583 the Treaty which provides for the restoration of your establishments in this country It is in the exercise of these rights of Government that the States General of the United Provinces have considered our Employers in those articles of the Treaty which provides for the restoration of your establishments in this country, permitted to trade with the native distilleries of these provinces. We thank you for your attention in giving notice of your application to the Nabob for leave to treat with us on the subjects of your several requests; we imagine, however, that the rights and powers of the East India Company as Dewan of these provinces had been sufficiently known and generally understood, and that it had been unnecessary to inform you that, as representatives of that Dewan of these provinces, we possess all parts of the right of government which that character includes. It is in the exercise of these rights of government that the States General of the United Provinces, our Lords and Masters, have We have now the honor to reply to your second memorandum. In regard to your claim to a free and uninterrupted trade, particularly in the articles of opium and saltpetre, we must observe that we have found it impossible to realize those articles of commerce for our own Company but by a system of monopoly. Your Company will have its just share in these monopolies. We heartily wish that the trade could be carried on according to the system and free principles of the English Government, but it was never conducted upon the footing of an open and free trade, and we are apprehensive that it never can be, for such are the dispositions and habits of the natives, and such is the nature of the advances that must be made to promote it. 384 can take place; for such being the inclinations and customs of the natives, and such being the nature of the advances which must be made to carry on the trade and to regulate both the quality and the collection of the manufactures. A free trade in Opium in these provinces and a free sale of it in the Eastern Islands would tend much to the advantage of the country producing that article, for its value would rise in proportion to the extension of its sale, and the revenues of the districts producing the Opium would increase in proportion to that heightened value. The Opium of this country was always managed by the Native Government as a monopoly, and we have before us the evidence of a person who for more than sixty years held a considerable office at the Baxbander, and who now still holds office, that the Opium and Saltpetre were purchased by the foreign Companies as best they could, and on the same footing as private merchants, from the persons who enjoyed the exclusive privilege of these monopolies. But even supposing that this testimony differed from the actual state of the fact, it seems to have been admitted by your honors that it has been the usage for several years to purchase the Opium and Saltpetre from the English Company. We have had the pleasure of assisting your honors' convenience so far as to allow your honors for the present year a quantity equal to seven hundred chests, and on the grounds of that same motive we have now agreed to allow you the usual quantity of Saltpetre for the present year, viz. 23000 Maunds.

from our respective settlements that might take refuge in them, to allow the usual quantity of saltpetre for this year, being 23,000 maunds, to be forwarded to you. We have considered, Gentlemen, the communication which you have made to us of your readiness to enter into a provisional convention with us which shall promote the ease and convenience of our respective affairs, and we should be happy to receive any proposition that might be offered to us on that subject; but we are apprehensive that you may wish to delay any arrangement of this nature, as we have lately received a letter from the Director and Council at Chinsurah desiring to postpone their answer to a proposition from us for an agreement with them until they should have received certain expected orders from the Supreme Government at Batavia. The agreement we allude to was for the mutual surrender of deserters who might desert to our respective colonies. The complaints which were preferred to the Governor General by the Director and Council at Chinsurah, and mentioned in your second memorandum respecting the hindrance that was suffered by the gomastahs of the Dutch Company in the Malda district, having been transmitted to the Commercial Resident at that place, he has observed in answer to it that no such publications as those mentioned by your gomastahs had been ever made, either by himself, his assistant, or any person under him, and that he only published anew the standing orders of Government passed in 1775 and 1782 against an illicit trade with our Company's weavers. The orders of 1775 direct that weavers who had executed engagements to the Company and received the Company's advances shall deliver their cloths accordingly; that any weaver failing to deliver cloths according to the stated periods agreed upon, the Company's agents shall have liberty to place peons on them; and that if any weaver in the Company's service shall be convicted of selling cloths to private merchants while he is deficient in his deliveries according to the stated periods of his agreement with the Company, such offender shall be punished after regular process and conviction in the judicial court. The orders of 1782 direct that as a practice had prevailed in some parts of the country of selling cloths clandestinely to individuals which had been provided for by the Company's advances, the purchasers of the said cloths, apparently knowing them to be the property of the Company by the secret and clandestine manner which they take to procure them, or by the notoriety of the weavers who offer to dispose of them being in the Company's employ, shall, on proof of the fact, be liable to punishment by the Adalat according to the nature of the offence, and the cloths so purchased shall be confiscated.

