The 25th of November Anno 1776. — The sending hither of the sloop de Papegaaij and the provision of an anchor to the same. ~ To the letters of the 6th, 10th, 17th, 19th, and 29th of September, as well as the 9th and 12th of October, it was initially resolved to reply that there have been well received here, carried hither in three voyages with the thonij the Johanna Maria and the pantjalling the Goede Verwagting, 170 packs of diverse linens, and 2,000 pieces of freestone floor tiles of 1 foot, as well as 4 chests of chintz collected for the demand of 1775, likewise some samples of spices and a coir anchor rope that had remained there in balance; with further note regarding this last item that, upon examination here, it was also found to be good and serviceable. The sending hither of the sloop de Papegaaij, which had arrived there from Paliacatta, was resolved to be approved, as it would not have been at all prudent to send this small vessel back to Palleacatta with a rope that was little to be trusted; while likewise 613. 824 The 25th of November Anno 1776. — Passage granted to these persons. — and with which recommendation it was also resolved to hold as well done the provision of an anchor to the same. Transport hither having been granted by the servants with the sloop de Papegaaij to the crew of the boat de Herstelder, which belonged at Batticaloa and was sold at Palleacatta, from where they had arrived at Sadras, it was resolved to approve the same, as well as the sending hither of Hans Jacob Smith, who arrived there from the Moors and has been taken into service here. — After examination of the pouring and carpentry accounts during the last six months of the recently expired book year, and confrontation of the summaries sent therewith of the entire amount of the said accounts in the just-mentioned trading year The 25th of November Anno 1776. — Particular satisfaction with the profits and revenues there. trading year against those of the year before, it being seen that the first-mentioned account amounted to f 12: 11: - less, but the other, on the contrary, fully f 264. —. - more than the year before: it was, for the reasons adduced for it, well approved and resolved to authorize the chiefs to write off the same, yet nevertheless repeatedly to recommend to them to observe the utmost thrift in this regard. — Furthermore, it having appeared from a summary sent of the merchandise sold in the said book year, to the particular satisfaction of the government, that a considerable sum of f 101,974. 17. — was profited on the same, or, in comparison against Anno 1774/5 when the profits amounted to only f 72,300. 12. -, fully f 29,674. 5. - more, 615 825 The 25th of November Anno 1776. — to the chiefs. — Report of the inventory and the expense account under the last of August. — Resumption of and disposition upon the memorandum of short-weights. — more than in the past year: it was also approved and resolved to praise the servants on that account; as well as concerning the increased revenues of the past year, which also yielded f 946. 10. 8 more than in the preceding one, yet at the same time giving notice that it is expected of their goodwill and zeal for the interest of the Company that they will continuously be active to cultivate and foster the Company's trade at Sadras more and more. — Approval of the sworn report. Upon the representation of the employees, it has been resolved to permit the soldier Hendrik Pietersche, detained yonder due to illness, to remain yonder in military service. Likewise, according to the custom of this coast, it has been approved and resolved to grant the Second de Ravallet, pursuant to his request, the surplus of board allowance and emoluments from the day he was appointed Second of Sadras by Their High Nobilities. Taking as communication the shared price of Japanese bar copper at Madras in the month of September, it is further resolved to approve the detention and sending hither of the soldiers Jan Hendriks and Johannes van Cleef, who arrived there from the English, on the grounds that they both entered into the service of our Company in the year 1775 and sailed out with the ship Westerveld; the judgment of this Council being that their pressing in England, which is an act of violence, gives the English not the slightest right to reclaim the aforementioned persons according to the terms of the cartel concluded between both sides. Notification to Paleacatte that these accounts have been passed for write-off. Remarks thereupon. letters sent hither having been found drawn up according to order, it is resolved to give them notice hereof for their information. The 25th November anno 1776. Communication that the cloths have been received from there and disposition thereon notified; likewise that the letter has been delivered to the Church Council, and the transfer of the chief administration made by the chief is approved. Authorization to the chiefs to strike out the