the 31st of July 1772. must strike, rather than such all too pervasive, erupting sins, on account of which a holy and righteous God especially wishes to cease doing good to an entire land and people, and which thus, without repentance, will change the manifestations of longsuffering and forbearance into the most dreadful experiences of wrath and indignation. That therefore every person who does not willfully seek to neglect his own and the public welfare, or who is not surrendered to the ungodly persistence in evil and the most shameful insensibility, under supplications of Heaven's grace, shall make a humble confession of his evil deeds before the high God, and in general, through broken wickedness, marvel at the riches of God's lovingkindness with grateful acknowledgment for the least good received, and sincere supplication that the Lord may cause the light of His countenance to shine upon us under the most ample dispensation of the choicest of His blessings, in general to the most flourishing condition of the United Netherlands, of the conquered territories largely supporting the same, and of this government, coupled with ceaseless sighing for the high powers who hold in their hands the subordinate administration of Him who rules and governs all things, especially the high person of His Serene Highness the country's beloved Hereditary Stadtholder, and Her Royal Highness the Lady Princess, that Their Highnesses may ascend the highest step of this mortal life, laden with gifts of salvation and acclamations of a grateful people, honored as true foster parents of the beloved fatherland, and that Their Highnesses may transmit the luster and prestige of an immortal name, which they are worthy to bear, to the latest posterity; and likewise that Heaven in particular be approached with fervent prayers for the navigation of the East India Company and most especially for the richly laden keels that are soon to depart from India's capital, as well as from here and elsewhere, for the beloved fatherland, all to the glorification of the Triune God in the expansion of Christ's Kingdom, who thereto may teach the inhabitants of the world righteousness, humble us from the heart, convert us, and through the application of the Prince Messiah's saving merits not only deign to make us serve as a prop and stay for the common burden oppressed by wantonness, but thus also make us partakers of those graces which shall exchange a holy and godly walk for undisturbed heavenly bliss. To which ends it was also resolved on the aforesaid day to awaken everyone through the publication of this from the pulpit of the Castle church on Sunday the 2nd of this month, and the following day from the public gallery of the government, so that each and everyone may have time to prepare themselves for the godly intentions of this Government, with the prohibition of all trade and commerce on the aforesaid day of thanksgiving, fasting, and prayer, upon penalty that the transgressors shall be punished. Nagapatnam, in the Castle, the first of August 1772. Below stood: By order of the Right Honorable Valiant Lord Governor and Council. Was signed: Wm Duynevelt, Secretary. Upon the motion and application made by the skipper of the said vessel Alkemade, Jan van Eyssen, the sailors Joovis Jansz of Leyden and Hendrik Jansz of Batavia were appointed cook and cook's mate, as well as the fellow sailor Pieter Paulus of Dockum as quartermaster, all with the wages standing according to the regulation of transfers; and furthermore placed on that vessel the under-carpenter of the ship De Bovenkerkerpolder, Jan Vogelsang of Amsterdam, with promotion to master carpenter. Furthermore, the soldier Pieter Fox was promoted to corporal at 14 guilders, the soldier Pieter Jansz of Pinjum was transferred to sailor, and the sailor Tam Bormeester of Nystad to soldier, and admitted as soldiers among the Company's easterners the Malays Ismael of Queda and Tabar of Macassar with the usual pay of three rixdollars. Thus done and decreed in the Castle at Nagapatnam, date as aforesaid. Was signed: as before. the 31st of July 1772. Monday the 17th of August Anno 1772. Complaint made by a certain Englishman named Geo: Is: Hoisard in his letter of the 30th of July last addressed to this Government, enclosing a copy of a Gentoo bond dated the 1st of April 1757 granted by Rawoerij Wieragoea Chittij to one Collasingana Chittij for the amount of 3156 ½ Madraspatnam star pagodas, accompanied by the copies of three Gentoo letters written by the said Rawoerij Wieraragoewa Chittij to Collasingana Chittij under the dates of the 1st and 17th of April and the 2nd of May of the said year, complaining about the unwillingness of the merchant of the Honorable Company at Palliacatta, Ragoer Wengetarama Chittij, who had succeeded his father, the aforesaid Ravroerij Wieragoe Chettij, in trade, to pay that bond or to render any account, notwithstanding the fact that the aforesaid Collesingana Chittij, who was a servant of that Englishman, more than [illegible]