that the linens which are thus purchased shall be confiscated. These orders are nevertheless declared to be understood that the Government excepted from them the buyers of all linens which were purposely manufactured for them on the basis of previous agreements and for which the advances had previously been made to the weavers, likewise all purchases which are made openly and fairly at the public places and bazaars. These regulations were affixed to the gates of the subordinate factories as the regulations of the Government. We are of the opinion that the Dutch gomastas could not be ignorant of the authority from which they originated, and if they nevertheless wished to complain, they ought to have sent a copy of those regulations to Chinsurah. Whatever the case may be, we think that they ought to have represented the matter to Mr. Grant, who informs us that this did not happen. Mr. Grant assures us that he had no other intention than to make the above-mentioned regulations serve as the rule for his orders, and he has every reason to think that they have not been exceeded in this case, not even by his gomastas, and much less by his assistant, who was not in the aurangs when the publication ascribed to him was said to have been made. And as Mr. Grant has neither attempted nor desired to impose any prohibition, it is very evident that if he had done so, this would have been in vain, seeing that he had no authority over weavers outside the Company's employ, and that he had nothing to expect but resistance and complaints. We remain assured that the account which we have stated here of what has passed will not be contradicted by the Dutch gomastas; but if this should happen, the point in issue must by its nature be of great notoriety, and Mr. Grant will be very well pleased that any of the gentlemen stationed in the division of the country in which he resides should be desired to inquire into the matter. The prevention of clandestine trade was the main object of the public regulations quoted above, and it is agreeable to general equity that whoever engages a weaver not under any previous contract and gives him money to work should receive the first cloth produced by that money. In order to be certain of this, it has sometimes happened that the Company's stamp was placed upon linens which are still in the loom, which, as stated in your complaints, might be understood to indicate a forcible monopoly of all that the private stock and labor of an unengaged weaver can produce; whereas it is nothing other than distinguishing those linens which, on account of advances received, the weaver has put into the loom and to the delivery of which he has bound himself. With respect to the above-mentioned regulations, they extend equally to foreign companies and to private individuals; and it is proper to remark here that the regulations of 1775 resulted [illegible]

of 1775 may be indebted to complaints which were then made by the Director and Council at Chinsurah, concerning impediments to their trade in the Dacca District, and that the contractors must bear the risk of the balances; it clearly appears to us that it is a matter of the greatest importance to them that they purchase linens which are already prepared, and it is in some measure necessary for them to do so; they also arrive there at an opportune time, in the middle of the season, when the advances of our factories are dispersed throughout the entire country. In this case they will certainly reap a part of the fruits of these advances, unless preventive measures are put into effect which prevent the same. To punish the weavers after the evil is done would only serve to increase their inconvenience. We are entirely assured that the gentlemen who act for the Dutch Company do not undertake illicit trade, but we leave it to Your Honour yourself to judge whether that same pure dealing can be expected from natives, whose conduct in remote places, free from restraint, is very often regulated by their own principles. We now have the honor to communicate to Your Honors our sentiments on Your Honors' third Memorial dated the 19th of August. This Memorial sets forth that, to obviate the difficulties and unpleasantnesses caused by the double ownership of the grounds situated within the limits of Chinsurah, part whereof belongs to the Dutch Company and another part is Moorish ground or native property, Your Honors are pleased to request a complete surrender of the latter, and in general a wider extent of the jurisdiction of the Dutch Company at Chinsurah than it at present holds, assuring us that such ground rents, duties, etc. as may be reasonable shall be paid to the government of the country for this increased possession. We are not perfectly informed of the rights of property upon which these natives have established themselves within the limits of Chinsurah, and, desirous as we are to promote the convenience of your settlement, we yet wish to refrain from doing anything to which we cannot give a legal as well as an equitable sanction. In whatever degree of power Your Honors may estimate the influence of our Government in this country, we have never attempted to alter the tenures or invalidate the rights of property which the natives possess in the soil. The criminal jurisdiction beyond the limits of Calcutta is exercised by the Nawab and his deputies, and civil process among the natives is determined in the Country Courts. The fourth and last memorial with which your Honors have honored us relates to the damage which the Netherlands Company and individuals have sustained from the capture of the sloop Constantia and the pantchiallang Het Geduld by Captain Robert Geddes, commanding the ship Nonsuch, on the 26th of June 1783, twelve days after the time fixed by the preliminary