Whereupon it was unanimously approved to require those who held the commission to account for themselves satisfactorily in writing concerning the neglect that probably took place during the inspection of the households, in order to decide further upon the matter according to the findings; while it is also simultaneously resolved to place the aforesaid Philip Bakhuijs—who, upon inspection by the Chief Surgeon of the Company's Hospital, Louis Quintin Martensart, and the native physician Genasa Pandiet, was found according to the submitted report to have a very contagious disease of leprosy—into the leper house at Paliaporto, and to that end to grant a warrant to the outside regents of that hospital to lodge and treat him therein, and to insert the report herein.

An extract of the resolution taken in the Council of Malabar under date of the 18th current having been handed to the undersigned, whereby they are ordered to justify themselves satisfactorily regarding a neglect of duty said to have been committed during the recently conducted annual survey and inspection of the families within this town; yet the same take the liberty respectfully to bring to your Right Honorable's attention and to testify under the oath imposed upon them: that when the families were surveyed and inspected by them by the end of June last, of all the residents who were presented to them, they found no one who was infected with the grievous disease of leprosy; furthermore, that the European Johannes Philip Bakhuijs, who is now discovered with that sad disease, was not present at the time, but according to information obtained lived on Vypin, and only just recently came to live in the town; therefore, the undersigned hope that it will most favorably please your Right Honorable to pardon them in this matter, since that unfortunate person not having been present, it was impossible for them to know whether he was infected or not. Friday the 28th October Anno 1774. That his Honour had caused a warrant to be issued upon the Fiscal, to pay that sum into the Treasury, but that he had presented in that regard a petition, which his Honour produced, which having been read, it appeared therefrom that the said Van Barn makes known that he finds himself very embarrassed in that regard, that having no ready money, without directly encumbering or pledging his goods and effects to his considerably greater disadvantage, he is unable to satisfy that amount immediately. Therefore he humbly requests that this charge may remain running upon the books under charged levies, or that he may be debited for it and two sufficient sureties may be accepted, until Their High Excellencies' further orders; as well as that he might be granted permission to present his interests against this charge to Their High Excellencies, requesting also this meeting, upon submitting the petition for his discharge addressed to the said Their High Excellencies, to take cognizance of the matter. Whereupon having deliberated and taken into consideration the precedent regarding a charge amounting to 6868 guilders to the debit of the Junior Merchant Van der Wall, the details of which are noted in the Malabar resolutions of 8 December 1762 and 21 January 1763; likewise in dispatched letters from here to Batavia of 31 March 1763 and 15 April 1764; likewise in received letters from Batavia dated 25 October 1763 and 24 September 1764; from which it appears that the said sum was placed upon the salary account of the said Van der Wal until he submitted his objections against it and requested an exemption, which subsequently also followed from Europe; while at the same time it was taken into consideration that, although the case of Van der Wal was not in all its parts identical to that of the petitioner, the Company nevertheless incurs not the least risk in this, but is sufficiently secured by sufficient sureties, and that only for that short intervening time until Their High Excellencies will be able to dispose of and answer it; as well as that among the arguments which the petitioner employs, there is one that serves very much for his excuse and of which our superiors will undoubtedly have had no knowledge, namely that the public sale at Surat, from which the aforesaid charge actually originated, was held by the former Director Drabbe himself, and that he was thus not only ignorant of the particulars relating to that matter, but even unable, even had he been informed of everything, to take the necessary precautions regarding it, and thus may still have hope for a more favorable disposition. So it has been approved, in order to prevent the petitioner from immediately having to proceed to a disadvantageous encumbrance or sale of his goods and effects, to give him for the present, or until further orders from Their High Excellencies, an account on the books for that charge, and to have two sufficient sureties provided for it, as well as to present his request for exemption to Their High Excellencies in the most favorable manner, since it appears in all respects to be a very unfortunate case and to have occurred through no fault of the petitioner.

This entry of ƒ14400:— being utterly hopeless, it was understood, upon further departure of letters, to bring this respectfully to their knowledge, and to request their Highest Dispositions, respectfully referring to the notes of the bookkeeper. ƒ11248. 17. 8.
