1st of December next, and The Indian goods on the 15th of March following. 9. Lastly, all that is not ready by that time and might come in later shall not only be left at the suppliers' expense, but they shall also be obliged immediately to return in cash whatever they might have already received thereon by way of advance payments, and thus properly liquidate the contracting account in due time. 56 To the observance of all this, the contracting parties bind themselves in the strictest manner, but particularly the brokers and suppliers, their persons and goods according to law. Whereas the brokers had arrived at the next-mentioned increase, and having proceeded from a consideration of what was noted in the margin, it was finally brought so far with much difficulty that they were willing to agree to pay for the imported merchandise as follows: for the fine spices, candy sugar, Japanese camphor, and musk, the prices of the previous year; for the powdered sugar, 9 5/8 rupees or 1/8 more than they paid for it in the preceding year; for the lead, 12 rupees, being the fixed price; and for the Japanese copper in bars, 56 1/4 rupees; consequently presenting to the members for consideration whether one should strike the sale with the brokers for the aforementioned prices, or whether one should still wait some time concerning this; whereupon, after deliberating with the requisite attention and having noted principally that at present there is in no way to be expected that the market will rise for the time being, 59. And in default thereof, they shall be obliged to permit and endure that all the merchandise remaining as a balance after the said time shall be sold and weighed out for their account. V. The Brokers shall be bound to pay for the goods twenty days after they have been weighed out to them, namely for such lots as they receive from time to time. VI. However, in such manner that, before and prior to the goods being weighed out and delivered to them, they shall be required to hand over to the Director a bond duly signed by the merchants who have in turn bought these goods from them, whereby the same bind themselves to pay the monies within the said twenty days to the Honorable Company's money-changers, in order to be delivered by them into the Treasury. A specification exhibited for repairs side, serving as a revetment of the Honorable Company's yard, to have it plastered and whitewashed, as this had not been done for some years, in order thereby to prevent further water penetration and erosion, so now, since that work had reached its full completion, the specification submitted in that regard by the Master of the Equipage van der Kuijl was presented by the Director, both for the plastering and whitewashing of the said entire stone revetment, as well as for some other highly necessary, as well as various performed highly necessary repairs to the Northeast Pier and between the said Pier and the stone stairs, constituting the northeasternmost part of the said revetment, the bricking up or closing of several sections that were already severely eroded by the lapping of the water; the bricklaying of a stone sewer and various other repairs and improvements to that costly work, amounting together to rop.:s 3714: 32., of which in cash Rops. 85 The 7th of March Anno 1711. We flattered ourselves with reason that if the first request had met with obstacles, at least one of the other two would immediately have been granted, and we were strengthened in this good expectation when Your Honour the Chief here saw fit to send the Captain Engineer of the English Company, Nilson, to our yard two days after the aforementioned request had been made; and who had examined the aforementioned collapsed dwelling and the terrain upon which one wished to build this new one; experience has taught us the contrary thereof, having waited for an answer until the 19th October following and thus for fully 3 months, and finally, upon our letter dispatched that day to the Surat Chief and Council tending to a repetition of the aforementioned request, having received on the 26th of the same month by letter from the Surat ministry of the day before nothing else in answer but that the said request would be answered as soon as Their Honours had received the resolution of Your Honour in that regard, without anyone having been pleased to see fit up to now, and thus in the space of eight months, to send us even the least answer, let alone that the said request would have been granted to us in accordance with equity. We shall not, Gentlemen, enter here again into a discussion of our right, and of the injustice that has been done to us now for two years, as we believe we have done so in detail in our aforementioned letter of the 12th September 1770; we shall by no means express ourselves as to whom it must be attributed that we are thus unworthily treated, as we flatter ourselves that this treatment will now take a different turn, while it is enough for us that we made the request at the proper place according to Your Honour's own contention, and that consequently the Gentlemen of 103 The 7th March Anno 1771.
