We also find ourselves obliged further to trouble your Excellency and your Honors with complaints which have been received from the Aurungs Baddael, Jaggernaatpoer, and Malda since the delivery of our Memorandums to the Resident of the Council at Chinsura, wherein amongst other matters is shown the very severe proceedings of Mr. Charles Grant against the carrying on of our Company's affairs, of such a nature that, if it is not immediately provided for, the gomastahs declare that they run the danger of seeing the money advanced for the Company's account to be lost. We shall have the honor to deliver a copy of the letter to one of the Honorable Secretaries of this Government as soon as the same shall be translated into English. Meanwhile we must not neglect, on account of the urgent danger of the damage to be sustained, repeatedly to request your Excellency and your Honors for an immediate proclamation of the peace in the Aurungs, and also likewise such an order as, for the advancement of our affairs, is highly necessary and was requested in our second Memorandum after the example of 1775; the more so as from these further complaints it appears that the oppositions and hindrances are founded on the lack of permission for an unhindered progress of our trade in the aurungs. To which the Naib of the Catcherie gave this answer: I did not call those merchants here. They came of their own accord. Previously they have always been here and done their work; they are not merchants who can simply be chased away like that. I am the Lord of the Land. In my district live merchants, thieves and robbers, and all kinds of people; therefore, when traders come, I must assign guards to them according to custom. What purpose then does that serve which you tell me? You have the power, make them move if you think fit. To which they answered by saying, it is good, it is good, in 8 days we shall burn the Lodge. After that, that Haveldar and sipahis came to us and said: our Master forbids you to set up a washing place here, or to employ washers, or to buy linens; bring a permit from our Company, and you may then make purchases, which cannot be done without a Perwanah. We answered them: we are no servants of your Master to carry out his orders; we shall follow the orders of our Company; what Perwanah does your Master possess by virtue of which he forbids us to buy? We shall make purchases here and we shall establish a washing place; report this to your Master, and let him then make us leave. Upon these words, two or three of them departed, calling out: it is good, it is good. We had given money to seven washers from Seerpoer and had them come here, who were then in our lodge; they were carried off, and we were forbidden to erect furnaces for boiling the linens, with the threat that if we did so, the same would be broken up. Having said this, the rest also departed and kept the washers imprisoned. So much violence have they committed against us, and they have placed guards on the four sides of our lodge, so that not a single weaver or pykar can come to us. You are our Masters; if you can provide for this, the service can be performed; otherwise all the money we have advanced here is lost. On the 19th of the previous month they seized seven Dalaals and Pykaars and imprisoned them in their Lodge. Today those people returned, after they had signed an agreement. The Gomastah of the English having shown three or four letters from his Master to those people, in order to convince them that he acted thus on his orders, adding that he could not allow them to work for us; that it had been learned that they had prepared some linens, and that he had received a very sharp letter about this, which he showed them. We let this serve to duly notify you of the complaints emphatically made yesterday to the Calcutta Government regarding the further intelligence received concerning impediments in the Aurungs of Baddaal, Jaggernaatpoer, and Malda, the original grievance letter of which remains in our custody, as well as our concurrent request that, pending the deliberations on our submitted petitions, the orders to stop or detain the vessels which had to go up the river with the goods unloaded from our ships might provisionally be countermanded, and thereby bring about an unhindered progress in the unloading and reloading thereof. The reply received thereto this afternoon, written to us by Secretary Hay by order of the Supreme Council, dictates in substance that the subject of our aforementioned letter 354 is to be taken into full consideration on next Tuesday, together with the remaining representations submitted by us last Friday the 19th instant. However, since one of our ships had already arrived and it appeared to be our wish that the delivery of its cargo at Chinsurah should be facilitated, orders had been sent to the customs department to permit all boats and vessels to pass unhindered, without search or detention, both up and down the river, carrying goods from or for our ships, until the assembly shall have determined upon the differences which have been presented by us with respect to the toll; it being expected of the Direction of Chinsurah that it will be pleased to bring forward the declaration or the manifest of the cargo or cargoes whenever they might be required for the verification or confirmation of the amount which shall be judged proper to be paid for duties, as soon as the percentages shall be agreed upon with one another. Vanden Broeck agreed to grant them seven hundred chests of opium for this year, and we have ordered our Committee of Revenue to issue the necessary orders to supply the Dutch Agents at Patna with such a quantity of crude opium as shall be required for the aforementioned number of chests, at the price that was usually paid before the late war. We have taken into consideration the various pieces of evidence that were sent to us by the Director and Council at Chinsura concerning the complaints made by the Chief at Calcapore against Ensign Morris and other officers regarding their conduct towards Mr. and Mrs. Verspijck on the 10th of last month. Lieutenants Crawford and Aird and Ensign Morris have been placed under arrest upon these complaints, a formal action has been instituted against them, and according to the rules of our military service, it is necessary that