articles of peace between our respective nations for the cessation of hostilities in India. Your Honors inform us that the amount recovered from Captain Geddes is less than the actual cost of these vessels and their cargoes. Your Honors request a reimbursement of this sum and of the amount paid for a vessel which was purchased from the King of Trengganu to transport the prisoners of war who had been put ashore in his dominions (we suppose by the Nonsuch), which vessel was lost on the voyage to Malacca. Your Honors recommend to us the claims of individuals who may have suffered from this capture and propose the granting of a further compensation, not only to make good the losses which the parties have sustained, but also to compensate them for the loss of profit which was caused by their having been taken. We have the honor to transmit to your Honors herewith copies of papers left with us by Captain Geddes before his departure for England. The amount thereof will be given up according to the invoice, but shall be deducted at the time of payment from the sum on which 2½ per cent is to be paid according to the Company privileges and actual agreement. Number 6. Merchandises or goods for use or consumption, being sent on account of the Company to Cossimbuzar or Patna or to some other place, are to meet everywhere with a free passage; they shall not be subject to any further duties and shall want no other passports but the Dustuk of the Director, in the manner as will be stipulated hereafter concerning the Dustuks themselves. Number 3. The Netherlands Company shall, in conformity with her Farmans and established custom, pay no duties on merchandises imported, until they are exported from Chinsura, either by the Company or by individuals who bought the same. No duty can be demanded on goods remaining unsold or to be sent back again. Concerning the arrack, an acknowledgment of 12 rupees per leaguer will be paid to the government. The merchandises and other goods serving for consumption and use, which are dispatched on the Company's behalf to Kasimbazar, Patna, or elsewhere, shall pass everywhere freely and exempt, without being detained anywhere, or troubled along the way or at the destined places for any duty or other charges, and without any other passports than the Dustuk of the Director, in the manner as will be stipulated hereafter. Number 4. Also, the Netherlands Company needs pay no duty on goods that are spoiled along the way by leakage, drying out, or otherwise lessened in quality, quantity, or weight; of which the value shall be stated on a specific list, and at the payment of the duty, shall be deducted from the general sum. Number 5. Regarding imported merchandises, the Netherlands Company shall, according to her Farmans and ancient usage, pay no duty other than on goods that are exported from Chinsura, whether for her own account or by the person who buys them from her or wishes to dispatch them; and regarding such goods as might be returned unsold, she shall owe no duty for them; as it is also now agreed to pay twelve rupees per leaguer on arrack as an acknowledgment to the government. The goods from the Province of Behaar delivered at Patna, having their duties paid before their exportation from Patna and of which until now, without notice having been taken thereof, a rowannah was granted under the seal of the Dewani, shall henceforth, upon request as in former days, be dispatched upon a rowannah from the Naib soubah or governor at Patna, upon the presentation of which to the Bagsbender at Hoeglij no duty shall be demanded for a second time. Aurung dispatches or goods from Kassembuzar intended for dispatch to the factory at Sinsura shall, according to ancient custom, proceed freely and unhindered under the Dustuk or passport of the Director or the Chief of Kalkopoer; and the Director, as soon as the goods are en route and approach the Bagsbender or Bachsbender, whether by water or by land, shall give notice thereof to the Fausdaar at Hoeglij by a memorandum upon which the parcel or parcels intended to be imported shall be distinctly stated, in order to obtain the necessary license for the passage thereof, both to the factory and subsequently on board the Company's ships, without requiring any other passes for their transit and landing than a Dustuk from the Director, drawn up in the manner as shall hereafter be stipulated regarding Dustuks in general, and without requiring anything else for shipment from the Company's warehouses than passes issued and signed by the Head Administrator. The Talica of the duty due to the Bachsbender shall be drawn up in good faith, and in proof thereof signed and sealed by the Director and Head Administrator, and written in the Dutch and usual native languages; and it shall also be signed by the Trade Bookkeeper, in attestation that it agrees with the Company's books. The payment of duty on the goods received at Sintsura by the Company's ships shall be made on the last day of December or at the latest on the last day of January, and that of the inland returns annually on the last day of April. A distinct entry book shall be kept of the payment of duty upon the respective Talikas, and upon the final payment of duty on the last day of April an annual account current with the officers of the Bachsbender or the Fausdaar shall be drawn up in duplicate in Dutch and Persian, signed and sealed by the Director and Head Administrator on the one part, and the Fausdaar on the other part, and exchanged against each other and preserved in the respective offices. As the duty owed to the Fausdaar is paid successively, he shall grant a receipt or discharge on each occasion, and annually, for the total amount of the duty, a general rowannah or receipt under the seal of himself and the respective officers of the Bachsbender shall be granted in exchange for the separate receipts, and against the return of the respective Talikas of a full year, in order that they may be cancelled. The payment of the Company's duty being made from the Company's treasury to the person whom the Fausdaar sends for that purpose and authorizes by a letter to the Director, this envoy shall, for the amount he receives, sign the written order for payment from the treasury to the discharge of the Cashier, in the presence of the Company's broker and vakeel. 