newly introduced articles in the contract with the merchants. Approval of the sending here of a Malay; for communication the desertion of a soldier. Regret over the diminished profits there; recommendation in that regard to the present chief. Communication of the treasury count. Payment by the Deacon Cashier of the 349 guilders, 1 stuiver charged from there. Authorization for the sending here of two arrived deserters. Promotion of an Eastern soldier to corporal; admission of an ordinary ditto. Particular satisfaction over the profits achieved at Jaggernaikpoeram; recommendation in that regard to the chiefs. The sloop De Papegaaij and the thonij Johanna Maria having brought here 42 packs of both acceptable and rejected cloths, it has been resolved to notify the servants thereof, with the instruction that the Government's disposition thereon will be sent to them in the coming days. A letter addressed to the Church Council having arrived here alongside the chiefs' letter of the 30th August sent hither, it has been resolved to notify them thereof. Likewise that the transfer of the chief administration, made by the departed chief Hendrik Ambrosius Johnson on the 31st August to his successor in the aforesaid office, the merchant Nicolaas Padama, has upon examination been found according to order and is thus approved. From the servants' letter of the 1st October of this year, it having appeared to the Government that the merchants persistently continued to refuse to sign the cloth contract for the year 1776 in such form as had been drawn up by the former chief Johnson, and this Council being thereby all the more confirmed in the view which one has always held of it, namely that the Company will never be able to contract with them or others on such a footing, it being an innovation contrary to all previous contracts concluded with the merchants during our residence on this coast. Thus, in order to see an end to this matter once and for all, it has been approved and resolved to authorize and order the present chiefs to strike out with the pen, in the cloth contract for the supply of the year 1776 already signed by the former chief Johnson and the second Scofsier, the two new articles that were added to it by the merchant Johnson, and subsequently to have this contract signed by the merchants, which it is trusted will then willingly be done by them. Furthermore, it has been resolved to hold as well done the sending hither of the malicious Malay Oesmon of Keribom; and to accept for communication the reported desertion of the soldier Johannes Meijer. Concerning the profits on the sale of merchandise obtained at the Office of Palleacatta in the most recently expired book-year 1775/6, it having appeared from the servants' letter of the 9th October to the particular regret of the Government that the same have amounted to only a sum of 20,201 guilders, 9 stuivers, 8 pennings, or by comparison with the previous book-year, when they still mounted to 35,939 guilders, 6 stuivers, 8 pennings, being 15,737 guilders, 17 stuivers, less than in the past year; it has therefore been approved and resolved to earnestly exhort the servants to employ all mercantile means that can possibly be devised by them toward the revival of the decayed trade, with the notification at the same time of the Government's wish that the present chief will succeed better therein than his predecessor. The 349 guilders, 1 stuiver, charged hither to the debit of the Diaconate on account of paddy supplied there for the benefit of the poor, having been duly satisfied in cash by the Diaconate Cashier, it has been resolved to give communication thereof to the servants. And furthermore it has been resolved to authorize them to send hither at the first maritime opportunity the deserters Jan Cornelis of Vlissingen and Johannes Meijer, who arrived there from Madraspatnam, as both are Netherlanders by birth, regarding whom no exchange takes place, taking account of their allowances. Furthermore, upon the proposal of the chiefs, it has been approved and resolved to promote the Malay soldier Carien of Macasser to corporal, in place of Corporal Abdoel Agiet, who was advanced to sergeant, as well as to take into service the Malay Maidie Samarang of Samarang as an Eastern soldier, to remain stationed at Palleacatta, both with the allocation of the usual allowances. Thereafter, the Jaggernaikpoeram letters of the 8th, 11th, 13th, 29th September, as well as 15th October, and their enclosures having been taken into hand, it was initially resolved to praise the servants in the name of the assembly for the considerable profits achieved on the merchandise sold there in the month of July, as a notable sum of 10,428 pagodas, 5 5/8 fanams, or 46,927 guilders, 1 stuiver, was profited thereon; with the notification at the same time that this Council

