306. The 24th of May 1773. The 24th of May 1773. To the Right Honorable and Venerable Sir Martinus Joan Bosman Director and Chief Commander of this Directorate as well as The Honorable Political Council! Right Honorable and Venerable Sir and Gentlemen! In accordance with and in fulfillment of Your Right Honorable's most respected intention, as appears from the excerpt of the minutes of the resolution adopted in the Council of Policy on the 17th of this month handed over to us, that the undersigned were to examine and closely investigate the account entrusted to us of the chief mate Nicolaas Hilkes and the third watch Wilhelmus Schendelaar on the one hand, and the sworn statement of all the deck officers who had been on board on the other hand, concerning the stranding of the Company's ship Walcheren on the first of May recently past, in order to provide a written report on whether the said Hilkes has made himself guilty of neglect of duty or not; so we have the honor respectfully to state that, after mature deliberation and having compared everything carefully against each other, it is our respectful opinion that the aforesaid chief mate Nicolaas Hilkes has indeed clearly made himself guilty of neglect of duty, as appears from his own and self-contradictory account, and secondly even more clearly through the aforementioned sworn statements of the deck officers. Firstly, it appears to us that he had no reefs in the topsails, much less having them on the reef points, nor did he use the precaution, with the rising wind and high sea, to haul long bights of the sheet and bow cables onto the deck as is the duty of every seaman in general; all the more so since wind and current having a double force on the vessel, he should not have neglected, with the rising of the flood and increasing wind, especially since the dark evening was approaching, to drop the sheet anchor, and by veering out a reasonably long slack thus ensure that the latter came to bear an equal strain with the daily anchor. In which cases, and if he had put that into effect, humanly speaking that striking misfortune would not have befallen him, and he would only have had to weigh the sheet anchor again with the onset of the ebb, and shorten onto the service of the daily cable when it came to lie moored as before. Secondly, it appears to us that, at the breaking of the daily cable, he was not ready, upon the dropping of the sheet anchor, to veer out so much slack of the cable that the ship could ride properly according to the conditions of sea, current, and wind, since, according to the general statements, he had not the least bit of cable on the deck, whereby that anchor certainly only dropped for a short bight, and the veering out, through a consternation that one can reasonably imagine, must have proceeded very slowly; besides and in addition to the fact that, through that carelessness and because one could not immediately let the sheet anchor run out so, the ship was driven toward the shore, over sea and current, and by that heavy jerk or wrench that the ship had to exert on the mooring or shore anchor, that cable notoriously had of 307.

Ten Tweeden Komt ons te vooren, dat hij bij het breeken van het daags Touw, niet is klaar geweest om met het vallen van het plegt soveel bot te steeken van het Touw dat het schip be„ „hoorlijk konde rijden nageleegendheid van Zee, stroom en Wind, dewijl hij blijk ens de algemeene Verklaaringen geen het minste Touw op het dek heeft gehad, waardoor dat anker sekerlijk, maar voor een korte bogt gevallen is, en het toesteeken door een Consternatie, welke men sig met reeden kan voorstellen, seer langsaam moet sijn toege„ „gaan, buijten en behalven, door die onagtsaamheid, en dat men het plegt soo niet terstond konde laaten toegaan, het schip nade Wal, over Zee en stroom geslaegen is, en door die swaare torn of ruk welke het schip aen het tuij of land Anker er moestdoen; dat Touw notoir gehad van 307.

308 309 The 24th of May 1773 The 24th of May 1773 must have been of an extraordinary quality in order to hold, whereas it has now already parted before it even came to point ahead. Thirdly, that then, with the breaking of the bad rope and the dropping of the bower anchor, which appears according to seamanship to have been paid out to its end, there was also then no time left to loosen the sails that were lying ready for the emergency or final anchor, and thus by the strong catching of the wind in the sails on the topmasts to hasten the breaking of the last hope, the more so as it is not without well-founded suspicion that the ship, by the continuous dropping of one anchor before and another after, must have been driven toward the shore very much by the hard wind, high seas, and flood tide, and that there was thus no time left to reef the topsails, which as a result of all this could not be ready before the ship had already struck ground, since lying across the sea and current, with so many ends of ropes ahead, it was not humanly possible for the ship to tack or veer with them into the wind, but it absolutely had to hasten its drifting onto the shore or banks, the turning being made impossible because the ship could not gain the least headway, and therefore his chief mate's first work should have been to haul in immediately the ends hanging out of the hawseholes of the successively broken ropes, or according to the circumstances of time to chop them off at the bitts, so that they could not be an impediment to him in case of having to use sails, and thus we find ourselves obliged in conscience, however much the master's misfortune affects us, to say that we do not find that he in any way discharged the duty and foresight of a seaman, because he did not reef the topsails in time and set them together with the foresail on stopping ropes, and did not, following the esteemed order or instruction of this roadstead at the proper time, inspect the anchors and ropes, and indeed the worst, that he, being well aware in what poor condition he was to be able to use sails, did not, as mentioned before, let go the sheet anchor in time, in order to bear equally alongside the daily or sea anchor, and in which case his duty would also have been subsequently to have the bower rope hauled onto the deck and secured to the bitts immediately, in order, in the event of the breaking of one or another rope, to be once again in a position to lay the ship to two anchors, when, with the wind that was blowing then, it humanly speaking might well have been able to hold the Company's valuable vessel