To approve the same, to have the unpaid moneys settled, and to request Their High Excellencies for their write-off. so it was, after exact resumption of that Paper with the Accounts and receipts belonging thereto under the Letters A, B, C, D, E, F, and G, and the knowledge that what was entered had truly been gifted and paid, deemed good to approve the aforementioned memorial, to have the unpaid remainder still outstanding on it amounting to rops 932 7/8 satisfied from the Treasury, in order to debit the account of the mission to the Poena court for that and for the gifts presented from stock entered in this Financial Year amounting to f72:13:8, and subsequently, upon the first letter of address to Their High Excellencies with the transmission of the original submitted memorial and appendices, to request Their High Excellencies' most favorable authorization in order to be permitted to write off the entire amount, and pursuant to the authorization from there to balance it in the General ledger. On this occasion, further deliberation having been held upon what was communicated to the meeting by the Lord Director, that Their High Excellencies, upon the proposal made thereto by His Honor and the second, 188 The 13th of June Anno 1772. To resolve to dispatch an annual gift of ro/a 4000 to the Maratha court to cultivate his friendship and present a gift. in their secret Letters of the 2nd of August 1771, had permitted to give an Annual present to the value of Rops 4000:—. to the sovereign of the Marhattas in order thereby to attempt once more whether one might obtain from the said sovereign a safe-conduct for the Company's Ships departing for Souratta and Malabar, as well as for the Persian Gulf, and also along that way to cultivate more and more the established Friendship; so it was deemed good, pursuant to this most favorable authorization, and on account of the necessity thereof, as the only means to maintain peace with these peoples, who are constantly increasing in power and capacity, and to be protected from their Piracies at sea, to have the necessary and sufficient Presents purchased for the Sovereign and his court dignitaries, and therewith directly after the end of the Rainy monsoon to dispatch a competent person to the Poena Court, 189 The 13th of June Anno 1772. in order to insist upon the Acquisition of three letters of safe-conduct for our Ships. Was signed: A. J. Sluijsken The 13th June Anno 1772. The surplus delivered over what was paid. Sale of 90 leagers of arrack at Rdo 100 per leager at 33 1/3 percent advance. Thus, after re-examination of that paper, it was approved to have the amount of ƒ15020:7:—, or Ropias 12516:46, which these servants were found to have delivered in excess of what they received, paid out of the Treasury. The Director having informed the meeting that at last, and after having tried for some time to sell the arrack recently brought here, or rather that portion thereof which is held in excess of what is needed for the household, he had now succeeded so far in that respect that His Honor was offered by the Parsi merchant Boumanje mannikje a sum of 100 Ropias per leager, being all that His Honor saw any chance of obtaining for this article with any possibility, it was, in consideration of the fact that according to rumors a small ship from Batavia had arrived at Bombay a few days ago with 90 leagers of liquor, and that the same was thereby likely to drop sharply in price again, whereas now it would still yield an extra profit of easily 33 1/3 percent, approved to cede the aforesaid arrack for the aforesaid one hundred Ropias per leager to the aforesaid Boumanje mannikje, on condition of receiving it immediately and paying at the end of August. Next, an invoice submitted by the Master of Equipage van der hegge was presented concerning the expenses incurred in rebuilding with brick and lime a wall formerly of bamboo filled with earth, 44 3/4 feet in length and 17 feet in height, which had fallen down from the dwelling house on the Northeast jetty of the Company's shipyard, occupied by the Honorable Secunde, as well as repairing and restoring the water well on the shipyard, and masonry work and plastering of a large water basin around it, together with the making of a wooden derrick above it, amounting in cash to Ropias 970: 36. After prior re-examination, and since it was evident to the assembly that the aforesaid specification below contained nothing excessive, it was approved to confirm the same and thus have it paid out of the Treasury. The 7th of August Anno 1772. Upon the request of the brokers to transfer their debt claim against Sabidas Nagerdas to the Company. All present. Before noon. The Lord Commander, having convened the members of this assembly, made known to them how the Company's brokers, some days ago when the rumor began to spread that the Banyan merchant Tabitas Nagerdas was about to go bankrupt and had already absented himself by flight, had addressed His Honor, stating that there was still due to them from the