they be brought to trial before a court-martial. For this trial, orders will be issued immediately, and Mr. Verspijck will be afforded the opportunity to present his representations in substance before a respectable tribunal, and to produce such evidence as he may think proper in support thereof. This evidence will be registered in the records of the court-martial, and if the outcome of the proceedings should not provide sufficient satisfaction to Mr. Verspijck, a lawsuit for damages may be commenced at his instance before the Supreme Court of Judicature against the gentlemen who are said to have insulted him, and we shall pass such judgment on their conduct as the records of the court-martial shall show to be required. In the same manner, we shall act with respect to the occurrence at Kalkapoor in the assault upon Mr. and Mrs. Verspyck by Ensign Morris and other officers who assisted him. We do not doubt that we will be enabled, in the coming week, to deliver to Your Excellency and Your Honors the reply of the Council at Chinsura on this point; finding ourselves placed beyond the possibility of reporting our opinion on it, as it forms no point of our instructions in the commission with which we are entrusted. To that end, we believe there is no readier way to pursue than to make things difficult in every respect for our subordinates, whoever they may be and whoever may be included under that name, and to prevent them from carrying on their trade in contempt of the authority of the Company, and under favor of the English rowannahs. The public would now need to be informed of this by the posting of notices, but pending the negotiations, so as not to proceed to extremities, it seems to us that it would provisionally suffice if, by extract from your resolution, the Fiscal is requested in this capacity, as well as in that of village master, to see to the execution of this intention, and thus generally to prevent any goods whatsoever from being pushed off from the shore or dispatched, or from being imported into or exported from our village, except with a customary dastak, and to challenge or take action against anyone wishing to make use of an English rowannah according to the exigency of the matter, in order that people thus gradually become accustomed to the obligation, both for the right of residence and protection and for carrying on trade within our jurisdiction, to pay the due acknowledgment and to pay a bearable assessment, if matters should once reach the point where the intended object were attained thereby. All the commotion that can arise from this is the complaint of one person or another to the Calcutta government, if they in such a case or cases consider it their competent judge, which will then have to appear if that government should see fit to confer with us on this matter. Also, the Hooghly Collector, upon the dispatch of a vessel or vessels with dastaks, will apparently arrogate to himself, just as recently, the right to refuse passage unless provided with a rowannah from him. But in such a case, and in case of complaints about this, it is inevitable, upon handing over a written protest, provisionally to leave to his account and responsibility all costs, damages, interest, and loss of profit that might have been or could be suffered by the refusal of passage and the delay of the voyage of such a vessel or vessels, in order to recover them as, where, and when it shall be deemed proper. 372 to respect our dustucks as before would be regarded as untimely, if not premature, and would moreover also be of too much detriment to the inhabitants of our colony, because the little trade that is still carried on must thereby fall away entirely. For what benefit would it be to a merchant whose goods, transported both incoming and outgoing on our dustuck, were detained, that one protested against that detention without having the power to procure so speedy a release of the same that that delay brought him no damage? The prospect of the uncertain compensation that one might be able to demand by virtue of that protest would not encourage him to proceed with his undertakings. We have thus judged it best to leave that matter as it is at present until the point of the tolls and dustucks shall be settled with the High Council. If it be that we are restored to our privileges in that regard and are assured that our dustucks shall everywhere meet with the proper respect, then we can rightfully demand that our residents also acknowledge our authority in that respect and pay the due dues for carrying on a free and undisturbed trade under our protection; and we rest assured that in that case no one will be unwilling to do so, or if such a person should be found, one will with reason and fairness be able to compel the same to it. In order meanwhile, if possible, to bring about greater expeditiousness in this, we have resolved to write to the High Council ourselves with a request for a speedy answer and settlement of affairs. We shall also request the same of the Gentlemen Nawabs. We think that it would not be useless if Your Honours also pressed for it in writing from time to time. The complaints in the adjoining Cossimbazar letter about vexations in the aurung Naimoor will give Your Honours an opportunity to demonstrate the damage we suffer through their delays. The same will occur repeatedly in a short time, since we daily expect goods from the aurungs, all of which, being brought in with our dustucks, will certainly again give cause for complaints. A continual repetition thereof and pressing for an answer will finally make those gentlemen weary and compel them to come to a decision on the matter. It grieves us very much to see from the first the persistence of the lack of money, and even more that the credit of the Honourable Company, on account of our small request for an amount of one thousand rupees to settle our expenses, has been exposed to the refusal of so wealthy a shroff as Niloo Seal. We are assured that it is unnecessary to give Your Honours any idea of how severely the lack of money makes itself felt here locally and throughout the whole country as well. Nevertheless, in accordance with Your Honours' authorization, we shall do our best to negotiate here at interest what we require and, if possible, some more money to reinforce the Chinsurah