in the roadstead, and in case misfortune should then have struck, he would have discharged his duty for the greatest part and principally with respect to anchors and ropes. And further resolved to have all of the Company's vessels, as they can now be of no further service, unrigged according to annual custom, and to have their defects or necessities reported by the equipment overseer, as well as to discharge the native sailors serving thereon at the end of this month. Lastly, the Director caused it to be noted herein that when Mr. Price had informed His Honor on the 19th of this month through a body servant of his impending departure on a short trip to Bombay, asking whether there would be anything for the service of the Director, Thus done, resolved, and determined, on the day, month, and year aforesaid, was signed, M:s J:n Bosman, A:m J:s Cluijsken, J:b v. d. Sleijden, F: B:d Zimmerman, R:s C:s de Passij, W:m L:k Sontag, P: J:n Bocquet, and E: N. Wiardi. His Honor thereupon on the 22nd of the same, however much the duties of civility otherwise require that someone who is about to depart from a place comes to pay the first farewell visit to another, proceeded in the company of the Honorable Second Cluijsken to the said Mr. Price, and took a very friendly farewell of him, but that this gentleman, not having deigned to pay a return visit to the Director, His Honor for that reason also caused no salute to be fired when the aforesaid Mr. Price passed our shipyard upon his departure on the 23rd following. All present Forenoon The Lord Director declared that he had convened this meeting in order first of all to have recorded That His Honour on the 18th of the past month of May, with an English opportunity, had received a packet wherein upon opening were found An original letter from the Lord Governor and Council at Colombo, dated 16 March 1773, conveying a Bengal letter under date of 15 December 1772 and the copies of the letters dispatched by those ministers both to the Right Honourable Gentlemen in the Fatherland and to the High Mightinesses at Batavia, with and beside a duplicate letter and requirements from Ceylon, and which aforementioned letters it is deemed proper, insofar as they require an answer, to reply to at the first opportunity. For some years the ground on the northeast side of our wharf has been so washed away by the force of the currents which strongly press upon it, especially during the usual drainages in the bad monsoon, that the stone stairs on the said side have become totally undermined and are already sinking away, and which in time could have the consequence that both the land before it and that side part of our wharf itself would be swallowed up by the water. Accordingly, having already taken advice hereon a year ago with the prior knowledge of Mr Price from Your Honour's engineer Mr Makniel, we have taken the resolution, in order to break the force of the currents and to protect the ground from further washing away, to have a piling built before it to a length of 325 feet, and which would consist of three rows of piles, driven into the ground, protruding at least two feet above the highest water, and the outermost row of piles lined with woodwork. And the consent of the Castle Governor being required for this according to custom, I have the honour, as Your Honour presently presides at the head of affairs, to request Your Honour very kindly herewith for the same, as well as subsequently to be pleased to allow the engineer of Your Honourable Company serving here, Mackniel, to serve us in this work with his good advice and knowledge. The 22nd of June 1773. against which Holmberg made his request the voting members agreeing with the proposal But the Lord Director persisting in his opinion of these good men should proceed from our side, while His Honour declared to be of the opinion that, whereas Deanaat, according to the complaint submitted by him to the English Council and sent to us with their letter of the 17th of December 1772, instituted his claim in two parts, the first being against the Company on account of goods which he is said to have purchased from the Director and Secunde, and partly not received by him, and the second against the Warehouse Master Holmberg concerning sugar purchased from the same, the election of the Arbitrators with respect to the first ought to be done by this Assembly, and of the second by the said Warehouse Master, whom, however, one ought to let defend both disputes according to good counsel, as being solely responsible for the weighing out, about which the dispute exists. Upon hearing this last proposal, the said Warehouse Master Holmberg, standing up, most respectfully requested that it might please this Council, before proceeding to a positive decision thereon, But the Lord Director declaring once again that, whereas according to His Honour's opinion the Warehouse Master was the only one who had to answer for the weighings-out which he carried out upon written order according to custom, he also alone and no one else could be held accountable for it and was able and obliged to refute the assertions of Deanaat, and that, if the arbitrators might come to make an award to the detriment of the Company, Holmberg, regarding the claim that the said Honourable Company retains against him, can justify himself before this Council as seen fit. Thus His Honour put this matter to the vote, and to examine to what extent he could reasonably be ordered to defend Deanaat's certain claim upon the Honourable Company, as he maintained having no direct relation thereto, at least not so long as he had not been condemned by definitive sentence to compensation, and he should beforehand have brought forward his interests against it. And by the aforesaid Mr. Perrott it was said that it ought to read: That one must not hinder them without reason, or unless some fault had been committed; but the latter having been added arbitrarily by his Honor and without saying anything to anyone, upon the discovery thereof and the consequent opposition of the undersigned, it was left out, and he drafted in English that one must not hinder them without reason or guilt, further giving to understand of his own accord that the brokers were indeed primarily answerable to the Moorish regents in case of misconduct, as well as all the Company's subordinates, to which the undersigned fundamentally only replied that, since this remark did not pertain to the subject of the present commission, no discussion on this matter was appropriate at this time.
