To which, following the tenor of Your Honour's letter, we shall now in the first place address 180. the violence committed in occupying with armed men a house of a subordinate of the Noble Dutch Company, 181. and the carrying off into prison and detention of its salaried servants, 182. as we gave Your Honour notice thereof in our letters of the 11th and 21st of December last, 183. with the request to assist us against this violence in accordance with your obligation. 184. Concerning which we find it impossible to conceive 185. how Your Honour thinks fit to justify the Nabab, 186. and that, moreover, as Your Honour reports, after a careful investigation regarding all that, NB, occurred previously on similar occasions. 87. Whereas we may summon Your Honour to show us a single example of such violence committed. 188. Indeed, since it is as certain as certainty itself 189. that it has always and from the very first time that the Dutch Company has been established here for trade, 190. been a fixed and unalterable custom 191. that we punish our own servants and subordinates 192. whenever they had offended in our service. 193. That is, whenever they served us poorly or ill, or stole something from the Company or from us, 194. without any of the regents having interfered with it, nor being permitted to interfere. 195. As will be testified to by all the merchants and inhabitants of this city who are aware of the old customs, 196. and as is also practiced by us daily. 197. For however much we are willing to agree that the Nabab, by virtue of the power granted to him, has the right to correct all crimes of the inhabitants, 198. it remains no less certain that he has never interfered, nor may interfere, with such domestic affairs of ours. 199. Which can have all the less place in the case in question, where a Malwari who works daily in the warehouses finds an opportunity to gather from the ground a few spices, consisting mostly of dust and cloves, and to take them along to his house, and which were taken from him along the way by this Parsi and kept in his house. 200. And it is thus a certain truth that this Parsi himself did not steal, 261. but took it back from a Malwari who intended to steal it. 202. He having himself, just before his house was occupied by the Nabab's sepoys, 203. given notice to our Fiscal that he had a small bag of spices at his house, which he had taken from a Malwari who possibly on various occasions had purloined them during the weighing. 204. But suppose for a moment that this Parsi had indeed stolen the spices from the warehouse, 205. and thereby deserved exemplary punishment, 206. then the Nabab would surely have been obliged, 207. if he maintained that he was entitled to execute this punishment, 208. to demand this man, along with his entire family who as well as their ancestors have been in our service and under our jurisdiction, 209. from our Director. 210. Whereupon, assuming the theft had truly been committed, 211. we would not have delayed a single moment to hand him over to justice, 212. as a subject unworthy of our protection. 213. Yet the Nabab has never demanded him from us, 214. but before the man was heard, and without leaving him any defense, 215. not only occupied his house and property with armed men, 216. but even the sepoys of the Noble Dutch Company, 217. who were stationed there to see that the goods of this Parsi, as a subordinate of the said Company, were not plundered, 218. and that those spices, which it was said were stolen from us and therefore had to return to the Company, were not carried away, 219. were taken away from there by force and brought into prison at the Darbar, where they still remain. 220. An act so outrageous 221. that no one can produce any example of it. 222. And that if this should happen more often in the future, it would compel our Company either to remove from Surat 223. or to take other measures with the Nabab. Turn over.

The 24th of February Anno 1773. 224. as there can no longer be any safety for us 225. when the servants of the Company and its subordinates are simply seized and kept under arrest, 226. and people wish to prevent us from properly punishing those same servants and subordinates in cases where they commit offenses in our own service, 227. for thereby we would, from a pack of merchants, as your Honors are pleased most incorrectly to title us, become not only less than the lowest Banyan, 228. but would become unable to entrust the Company's vessels and goods, as well as our own, to people who could act towards us at their pleasure 229. without having to fear the slightest punishment from us. 230. A matter which contains absurdity itself, 231. which cannot be defended without committing a great injustice, 232. and which we think, on that account, also needs no further substantiation. 233. Wherefore we also now trust 234. that your Honors, instead of demanding from us that we make any excuses in this regard to the Nabob, 235. will no longer delay in maintaining us in our right, 236. and in doing so, compel the said Governor to improve this matter immediately, 237. as it will thereby become apparent 238. that your Honors faithfully fulfill your repeatedly given assurances, 239. and continue to maintain us in the privileges and prerogatives granted to us by that same supreme power 240. in whose name the city and Castle are governed. 241. Whereby we shall then also be able to avoid the dire necessity 242. of keeping your Honors' own engagements so often before your eyes, 243. which has been all too often necessary since the year 1762. 