and with which request he had then visited Pulicat expressly for that purpose, both to the former and the present chief, yet each time had to return fruitlessly or with the matter unaccomplished, just as the letter which the said Englishman Hoisard had sent directly on that subject to Chief Dormieux had been of a similarly fruitless effect, all very amply set down in his aforementioned letter, requesting at the end thereof that his aforementioned servant be done justice in his righteous demand, and thus that his disbursed money for the purchase of corals, estimated by him with principal and interest at 7000 pagodas, may be paid to him, as is further understood by the aforesaid letter, the translation of which from the English language reads as follows: Nagapatnam the 17th of August 1772 To the Right Honorable Pieter van Vlissingen, Esquire, President and Governor etc., together with the Council. Right Honorable Sir and Gentlemen! I regret that I am hereby brought to the necessity of troubling Your Honors, but I hope that the occasion thereof will be sufficient to plead my excuses, and that Your Honors will be pleased to take the cause thereof into the most serious consideration. It is a complaint made to me by my servant Colla Singanah Chetti against one of Your Honors' merchants (who owes him a considerable sum of money, but refuses payment thereof) and is as follows, namely: That about 15 years ago, Balakistna (eldest son of the deceased Vera Chetti) came to Madras, bought corals from him (Singana) to an amount of about 3000 pagodas, for which sum he provided a bond in the name of his father (Vera Chetti), payable upon first demand, of which payment, having been demanded, was not fulfilled. That he (Singanah) immediately wrote to Vera Chetti at Pulicat, informing him of all the particular facts concerning the purchase made by his son Balakistna and requested that the bond might be satisfied; pursuant to that letter, Vera Chetti replied that as soon as the Dutch Company should advance him money, he would pay him (Singanah) what was owed to him, which he said would be within a few days. Nevertheless, several weeks passed and no money was paid, whereupon he (Singanah) again wrote to Vera Chetti for payment, to which he replied that he had about 3000 pagodas in his possession, which he wished to remit to him, and that he would send the remainder as soon as he should receive funds, which he assured him (Singanah) would be shortly; several months passed and no money was received; he (Singanah) resolved to go to Pulicat himself and to address the then Governor there for justice, which he did, and it was promised to him that he would be paid if he would return in a day or two; that time having elapsed, he (Singanah) paid his respects to the Governor, in expectation of obtaining his payment, but was turned away, and the same occurred from day to day for more than 6 months, so that Singanah, seeing his applications to obtain justice were fruitless, returned again to Madras, with the resolution to postpone his applications until a more favorable opportunity. That in the meantime Vera Chetti died, and Vencata Ramah Chetti succeeded to the estate as well as to the employment of his father with the Dutch Company (namely, as one of its merchants); Mr. Dormieux also succeeded as Chief of Pulicat, and he (Singanah), thinking it was now the right time to seek his justice, and that he would be treated better by him (Mr. Dormieux) than by his predecessor, therefore went thither again and informed Mr. Dormieux of all the particulars of this case, who promised him all the help that was in his power for the recovery of his funds, since his (Singanah's) claim upon Vencata Ramah was very equitable