treasury. But we cannot indeed wonder enough at the conduct of the aforesaid Niloo Seal as well as generally, namely to leave the Company in such great embarrassment that Your Honours do not know how to cover the necessary expenditure of wages and subsistence allowance for the common men. 374 From this offensive conduct it is all too clear to gauge how far the affection of the native extends, and what reliance can be placed on his assistance when a crisis arises. How much such a people ought to be patronized, and, as Your Honors remark in your second letter, ought not to be disadvantaged or prevented in the conduct of an unhindered trade through the use of English rowannahs instead of the Company's dustucks, can be better judged than described. The only liberty we take to remark upon Your Honors' resolution is that our opinion regarding the dustucks applies only to those whom we believe cannot or may not proceed according to their own discretion in carrying on their private trade, but must submit to the same fate as those who rule over them, and whose privileges they eagerly invoke for assistance when they claim to be entitled to assert them. Yet now, because the Company attempts to prevent them in this, they make use of illicit dealings with foreigners, casting aside all loyalty and duty to the Honorable Company. The Company, seeking to uphold its authority, cannot tolerate its subordinates acting to the contrary by availing themselves of the authority of foreigners in contempt of its own, declining our dustucks and preferring English toll clearances, as it were to facilitate an illicit trade conducted in that manner. a principal cause of the delay that has occurred in making our reply to your several applications, for it was our sincere desire to make the most accurate arrangements to prevent all future hindrances in the conduct of your trade in Bengal; and this has been a principal cause why our answer to your various representations has been delayed for so long. We are particularly pleased to bring this delay to an end at present by informing you of our sentiments and resolutions on the questions which you have laid before us. These resolutions may possibly not in every respect correspond to your wishes, but they are as accommodating and conclusive as our power permits. We observe that many of your demands are not of recent origin, but have been preferred from time to time over a course of several years prior to the commencement of the late war. We find that notice thereof has been given to our superiors in Europe, and that they have not been followed by such definitive orders as could serve as a guide to this government in its determination upon them. But we hope to be excused if we take occasion to remark that we little expected a revival of old demands at this period, after the conclusion of an agreement in 1780 between the late Director at Chinsurah and the late Governor General of Bengal, established by the acquiescence of your Director and Council, as expressed in their letter to the Governor General and Council bearing date the 21st April of that year, and stipulating in the 6th article thereof that the Dutch Government should not renew any of their former claims, but that the accommodation then settled should be final and conclusive.

We understand very well that the war that has taken place between our nations in the period between the date of this adjustment and the present time may be brought forward as a compelling reason to invalidate the obligation to which your Director and Council then agreed; but we presume to think that an engagement declared to be final and conclusive, and interrupted by some temporary cause through no fault of the parties, immediately resumes or ought to resume its validity as soon as that cause is removed, when the parties also are, or ought to be, as strongly bound by it as ever; and we furthermore request permission to observe that in the late definitive peace treaty no stipulation appears which could with any possibility be construed to mean that the same gave right either to new extraordinary claims or to the destruction of agreements made prior to the war. And at what period of the native government of this country, before our influence upon the same was established, did both your and our Company not encounter impediments and misfortunes in their commerce? When we inform Your Honors, as we may properly do, that we regard the trade of your Company to be an advantage to these provinces, we give you a strong security that we will provide all equitable help which our influence can afford to your commerce and its freedom. We trust, however, that your nation will never be so unreasonable as to demand privileges which, although they can easily be committed to paper, cannot be so easily exercised in the execution of affairs. The Government Duty which is now levied on the goods you import and export is as it was before the War, and indeed as it has been from time immemorial, 2½ per cent, and is payable at any of the Custom Houses within the Provinces. The facilities for your commerce are now greater than they ever were, since several impediments and exactions which formerly hindered it now no longer take place. And this brings up, lastly, a question of the greatest importance, which has already been repeatedly stated in our records and represented to our Superiors in Europe long before the late War; yet in the late Treaty of Peace no explanation of your demand is given, nor are any arrangements made on that subject, and we have received no orders from the East India Company to abolish the established duties. To the Zemindars, who formerly demanded duty at their guard stations on all merchandise passing thereby, an income of about Nine lacs of rupees is now remitted. Enclosed herein we send for your information and guidance a copy of the regulations made for the Burbunder, or the Native Custom House. We trust that you will find them so clear that no dispute ought to arise concerning them, and so free from any substantial objection that every source of difficulty or embarrassment will thereby be cleared away. These regulations are general and exactly the same as those by which the French and Danish settlements will have to govern themselves, as well as the trade of our own Company, which must also conform thereto.