244. For however much it pleases your Honors, my Lords, to try to help us remember our present situation, 245. which your Honors are pleased to call better than before, 246. this same letter of your Honors shows that such improvement is far to seek, 247. and that we may never flatter ourselves therewith, 248. since your Honors, having become the masters of the Surat Castle, already seem to have forgotten 249. that we are a privileged Company, 250. which is itself a power in the Indies, 251. and which we do not exalt when it is placed on an equal footing with that of your Honors yourselves, 252. when you stamp us with the name of a pack of merchants 253. and wish to treat us on the footing of a common Banyan, 254. against whom one would still very rarely act in the manner that has been done with us for some time past. 255. And truly, my Lords, it can very little excuse your Honors before the impartial world 256. that your Honors, whenever the Nabob does us injustices and your Honors do not see fit to prevent them, 257. pretend an ignorance of our privileges that cannot possibly be true, 258. considering it must be beyond any dispute 259. whether His Mogul Majesty Alamgir the Second, when in the sixth year of his reign, the 11th of the Moorish month Muharram in the year 1173, or on the 2nd of September 1759, 260. he saw fit to entrust the government over the Castle at Surat, 261. which had previously been captured by your Honors' troops, 262. to the Honorable English Company, 263. did at the same time deliver to your Honors all charters and papers relative to the government of the city, 264. together with such privileges and Firmans as the said His Majesty and his illustrious ancestors have granted to us. 265. And this is clearly evident when your Honors say you are so well informed of the Nabob's privileges, 266. so that the request which your Honors make to have copies of our Firmans 267. gives us no other than an unfavorable impression of your Honors' intentions, 268. however much we hope for the contrary. 269. For we can find no other reasons for this request 270. than that your Honors wish to see whether we have indeed preserved all those Firmans which were granted to us by the Moguls, or whether any of them have been lost. That we cannot judge ourselves obliged to produce all these farmans of ours, except in so far as such shall be necessary, and as has also been practiced by us repeatedly. 274. While we cannot view the request made to that end as anything other than a chicane, which is now intended to embroil matters as much as possible. 275. Considering it has always been evident. 276. That we have never made any request to Your Honours that was not grounded upon the same. 277. And we also repeatedly showed some of the same, which we judged necessary, to Mr. Price, and in the time of Mr. Draper, at Their Honours' request and in order to spare them the trouble of having them fetched from the Castle, 278. Just as again by this writing, for Your Honours' convenience, some extracts from the same are subjoined. 279. And while we regret that we are in this matter unable to comply with Your Honours' requisition, 280. We must further briefly remark that in many cases we have no need of farmans, 281. As constant custom, especially in these countries, establishes a law, and these customs are known to all merchants of the city, 282. Without our having found it necessary or ever having attempted to introduce new ones, 283. Or to regard mere favours that we have ever enjoyed from the Nawab as privileges. 284. And forgive us, Gentlemen, that we cannot conceive 285. How Your Honours see fit thus to plead for the conduct of the Nawab, 286. And had this been properly ordered, we should never have needed to trouble Your Honours daily with instances for protection against him, 289. Whereas now, to describe all the impediments to trade, unpleasantries, and chicanes that are daily inflicted upon us, reams of paper would be required. 290. Nevertheless, in order not to enlarge this markedly with the narration of matters of which no one can be unaware, we shall follow the thread of Your Honours' letter further. 291. And it will fully convince Your Honours that people are to be found who take pleasure in constantly raising disputes. 292. When, with regard to the complaint of the Nawab concerning a dispute with Boetoesa, Your Honours will please consider the following as a certain truth: 293. That when the Bania merchant Tabitas Nagerdas, belonging under the protection of our Honourable Company, happened to fail and flee in the month of July last, 294. Leaving behind a debt, among many others, of ro/a 39240:17:— to the said Company. 295. And we on the 7th of August thereafter resolved to inventory the goods of the said Tabitas and take them provisionally into custody for the indemnification of our masters, 296. The Warehouse Master Holmberg made a request to us, 297. That there might be delivered to him from the warehouses of the said Tabitas 298. Such 45 candies of candy sugar as were still found there, and which he, the Warehouse Master, among other goods from the Company's warehouse, had delivered to the same, 299. In order to discharge out of the proceeds thereof the tolls of the Company to the English gentlemen and the Marathas. 300. And which request having been granted by us, 301. In consideration that the sugar had been delivered for the tolls of the Honourable Company, and must always remain as a pledge for the same, 302. Since the said tolls to an amount of 5070 rupees had been left unpaid by Tabitas, even though the greater part of the delivered goods had also been alienated by him; 303. Provided, however, that the said Warehouse Master declared to us by solemn affirmation in lieu of an oath, 304. That these 45 candies were the same that had been delivered by him to Tabitas for the discharge of the tolls, 305. As appears from an extract from our Resolution of the said 7th of August sub [illegible]. 