445. 17 August 1772. seemed to be reasonable, but he, Singanah, was obliged to leave Palliacatta, as his affairs required him in Madras, without taking advantage of Mr Dormieux's good intentions towards him. That since then, Vencata Ramah has not made the slightest offer of payment, but thinks that he finds himself relieved of the least trouble in that regard, having seen him, Singanah, return twice to Madras without being able to effect his intentions in his journeys to Palliacatta. He, Singanah, has therefore requested me to undertake to procure for him the payment of his bond, which I promised him I would do, seeing that his case is a very hard one; I do not doubt that Your Honours will do the same, from the above-mentioned account. Having promised my servant that he would recover his money and that equitable justice would be shown to him, I first sent to the merchant for payment of the bond, letting him know my intentions in case of refusal, but he sent me a multitude of frivolous excuses. Therefore I immediately wrote to Mr Dormieux by one of my servants, laying before him the above-mentioned complaints and requesting His Honour to examine the same and do justice therein. But my servant returned after waiting for three weeks and informed me that he had delivered my letter to Mr Dormieux and that he had promised to answer it as soon as a vessel, lying on the roadstead of Palliacatta, which was loading Company goods, should be dispatched; that after it had departed, he paid his respects to the Chief to receive the promised answer, but that he was put off from day to day, and that Vencata Ramah, far from having been ordered by Mr Dormieux to render an account, laughed at my servant. Receiving this report, I wrote anew to Mr Dormieux, requesting him to let me know whether he was authorized to investigate the matter and take cognizance of it, of which I was in some doubt, as I was informed that he had made not the slightest inquiry into the complaints which I had made to him against Vencata Ramah; that in case he was unwilling, I would then address myself to the Governor and Council at Nagapatnam. But I waited more than a week without receiving an answer. Therefore, seeing that in that quarter all means of redress are fruitless, I turn to Your Honours, not doubting that you will readily grant me the same in an ample manner and do justice so far as the nature of the case shall appear to Your Honours to require. Therefore I beseech Your Honours that it may please you to write to Mr Dormieux to make the necessary inquiry into this matter and summon Vencata Ramah to defend himself and provide proof that this demand made upon him is unjust; if he is able to do so, then I shall desist from all further proceedings against him, but if not, I trust that Your Honours will act with him accordingly and 447. 17 August 1772. and will procure for me the payment of the bond by all means that are in Your Honours' power, without any consideration that he is a Company merchant, but that justice may take its course with him as well as with any other man; the sum he owes amounts to nearly 7000 pagodas, which cannot be regarded as a trifle for a man to lose, therefore I hope Your Honours will be pleased to consider this matter very seriously. Enclosed herewith is a copy of the bond and letters written by order of Vera Chittij promising payment of the same; the originals will be delivered whenever they shall be required. I am with great respect, was subscribed, Right Honourable Sir and Gentlemen, Your Honours' humble and obedient servant, was signed, Geo: J: Hoissart, in the margin, Fort St George, 30 July 1772. Which above-cited papers having been sent by order of the Governor to the members for reading, and it having been proposed to them on behalf of His Honour to transmit copies of those documents to the Palliacatta chiefs, with instructions to examine the state of that affair carefully, and to furnish this Government promptly with an explanation of their findings, as well as, upon finding that the merchant Ragoer Wengatarama Chittij, son and heir of Ragoer Wieragoe Chittij, is truly indebted, to recommend most earnestly to him on behalf of this Government to settle that debt amicably; lest he should otherwise be subject to being excluded from trade until he should have resolved that affair; and further to communicate to the said Englishman Hoissart, in answer to his letter, what has been ordered to the Palliacatta chiefs; yet if contrary to expectation the matter in question could not be settled amicably there, his servant could then address himself to the judge or the Honourable Court of Justice of this city and institute his action against that merchant, as should be found proper. Thus it was unanimously approved and agreed to carry the same into effect in such manner as has been proposed by the said Governor. Thus done and resolved in the city of Naga, 17 August 1772.

