Petition of the First Clerk Spierejee. consideration that this Hunter, as a man whose credit under the Government in Bombay is very extensive, has now and then been of service to the Honorable Company, and to oblige this Council, as appears from the minutes recorded at the session of the 24th of May last, was also very willing to take upon himself the transport of various papers of ours to Malacca, consigned to the Honorable High Indian Government at Batavia, and which he, by previous writing addressed to the Lord Director, declared already to have received and placed under his particular care, it was approved and resolved to grant the aforementioned request and consequently to dispatch for that purpose a brief letter to the Lord Director and Council of the China Trade, as well as to send the same to the aforementioned Hunter for delivery. The Bookkeeper and acting First Sworn Clerk of Police, as well as Secretary of Justice Hendrik Spierejee, having submitted a petition of the following content: To the Right Honorable Lord Martinus Joan Bosman, Director and Commander-in-Chief of this Directorate, together with the Council. Right Honorable Lord and Gentlemen! Your Right Honorable's very humble servant Hendrik Spierejee of Amsterdam, Bookkeeper and acting First Sworn Clerk of Police, as well as Secretary of Justice employed at this office, respectfully submits to Your Right Honorables how he, for some time now to his inner grief, has been afflicted with violent and debilitating illnesses, which, combined with a rupture that befell the petitioner already in his childhood years, completely incapacitates him from performing his duties, with which Your Right Honorables have been so very graciously pleased to honor him, so that he finds himself compelled most respectfully and as a great favor to request of Your Right Honorables that it may please Your Right Honorables to relieve him of these aforementioned duties, and further to permit him 384. 385. The Sworn Clerk Goverts junior in his place. referred to Their High Nobles, but his request for retention of salary. to sail with the very first opportunity to the capital, retaining rank and salary, in order to test whether a change of climate might in any way promote his recovery, which is otherwise much to be doubted; for which great favor he shall always show himself grateful. Which doing, etc. In the margin: Surat, the 2nd of July 1773. Having made request that, since he has for some time been afflicted with violent and very debilitating illnesses, such that the same, combined with a rupture that befell him already in his childhood years, completely incapacitate him from performing his aforementioned duties, he might graciously be relieved thereof, and that it furthermore be permitted to him to sail to Batavia with the first opportunity, in order to test whether a change of climate might in any way contribute to his recovery, which is otherwise much to be doubted; so it was, out of conviction that the statements advanced by him, Spierejee, correspond in all parts with the truth, approved and resolved to grant his aforementioned requests, but, regarding his plea to be relieved from here with retention of his earned salary, to refer him to Their High Nobles, the Lords of the High Indian Government, as this cannot be granted here. And since the office of First Sworn Clerk of Police and Secretary of Justice at this office has hereby become vacant, the Lord Director inquired which of the scribes currently present might suitably be appointed thereto; but the collective members, declaring thereupon that they would give their vote to whoever His Honor should be pleased to nominate, His Honor proposed the bookkeeper and senior of the sworn clerks Jacob Goverts Junior, who was then also appointed as such pro tempore and subject to the approval of Their High Nobles in place of the aforementioned discharged Spierejee; it being further approved that the post of senior sworn clerk, which had thereby become vacant, Granted.

The 2nd of July 1773 The 2nd of July 1773. and Roeff appointed as the youngest sworn clerk Goverts to provide bail as sequestrator for R da 1000 and has, as well as Roeff, taken the oath A soldier taken into service Request from the Second Factor at Brootchia for a relief of funds sworn clerk at the secretariat, to be held by the current youngest ditto Josua Hen, to be succeeded in turn by the absolute assistant George Cristoffel Roeff, whose satisfactory conduct and demonstrated zeal have always served to satisfaction, and who then also, according to the orders of Their Right Honourables the Esteemed Council of Justice of this office, shall have to serve as court messenger instead of the aforementioned Hen, dismissed therefrom by these presents, while it was furthermore understood to give notice of these changes to the aforementioned body by extract hereof. Lastly, it was noted herein that the aforementioned appointed First Sworn Clerk Goverts, who it is also understood shall provide the usual bail as sequestrator up to Ro/a 1000:—, and the youngest sworn clerk as such have each separately taken the oath before this Council. That on the 5th of this month the person of Jan Grabout of Breemen was engaged into the service of the Honourable Company as a soldier at ƒ12:—:— per month. Thursday The 15th of July 1773. The 15th of July 1773. and reimbursement of the expenses on the vessel de Merwe to the same has been remitted ro/a 2000: likewise the annual gifts with orders to account for the same now and to pay Zimmerman the portion of the former Nabob Desertion of the persons listed alongside while the expenses on the Merwe must be accounted for with the equipage overseer in cash, to be favoured with a relief of funds for daily expenses, as well as for the reimbursement of such Ro/a 15:58 as were necessarily expended by him for covering with palm leaves the keel of the vessel de Merwe that remained there; on the 10th thereafter a missive was dispatched thither with and