aforementioned Tabitas Nagerdas approximately a sum of thirty-nine thousand two hundred forty Rop:s and 17 peesen on account of merchandise delivered to him out of the Company's warehouses and assigned to him, and urgently requesting to protect them most effectively in obtaining this debt claim, and to that end to collect this claim on behalf of the Company in reduction of their debit to the Honorable Company, as it was otherwise to be feared that if not the other numerous native creditors, the respective regents would make themselves masters of the left-behind goods and leave the debts unpaid. That he, the Lord Director, hereupon, as well out of consideration that what was advanced by the brokers was in all parts the truth and confirmed by numerous examples, as also mainly out of consideration that the said servants, who also through the misfortune of the times, the numerous disasters in trade, and a number of bankruptcies had suffered much for some time, might through such an important loss be rendered unable to satisfy their own debit to the Honorable Company, and that along that way it might happen that the said Company itself suffered damage, had deemed it well to have the aforementioned brokers execute, on the 31st of July last, a formal deed whereby they transfer this claim in reduction of their debit to the Company in full ownership, without prejudice however to the right which the Company has, and continues to retain, against their persons in case nothing can be recovered from the goods of Tabitas Nagerdas in case of non-payment by Tabitas, who has since gone bankrupt. And whereas one was now thereby placed in a position, in order to protect the brokers and consequently the Company as much as possible from damages, to publicly claim this claim against the aforementioned Tabitas Nagerdas to the amount of Ropias 39: 240: 17 on the Company's behalf, His Honor, since the flight of the same was certain and he, the Lord Commander, had already four days ago caused all his warehouses and dwellings to be occupied by the Company's native soldiers, submitted to the joint members for consideration in what manner this affair had now best be handled further for the indemnification of the brokers and the protection of the Company. Whereupon, having deliberated with attention and taken into consideration that it is in the highest degree necessary to protect the brokers in these critical times as much as possible from damages in order consequently to protect the Company itself from disadvantages; and that for this purpose in this case there is no other means than to publicly hold and treat the debt to the brokers as a debt to the Company itself, and this for the reasons that the brokers in case of preference for this claim would never get any further than in competition with the other creditors, whereas the Honorable Company nevertheless always retains the right of preference in the first degree over its merchants and dependents, such as this Tabitas who has always been under its protection; it was unanimously approved by all members to assert and maintain the right of the Honorable Company, on the grounds, to the end, and in the manner aforesaid, upon the left-behind goods of the aforementioned absconded Banyan merchant, and consequently to have all of the same taken into custody and attachment in the name and on behalf of the Honorable Dutch Company, accordingly causing two judicial commissioners to open the warehouses and to inventory and seal the goods and merchandise found therein, and subsequently transfer them to the Lodge on the Company's own territory, in order from that subsequently, as far as possible, to be able to indemnify the Company and other creditors according to the order of law. 187 The 15th August 1772. as appeared from a contract produced: written down, and sent to the Lodge, might be returned to him, on the grounds that this sugar, among other goods, had been pledged to him by the said Tabidas, and he had advanced on all the same a sum of Ropias 8490: -., as would appear from an annexed translated contract drawn up with the aforementioned Tabidas Nagerdas, but signed by his brother Sieuwdas, the said petition and contract being of the following content. To the Right Honorable Martinus Joan Bosman Director and Commander-in-Chief of this Directorate together with The Council Right Honorable Sir Gentlemen The Banyan merchant Saa Rettingje Gokel shows with all due respect how, when on the 7th of this month an inventory was made of the remaining goods of the absconded fellow Banyan merchant Tabidas Nagerdas by a judicial committee, as the petitioner has been informed, and these were transferred to the Honorable Company's lodge, the same committee members, in a house containing also a warehouse belonging to the petitioner, through mistake and lack of necessary information, also wrote down and sent to the said Lodge a quantity of forty-five pieces of canisters of candy sugar. That the petitioner immediately upon receiving this news approached the aforementioned