25 November Anno 1776. The Council, expecting nothing other from their zeal and goodwill in attending to the interests of the Company than that they will employ all mercantile means to maintain trade there on its present favorable footing by attracting the native merchants. Meanwhile, after examination, it was agreed to pass for write-off the expense account for the month of July, on which there was nothing to remark, and also to accept the submitted corrected expense account for the month of June, but to admonish the servants earnestly in this regard, that they must carefully guard in future against such errors as were committed in the last-mentioned account through improper handling. Regarding the memorandum by which f44583. 1. -. or 9907. 8 1/4 new Nagapatnam pagodas were charged this way by the chiefs, being what they paid out of the Company's treasury to the merchants there, Batjor Camelnaboedoe and Batjoe Grevengelen, on account of the estate of the late second Dumon: since this money will, for the most part, be repaid into the Company's treasury at Jaggernaykpoeram by the attorneys of the heirs of the said Dumon, or by their order, it was approved and agreed to send the aforesaid memorandum back to Jaggernaykpoeram, instructing the chiefs that, after receiving the greater part of the aforesaid amount, they are to charge hither only by memorandum the remaining balance required for the complete satisfaction of the above-mentioned principal sum, so that it may be settled here in the Company's treasury. Upon the communication from the servants that the Bookkeeper Jacob Abraham Raadges had died there unmarried and intestate, and the accompanying request for instructions on how to handle his modest estate, it was agreed to authorize them to sell his left-behind effects by public auction and, after paying his debts, to hand over the remaining surplus to the deceased's brother, the soldier Hendrik Diederik Raadjes, under security de restituendi, he being, so far as this Council is aware, his nearest and sole heir ab intestato. In the submitted memoranda of the disbursed board money and rations provided to the seafarers assigned to the barks de Eendragt and de Liefde, as well as the sloop de Walvisch, namely to the first for September and October, to the second for October, and to the third for November, no excesses or errors having been discovered upon examination, it was agreed to authorize the servants to write this off, as well as the amounts brought to account for paid sleng wages for provided drinking water, etc., on behalf of the aforesaid vessels. It having appeared to this Government from the findings sent hither regarding the cargo discharged at Jaggernaykpoeram from the sloop de Walvisch, and the accompanying memorandum of charges, that after validating the usual percentages, 5 3/8 lb. of Japanese bar copper was accounted for short on the aforesaid cargo, it was approved and agreed to debit the pay accounts of the boatswain of the aforesaid vessel, Willem Gysbertsz, and his quartermaster Jan Adolf, for this in the usual proportion of the purchase price, or f5:10:8. Furthermore, it was agreed to note in the outgoing letter, for the servants' information, that the charitable donations remitted hither, amounting to f132. 15. 8, have been duly paid out to the Diaconie cashier; as well as that the 61 packages of various piece goods shipped at Jaggernaykpoeram aboard the sloop de Walvisch have safely arrived here. Furthermore, it was agreed to accept for information the reported shipment to Bimilipatnam aboard the thony de Orange Spruijt of the goods that were sent from here to Jaggernaykpoeram for that factory. And at the same time to approve the detention there from that lot of four packages of roelie, since Bimilipatnam will be able to manage with the remaining four until they are resupplied from here upon the opening of navigation. Concerning Palicol, in response to the servants' letters of 4 July, 27 August, and 10 September, it was agreed in the first place to reply that their letter to the Council of Justice here

The 25th of November Anno 1776. It was agreed to let the aforementioned amount of f 9179.- be entered into the Nagapatnam books to the debit of the said farmer. On the other hand, it was also agreed, in favor of Pfeiffer and Brouwer, to let the f 9179:1, which were brought to their credit here in a second memorandum and originally derived from the jewels, title deeds, and cash of the former Bimilipatnam chiefs Pfeiffer and Brouwer that had been placed under sequestration there and sent over here, continue in the Nagapatnam books in favor of their accounts. Furthermore, for the information of the servants, it was agreed to note in the outgoing letter thither that the bills of exchange drawn hither on behalf of the signers of the small seal, the Deaconry, and the merchant Mossel here, have been duly paid. Concerning the blessed result of the procurement in the most recently completed trade year, through a complete satisfaction of the entire demand for Anno 1776, it was agreed