Honorable Sir, I inform your Honor that I have today taken over the post of Director of the Portuguese Nation here, as well as Administrator of its affairs here, in which capacity I desire, as occasion offers, to be able to demonstrate to your Honor how much I esteem your friendship, to which end I solicit your Honor's commands and remain with great esteem, Your Honor's very humble Servant. At Surat Worshipful Sir and Sirs, We shall now do ourselves the pleasure of replying to your letter of the 20th of April, which we should have done sooner but were prevented by some material business. As we cannot but think that the Nabob has an undoubted right, as Governor of this city, to make any regulations he may think necessary for the advantage of the town and good of his government, and that the fees he has established in the Furza are very just and moderate, and we cannot see any reason why you gentlemen should not pay these fees, as well as the Moguls, Armenians, and other merchants of this city, particularly as they are not only demanded of you, but of all the other European nations residing To the Worshipful Marten John Bosman Esqr., Director for affairs of the noble Netherlands Company, and Council Here 166 here who have acquiesced in the payment of them, we must, for these reasons, beg to be excused interfering with the Nabob in the present case, but have forwarded a copy of your letter to our superiors at Bombay for their directions on the subject, which we of course shall obey and communicate to you if it should be requisite. However prompt an answer the agreeable content of your much esteemed letter of the 27th of last month required of us, many occupations nevertheless in dispatching our vessel and otherwise have prevented us from expressing sooner to Mr Gambier the singular satisfaction we feel at seeing him placed here at the head of the affairs of the Noble English Company, on which we have the honor to congratulate him by the present; whilst on our part we shall always employ all that may contribute to the preservation and increase of the good harmony that now subsists here between the two nations. The city Governor has seen fit to prevent us for some days from duly taking custody here of the linens and merchandise of our Noble Company coming from Broach and dealing with them according to our pleasure, and not only that, but furthermore to declare that he, the Governor, would permit no unloading or transport of any more goods, so long as we did not resolve to pay to Mr Marley, member of your assembly and Collector of the portion that the Noble English Company receives in the tolls of this city on behalf of the Mogol's Governor of the Castle, a certain duty upon all arriving and outgoing goods, according to a note delivered to us, and that for the benefit and advantage of the aforementioned Mr Marley and possibly of all his successors in that office of Toll Collector. And however much we have endeavored to demonstrate to the said Governor that according to ancient customs and the firmans granted to the Dutch Company by the Mogol Kings we are in no way bound to pay such an innovation, or indeed any other howsoever it might be named, since we are able to suffice with the payment of the toll of 2½ per cent on arriving and dispatched goods established for 150 years, this nevertheless has not been able to bring about that the aforementioned city Governor would see fit to desist from his demand, which conflicts with our privileges. to preserve inviolable the privileges of the European nations established at Souratta, to be pleased to persuade the aforementioned gentleman the Town Governor to abandon this new unfounded demand and to allow us freely and unconstrained to enjoy those ancient customs and privileges which were granted to us by the Sovereign Lords of these Countries, and the maintenance of which is commended to Your Honour, as Governor of the Castle, by that same sovereign, since these privileges very expressly order and entail that, in whatever places it might be, no one whatsoever shall be allowed to take anything more from us than the established toll of 2½ percent once in Souratta, and that no one shall be allowed to demand anything else or formulate any greed, just as our firmans from King Tja schaan of 1643, from Orang seep of the year 1662, from King Daarsja of the year 1712, and from King Mahomet Sijha of the year 1729 expressly dictate, and of which original firmans we hereby offer Your Honour the inspection and reading, whenever Your Honour, to that end, may be pleased to depute a committee from your council to us, while copies of their translations into the French language, as none among us is sufficiently conversant in the English language, accompany this, and we are prepared, should Your Honour require it, to transmit to you the copies of these aforementioned firmans in the original Persian language. Sir, the Governor of the town saw fit a few days ago, not only to prevent us from warehousing and using our cotton goods and merchandise of our noble Company coming from Baroche, but also to declare further that he would no longer permit any unloading or transport of whatever merchandise as long as we would not resolve to pay to Mr. Morley, member of your Council and collector of the portion of the town customs due to the noble English Company as governing the Castle on behalf of the Mughal, certain duties, according to the tariff delivered to us, on all import and export goods, and that, to the advantage and profit of the said Mr. Morley, and perhaps also to that of all his successors in his capacity as customs officer; and whatever efforts we have made to demonstrate to him that, in view of the ancient customs and firmans granted by the Great Mughals to the Dutch Company, we are completely exempt from complying with such or any other novelties whatsoever, as we satisfy all obligations by paying the 2½ percent customs fixed for nearly two and a half centuries on goods coming and going, this nevertheless has not yet had the effect that the said gentleman the Governor of the town has desisted