407 They shall pay no higher duty thereon than that paid by the Company, and in the first place the officers of the Company's ships, they shall in good faith deliver a list to the Director of the private merchandises allowed to them in the respective ships. Article 15. Regarding private goods in general which are found to be liable for the payment of duty to the Buxbunder, they shall not be required to pay any higher or greater duty than the Company owes for its merchandise, and any excess or surplus shall be settled according to the exigency of matters and a moderate and equitable valuation. The owners of private goods which are to pay duty are to deliver a written list thereof, certified by the Fiscal as the collector of the Lord's dues, to the Director, who will afterwards deliver a Talika thereof to the Faujdar of Hooghly, signed and sealed by him and the Senior Administrator, and written in the same manner as has been stipulated concerning the Company's Talikas in Article 9. Article 16. No inhabitants of Chinsurah, either servants of the Company or others who are subject to them, shall import or export any goods into or out of the place without prior payment of duty, it being understood this applies to merchandise and not to provisions or articles for consumption, which are as little comprehended thereunder as such merchandise which they can prove to have been bought from the Company and paid for to it, which therefore, as upon first importation, shall be held to be duty-free. Article 17. Payment of the private duty shall be made by the Director to the Faujdar every six months or once a year, as may best suit, and a similar account thereof will be made and exchanged annually on the last of April, as is mentioned concerning the Company's duties in Article 11, with this addition that the accounts of the private duty shall likewise be signed by the Fiscal. Article 18. In exchange for the Talikas for the payment of the private duty, the Faujdar and his officers are to grant a separate Rowannah, signed and sealed in the same manner as has been agreed upon and stipulated for the Company under Article 12 of this regulation. 408 Article 19. The Rowannahs will be drawn up in the same form as is done by the heads of the respective English residencies and the Board of Trade at Calcutta, after the model which is delivered upon request to the committee members of the Council at Chinsurah. Article 20. As to the Dustucks, it has been stipulated that they shall be granted by the Director for the goods of the Company, signed by the Director with his ordinary signature, the Persian and the Company's seals; and for individuals, with the omission of the latter and the addition of his own private seal, either printed in ink or in wax. Article 21. No private goods will be sent down to the Company's ships except those on which duty has been paid upon importation at Chinsurah, for which the Senior Administrator and Fiscal are in good faith to attest by their signatures when shipped to the vessels. Article 22. Signed by the Fiscal likewise. Article 23. Foujdar to prevent any untolled goods from being imported or exported, the solemn assurances and written declaration of the first principal ministers in Chinsurah will serve as a guarantee, and in order to prevent all difficulties and unpleasant disputes, credit will be given to the word of honor of the aforementioned ministers and the aforesaid guard duty will be omitted, so that no extravagant procedures will be resorted to or entered upon, except in the case of the most manifest conviction that smuggling is taking place or that actions contrary to this are being committed. On the other hand, we regret to learn that the length of our submitted Memorials has detained Your Excellency so long, and that we have thereby perhaps disturbed your attention in affairs which are considered by you to be of greater weight than the chain of complaints by the Netherlanders settled in this country and the accompanying urge for redress. But, Most Honourable Gentlemen, however much on the one hand we ask forgiveness for our prolixity, we on the other hand console ourselves with Your Excellency's favorable acknowledgment regarding the seriousness of the subjects and that the matters treated undeniably require clarity and emphasis. How happy we would be if our simple language could touch the hearts of Your Excellency and bend them to a conviction that justice is on our side. Yet this requires more than the setting aside of self-interest, and certainly one must be an accomplished orator so to manage that in the judgment of what is pleaded, the balance tips to the right side. Your Excellency yourselves meet us not a little in this opinion, by acknowledging and believing on the first page of the aforesaid Answer that your decisions reached upon our representations might in all respects not be of such a nature as to answer entirely to our expectations. The objection as if several of our claims were already of old date, having indeed already been proposed before the War and even submitted to the decision of the mutual Principals, does not, under favorable correction, invalidate the right to revive the same and to insist thereon until it appears who is