to convey to the chiefs the singular pleasure of the Government, further making known that, as this has given this Council a singular satisfaction, the servants will thereby also gain no less praise and reputation. Furthermore, in this regard, it was agreed to convey to the chiefs the wish of the Government that they may succeed annually as happily in this principal matter, and may always take the utmost care to keep an even account each year with the merchant or merchants to whom they shall henceforth assign the procurement, just as was done this year, further instructing them that it would greatly displease this Council if they were to become debtors of the Company again in the future. The bad times that are currently being experienced at Bimilipatnam, and the doubtful prospect of improvement, having brought the servants into great uncertainty regarding how matters will turn out with the revenues of the Bimilipatnam domains for the book-year 1775/6, it was agreed to note in the outgoing letter that although one had indeed wished they might have flattered themselves with a more pleasant prospect in that regard, one must nevertheless accept this unfavorable circumstance, in the hope that it will still turn out as favorably as one thinks. Furthermore, regarding the arrears of the previous year's farm, it having been reported by the servants that each of the farmers had duly paid his share of the farm money for the book-year 1775/6, except for the burgher Fredrik Rijkloff Cooymans; but that the latter, as farmer of the beverages, remained in arrears on the previous year's farms for rupees 113.-, besides the farm money due for September and October of this current year, further making known that his entire estate would barely be sufficient to satisfy a part of his arrears: it was, in order to protect the Company from damage as far as possible, approved and agreed to order the chiefs to seize the entire estate of the burgher Fredrik Rijkloff Cooymans and sell it at public auction, and to allow its proceeds, as far as they will go, to serve toward reducing his debt; but to collect the amount lacking for full satisfaction from his guarantors, and at the same time to instruct them to communicate the outcome thereof to this Council as soon as possible, in order to enable it to give further orders as to how it wishes to proceed regarding the aforementioned farm. Furthermore, it was agreed to fully approve the correspondence conducted by the servants with the chief and the Council of Visagapatnam concerning the exchange of deserters, as well as the refused return to the English of two Dutch sailors, since that refusal is founded upon the Cartel existing between the English and our Company, for under it similar detentions are mutually stipulated. Pursuant to the resolution of this Table of the 25th of November last, the under-steersman Jan Hansen and the tindal Wellepanaijker have served the following written report concerning the condition of the roadstead and river of Narsapoor: To the right honorable, rigorous Sir, Reijnier van Vlissingen, Governor and Director of this Coromandel Coast with its dependencies, Doctor, General, etc. Right honorable, rigorous Sir. The collective merchants of this place, having properly settled and liquidated accounts with the Company concerning the intake of anno passato, were subsequently summoned by the Governor into the meeting, where they were again charged with the delivery of the respective homeland and Indian demands of Nagapatnam for the coming year 1777, consisting of 351 bales; namely 190 bales pro Patria and 161 bales for the Indies, and this for the prices most recently paid; as well as to the two merchants Piroemeni Chittij and Ramalinga Poele alone the linens petitioned from here pro Patria, woven after a Sadraspatnam, Cuddalore, and Pulicat sample, amounting together to 389 bales. And after the aforesaid merchants had for some time vainly insisted on a price increase, the delivery of the said petitions pro Patria and the Indies having been accepted by them, with promises to fulfill the same not only completely but also with sound goods, according to the terms of the contracts, in due time, the general contract prepared in readiness, in which they each share for a 1/6th part, was furthermore properly signed by them; as was also signed by Piroemenij Chittij and Ramalinga Poele alone the separate contract entered into with them for the fulfillment of the Sadraspatnam, Cuddalore, and Pulicat weaves; whereof it was not only approved and resolved to keep this record, but also to disburse to the collective merchants on delivery of linens a sum of 26,000 old pagodas, as well as to the two separate traders 2,500 of the same pagodas; together with inserting both the aforementioned contracts here according to order. The 4th of December Anno 1776. — of this Coromandel main establishment, faithfully observed. — It shall also at all times be at the discretion of