306. Thereupon the Bania merchant Saa Kettenjie Gokel addressed himself 307. To our assembly by petition on the 15th of that month, of which the copy accompanies this under No. 7, 308. Requesting that the aforesaid 45 candies of sugar might be delivered to him, 309. First: that the contract which the said Banyan had submitted, and which is annexed hereto under No. 18, 317. was not of the requisite validity, but on the contrary bore all the signs of having been drawn up after the flight of Tabibas. 318. Supplicant of mediation and protection, etc. Thus it was deemed proper to answer them upon the mentioned dispatch as soon as possible in terms of emphasis, and thereby to declare that their Honors have never, nor ever in present times, been sought after as mediators and protectors, and in which capacity one can also never acknowledge them; since the year 1762—when their Honors, making use of open violence and famine and the weak physical condition of a ruler weighed down by the burden of years—is still all too fresh in memory for one to be able to proceed again to such a step, but that one demands of them, in their capacity as possessors of the Surat Castle on behalf of the Great Mogol, according to their obligation and repeatedly given and reiterated assurances, to do us justice according to our chartered privileges, and in equity to maintain them therein; whilst one will still have to decline the demand regarding the production of our Firmans, for such reasons as cited in our dispatch of the 24th of February, as well as because one judged not to be able to proceed to such a step without the prior knowledge of our High Rulers, since it is certain that they, once obtaining the same in their hands, would not fail to interpret the said Firmans according to their fancy and desire, just as they also practiced with the French on the Coromandel Coast in the year 1756, and thus the Honorable Company's precious privileges, obtained at the cost of so many treasures, would be of no greater influence for the well-being of the Company in these regions here than the English gentlemen saw fit to concede thereto according to their pleasure; with further insistence by this dispatch to cause the obstructions brought about by the Nawab upon our trade and collections to be revoked as soon as possible, and to ensure that the same might be granted a free and undisturbed course, so that one should not ultimately be placed in the necessity of having to submit our lawful complaints on this account, and on account of a multitude of other hateful vexations, to their superiors. The 11th of March 1773. assured that a Provident Omnipotence, which will finally, should we be forced to submit all our lawful grievances to them, vindicate us in the eyes of all the impartial world, and even of Your Honors' own High Superiors, Gentlemen, against all unlawful attempts, however cautiously devised according to the fragile knowledge of men; and will never be able to approve of Your Honors' conduct, which Your Honors seek to cloak in seeming kindlinesses, when the entire chain of events shall have been analyzed. We assure Your Honors at the same time that all these unpleasantries grieve us to the soul, and that we desire nothing more than to be able to settle them in a becoming and sustainable manner; but how will that be possible, Gentlemen, if Your Honors entertain so high an opinion of yourselves, and seek to treat the General Dutch Chartered East India Company, which we directly represent in these regions, as conquered subjects, or, at best, as vassals who prostrate themselves to implore their Masters' goodwill and clemency. For indeed, in these matters we have not yet petitioned Your Honors as anything other than mediators or protectors. It is true that Mr. Hodges in the year 1762, taking advantage of an old and infirm Governor who was weighed down by the burden of years, compelled him to accept his mediation, but the memory thereof is imprinted with such vivid colors upon our hearts that we would much rather see our blood shed one by one than, by our voluntary request, provide an opportunity to render us such a service again. Please accept our candor, Gentlemen; Your Honors' offered mediation and protection demand nothing less of our duty as Free Dutchmen, who, just as Free Britons, have a natural abhorrence for everything that smacks of tyranny and domination. We can therefore, Gentlemen, recognize Your Honors by no means as mediators, but must demand of Your Honors, as masters of the Castle, that Your Honors, pursuant to Your repeated promises made to us and according to the guarantee of our privileges both by Your Honors yourselves and by the Right Honorable the President and Council at Bombay, shall oblige the Nabab to do us justice regarding all such articles as we have complained of or explained to Your Honors in our latest letter of the 24th of February last; and above all to withdraw a general stoppage of our trade and collection of piece-goods that has occurred since that time, and to allow us to continue our trade and commerce peacefully in a reputable manner, since the Honorable Company's vessels have lain unloaded with piece-goods from outside for almost 3 weeks, and thereby the dispatch of our returns has been made almost impossible, which we consequently shall not be able to attribute to any other causes than those aforementioned; without it pleasing Your Honors any longer to insist on the production of our firmans, which we must still decline, as before, for reasons mentioned in our last letter, and because we are not capable of taking such a step without the knowledge of our high Superiors, who must necessarily direct our conduct in this case. 82. 11 March 1773. 