alienated, but that each and every person who is the master of such serfs and who hereafter causes his male or female slaves to be instructed in the Reformed doctrine in order to incorporate them into the Christian church, must submit to this manner which is so commendable, indeed mandatory according to the laws of the land, and thus bring themselves under that obligation, upon their death or departure from these regions, 1. to release all such male or female slaves from slavery; 2. or by donation inter vivos, or testamentary or other codicillary dispositions, to give away or bequeath them to their children, other relatives, or outside heirs; provided, however, that the ownership of the same shall not pass to them except under the aforesaid obligation; and 3. or else, upon departure from the Indies, upon a reasonable appraisal by the messengers of the aldermen or orphan masters, or the auctioneer of the vendue masters, to transfer them to anyone who, out of Christian charity and philanthropy, might be inclined to take them over and then grant them freedom; 4. or to allow them to purchase their own freedom for the purchase price or according to appraisal, if they are house-born or slaves given to them as gifts, with the abolition in any of the aforesaid cases of the fine of 25 rixdollars on the emancipation of serfs established by the resolutions of this Table of 20 May 1766 and 27 July 1767; furthermore, to give notice of all this not only to the respective courts of justice, both here and at the respective outer stations, as well as to the vendue masters, but also to order all notaries, secretaries, and scribes to properly elucidate this to the appearing parties, or testators and testatrices, to the end that they may dispose of their Christian serfs in the manner aforesaid. Servants the 5th of June 1769, not to make any changes regarding the prices fixed by Your Honour on the fine spices etcetera, notwithstanding what was written from here by Resolution of this board on the 30th of September 1768, because those there on the Coast yielded higher profits than those calculated for them at this capital, as was shown in the specification inserted in Your Honour's letter of the 29th of August 1769. Yet concerning this, people at Your Honour's do not seem to have the correct understanding, since the prices set here on the trade goods, in the documents belonging to the books for the reduction of Indian money, are arranged merely in a fixed manner, and the orders do not dictate that the goods absolutely must be sold for that amount, or may not be sold at higher prices. Concerning the item of the treasuries and cash, there being nothing special to remark, this serves solely for Your Honour's information: that we have approved dispensing with the requisition of duits, both whole and half ones, and therefore Your Honour must in future dispense with sending them here. With regard to the Moorish and Heathen Governance, we agree with Your Honour that the Bimilipatnam chiefs have acted quite foolishly and indiscreetly by receiving into the Company's treasury there, at the request of the Princes Visia and Sjetta Ramarasoe, a considerable amount of 23004 N: N: Pagodas, and drawing for this a bill of exchange in Pagodas with an 8 percent agio to the amount of 213000 pieces or ƒ 95850 on the Palicat chiefs, to be paid there, or in the absence of funds, partly at Sadras. Your Honour has therefore done well to reproach the said chiefs in the strongest terms for this arrogance of theirs, and to point out the harmful consequences that might sometimes arise from this and similar far-reaching compliances and engagements, while we, for our part, strictly forbid the said chiefs, as well as all other subordinate servants, to involve themselves in such disadvantageous negotiations with the native rulers, under penalty of our extreme indignation. Requisitions persons residing outside Batavia who believe they have or may raise any claims against estates that come under the administration of the aforementioned Curator shall be allowed the period of one year, calculated in both cases from the day after the assumption of such estates, on pain of forfeiture. The aforementioned sequester at this capital and those acting as such at the outer offices are thereby also ordered and commanded to provide such creditors as present themselves to them within that peremptory term with proof thereof free of charge, and to record their names and the amount of their claims on the sequestration account which they are required to attach to the other documents and papers and send over. It has been resolved, for the prevention of confusion in the Native military registers, henceforth to forbid the ministers and officials at the subordinate outer offices where no formal accounts of such soldiers exist from paying out the retained monthly pay due to Native soldiers who die, desert, or otherwise become absent there. Armories Judicial Matters And therefore approved and resolved to statute, as is statuted hereby, that the goods and wages of those sentenced to death or condemned to lesser corporal punishment in which confiscation also takes place according