the well-mentioned His Honour and the Council to add to them such other substantial merchants as they shall judge necessary for the service of the Honourable Company, who shall likewise be bound to sign this Contract with the submission expressed therein. — The aforesaid merchants shall, if necessary, even have to go to the weaving places to urge the weavers to weave sound cloths, according to the samples, as well as to ascertain whether their servants therein indeed go to work with the requisite fidelity, vigilance, and diligence in the procurement of linens, expressly binding themselves not only to remain accountable for any lesser qualities that might be found in the linens than they ought to be, and to make good the value thereof if desired, but also to dismiss or otherwise correct whoever shall in one way or another be found negligent in his duty, as well as to choose and appoint anew in the place of such dismissed persons vigilant and capable persons as far as necessary, which, as a principal point for obtaining good and sound linens for the Honourable Company, shall be maintained in force and vigour and observed. To settle accounts annually with the Honorable Company, and to pass receipts thereof. — It is also expressly stipulated hereby that the merchants henceforth shall each have to deliver their contingent of the linens assigned to them separately, without mixing them with one another, as has been practiced, to the end that one can distinguish the linens and discern who among them delivers good cloths, and who among them does not fulfill their bounden duty according to the intention, so that in the encounter of inattention and neglect of duty, it may be redressed, for the prevention of the Company's damages. — The merchants are permitted to bring into this place for trade, and to transport from here, all manner of wares, provided they pay the ordinary toll, and with the exclusion of spices, copper, tin, pepper, opium, just as the Right Honorable Strict Lord Governor and Council also reserve to themselves the right to declare such goods as pass for free henceforth also to be contraband, whenever they may deem it necessary in the service of the Honorable Company, provided that they the merchants are informed thereof in good time so as to be able to guard themselves against damage. — To the aforementioned merchants is granted permission to bring in toll-free for their household, each who is interested for a whole sixth part, and those who are in partnership together, in a quantity of 400 bullock loads of paddy and seventy-five bahars of indigo, nothing more, besides that rice and natgenaij that are needed for the congee of all the Company's linens, being required to pay, for all further grains and indigo that they bring in or transport from here by sea above that, such toll as is paid by all other residents. 11. 9. For Macassar binding 677. 856 The 4th of December Anno 1776. Request of Tieroemenij Chittij to be permitted to continue as guarantor for this Porto Novo merchant according to the deed. The merchants who are indebted to the Honorable Company, namely Masalimanie Moddelij, Waijtinada Moettoe Chittij, and Ragoena Chitty, each for himself, as well as Tamboe Nayker and Rengasaaij Chittij together, expressly binding themselves to reduce their old arrears by 8 per cent on the cash advanced to them through the delivery of Linens to the Honorable Company, just as it was also stipulated and agreed upon that of the demanded Guinees common bleached in the quantity of one hundred and ten packages, 37 packages shall be delivered for the ordinary price of pa/o 86. 12½ per package, and the remaining 73 packages with an increase of 8 per cent thereon, as has been granted to them in the said price. Produced a petition from the Chief Surgeon of the Nagapatnam Castle, Johannes van Halteren, containing a request that it might favorably please this Council to grant transport to Batavia for his very respectful petition submitted herewith and addressed to the High Indian Government, with favorable recommendation to their High Mightinesses to release him, according to his urgent request, directly from here to the Netherlands, taking along his wife and child; whereupon, after reading, it was approved and agreed to present his aforesaid petition to their High Mightinesses at the first opportunity, with an urgent plea to the same that, in consideration of the man's sickly condition, long years of service, and faithful treatment of the sick who have been placed under his care in the hospital, his aforesaid request may be favorably granted. Furthermore, after reading, it was approved and agreed to also submit to their High Mightinesses the petitions received at the same time from 681. 