alongside a bill of exchange amounting to ro/a 2000:—, while the ordinary annual gifts, which ought already to have been sent off at the end of the past or beginning of this year, but which were detained here firstly on account of the executed siege and subsequent capture by the English troops of that place, and secondly for reasons mentioned in the resolution of the 19th of March last past, where its draft is inserted, have now also been delivered, with an added order to the aforementioned Second Factor to settle accounts now, according to custom, with the Marathas Pandes and to satisfy him for his portions, as well as to pay to the Junior Merchant F:s B:d Zimmerman, from that part which belongs to the former Nabob or city governor (in consequence of what was resolved at the meeting of the 5th of the last passed month of April), under caution of restitution in case the English gentlemen at that place form further pretensions thereon or might not wish to acknowledge any reasons therein, a sum of ro/a 512:- in reduction of his claim against the said now deceased Nabob; and furthermore to have the aforementioned expenses incurred by him, Meijer, on the vessel de Merwe settled with the equipage overseer van der Hegge, in order to be entered by the latter into the general account of expenses incurred on all vessels belonging to this place. And finally, that on the 14th ditto a letter was received from the Second Factor at Broach, serving to communicate the receipt of the bill of exchange and the gifts sent to him prior to that on the 10th, as noted above; and that with regard to the distribution of the latter, work was done according to order, and the bill of exchange has been accepted for payment against the stipulated time. On the 13th of this month, a dispatch having been received by the Director from the English Ministry here, communicating that their superiors in Bombay would acquiesce in the request made by his Honor in a letter of the 24th of May last past, mentioned in the Resolution of that date, to be allowed to repair the stone stairs on the north-east side of the revetment of the Company's wharf, and furthermore to place a piling over a length of 325 feet, provided the city Governor had no substantial objection against it, the said Director now presented this dispatch. And since it was thought, from its strange context, that one could clearly suspect that the English Ministry was not inclined to allow us to enjoy this permission, which for various reasons they seemed not to want to refuse openly, in order thereby to prevent, behind the screen of the Nawab, this most necessary repair and the resulting preservation of the Company's entire wharf with its valuable buildings and residences, which without this piling would indisputably be engulfed and destroyed within 8 to 10 years by the force of the currents that had already halved the ground up to and in front of the north-east gate; and of which no one could doubt any longer when the Commander made it known to them how his Honor was reliably informed that some of the English council members here had expressed that it was now the right time to make the Dutch, whom they had always sought to keep away from the riverfront, move back to the Lodge in the city, since they would naturally be forced to do so if one dispatch simply, 392. 393. Pursuant to your Honor's esteemed verbal order, the undersigned pay bookkeeper has conducted an inquiry concerning the Moorish sailors who were taken into the service of the Honorable Company on the 15th of April just passed and placed on the ship Walcheren in order to serve on that vessel and be transported to Batavia; to which end he first summoned and questioned the agents, who testified to having seen and spoken to some of these people, and to have learned from them that after the stranding of that vessel they were on board for another three days, that subsequently they were put ashore at Dumas, from where the one had deserted here and the other there. Forenoon All Present Having been submitted by the Lord Director two accounts of expenses incurred in two missions sent to the Court of Poena, of which the first contains a memorandum of the amount of such gift goods etc. as have been purchased and issued from stock by the Honorable Second and Head Administrator Abraham Josias Sluijsken by virtue of the highly esteemed qualification of Their High Mightinesses dated the 2nd of August 1771 and the subsequent resolutions of this Assembly of the 13th of June and the 30th of October 1772, and the project inserted at the last-mentioned resolution for the supreme prince of the Marathas, Madurouw, his Prime Minister, and other court grandees, as well as to the Governor of Bassijn, together with the travel expenses incurred and paid to the envoy Mhamet Areff on the journey to the Poena Court from the month of November when he departed thither until the 28th of January, both last past, when he returned. Against which, the adjacent being taken into consideration, now noticeably diminished since the growth of the city of our competitors to the west of the Indies, demanding above all to be preserved from final contempt through the respect paid to its flag, acknowledged not only by other trading European powers in the Indies, but especially by a rabble of pirates who, having been as it were dug up out of the pool of obscurity for nearly 30 to 40 years, have made only some minor progress at sea through an unfortunate concurrence of times and circumstances, and to which indulgence, jealousy among the trading European competitors, inactivity of the Portuguese nation, who for a longer time have had a formidable naval force on this coast though poorly managed, the weakening of the Mughal Empire for 50 to 60 years, and in short a combined complex of variable and unstable events must have contributed. Far from being able to think, therefore, that the true interest of the Honorable Company can be sacrificed to this precaution of taking passes, the Warehouse