to the statutory laws of these lands, may be confiscated for only one half, and the other half must be left to the delinquent's wife, legitimate children, or heirs, except in cases of enormous and egregious crimes, such as the Crime of High Treason or Lèse-Majesté, and other acts of that nature, in which case confiscation must take place in its entirety, and that with regard to the forfeiture of the goods and wages of runaways and deserters, or those who abandon their service, the determination of Their High Mightinesses in the General Article Letter of 4 September 1742, Title 3, Articles 29, 30, 31, and 33, must be observed; furthermore, notice thereof shall be given by extract hereof, for their information and observance, to the Court of Justice of this Castle and the aldermen here at this capital, as well as to the judicial colleges at the subordinate outer offices. Native Military It has been approved and resolved to instruct the Commissioner for and over the Affairs of the Native that in the future, upon the recruitment here or arrival from Java of such soldiers for dispatch elsewhere, he shall always issue to each of them a certificate on parchment, by way of a deed, pro Deo, stating alongside their name the companies to which they belong, and the rank and wages for which they were engaged; furthermore, to notify the ministers and officials at the outer offices to which Native soldiers are sent of this, with orders that upon the arrival of those soldiers they shall compare their aforementioned deed with the recruitment or muster roll, and upon finding discrepancies, alter the latter to match the former; and furthermore, in the future, to make no disbursement of monthly wages to such soldiers except upon the presentation of that certificate, and provided that the name they then give agrees with it as well as with the debt registers.

We have thought fit to order Your Honour in future to send to the aforementioned ministers a duplicate set of all the papers that Your Honour customarily sends here via Ceylon, so that each set, which must be designated as original and duplicate, may be sent from there hither by a separate ship. Extract from the General Resolutions of the Castle Batavia, taken in the Council of the Indies on Friday the 21st of May 1771. Foreign Nations Regarding the article of the foreign nations, we can well approve Your Honour's reclamation made to the ministry of Pondicherry concerning a certain deserted sailor named Louis Moerij, who had defected from the ship Noord-Beverland lying in Your Honour's roadstead to a French vessel, even though the said reclamation proved fruitless; but that Your Honour, on that occasion, entered into a certain convention with the said ministry and had bound yourselves to hand over, just as they would do regarding those of their nation, all the defectors who might come to seek refuge from their ships lying in our ports or in the forts and strongholds before which their ships lay, even if they were native-born Netherlanders, to that we can by no means affix our seal of approval, since this is absolutely contrary to the intention of our Sovereign according to the General Articles of War, title 3, article 30, and therefore Your Honour shall, without deviation, abide by the aforementioned Articles of War.

Upon the declaration of the Lords Masters that it would be particularly agreeable to their Right Worshipful Lordships if slaves could be trained in masonry and carpentry, since it became increasingly difficult for their Right Worshipful Lordships to find capable craftsmen who are inclined to proceed to the Indies in the service of the Company; it has been approved and agreed to order the ministers and servants at all subordinate outer trading posts where there are Company slaves, by extract of this, to have them taught, as much as possible, the aforementioned two trades most necessary in their service, but no others, of which they 182 Native military might sometimes make misuse, and at the same time to ensure that those who have acquired sufficient skill therein at the expense of the Company are not employed in the service of private individuals, nor exchanged for others, in compliance with the previous orders of the 12th of August 1765 and the 29th of November 1768. Honorable Gentlemen Majors, having written, it is approved and understood to order the head of Surgery here not to place more on the return ships in the future than a chief, an under-, and a third surgeon, as well as to give notice of this to the ministers of Ceylon, Coromandel, and Bengal, to the end that they also there be mindful of the execution of this order. Extract from a Circular Letter written by their High Mightinesses, the Noble High Indian Government at Batavia, to the Governors, Directors, etc. in the Indies, dated 3 December 1771. And whereas we have thereby lifted our previous interdictions against the importation here of Western linens and silk fabrics, except with regard to certain varieties reserved for the trade of the Company, we hereby authorize the ministers of Ceylon, Coromandel, Bengal, and Malabar to accept all linens and silk fabrics which, pursuant to