858 The 20th of December, Anno 1776. Item, to send the letters requisitorial accompanying a certain counter-protest to Jaggernaykpoer, and with what instructions. from the Chief Surgeon of the Outer City, Jens Nielsen Kalhoven, and the Apothecary of the Company's Hospital, C: Pancratius Haringa Messe, both containing a request to be allowed to succeed upon the departure of the aforementioned van Halteren to the Netherlands; each to be presented to their High Mightinesses, with favorable recommendation and request from this Council, that upon the discharge of the Chief Surgeon van Halteren, he may be graciously succeeded by the Chief Surgeon of the Outer City, Jens Nielsen Kalhoven, and the latter by the Apothecary in the hospital, as being persons who, through their good conduct and competence in their profession, are indeed somewhat worthy of such an outstanding favor. Furthermore, the Governor laid upon the table of this Council an extract resolution taken by the Council of Justice of this Castle on the 10th instant, containing a decision to grant to the Master of Equipage, The 20th of December, Anno 1776. Master Jacob Hartman, letters requisitorial to Jaggernaykpoer to accompany a certain counter-protest made by him here against the Jaggernaykpooram chiefs, Baars and de Creijs, as well as the sworn clerk there, Popander, with a request to this Government to authorize a person there to serve the aforesaid protest, and at the same time to grant the ordinary transport for the aforesaid letters requisitorial; whereupon, after deliberation, it was approved and agreed to send the said letters requisitorial to Jaggernaykpoer to the bookkeeper stationed there, Fredrik Groenou, with orders to him to serve the accompanying counter-protest of the Master of Equipage Hartman, in place of the sworn clerk Popander, who is also involved in this matter, where and as it ought to be done, as well as to report on his actions to this Council of Justice as required. Confession, and accusation of the Palicol interpreter Bandaar ady Naraijna, of falsity in translating his words during the examination over there, under pretext that he was related by blood to the murdered woman, and was jealous of him, the prisoner, on account of the favors she showed him, after having first interrogated the prisoner by way of official points on the three following articles.— Namely: 1st. Whether his aforesaid mistress, because she had become pregnant, for fear of shame, had not repeatedly approached and requested him to provide her with some poison. 2nd. Whether he had not refused that request of hers, and she having afterward been reproached by some women for being pregnant while being a widow, she out of heartbreak had taken a knife and made a cut to her throat, but not having the courage to cut all the way through, had not prayed and begged him, the arrestant, to give her the rest.— 3rd. Whether he had not done so upon her lamentable plea, and thus cut the throat of his aforesaid mistress, as he had confessed in his confession sent hither from Palicol by the chiefs.— And after the criminal had answered the following thereto with consternation, namely:— That from the very beginning he has related and confessed nothing other than what he had previously confessed to have done, and that the interpreter and several others, and especially the first-mentioned, were his enemies, as well as that the interpreter was not only a close relative of his deceased mistress or mother aforesaid, but also could never stand him, and on the contrary was constantly envious of him because the deceased held great love and affection for him, and he was loved and trusted by her above her friends. That he, the arrestant, therefore firmly believed that that interpreter must have translated falsely to the chiefs in order to bring misfortune upon him. Denying once again to know anything of that murder, other than as he had related hereinbefore.— It was resolved, after having read all the documents and legal instruments with attention, and having ripely considered and noted what was brought in by the prisoner, that the papers sent over from Palicol were found not to correspond with the arrestant's statement, to take this notable resolution: To notify the Fiscal that he shall for the present, as officer, investigate this matter further and as required here, and thereafter advise this Council of its essential condition.— Whereupon - - The 20th of December Anno 1776.— Wherefore it was also further understood, until the time and while thereof, for the present to suspend the final disposition upon the claim of the Honorable Council Officer made and submitted against the prisoner in this matter.— His Honor having been called inside and informed of this, served as an answer that His Honor would declare himself further in this regard.— Yet hereupon it was resolved by the Council to notify His Honor that they persisted in the taken resolution, and thus insisted upon compliance therewith.