from this demand contrary to our privileges. By all this, added to what was communicated in the aforementioned letter by the Surat Chief and Council, namely that they were awaiting Your Honors' further orders in this regard, we find ourselves compelled to dispatch this letter to Your Honors, however much we might wish that the Nabab, by a strict observance of our privileges, would free us from all such demands, which cause us difficulties and afford Your Honors no pleasure. to place what has been advanced beyond all dispute, and therewith, in order to fatigue Your Honour's attention as little as possible, making an immediate beginning, under serious protestation that we desire nothing other than to continue to preserve with all our power the good harmony which at present so happily subsists here, and that with this our lawful instance we aim at nothing other than the defence and maintenance of the prerogatives and privileges granted to the Noble Dutch Company in Soeratte by the Mogol emperors as sovereign Lords of these Lands, and upon which, in the present subject matter, in the time of more than a century, no breach or diminution has ever been undertaken, without our being in any way minded to oppose or thwart the revenues which the Noble English Company or its servants in these regions may enjoy, in so far as these do not tend to the direct prejudice of our privileges and trade. Thus we readily concede that the Nabab as Governor of the city may be entitled to make certain ordinances for the best and to the benefit of the inhabitants, as the aforementioned missive from Your Honour's Chief and Council advances; but we neither can nor ever shall acknowledge, just as the prudent writer of that letter carefully guards against positing, that this right should extend even so far that those ordinances could be of application against, and that the same might tend to the reversal, diminution or curtailment of, such privileges as the Sovereign Lord has granted to various parties, and, to confine ourselves to our own case, to the Noble Dutch Company, as being contrary to everything that is called right and equity; for not only do all orders emanating from a subordinate power possess no force nor validity except in so far as they tend to the execution or fulfilment of the will of the Sovereign, but above all those orders may never conflict with the express pleasure of that same supreme power, out of whose fullness it has granted special privileges to various parties. And thus all ordinances of the Nabab of Souratta, be it said with all due reservation of the high regard which we bear towards his excellency, are notoriously powerless and non-binding in our regard as soon as they run counter to our acquired privileges, and even so much the more when they directly tend to the reversal and destruction of the same. That this new tax, according to which everyone must pay to servants of the Noble English Company at the Customs, whether for himself or in what manner is unknown to us, a certain amount on every package, bale, chest, etc., which he exports and imports with merchandise, directly runs counter to our privileges and would utterly destroy the liberties granted to our Company in Souratta, no one will any longer dispute when one considers: On the one hand, that by a multitude of firmans, and especially by those copies of which were appended to our repeatedly mentioned letter to the Sourat ministry, and which we also have the honour to accompany this present letter, it has been granted by the Mogols Tja sehaan, Orang seep schaan, Daarsja, and Mahomet sja to the Noble Dutch Company as an everlasting privilege to be permitted to trade throughout the entire Empire and specifically in Souratta, under payment of 2½ per cent custom on all imported and exported goods, with this express privilege, that no one, whoever he may be, shall be allowed to take anything more, by whatever name, from it than the aforementioned 2½ per cent once in Souratte, and alongside this a prohibition against forming any cupidity or pretension, just as no Regent has ever before undertaken to burden its trade with anything else. all taxes of whatever name are prohibited with regard to us, and consequently, with whatever legitimacy they may be designated in respect of others, they can never be binding with regard to us. Against this well-founded argument of ours, the assertion advanced by Your Honours' Chief and Council in the repeatedly mentioned missive of 2 June can also effect nothing, namely that they could not see why we should not pay this imposition, as well as the Armenians, Mughals, and other merchants, and that it had already been agreed to by the other European nations. For the Mughals, Armenians, and other inhabitants and merchants of this city are people who are either born subjects of the Mughal or citizens bound to the general ordinances, and moreover have never been favoured with any special privileges. How far the other Europeans trading here may or may not have an equal right by public privileges, and to what extent the representatives of those nations are empowered to waive their privileges, is not for us to examine. But this, Gentlemen, is beyond all contradiction: that neither the impropriety nor the compliance of others binds us, nor can it move us in any respect to sacrifice the Company's precious privileges to the arbitrary desire of this or that person. And we ask Your Honours' own impartial judgement: for what purpose would privileges ever have been solicited and granted if they could lose their binding force, and if the respective Governors and Rulers were empowered to undermine them at the very time they are bound to protect everyone in the same? And over and above that Your Honours' Surat Chief and Council cannot, without doing us great injustice, dispense themselves from preserving the Honourable Dutch Company in these privileges in their capacity as Governor of the Mughal's Castle, Your Honours will please allow us to remind you how they themselves are also bound thereto according to all the principles of good faith, by