the permission granted by the aforementioned proclamation to the Company servants and the citizens of Batavia, are offered or declared to them for shipment or transport by the Company ships or smaller vessels, and to let them be brought hither, in so far as this can take place without prejudice to the loading of the Company own goods, and to furnish us, under the Company papers, with the separate bills of lading which shall have to be drawn up there and signed by the skippers or commanding officers of such ships and vessels, together with the original invoices of the cost of the said textiles; just as the invoices of the same must likewise be sent to us with the ships and vessels of the residents of Batavia who bring linens and silk fabrics hither, and those goods must be declared on the passes. But in order that our aforementioned disposition shall not hinder the collection of linens and silk fabrics for the Company account, we wish to have the Gentlemen Chief Rulers of Ceylon, Coromandel, and Bengal, together with the chiefs of the linen-producing trading posts there, most earnestly recommended hereby to ensure above all that the Homeland and Indian requisitions for those articles are fulfilled, if not entirely, then at least as closely as ever possible, and therefore to use the necessary precaution that the weavers do not engage themselves into the service of private individuals to such an extent that the fulfillment of the said requisitions could ever suffer any the least prejudice thereby, as we have resolved to the contrary to hold the said Gentlemen Chief Rulers and chiefs responsible therefor. It was agreed to recommend to the Ministers and Employees at the subordinate Outlying Offices, by extract hereof, the strict observation henceforth of the order laid down in the Regulation on the Promotion of Servants of 29 September 1767, not to allow any qualified officers of the Commerce, up to and including junior merchants, nor officers of the Militia and Artillery, as well as Engineers, to come over hither, without special consent of this Government, unless there should be lawful reasons for it, and even then with suspension of salary. Judicial matters. To permit private traders without distinction, and also foreign nations, for the future, as they are hereby permitted, the import with their ships and vessels to Nagapatnam of all kinds of merchandise, lifting the ban against it, and excepting only cloves, nutmegs, mace, and cinnamon, which, unless purchased from the Company itself, shall remain subject to confiscation as before, along with all other contraband goods that are brought from Batavia or elsewhere with the Company's ships and lesser vessels. On the request of the Bengal ministers, in their letter of the 28th of March 1771, to know in what degree the Company holds priority in case of legal action brought against insolvent estates, or which creditors, without prejudice to it, may or must take precedence, it has been resolved and understood, after deliberation, to establish and declare as a permanent law hereby that, concerning the administrators of Company funds and goods, the Company, in the event of their deficit or insolvency, must be preferred over all others by legal mortgage, in so far as the real estate upon which the legal mortgage is placed belongs to the original administrator; and that, therefore, the Company first has its guarantee upon it before the sureties may be called upon, up to the sum stipulated in the suretyship. However, if the administrator still falls short, the Company in such case also holds priority over the real and personal property of the sureties, whether encumbered or not, and in the case of a mortgage, if the same were encumbered after the date of the suretyship, both up to the amount stipulated in the suretyship; while the further priority, in so far as the original debtor is concerned, shall take place after death duties, house and land rent, as well as consumption taxes, and for the rest, that which was decreed regarding this by the resolution of this Government of the 9th of July and advertisement of the 13th of August 1762 must be observed. And so that this may not only be executed properly, but that no one may claim any ignorance in this regard, it is also understood that the aforesaid statutory order is to be communicated for instruction, by extract hereof, to the Court of Justice of this Castle, as well as to the ministers and servants in the respective outer stations, and to the public, both here and elsewhere, by the posting of placards. 127. 