right or wrong. And as to what Your Excellency are further pleased to remark, that a resumption of those demands was the less to be expected on account of a certain convention concluded by the former Director Mr. Ross in April 1780 with His Excellency the recently retired Governor General Mr. Hastings, and ratified on the 22nd of that month by the Council at Sinsura; against this there arises on our part more than one objection. Unable to say why the Definitive Peace Treaty determines nothing that might give cause for new or extraordinary demands, we nevertheless believe that our duty requires us never to lose sight of the rights of the Company and to champion them as often as anyone inflicts, or attempts to inflict, any inconvenience or injustice upon it. 4. Although Your Excellencies now show yourselves inclined to regard our demands and petitions as new, and to take them into consideration as such, there nevertheless strongly shines through, in more than one place in the reply and particularly at the beginning in the introduction, what is in our view an entirely unfavorable perspective on matters, not only by virtually everywhere rejecting the proposals, but, what seems incomprehensible, so to speak declining the force and value of the Company's privileges, disputing with us any infringement upon them, and attempting to explain all the unlawful proceedings of which we complain as difficulties inherent in commerce, or as local and provincial customs, which everywhere caused hindrance to trade and were experienced here in this country, during the period when the authority of the Moorish Government predominated, repeatedly by both the English and Dutch Companies. But to make general applications and remarks from general arguments; may Your Excellency and Your Honors please dwell with us for a moment on that period of the Moorish Government. Then the nations established here were happy and prosperous in their trade. It is true that among the Regents or their officials there have been such persons as did not fail to inflict upon one or the other in particular, or even both at once, some grief, nuisance, or violence in the most unjust manner; but besides the fact that in the first case, we especially, generally experienced that such outrages were caused to us by malicious insinuations and instigations of others, and in the latter case, the misfortunes were general and seldom owed their origin to commerce, but to the greed for money which delayed the progress of trade until the hunger for money was satiated, one nation then had nothing to reproach the other for. Neither of them was, as at present, Judge and Party at the same time. They might lay mercantile snares for each other, but those made the industry of each all the more active. The trading places were open to everyone and never did it occur to anyone, as at present, that without a monopoly no manufactures could be procured. Are not the manufactures what must make the Country flourish, and are not these implements of trade, so to speak, the sole sources of the significant revenues? The most temperate and well-known writers of Your Nation place the commerce of these provinces in a completely different light. The national institutions of the native of Hindostan, and not those of the Europeans of later times, caused this mighty Empire to flourish, so that, as one of those authors remarks, the laws of Hindostan are wisely established as barriers against oppressions, and were of real force until the invasion of Nadersjah. The manufactures, commerce, and agriculture flourished uncommonly, and no one felt the hand of oppression except those who constantly worried about their fortunes or wealth, for until these very few years merchants were never better protected, nor did they find it easier anywhere than under this Government. There is no part of the world where art and agriculture have been more cultivated, regarding which the strong influx and variety of manufactures and a multitude of wealthy merchants were sufficient witnesses. Hindostan is in several places greatly favored by Nature with commercial advantages, and Bengale deserves consideration above all others. That Subah of the Empire, which was emphatically called the Paradise of Nations by the Emperor Aerreng zeeb, produced without effort, in the greatest abundance, everything necessary for the sustenance and convenience of mankind. The encouragement of foreign and domestic commerce was all the more necessary for Bengalen, which, containing no Gold, silver, or Diamond mines, relied solely and exclusively on its manufactures for that great balance of trade in its favor, which alone enabled it to pay a considerable tribute to the court of Dillij. It was there, as Mr. Scrafton expresses it, that, until recent years, an untraceable number of merchants, from all parts of Asia in general as well as from the rest of Hindostan in particular, sometimes in bodies of several thousands at the same time, were employed annually to travel to Bengalen with little else than ready money or bills of exchange for the purchase of the products of this Province. The causes and effects of the execution of such a commission can be found described in more than one English author, and we would lapse into too great a prolixity if we wished to follow those writers therein step by step. 45. Let us, however, linger for a moment longer with a short comparison of the security of the former with the present form of government of Bengalen and what is included under it. Even if it happened that in the first period commerce was exposed to obstacles and difficulties, it nevertheless had so much progress and success for everyone that, a few years before the revolution, sufficient cargoes for more than eight ships were procured at first hand.