Except The Assayer Iacob van Tessel, due to indisposition. Arrival of the ship Vreedelust. The ship Vreedelust, projected by Their High Excellencies the Noble High Indian Government at Batavia to be an ordinary contra vessel for this Coast, having arrived here in the roads yesterday evening, and a packet of papers having been received therewith, upon opening, there was found therein the aforementioned esteemed dispatch of Their High Excellencies dated 3 July last, together with the annexes belonging thereto. And having perused the same, reflecting upon the shortness of the remaining time between today and the appointed departure of that vessel to Batavia from the northernmost office which it must call upon, namely around the 15th or 20th, or at the latest the 25th of the upcoming month of September, after having been unloaded here and having called upon both southern offices to take in the packages of linen lying ready there; so the execution of that order was deemed almost impossible to carry out effectively on account of the late arrival of that keel here, considering that one would easily need a month to unload what was brought along, and that only if the rapid back-and-forth plying of the chelingas is not impeded by the fierce west and southwest winds, as frequently happens, in which case it would then become too late to send that vessel to the north, besides other inconveniences that might occur in the meantime. But it was approved and agreed, subject to Their High Excellencies' respected approval, to detain the said ship here, in order to let it depart from here directly for Batavia at the ordinary appointed time around mid-October, and in the meantime to send all available sloops with cash and merchandise for Jaggernaijkpoeram as well as Bimilipatnam and Palicol, in order to collect with them all the packages that are on hand there not only for India, but also the homeland packages that might remain after the loading of the return ship, while having the packages from Sadraspatnam and Palliacatta successively conveyed hither by the pantjalling De Goedeverwagting and the thonij De Iohanna Maria. Having read the request of the native merchants Tieroemenij Chittij and Wagtinada Chittij, wherein they represented that, due to the troubles that have arisen in the principality of Tansjour, and the consequent departure of the principal merchants following the contributions imposed on the inhabitants of that realm, they have not yet been able to sell the 100 bhaaren of bar copper from Japan already received to date for this year, out of the 200 bhaaren of that mineral according to the contract entered into by them with the Honorable Company. Therefore requesting to be allowed to count into the treasury by the end of February 1773 the amount thereof, being 10000 new Nagapatnam pagodas, which according to the aforementioned agreement was to be paid mid-October next, before the end of August 1772; for the fulfillment of which the surety mentioned in the contract, the saukaar Betlappa Naijker, or his principal associate currently present here, would intervene. Although those traders are obliged promptly to fulfill the bond they entered into in that regard, and thus granting all such deferrals may not only sometimes lead to disadvantageous consequences but also give rise to more such instances; yet, on account of the promised mitigation in the aforementioned contract in case unrest should arise in the Tansjour principality, it was approved and agreed to grant the requested deferral until the end of February, but without this being allowed to be drawn into a precedent in the future, and that the amount for the copper to be taken must be counted into the treasury in due time without any delay or exceptions. Nevertheless, the proceeds of the aforementioned copper, as well as whatever they might have taken in addition on one or another security to complete the contracted 200 bhaaren for this financial year, shall be entered into the yield of the end of this month, and they shall be debited for it in the books as is proper. The expense account of Any of recent date, as well as that of Palicol, was approved, in response to which it was agreed to convey to the servants there, upon their letters of 8 and 28 July, as well as 8 instant, this Government's approval of the retrieval of the 20000 three-image pagodas lying at Jaggernaykpoeram for the service of that factory, with the announcement that another sum of 31347 of the same pagodas had recently been sent to Jaggernaijkpoeram for them. It was also approved that the merchants, since they had completely fulfilled the demands placed upon them, had been recommended to continue with the collection of coarse cloths, both short and long, to serve in fulfilling the new demands, as this was in accordance with the orders issued by this Government by letter of the 4th of this month; while in the meantime the Government hoped that the extraordinary mortality among the inhabitants there, caused by childhood and other diseases, might soon cease, and the residents who had fled out of fear might return. 22 August 1772. As it already appeared to the joy of this Government from the servants' letter of the 8th instant that the mortality was beginning to cease, and the majority of the fled people having returned, everyone had gone back to work and thus the cloths secured in the lodge because of their flight were returned to the washers, with whose finishing it was hoped the servants would have made all haste so that they could have been sent to Jaggernaijkpoeram in time for shipment on the vessel Alkemade of whatever among them might be destined for the fatherland. Upon resumption of the Palliacat letters of 21 and 31 July last, nothing was found to remark upon other than to approve the conduct of the chiefs regarding the loading and speedy dispatch of the sloop Poeijoer and the thoni De Johanna Maria, as well as the repair made to the leak discovered on the first-mentioned vessel, with a strict recommendation to prepare the incoming and on-hand linens with all haste for transport here, and that they should therefore inform this place how many bales they count on having ready by the 20th or 25th of next month, so that one may regulate oneself accordingly in sending the sloops for their collection. 