445 Linens Private saltpetre And whereas it has appeared to us, among other things from some of the most recently arrived invoices of those who make use of the permission given by edict of this Government dated 3 December for trade in the Western Quarters, that these are not drawn up according to order, through the failure to properly make known therein the assortments of linens packaged in each sack, we have therefore thought fit in our session of 22 September last to order Your Honour, as well as the Ministers of the remaining Western offices, to be attentive in future that the content of the aforesaid edict is complied with in this regard, before and prior to such invoices of private linens being accepted and sent over hither among the Company's papers; regarding which Your Honour must also recommend the necessary attention to the chiefs and residents of the subordinate offices on Your Coast. Regarding the article of the short weights, having seen in Your Honour's aforementioned letter of the last of June past that on a quantity of 13001 lb of saltpetre, being a remainder of 30000 that Your Honour requested from Bengal in the year 1769 and subsequently received, but because no or little powder was made by Your Honour after that date, it remained lying over, and upon which now, in the refining of 100 lb, a loss of 55½ per cent occurred, Your Honour comes to make a request for the write-off of that excessive loss; we have therefore thought fit, because it does not appear to us that this is to be attributed to any negligence of one or another, and was caused solely by the long lying over of that combustible material, to condescend for this time to their requested write-off of that excessive loss; but we also wish to have Your Honour seriously warned at the same time, when making the demands for that combustible material, not to requisition more than Your Honour will need for one year. It is resolved, by extract of this, to recommend to the ministers and servants at all subordinate offices henceforth annually, without fail, carefully to have the General Muster Rolls of the Company's servants as of the end of June, having served on land or on vessels, or having been assigned, confronted against the pay ledgers, not by the pay bookkeepers, but by other commissioners expressly appointed for that purpose, who must note in the margin of the account of each person at which post, guard, or vessel he was assigned at the time of the general muster, in order that, upon discovering that in the aforementioned books any accounts have continued to run for persons who have already deceased, departed elsewhere, or are missing, an investigation is made as to when this occurred, to the end that their accumulated pay be written back to that extent, and their accounts finally closed, without carrying them forward into the next books, unless those persons Monthly wages. have an adverse balance and have left behind assets from which their debt can be satisfied; but if this cannot be traced, then to cause their pay to cease, and to close their accounts as of the end of June with the entry that they were found absent at the general muster. may, that they on their part will contribute to the fortunate success of the said arrangements, without prejudice to a strict oversight ensuring that our concessions are not abused for the conduct of an illicit trade, we have nevertheless deemed it not unserviceable to prescribe to your Honors some general rules in that respect, namely: First, to persuade and encourage all well-to-do servants and other subjects of the Company, as well as the Moorish merchants in Bengale and Souratte who have any connection to the Company, to equip ships or lesser vessels bound hither, or to other places where they may be admitted; Secondly, to assist them, under the necessary precautions, whenever they request it, with charts, navigating equipment, tackle, ammunition, and other goods at the fixed prices, in so far as this can take place without the Company's inconvenience or prejudice; Thirdly, to allow them to erect warehouses on the Company's territory, or to rent them according to their convenience and need for storing their goods, provided they remain subject to the customs and police of the country; but where the former cannot be granted to them without becoming entangled in some embroilments with the native rulers, and there is no opportunity for the latter, to permit them to store their goods at their own risk in a part of the Company's warehouses, and to let them retain the keys thereof for that duration; Fourthly, with regard to the purchase and sale of goods in which they may trade, to let them proceed as they see fit, and also to leave it to their choice whether, upon the return of their ships and lesser vessels to the place from where they first departed, they wish to unload the same there, whether entirely or in part, or rather let them depart with the imported goods to some other place, without causing them any hindrance in that regard, nor compelling them to comply with monopolizing notions, on pain of our utmost indignation; whereas no toll shall be levied on the goods that remain in their hulls and thus unsold, but only on that which they shall happen to dispose of; Fifthly, to demand from them, beyond the stipulated tolls on the import and export of goods, no other duties whatsoever they may be called, whether for the benefit of the Company or for its servants, on pain, in the event of any excess receipt, of forfeiting four times the value thereof in favor of the injured party, and arbitrary correction in addition thereto; Sixthly, to ensure also that the fiscals, who are bound to be vigilant against all frauds, do not make themselves guilty of any illicit demands or extortions, but