committee members, informing them that the transferred 45 canisters of candy sugar belonged to him in ownership and requesting immediate restitution thereof, but he was answered by them that this was beyond their power, and in this regard they referred him to their Commander, who they did not doubt would grant him the justice to which he is entitled. And since the petitioner subsequently addressed himself to the Right Honorable Director, who required him to prove sufficiently his right of ownership in this matter, he takes the liberty very humbly to perform this herewith, and to that end to submit: That when the said Tabidas on the 8th of the recently passed month of June received from the Honorable Company's warehouses a quantity of 8 bags 224 The 15th August Anno 1772. 8 bags and 95 lb cloves 1 ditto 56¾ lb nutmegs and 45 canisters of candy sugar The same subsequently having approached him, the petitioner, wishing to borrow some money on the aforementioned merchandise, which he knew no other than that they belonged in full ownership to the said Tabidas, and to pledge the said goods for it, they agreed on the 11th thereafter, as appears from this annexed original contract, to advance thereon a sum of Ropias 8490:—: and which having consequently also taken effect immediately, the goods were placed under his custody and the cloves etcetera from them have already been sold. Instead of acquitting himself of this his duty, he has failed, leaving behind among other debts a claim to my charge by the toll collectors amounting to Rs 5070:17, notwithstanding that I, as stated above, had placed him fully in a position for its liquidation. My first care upon discovering this unpleasant news was to inform myself whether he had sold the frequently mentioned toll goods, whether they were paid for, and whether they had been collected. In this investigation I proceeded with the greatest accuracy, and to my particular regret found that the spices, and among them indeed 1545 lb cloves, 238 lb nutmegs, and 54 lb mace, were collected a few days before his flight by the merchants as presumably sold to them, or actually pledged in an ungodly manner, as will appear better in the sequel of this; but that the aforementioned 45 canassers of candy sugar, of which he was said not yet to have disposed, had remained in his own warehouse; Since at the same time the warehouses etcetera of the repeatedly mentioned runaway Banyan had been occupied with sepoys on behalf of the Honorable Company by the Lord Commander according to the custom of the country, I have, according to my bounden duty, made a report of the whole matter to His Honour, with a humble request for his assistance, to the end that I might as much as possible be preserved from damage on account of the King's toll goods delivered to the repeatedly mentioned Banyan for distribution. And which humble instance was also of that fortunate consequence, that Your Honour and Your Honours jointly, my lords, have been of that particular goodness to allocate to me the said 45 canassers under the taking of a solemn oath before the Lord Commander that they were the same 45 canassers that I, for the purpose as said before, had delivered to Tabidas; and for giving which formal assurance I was at that time prepared, and henceforth will also always remain so. The matter having remained thus, and being in no way able to suspect that anyone else could still form any rightful claim to these 45 canassers in the least equaling mine—the more so since already 14 days had passed since the flight of Tabidas without anyone having presented himself publicly—there was handed to me yesterday by Your Honours in this meeting a petition in the name and on behalf of a certain Banyan merchant named Saa Rettingjie Gokel, whereby he, the petitioner, attempts to prove on two principal grounds that the repeatedly mentioned 45 canassers belonged to him in ownership, exhibiting to that end: firstly, alongside his petition, a native so-called deed of favor, alias a deed of sale or pledge, in proof, as he says, that the mentioned 45 canassers, among others, were said to have been transferred to him, and that he had advanced money on them; and asserting his alleged right in this secondly in two places with this positive position that the judicial commissioners by mistake in a