465. 22 August 1772. Upon the letters from Sadraspatnam dated 3, 6, 8, 9, and 15 instant, it was deemed proper to instruct the chiefs to retain the spelter there for the time being, in which, according to the servants, there was no sale, because its price had also fallen considerably here due to the large supply from Macau, and to order the servants to report to the Government the current selling price there and in the surrounding areas. Council of Policy Private lease of the Today being the appointed day on which it is customary to publicly auction and lease the Company's domains of this city, the Governor showed the assembly that, out of the various proposals made to his Honour to have the lease of the mouth of the river privately, that of the Sahukar Ramasjandree Terre had appeared the most advantageous; namely 50 pagodas more than the latest lease in the year 1769, which had yielded 3660 pagodas per year, and that for three years amounting with the aforesaid increase to 3710 pagodas per year, with the request that in addition to this, also for the same three years, there may be assigned to him the tolls of the city gates 471. the 31st of August 1772 Further continuation things of that nature with the Company's ships to Batavia had to be missed; and moreover it was very necessary that the lease of the tolls of the city gates remained united with that of the mouth of the river, to prevent many fierce disputes which have frequently arisen and were difficult to prevent and to decide, especially concerning the goods which, under the name of maritime transport, were brought inside the gates, but sold here in the city to this one and that one without payment of the toll at the gates, regarding which there was mostly some collusion on the part of one or the other farmer: Thus, out of consideration that if the lease of the mouth of the river were auctioned separately, it would, for the aforementioned alleged reasons, absolutely yield less, since it was desired by some with a reduction of up to 240 to 400 pagodas; it was approved and agreed to cede the aforementioned three leases to the said Saukaar Ramasjandra Dewe, all the more so because the ordinary Saukaar of this place, Nallabheraam Tarwardie, wished to interpose as co-surety for it with 473. the 31st of August 1772 not only his name, but also make himself directly liable, so that, being men of great means, the required security was given for the prompt receipt of the lease monies on time, whereas otherwise, when leased by others and mostly divided into many shares, one had nothing but much trouble to collect the lease monies, because the one referred to the other, and thus coercive measures always had to be used to obtain the money, because those who participate therein secured for themselves as much of the incoming lease monies as was possible at the very first, in order to serve, at their mutual settlement to be held, as a deduction against whatever might fall to their share, yet at the final settlement most remained debtors; which conduct could sometimes have very detrimental consequences for the Honorable Company, and which it was impossible to counter if it remained on that footing. As likewise, for the term of three years and for 2700 pagodas per year, the lease of betel and tobacco was ceded to the native Nagamalloe Soeberaijloe Naijker, under the suretyship of the fellow natives Mahamadoe Meira and Narsinha Chittij, and thus 60 pagodas per year more than the leasing of the same had yielded in the year 1769. First was opened a packet of Batavia papers sent here via Bimilipatnam by the Bengal ministers along with their covering letters of the 10th of July last, and brought in that direction with the private bark Mastenbroek, which had been projected for this Coast but was dismasted in the Ganges; and found therein Their High Honours' separate and general duplicate missives of the 12th of May past with the accompanying annexes according to the register, of which the originals, according to what is noted in the resolution of the 9th of July, have already been received here via the return ship Alkemade. Further, having resumed the report of the members of this Council, the Junior Merchant and Dispenser Ian Aspengh and the Junior Merchant and Second Warehousekeeper Ioan Daniel Simons, concerning their conducted examination of the state of the diaconate poor fund as well as that of the lepers here, it was found thereby that not only were some guarantors lacking for certain sums invested at interest, but also that some guarantors, due to the insolvent demise of the debtors, having already been condemned by the judge to the satisfaction of the borrowed capital, have still not paid, and that it has hitherto been neglected by the church council, as the administrators thereof, to put the judgments obtained therefrom into execution, and properly to collect and cash those monies in due time: thus it was resolved to express this Government's utmost displeasure regarding that negligence and carelessness, since that heedless manner of proceeding was judged not to correspond in any way with the proper order and