11 March 1773. propose as very necessary, specifically to find thereby some semblance of reason to obstruct our trade, as has now happened, and to force us, to the ruin of private individuals, to satisfy unreasonable demands. Indeed, Gentlemen, we must put a heartfelt question to Your Honours: How could Mr. Spencer and his successors, and furthermore your High Council before and after the capture of the Castle, guarantee all our privileges if they had been ignorant of those very privileges? Furthermore, in these present matters no firman is in the least necessary, because we have demanded no novelty. In the case of the Persian, which in itself may be regarded on the part of the Government as a so-called querelle d'allemagne, the Director, by stationing sepoys at property assigned to the Company, surely showed no disrespect to the Nawab, if His Excellency has, either of his own accord or at the instigation of others, broken out from it. For how could his authority be diminished because our Company guards its own property? And how can it be said, Gentlemen, that Your Honours infringe the Nawab's jurisdiction when Your Honours, according to your duty, convince the Nawab of his error in so trivial a matter, and consequently oblige him to give us satisfaction? We have never had any thought—we solemnly declare it—of offending the Nawab nor anyone of the government here, nor of interfering in the least with any of their affairs; but on the other hand Your Honours will also easily understand that we cannot pass over insults and indignities, both with respect to our Company and its A sailor engaged in service at f 10 As also that on the 14th of this month Pieton Petton of Bengal at his made request subordinates, with indifference. And with regard to which matter the Lord Director now made known to the Assembly that, while from the aforementioned English letter it had most clearly become apparent that in the present disputes with the mixed government here—which were all stirred up against us through the improper practices of the English Chief, Mr. Price, as His Honour, according to the unanimous opinion of the principal inhabitants of this city, has drawn no small sum of money, according to the praiseworthy custom of the English and native regents of this city, for the protection of the absconded Capitas and his creditors, from which all the present disturbances in Souratta have also principally derived their source—one could not at present treat any further with the English Council, as it had already been resolved not to surrender the Honourable Company's firmans to them without the special knowledge and consent of the Noble High Indian Government of Netherlands India; for that reason it had been decided to try whether one could come to a somewhat better understanding with that gentleman through private, emphatic representations to Mr. Price himself, with the addition of some threats regarding certain occurrences in matters of governance which, becoming public, could reflect little honour upon His Honour, and thereby as it were compel him to urge the Nabab, or rather to order him, that he grant unimpeded progress to our trade and collections.

His Honour communicated further to the members on this occasion how His Honour had progressed so far with these negotiations that the Nabab had already given permission two days ago for the unloading of the vessels; as also that the guard placed by His Excellency on the 6th of December last on the house of the Parsi Nanla Dansjie, who falls under the Company's protection, has been withdrawn from there, and the two peons of ours who had been arrested in the Durbar had returned to the Wharf at the same time, as the small bag of spices was properly stored again in the presence of judicial commissioners in the spice locker; furthermore, that the claim of Boetoesa against the Warehouse Master Holmberg on account of the 45 canisters of candy sugar allotted to him by this Assembly, as appears from the resolution of the 15th of August last, was, with the approval of the two contesting parties, submitted to the verdict of four arbitrators, to which, on the side of the Warehouse Master, the Director declared he had, with incredible difficulty, obtained the admission of the Company's Broker Mantschergie Gotsedje and Govenram Roederam, to whom His Honour had given precedence above all others belonging under the Flag, partly because they were the most qualified for it, and secondly on account of their esteem among the natives, but against which Mr Price had fought most vigorously and constantly raised endless obstacles on account of his well-known antipathy against the Company's First Broker Mantchergie, who to his detriment has had the occasion to get to know His Honour intimately. While regarding the obstacles brought about by the native government at the instigation of the English gentlemen to prevent the Company's merchandise from being weighed out of the warehouses, and concerning which his Honour has protested in the strongest terms against Mr Price and the Nabab, 98. — 99. From that which was made known by the Honorable Commissioner Sluijsken by the letter of the 13th, it is understood that one should address the government in Bombay, for reasons that the weighing out has thus far been hindered. His Honor has further submitted for consideration that a record be kept, so that these measures might be revoked at the earliest opportunity, since one could therefore very well negotiate with the government here concerning the pending disputes. To which resolution, and in order to write further to the Honorable Sluijsken from time to time what is necessary in this regard, His Honor was so much the more inclined, as the said Commissioner, by his letter to this Assembly of the 13th instant received the day before yesterday, says