— Which the undersigned, who ex officio found himself very aggrieved by that decree, and at the same time from the phrasing of insisting upon compliance therewith was reasonably apprehensive that something might at times be undertaken against him by Their Honors which could tend to the disparagement of his office in order to constrain him thereto, did necessitate him, for the prevention thereof, to address himself directly concerning this to the Right Honorable Valiant Lord Governor as supreme commander, and under a brief yet respectful demonstration of his grievances to request that, since the resolution of the Honorable Council of Justice was only interlocutory, and by intervention of the High Authority was completely reparable, and he thus could not appeal from it to the Honorable Respectable Council of Justice of the Castle of Batavia, to suspend compliance therewith, and to permit him, the undersigned, to apply concerning this to Your Right Honorable and Honors as the Government of this Coast, and thus representing the High Authority, as was then also granted to him by the Highest mentioned His Right Honorable. Pursuant to that permission, and in compliance with his made instance, he then presents this humble address to Your Right Honorable and Honors under the sincere assurance that it is not at all his intention to bring the least or slightest disrespect or decline upon the Honorable Council of Justice from there, having full knowledge of the numerous strict orders, both of the Honorable High Respectable Lords Masters in the fatherland and of Their High Nobles the High Indian Government at Batavia, regarding the preservation of the respectability of Justice; not only that, but besides knowing thoroughly what respect and esteem one must have for such a College, and how delicately and cautiously one must proceed regarding the same, so that such an act would be unforgivable in him, who as an officer is obliged to take care and be vigilant that the authority of the court is not compromised, but on the contrary, against those who have the audacity to do so, to observe his office and duty for the maintenance thereof; the more so because he, being in the civil service and a fellow member of that same body, would at the same time offend himself; but that his aim extends to nothing else than to maintain himself in his office as officer, which likewise can suffer no insult whatsoever, and to purge himself of neglect of duty, which clearly shines through in the aforementioned resolution.— And

687. 861 The 20. xber A„o 1770. — And in order to do so with proper reverence, he is compelled to submit to the consideration of your Right Honorable and Noble Worships how painful it must be for him that their Worships, upon the mere denial of a delinquent who, for a committed murder, is already formally in confession in the presence of two persons who are permanently commissioned members of the Honorable Council of Justice and an official writer, namely the Palicol chiefs D' E„ Accama and D' Tan alongside the Bookkeeper Neurenburg, notify him, the undersigned, in his capacity as officer, that he, as officer here, will have to investigate the matter further and as required, and thereafter advise their Worships of its true nature, suspend the final ruling on his brought claim regarding this matter, and, notwithstanding his reply that he would declare himself further on that subject, persist therein, and that moreover with this notable expression, to urge compliance therewith, just as if he had already directly refused to satisfy their Worships' resolution, whereas he had merely said that he would declare himself further thereon, with the intention to then demonstrate to their Worships evidently in writing how useless and reprehensible the delinquent's denial was in contrast to a lawfully recorded voluntary confession, which is the very best and most certain proof in law, so that not only was more credit given to the foolish exception of the criminal than to his confession sent over in forma probanti and exhibited by the undersigned, but the officer himself was prevented from bringing forward his interest against it, which in his opinion, respectfully said, could according to received practice have been handled otherwise and without derogation to the office he has the honor to hold. — For he is, with respect said, just like a common attorney who pleads before the court, reproached and admonished to give notice of the true nature of the case, and thus distrusted just as if he had intentionally concealed, neglected, or wrongly brought forward something in order to cause the delinquent to be innocently, and consequently wretchedly, deprived of life, whereas not a single document was drawn up in his presence, but everything was submitted exactly as it was sent over from Palicol, and thus just as little could have been done by him pro as contra the delinquent, for which reason, in order to have a correct concept of this case, 5. points are now to be dealt with; namely: — A. whether his character ought not to be regarded as far above that of a common attorney, and he thus treated accordingly 2.