attentive management of affairs directly entrusted to them, and on that account it was further resolved to leave the damages and consequences that might already have arisen from this, or might still result, directly to the account and responsibility of the said church council, with the recommendation in the meantime to see to it at once that for the capital sums for which guarantors were lacking, other sufficient security be provided, or otherwise to demand the principal sum along with the accrued interest from the debtors within certain peremptory terms to be set for that purpose; as well as that there be collected at once the small capital debited to the repatriated Junior Merchant Iohannes Haselkamp, as well as his share in his capacity as co-guarantor in the debt of the clerk Claas Jan Dirksz., who already died insolvent in the year 1763, since for the discharge of both those debt items, the administrators in the estate of the said Haselkamp have been condemned by the judge, but, as aforesaid, it has been neglected to collect them as yet; as well as the debit of the deceased sexton Bastiaan Doense, without any further delay or exception being permitted in that regard, as the church council was judged accountable by the Government, and all of these could have been settled long ago if only the duty attached to the administration entrusted to them had been properly observed; and it was furthermore resolved to order them by extract hereof to present every year precisely around the end of mid-October the statement of accounts of the diaconate treasury closed as of the end of August, along with that of the lepers, with a clear showing of the receipts and expenditures, and whether the same has advanced or fallen behind, as has always been done and must happen in all well-ordered management. 501. 25 September 1772. to request their Honors mitigation in the arrangement regarding the garden to visit China because all of these are of not the slightest use or benefit, and yet make a great display, it was approved and resolved to address Their Right Noble the Noble High Indian Government in Batavia in the respectful letter to be sent via the ship Vreedelust, enclosing the said note, to request orders as to how their Right Nobles wish this to be dealt with, in order best to unburden this government of those useless and serve-nothing effects. The Lord Governor further showed that his Honor, upon taking over the China garden from his predecessor, the Noble Ordinary Councillor of the Netherlands Indies Pieter Haksteen, had discovered that its price was set at 5000 rix-dollars, of which the said Noble Lord Haksteen had remitted 500 rix-dollars, his Honor thus having paid and disbursed for it a sum of 4500 rix-dollars. From which capital, pursuant to the order of their Right Nobles, the Noble High Indian Government in Batavia, contained in their esteemed letter of 14 July 1770, ten percent had to be written off annually, so that if this continued to stand in such a manner, his Honor would in the span of five years alone pay half the value of that garden, and proposed at the same time respectfully to petition the said Right Nobles that some mitigation might be made in this regard. Which having been deliberated upon, it was approved and resolved to present that request of his Honor most respectfully to their Right Nobles in the aforementioned outgoing letter, since the assembly considered the same to rest upon equity, and certainly to be of no small importance for his Honor to have to lose in the span of five years alone a sum of 2500 rix-dollars on that garden, whereas the governor coming afterwards would have the same at their full disposal without contributing the least towards it. After this, the Lord Governor told the assembly that the Company's interpreter Nagamaloe Chinaija Naijker had in the past month of August extensively shown and demonstrated to his Honor not only the 503. 25 September 1772. the vexations and unreasonable treatments which were done and brought upon him by the native Mandalam Wengadassalam Naijker, to such an extent that he complained that if this were to continue, he would not be able to maintain himself any longer as the Honorable Company's linguist, since he was thereby deprived of all esteem, both among the inhabitants of this city and native grandees, and everything that he undertook, both within and outside the service of the Honorable Company, was thwarted; but that the same, in their pending lawsuit before the Honorable Court of Justice of this castle, had also availed himself of some false witnesses, who had been expressly summoned by him for that purpose from Madraspatnam and elsewhere, and who charged him, the interpreter, with matters which, if they contained the truth, would make him unworthy to serve the Honorable Company any longer in that employment which demands a certain degree of respect among the natives. Requesting therefore, since that lawsuit was already too far advanced to make new production therein without the benefit of relief, as the term for salvation had already been decreed, and he consequently could not obtain any new documents relating thereto without it, that his Honor, representing the high authority, would kindly permit him to obtain the necessary evidence in this regard in secret before the secretary of this assembly, Willem Duijnevelt, who also exercises the office of notary and was thus fully qualified for it, and further to grant permission to two of Mandalam's witnesses, named Annandappa, inhabitant of Madraspatnam, and Coepie Naijker, inhabitant of Direcotte, that they might come unmolested into this city to declare how the matter had in truth occurred with their given testimony and the oath that followed thereupon in the Malabar manner, because if he wished and were able to file those documents judicially at once, this would not only have become public and thereby thwarted due to the circumstances that would have to take place in such a case, but the aforementioned two persons, who had then 505. 