Master is of the opinion that one should rather wait and see what the Marathas will further dare to undertake in time; after which, as much as a good and cautious policy entails, one shall have sought to bind them to our nation through a fitting, friendly correspondence, even by giving some presents, entering into alliances now and then, and indeed even to the exchanging of signal flags mutually. And that one meanwhile ought respectfully to request Their High Excellencies, at the slightest rupture by this people at sea, to immediately teach them a lesson by means of force and severity, after which they will presumably never dare to commit steps of this nature; it has been seen that the English, since the conquest of Gheria in the year 1756 and the destruction of the entire Angrian naval force, have concluded the best contracts with the Marathas, and since that time have always remained unmolested on the element of water and spared to this hour. In the margin: submitted in the Council of Policy at Surat, the 23rd of July, the year 1773. However, since the aforementioned Honorable Secunde and Fiscal declared once again to be of the opinion that one ought to proceed with the mission proposed by the Director, both on account of the reiterated orders regarding this matter from the Lords Majors in the Fatherland, as well as Their High Excellencies at Batavia, and because the interest of the Honorable Company on this Coast did not seem to permit the protection of navigation by sending hither and maintaining a sufficient naval force, so long as there remained any hope of being able to conduct it with some safety along the path of friendship and good understanding, even by bestowing presents; and to which one might still add as a third reason, as an undeniable truth requiring no proof, the greatly increased power and capability of the Marathas (who are very unjustly regarded as robbers and a gathered rabble), which has grown to such an extent that they are perhaps the strongest in the entire widely extended Mughal Empire, indeed even allied with that Emperor, and possibly even his protectors. The 23rd of July 1773. which shall be deposited in the secret treasury, and to make a beginning with this work, to charge the English engineer with the supervision thereof, and to make the advance disbursements to the equipage supervisor. The arbiters in the case of Deanaat have requested the bonds of submission. His Honour was unanimously and most respectfully thanked for his applied efforts and the license so happily obtained thereby, and it was further resolved to deposit the aforementioned written permission with the other papers of that nature in the secret treasury, and now to make a beginning as soon as possible with that so highly necessary work, which one cannot expect to be hindered by any obstacles at present, and to request and charge with the supervision over its construction, as being of great importance, the same English engineer Macniel who formed the plan thereof presented to Their High Honours, as well as to allow the necessary moneys to be advanced to the equipage supervisor Vegge for the purchase of the timber and necessary materials. The Lord Commander further informing the Council how His Honour had been reported to by the arbiters, the Honourable Abraham Josias Sluijsken and Jacob van der Sleijden, nominated in the case of Deanaat by resolution of the 23rd of June last by this Council and chosen by the warehouse master Holmberg, that at the opening of the conferences on the 19th of this month it had been submitted for consideration by the arbiters appearing on behalf of the said Deanaat, the gentlemen Perrot and Crockat, how constant legal practice always required that the parties, before proceeding to the settlement of affairs, should mutually exhibit their bonds of submission whereby they declared they would abide by the proceedings and verdict of the arbiters etc., declaring themselves ready to that end to submit those on the part of Deanaat, and that they, having found such to be in accordance with custom and law, had been obliged to agree thereto, requesting therefore that this Council would give the necessary orders that the aforementioned bonds of submission of this side be prepared and put in proper order; wherefore His Honour put this request to the vote. 424. 425. The Honourable Second Sluijsken advising hereupon that, granting this instance as very equitable, the requested bond of submission ought to be caused to be prepared and delivered by the Secretary of this Council in so far as concerns the claim which the said Deanaat has seen fit to institute against the Honourable Company, whilst the warehouse master Holmberg ought to be ordered likewise to grant such an instrument whereby he similarly binds himself to submit to the verdict of the arbiters, and to hold their judgement good and valid; whereupon the other members, as also the Lord Director, concurred with this opinion, and the same was thus established as a resolution. However, the warehouse master Holmberg, having heard the same, declared that he found himself obliged to testify to the emotion and grief he felt at seeing himself thus removed from his natural and only competent judge, and that on that account he could not refrain from, but found himself compelled to, request of this Council in the most urgent manner that it might please the same to retract the aforementioned resolution before the close of the meeting and leave him to the judge whom the Supreme Being and nature had given him; failing which, saving the respect due to this assembly, he declared in the most emphatic and concise form, by repetition and in accordance with his reservation made at the resolution of the 19th of April last, that he protested against all detrimental consequences that might at any time befall him from these proceedings, reserving to himself moreover the freedom to address his High Superiors concerning this matter in such manner as he shall judge to be best.