could provide when purchased. Indeed, there have been years that the Dutch Company dispatched thirteen well-laden ships in a single season from the Ganges. How unfortunately has the leaf turned since then. The blow of the year 1755 will never fade from the memory of anyone who knows how things were conducted previously and what has been the case after that unhappy period of time. It would be a stark and vivid picture to touch upon all the events or to point to them with one's finger. The experience that the Dutch Company has had thereof, and that which successively has been its unhappy fate here in the country through a surprising revolution in the system of government, has provided too frequent matter of complaint to weary the attention with it anew. The correspondence of 1775 and 1776 between this Government and the Directorate of Chinsura provides more than one instance to demonstrate the difficulties with which the Dutch Company had to contend then and, as it appears, must face anew at present. The complaints have been repeated many times and the promises of redress are strong enough in their expressions, but we have never been permitted to perceive the agreeable consequences. If one now adds thereto that in the days of the Moorish Government the Dutch Company, even though they felt here and there in the course of their trade some oppressions and extortions, even though they obtained no justice regarding this to their satisfaction, nevertheless was always safe and secure in the Hindostan Empire regarding its possessions. That however the war might rage in Europe, it never spread its flames to the establishments of the Dutch Company in these regions; that the Government was its guarantee and its security, and that before the year 1757 no one dared to entertain the thought of actually or violently attacking one another in the Ganges, which was safe and neutral. That we, in the meantime, in the year 1781 had to suffer the fate of war in Hindostan as well; that at Surat and in Bengal as well as elsewhere our factories were overwhelmed and immense damages were thereby inflicted upon the Company, even by those who ought to have checked it, namely the English East India Company representing the Dewani. If, we say, all this is considered with that attention and impartiality as is proper, then we believe we have no mistaken understanding of affairs if we deduce and conclude from all this that the days when the Hindostan Empire was governed by its own legitimate rulers were happier, safer, and more secure for the Dutch Company than the present, however much Your Excellencies may please to promise us that safety and security which your influence on the form of government can afford us, it being of no importance if those promises are not, better than until now, effectively followed through, and the Dutch Company be permitted that freedom which on the one hand is due to it by virtue of its privileges, and on the other hand it ought to have in common with that of the English East India Company in so far as concerns its trade, regarding which the latter ought not to usurp any privilege above the former without infringing upon the freedom of trade in general and upon the effective right of the Dutch Company in particular, as we shall take the liberty to demonstrate further in the proper place. We now proceed, with Your Excellencies' leave, to the particulars. The first of these concerns our address with respect to the payment of tolls and the respecting of the dustucks which, according to the right of our Firmans, are granted by the Director and the chiefs of our respective factories. We will not and may not deny that, after the withdrawal of an unusually swollen number of shore-guards or chowkies along the bank of the river, the passage up and down for vessels is much easier than in former days, and one thus suffers no obstacle of costly delay, just as expenses must be incurred for the maintenance of peace and security. But apart from the fact that this in itself is the effect of a good, regular administration, it may on the other hand be observed to be founded on those political laws of the Hindostan Empire of which we have made mention here before, and everything in accordance with the nature and spirit of our privileges, which very expressly dictate that after payment of the toll at the places destined thereto, we shall not or may not be subject to any vexations or taxes whatsoever. And as for the expenses serving that purpose which the English Company must incur, these naturally flow from the advantages which yield it, outside of trade, immense treasures every year. But to step away from this and come to the matters themselves: Your Excellencies are pleased to present to us as if we had not been clear enough in our first address in arguing our right to a free trade, and as if we ought to have given a more precise description thereof and not refer generally to Firmans and Sanads which were not in the possession of Your Excellencies. 