21 September 1772. already departed from here again, would then not wish to come into the city to disclose the matter out of fear that some harm might befall them on account of their previous testimony, to which he, the interpreter, had said they were led astray through various detours, and which they, having great remorse about it afterwards, had related to different persons, which thus had come to his ears; and all this not so much to make use thereof in the trial, but rather to furnish his Honor with proof that he was by no means such a bad and pernicious subject as he was registered and decried as being through all those things, in order thereby to cause all bad thoughts that one might sometimes have conceived of him to cease. That His Honour, having reviewed that written document and found that what is contained therein pertains mostly to the lawsuits, and thus has no further relation to His Honour except that the documents, having been gathered by his order, ought primarily to be offered to His Honour in order to take the necessary information regarding the interpreter, and therefore deemed it best to refer the same to the Honourable Council of Justice, so that regarding the matters contained therein, at the decision of the suit, such consideration may be given as their Honours shall find to belong in good justice, since the ordinary way of relief was not only unknown to the native, but could also have no place in this matter, as they were not new productions but documents serving as proof of the falsity of the witnesses of the adverse party. 25 September 1772. All of which having been considered with attention, it was approved and agreed to confirm fully with the proposal of His Honour, and consequently to refer the aforementioned deduction and annexed documents to the Honourable Council of Justice of this Castle, just as they were then handed over during the meeting by His Honour to the Honourable President, in order that at the conclusion of the lawsuit brought against the aforementioned interpreter Nagamaloe Chinaija Naijker by Mandalam Wengada Pelam Naijker, such use and reflection may be made of them as their Honours shall find to belong in good justice. And further, the 4 Malacca mast timbers of 16, 15½, and 15 palms received beyond and above the invoice by the master of equipment to the credit of the Cormandel office; without booking the money until the billing thereof shall be received, which it was decided to request from their Right Excellencies; and furthermore here to note that all the armory goods brought per this vessel, conforming to the report received thereof from the commissioned military officers, are very bad, and instead of new, some already used and partly worn-out pieces are among them. — In regard to the exorbitant deficit on the pepper of as much as 8327 on 200005 lb, or 4327 lb more than the permitted allowance, it being made known and demonstrated by the skipper of that vessel by petition that such could be attributed to nothing other than the good condition of the vessel under his command, as the pepper having been unladen from there extra the 25th of September 1772. extra dry had thereby lost much of its husk and thus had yielded such a great wastage, with the further citation that the same would not have happened if the pepper had been shipped in straw sacks, with the request therefore, since it fell extremely hard upon him to have to bear such an important loss caused without his doing or any neglect of duty, for a favorable recommendation from this government to their Right Excellencies, to the end of thereby obtaining, if it might be possible, the discharge from that oppressive entry; it was thus understood to condescend thereto, and to make the same known in the outgoing letter, as the petitioner's request was judged by the assembly not to be unfounded, since the pepper according to the aforementioned finding was found completely dry and dusty upon receipt, and from that, not being shipped in straw sacks, notoriously a large wastage must have resulted. — The nutmegs brought per the ship Alkemade 519 the 25th of September 1772. nutmegs in the quantity of 158 chests, according to the report of the fiscal and judicial commissioners who assisted at the receipt thereof, having already been severely infested with mites upon delivery, and consequently by order of the governor having been garbled by the said officer and two members from the Judicial Council to prevent still further spoilage, and sprinkled with cloves, the report received thereof was also summarized, and in that regard it was decided to write off the found 3508½ lb of mite-infested and tainted nuts on 19896 lb, making 17 5/8 percent, to the profit and loss account, and then to transfer them to that of dust and rubbings of spices, and to send them with the ship Vreedelust to Batavia; and furthermore to write off also to that same account the short found 199 lb or 1 percent; as well as 56 on 5599¾ lb of cloves, likewise making one percent found short during the sprinkling of the aforesaid nuts. — The skipper of the aforementioned ship Vreedelust lust having made a request in a submitted petition for diverse necessities for the benefit of that vessel further specified in that document, it was thus understood to condescend to that request as it lies, since the same is extremely necessary, to insert the said paper into this. —.