virtue of the solemn engagement made by Your Honours yourselves to us, at the time Your Honours wished to attack the Surat Castle, by Mr Spencer and Council on 18 February 1759, when the same assured us that none of Your Honours' measures concerning the aforesaid Castle would in any way tend to the diminution of our privileges in trade or otherwise to which the Honourable Dutch Company or we ourselves are entitled in Surat; while Your Honours yourselves, by letter of 25 January 1765, have so solemnly assured that it would be your constant endeavour to preserve the privileges of the European nations established at Surat inviolate. your chief and Council to urge these gentlemen to persuade the Governor to desist from this new and unjust pretension, and to allow us fully to enjoy our ancient privileges, as you will see for yourselves, gentlemen, by the copy of that letter which we send you enclosed, translated into French together with the documents relating to it. Despite our strong conviction that we could hope to find enough equity here so as not to be troubled any further by this ill-founded demand, and to be preserved in all our rights and prerogatives, we were not a little surprised to see from the letter of the 2nd of this month that your gentlemen are by no means inclined to do us this justice; consequently, the customs officer of your honorable Company, Mr. Marley, has demanded from us a sum of 1624½ rupees, which he says is due to him according to this newly imposed tax. After all this and the advice given to us by your chief and Council of Surat that they would await your decisive orders on the matter, we find ourselves under the necessity of sending you the present letter, and we very strongly desire that the Nawab allow us the free exercise of all our privileges, and vex us no more with such demands, which can only cause us many difficulties and losses, and to you, gentlemen, much unpleasantness. We do not think it is necessary for you, in order to show the groundlessness of this pretension of the Nawab, to enter into new details in this regard; the letter that we wrote to your chief and Council of Surat, to which we attached copies of the firmans and privileges granted to us by the sovereigns of this country, is more than sufficient. All these documents enclosed herein and translated into French form an evidence as clear as the sun at midday. In the refutation that we are going to make of the letter from your Council of June 2nd, we shall put clarity in its proper place and we shall advance nothing that can suffer any contradiction on your part; and so as not to fatigue your attention, we begin by assuring you that we have no other desire than to maintain, as far as it is in our power, the good harmony that currently exists here, and that our sole and very legitimate aim is the defense and maintenance of the rights, prerogatives, and privileges granted to the noble Dutch Company by the Mughal Emperors, sovereigns of this country, which for more than a century have never suffered any infraction or alteration similar to the one currently in question. Although we have no intention of opposing in any way the revenues that the noble English Company or its employees may enjoy in these parts, as long as they do not infringe upon our privileges and our trade, we are nevertheless willing to admit that the Nawab, governor of the city, may have the right to make regulations for the well-being and advantage of its inhabitants, as remarked in the letter of your chief and Council of Surat; but we shall never agree, and the writer of this letter has taken good care to avoid advancing, that this power of the Nawab could extend to making regulations or choices of changes and reversals contrary to the privileges granted to either party by the sovereign of this country—and, to speak only of ourselves, those specially granted to the noble Dutch Company—because such a power of the Nawab, if he possessed it, would be entirely contrary to justice and equity. our Privileges, and with much greater reason if they tend directly to infringe them or to annul them. When we maintain at present that this new imposition, according to which everyone must pay to the Custom Officer of the English Company, whether on its own account or for any other destination, which we do not know, a moderate agreed sum on all import and export goods, on each bale and crate, etc., is directly contrary to our privileges and would entirely annihilate the prerogatives granted to our Company at Suratte, we do not fear to be contradicted by anyone whatsoever, especially when it will be taken into consideration that on the other hand these same privileges and prerogatives have been granted to the Noble Company of Holland by a quantity of Firmans, and specifically by those which we have enclosed in copy with our letter addressed to your administration of Suratte and which we have the honor to send to you also enclosed: Sja Schaar, Orangseeb, Iehaan Daarsja, and Mhahometsjher, all of which we possess, as an eternal prerogative and power to trade throughout all Indostan and principally at Suratte, paying the custom of 2½ percent on all the import and export goods, with this express privilege, that nothing more than this 2½ percent once paid at Suratte shall be taken by anyone whatsoever, and in any manner, and with prohibition, furthermore, that no claim be announced nor any new charge placed on our trade, which previously no Ruler has ever undertaken to do; and when attention will be paid, on the other hand, that by levying such a tax, the trade of our Company is directly overburdened, and could, in the future, be so oppressed by the collection of ever newer taxes, that it would be impossible for it to continue there any longer. For the rest, during all this it matters little by whatever name one designates this new tax, because every imposition whatsoever is expressly forbidden with regard to us, and it is consequently never binding upon us, however just it may be with regard to the others; and it is not a reason for us to abandon this opinion what it