he thinks he can assure this ministry that if the Surat government should further see fit to bring the entire trade of the Company to a standstill by force, Bombay will provide against it and see to it that one in Surat remains protected from all acts of violence, while in the meantime all disputes are settled according to equity. As this was already ordered and written to the often-mentioned Commissioner from time to time with unanimous approval, and in such manner as can be seen more closely from the letters exchanged with the same Commissioner, it was resolved likewise to make a note in this matter of this communication from His Honor. Subsequently, His Honor submitted for the consideration of the members whether it would not be necessary, now that the Nawab, as previously noted here, had declared that he could permit no weighing out of merchandise before satisfaction according to his desire had been procured for the Banyan merchant Deanaat, who is under English protection; and that the English did not deign to confer further with us regarding this, but had left this matter to the Nawab for decision, as His Honor testified to be very well informed of privately; and that they were so much the more strengthened in this intention of theirs by an approval obtained for it from Bombay, to address oneself directly, for the first instance, only concerning this matter alone, being the one concerning meum et tuum and currently the principal one in question, by a letter 102. 103. 19 March 1773. 19 March 1773. letter to the English Government at Bombay, which, having already been drafted in minute by His Honor and produced, after reading, was found to be of the following content: To The Right Honorable Willem Hornby, Esquire, Governor, etc., etc. along with The Council. The gentlemen of the English factory here addressed us on 17 December 1771 regarding claims made against some of our gentlemen by a merchant under the protection of the Honorable East India Company of England, named Deanaat Ramdaet. Which man, in the bankruptcy of one of our Banyan merchants with whom he was short of money, regarded it as a good means to satisfy himself by holding our nation liable for losses which he was said to have suffered with his bankrupt debtor. We, having clearly shown to the gentlemen of Your Honors' factory, who desired to be informed in this regard, by a letter of 2 January, the groundlessness of the man's claim insofar as it concerned the Honorable Company's goods sold to him, and with respect to what he claimed from a private gentleman having referred him to the honorable Court of Justice of this factory, or to that of Batavia, it being an affair of Meum et Tuum which we were not capable of deciding, with a further offer to assign him a competent person to look after his interests. Since we have, until this hour, had not a single letter in answer to this letter of ours, we thought nothing other than that these gentlemen had been satisfied therewith. But to our utter amazement, we have experienced that in some differences which we happen to have with this city's government, the Nawab, among other frivolous pretexts and those that have nothing but private and worthless causes as their foundation, has taken as a principal reason to cause a general hindrance to all the Company's affairs in this city the aforesaid groundless claims of the aforementioned merchant Deanaat, standing under English protection. Impossible to understand the connection of this, we have made somewhat closer inquiries, and we have been told that at the request of the English gentlemen here, who were willing to support this Deanaat absolutely, Your Honors had sent an order to have this matter settled by the Nawab. Not to mention what reflection it must cause on the Gentlemen of your factory in Surat that they attempt to hand over a matter, which they themselves cannot lawfully protect, to the decision of an Asiatic Regent, who Your Honour well knows what means he employs to terminate such disputes, since he is so much interested in it himself, as the government here usually enjoys a quarter of the capital in question. We therefore most politely request, Right Honourable Sir and Gentlemen, that Your Honour please instruct the nabob for these reasons not to interfere in this affair in any way, nor on that account to cause us any trouble, and on the other hand assure him that upon the return of the Banyan Tabitas, whom we daily expect back, and without whose presence no investigation into this matter can be instituted, we shall ensure that the most pure justice due to him shall be done to the said Banyan, as is fitting for men of honour occupying a public character. The Director also showed a separate Missive received by His Honour from the said Second Factor, containing, among other things, a communication that the Pandit Roederagie residing there on behalf of the Marathas had already twice pressed the Company's Broker for his portion of the yearly gifts, without letting himself be moved by any persuasions to wait with that until the complete settlement of the Brootchia affairs, threatening that upon non-compliance he would have the house of our said Broker occupied; so it was thought fit and agreed to let the latest ordinary yearly gift, which had not yet been sent off due to the executed siege of the city by the English troops, be paid for one half to the entitled persons there at the first good opportunity by land or sea route, according to the draft written below, and to wait with the delivery of the other half, or the nabob's portion, until it shall have been seen whether any claims upon it will also be formed by the English, as having now stepped into all the privileges of the Mughal Government that previously subsisted there. been formed