properly observe their official duty and protect the said merchants in all fairness; Seventhly, to grant the owners, shipowners, or commanders of private ships and lesser vessels that transport any goods for the Company, if they so desire, a reasonable freight for the same, taking note for your Honors' information that we have once and for all fixed the freight for the saltpeter brought to us from Bengale, whether on English ships or on those of the Company's subjects, at 8 percent of the purchase value, calculated at 7 Rijxdaalders per Picol of 125 pounds. However, the highest wage for a sergeant remained fixed at f 24., for a corporal at f 18., and for a private at f 14., under an engagement of five years, which shall not be exceeded. Servants. Returning salutes of private vessels. It is understood to make a circular of the order established by Resolution of 18 March of this year, and also already given to the Malacca Ministers, regarding the returning of the salute of the English Company ships, and French private vessels which sail with passes from the Directors of the French East India Company, to answer their salute upon arrival there with equal shots; and of this to notify the Ministers and Servants at the other respective Outstations for their information and observance, sending an extract from the above-mentioned Resolution. Friday, 28 October 1774. Extract from the General Resolutions of the Castle of Batavia, taken in the Council of India. On this occasion, when the Banda Requisition of 15 August 1774 was dealt with, the request of the Ministers for two or three clerks who are somewhat capable of trade work was also discussed. But it also being taken into consideration that it is not Banda alone where one finds oneself devoid of such persons, but that the shortage of the same at other places also increases to such an extent that it is impossible to provide for it from here every time, it is, for the remedying or prevention of the embarrassment in that regard, deemed necessary and understood to order the Ministers and Servants at all the subordinate Outstations by this extract, always to ensure that the Trade and Pay Bookkeepers diligently instruct at least two of the clerks assigned under them, whom they believe will have sufficient ability to learn that work, to such an extent that they become capable of properly performing it themselves, in the event of illness or otherwise of the said Bookkeepers, or of their predecessors. To order also, not to accept any money under their administration in future for the benefit of children who depart from India to the Netherlands, whether with their parents, or if their father or mother remains here in the country, and in the meantime etc. Furthermore, with regard to the determination made by Resolution of this Board of 14 May 1698 of the sum on which interest must be credited to the orphans, namely up to 20000 Rds. for each of them, to declare by this, for the information of the orphan masters, that this determination henceforth, or from 1 March 1775 onwards, shall only apply and remain applicable to the capitals of children who are begotten in wedlock, but that of all others, such as illegitimate children and bastards, no more than up to 10000 Rds. for each of them may be made profitable. by the Auctioneer of the city vendue masters, together with the Messenger of the Orphan Masters, and of the real property by their Sworn Appraisers, both according to the present value, in order that therefrom, if the Orphan Masters should be satisfied with that summary statement or specific inventory, and wish to allow the surviving spouse to suffice with the offering of the usual Estate Oath, or indeed having the same effectively administered, six weeks after the death of the first-deceased, to have delivered and transferred to the Orphan Chamber that which, to the surviving child or children, in conformity with the testamentary disposition of the first-deceased, or according to law, (in case such should not have been determined by the said disposition, or no such disposition has been left,) shall be found to be due, without being permitted to accept any security for it, in order to treat that child's portion, or the capital transferred to the Orphan Chamber, according to the latest statutory resolution of this Government of 29 November 1774, and that consequently the surviving spouse will no longer be obliged, as at present, to hand over the entire estate, or even a part thereof, to the Orphan Masters for sale, or to leave it to Their Reverences' administration; while the said Appraisers of the movable property shall enjoy one half, and those of the real property one quarter per cent, as a gratuity for their trouble, provided the former remain obliged to perform the appraisal under presentation or if necessary under taking of an oath; That in the aforesaid case, or whenever the Orphan Masters are content with the submitted summary statement or specific inventory, and the surviving spouse thus remains in undisturbed administration of his or her property, instead of the usual salary that is otherwise allocated to Their Reverences, only half thereof shall