has pleased your Chief and Council to advance in their letter of the 2nd of June, in these very terms, that they did not know why we should not pay this imposition as well as the Armenians, Mogols, and other merchants; all the more since the payment of it had already been granted by the other European Nations, because the Mogols, Armenians, and the rest of the inhabitants and merchants of this city are all subjects born of the Mogol, subject to the ordinances and customs of the country, and who have never been favored by any particular Privilege; as for the European Nations, it is not within our province to know to what point their rights and privileges extend, and what reasons the representatives of these Nations may have to waive them; but what does not admit of any contradiction, Gentlemen, is that the incompetence or the complacency of others can never serve us as an example, nor induce us to yield and to sacrifice the precious Privileges of the Company to the free arbitrary will of this one or that one, and consulting the integrity of your Judgment, we ask you, to what good would the requested and obtained privileges serve us, if they were liable to lose their binding force as soon as the Governors and Rulers, obliged by their establishment to protect everyone, had the power to annihilate them. Moreover, your Chief and Council of Suratte, in the capacity of Governor of the Fortress of the Mogol, cannot dispense themselves, without doing us a great injustice, from maintaining the Noble Company of Holland in its Rights and Privileges: And we beg you, Gentlemen, to allow us to remind you that you engaged yourselves in this according to all the principles of good faith, very solemnly, by the letters of Mr. Spencer and his Council of the 18th of February 1759, when you besieged and took the Fortress; you assured us then that all your steps and your expedition against the Fortress would not tend in any manner to the infringement of our Privileges or to the least diminution of any rights which the Noble Company of Holland or ourselves enjoyed. Conducting ourselves in all respect toward the letters dispatched by us under date of 22 December 1771, the duplicate of which we have taken the liberty to offer today per the Veldhoen to Your High Nobility, the Honorable Councillors of the Netherlands Indies, the High Noble, Right Honorable, Far-Ruling Lord and Honorable Lords; to His High Nobility, the High Noble, Right Honorable, Far-Ruling Lord Petrus Albertus van der Parra, Governor-General on behalf of the State of the United Netherlands and its General East India Company, Batavia. 218 Both with regard to what was notified therein, as well as in respect of the instances mentioned therein—insofar as no express citation of them, or any of them, is made herein—we have the honor briefly to inform Your High Nobilities: That although, upon dispatching our aforesaid letters, we were indeed of the mind to commence the construction of a warehouse for storing the return cargo after the four stone residential houses were completed, we have departed from this to the extent that, after the aforesaid houses were completed, we first built the rooms for the clerks, in order to be able to have all the servants gathered together in the wharf. And in this regard we have succeeded so well that not only the fourteen clerks' rooms as well as the four stone residential houses have been finished, as the specification thereof is detailed in our general letter departing today, but also that all these same residences are already occupied by 19 servants of the Company along with their families, with no one now remaining outside the wharf except the purveyor Monte alone, whom we have still allowed to remain there since it would not be advisable to abandon the lodge entirely as long as the return goods must still be kept there. Meanwhile, the house that was built by the mutsaddi outside the gate of the wharf, and of which we have not yet received the specification, we have caused to be occupied upstairs by the head surgeon Van der Sprenkel and the bookkeeper Smit, and have had the downstairs appropriated for a hospital, as well as for lodging for the under- and third surgeon. And thus this important work having finally been brought to completion to this extent—which others have previously very mistakenly represented to Your High Nobilities in separate letters as practically completed—we hope that this will meet with the highest approval of the same, while we shall not fail, now that we will have the warehouses ready, to employ everything that can be of service toward obtaining the right to likewise inspect and pack the textiles in our wharf. 219 To the Moorish merchant Mullah Fakhruddin we have indeed, pursuant to Your High Nobilities' authorization in your highly respected letters of 2 August 1771, caused a small present to be offered, with the announcement that on a further occasion we would return to him his note, which he had granted to the late extraordinary Councillor and Director of Surat, Senff, concerning the island of Premeger. But he, having refused acceptance of the aforesaid gift, declared that such a trifle of 2 to 300 rupees was not sufficient for the use that had been made of the same for seven years; whereas the assurance of the said Lord Senff that the Company would pay a good sum of money for it had persuaded him to assure by the aforesaid note that he wished to sell the said island to the Company for the price to be determined, he having thereafter, at least as long as the aforesaid Lord Senff had remained here, enjoyed not the slightest revenue from the aforesaid land. Thus we have had to appease him for the present with kind words, and we pray Your High Nobilities to authorize us to return his note to him, because the aforesaid island of Premeger can be of no use to the Company anyway, and further to satisfy him as best as possible, as it is otherwise to be feared that through this affair we shall get into greater difficulties with the government here, to whom the said Fakhruddin will not fail to address himself otherwise.