Furthermore, the remaining members Bocques and Wiardi having joined the advice of the aforementioned Honorable Secunde, the Lord Director declared to do the same, and both matters were thus established into a resolution by a majority of votes; and which being announced to the Warehouse Master Holmberg, having reappeared inside, the same declared that, however much he feels himself, be it said with respect, oppressed in all respects by the above repeated resolution of the Council, he nevertheless, on the foundation of owed obedience to the Council, declares that he will have to submit, and thus obey it, with the declaration however that he will conform under repeated reiteration of the protest already made, and express stipulation never to bear the damage that might sometimes arise for him from this, further requesting that, since the preliminaries to the meeting of the Arbiters have now been established by this assembly, a copy of the Deed of Compromise, to the signing of which he has been ordered, may be granted to him by the Council.

Honorable Gentlemen! The bond of society which men have made could not possibly have endured if they had not mutually obligated themselves to obey the laws of those to whom they had entrusted authority; and this because no more essential means could be devised, nor one more natural, to bind men to one another than by their mutual promises. It is therefore Nature itself that is the source of civil law; and just as the laws which have flowed from the supreme power, being made only for one people, will seldom suit another, so it follows that a citizen is doubly entitled to follow no other laws than those proper to the state of which he is a member. To live under the protection of these same laws, and to be in no way dependent upon those of another state, therein consists the freedom of the citizen. It would, moreover, not be in his power to take refuge in foreign laws, even should he wish to do so, since the administration of lawful justice belongs to the civil power that governs the state; and it is not permissible for subjects to deprive their natural judge of a power that God Himself entrusted to them when He set them over it. Such, Gentlemen, are the indisputable fundamental principles recognized by all nations, which they would not have the power to violate; would then particular administrations possess a right which the Supreme Power does not have? After the bankruptcy of Tabitas, my agent, and that of Deanaat, it was not enough to have to endure frivolous claims from the latter, or rather from his nephew Raanbhaij, but I have also had the grief of seeing that a respectable foreign body, 432. Deanaht, supported by the protection of His Britannic Majesty, thought he could obtain justice through the influence of Your Honors' Council in Souratte, as if personal lawsuits were not required to follow the domicile of the defendant, which is another fundamental principle in which Your Honors must certainly agree with me. A principle that is founded on natural equity, since it would not be right for the plaintiff to have all the advantages at once, such as bringing the claim and at the same time having his case decided by a judge of his own choosing; were it otherwise, the defendant, who might sometimes be in the right, could reasonably judge that he had fallen into the hands of men who were more inclined to favor his adversary than himself. Had the gentlemen of Your Honors' Council, instead of permitting the protégé of His Britannic Majesty Deanaht (or rather Raanbhaij) to apply to the Moorish government of this city against the subject of another European power, seen fit to refer him to the Court of Justice, where he ought lawfully to have instituted his action against me, then everything would have been in order, and Deanaht would have found in my judges men who would have examined his claims with all possible uprightness and virtue. Thus, besides the displeasure of seeing myself torn from my lawful jurisdiction, I was also nearly sacrificed and on the verge of succumbing to the acts of violence and the foul greed of the native. Can one indeed expect justice from a Moorish government that is based on no laws, self-interested, despotic, and listening to no other reasons than those of the highest bidder? Furthermore, can a protégé of His Britannic Majesty, having thereby become in some measure his subject, who seeks nothing other than to prove the lawfulness of his claims, properly apply to such a government, while the European communities of which he is a member have such fine laws, to which he ought to have had recourse? This same government, Gentlemen, without any other examination, has spared no acts of violence (its customary weapons) with respect to my Nation; and if the same have ceased for the past 3 months through the authority of the Honorable Council at Bombay, to whom we addressed our representations, this has nevertheless occurred only under conditions that are exceedingly painful for any citizen who loves his freedom. And it is solely by virtue of its decision that your Honor caused me to appear before the same today: but according to the principles which I had the honor to present, scarcely anyone will be able to doubt whether this was against my will and consent. Having hitherto refused to submit myself to any other jurisdiction than that of my competent judges, could I recognize, gentlemen, as actual judges of my case, strangers whom your Honor will readily grant have no right either over my person or over my property. And although it might seem as if my case were not brought before a foreign court of justice, but that the same would be decided amicably through an express appointment of persons in the capacity of arbiters or good men; yet these same arbiters have become judges by compromise, in whose verdict one would willy-nilly have to acquiesce. Being unable to contradict myself in a matter with which my property is so particularly bound up, I must as much as possible provide for my security and well-being, especially since the means thereto are supported by privileges which every citizen has the right to claim.