418 of the letter dated 10 June of the aforementioned year and the register attached thereto is proven, we have nevertheless, in order to give even more force to our representation, the honour under numbers 2 and 7 to attach hereto a copy of the firman, granted on 13 August 1712 by Emperor Jehaandar Sjak, and of the sanad granted in August 1766 by the then Nawab to the Dutch Company. We make use of these documents because, as regards the former, we have stated in our first address regarding commerce and the freedom to conduct the same that it is of no less extent than the privilege granted in the year 1716 to the English Company, and because, as regards the sanad, this originates from the Nawab who governed one year after the Noble English Company obtained the title of Diwan Khalisa Sharifa, and that from this has resulted the question which we cannot recall having been asked otherwise than on this occasion, namely with whom the supreme power in the administration of these Provinces resides, whether we must still regard the Nawab in that same light as in the year 1766, and whether we would not consequently sin against the supreme power if we accounted for and paid the customs duties otherwise than with his consent and concurrence. This does not imply an opinion as if, regarding the payment of duties, any arrangements were made at the conclusion of the latest peace, as if we were of the opinion that the established customs duty ought to be abolished. On the contrary, the Dutch are as much attached as anyone to the well-known law: render unto Caesar the things which are Caesar's. But, because without any prior negotiation, the custom that had crept in during the war regarding the accounting of customs duties, the granting of rowanahs, and the, so to speak, tacit annulment of our right to grant dastaks seemed to be maintained, and because according to common rumours the customs duty was to be levied arbitrarily and demanded more on one article than on another, whereas our nation and all those belonging under her are accustomed to pay no more than the established 2.5 per cent, that, and leaving unanswered our preliminary declarations and protests that we cannot submit to any novelties or infringement of our privileges, gave occasion to demonstrate the necessity to clear away all difficulties in that regard now, as the Company was about to recommence its trade anew, and to arrange it with each other in such a manner that we could be calm and certain, for the present and the future, of doing nothing in the acknowledgement of the country's sovereign power—under which the payment of customs duty is indeed specially included—that could sooner or later be imputed to us as a reproach of having exceeded our duty in that regard. 419 18. The regulation which Your Excellencies have done us the honour to enclose with your respected reply, we have, in accordance with our bounden duty, shown to our constituents. They are of the same opinion as us that, in order to attain the objective, nothing else seems necessary in this regard than to be allowed to expect some distinction above others for the Dutch Company; that it be regarded as a privileged trading body not to be equated with any private merchant, nor with the present constitution of the other foreign nations established here, the French and Danes, whose companies, to whom their privileges were originally granted, no longer exist, and who therefore indeed appear in a national and territorial aspect, but not in that aspect with regard to commerce as the Dutch Company, which until now maintains its trade with the Indies and consequently has not renounced any part of its privileges of whatever name; whereas the others, who have opened the navigation and trade to the Indies to their private individuals, cannot claim any privilege or equality of status with the Dutch Company regarding the payment of customs duties; since the privileges to which those nations might appeal were granted to companies that indeed once existed but are no longer in being, and could never be compared to the Dutch Company. The Dutch Company is a completely different, respectable body and a power in itself, so to speak. It is therefore also that, just as it shows respect to others and observes good faith, it may also expect to be dealt with in the same manner. And it is therefore that we are charged and authorised to offer Your Excellencies the draft of a regulation for the accounting and payment of customs duties, both for the Company and others subordinate to it, likewise the granting of dastaks for goods that have already been cleared through customs, or which, being transported from the country to our factories, shall be properly declared to the Bakhshbandar before approaching the same. In framing that regulation, close regard was paid to the general content of the regulations handed to us, as well as to that which, in accordance with our privileges, has always been the custom. In this regard, not only will the content of the firman and sanad cited here under numbers 2 and 3 decide the matter, but anyone who has been in Bengal for a period of thirty years can bear witness to it. We refer at the same time to that which Your Excellencies may be pleased to observe from the certificate under number 4 annexed hereto of a Sheikh Ahmed, who has served our Company at least since the year 1750 and so