and may be charged to the entire estate, so that after the deduction thereof the true inheritance of the child or children may be calculated and claimed. That the Orphan Masters shall also have the liberty, if appointed or called upon as executors or liquidators of the joint estate of any spouses, if the surviving spouse should be of such a character that it were judged by Their Reverences rather advisable to monetize the entire estate in order thus to make the division, and therefrom to find the portion of the child or children, to content themselves with the said summary statement or specific inventory, to proceed in that regard in such manner as Their Reverences, according to conscience, shall deem to be proper for the greatest benefit of the surviving child or children; and in this case they shall continue to enjoy the ordinary salary of the entire joint estate. Whereupon having deliberated, it has been approved and agreed to conform with that proposal and advice of His Honour, and therefore to convert the same into a Resolution, as it is converted hereby, and to provide an extract hereof to the Board of Orphan Masters of this city, to serve in the future for their instruction and observance. Furthermore, upon the proposal of the Governor General, it has been approved and agreed that of the above-mentioned and previous Resolutions of this Government of 6 July, 20 August, and 15 October 1762, as well as 29 November 1774, concerning the demanding of a statement and inventory of estates from which the Orphan Masters are excluded, as well as the claiming, acceptance, and investment of the children's legitimate portions or other moneys, extracts shall be sent to Ceylon, Coromandel, Bengal, and Malabar, with orders to the Orphan Masters there to govern themselves henceforth according to the contents of those Resolutions. Outstanding balances. and Upon the request of the Farmer of the Revenues on goods imported and exported by sea at Nagapatnam to obtain some remission of the pledged moneys, in proportion to the damage suffered by him because, among other things, he had to forego the customs duty on the piece goods transported to Batavia both by private and by Company ships, it has been judged necessary and decided, by way of interpretation of the 12th Article in the Edict of 13 May 1774 concerning private navigation and trade, to declare hereby that all permitted piece goods and other merchandise transported hither from the west of India and from Malacca for the account of private individuals, whether with Company ships or with ships sailing under its flag, and on which the Company here enjoys a certain recognition, shall upon exportation from there not be subject to any customs duty or other toll, by whatever name called, and therefore the same may also not be claimed by the Farmer of the Revenues on goods imported and exported by sea. —. Servants. might entail among the stubborn native population who are attached to their old customs, we have changed our resolution on this subject, and therefore hereby instruct you to let the previous conditions stand, and thus to persist in the ancient custom, since through sufficient sureties no bankruptcies are to be feared. — For the present we have nothing to remark in that regard, other than that you continue annually to send us a clear statement of the colleges, and that you must ensure, as far as lies in your power, that they do not fall behind. It has our approval that, following the example of the other governments, the Chief Administrator was appointed as permanent Political Commissioner; and further, in answer to your queries to obtain an instruction or guideline showing what both the President and the Political Commissioner each in particular had to observe: that the minister, being permanent president, shall direct and manage with elders and deacons all matters directly concerning the church, and that the Political Commissioner shall behave according to the enclosed copy of the instruction subsisting at this principal place. Regarding servants, before explaining ourselves on your arrangements made in that respect, we cannot refrain from stating that we were extremely surprised that you could have proceeded to the step of not only dismissing the Chief Administrator Henricus Leembruggen from his service, but even permitting him to transport himself to Colombo in order to take up his residence there; however justly you merit our displeasure and resentment thereby, we will for this time only most earnestly order and prohibit you ever to arrive at such a disposition again, even if it concerned one of the least members of the Political Council, or any other junior merchant, and those of equal rank with them. — Likewise, it meets with our approval that titular Ensign and Land Surveyor Henck has been placed in the post of overseer of works, yet only until such time as the completion of the unfinished fortification works currently underway shall have been accomplished, after which the said post, according to the proposal of the Governor, shall be abolished, and the said Henck shall then, upon an occurring opportunity, be employed in the political service.