Surely such a contradiction must appear suspicious to everyone, and lead to the very probable conclusion that just as his assurance that he had a warehouse in Tabidas's house is untrue, so too the alleged contract, which is in and of itself untenable, can and may be regarded entirely as fabricated and worthless; and possibly concocted not until after the flight or feared bankruptcy of Tabidas, with or without his brother Sibidas, in order to have some appearance of right to the King's toll goods delivered by me to the frequently mentioned Dabidas. Thus, after careful reading of that document and consideration of everything relevant to the matter, it was approved and resolved to persist with the decision of this Council of the 7th of this month, and consequently still to award the 45 disputed cannassers of candy sugar to the aforementioned Warehouse Master once he shall have performed the required solemn affirmation in place of an oath that these 45 cannassers are indeed the same that were weighed out by him toward payment of the tolls, and this for the following reasons: First, that the produced contract of pledging, submitted with the petition of the Banyan Saa Rettingjie Gookel and recorded in the resolution of the 15th of this month, can merit no credence whatsoever, not to say that it may have been fabricated after the flight of Fabidas, since it is not signed by the seller or pledger, the aforementioned Fabidas Nagerdas, to whom the goods were delivered in satisfaction of the tolls, and that the signature of his brother can be of no validity, 236 The 18th of August, Anno 1772. since they have not traded together for two years past, and the same signature, according to the own confession of the aforementioned Saa Kettengie Gokel, took place only a month after its date, when Tabidas was already out of the city and partly on the run from one place to another. Secondly, that the assertion of the aforementioned Gookel, that this sugar had been found in his warehouse and had been mistakenly removed from it by the commissioners, is completely refuted and stripped of all semblance of truth by the attestation submitted by the Warehouse Master with his aforementioned report. And thirdly, that it cannot have been unknown to the aforementioned Banyan that these 45 cannassers, among others, had been delivered in satisfaction of the tolls, and the repeatedly mentioned Fabitas Nagerdas thus had no right to pledge them to him to the detriment of the country's dues, quite apart from the fact that the prices for which they were pledged clearly demonstrate the invalidity of the contract, being far less than what they are sold for even by the Company. 211 The 22nd September Anno 1772. Mr. Price was requested to use his influence for his return, which he accepted, under the condition of a written assurance that no personal harm would come to him. In order also to request the Nabob's assistance, the Company's brokers were sent to the Darbar. disagreements and disputes, both among the Europeans and natives, caused His Honour to decide to request Mr. Price, in the capacity of a friend, to employ his well-known influence both in this city and with the surrounding rulers in order to recover this Fabidas; which being accepted by His Honour under the condition that he, the Director, should grant the fugitive Fabitas a written promise that, upon his return, no personal harm would be done to him by arrest or otherwise; so he, the Governor, subsequently also agreed with Mr. Price on the 1st of this month to leave all disputes caused by the said flight in statu quo until such time as the fugitive should be recovered. That he, the Governor, before this matter had progressed thus far, had on the said 20th August sent the Company's brokers Manchergie Gorseedjie and Govenram Roederam to the Darbar, in order to deliver to the Nabob the same message as mentioned herebefore to Mr. Price; but His Excellency having refused audience to the brokers on two separate occasions, His Honour was obliged, on 21 August, through the aforementioned, But who, being unable to obtain an audience, 242 The 22nd September Anno 1772. a complaint was made thereabout to Mr. Price, who gave the answer that the Nabob did not wish to speak with Manchergie, which reasons, however, not appearing, another delegation was sent again. to lodge a complaint with the said Mr. Price in his capacity as Governor of the Mogul's Castle through Commissioners van Cittersz and Sontag, and to submit that such conduct was contrary both to ancient customs (according to which no one other than the Company's brokers is ever sent to the Darbar) and especially also to the Company's firmans, which grant them lawful power to be able and permitted to employ in their service, without contradiction from anyone, such persons as they deem useful and necessary for the purpose; to urge him to oblige the Nabob to grant audience to the Company's brokers according to ancient custom. That Mr. Price at that time merely answered that he would send to the Nabob, and subsequently on the 23rd of the same month did let it be known through a servant that the Nabob did not wish to speak with Manchergie, and that His Excellency had undertaken to provide the reasons for this in writing; of which a written statement of reasons was to be given; but that these reasons not appearing, although he, the Governor, had on that account also caused insistence to be made on the 24th of the same month by a second delegation, His Honour on 29 August sent a third delegation, consisting of the members of this Council Holmberg and van Citters, to Mr. 243 The 22nd September Anno 1772. and received as an answer the aforementioned, namely that Manchergie had sought to ruin the Nabob.
